Contemporary political philosophers disagree about whether theories of justice should be utopian or realistic. Contributors to this volume largely deny that the choice between realism and idealism is binary. Their contributions represent a continuum between realism and idealism that best represents the contemporary state of the debate.

The monitoring role performed by the board of directors is an important corporate governance control mechanism, especially in countries where external mechanisms are less well developed. The gender composition of the board can affect the quality of this monitoring role and thus the financial performance of the firm. This is part of the “business case” for female participation on boards, though arguments may also be framed in terms of ethical considerations. While the issue of board gender diversity has attracted growing (...) research interest in recent years, most empirical results are based on U.S. data. This article adds to a growing number of non-U.S. studies by investigating the link between the gender diversity of the board and firm financial performance in Spain, a country which historically has had minimal female participation in the workforce, but which has now introduced legislation to improve equality of opportunities. We investigate the topic using panel data analysis and find that gender diversity – as measured by the percentage of women on the board and by the Blau and Shannon indices – has a positive effect on firm value and that the opposite causal relationship is not significant. Our study suggests that investors in Spain do not penalise firms which increase their female board membership and that greater gender diversity may generate economic gains. (shrink)

Drawing on conceptual works by Murphy (1999) and Solomon (1999), we develop a virtue ethics scale. Other ethics scales, which are grounded in deontological and teleological principles, may be used to classify people according to their beliefs about (1) the criteria they use to make ethical decisions, or (2) the ethicality of those decisions. We suggest augmenting these scales with our virtue ethics scale, which may be used to classify people according to their beliefs about the virtuous qualities of businesspeople.

Although several important methodologies implicitly assume the truth of epistemic conservatism, the view that holding a belief confers some measure of justification on the belief, recent criticisms have led some to conclude that epistemic conservatism is an implausible view. That conclusion is mistaken. In this article, I propose a new formulation of epistemic conservatism that is not susceptible to the criticisms leveled at earlier formulations of epistemic conservatism. In addition to withstanding these criticisms, this formulation of epistemic conservatism has several (...) benefits. First, this formulation has the benefits of earlier formulations of epistemic conservatism, that is to say it makes sense of our intuitions about justification in regard to both memory beliefs and beliefs for which we have forgotten our evidence. Second, it provides a good way of responding to the skeptic’s challenge concerning the possibility of possessing knowledge of the external world posed by the Alternative Hypotheses argument. Third, it provides responses to both forms of a new skeptical problem plaguing basic knowledge structure theories, the Problem of Easy Knowledge formulated by Stewart Cohen. I argue that given the many benefits of this formulation of epistemic conservatism and the fact that it is not vulnerable to the criticisms that undermine earlier formulations of epistemic conservatism, this formulation of epistemic conservatism is a plausible view to maintain. This essay develops a novel account of the distinction between a publicly justified polity and modus vivendi regimes by appealing to the ideal of congruence in public reason liberalism. A fully publicly justified polity is one whose laws are supported by congruent “first-personal” and “second-personal” moral reasons to internalize laws as personally binding on those subject to them. Regimes approach modus vivendi status to the extent that their laws fail to be justified by either type of reason, or where firstpersonal (...) and second-personal reasons fail to justify internalization. I examine the positive and negative features of homeopathy from an ethical perspective. I consider: (a) several potentially beneficial features of homeopathy, including non-invasiveness, cost-effectiveness, holism, placebo benefits and agent autonomy; and (b) several potentially negative features of homeopathy, including failure to seek effective healthcare, wastage of resources, promulgation of false beliefs and a weakening of commitment to scientific medicine. A utilitarian analysis of the utilities and disutilities leads to the conclusion that homeopathy is ethically unacceptable and ought to be (...) actively rejected by healthcare professionals. Over the past several years, I have been arguing that nature sports such as surfing, backcountry skiing, and mountaineering are best described as sports in which athletes interact dynamically with natural features rather than compete with other humans. This article is part of a larger attempt to trace the implications of that view. Specifically, I consider the relationship between nature sports and competition. To this purpose, I address three separate, but related topics: First, I reply to Leslie Howe’s article, ‘On (...) Competing Against Oneself, Or, I Need to Get a Different Voice in My Head’, in which she argues that there is a version of self-competition that is central to nature sports. Second, I argue that adapting nature sports to fit into formal competitive frameworks is problematic because, when we do so, the focus shifts from athletes interacting with natural features to athletes using natural features to outdo other athletes. This paper looks at some of the different practical cyborgs that are realistically possible now. It firstly describes the technical basis for such cyborgs then discusses the results from experiments in terms of their meaning, possible applications and ethical implications. An attempt has been made to cover a wide variety of possibilities. Human implantation and the merger of biology and technology are important factors here. I argue against Lori Watson and Christie Hartley's recent criticisms of convergence approaches to public justification. In particular, I argue that convergence approaches can capture what is distinctive about democratic decision‐making and provide an attractive account of stability for the right reasons.

I examine the process and outcomes of animal genetic manipulation (‘transgenesis’) with reference to its morally salient features. I consider several objections to transgenesis. I examine and reject the alleged intrinsic wrongness of ‘deliberate genetic sequence alteration’, as I do the notion that transgenesis may lead to human genetic manipulation. I examine the alleged wrongness of killing inherent in transgenesis, and suggest that the concept of ‘replaceability’ successfully justifies such killing, although not for entities deemed to possess ‘personhood’. I examine (...) ‘significant suffering’ associated with transgenesis and propose the radical conclusion that, although it would be wrong to prohibit animal genetic manipulation per se, utilitarians ought to support a ‘default prohibition’ on transgenic experiments that entail significant suffering. This paper seeks to uncover and rationally reconstruct four theoretical prescriptions that H. L. A. Hart urged philosophers to observe and follow when investigating and theorizing about the nature of law. The four prescriptions may appear meager and insignificant when each is seen in isolation, but together as an inter-connected set they have substantial implications. In effect, they constitute a central part of Hart’s campaign to put philosophical investigations about the nature of law onto a path to a genuine research (...) program. The paper takes note of certain prevalent and robust trends in contemporary legal philosophy that detract its practitioners from the four prescriptions, and that have them revert to the some older modes of thinking from which Hart sought a decisive break. The “problem of forgotten evidence” is a common objection to evidentialist theories of epistemic justification. This objection is motivated by cases where someone forms a belief on the basis of supporting evidence and then later forgets this evidence while retaining the belief. Critics of evidentialist theories argue that in some of these cases the person's belief remains justified. We tend to imagine revolution as a vivid tableau of uprisings and armed conflicts. Much less notice is taken of the complex layers of meaning that shape our understanding of these events: why some are seen as just expressions of a popular will, while others are condemned as wild disruptions of political order. A critical understanding of politics must grapple with these subtle, often unnoticed normative issues. This essay tries to understand some of the processes that create political normativity, investigating (...) the way revolutionary movements use time to endow themselves with normative value. I sketch a genealogy of revolution across three centuries, noting changes in its meaning, observing the rise of discourse as an important mode of revolutionary activity, and tracing a shifting mosaic of temporalities that are politicized in important ways. Journalists enjoy unprecedented freedom from government interference to gather facts from sources, but journalistic tradition and custom restrict the freedom of journalists to report fact as they see it. This study critically examines the concept of objectivity and proposes an alternative philosophy for encouraging ethical behavior. The first section of the article focuses on the ideological and occupational origins of objectivity and identifies the conflict between these two perspectives Next, the study reviews contemporary literature in regard to objectivity, showing how (...) the concept has evolved, and why objectivity as a journalistic norm needs reevaluation. Third, the study proposes linking the occupational norms and standards of objective journalism with a subjective existentialism, which is more consistent with the ideological definition of objectivity. Finally, the study proposes that journalists improve ethical behavior by developing an existential ethic emphasizing individual responsibility. (shrink)

Defenders of a priori arguments for dualism assume that the Cartesian thesis that possibly, I exist but no bodies exist and the physicalist thesis that I am identical with my body, are logically inconsistent. Trenton Merricks offers an argument for the compatibility of those theses. In this paper I examine several objections to Merricks’ argument. I show that none is ultimately persuasive. Nevertheless I claim that Merricks’ argument should not be accepted. I next propose a view of persons that is (...) an alternative both to person-body identity and Cartesian dualism and offer a view of the afterlife that is compatible both with the alternative conception of persons I present and the Christian doctrine of resurrection. This essay provides an internal critique of John Rawls’s case for liberal socialism. A liberal socialist regime combines liberal rights with public ownership of the means of production. The state deliberately manages capital to promote both economic and moral ends. I argue that liberal socialism cannot satisfy Rawls’s own criterion for a well-ordered and legitimate regime: stability for the right reasons. Liberal socialism cannot be stable much as reasonable comprehensive doctrines cannot. Reasonable comprehensive doctrines impose detailed patterns of conduct on (...) citizens in ways they can reasonably reject. Liberal socialism imposes similarly invasive and complex directives through what I shall call reasonable economic plans: multifaceted directives for the ownership and operation of capital that satisfy Rawls’s justice as fairness. Consequently, imposing any reasonable economic plan will destabilize the regime. For this reason, liberal socialism cannot serve as an ideal regime type for Rawlsian egalitarians. (shrink)

Corporate social responsibility involvement and disclosure has been becoming increasingly popular among US public firms, including those that qualify as real estate investment trusts. This paper aims to discover the relationship between CSR involvement and potential determinants such as growth opportunities, profitability, visibility, and agency costs. Types of CSR involvement are assessed in terms of environmental, community, and governance disclosures and are quantified using word count from the company’s voluntary disclosure. Our results support the hypothesis that CSR has a strategic (...) element and that REITs have greater CSR involvement when they have greater growth and investment opportunities. When the type of disclosure is broken into subcategories, the results show that not all dimensions of CSR are alike: environmental, community, and governance CSR disclosures appear to be motivated by different sets of incentives and reasons. A series of imitation games involving 3-participant (simultaneous comparison of two hidden entities) and 2-participant (direct interrogation of a hidden entity) were conducted at Bletchley Park on the 100th anniversary of Alan Turing’s birth: 23 June 2012. From the ongoing analysis of over 150 games involving (expert and non-expert, males and females, adults and child) judges, machines and hidden humans (foils for the machines), we present six particular conversations that took place between human judges and a hidden entity that produced (...) unexpected results. From this sample we focus on features of Turing’s machine intelligence test that the mathematician/code breaker did not consider in his examination for machine thinking: the subjective nature of attributing intelligence to another mind. Elaine Scarry argues in The Body in Pain that war is a vast and reciprocal swearing on the body, with corporeality key not only to its brutal prosecution but also to the eventual ending of the political ‘crisis of substantiation’ that war entails. However, her work has not been extensively explored with reference to significant transformations in the embodied experiences of contemporary warfare. This article thus analyses a particular articulation of late modern warfare that I term predatory war, whose current (...) signature motif is the drone strike, through the lens of Scarry’s work. Here, the associated modes of embodiment are radically non-reciprocal, the woundscapes of conflict are profoundly asymmetric, and the affective mediation of bodily injury does not substantiate any ending to the conflict. As such, I argue that the ontology and phenomenology of predatory war increasingly resembles what Scarry identifies as the underlying structure of torture. (shrink)

Conversations about art often include broad statements about the stature of artists. Such statements raise questions about the best way to look at the bodies of work of artists. Like individual works of art, bodies of work are artistic objects worthy of appreciation. Through the body of work, we are better able to engage the aspects of creativity that require a long-term perspective. This long-term perspective allows us to look for a range of aesthetic qualities not readily evident in individual (...) works of art. Poverty tours - actual visits as well as literary and cinematic versions - are characterized as morally controversial trips and condemned in the press as voyeuristic endeavors. In this collaborative essay, we draw from personal experience, legal expertise, and phenomenological philosophy and introduce a conceptual taxonomy that clarifies the circumstances in which observing others has been construed as an immoral use of the gaze. We appeal to this taxonomy to determine which observational circumstances are relevant to the poverty tourism debate. (...)
