Recent work at the junction of epistemology and political theory focuses on the notion of epistemic injustice, the injustice of being wronged as a knower. Miranda Fricker (2007) identifies two kinds of epistemic injustice. I focus here on hermeneutical injustice in an attempt to identify a difficulty for Fricker's account. In particular, I consider the significance of background social conditions and suggest that an epistemic injustice should not rely on other forms of disadvantage to achieve its status as an injustice. Sexual self-determination is considered a fundamental human right by most of us living in Western societies. While we must abide by laws regarding consent and coercion, in general we expect to be able to engage in sexual behaviour whenever, and with whomever, we choose. For older people with dementia living in residential aged care facilities (RACFs), however, the issue becomes more complex. Staff often struggle to balance residents' rights with their duty of care, and negative attitudes towards older people's sexuality (...) can lead to residents' sexual expression being overlooked, ignored, or even discouraged. In particular, questions as to whether residents with dementia are able to consent to sexual activity or physically intimate relationships pose a challenge to RACF staff, and current legislation does little to assist them. This paper will address these issues, and will argue that, while every effort should be made to ensure that no resident comes to harm, RACFs must respect the rights of residents with dementia to make decisions about their sexuality, intimacy and physical relationships. Millions of people in our world are in need of assistance: from the global poor, to refugees, from the victims of natural disasters, to those of violent crimes. What are our responsibilities towards them? Christian Barry and Gerhard Øverland’s answer is plausible and straightforward: we have enforceable duties to assist others in need whenever we can do so ‘at relatively moderate cost to ourselves, and others’. Barry and Øverland defend this answer on the ground that it best fits our intuitions (...) in a variety of hypothetical rescue scenarios. I argue that, although Barry and Øverland’s view is intuitively appealing, appeal to intuitive cases is insufficient to vindicate it satisfactorily. Intuitive cases alone do not allow us to establish: (i) what costs count as moderate and (ii) whether assistance-based responsibilities are, in fact, enforceable. These considerations suggest that Barry and Øverland’s defence of their preferred answer to the assistance question may be incomplete. (shrink)

In 2010, Connecticut implemented an offence prohibiting minors from engaging in sexting. This legislation was part of a range of reforms across the United States aiming to better tailor the criminal law’s response to youth sexting by distinguishing sexting from child abuse material. Drawing from submissions to the Connecticut General Assembly’s Sexting Bill, media reports and recent ‘sexting’ cases, this article adopts a feminist perspective and examines the justifications for and implications of this sexting statute. It argues that while aiming (...) to create a distinction between child abuse material and sexting through a ‘lesser’ offence, these paternalistic reforms are informed by some of the same logics shaping child pornography/child abuse material law. Therefore, this statute is situated on a continuum of paternalistic legislation which utilises the constitutive expressive function of the criminal law to register anxieties about young people’s sexual and technological practices. As a result, this statute conflates victims and perpetrators of image based sexual abuses and fails to meet its deterrent and protective aims. (shrink)

This article reflects on the ‘Philosophy and Gender’ project, which introduced the pedagogical technique known as the ‘Community of Inquiry’ into an undergraduate Gender and the Law course at the University of Western Australia. The Community of Inquiry is a pedagogy developed by Matthew Lipman in the discipline of Philosophy that facilitates collaborative and democratic philosophical thinking in the context of teaching philosophy in schools. Our project was to see if this pedagogy could advance two objectives in Gender and the (...) Law at undergraduate level: ‘reflexive thinking’ and ‘standpoint thinking’. We conclude that the Communities of Inquiry had a significant influence on the development of ‘reflexive thinking’ but appeared to have limited influence on the development of ‘standpoint thinking’. Here we provide a practitioner reflection on an exploratory new approach to teaching in a tertiary setting, with a view to setting an agenda for more systematic research in the future. (shrink)

In his article, “Defining Death: Beyond Biology,” John Lizza argues in favor of a civil definition of death, according to which the potential for consciousness and social interaction marks us as the “kind of being that we are.” In this commentary, I critically discuss this approach to the bioethical debate on the definition of death. I question whether Lizza’s account is based on a full recognition of the “practical, moral, religious, philosophical, and cultural considerations” at play in this debate. I (...) further propose that a truly ethical debate on definitions of death ought to concentrate on how different definitions of death are used in diverse contexts – what definitions of death do – and focus less on who has the right definition of death for all situations. The world is riddled with human suffering, poverty, and destitution. In the face of this moral tragedy, the least that the global wealthy can do is try to support aid programs aimed at relieving the plight of the very poor. Many political leaders, pop stars, and religious personalities have realized this, and routinely urge us to be more sensitive to the conditions of the distant needy. On the Justification of Basic Rights In his thought-provoking article, Rainer Forst develops a discourse-theoretical approach to the justification of basic rights, and argues that it is superior to interest-based and autonomy-based views. I cast doubt on the superiority of the discourse-theoretical approach. I suggest that, on reflection, the approach suffers from the same difficulties that Forst believes undermine rival views. My discussion raises broader questions about what desiderata a good justification of basic rights should satisfy.

This article suggests that there are systematic ways in which the identity of the ‘self’, as created and performed through first-person markers, can be made relevant and consequential in particular episodes of interaction. More specifically, the study looks at generalizations that people present about themselves in local interactional contexts: displays of the types of people they are and the ways in which they always or never behave. It will be shown that such self-generalizations are typically used to account for one’s (...) behavior, and that this tendency is tied to the epistemic and moral rights provided by the first-person perspective, having the primary rights to one’s own experience. The study suggests that speakers’ personal characteristics or habitual behavior can be offered as a locally produced micro-identity, which can come to have interactional significance. (shrink)

In this article, we reflect on the particular temporal structure of pregnancies and prenatal entities with the aim to contribute to the field of the sociology of pregnancy. Medical models and technology shape today’s notion of pregnancy as a linear, nine-month developmental process that leads to the birth of a child. Through ultrasound technology and prenatal examinations, prenatal entities have thus historically gained a present ‘being’ as a developing, unborn child. While these ideas undoubtedly greatly influence the participants’ interpretations, a (...) culturalistic perspective on time alone does not do justice to the phenomenon’s lived tensions and the temporal complexity of the phenomenon. From a Schutzian perspective of time, we have worked out how practices of pregnancy and the production of meaning are shaped by an interwoven back and forth between orientations to the past, present and future. Drawing on relevant works from the sociology of pregnancy, we work out five modes of temporal references that mold the phenomenon of pregnancy: joint imagination of the couple, in which the born is anticipated as fantasies of the future, passivities of pregnancy, in which the desired future is experienced as unable to influence, the presentification of the unborn in and through visual and bodily-somatic contact moments, its futurization through the cultivation of a ‘not-yet’ and prenatal losses, as a critical rupture with the anticipated and desired future. Our analysis underlines the potential of a time sociological perspective on pregnancy and the constitution of relationships and persons. (shrink)

The authors investigated whether college students possess abstract rules concerning the applicability conditions for three spatial diagrams that are important tools for thinking—matrices, networks, and hierarchies. A total of 127 students were asked to select which type of diagram would be best for organising the information in each of several short scenarios. The scenarios were written using three different story contexts: (a) neutral, presenting a real-life situation but not cueing a particular representation; (b) abstract, presenting only variable names and relations; (...) and (c) incongruent, in which the context and informational structure cued different representations. The results indicated above-chance performance on the abstract scenarios, as well as comparable performance on the abstract and neutral context scenarios. In a follow-up study in which eight students thought out loud while selecting diagrams for the abstract scenarios, there were almost no references to concrete examples. The results of these studies suggest that students possess abstract rules concerning the applicability conditions for matrices, networks, and hierarchies. (shrink)

Este trabajo insiste en la utilidad de la distinción entre medios y consecuencias en la atribución de responsabilidad penal. La estrategia argumental se basa en algunas de las principales intuiciones de la doctrina del doble efecto. En particular, se analiza el modo en que esta doctrina moral traza la diferencia entre daño instrumental y daño incidental. Dado que en la filosofía moral contemporánea se ha criticado severamente esa distinción, se elabora una respuesta a esas críticas. Finalmente, se subraya no sólo (...) en qué sentido es diferente intentar y prever un daño sino también por qué los daños instrumentales cuentan también como daños intentados por el agente. (shrink)

El presente trabajo es un estudio descriptivo y con un enfoque sincrónico que da muestra de las deficiencias de los profesores universitarios al redactar textos científicos. Este estudio tiene como objetivo proponer varias acciones de superación para perfeccionar el manejo del lenguaje y el arte de redactar de los docentes de la Universidad de Ciencias Médicas "Dr. Faustino Pérez Hernández" de la provincia Sancti Spíritus que cursan la octava edición de la Maestría en Ciencias de la Educación de la Universidad (...) de Sancti Spíritus "José Martí Pérez". Para darle cumplimiento a este propósito, se aplicaron varios métodos y técnicas de recolección de datos a una muestra seleccionada al azar de informantes y de sus publicaciones, lo que permitió fundamentar la existencia de varias problemáticas en la redacción científica de dichos profesores y la necesidad de implementar formas organizativas básicas del proceso de educación de posgrado para su inmediata y eficaz aplicación. The present work is a descriptive study grounded in a synchronic approach that identifies the deficiencies of university professors when writing scientific texts. This study aims to propose several measures to improve the use of language and the art of writing of teachers of the " Dr. Faustino Pérez Hernández" University of Medical Sciences in Sancti Spíritus, Cuba who are participating in the eighth edition of the Master's Degree in Educational Sciences program at the "José Martí Pérez" University, also located in Sancti Spiritus. Several methods and techniques of data collection were applied to a random sample of informants and their scientific articles. This allowed for the detection of several problems in scientific writing and the need to implement basic organizational forms of postgraduate education for immediate and effective application. We understand metahistory as an approach that studies how histories within a particular discipline have been written and focus on insider scientists’ reconstructions of twin research. Using the concept of ethical-political affordances we suggest that such histories are based on a management of resources that prove to be beneficial for representing one’s own research traditions in a positive light. Instead of discussing information on the context and intellectual life of pioneers of the twin method, which include high-caliber eugenicists and Nazi (...) ideologues, and on how the twin method has been used and abused, insider scientists’ accounts present twin research as neutral, objective and void of any kind of political connotations. We show how important leaders of German twin research have been historically managed, and how their contributions have been distorted and omitted. Reasons for historical revisionism by omission and for selectively revised accounts of the past are discussed. Suggestions for writing accounts of the twin method are included and focus on the necessity of self-reflection, considerations regarding one’s own ethical-political inclinations, and review of the existing historical literature. In analyzing these connections, we attempt to understand how science, politics and history interact. (shrink)

The fifth edition of this classic introduction to Christian ethics via the case method approach, utilizing case studies of contemporary ethical issues.

This essay focuses on the empowerment of families headed by solo moms in the United States and argues that the so-called “breakup of the family”—whether through divorce, chosen solo parenthood, or non-heterosexual families—is not the primary problem Christian ethicists should be concerned about. Instead, our attention should be directed towards a neoliberal political economic system that does not consider the rearing of children as a public responsibility and does not prioritize support to families of any type. This essay critiques the (...) traditional Christian framing of family and view of the “family crisis” by drawing on the work of Black queer scholars who offer a more inclusive and interdependent understanding of family that challenges the White heteronormative nuclear family ideal. It concludes with an argument for structural change that prioritizes the rearing of children as a public good and not simply the responsibility of individual households and offers support for the flourishing of all families with attention to particularities of race, class, and gender justice. During goals of care conversations, palliative care clinicians help patients and families determine priorities of care and align medical care with those priorities. The style and methods of communicating with families and negotiating a care plan can range from paternalistic to entirely patient driven. In this paper, we describe a case in which the palliative care clinician approached decision-making using a paradigm that is intuitive to many clinicians and which seems conceptually sound, but which has not been fully explored in (...) the bioethics literature. This paradigm, termed maternalism, allows the clinician to direct decision-making within a relationship such that best interests and autonomy are mutually reinforced, thus reflecting relational autonomy as opposed to individual autonomy. We explore whether this method is appropriate in this case and explain how it captures significant ethical features of the case that might be missed by other approaches. (shrink)

Throughout his entire career, Nishida Kitarō was, arguably, interested in challenging Immanuel Kant’s formulation of the moral will. In his first work, An Inquiry into the Good, he criticizes Kant’s pure practical reason as idealistic, arguing that the good should be understood not in terms of an abstract, formal relation of reason with itself, but in terms of personality as a single, unique, unifying power that is the true reality of the self. He echoes this language in his last work, (...) “The Logic of the Place of Nothingness and the Religious Worldview,” proposing that the personal self exists as a self-determining individual through creative expression. This article will investigate how Nishida’s development of this concept of the personal self grounds his proposal that the goal of the moral will is realization of the good as a personal, rather than abstract, ideal, through the intentional action of active intuition. Introduction: People with Spinal Cord Injury are at risk of feeling socially disconnected. Competitive esports present an opportunity for people with SCI to remotely engage in a community. The aim of this study is to discuss barriers to esports participation for people with SCI, present adaptive solutions to these problems, and analyze self-reported changes in social connection.Materials and Methods: We presented a descriptive data collected in the process of a quality improvement initiative at Mount Sinai Hospital. In 2019, seven individuals (...) with cervical SCI and quadriplegia participated in a special interest group on esports. Group scores were then analyzed for evidence of between subjects variability using a single sample t-test. A Pearson's correlation was conducted to determine the relationship between social connectedness and demographic data.Results: All players experienced functional limitations as a result of their injury but managed to design personalized gaming setups with adaptive equipment that allowed them to successfully compete in esports. All players reported a positive change in perceived social connectedness after participating in the special interest group. Score on Social Connectedness Scale negatively correlated with Time since injury.Discussion: It is feasible to create adaptive gaming setups that can be used by people with differing degrees and severity of SCI in a competitive esports environment. Technology and adaptive competitive esports have a potential to improve social connectedness and inclusion in people with quadriplegia. Further research on efficacy and effectiveness of these inclusive environments and their effects on quality of life, activity, and participation is warranted. (shrink)

We introduce a novel paradigm for studying the cognitive processes used by listeners within interactive settings. This paradigm places the talker and the listener in the same physical space, creating opportunities for investigations of attention and comprehension processes taking place during interactive discourse situations. An experiment was conducted to compare results from previous research using videotaped stimuli to those obtained within the live face-to-face task paradigm. A headworn apparatus is used to briefly display LEDs on the talker’s face in four (...) locations as the talker communicates with the participant. In addition to the primary task of comprehending speeches, participants make a secondary task light detection response. In the present experiment, the talker gave non-emotionally-expressive speeches that were used in past research with videotaped stimuli. Signal detection analysis was employed to determine which areas of the face received the greatest focus of attention. Results replicate previous findings using videotaped methods. (shrink)
