Abstract:Qi has been both understood separately as substance and as field. This essay argues that qi in the Zhuangzi is both substance and field together. This qi field-substance is bidimensional where its vertical axis is that of substance and its horizontal axis that of field. This essay argues that the vertical dimension does not imply a substance dualism but a holism where qi differs in degrees of refinement; it argues that the horizontal dimension is composed of interrelated yinyang forces that (...) constitute an "empty" field. It also argues that at the center of this qi field-substance is the heart-mind and the body and, by drawing on rich resonances between the Zhuangzi and phenomenology, that human beings bring the fields of qi that they are situated in into certain coherences. Perhaps the most fundamental principle of legal interpretation is the presumption that terms should be given their “ordinary” (i.e., general, non-technical) meanings. This principle is a central tenet of modern textualism. Textualists believe a universal presumption of ordinary meaning follows from their theory’s core commitment: A law should be interpreted consistently with what its text communicates to the ordinary public. This Article begins from this textualist premise, empirically examining what legal texts communicate to the public. Five original empirical studies (N (...) = 4,365) reveal a surprising finding: Ordinary people consider genre carefully and regularly take terms in law to communicate technical legal meanings, not ordinary ones. -/- This discovery carries implications for legal interpretation’s theory and practice. Modern textualists—especially at the Supreme Court—justify their theory through “democratic,” fair notice, and rule-of-law appeals to ordinary people. But the empirical studies reveal that fidelity to ordinary people does not imply an unwavering commitment to ordinary meaning. Instead, it requires interpreters to also look to technical meanings. On a practical level, the results support a new presumption of legal meaning and ground a new challenge to textualism’s claim to promote fair notice. As a case study, we consider Bostock v. Clayton County, Georgia, which held that both sexual orientation and gender identity discrimination are prohibited forms of sex discrimination. The Article’s empirics and theory offer a new justification of the Court’s landmark decision. (shrink)

Cognitively disabled individuals have been marginalized by our larger culture; they’ve also been marginalized in philosophical discussions. This paper seeks to begin correcting this situation by examining how assumptions which shape our social interactions and expectations disadvantage individuals with a range of cognitive disabilities. After considering Rubella syndrome and autism in detail, I argue that we have a moral obligation to change how we approach social interactions with cognitively disabled individuals.

Some think of art as opposed to philosophy and science, and indeed sometimes opposed to morality. Here, Wall explores the fundamental ways of pursuing aesthetics, speculation, science, mathematics, and morality. Conceptually these are not opposed. He illustrates the ideas with reference to an array of ancient and modern thinkers.

Starting from Summa Theologiae 1.2.3.obj.2, I consider some aspects of the term propositum as it occurs in his works. The objection divides “everything thatappears in the world” into what is natural and what is a proposito, and argues that each of these can be accounted for by causes other than God. I suggest that what is a proposito be called “the purposed,” and I try to clarify Aquinas’s understanding of purpose in relation to other notions in his writings, in particular (...) nature, fortune, and above all deliberation or “counsel,” which is the prelude to choice. After some reflection on the theme of “deliberated will” and on the contrast between deliberating and being deliberate, I return to Aquinas’s reply to the objection I began with, then conclude with reference to a recent discussion of the difference between ends and purposes. Trenton Merricks has objected to dualist conceptions of the Incarnation in a similar way to Jaegwon Kim’s pairing problem. On the original pairing problem, so argues Kim, we lack a pairing relationship between bodies and souls such that body A is causally paired with soul A and not soul B. Merricks, on the other hand, argues that whatever relations dualists propose that do pair bodies and souls together (e.g. causal relations) are relations that God the Son has with all bodies (...) whatsoever via his divine attributes (e.g. God the Son could cause motion in any and all bodies via his omnipotence). So if we count these relations as sufficient for embodiment, then dualism implies that God the Son is embodied in all bodies whatsoever. I shall argue that while the original pairing problem might be easily answerable, the Christological pairing problem is not and that dualists must shift some of their focus from the defense of the soul’s existence to explicating the nature of the mind-body relationship. Au cours de mon développement, j’attire l’attention sur les critiques formulées par Anthony Brueckner à l’égard de l’approche de BonJour, détaillant les raisons pour lesquelles elles ne parviennent pas à réfuter de manière cohérente l’argument de BonJour. En distinguant et en appliquant (...) deux types distincts d’évaluation des probabilités aux hypothèses de BonJour, j’avance l’argument selon lequel la stratégie déductive de BonJour échoue à fournir une argumentation convaincante en faveur du PI. This article presents a close reading of Kierkegaard’s Works of Love in light of the question whether neighborly aspirations are sensitive to the worth of close personal relationships and to the importance of the material well-being of fellow citizens. The interpretive analysis is set within the larger debate overKierkegaard’s critique of preferential love and his apparently apolitical focus on inward authenticity, and it concludes that neighborly love is far more emotionally vulnerable and sensitive to the particulars of individuals and their (...) social and material standing than isolated passages suggest. Kierkegaard’s work thus contributes to the current preoccupation with the moral relevance of emotions and their place within public life. (shrink)

The approach to scientific methodology developed in my recent book The Logic of Reliable Inquiry (LRI) shares many general features with that summarized in Larry Laudan’s concurrently published collection of papers Beyond Positivism and Relativism (BPR). Nonetheless, this fact might not be apparent, as my own work emphasizes mathematical theorems, whereas Laudan’s draws primarily upon historiography. It is, therefore, of some interest to discuss the extent of the agreement and the significance of the differences. More generally, the discussion will (I) (...) provide a logical analysis of the instrumental significance of empirical meta-methodology and (II) redefine the role of logic in a post-positivistic, naturalized approach to epistemology and scientific method. The varying motivations of early morning runners becomes a useful way of distinguishing a 'decision' from an 'intentional action'. Runners may differ greatly on the number of actual decisions that are made in the course of a run--even while they perform roughly the same number of intentional actions. In showing how this is so, it also becomes clear why a single action can have multiple descriptions.

If a painting or a sculpture needs to be supplemented and explained by words, it means either that it has not fulfilled its function or that the public is deprived of vision. They had manufactured a technology of universal incomprehension. If one is uncomfortable with a commitment one’s theory is saddled with . . . one must reformulate one’s theory. These three citations define the scope and interest of my argument regarding twentieth-century formalist art and visual communication. Since 1945 regions undergoing dependent development have displayed a great diversity of regime outcomes. In contrast, the nations of the capitalist core have experienced relatively stable democratic regimes. In this paper I begin the development of a theoretical framework for comprehending these diverse patterns. I argue that regime outcomes vary across regions of the capitalist world economy because structural economic constraints also vary by region. Dependent economies are characterized by two major constraints: 1) the lack of a locally dynamic accumulation (...) process and 2) the persistence of widespread and deep income inequalities. These two factors increase the level of class conflict even while they reduce the level of state resources. Thus, regime officials have insufficient resources to address accumulation and consumption demands simultaneously. Variation in regime outcome in the capitalist periphery is produced by variation in "situations of dependency" (i.e., the forms of integration into the capitalist world economy) that produce different class structures and levels of economic constraints. In the capitalist core, however, locally dynamic accumulation processes and relatively low income inequality provide the structural conditions for stable democratic regimes. (shrink)

Examines the meaning of tolerance, its importance in modern society, and the kinds of intolerance or prejudice that may prevent people from respecting differences in others.

Today’s textualist Supreme Court draws a bright line between essential “linguistic” interpretive canons and suspect “substantive” canons. This Article’s thesis is that the venerable linguistic/substantive dichotomy is false. We present the first empirical study of whether ordinary people (N = 1,520) understand rules in line with some of law’s substantive canons. The study supports that some substantive canons represent valid linguistic generalizations about how ordinary people understand rules’ meaning. For example, the presumption against retroactivity is usually justified by values like (...) fairness, but it also best reflects ordinary readers’ default understanding of rules’ meanings. -/- In an age of textualism, this argument has direct practical implications. Interpreters committed to the ordinary reader should reconsider whether rules that have been traditionally described as “substantive canons” might also be linguistic ones. The article’s analysis also puts pressure on textualists to better justify their recent embrace of purely substantive canons, like the new “major questions” canon. Most broadly, the Article makes progress on a longstanding philosophical debate about facts and values in interpretation. Beyond the exclusively linguistic canons and the exclusively substantive canons, there is an important but overlooked category: The linguistic and substantive canons. (shrink)

Hegel's system is not teleological. For a philosophy to be teleological, as I shall use the term, means that it takes the basic nature of the world itself or any foundational account of that world to be defined ultimately by final causality. Such a view has, of course, long stood as the dominant model for interpreting Hegel's system. This essay argues, to the contrary, that the accounts of Teleology and Life in the Science of Logic, and more precisely their analyses (...) of what Hegel calls there subjective purpose and objective purpose, actually demonstrate this conception of teleology to be profoundly mistaken.The conventional reading of these sections is that they argue for two related claims: (1) that the means-ends relationship of extrinsic purposiveness—subjective purpose—is made possible by the intrinsic self-organizing process of intrinsic purposiveness; and (2) that intrinsic purposiveness—objective purpose—takes the basic structure of an organism, a natural purpose (Naturzweck), as its model, a model defined by final causality. I show this to be a deeply flawed interpretation. Hegel certainly shows that extrinsic purposiveness entails intrinsic purposiveness, but he does not conceive of intrinsic purposiveness, objective purpose, in terms of the final causality inherent in the model of a natural purpose. Rather, the systematic account of logical life argues that the activity of life must be understood as genus and this as a process of self-differentiation where the immanent and necessary unfolding of determinate negation itself, and itself alone, engenders the development without possessing or relating itself to any antecedent content. Hence, this austere thesis, rather than any form of final causality, is, as Hegel puts it, the truth of teleology, the nature of the absolute idea, and, as a result, Hegel's system is shown, at its very core, not to be teleological. Part of the traditional Christian doctrine of sin is the claim that, due to the effects of original sin, acts of sin are inevitable. Of course, our reflection on sinful actions is shaped by how we think about human freedom and divine providence more broadly. Some have argued that libertarians have a difficult time accounting for the inevitability of sin. This paper uses David Lewis’s work on counterfactuals and possible worlds to give an account of how the inevitability of sin (...) can be understood. It then shows how both theological determinism and Molinism can give an account of sin’s inevitability so understood. In doing so, I show that sin’s inevitability only follows if we restrict our focus to certain possible worlds that share certain features with the actual world. But once such a restriction is made explicit, I then develop a framework for how the libertarian non-Molinist can also use a similar restriction to give an account of the inevitability of sin given original sin. According to Hegel, the determinations of the absolute are conceptual properties that identify what the absolute is, and are related through logical entailments. The shapes of the absolute are historical configurations that religion takes as it appears in the domain of contingent existence. This essay claims that Stewart’s interpretation does not observe this distinction, and as a result transforms the determinations of the absolute into projections of a people’s self-understanding. I argue that Hegel himself takes a history of religions to (...) be a logically necessary sequence in which the determinations of the absolute are articulated and proved, rather than a history of the cultural forms that the divine happens to have taken in the movement of human history. I examine as a test case the proper place of Islam in Hegel’s schema of determinate religions in order to show how Stewart’s conflation of determinations and shapes affects the possibility of determinate world-religions arising after what Hegel takes to be the consummate religion, Christianity. One of the central claims of Alexander Bird’s book Knowing Science is that the concept of knowledge is central to understanding science. In light of this, it is unsurprising that Bird construes scientific progress solely in terms of the accumulation of scientific knowledge. Although his account of scientific progress is itself promising, there is an underlying tension between Bird’s support for the knowledge-centric account of scientific progress and his case against rival accounts of scientific progress. Specifically, Bird criticizes semantic accounts (...) of scientific progress on the grounds that they allow achievements that fall short of knowledge to count as genuinely progressive. However, he also acknowledges that there are historical examples where scientific progress was made even though knowledge was not accumulated. In this article, I explicate this tension underlying Bird’s arguments concerning scientific progress, suggest how it might be resolved, and explain the implications for Bird’s take on scientific progress. Internalist theories of epistemic justification supposedly have trouble explaining what justifies beliefs that are both stored in memory and currently out of mind. This is the problem of stored beliefs. This chapter provides a preliminary defence of stored/dispositional appearances and suggests that they provide a straightforward solution to the problem of stored beliefs.
