Many countries are experimenting with planned (or quasi-) markets to discover if they can efficiently deliver health care in keeping with societal objectives. This paper examines the information requirements of this approach. Information is necessary in order to compare the performance of providers, to support billing, and to monitor access to care. It should be accurate, unambiguous, and resistant to manipulation. We draw on a project to find out how information on hospitalisation could be used in contracting in the British (...) National Health Service. We conclude that the existing British system fails to provide robust measures of how many patients are treated, for what conditions, and with what treatments. We identify some promising remedies, others that are more difficult, and some which may be impossible to implement in any planned market, given the uncertainty of clinical practice. (shrink)

We assert that one of the examples used by Keller & Miller (K&M), namely, autism, is indeed common, and heritable, but we question whether it is harmful. We provide a brief review of cognitive science literature in which autistics perform superiorly to non-autistics in perceptual, reasoning, and comprehension tasks; however, these superiorities are often occluded and are instead described as dysfunctions. Many studies require standardized and replicable protocols composed of emotional stimuli. To this aim, several databases of emotional pictures are available. However, there are only few images directly depicting interpersonal violence, which is a specific emotion evocative stimulus for research on aggressive behavior or post-traumatic stress disorder. The objective of the current study is to provide a new set of standardized stimuli containing images depicting interpersonal situations. This will allow a sensitive assessment of a wide range of cognitions linked to (...) social interaction. To this aim, 240 participants rated the valence and arousal of 79 pictures collected from online sources in 2018. Results showed a distinctive pattern of valence and arousal regarding the picture content and specific associations between those two dimensions. Taken together, these results suggest a good reliability of the selected images. In conclusion, our study provides an open access set of recent pictures depicting interpersonal situations along with normative valence and arousal ratings, that are available for download from: https://osf.io/ak4m7/?view_only=None. Within the realm of structures of society, the caste system, a unique example among all the aspects of human adventure, represents at the level of social morphology, that is in the manner of grouping characteristic of a society, India's most original contribution to human history within all great civilizations, to the point that India's civilization is generally identified by the principal feature of its morphology.

Since time immemorial, the most varied divinatory practices have flourished in India. Their prognostications were supplied by the interpretation of quite diverse omina and portenta: Thus “meteors” (lightning, rain or comets) earthquakes, the flight and cries of crows and other birds, the degree of clarity of a subject's image reflected in melted butter (gharta), lines and marks on a body, the direction taken by smoke rising from the altar once the rite had condensed a certain magic power from it (prabhāva), (...) dreams, all were thought to furnish the diviner with presages. As the abundant lists of the Garga samhitā and the Brhat Sarnmitā testify, for a conscience attentive to the intersigns there is no reality, even the most insignificant, that does not lend itself directly or by contiguity to systematic interpretation. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit (...) and The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. L’objectif du présent essai consiste à présenter une brève analyse comparative de cette image épistémologique (ou post-cartésienne) ainsi que de la perspective herméneutique que lui oppose notre auteur. En ce sens, nous comparerons tour (...) à tour six aspects déterminants de ces deux conceptions : le caractère « apodictique », « médiationnel », « désengagé », « désignatif », « dépassionné » et « procédural » de la première et le caractère « ad hominem », « immergé », « situé », « expressif », « passionné » et « substantiel » de la seconde. Nous éclairerons en outre les enjeux complexes de cette critique par quelques remarques introductives et conclusives. | : Charles Taylor’s main philosophical project presents itself as a critique of the “epistemological picture” of rationality. This critique is put forward in the name of a new understanding of reason, more sensitive to its transcendental and historical finitude. Dans les décennies qui suivent, on note une diversification des formes d’investissement (...) du barreau en politique, moins marqué par l’investissement dans le champ politique proprement dit que par l’engagement à travers la défense judiciaire de causes. Cognitive forms vary considerably as a human being detaches herself from what is closest and most personal and moves to communicate — in the broad sense of taking part in a common matter — across increasing relational distances. The article proposes to deal with the variety of cognitive formats which cannot `commonize' cognition to an equal degree, relating them to a set of regimes of engagement with the world that are identified in terms of the dependency between the human agent (...) and her environment. The good that engagement aims to guarantee orients how reality is grasped and specifies the format of what constitutes relevant information. This analysis offers new insight into the composition of communities as well as persons who have to cope with the plurality of cognitive formats and engagements from the very familiar to the most public. This article is about the conception of truth and signification in Augustine's early philosophical writings. In the first, semantic-linguistic part, the gradual shift of Augustine's position towards the Academics is treated closely. It reveals that Augustine develops a notion of sign which, by integrating elements of Stoic epistemology, is suited to function as a transmitter of true knowledge through linguistic expressions. In the second part, both the ontological structure of signified (sensible) things and Augustine's solution to the apparent tautologies of (...) mathematical truths are examined. Again his notion of sign turns out to be the keystone; this time, however, the natural in contrast to the conventional sign of linguistic expressions. In their complementarity, both parts show how Augustine intensely struggles with and (partially) overcomes the skepticism of the sensible world through his conception of sign and signification. This article traces a path through Bruno Latour’s reflections on politics to propose a constitutional reading, which makes ontological and normative lines of investigation intersect. It starts with a discussion of a central theme in Latour’s work, that of war and, more generally, opposition and conflicts, and connects it with questions of representation, delegation and decision-making. The preoccupation with land and territories found in Latour’s latest work is an invitation to extend his notion of constitution and turn it into a (...) situated matter of critical inquiry. The paper builds on debates and controversies surrounding mineral resources to show the analytical and critical value of constitutional analysis, and the way it can illuminate the ontological and normative issues associated with contemporary problematizations of land and territories. Since the 1990s, the terms “Lamarckism” and “Lamarckian” have seen a significant resurgence in biological publications. The discovery of new molecular mechanisms have been interpreted as evidence supporting the reality and efficiency of the inheritance of acquired characters, and thus the revival of Lamarckism. The present paper aims at giving a critical evaluation of such interpretations. I argue that two types of arguments allow to draw a clear distinction between the genuine Lamarckian concept of inheritance of acquired characters and transgenerational (...) epigenetic inheritance. The first concerns the explanandum of the processes under consideration: molecular mechanisms of transgenerational epigenetic inheritance are understood as evolved products of natural selection. This means that the kind of inheritance of acquired characters they might be responsible for is an obligatory emergent feature of evolution, whereas traditional Lamarckisms conceived the inheritance of acquired characters as a property inherent in living matter itself. The second argument concerns the explanans of the inheritance of acquired characters: in light of current knowledge, epigenetic mechanisms are not able to drive adaptive evolution by themselves. Emergent Lamarckian phenomena would be possible if and only if individual epigenetic variation allowed the inheritance of acquired characters to be a factor of unlimited change. This implies specific requirements for epigenetic variation, which I explicitly define and expand upon. I then show that given current knowledge, these requirements are not empirically grounded. This essay attempts to describe the neo-Lamarckian atmosphere that was dominant in French biology for more than a century. Firstly, we demonstrate that there were not one but at least two French neo-Lamarckian traditions. This implies, therefore, that it is possible to propose a clear definition of a (neo)Lamarckian conception, and by using it, to distinguish these two traditions. We will see that these two conceptions were not dominant at the same time. The first French neo-Lamarckism (1879–1931) was structured by (...) a very mechanic view of natural processes. The main representatives of this first period were scientists such as Alfred Giard (1846–1908), Gaston Bonnier (1853–1922) and Félix Le Dantec (1869–1917). The second Lamarckism – much more vitalist in its inspiration – started to develop under the supervision of people such as Albert Vandel (1894–1980) and Pierre-Paul Grassé (1895–1985). Secondly, this essay suggests that the philosophical inclinations of these neo-Lamarckisms reactivated a very ancient and strong dichotomy of French thought. One part of this dichotomy is a material, physicalist tradition, which started with René Descartes but developed extensively during the 18th and 19th centuries. The other is a spiritual and vitalist reaction to the first one, which also had a very long history, though it is most closely associated with the work of Henri Bergson. Through Claude Bernard, the first neo-Lamarckians tried to construct a mechanical and determinist form of evolutionary theory which was, in effect, a Cartesian theory. The second wave of neo-Lamarckians wanted to reconsider the autonomy and reactivity of life forms, in contrast to purely physical systems. (shrink)

Heredity has been dismissed as an insignificant object in Claude Bernard’s physiology, and the topic is usually ignored by historians. Yet, thirty years ago, Jean Gayon demonstrated that Bernard did elaborate on the subject. The present paper aims at reassessing the issue of heredity in Claude Bernard’s project of a “general physiology”. My first claim is that Bernard’s interest in heredity was linked to his ambitious goal of redefining general physiology in relation to morphology. In 1867, not only was morphology (...) included within experimental physiology, but it also theoretically grounded physiological investigations. By 1878, morphology and physiology were considered as completely independent sciences, and only the latter was perceived as suitable to experimentation. My second claim is that this reversal reflected the existence of two opposite attitudes towards heredity. In the late 1860s, Bernard was convinced that heredity would soon be accessible to experimental manipulation and that new species would be produced in the laboratory exactly like organic chemistry succeeded to do for raw bodies. Ten years later, he ascertained that this was impossible. My third claim is that Bernard was epistemologically ill-equipped to address the issue of heredity. Bernard was strongly committed to a general reasoning scheme that acknowledged only three categories: determining conditions, constant laws and phenomena. This scheme was a key factor in his successes as a physiologist who was able to capture new mechanisms in living bodies. Nonetheless, it also prevented him from understanding how time and history could be endowed with a causal action that cannot be reduced to timeless parameters. (shrink)

This article introduces a framework which aims at capturing the complexity of economic organizations. The analysis of most legitimate conventions of coordination results in a new approach to the firm as a compromising device between several modes of coordination which engage different repertoires of evaluation. This contribution to the Économie des conventions offers an analytical tool to operate comparative research on firms, intermediate regulatory committees or public policies.

Resumé On a coutume de considérer qu’il y a un revirement complet qui s’opère chez Fichte entre ses Considérations sur la Révolution française de 1793 et son Fondement du droit naturel de 1796 en vertu de ce que le droit naturel et la morale ne sont pas dissociés dans la première œuvre et le deviennent complètement dans la seconde. Sans doute, le droit naturel est bien posé en 1793 comme l’expression de la loi morale dans les phénomènes, au lieu qu’il (...) est affirmé comme une science distincte de la morale en 1796. Il y aurait donc là une évolution bien connue de sa philosophie et non un problème. Pourtant, c’est faire fi de la complexité de la rationalité juridique chez Fichte que de s’en tenir à une simple lecture discontinuiste. Cet article voudrait montrer que ces deux œuvres que l’on oppose traditionnellement ne représentent pas deux visions inconciliables de la rationalité juridique, mais plutôt deux aspects complémentaires de la même rationalité juridique. En effet, selon que le Moi est pris sous le rapport de sa destination ou de sa genèse, deux perspectives différentes mais conciliables s’ouvrent sur le droit. (shrink)

This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Malgré l’important renouveau que connaît la théologie naturelle depuis environ un demi-siècle dans le champ de la philosophie de la religion, Charles Taylor soutient que celle-ci appartient à une époque désormais révolue. Cette étude propose de restituer de manière aussi fidèle et précise que possible les raisons de ce verdict. Une telle analyse vise à combler une lacune importante dans la littérature secondaire. Cette lacune tient, d’une part, au fait que Taylor lui-même ne développe jamais ces raisons de façon systématique (...) ; d’autre part, elle tient également au fait que plusieurs commentateurs semblent présupposer qu’un tel argument n’existe pas : Taylor récuserait la théologie naturelle simplement parce qu’elle ne correspond pas à la manière dont il est enclin à justifier ses propres convictions religieuses. Laurent Henninger intervenant sur les « révolutions militaires » (notion située au carrefour du débat historique lancé dans les années 1980 par Geoffrey Parker – en polémique avec Jeremy Black – et du débat stratégique américain dans les années 1990) souligne que les avancées dans l’art de la guerre ont été depuis cinq siècles une des composantes majeures de la barbarisation et du totalitarisme. La notion de « révolution militaire » est aujourd’hui contestée par ceux qui y voient un (...) outil interprétatif de trop longue durée et lui préfèrent l’idée de « mutations militaires » (selon laquelle l’accumulation de changements millimétriques sur la longue durée débouche sur des ruptures). Après avoir passé en revue la première révolution militaire – XVe-XVIIe siècles – fondée sur la mise à distance de la cavalerie grâce à l’infanterie nouvelle, à l’artillerie du champ de bataille, Henninger s’interroge sur le critère discriminant pour qualifier les nouvelles guerres de la Renaissance (l’hyperviolence n’en est pas un à ses yeux) et voit dans les armes à feu la vraie rupture car elles influent de façon radicale sur la peur et le courage des combattants et sont source d’une véritable « inhumanité » dans la mesure où leur feu est « imparable ». Il insiste sur l’émergence d’un nouveau type de courage guerrier non archaïque et plus « stoïcien » marqué par l’acceptation de la mort. Dans cette perspective, l’« inhumanisation » technique porterait en elle la possibilité de la barbarisation. L. Henninger développe ensuite cette thèse à partir de l’examen des guerres mécanisées de la période 1860-1950 en s’attardant sur la guerre de Sécession puis sur la Grande Guerre. Il relie aussi la question du totalitarisme à la réflexion sur les « bombardements stratégiques massifs » et les débuts de la dissuasion nucléaire (terme qui ne s’impose que vers 1960). Il conclut en insistant sur le fait que, selon lui, la brutalisation des conflits naît toujours d’un retard de la pensée de la guerre et sur le paradoxe d’une culture occidentale qui produit en même temps barbarie de la guerre et codes qui tentent de l’enrayer. This article shows how Lamarckism was essential in the birth of the French school of molecular biology. We argue that the concept of inheritance of acquired characters positively shaped debates surrounding bacteriophagy and lysogeny in the Pasteurian tradition during the interwar period. During this period the typical Lamarckian account of heredity treated it as the continuation of protoplasmic physiology in daughter cells. Félix d’Hérelle applied this conception to argue that there was only one species of bacteriophage and Jules Bordet applied (...) it to develop an account of bacteriophagy as a transmissible form of autolysis and to analyze the new phenomenon of lysogeny. In a long-standing controversy with Bordet, Eugène Wollman deployed a more morphological understanding of the inheritance of acquired characters, yielding a particulate, but still Lamarckian, account of lysogeny. We then turn to André Lwoff who, with several colleagues, completed Wollman’s research program from 1949 to 1953. We examine how he gradually set aside the Lamarckian background, finally removing inheritance of acquired characters from the resulting account of bacteriophagy and lysogeny. In the conclusion, we emphasize the complex dual role of Lamarckism as it moved from an assumed explanatory framework to a challenge that the nascent molecular biology had to overcome. (shrink)

La théorie de la relativité d'échelle développe les conséquences de l'abandon de l'hypothèse de différentiabilité des coordonnées spatio-temporelles. La première est le caractère fractal, c'est-à-dire explicitement dépendant des résolutions, qu'acquiert l'espace-temps. On redéfinit alors les résolutions comme caractérisant l'état d'échelle du référentiel, puis on postule un principe de relativité d'échelle, suivant lequel les lois de la nature doivent être valides quel que soit cet état. Il s'agit ainsi de construire une extension des théories existantes de la relativité, qui s'appliquaient jusqu'à (...) maintenant aux changements d'état de position, d'orientation et de mouvement. Par conséquent, la structure de la théorie suit un cheminement parallèle aux différents niveaux de la théorie relativiste (galiléenne, einsteinienne restreinte puis générale), auxquels s'ajoutent les effets du couplage entre échelle et mouvement.
