This book provides a philosophical examination of the extent to which legalizing same-sex marriage can contribute to ending the discrimination and social stigma faced by LGBT men and women in the Western world.

A case has been made by various authors that the normative and processual notion of personhood found in African philosophy is discriminatory: it has been labelled as sexist, ableist and anti-queer. Within the anti-queer critique, one area that has not been specifically addressed in the literature is whether this notion of personhood is biased against people who identify as non-binary with respect to gender. This includes people who are gender fluid and gender neutral, among others. In this article, we argue (...) that the binary conception of gender is deeply connected to a colonial agenda, and does not accurately fit extra-colonial gender conceptions. Through an analysis of extra-colonial language and logic, read together with the flexibility inherent in the processual notion of personhood (on our reading), we argue that binaries do not sit comfortably with extra-colonial African thinking, and as such, processual and normative personhood can be understood in a way that embraces non-binary individuals. Further, the standards for achieving personhood are set by and achieved within the community, so a community which recognises and celebrates non-binary individuals can set up a framework for them to achieve personhood. Accordingly, normative personhood in African thought is found not to exclude those of non-binary gender. This reading saves the normative approach from some of the critiques levelled against it, as well as: i) enhancing consistency in an African world view; ii) strengthening the decolonial agenda; and iii) showing normative personhood to be fairer and more inclusive. This study aimed to explore the conditions for nurses' daily patient education work by focusing on managers' way of speaking about the patient education provided by nurses in hospital care. An explorative, qualitative design with a social constructionist perspective was used. Data were collected from three focus group interviews and analysed by means of critical discourse analysis. Discursive practice can be explained by the ideology of hegemony. Due to a heavy workload and lack of time, managers could ‘see’ neither their (...) role as a supporter of the patient education provided by nurses, nor their role in the development of nurses' pedagogical competence. They used organisational, financial, medical and legal reasons for explaining their failure to support nurses' provision of patient education. The organisational discourse was an umbrella term for ‘things’ such as cost‐effectiveness, which were prioritised over patient education. There is a need to remove managerial barriers to the professional development of nurses' patient education. Managers should be responsible for ensuring and overseeing that nurses have the prerequisites necessary for providing patient education as well as for enabling continuous reflective dialogue and opportunities for learning in practice. This study examines the conditions under which local social environments are likely to influence corporate tax behavior. Using a social capital index at the county level, we find that on average, social capital reduces firms’ aggressive tax avoidance behavior. The impact of social capital on corporate tax avoidance is weaker when managers are under excessive pressure to meet earnings targets, during the periods of financial constraints, and when managers are incentivized to undertake risk. We further find that corporate tax avoidance (...) activities engaged by firms headquartered in high-social-capital counties tend to be less value-increasing, indicating that potential social sanctions in these areas may reduce the benefits of tax avoidance activities accrue to firms. However, the negative impact of tax avoidance on firm value in high-social-capital counties tends to be lower for firms with strong corporate governance, which suggests that managers in well-governed firms can better exploit tax avoidance opportunities. Overall, our evidence is consistent with our conjecture that although the local social environments have a significant influence on corporate tax behavior, this influence is fragile in the presence of excessive earnings pressure, financial constraints, and equity risk incentives. In her 1958 book The Human Condition, Hannah Arendt points to the potential of human action to initiate new beginnings, a capacity she calls natality, as the source of political renewal that could save the modern age from ruin. The question of the relationship between natality and theological concepts is one of the most perplexing points of dispute in the Arendt scholarship of the last two decades. The overall function of the concept of natality in Arendt’s thought has been variously (...) categorized as ontological, political, “covertly” theological and “inconspicuously” messianic. This essay addresses the question of whether Arendt’s understanding of the essential natality of human action should be read as straightforwardly philosophical, as secularized theology or as “covert” or “inconspicuous” theology with a focus on how textual and contextual elements might be assessed in a way that does justice to the complexity of Arendt’s thought. Background Ethical challenges constitute an inseparable part of daily decision-making processes in all areas of healthcare. Ethical challenges are associated with moral distress that can lead to burnout. Clinical ethics support has proven useful to address and manage such challenges. This paper explores how prehospital emergency personnel manage ethical challenges. The study is part of a larger action research project to develop and test an approach to clinical ethics support that is sensitive to the context of emergency medicine. Methods We (...) explored ethical challenges and management strategies in three focus groups, with 15 participants in total, each attended by emergency medical technicians, paramedics, and prehospital anaesthesiologists. Focus groups were audio-recorded and transcribed verbatim. The approach to data analysis was systematic text condensation approach. Results We stratified the management of ethical challenges into actions before, during, and after incidents. Before incidents, participants stressed the importance of mutual understandings, shared worldviews, and a supportive approach to managing emotions. During an incident, the participants employed moral perception, moral judgments, and moral actions. After an incident, the participants described sharing ethical challenges only to a limited extent as sharing was emotionally challenging, and not actively supported by workplace culture, or organisational procedures. The participants primarily managed ethical challenges informally, often using humour to cope. Conclusion Our analysis supports and clarifies that confidence, trust, and safety in relation to colleagues, management, and the wider organisation are essential for prehospital emergency personnel to share ethical challenges and preventing moral distress turning into burnout. This study underscores The Lily and the Bird's response to despair in The Sickness unto Death. By suggesting in The Lily and the Bird that we look to nature's creatures to learn an attunement and responsiveness to our situation as physical creatures subject to finite constraints, Kierkegaard's text comes into dialogue with a form of misalignment portrayed in The Sickness unto Death as a refusal of the given, “the finite,” and “the necessary.” One way of seeking alignment in The Lily (...) and the Bird entails learning to hear and to answer within one's given environment, opening up the possibility of embodied joy. If the discourse of manners and customs aspires to a stable fixing of subjects and systems of differences, however, its project is not and never can be complete. This is true if only for the seemingly trivial reason that manners-and-customs descriptions seldom occur on their own as discrete texts. They usually appear embedded in or appended to a superordinate genre, whether a narrative, as in travel books and much ethnography, or an assemblage, as in anthologies and magazines.6 In the case (...) of travel writing, which is the main focus of this essay, manners-and-customs description is always in play with other sorts of representation that also bespeak difference and position subjects in their own ways. Sometimes these other positioning complement the ideological project of normalizing description, and sometime they do not.In what follows, I propose to examine this interplay of discourses in some nineteenth-century travel writing chiefly about Africa. While Barrow’s work is not prominent on anybody’s mental bookshelves these days, readers will recognize such names as David Livingstone, John Speke, James Grant, Richard Burton, Mungo Park, or Paul Du Chaillu. During the co-called opening up of central and southern Africa to European capitalism in the first half of the nineteenth century, such explorer-writers were the principal producers of Africa for European imaginations—producers, that is, of ideology in connection with the European expansionist project there. What I hope to underscore in these writings is not their tendency towards single, fixed subject positions or single, fixed systems of difference. Rather, I wish to emphasize the multiplicity of ways of codifying the Other, the variety of fixed positions and the variety of given sets of differences that they posit. European penetration and appropriation is semanticized in numerous ways that can be quite distinct, even mutually contradictory. In the course of examining discursive polyphony in these travel writings, I hope to stress the need to consider ideology not only in terms of reductive simplification but also in terms of the proliferation of meanings. 6. This article explores the emergence of leadership during implementation of a water saving initiative in the rural community surrounding Barren Box Swamp in the Murray Darling Basin, Australia. Qualitative data analysis indicated that the system elements affecting the type of leadership to emerge included the extent to which the groups were engaged in the process, the level of access to resources, and the level of investment in the outcomes of the project. Although these results reinforced key aspects of complex problem-solving (...) through collaboration, they demonstrated varying degrees and types of both engagement and leadership within the case community. Given the current finding that these varying elements can coincide within one system, this case suggests that each community’s characteristics, resources and context will determine the optimal combination of leadership style and level of collaboration needed to facilitate sustainable community development. In this article we present a phenomenological single-case study of a client’s experience of her therapist’s bodily movement in the context of narrative therapy. A client was interviewed regarding her experience of selected bodily movements of the therapist based on a video recording of one of her therapeutic sessions. The movements were analyzed through Maxine Sheets-Johnstone’s cardinal structures of movement while the interview was analyzed through a modification of Giorgi’s method for phenomenological psychology. We focused on the relationship between the (...) therapist’s bodily movement and therapeutic movement in the client and arrived at general structures of the client’s experience of being moved by movement. The experience comprises three core constituents: ‘shifts in sense of self’, ‘sense of togetherness’ and ‘feelings of mobility’, and reveals that the therapist’s bodily movements can lead to therapeutic changes compatible with the aim of narrative therapy. This article explores refusal of medical treatment by adult patients from ethical and legal perspectives. Initially, consequentialist and deontological ethical theory are outlined. The concepts of autonomy, paternalism and competence are described and an overview of Beauchamp and Childress’s principle-based approach to moral reasoning is given. Relevant common law is discussed and the provisions of the Mental Capacity Act 2005 in assessing competence is evaluated. In order to demonstrate the consideration of moral issues in clinical practice, ethical theory is applied (...) to two well-known incidents: the case of Re MB, where doubt over decision-making capacity led to a paternalistic act to override a patient’s choice; and the death of Emma Gough, a situation where respect for autonomy prevailed when healthcare staff acted lawfully in following a patient’s refusal of life-saving treatment. Finally, guidance from regulatory bodies on the roles and responsibilities of health professionals in relation to this topic are considered. (shrink)

A brief introduction to the problem of other minds and knowledge of the world outside our own minds.

Since the 1960s, the focus of African Philosophy has predominantly been Afrocentric, and with an emphasis on racial issues, as a reaction to Eurocentrism. To hold an open intercultural dialogue on African Philosophy with African and other philosophers is, therefore, not-self-evident. This article will argue that intercultural dialogues or (in case of more than two participants) ‘polylogues’ can and should become a more central point of focus in the academic study of African Philosophy. The author will center on how three (...) renowned African(a) philosophers with a focus on the Akan people of Ghana have initiated intercultural dialogues for the enhancement of human wellbeing. These are Kwasi Wiredu, Kwame Gyekye and Kwame Anthony Appiah. What these philosophers have in common is their belief that all human beings are interdependent and that an emphatic, ethic orientation to one another and mutual communication helps to live together in social harmony, which enhances the wellbeing of mankind. Discussing these African philosophers’ insights into depth will pave the way for other scholars to explore the intercultural dialogue as a weak or non-centric and non-racial focused philosophical method and to enhance understanding of its relation to African(a) Philosophy and a Global Ethics of care. The article explores the complex and multi-dimensional relationship between organization and discourse, using interview data and written documents collected within banks in Sweden, Germany and Britain. The first part of the analysis, which examines the extent to which the organizations studied can be said to form discourse units in their own right, shows that management ideas, norms and values seem to have a considerable impact on bank discourse. Although the discourse found in different banks naturally has many features in common, (...) each organization is found to be created at least partly differently by its discourse. Analyses of sender markings, expressive illocutions and expressions of thanks to the staff show how discourse is part of the construction of an organizational culture in relation to ideas concerning leadership, hierarchy, centralization etc. The second part of the analysis focuses on the role of the national community in the formation of an organization. An analysis of the bank images disseminated in spoken discourse and documents points to differences which could be attributed to national cultural patterns. The interview data further show how much effort is devoted to internally and externally disseminated images; this could be seen as a sign of an awareness among management of the decisive role of the spoken and written word for their company. The book Identité et primauté d’autrui presents a study of intersubjectivity in Merleau-Ponty. Subjectivity emerges against a background of a world shared with the other, a human world, and is preceded by its relationship to the other. The assumption of the primary character of this relationship takes on the shape of hospitality. Such a politics of hospitality is opposed to state politics aiming for cultural security and the defense of values, taking their origins in neoconservatism and notably deployed against immigration (...) and mixity. This original study of hospitality, departing from Merleau-Ponty in an original manner while remaining anchored in the Phenomenology of Perception, offers a response to the need to protect an unavoidable ontological pluralism. Contemporary democratic theory, in its focus on the distinction between a private and a public sphere, tends to exclude emotions from political life. Arendt, Habermas, and Angus present critical theories of politi­cal action and deliberation that demand that emotions be left behind in favour of a narrower rationality.
