L’investigazione del testo, che pone il «valore di legge» ma che disorienta il diritto accostando al valore la «forza di legge», passa dalla sua scomposizione, dall’interrogazione delle lettere che sono depositate e custodite nei suoi anfratti, negli interstizi. Bisogna, cioè, seguire tanto l’esplicito, la superficie, quanto le tracce disseminate, talvolta nascoste, senza dimenticare che la superficie è tale per il profondo. La ricerca muove da un’opzione ermeneutica. Ogni ricerca presuppone un’ipotesi preliminare, che l’inchiesta abbia già una direzione. In principio era (...) il Verbo e il Verbo si fece carne, ma in un senso peculiare. Nella Seconda Lettera ai Corinzi, Paolo di Tarso disse che «la lettera uccide, lo spirito dà vita», opponendo la Legge cristiana, la buona novella, l’evangelo, la parola orale portata «sulle tavole di carne dei [...] cuori», alla Legge ebraica, antica, immobile, rigida, scritta «su tavole di pietra». Altrove, però, nella Lettera ai Romani, precisò: «Togliamo dunque ogni valore alla legge mediante la fede? Nient’affatto, anzi confermiamo la legge», ove la legge, a cui il valore è qui già legato da una relazione di predicazione, è la lettera giudaica e la fede è lo spirito vivente della rivelazione cristiana. Ecco che il «valore di legge» è la secolarizzazione, più o meno consapevole, di un tema messianico. E, muovendo dalla prospettiva teologica in cui la Legge “significa”, si azzarda che «la lettera uccide chi la ignora». Contro lo spettro paolino, o meglio prima del paolinismo e poi dell’agostinismo, dell’ordine nuovo dello spirito contro la antica, morta, silente, lettera, questa lettura della Legge tenta di farsi carico del peso del testo, di “valorizzarlo” e di non ridurlo a figura, a immagine di altro, ad anagogia o ad allegoria con quel tanto di nichilismo che questa porta con sé, ove la lettera assume valore ancillare. La lettera della Legge è dura, nel senso che è, teologicamente, «scrittura su tavola» ed è, nel Secolo, scrittura incisa su carta. Ha una sua fissità, seppure alterabile. La sua normatività è tutt’uno con la sua inscalfibilità, con la sua resistenza e, dunque, con la sua positività. Ma – per restare dentro l’ordine discorsivo dell’interpretazione della Scrittura – non si avanza una proposta interpretativa masoretica, che venera superstiziosamente la lettera della Scrittura originaria e men che meno il pensiero e la voce di chi la creò e rivelò. Tutto al contrario. Per dirla nel discorso dell’interpretazione delle leggi e, tra esse, della prima legge, la Costituzione, implica il testualismo, ma non nella versione soggettivistica dell’original intent, perché i testi scritti, che sono “cose”, vivono di vita propria, separata dal loro autore (o “firmatario”) e dai lettori, potenzialmente infiniti, e producono sensi e conseguenze inintenzionali. Senza arrivare alla radicale conclusione strutturalista di Roland Barthes, che già nel 1968 decretava La mort de l’auteur, perché lo impedisce – ove ritenuta applicabile alla Costituzione/legge – l’art. 12 delle preleggi che prescrive di ricavare il senso della legge fatto palese (anche) dall’intenzione del legislatore, l’autore si trasfigura in funzione (dell’autore), perde la propria individualità e intenzionalità e si confonde, si disfa, nel discorso, nell’ordine del testo. La scissione strutturalista (e non solo) tra autore e testo nella teoria costituzionale conduce difilato al rigetto delle ragioni dell’originalismo ingenuo delle intenzioni e, con esso, del mito delle origini, ma non porta affatto all’oblio del testo in nome della esclusiva normatività della unwritten o living Constitution: sostiene, anzi, il privilegio della scrittura della legge e non della voce, del corpo e non del senso. Nel mezzo, contro il dualismo tra materia e pensiero, tra il significato immanente alle lettere, “cose scritte” nel testo e il tesoro delle intenzioni di chi scrisse la Costituzione, ciò che conta è la posizione, la “incorporazione”, nel documento costituzionale, nella scrittura che si fa testo nel senso proprio di “tessuto”, del «valore di legge» che, almeno nella “lettera”, è rimasto incorrotto e che quelle lettere hanno agito sul testo che le ha accolte e il testo ha retroagito su quelle nel tempo. Le possibilità discorsive e significanti del valore di legge dipendono, cioè, strutturalmente, dal reticolo di dati interrelati e interdipendenti che lo legano seguendo la logica interna al testo costituzionale. Va da sé che la valorizzazione della (lettera della) Legge presupponga, all’origine, un sottinteso ebraico e, quindi, la lotta alla polemica paolina contro il formalismo conservatore della legge (ebraica). È una polemica simile all’accusa di conservatorismo dell’originalismo testualista. A difesa, il testualismo è conservatore o meno a seconda del testo che serve e della relazione tra il testo dell’origine e le interpretazioni che ne sono seguite. Ma, contro l’originalismo, contro la conversione del testo costituzionale in Sacra Scrittura, la lettura che qui si esperisce si apre al commento – che quel reticolo sappia analizzare – del testo, alla sua significatività mai esaurita, che annulla la concepibilità di un testo originario inteso quale testo “autentico”. Which standards should we employ to evaluate the global order? Should they be standards of justice or standards of legitimacy? In this article, I argue that liberal political theorists need not face this dilemma, because liberal justice and legitimacy are not distinct values. Rather, they indicate what the same value, i.e. equal respect for persons, demands of institutions under different sets of circumstances. I suggest that under real-world circumstances – characterized by conflicts and disagreements – equal respect demands basic-rights protection (...) and democratic participation, which I here call ‘political justice’. I conclude the article by considering three possible configurations of the global order – the ‘democratic world-state’, ‘independent democratic states’, and ‘mixed’ models – and argue that a commitment to political justice speaks in favour of the latter. Recent work at the junction of epistemology and political theory focuses on the notion of epistemic injustice, the injustice of being wronged as a knower. Miranda Fricker (2007) identifies two kinds of epistemic injustice. I focus here on hermeneutical injustice in an attempt to identify a difficulty for Fricker's account. In particular, I consider the significance of background social conditions and suggest that an epistemic injustice should not rely on other forms of disadvantage to achieve its status as an injustice. When people describe motion events, their path expressions are biased toward inclusion of goal paths (e.g., into the house) and omission of source paths (e.g., out of the house). In this paper, we explored whether this asymmetry has its origins in people’s non-linguistic representations of events. In three experiments, 4-year-old children and adults described or remembered manner of motion events that represented animate/intentional and physical events. The results suggest that the linguistic asymmetry between goals and sources is not fully rooted (...) in non-linguistic event representations: linguistic descriptions showed the goal bias for both kinds of events, whereas non-linguistic memory for events showed the goal bias only for events involving animate, goal-directed motion. The findings are discussed in terms of the mapping between non-linguistic representations of goals and sources in language, focusing on the role that linguistic principles play in producing a more absolute goal bias from more gradient non-linguistic representations of paths. Much contemporary political philosophy claims to be Kant-inspired, but its aims and method differ from Kant's own. In his recent book, Force and Freedom, Arthur Ripstein advocates a more orthodox Kantian outlook, presenting it as superior to dominant (Kant-inspired) views. The most striking feature of this outlook is its attempt to ground the whole of political morality in one right: the right to freedom, understood as the right to be independent of others’ choices. Is Ripstein's Kantian project successful? In this (...) research note I argue that it is not. First, I suggest that Ripstein's notion of freedom is viciously circular. It is meant to ground all rights, but in fact it presupposes an account of those rights. Second, I show that—independently of its inability to ground a whole political morality—such a moralized understanding of freedom is normatively unappealing. (shrink)

This article examines the methodology of a core branch of contemporary political theory or philosophy: “analytic” political theory. After distinguishing political theory from related fields, such as political science, moral philosophy, and legal theory, the article discusses the analysis of political concepts. It then turns to the notions of principles and theories, as distinct from concepts, and reviews the methods of assessing such principles and theories, for the purpose of justifying or criticizing them. Finally, it looks at a recent debate (...) on how abstract and idealized political theory should be, and assesses the significance of disagreement in political theory. Sexual self-determination is considered a fundamental human right by most of us living in Western societies. While we must abide by laws regarding consent and coercion, in general we expect to be able to engage in sexual behaviour whenever, and with whomever, we choose. For older people with dementia living in residential aged care facilities (RACFs), however, the issue becomes more complex. Staff often struggle to balance residents' rights with their duty of care, and negative attitudes towards older people's sexuality (...) can lead to residents' sexual expression being overlooked, ignored, or even discouraged. In particular, questions as to whether residents with dementia are able to consent to sexual activity or physically intimate relationships pose a challenge to RACF staff, and current legislation does little to assist them. This paper will address these issues, and will argue that, while every effort should be made to ensure that no resident comes to harm, RACFs must respect the rights of residents with dementia to make decisions about their sexuality, intimacy and physical relationships. In this paper I argue, against recent claims by Bermúdez and Toribio , that within the debate about whether perceptual experiences are nonconceptual, ‘state nonconceptualism’ can be a coherent and plausible position. In particular, I explain that state nonconceptualism and content nonconceptualism, when understood in their most plausible and motivated form, presuppose different notions of content. I argue that state nonconceptualism can present a plausible way of unpacking the claim that perceptual experiences are nonconceptual once the notion of content it (...) should presuppose is taken into account; and once this notion of content is clearly distinguished from the one usually presupposed by content nonconceptualism, the criticisms that Bermúdez and Toribio place against state nonconceptualism become ineffective. This article provides a much‐needed review of the neural bases of implicit statistical learning. Batterink, Paller and Reber focus on the neural processes that underpin performance in experimental paradigms employed in implicit learning and statistical learning research. An important insight is that learning across all paradigms is supported by interactions between the declarative and nondeclarative memory systems of the brain. They conclude with a helpful discussion of future directions of research.

En este artículo abordo la deriva más polémica del debate clásico en torno al realismo científico, a saber: la discusión sobre la naturaleza de los hechos de los que se ocupan las ciencias.

One way visual representations might function in scientific reasoning is to convey content that is true or false, analogous to making a claim. An alternative way that visual representations might function is as an object that may make statements true or false, but is not itself true or false, analogous to a scientific model. Analysis of two key ways of characterizing genes—as causes of phenotypic effects and as genomic DNA sequences—has yielded widespread pessimism that they can be united in a coherent gene concept. This raises important questions about the epistemology of genomic research: If analysis of a genome sequence cannot yield information about genes defined both in terms of their products and their DNA sequence, then what could we learn from it? Musical systems develop associations over time between aspects of musical form and concepts from outside of the music. Experienced listeners internalize these connotations, such that the formal elements bring to mind their extra-musical meanings. An example of musical form-meaning mapping is the association that Western listeners have between the major and minor modes and happiness and sadness, respectively. We revisit the emotional semantics of musical mode in a study of 44 American participants (musicians and non-musicians) who each evaluated the relatedness (...) of 96 melody-word pairs. Among the tonal melodies, we manipulated mode (major and minor) and timbre (clarinet and flute) while systematically controlling for other musical factors including pitch register and melodic contour. Similarly, among the English words, we manipulated word affect (happy and sad) while systematically controlling for other lexical factors including frequency and word length. Results demonstrated that participants provided a higher proportion of related responses for major melodies paired with happy words and minor melodies paired with sad words than for the reverse pairings. This interaction between mode and word affect was highly significant for both musicians and non-musicians, albeit with a larger effect for the former group. Further interactions with timbre suggested that while both clarinet and flute conveyed happiness when in the major mode, the clarinet was somewhat more successful than the flute at conveying sadness in the minor mode. Debriefing questionnaires suggested that the majority of the participants, including all of the non-musicians, had no awareness of the major-minor manipulation, and instead directed their attention to register and contour. We argue that the affective character of the major and minor modes is but one example of form-meaning mapping in music, and suggest further exploration of the roles of timbre, register, and contour in conveying musical emotions. Given the bewildering array of measures available, and ambiguity regarding when and how to measure particular aspects of well-being, knowledge in the field can be difficult to reconcile. Representing numerous disciplines including psychology, economics, sociology, statistics, public health, theology, and philosophy, contributors consider the philosophical and theological traditions on happiness, well-being and the good life, as well as recent empirical research on well-being and its measurement. Leveraging insights across diverse (...) disciplines, they explore how research can help make sense of the proliferation of different measures and concepts, while also proposing new ideas to advance the field. Some chapters engage with philosophical and theological traditions on happiness, well-being and the good life, some evaluate recent empirical research on well-being and consider how measurement requirements may vary by context and purpose, and others more explicitly integrate methods and synthesize knowledge across disciplines. The goal of the following paper is to consider the development and viability of Korsgaard’s latest work, Self-Constitution. More specifically, I show that we should understand this book as a response to difficulties with both Korsgaard’s argument in 1996’s The Sources of Normativity and Korsgaard’s earlier attempts to explain what marks the difference between realist and constructivist approaches to ethical theory. I begin by focusing primarily on her essay “Realism and Constructivism in Twentieth-Century Moral Philosophy.” Here I consider exactly how (...) Korsgaard defines constructivism and what makes constructivism different from realist approaches to ethics. I then examine Korsgaard’s two most influential books – Sources and Self-Constitution – in light of this definition. Looking at Sources I argue that there is a serious problem with Korsgaard’s attempt to develop a constructivist moral theory; more specifically, I expose a tension in Korsgaard’s claim that ethical concepts both are rooted in a philosophy of action and exist only as the solution to a concrete practical problem. I then turn to Self-Constitution. I show that a different account of the distinction between realism and constructivism is proposed, one that not only seems designed to avoid the problems that plagued Sources but also forces Korsgaard to significantly revise and retreat from earlier attempt to distinguish constructivism from realism. Despite substantial research on overall decision-making capacity levels in schizophrenia, the factors that cause individuals to make errors when making decisions regarding research participation or treatment are relatively unknown. We examined the responses of 84 individuals, middle-aged or older, with schizophrenia or schizoaffective disorder. We used a structured decision-making capacity measure, the MacArthur Competence Assessment Tool for Clinical Research, to determine the frequency and apparent cause of participants’ errors. We found that most errors were due to difficulty recalling the disclosed (...) information, particularly the study’s procedures, potential risks, and purpose. Errors attributable to concrete thinking, psychotic symptoms, or perceived coercion were rarer. These results suggest that informed consent procedures for this population might be improved by providing information in a way that facilitates learning and memory, such as iterative disclosure of the information, corrective feedback, and emphasis of key points of the study—for instance, its purpose, procedures, and potential risks. There is a debate within philosophy of literature as to whether narrative artworks should be judged morally, for their ethical value, meaning and impact. On one side you have the aesthetes, defenders of aestheticism, who deny the ethical value of an artwork can be taken into consideration when judging the work’s overall aesthetic value. Richard Posner backs artists such as Oscar Wilde who famously wrote, ‘there is no such thing as a moral or an immoral book. Books are well written, (...) or badly written. That is all’. On the other side of the debate are proponents of ethical criticism such as Martha Nussbaum, Wayne Booth, Noël Carroll and Mary Devereaux. This article examines the educational implications of each position and ultimately defends the importance of moral education alongside aesthetic education. Given artworks are powerful vehicles for moral sentiments and meaning, it is important that viewers are taught to engage critically with art’s ethical features as well as aesthetic features. In this way, educational concerns pose a challenge to the position of aestheticism. (shrink)

In Australia, the ethics of the use of animals for scientific purposes are assessed by Animal Ethics Committees that are comprised of the four major parties involved in the animal experimentation debate: veterinarians, scientists using animals, animal welfare representatives and members of the public. AECs are required to assess animal experiments as ethical based on a cost/benefit analysis, suggesting the use of consequentialist ethics. However, people are more likely to use a mixture of frameworks when making ethical decisions. Therefore, we (...) hypothesised that AEC members will make their decisions using argumentation relying on multiple frameworks, including ethical relativism, deontology and emotional ethics; frameworks commonly used in the public debate about animal experimentation. The language used by AEC members, examined using discourse analysis techniques, can indicate which ethical frameworks they rely upon. Using a role playing method, representatives from each of the four AEC categories discussed the ethical value of eight fictional protocols involving animal experimentation. The discussions were recorded and analysed using Nvivo for instances of emotional and ethical language. Data were analysed using ANOVAs and Tukey tests. This volume presents new philosophical perspectives on environmental emotions. It explores the motivating nature of emotions such as anger, grief, and hope in relation to the current climate crisis. Many of our emotional responses to the climate crisis take a distressed form like anxiety, despair, or grief. However, these emotions almost always coexist with hope, drive toward action, or a strengthened sense of relationality and belonging. This book explores the different levels at which these tensions take place. Part 1 discusses (...) the conceptual and linguistic notions we use to make sense of our ecological predicament. Part 2 looks at the embedded dimension of our emotions: how we feel about the climate crisis as members of our communities and how our emotions are interconnected with what we do and how we work in and for our communities. Several chapters in this section explicitly discuss hope. Finally, Part 3 has a phenomenological and existential focus: it explores the nature of the rootedness and how it shapes our emotional experiences during the climate crisis. This article deals with the discussion on the status of the human embryo in Italy on a philosophical, socio-ethical and juridical level before, during and after the law. Different lines of thought are outlined and critically discussed. The focus is the debate over the so-called embryonic stem cells, pointing out the ethical premises and the juridical implications. The regulations in Italy are analysed in detail, referring to legislation and jurisprudence. In particular the author includes evidence for the debate after the (...) law came in, with specific attention on the question of the use of imported embryonic stem cells and public financing for research and the problem of the use of frozen and non-implantable embryos. Kant thinks poetry is the greatest of all the arts, and that Milton is one of the greatest poets. Sanford Budick, a professor of English from Hebrew University, investigates the Miltonic echoes in Kant’s work in this very thorough, dense, and deliberate study. Budick argues that Milton’s poetic form, especially his use of successive images, informs some of the most crucial and complex passages in Kant’s ethical and aesthetic theory. Budick concedes that it may seem strange to blur the line (...) between poetry and philosophy, but he also underlines the fact that “in Kant’s world poetry and philosophy had not yet experienced the virtual divorce that characterizes our own age” (119). This paper responds to Love's Labor, Eva Feder Kittay's seminal contribution to feminist disability theory, arguing that Kittay's “nested obligations” approach creates a two-tiered system of justice in which care relationships built around private dependence and private obligation are figured as wholly prepolitical, to the detriment of both gender justice and disability justice. I suggest that centering the civic membership of the disabled person allows us to keep what is valuable in Kittay's contribution, namely her theorization of the nature of (...) care and its political significance, and her call for collective support of care relationships, while omitting the nesting of obligations and resituating care recipients and care workers as equal and interdependent. El mandato de proporcionalidad se ha convertido desde hace algunos años en un examen de aplicación frecuente por tribunales nacionales o internacionales para la determinación de violaciones a los derechos. Se ha llegado a sostener que la "proporcionalidad es un criterio universal de constitucionalidad". Sin suponer semejante alcance de aplicación de este examen, el presente trabajo explora las debilidades y fortalezas de su aplicación por un tribunal constitucional en el marco de una práctica constitucional relativamente estable. Se reconstruye un conjunto (...) abultado de reglas que pretenden delimitar el resultado del examen de proporcionalidad (como mandato de prohibición por acción excesiva y como mandato de prohibición por omisión o acción insuficiente). De esta forma se demuestra que un modelo de proporcionalidad orientado por reglas se aleja del criticado modelo de ponderaciones ad hoc en donde el tribunal adquiere un amplio margen de discrecionalidad para resolver el conflicto entre derechos. Se advierte, sin embargo, que el modelo de proporcionalidad orientado por reglas requiere de una dogmática de los derechos fundamentales crítica y de tribunales superiores que se interpreten como parte de una comunidad argumentativa abierta al debate público, de lo contrario este examen puede ser utilizado como una herramienta para justificar un status quo desigualitario.
