Are wealthy countries' duties towards developing countries grounded in justice or in weaker concerns of charity? Justice in a Globalized World offers both an in-depth critique of the most prominent philosophical answers to this question, and a distinctive approach for addressing it.

Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation on (...) the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Future research in the so-called Neurolaw field is needed to replicate and expand current findings. (shrink)

In this paper, we explore the experiences of EU migrants working in UK restaurants in the aftermath of the Brexit vote. We do so through a care ethics lens, which we bring together with the integrative approach to organisational silence to consider the ethical consequences of the organisational policies of political silence adopted by the restaurant chains in our qualitative empirical study. We develop the concept of political organisational silence and probe its ethical dimensions, showing how at the organisational level (...) it falls short of constituting a practice of caring for migrant workers in politically divisive and hostile times. We argue that organisational policies of political silence emphasise the exploitative nature of the business of (im)migration, which prioritises concern for profits over care for the needs of others. Organisations refuse caring responsibility for migrant workers, leaving care to the migrants themselves and their co-workers and managers. Whilst peer-care practices partially fill this politically silent care-vacuum, this leaves individuals to negotiate difficult tensions without institutional support at a time of increased uncertainty, complexity, hostility, violence, and vulnerability. Drawing lessons from our study and its aftermath, we call for a care manifesto to inform the business of (im)migration, which would need to include caring political responsibility towards migrant workers exercised through caring political organisational voice as well as silence. This article explores how high-functioning children with autism navigate in the social world, specifically how they orient in the realm of norms and standards. In particular, this investigation focuses on rule violations episodes and sheds light on how these children account for their conduct and position themselves in the moral framework. This analysis shows that high-functioning children with autism can actively engage in discourse about norms and transgressions in an initiatory capacity, thereby displaying a mastery of social rules as a (...) guide for appropriate conduct and interpretation of others’ behavior. Furthermore, this article argues that these social skills are linked with the ability to operate with sequentially based understandings: Prior courses of action constitute for the autistic children the fundamental source for reaching an understanding of the normative mechanics of everyday life, and subsequently for constructing their own lines of conduct and themselves as moral agents. New and proposed medical technologies continually challenge our vision of what constitutes appropriate medical treatment. As scholars and consumers grapple with the meaning of innovation, one common critical theme to surface is that it constitutes undesirable medicalization. But we are embodied creatures who can often benefit from medical knowledge; in addition, rejection of medicalization may be in some cases based on an untenable appeal to nature. The increasing role that new technologies play in intimate relationships has led to the emergence of a new form of couple violence, cyber dating abuse, especially among adolescents and young adults. Although this phenomenon has received increased attention, no research has investigated predictors of cyber dating abuse taking into account the interdependence of the two partners. The study examines adverse childhood experiences and early maladaptive schemas as possible predictors of young adults’ perpetrated and suffered cyber dating abuse. Adopting a dyadic (...) approach, mediational models in which adverse childhood experiences were assumed to be related to individual and partner’s cyber dating abuse through individual early maladaptive schemas were tested. 134 couples completed online self-reports of the variables of interest, including a bidimensional measure of cyber dating abuse assessing pressure-aggression and control-monitoring. Actor-partner interdependence mediation model analyses were conducted. Results indicated that the emotional deprivation schema mediated the association between adverse childhood experiences and cyber dating abuse, whereas the abandonment schema did not. Specifically, more frequent experiences of emotional abuse and physical neglect during childhood were indirectly related to increased likelihood of perpetrating cyber dating pressure-aggression as well as of perpetrating and suffering cyber dating control-monitoring in both males and females. These associations were mediated by a stronger internalization of the emotional deprivation schema and were supported by both self-reported and partner-reported data. Also, a strong and direct association was found between childhood exposure to intimate partner violence by the opposite-sex parent and cyber dating pressure-aggression by females or control-monitoring by both males and females. These findings help to clarify the potential negative effects of specific adverse childhood experiences and early maladaptive schemas on the tendency to perpetrate and suffer cyber abuse in romantic relationships. The implications for prevention and treatment programs are noted and avenues for future research are described. (shrink)

Background: The United Kingdom has the highest incarceration rate in Western Europe. It is known that women in prison are a vulnerable female population who are at risk of mental ill-health due to disadvantaged and chaotic life experiences. Accurate numbers of pregnant women held in UK prisons are not recorded, yet it is estimated that 6%–7% of the female prison population are at varying stages of pregnancy and around 100 babies are born to incarcerated women each year. There are limited (...) published papers that document the departure of the researcher following closure of fieldwork with women in prison. This article identifies the dilemmas and challenges associated with the closure of prison fieldwork through the interwoven reflections of the researcher. Departure scenarios are presented which illuminate moments of closure talk with five women, supported by participant reflections regarding abandonment and loss, making pledges for the future, self-affirmation, incidental add-ons at the end of an interview and red flags, alerting the researcher to potential participant harm through ill health or self-injury. Objectives: The primary intention of the study was to observe the pregnant woman’s experience with the English prison system through interviews with pregnant women and field observations of the environment. Research design: Ethnographic design enabled the researcher, a practising midwife, to engage with the prisoners’ pregnancy experiences in three English prisons, which took place over 10 months during 2015–2016. Data collection involved semi-structured, audio-recorded interviews with 28 female prisoners in England who were pregnant or had recently given birth while imprisoned, 10 members of staff and a period of non-participant observation. Follow-up interviews with 5 women were undertaken as their pregnancies progressed. Computerised qualitative data analysis software was used to generate and analyse pregnancy-related themes. Ethical considerations: Favourable ethical opinion was granted by National Offender Management Services through the Health Research Authority Integrated Research Application System and permission to proceed was granted by the University of Hertfordshire, UK. Findings: Thematic analysis enabled the identification of themes associated with the experience of prison pregnancy illuminating how prison life continues with little consideration for their unique physical needs, coping tactics adopted and the way women negotiate entitlements. On researcher departure from the field, the complex feelings of loss and sadness were experienced by both participants and researcher. Discussion: To leave the participant with a sense of abandonment following closure of fieldwork, due to the very nature of the closed environment, risks re-enactment of previous emotional pain of separation. Although not an ethical requirement, the researcher sought out psychotherapeutic supervision during the fieldwork phase with ‘Janet’, a forensic psychotherapist, which helped to highlight the need for careful closure of research/participant relationships with a vulnerable population. This article brings to the consciousness of prison researchers the need to minimise potential harm by carefully negotiating how to exit the field. Reflections of the researcher are interlinked with utterances from some participants to illustrate the types of departure behaviours. Conclusion: Closure of fieldwork and subsequent researcher departure involving pregnant women in prison requires careful handling to uphold the ethical research principle ‘do no harm’. (shrink)

Prominent accounts of collective intentional activity explain the nature of social groups by virtue of a specific criterion: goal-directedness. In doing so, these accounts offer little in the way of determining whether there are any differences among social groups. In this paper, I propose a refined framework of collective intentional activity that can distinguish among social groups better than alternative accounts, and which has revisionary but nevertheless plausible implications for the nature of the family: specifically, that certain friendship relationships may (...) count as genuinely familial, and that we ought to count them as such. I argue that social groups are distinguished by what we can expect from one another within different kinds of social groups; specifically, that there is an important difference between reciprocity that is equivalent in performance and reciprocity that is equivalent in intention; familial groups are specifically guided by this latter kind of reciprocity. This more inclusive definition of familial groups may have important implications for how such groups are supported within a given society – for instance, by recognizing certain caring relations as essential for well-being and supporting them accordingly. Although the reception of John Dewey's _Art as Experience_ has not been totally ignored by secondary literature, the few works that have dealt with the subject have been restricted to the English-speaking context, and more specifically to the United States. This essay sought to consider the reception of Dewey's book on aesthetics in the context of Spanish-speaking countries, with special attention to Mexico, Spain, Colombia, and Argentina. The hypothesis put forward and supported here is that _Art as Experience_ had a (...) late reception due to political and cultural factors in these countries and that it is at present that we really find a deeper reception of this work, with an increasing number of publications about the subject. In his inaugural lecture as director of the Institute for Social Research at the University of Frankfurt, Horkheimer points out the need for a new understanding of history that avoids the contemporary versions of the Hegelian Verklärung. He synthesizes this challenge with an imperative: to do justice to past suffering. The result of this appeal can be found in the works of the members of the Frankfurt School in the form of multiple, even divergent, trains of thought that reach with (...) unlike intensities the current debates on memory and its link with history. This paper focuses on three of these trains, which can be traced back to different periods of the work of Herbert Marcuse. It intends to systematize and present what can be considered alternative—although not necessarily contradictory—approaches aroused from the same concern over the critical power of nonreconciliatory memory: first, a genealogy inquiry that deconstructs the reified character of the given; second, a recollection of past images of happiness; and finally, a memory of the limits of all attainable freedom. Exploring these three moments, their shortcomings and tensions, may shed light on the complexity and present importance of the challenge they intend to face. (shrink)

In order to move towards an Ethic of Accounting, one must start by defining the function and role of the accountant. This in turn depends to a great extent on the identity of the client or whatever party the Accountant owes his loyal agency to. The issue is one of cardinal importance, and it is perceived as such by the accountants themselves. Loeb for instance says that the client-identity issue is overriding importance now, and will become even more crucial in (...) the immediate years ahead. The question of what constitutes ethical behaviour on the part of the accountant will depend then upon the relation within which such ethical behaviour will have to be deployed.The main question raised in this paper will therefore be, is the accountant primarily engaged by one client (whether an individual or a corporation) to act as their agent, deal with their problems by loyally advancing their interests to the best of his professional competence, although within the limits imposed by law and morality? Or is the public sector to be considered the principal target of the accountant's resolute professionalism and unswerving loyalty? (shrink)

This article examines how on-air conversations between journalists indicate how US television coverage of a race-related crisis can reflect racial ideology. Using critical discourse analysis, we examined interjournalistic discourse about African Americans in national network and cable news programs that aired after Hurricane Katrina reached New Orleans. While we expected conversational semantic items from conservative Fox News to reflect racial ideology, we also found such discursive elements from politically moderate and progressive news organizations such as CBS, CNN, and MSNBC. These (...) findings are consistent with Anxiety Uncertainty Management theory, which predicts that exposure to stressors in unfamiliar settings causes individuals to think in ethnocentric, dichotomous, stereotypical ways. Our research underscores the impact of white privilege on language, communication, and news production, and the need for cultural competence training to enhance journalists’ ability to discuss racial matters with ease. The idea at the core of the New Mechanical account of explanation can be summarized in the claim that explaining means showing ‘how things work’. This simple motto hints at three basic features of Mechanistic Explanation (ME): ME is an explanation-how, that implies the description of the processes underlying the phenomenon to be explained and of the entities that engage in such processes. These three elements trace a fundamental contrast with the view inherited from Hume and later from strict logical (...) empiricism (see Creath 2017), focused on epistemic and formal features of science and according to which issues concerning the kind of entities and processes that lie within a theory’s domain are extraneous to science and belong instead to ontology or metaphysics. Philosophers belonging to the new mechanical philosophy believe that the received view of scientific explanation (Hempel 2001), pivoting on the notion of law of nature, overshadows this insight. Since its origin in the 17th century, mechanical philosophy aimed to explain natural phenomena by reducing them to mechanisms. Traditional attempts to define the concept of mechanism involved the identification of a limited set of fundamental elements as, for instance, contact action, action at a distance, inertial motion (see e.g. Hesse 2005), and, more recently, transmission of a mark, or of a conserved quantity (see Frisch, this volume). The new mechanical philosophy rejects this austere characterization of mechanisms and mechanistic explanation and aim at providing a novel, philosophically rigorous explication of the concept of mechanism and of its role in scientific explanation and practice. ME has been adopted with profit in philosophy of special sciences (for instance in biomedical sciences, e.g. in the explanation of chemical transmission at synapses ((Machamer, Darden and Craver 2000), MDC henceforth); but also in social sciences, e.g. the three kinds of social mechanisms in Coleman’s analysis of Max Weber’s account of the role of the Protestant ethic in the growth of capitalism (Hedström and Swedberg 1998)), where exceptionless regularities are rarely ever found. In physics, it is generally possible to formulate explanations in law-based form, with the result that the plurality of explanatory forms might be overlooked. This should not come as a surprise, given that physics was the main inspiration for logical empiricists, and, in particular, Newtonian physics was a template for Hempel’s formulation of the covering law model. However, this situation is unfortunate, since, we will argue, knowing how things work is often part of the explanation of physical phenomena. In this chapter, we provide an introduction to the basic features of ME, with specific focus on its application to physics (section 1). The main part of the chapter is devoted to the defence of two theses: on the one hand, some domains of physics are not compatible with mechanistic reasoning and explanation (section 2); on the other hand, a comprehensive account of explanation in physics can’t dispense with ME (section 3). In 2010, Connecticut implemented an offence prohibiting minors from engaging in sexting. This legislation was part of a range of reforms across the United States aiming to better tailor the criminal law’s response to youth sexting by distinguishing sexting from child abuse material. Drawing from submissions to the Connecticut General Assembly’s Sexting Bill, media reports and recent ‘sexting’ cases, this article adopts a feminist perspective and examines the justifications for and implications of this sexting statute. It argues that while aiming (...) to create a distinction between child abuse material and sexting through a ‘lesser’ offence, these paternalistic reforms are informed by some of the same logics shaping child pornography/child abuse material law. Therefore, this statute is situated on a continuum of paternalistic legislation which utilises the constitutive expressive function of the criminal law to register anxieties about young people’s sexual and technological practices. As a result, this statute conflates victims and perpetrators of image based sexual abuses and fails to meet its deterrent and protective aims. (shrink)

Es parcializado, puesto que se lo suele interpretar bien en calve _solo _metafísica, dejando sin demarcar el tipo particular de la relación expresiva; o bien desde el _mero_ análisis de la relación expresiva como isomórfica, dejando sin atender su contenido metafísico. No solo suelen dejarse (...) ambas tendencias recíprocamente fuera de consideración, sino que ninguna de las dos suele atender a un aspecto fundamental de la expresión: el cuerpo propio de la mónada como _lugar_ para su punto de vista expresivo. El presente trabajo ofrece una reconstrucción del concepto de expresión que reconcilia ambas clases de interpretación, atendiendo, a la vez, a la exigencia del cuerpo para la acción expresiva. This paper provides information on different training models within clinical neuropsychology in Finland. Systematic specialization training program began in Finland in 1983. It was first organized mainly by the Finnish Neuropsychological Society and since 1997 by the Finnish universities. At present, close to 400 clinical neuropsychologists have completed the training. The number of professionals still does not cover the needs of the country, and geographical disparities are a constant concern. The training models in Finland have changed over the years and (...) will continue to evolve. Specialization training can be organized by national societies or by universities. It can lead to an academic degree or a diploma. It can be linked to doctoral studies or form a parallel track. Financial model can involve student fees or be governed by ministries. This paper describes and compares different strategies in education that have impact on the output of professionals. One model does not fit all, or even one country at all times. The strategies of the stakeholder ministries can change over time. The experiences from Finland can be useful for other countries that are developing their models. The estimated need of practitioners and the educational resources including the available financial models for training differ between countries. The guiding principles in specialist training should focus on the advanced competencies expected from the neuropsychologist when entering the profession. (shrink)

Preparing people for dealing with hazards, diseases and disasters requires teaching them statistics, and ideally doing so by means of good representation formats in a dynamic fashion. Translating these dynamics to simple communication is what governments need from scientists.

Individuals’ spatial position is affected by social factors. The majority of studies correlating spatial position and social factors have used methods with drawbacks. A more complete method was developed by Dolado & Beltran (2011) in captive animals. The present study aimed to apply a modified version of this method in two semi-free-ranging macaque groups. The proposed method divides group’s surroundings into different subareas, selecting different points in each subarea and calculating the coordinates of these points. We filmed each group and (...) analyzed the videos using an activated time transition recording to determine the individuals’ coordinates. With these data, we calculated spatial variables, allowing us to obtain groups’ spatial patterns. The current method improves on previous procedures and could be applied to larger study areas and groups than the method of Dolado & Beltran (2011), thus representing a viable option for studying spatial distribution patterns in semi-free-ranging macaque groups. In this article, we reflect on the particular temporal structure of pregnancies and prenatal entities with the aim to contribute to the field of the sociology of pregnancy. Medical models and technology shape today’s notion of pregnancy as a linear, nine-month developmental process that leads to the birth of a child. Through ultrasound technology and prenatal examinations, prenatal entities have thus historically gained a present ‘being’ as a developing, unborn child. While these ideas undoubtedly greatly influence the participants’ interpretations, a (...) culturalistic perspective on time alone does not do justice to the phenomenon’s lived tensions and the temporal complexity of the phenomenon. From a Schutzian perspective of time, we have worked out how practices of pregnancy and the production of meaning are shaped by an interwoven back and forth between orientations to the past, present and future. Drawing on relevant works from the sociology of pregnancy, we work out five modes of temporal references that mold the phenomenon of pregnancy: joint imagination of the couple, in which the born is anticipated as fantasies of the future, passivities of pregnancy, in which the desired future is experienced as unable to influence, the presentification of the unborn in and through visual and bodily-somatic contact moments, its futurization through the cultivation of a ‘not-yet’ and prenatal losses, as a critical rupture with the anticipated and desired future. Our analysis underlines the potential of a time sociological perspective on pregnancy and the constitution of relationships and persons. (shrink)

In many European countries,organic agriculture has rapidly beentransformed from a farmers' movement to aninstitutionalized part of agricultural policy.In certification, compliance with publishedorganic standards is verified through annualinspections on farms. In Finland, the role ofadvice in organic inspections has been thesubject of debate. Two inspections are usedhere to show how the term organic was definedand what the role of advice in relation tocompliance was. Both compliance and advisorytypes of interaction between the inspector andthe farmer were identified along an axis from “input (...) substitution” to “system redesign.” Thefindings illustrate the heterogeneity of theprocesses and definitions of the term organicin connection with inspections. System redesignwas less obvious in compliance than items ininspection documents suggest. The physicalsurroundings and the methods used affectinspection practices. Institutionalization isnot merely negative, but may also provideresources for system redesign. Whether adviceis part of a new and emerging way of enforcinginspections is considered. The findings suggestthat dialogue and negotiation are necessary inpromoting system redesign and in enhancing thedevelopmental functions of organicinspections. (shrink)

El siguiente trabajo busca entrecruzar algunos hallazgos de tres investigaciones antropológicas en Uruguay de las que he formado parte: una abordó las negociaciones sexuales y las estrategias que las mujeres ponen en práctica para gestionar las diferencias que se dan en los encuentros heterosexuales; otra, las significaciones y vivencias de lo erótico en practicantes de amor libre y de BDSM; la tercera los modelos de sexualidad y amor que se vienen construyendo y reafirmando desde iglesias neopentecostales en base a discursos (...) antigénero. El propósito será construir un diálogo entre estas investigaciones para visualizar las distintas formas que adopta el erotismo en estos contextos, considerando las prácticas y discursos de diverses actores sociales. En particular, el interés estará puesto en identificar de qué forma el erotismo puede ser útil para cuestionar o reafirmar los modelos sexo-afectivos dominantes, caracterizados por el patriarcado, la heterosexualidad y la monogamia como sistemas, y el binarismo y la complementariedad sexo-genérica. Las voces de les distintes actores darán cuenta de cómo se encarnan, resisten, modifican, desmontan, reconstruyen o reafirman estos modelos sexo-afectivos a través de sus prácticas y discursos. A foundational goal of cognitive linguistics is to explain linguistic phenomena in terms of general cognitive strategies rather than postulating an autonomous language module (Langacker 1987: 12–13). Metonymy is identified among the imaginative capacities of cognition (Langacker 1993: 30, 2009: 46–47). Whereas the majority of scholarship on metonymy has focused on lexical metonymy, this study explores the systematic presence of metonymy in word-formation. I argue that in many cases, the semantic relationships between stems, affixes, and the words they form can (...) be analyzed in terms of metonymy, and that this analysis yields a better, more insightful classification than traditional descriptions of word-formation. I present a metonymic classification of suffixal word-formation in three languages: Russian, Czech, and Norwegian. The system of classification is designed to maximize comparison between lexical and word-formational metonymy. This comparison supports another central claim of cognitive linguistics, namely that grammar (in this case word-formation) and lexicon form a continuum (Langacker 1987: 18–19), since I show that metonymic relationships in the two domains can be described in nearly identical terms. While many metonymic relationships are shared across the lexical and grammatical domains, some are specific to only one domain, and the two domains show different preferences for source and target concepts. Furthermore, I find that the range of metonymic relationships expressed in word-formation is more diverse than what has been found in lexical metonymy. There is remarkable similarity in word-formational metonymy across the three languages, despite their typological differences, though they all show some degree of language-specific behavior as well. Although this study is limited to three Indo-European languages, the goal is to create a classification system that could be implemented (perhaps with modifications) across a wider spectrum of languages. A case‐study essay, for example, argues that the dismaying decision to perform resuscitation efforts on a patient who had obviously been dead for some time can be understood in the context of the harmful practice of defensive medicine. A narrative essay concerns whether an adolescent with locked‐in syndrome should be asked her wishes about life‐sustaining interventions, and the articles illuminate the ethical (...) value of the parental role in pediatric decision‐making, an array of ways in which patient decision‐making is interdependent, and the limitations of measures designed to evaluate the quality of a patient's decision and decision‐making process. Women’s capacity to reproduce varies over the life span, and developmental goals such as family formation are age-graded and shaped by social norms about the appropriate age for completing specific developmental tasks. Thus, a woman’s age may be linked to her ideas about what an ideal partner should be like. With the goals of replicating and extending prior research, in this study we examined the role of age in women’s partner preferences across the globe. We investigated associations of age with (...) ideal long-term partner preferences in a cross-cultural sample of 17,254 single (i.e., unpartnered) heterosexual women, ages 18 to 67, from 147 countries. Data were collected via an online questionnaire, the Ideal Partner Survey. Confirming our preregistered hypotheses, we found no or only negligible age effects on preferences for kindness-supportiveness, attractiveness, financial security-successfulness, or education-intelligence. Age was, however, positively associated with preferences for confidence-assertiveness. Consistent with family formation goals, age was associated with an ideal partner’s parenting intentions (high until approximately age 30, then decreasing afterward). Age range deemed acceptable (and in particular, the discrepancy between one’s own age and the minimum ideal age of a partner) increased with age. This latter pattern also replicated in exploratory analyses based on subsamples of lesbian and bisexual women. In summary, age has a limited impact on partner preferences. Of the attributes investigated, only preference for confidence-assertiveness was linked with age. However, age range deemed acceptable and an ideal partner’s parenting intention, a dimension mostly neglected in earlier research, substantially vary with age. (shrink)

L’investigazione del testo, che pone il «valore di legge» ma che disorienta il diritto accostando al valore la «forza di legge», passa dalla sua scomposizione, dall’interrogazione delle lettere che sono depositate e custodite nei suoi anfratti, negli interstizi. Bisogna, cioè, seguire tanto l’esplicito, la superficie, quanto le tracce disseminate, talvolta nascoste, senza dimenticare che la superficie è tale per il profondo. La ricerca muove da un’opzione ermeneutica. Ogni ricerca presuppone un’ipotesi preliminare, che l’inchiesta abbia già una direzione. In principio era (...) il Verbo e il Verbo si fece carne, ma in un senso peculiare. Nella Seconda Lettera ai Corinzi, Paolo di Tarso disse che «la lettera uccide, lo spirito dà vita», opponendo la Legge cristiana, la buona novella, l’evangelo, la parola orale portata «sulle tavole di carne dei [...] cuori», alla Legge ebraica, antica, immobile, rigida, scritta «su tavole di pietra». Altrove, però, nella Lettera ai Romani, precisò: «Togliamo dunque ogni valore alla legge mediante la fede? Nient’affatto, anzi confermiamo la legge», ove la legge, a cui il valore è qui già legato da una relazione di predicazione, è la lettera giudaica e la fede è lo spirito vivente della rivelazione cristiana. Ecco che il «valore di legge» è la secolarizzazione, più o meno consapevole, di un tema messianico. E, muovendo dalla prospettiva teologica in cui la Legge “significa”, si azzarda che «la lettera uccide chi la ignora». Contro lo spettro paolino, o meglio prima del paolinismo e poi dell’agostinismo, dell’ordine nuovo dello spirito contro la antica, morta, silente, lettera, questa lettura della Legge tenta di farsi carico del peso del testo, di “valorizzarlo” e di non ridurlo a figura, a immagine di altro, ad anagogia o ad allegoria con quel tanto di nichilismo che questa porta con sé, ove la lettera assume valore ancillare. La lettera della Legge è dura, nel senso che è, teologicamente, «scrittura su tavola» ed è, nel Secolo, scrittura incisa su carta. Ha una sua fissità, seppure alterabile. La sua normatività è tutt’uno con la sua inscalfibilità, con la sua resistenza e, dunque, con la sua positività. Ma – per restare dentro l’ordine discorsivo dell’interpretazione della Scrittura – non si avanza una proposta interpretativa masoretica, che venera superstiziosamente la lettera della Scrittura originaria e men che meno il pensiero e la voce di chi la creò e rivelò. Tutto al contrario. Per dirla nel discorso dell’interpretazione delle leggi e, tra esse, della prima legge, la Costituzione, implica il testualismo, ma non nella versione soggettivistica dell’original intent, perché i testi scritti, che sono “cose”, vivono di vita propria, separata dal loro autore (o “firmatario”) e dai lettori, potenzialmente infiniti, e producono sensi e conseguenze inintenzionali. Senza arrivare alla radicale conclusione strutturalista di Roland Barthes, che già nel 1968 decretava La mort de l’auteur, perché lo impedisce – ove ritenuta applicabile alla Costituzione/legge – l’art. 12 delle preleggi che prescrive di ricavare il senso della legge fatto palese (anche) dall’intenzione del legislatore, l’autore si trasfigura in funzione (dell’autore), perde la propria individualità e intenzionalità e si confonde, si disfa, nel discorso, nell’ordine del testo. La scissione strutturalista (e non solo) tra autore e testo nella teoria costituzionale conduce difilato al rigetto delle ragioni dell’originalismo ingenuo delle intenzioni e, con esso, del mito delle origini, ma non porta affatto all’oblio del testo in nome della esclusiva normatività della unwritten o living Constitution: sostiene, anzi, il privilegio della scrittura della legge e non della voce, del corpo e non del senso. Nel mezzo, contro il dualismo tra materia e pensiero, tra il significato immanente alle lettere, “cose scritte” nel testo e il tesoro delle intenzioni di chi scrisse la Costituzione, ciò che conta è la posizione, la “incorporazione”, nel documento costituzionale, nella scrittura che si fa testo nel senso proprio di “tessuto”, del «valore di legge» che, almeno nella “lettera”, è rimasto incorrotto e che quelle lettere hanno agito sul testo che le ha accolte e il testo ha retroagito su quelle nel tempo. Le possibilità discorsive e significanti del valore di legge dipendono, cioè, strutturalmente, dal reticolo di dati interrelati e interdipendenti che lo legano seguendo la logica interna al testo costituzionale. Va da sé che la valorizzazione della (lettera della) Legge presupponga, all’origine, un sottinteso ebraico e, quindi, la lotta alla polemica paolina contro il formalismo conservatore della legge (ebraica). È una polemica simile all’accusa di conservatorismo dell’originalismo testualista. A difesa, il testualismo è conservatore o meno a seconda del testo che serve e della relazione tra il testo dell’origine e le interpretazioni che ne sono seguite. Ma, contro l’originalismo, contro la conversione del testo costituzionale in Sacra Scrittura, la lettura che qui si esperisce si apre al commento – che quel reticolo sappia analizzare – del testo, alla sua significatività mai esaurita, che annulla la concepibilità di un testo originario inteso quale testo “autentico”.
