The survival of the personal copy of Commentary on the Mishnah by Maimonides, which he revised throughout his life, provides an unparalleled window into the ways he continually reconsidered legal and conceptual questions. This manuscript covers five of the six orders of the Mishnah and contains countless corrections and emendations, the vast majority in the author’s own hand. This article argues that Maimonides’s intense interest in solving problems related to the enumeration of the commandments, which he addresses at length in (...) Book of the Commandments and, to a lesser extent, Mishneh Torah, led him to make a number of emendations to his Commentary and to rethink other aspects of his work. That is, when writing Book of the Commandments and Mishneh Torah in the decade after completing his Commentary, Maimonides tackled, and sometimes even concocted, questions that he had no reason to consider in the latter work. This study traces two ways that Maimonides’s later works diverge from his earlier ones, in the meaning of Hebrew and Arabic technical terms and in increased attention to scripture in determing Jewish law, revealing a great medieval mind “in perpetual motion.”. Accounting for the Commandments in Medieval Judaism explores the discursive formation of the commandments as a generative matrix of Jewish thought and life in the posttalmudic period. Each study sheds light on how medieval Jews crafted the commandments out of theretofore underdetermined material. By systematizing, representing, or interrogating the amorphous category of commandment, medieval Jewish authors across both the Islamic and Christian spheres of influence sought to explain, justify, and characterize Israel's legal system, divine revelation, the cosmos, and even the (...) divine order. This volume correlates bodies of knowledge-such as jurisprudence, philosophy, ethics, pietism, and kabbalah-that are normally treated in isolation into a single conversation about a shared constitutional concern. This paper discusses the legal implications of setting up two new biobanks in Belgium. The first is hospital-based and will archive tissue from patients with haematologic cancer, whereas the second is linked to a general practice based morbidity registry and will involve storage of blood samples. To date, Belgium has no specific legislation that regulates storage of human tissue and related databases. Several issues concerning the protection of individuals with regard to the processing of personal medical data are discussed from (...) the existing privacy legislation. We will address the principle of consent (broad versus specific) and the type of data recorded (anonymous, encoded and identifiable) for both biobanks. (shrink)

In this article, the morality in the “wickedness” of design problems as wicked problems is explored. I will use for that purpose the characteristics of wicked problems as identified by Horst Rittel and Melvin Webber. These characteristics suggest interdisciplinary thinking for solving such problems. An awareness of the wicked nature of design problems can stimulate proper use of the concept of utopias for solving these problems. I will use the philosophy of Herman Dooyeweerd to provide a framework for understanding (...) the nature of design problems as wicked problems. (shrink)

Herman Cappelen investigates how language and other representational devices can go wrong, and how to fix them. We use language to understand and talk about the world, but what if our language has deficiencies that prevent it from playing that role? How can we revise our concepts, and what are the limits on revision?

The beginning of the twenty-first century saw something of a comeback for relativism within analytical philosophy. Relativism and Monadic Truth has three main goals. First, we wished to clarify what we take to be the key moving parts in the intellectual machinations of self-described relativists. Secondly, we aimed to expose fundamental flaws in those argumentative strategies that drive the pro-relativist movement and precursors from which they draw inspiration. Thirdly, we hoped that our polemic would serve as an indirect defence of (...) a traditional and natural picture concerning truth. According to this picture, what we call ‘Simplicity’, the fundamental structure of semantic reality is best revealed by construing truth as a simple monadic property of propositions that serve as the objects of belief, assertion, meaning and agreement. Our project was not a straightforward one. So-called relativists are not uniform in their key ideology, are often sloppy, casual, obscure or confused in their self-characterization, and differ in their argumentative emphasis among themselves and over time, thereby presenting a target that is both amorphous and shifty. This is an area where parties will frequently claim not to understand each other and where certain parties will sometimes accuse others of failing to make any sense at all. One central purpose of Experimental Philosophy (hereafter, x-phi) is to criticize the alleged reliance on intuitions in contemporary philosophy. In my book Philosophy without Intuitions (hereafter, PWI), I argue that philosophers don’t rely on intuitions. If those arguments are good, experimental philosophy has been engaged in an attack on a strawman. The goal of this paper is to bolster the criticism of x-phi in the light of responses.

The question of whether biologists should continue to use the Linnaean hierarchy has been a hotly debated issue. Invented before the introduction of evolutionary theory, Linnaeus's system of classifying organisms is based on outdated theoretical assumptions, and is thought to be unable to provide accurate biological classifications. Marc Ereshefsky argues that biologists should abandon the Linnaean system and adopt an alternative that is more in line with evolutionary theory. He traces the evolution of the Linnaean hierarchy from its introduction (...) to the present. He illustrates how the continued use of this system hampers our ability to classify the organic world, and then goes on to make specific recommendations for a post-Linnaean method of classification. Accessible to a wide range of readers by providing introductory chapters to the philosophy of classification and the taxonomy of biology, the book will interest both scholars and students of biology and the philosophy of science. Barbara Herman argues for a radical shift in the way we perceive Kant's ethics. She convincingly reinterprets the key texts, at once allowing Kant to mean what he says while showing that what Kant says makes good moral sense. She urges us to abandon the tradition that describes Kantian ethics as a deontology, a moral system of rules of duty. She finds the central idea of Kantian ethics not in duty but in practical rationality as a norm of unconditioned (...) goodness. This paper began in the startled realization that little if anything is said in Kant’s ethics about the more violent forms of immoral action. There are discussions of lying, deception, self-neglect, nonbeneficence—but apart from suicide, a great silence about the darker actions. At the least, this should be an occasion for curiosity. Although the degree of concern with acts of violence in contemporary ethics may be in its own way curious, it does not seem unreasonable to expect a moral theory (...) to provide an account of what is wrong with acts of violence. Are trust relationships involving humans and artificial agents possible? This controversial question has become a hotly debated topic in the emerging field of machine ethics. Employing a model of trust advanced by Buechner and Tavani :39–51, 2011), I argue that the “short answer” to this question is yes. However, I also argue that a more complete and nuanced answer will require us to articulate the various levels of trust that are also possible in environments comprising both human agents and AAs. In defending this view, I show how James Moor’s model for distinguishing four levels of ethical agents in the context of machine ethics :18–21, 2006) can help us to develop a framework that differentiates four levels of trust. Via a series of hypothetical scenarios, I illustrate each level of trust involved in HA–AA relationships. Finally, I argue that these levels of trust reflect three key factors or variables: the level of autonomy of the individual AAs involved, the degree of risk/vulnerability on the part of the HAs who place their trust in the AAs, and the kind of interactions that occur between the HAs and AAs in the trust environments. This paper argues that some words are so highly charged with meaning by a community that they may prevent a discussion during which each participant is on an equal footing. These words are indeed either unanimously accepted or rejected. The presence of these adjectival groups pushes the antagonist to find rhetorical strategies to circumvent them. The main idea we want to develop is that some propositions are not easily debatable in context because of some specific value-bearing words, and one of (...) the goals of this paper is to build a methodological tool for finding and classifying these VBWs. Our study echoes the importance of “cultural keywords” in argument, but is rather based on a German approach developed by,, and about “Miranda” and “Anti-Miranda” words that is expanded and refined here. In particular, our study tries to understand why some statements, fueled by appreciative or evaluative adjectives, have such rhetorical effects on a pragmatic level in the particular context of a vote on the Swiss popular initiative called “for more affordable housing”. This context is fruitful since two parties offer reasons for two opposing policy claims: namely, to accept or to reject an initiative. When one party uses arguments containing such universally unassailable adjectival groups to defend a “yes” vote, the opposing party cannot use a symmetrical antonym while pleading for the “no” vote. The methodological tool that is proposed here could shed light on the use of certain rhetorical and referential strategies in conflicting policy proposition contexts. (shrink)

Ouija board sessions are illustrious examples of how subjective feelings of control – the Sense of Agency - can be manipulated in real life settings. We present findings from a field experiment at a paranormal conference, where Ouija enthusiasts were equipped with eye trackers while using the Ouija board. Our results show that participants have a significantly lower probability at visually predicting letters in a Ouija board session compared to a condition in which they are instructed to deliberately spell out (...) words with the Ouija board planchette. Our results also show that Ouija board believers report lower SoA compared to sceptic participants. These results support previous research which claim that low sense of agency is caused by a combination of retrospective inference and an inhibition of predictive processes. Our results show that users in Ouija board sessions become increasingly better at predicting letters as responses unfold over time, and that meaningful responses from the Ouija board can only be accounted for when considering interactions that goes on at the participant pair level. These results suggest that meaningful responses from the Ouija board may be an emergent property of interacting and predicting minds that increasingly impose structure on initially random events in Ouija sessions. In response to critical discussions of my book, Moral Literacy, by Stephen Engstrom, Sally Sedgwick and Andrews Reath, I offer a defence of Kant's formalism that is not only friendly to my claims for the moral theory's sensitivity to a wide range of moral phenomena and practices at the ground level, but also consistent with Kant's high rationalist ambitions.

This essay examines issues involving personal privacy and informed consent that arise at the intersection of information and communication technology and population genomics research. I begin by briefly examining the ethical, legal, and social implications program requirements that were established to guide researchers working on the Human Genome Project. Next I consider a case illustration involving deCODE Genetics, a privately owned genetics company in Iceland, which raises some ethical concerns that are not clearly addressed in the current ELSI guidelines. The (...) deCODE case also illustrates some ways in which an ICT technique known as data mining has both aided and posed special challenges for researchers working in the field of population genomics. On the one hand, data-mining tools have greatly assisted researchers in mapping the human genome and in identifying certain “disease genes” common in specific populations. On the other hand, this technology has significantly threatened the privacy of research subjects participating in population genomics studies, who may, unwittingly, contribute to the construction of new groups that put those subjects at risk for discrimination and stigmatization. In the final section of this paper I examine some ways in which the use of data mining in the context of population genomics research poses a critical challenge for the principle of informed consent, which traditionally has played a central role in protecting the privacy interests of research subjects participating in epidemiological studies. It is shown, in a large variety of manifestations, that the Aharonov—Bohm effect has classical counterparts in aspects concerning energy and momentum balance. No counterexamples are found in the cases considered, although whenever image charges shield the magnetic field region from the electric field of the passing electron the classical momentum effects, while present, would not be observable. Similarly, if the magnetic flux is maintained by superconductors, magnetic shielding will also render the classical energy effect unobservable. Partial shieldings of either (...) type will reduce but not totally eliminate the corresponding observable classical manifestations of these effects. (shrink)

Our delinquency, mylove, we are the worst criminals and the first victims. I would like not to kill anyone, and everything that I send you goes through meurtrières [murderesses; fortification openings for weapons]. As for the children, the last ones I might touch, the holocaust has already begun.We have never yet seen each other. Only written.[67–68]What exactly has Derrida archived here? Toward the back of the fascicle of cards Derrida will admit “that I will die without having understood anything” [247]. One wonders. Is this inevitable failure to understand constitutive of archive fever?Let’s start again. There is misunderstanding in the archive. It’s inevitable. And moreover, we have archives—we preserve archives—because there is something in them that defies understanding but that we want to grasp. In the archive that is Derrida’s fascicle of missives, the matter that defies understanding is as conspicuous as it is feverish. There is, for example, a rampant death wish that cannot decide whether to act or be acted upon, hence the wish not to kill and yet the wish to shoot something through the meurtrière. This, by way of verbal association, links up with the sending of something by way of a murderess. And then, the fragment of yet another fantasy, the holocaust of children and their being touched—by way of the murderesses? the malicious missives or orders that the subject has passed on to them? the kindness of the one who fantasizes and nostalgically holds on to them before the end? Obviously, one could speculate at length; indeed, we are supposed to speculate at length. Then the final scrap, “We have never yet seen each other. Only written.” Does this refer to the desk murderer and his accomplice? Or something more benign?Consider The Post Card to be the displaced main act of Archive Fever. As such The Post Card may well be Archive Fever’s phantom limb, something essential that has been cut off and that haunts the text. What sets Archive Fever apart, however, is that whereas the envois of The Post Card were, in essence, staged as a private correspondence inhospitable to onlookers, the Freud archives are being thought through from the [End Page 68] perspective of a public institution or apparatus that houses and is hospitable to that which it capitalizes upon, namely, the memory of something that would otherwise be lost. Still, as Derrida reminds us, perhaps with Archive Fever’s phantom limb in mind, archives occur at that moment when there is a structural breakdown in memory. This contrasts rather sharply with Michel Foucault’s view in The Archaeology of Knowledge that archives are, in essence, the textual systematization of their own enunciability and that, as such, they are predicated upon mnemonic reliability. Derrida’s archive, in contrast, is mnemonically unreliable insofar as it is somewhat feverish, hallucinatory, fragmentary, and, as in the case of The Post Card, somewhat sick (“as for the children... the holocaust has already begun”). In short, where there is regularity and efficiency in Foucault’s archive, there is trauma in Derrida’s.This trauma in the archive is what, I think, Derrida is referring to when he speaks of there being a mal d’archive. Our starting point is a somewhat obscure incident which has lately attracted some attention. The year is 429 B.C., and the place is Athens in the third year of the Peloponnesian war. The plague, which had broken out only a year before, was still claiming its victims. Yet military operations were in full swing, and the general Phormio operating in the Corinthian gulf against a Peloponnesian fleet was able to score an impressive victory. The Lacedaemonians were deeply dissatisfied. This was (...) the first sea-fight they had been engaged in, and they found it hard to believe that their fleet was so much inferior to that of the Athenians. They dispatched three advisers to Knemos, the admiral in charge, instructing them to make better preparations for another sea-fight. Additional ships were solicited from the allies, and those already at hand were prepared for battle. It is at this point that the incident in question occurred. Not to prejudge the issue, I quote the text in full leaving the controversial phrases untranslated: 4. And Phormio on his part sent messengers to Athens to give information of the enemy's preparations and to tell about the battle which they had won, urging them also to send to him speedily as many ships as possible, since there was always a prospect that a battle might be fought any day. 5. So they sent him twenty ships, but gave τ δ κυμξοντι special orders to sail first to Crete. Nικας γρ Kρς Γορτνιος πρξενος ν persuaded them to sail against Cydonia, a hostile town, promising to bring it over to the Athenians; but he was really asking them to intervene to gratify the people of Polichne, who are neighbours of the Cydonians. 6.
