For many immigrants to the United States, between 1892 and 1924, admission was contingent upon a medical inspection at an immigration centre, such as the one located at Ellis Island in the harbour of New York City. Much like passing through customs or security at airports today, these medical inspections were dreaded by immigrant travellers, and United States Government and Public Health Service publications show that these medical inspections were escalating in intensity and emphasis during the early twentieth-century. The purpose (...) of the PHS inspections becomes especially evident when looking at the gender considerations, or lack thereof, which arose during medical inspections at Ellis Island. A gender analysis of the PHS medical inspections, examined through the use of oral histories and photographs, provides a window into understanding the primary concern of the United States Public Health Service. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Taken together, map and drawing indirectly serve to illuminate Barbauld's complicated position within Enlightenment feminism and invite new insights into her relationship with the canonical male Romantics, reaffirming her status as a key transitional figure between Neoclassicism and Romanticism in the contribution she makes to the historical debate over the relationship between different arts. As a literary critic Anna Letitia Barbauld provides important evidence for those who have sought to challenge a long-established critical view that the development of the novel was premised on a renunciation of the wonders of romance which went hand in hand with the project of Enlightenment science and its rejection of miracles and the supernatural. At the same time, she presents an alternative perspective from that of influential eighteenth-century male critics such as Samuel Johnson regarding the relationship (...) between novels and romances, and a sharply contrasting view of the place of wonder within the overall history of fiction. Against male contemporaries, she makes a case for women’s continuing special claims as readers and writers of fiction based in part on their greater receptivity to emotions such as that of wonder, challenging Johnson’s implicit positioning of men as the leaders of a developing form of literary realism that required a broad knowledge of nature and society. The purpose of this study is to determine after a one year program, the effects of Philosophy for Children on critical thinking skills of a select group of 22 second graders at Saginaw Elementary. These students have had no previous study in Philosophy for Children and met for 170 days, bi-weekly for at least 30-minutes with no more than three sessions missed. It was anticipated there would be a significant positive difference of critical thinking skills of second graders as observed (...) and noted by the teacher, in a recorded journal, prior, during and after the study. I argue that there exists a natural kind social bias that subsumes seemingly heterogenous cases of implicit bias and other forms of social cognition. I explore the implications of this explicated notion of bias for the organization of the mind, theories of consciousness, and the system-dependence of biases.

The “beyond a reasonable doubt” standard of proof, currently used in criminal trials, is notoriously vague and undermotivated. This paper discusses two popular strategies for justifying our choice of a particular precise interpretation of the standard: the “ratio-to-standard strategy” identifies a desired ratio of trial outcomes and then argues that a certain standard is the one that we can expect to produce our desired ratio, while the “utilities-to-standard strategy” identifies utilities for trial outcomes and then argues that a certain standard (...) maximizes expected utility. I argue that both strategies fail on their own terms, by requiring us to perform calculations that we simply cannot perform. No version of either strategy can be performed by jurors or legislators in our actual epistemic position, in which, since we do not know which of the defendants in our trial system are genuinely innocent and which are genuinely guilty, we cannot determine the extent to which our trial system tends to produce evidence that misleadingly incriminates the innocent or misleadingly exonerates the guilty. But we would need to determine this in order to perform the calculations required by any possible version of the ratio-to-standard or utilities-to-standard strategies. I then suggest some empirical reasons to be pessimistic about the evidence produced by our actual trial system. The upshot is that the “beyond a reasonable doubt” standard lacks a clear interpretation and rationale, nor do we have a promising way to identify an alternative. Conviction Narrative Theory (CNT) is a theory of choice underradical uncertainty– situations where outcomes cannot be enumerated and probabilities cannot be assigned. Whereas most theories of choice assume that people rely on (potentially biased) probabilistic judgments, such theories cannot account for adaptive decision-making when probabilities cannot be assigned. CNT proposes that people usenarratives– structured representations of causal, temporal, analogical, and valence relationships – rather than probabilities, as the currency of thought that unifies our sense-making and decision-making faculties. According to CNT, (...) narratives arise from the interplay between individual cognition and the social environment, with reasoners adopting a narrative that feels “right” to explain the available data; using that narrative to imagine plausible futures; and affectively evaluating those imagined futures to make a choice. Evidence from many areas of the cognitive, behavioral, and social sciences supports this basic model, including lab experiments, interview studies, and econometric analyses. We identify 12 propositions to explain how the mental representations (narratives) interact with four inter-related processes (explanation, simulation, affective evaluation, and communication), examining the theoretical and empirical basis for each. We conclude by discussing how CNT can provide a common vocabulary for researchers studying everyday choices across areas of the decision sciences. (shrink)

Concussion is a common, serious injury in youth ice hockey, affecting up to 25% of players per season by one estimate. • Bodychecking is a major cause of injury and concussion in hockey, yet some Canadian provinces allow players as young as nine years to engage in bodychecking. • Reducing rates of concussion requires eliminating bodychecking for all except elite hockey players aged 16 years and older, as per the recommendations of the Canadian Academy of Sports and Exercise Medicine.

This paper concerns recent attempts to use the epistemological notions of sensitivity and safety to shed light on legal debates about so-called “bare” statistical evidence. These notions might be thought to explain either the outright inadmissibility of such evidence or its inadequacy for a finding of fact—two different phenomena that are often discussed in tandem, but that, I insist, we do better to keep separate. I argue that neither sensitivity nor safety can hope to explain statistical evidence’s inadmissibility, since neither (...) offers a plausible criterion of admissibility that would exclude such evidence; both are subject to copious counterexamples, especially given their factivity, and it is difficult even to state a coherent criterion of admissibility in terms of either sensitivity or safety. The possibility remains, though, that either notion might explain statistical evidence’s inadequacy for a finding of fact; I express some doubts about this possibility but do not rule it out. The importance of history for religious ethics lies in the fact that, in religious communities existing over time, values are encountered in history, given forms dependent on the historical experience of the believing community, and recalled by the individual moral agent through memory in the context of participation in that community. This paper has to do with the nature of that memory and its implications for moral identity. Specifically, I utilize the concept of "significant history," derived from Gordon Kaufman's notion (...) of the "living past," arguing that moral identity is defined by memory of such history, present to the self in two aspects, individual and communal. The historical task of the religious ethicist, on this view, is to render faithfully both his own significant history and that of his community of faith. With the problem thus defined, I analyze several attempts to solve it, attempting to show how a religious ethical tradition ought to be treated as normative for contemporary analysis and decision-making. With some justification, Michel Serres claimed that he was one of the first to make ecology a central question for philosophy. Many of his books explore the ecological emergency and spell out the need to include the more-than-human in any ethical and political response. Yet Serres’ thought has been generally neglected in scholarly debate outside France. To highlight the importance of Serres’ philosophy, I contrast aspects of his work with Latour’s sustained search for a political ecology. I contend that Serres’ (...) thought overlaps with but also challenges Latour’s approach that has increasingly turned for inspiration to the theory of Gaia proposed by Lovelock and Margulis. I argue that drawing from science, history, fables, the humanities and his own experience, Serres brings together a narrative of the commonality of all living and non-living things that exposes a contractable obligation and formulates the grounding for a new politics. Clausal edges seem to have an effect on the scopes that arguments residing at those edges can have. In particular, they influence whether an argument may be interpreted at a lowered, or reconstructed, position within the clause. This is probably what is responsible for the difference between (1a) and (1b), which formed the focus for the debate in Stowell 1991 and Williams..

Icelandic is the only Scandinavian language in which the verb always moves past negation, and other sentence adverbials, in embedded clauses. We follow everyone else and take this as evidence that Icelandic as opposed to the other Scandinavian languages has V°-to-I°1 movement (see, e.g., Kosmeijer 1986, Holmberg & Platzack 1990:101, Rohrbacher 1994:30-69, and Vikner 1994:118-127, 1995:ch.5). If we assume that negation and sentence adverbials mark the left edge of VP (they could be adjoined to VP or to TP, for example), (...) then the following embedded questions clearly show that the verb has to move to I° in Icelandic and remain lower in Swedish. In spite of the seeming heterogeneity of topics in its title - Revolutions, Systems, and Theories - this volume purports to be something more than a random collection of Essays in Political Philosophy. The Colloquium of the Philosophy Department of the University of Western Ontario (29-31 Octo­ ber, 1971) at which initial versions of the first eight papers were delivered was entitled 'Political Theory'; and while the organizers anticipated and indeed welcomed topicality in the issues accorded priority arid in the (...) empirical evidence invoked, they were also hoping for a reasonably comprehensive explorat ion of some of the central issues of political philosophy. For this reason it was quickly decided that in such a field a philosophical focus on clarification of ordering concepts required the suppIement - and test - of researches into more particular subject maUers by social scientists. Thus, to speak in general terms (where the specializatlons and their taxonomies multi­ ply fissiparously!), contributors include political scientists, economists and sociologists (Barnard, Baston, Tullock, Rapoport) as well as philosophers (Scriven, Morgenbesser, Braybrooke, TayIor), and juxtaposed as proponents and commentators ·to generate exchanges across disciplinary frontiers. While the five additional invited papers are alI by professional philosophers, they extend the original Colloquium either by continuing controversy on its funda­ mental issues (e. g., Rubinoff, Nielsen, Roy) or by their continued explorations in what are acknowledged to be boundary areas (e. g., Schick, Wartofsky). Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. In spring 2020, COVID-19 and the ensuing social distancing and stay-at-home orders instigated abrupt changes to employment and educational infrastructure, leading to uncertainty, concern, and stress among United States college students. The media consumption patterns of this and other social groups across the globe were affected, with early evidence suggesting viewers were seeking both pandemic-themed media and reassuring, familiar content. A general increase in media consumption, and increased consumption of specific types of content, may have been due to media use (...) for coping strategies. This paper examines the relationship between the stress and anxiety of university students and their strategic use of media for coping during initial social distancing periods in March-April 2020 using data from a cross-sectional survey. We examine links between specific types of media use with psychological well-being concepts, and examine the moderating roles of traits (hope, optimism, and resilience) as buffers against negative relationships between stress and anxiety and psychological well-being. Our findings indicate that stress was linked to more hedonic and less eudaimonic media use, as well as more avoidant and escapist media-based coping. Anxiety, on the other hand, was linked to more media use in general, specifically more eudaimonic media use and a full range of media-based coping strategies. In turn, escapist media was linked to negative affect, while reframing media and eudaimonic media were linked to positive affect. Avoidant coping was tied to poorer mental health, and humor coping was tied to better mental health. Hedonic and need-satisfying media use were linked to more flourishing. Hope, optimism, and resilience were all predictive of media use, with the latter two traits moderating responses to stress and anxiety. The findings give a nuanced portrait of college students’ media use during a pandemic-induced shutdown, showing that media use is closely intertwined with well-being in both adaptive and maladaptive patterns. Such arguments are examined here as they relate to the problem of theodicy, by looking at a particular case study that inspired comments on the relationship between medicine and faith, namely, the discovery of the diphtheria antitoxin.
