This paper discusses the legal implications of setting up two new biobanks in Belgium. The first is hospital-based and will archive tissue from patients with haematologic cancer, whereas the second is linked to a general practice based morbidity registry and will involve storage of blood samples. To date, Belgium has no specific legislation that regulates storage of human tissue and related databases. Several issues concerning the protection of individuals with regard to the processing of personal medical data are discussed from (...) the existing privacy legislation. We will address the principle of consent (broad versus specific) and the type of data recorded (anonymous, encoded and identifiable) for both biobanks. (shrink)

Have advances in the disciplines of psychoanalysis, psychology or the social sciences in general ministered to our needs in these areas? In this forcefully argued collection of essays, Frank Cioffi examines Wittgenstein's reflections on the comparative claims of clarification and empirical enquiry. Though writing out of admiration and indebtedness, he expresses reservations as to the limits Wittgenstein places on the relevance and (...) desirability of empirical knowledge. His discusssions extend from Wittgenstein's reflections on human sacrifice and other ritual practices dealt with by Frazer to Freud's account of the sources of anxiety, depression, dreams and laughter. Contemporary liberalism and republicanism present clearly distinct programs for domestic politics, but the same cannot be said when it comes to global politics: the burgeoning literature on global republicanism has reproduced the divide between cosmopolitan and associational views familiar from long-standing debates among liberal egalitarians. Should republicans be cosmopolitans? Despite presence of a range of views in the literature, there is an emerging consensus that the best answer is no. This paper aims to resist the emerging consensus, arguing that republicans (...) should be cosmopolitans. The considerations offered against cosmopolitanism generally rest on an incomplete understanding of the relationship between economic inequality or poverty on the one hand, and domination on the other. Insofar as republicans agree that promoting freedom from domination should be our central political aim, they should regard the reduction of economic inequality and poverty at home and abroad as equally pressing. The frame model, originating in artificial intelligence and cognitive psychology, has recently been applied to change-phenomena traditionally studied within history and philosophy of science. Its application purpose is to account for episodes of conceptual dynamics in the empirical sciences suggestive of incommensurability as evidenced by “ruptures” in the symbolic forms of historically successive empirical theories with similar classes of applications. This article reviews the frame model and traces its development from the feature list model. Drawing on extant literature, examples of (...) frame-reconstructed taxonomic change are presented. This occurs for purposes of comparison with an alternative tool, conceptual spaces. The main claim is that conceptual spaces save the merits of the frame model and provide a powerful model for conceptual change in scientific knowledge, since distinctions arising in measurement theory are native to the model. It is suggested how incommensurability as incomparability of theoretical frameworks might be avoided. Moreover, as nontranslatability of worldviews, it need not to be treated as a genuine problem of conceptual representation. The status of laws vis à vis their dimensional bases as well as diachronic similarity measures are discussed. (shrink)

In this criticism of Mitrović argument about realism it is pointed out 1): that Mitrović is unaware of how the medieval debate between realists and nominalists about the existence of universals complicates his position, 2) similarly, he is unaware of how the debate on the so-called ‘essentially contested concepts’ (W.B. Gallie) complicates his position, 3) when taking up the issue of holism and individualism he mistakenly assumes that what has been said about it in the context of the social sciences (...) can also be applied to the writing of history, 4) the debate on the legal person or corporation since Innocent IV further complicates the issue. Finally, I explain why and how one can be a realist in philosophy of history, though on the basis of arguments entirely different from those proposed by Mitrović. (shrink)

We study hyperdefinable groups, the most general kind of groups interpretable in a simple theory. After developing their basic theory, we prove the appropriate versions of Hrushovski's group quotient theorem and the Weil–Hrushovski group chunk theorem. We also study locally modular hyperdefinable groups and prove that they are bounded-by-Abelian-by-bounded. Finally, we analyze hyperdefinable groups in supersimple theories.

A theory is usually said to be time reversible if whenever a sequence of states S 1 , S 2 , S 3 is possible according to that theory, then the reverse sequence of time reversed states S 3 T , S 2 T , S 1 T is also possible according to that theory; i.e., one normally not only inverts the sequence of states, but also operates on the states with a time reversal operator T . David Albert and (...) Paul Horwich have suggested that one should not allow such time reversal operations T on states. I will argue that time reversal operations on fundamental states should be allowed. I will furthermore argue that the form that time reversal operations take is determined by the type of fundamental geometric quantities that occur in nature and that we have good reason to believe that the fundamental geometric quantities that occur in nature correspond to irreducible representations of the Lorentz transformations. Finally, I will argue that we have good reason to believe that space-time has a temporal orientation. (shrink)

We present empirical evidence from social psychological research which suggests that standard methods employed when teaching the heuristics and biases program in the context of critical thinking instruction are likelier to facilitate the discernment and correction of biases in others’ reasoning than to have a similar effect in the self-monitoring case. Exemplified by the social phenomenon of false polarization, we suggest that CT instruction may be improved by fostering student’s abilities at counterfactual meta-cognition, and present a corresponding teaching and learning (...) activity. Nearly a decade ago, Ingrid Robeyns formulated a distributive justice doctrine known as economic limitarianism. This article posits that Robeyns’ limitarianism is a politically plausible, practically feasible and morally justifiable doctrine. The doctrine effectively addresses concerns regarding incentives, efficacy and unequal opportunities. The article identifies a problem of scope or extensity, which it refers to as an asymmetric argument. The article proposes that this issue can be resolved by fully extending limitarianism to non-democratic states. This extension is justified by the (...) relationship between surplus money and political inequality, which can be explained through various avenues, including causal and constitutive explanations, structural injustice and systemic causation. While this list of avenues is not exhaustive, it is representative of the possible avenues that can be explored. Fully extending the doctrine to non-democratic states would enhance its robustness. Alex Gourevitch’s From Slavery to the Cooperative Commonwealth is a valuable contribution to republican historiography: in reconstructing the ideas of the 19th century American labour republicans, this work significantly expands and enriches our appreciation of the classical republican tradition. While the labour republicans are convincingly shown to have made important contributions to that tradition, stronger claims that they fundamentally transformed republicanism are less persuasive.

The deductive system in Boole's Laws of Thought (LT) involves both an algebra, which we call proto-Boolean, and a "general method in Logic" making use of that algebra. Our object is to elucidate these two components of Boole's system, to prove his principal results, and to draw some conclusions not explicit in LT. We also discuss some examples of incoherence in LT; these mask the genius of Boole's design and account for much of the puzzled and disparaging commentary LT has (...) received. Our evaluation of Boole's logical system does not differ substantially from that advanced in Hailperin's exhaustive study, Boole's Logic and Probability. Unlike the latter work, however, we make direct use of the polynomials native to LT rather than appealing to formalisms such as multisets and rings. (shrink)

This paper discusses an example of social policy argumentation from an opinion of the 2007 majority among the German National Ethics Council. It is employed to problematize argument reconstruction with respect to the Informal Logic quality criteria relevance, sufficiency, acceptability. The main thesis is conditional and rather weak: If the RSA criteria are sub-stitutes for the notion of soundness, then—next to premise-truth and validity—they also substitute recon-structive charity.

In this essay, I will outline the adjustments in Heidegger’s account of technicity that are necessary to address the danger ( Gefahr ) that revolves around recent advances, including cybernetics. These adjustments that Parvis Emad was among the first to pioneer, are hermeneutic guidelines that delineate the wholesale appearance of beings through the prism of a “mathematical project”. The mathematical project of ‘nature’ creates a platform on which cybernetics can arise in two ways: 1). by converting the linear sequencing of (...) ‘time’ (as “making present”) into a universal form of calculation and 2). by subdividing ‘space’ into infinite points. The danger, then, does not lie in the ominous effects of technicity, but as a throwback to the metaphysical distortion of the reciprocity between being and time in which the former is confined to the presencing of beings through a model of calculability and the latter is reduced to the “digitizing” of a linear sequence of units. The hermeneutic guidelines allow for the “retrograsping” ( zürckgenommen [Emad’s translation] of the danger of technicity (including its transmutation into cybernetics) as a “throwback” to the abandonment of and by being ( Seinsverlassenheit ). The thought of Bernard Lonergan provides an epistemological position that is both true to the exigencies of modern science and yet open to the possibility of God and revealed religion. In this paper I outline Lonergan's “transcendental method,” which describes the basic pattern of operations involved in any act of human knowing, and discuss how Lonergan uses this cognitional theory as a basis for an epistemological position of critical realism. Then I explain how his approach handles some philosophical problems raised (...) by classical and modern science and show how his thought provides an intelligible link between the scientific and religious horizons. This paper articulates the commitments, contours and justifications for a pluralist but non-eclectic critical, realist, reflexive social science with emancipatory aims. In it, we stress that social science can and should be used to guide the conceptualization of desirable and viable forms of social organization and their conditions of realization. In this regard, we advocate explanatory theorizing as an ethical duty of social scientists and as a moral good in itself as well as being an inherent epistemological component of scientific (...) practice. This entails that we take seriously the research strategies apposite to our disciplinary, intertextual and interdiscursive locations to make a serious theoretical case and practical case for the kind of social science here advocated. In our view, such a social science must acknowledge the path-breaking work of Roy Bhaskar, but must also recognize that the arguments deployed in texts as a resource in intellectual work can never be treated as the axiomatic grounds for further thought, but must be interrogated thoroughly and in each case what is to be retained must be defensible. No position has a monopoly of relevant insights and the development of science often involves syntheses. Syntheses must not be syncretic but reflexively interrogated to assess epistemological, ontological and conceptual coherence to avoid eclecticism. Development in critical realist philosophy will, we believe, continue to confront and offer plausible resolutions to a range of battles within and pertinent to philosophy and social-scientific metatheory. However, realists must recognize the continuing importance and discursive effects of a variety of critical and realist work in being able to defend, sustain and develop rigorous social-scientific research with emancipatory commitments. This embedding reflects the fmp, decidability, completenes and compactness.
