In the field of health technology assessment, there are several approaches that can be used for ethical analysis. However, there is a scarcity of literature that critically evaluates and compares the strength and weaknesses of these approaches when they are applied in practice. In this paper, we analyse the applicability of some selected approaches for addressing ethical issues in HTA in the field of complex health interventions. Complex health interventions have been the focus of methodological attention in HTA. However, the (...) potential methodological challenges for ethical analysis are as yet unknown.Six of the most frequently described and applied ethical approaches in HTA were critically assessed against a set of five characteristics of complex health interventions: multiple and changing perspectives, indeterminate phenomena, uncertain causality, unpredictable outcomes, and ethical complexity. The assessments are based on literature and the authors’ experiences of developing, applying and assessing the approaches.The Interactive, participatory HTA approach is by its nature and flexibility, applicable across most complexity characteristics. Wide Reflective Equilibrium is also flexible and its openness to different perspectives makes it better suited for complex health interventions than more rigid conventional approaches, such as Principlism and Casuistry. Approaches developed for HTA purposes are fairly applicable for complex health interventions, which one could expect because they include various ethical perspectives, such as the HTA Core Model® and the Socratic approach.This study shows how the applicability for addressing ethical issues in HTA of complex health interventions differs between the selected ethical approaches. Knowledge about these differences may be helpful when choosing and applying an approach for ethical analyses in HTA. Resentment, as it is currently understood in the philosophical literature, is individual. That is, it is anger about a moral injury done to oneself. But in some cases, resentment responds to systemic harms and injustices rather than direct moral injuries. The purpose of this paper is to move beyond individualistic conceptions of resentment to develop an account of collective resentment that better captures the character and effects of the emotion in these cases. I use the example of indigenous and settler (...) Canadians’ reciprocal resentments in response to the Indian Residential Schools and continuing political disagreements as an example of a context in which understanding collective resentment is important. Background: Exploring the concept of ethical competence in the context of healthcare is essential as it pertains to better quality of care. The concept still lacks a comprehensive definition covering the aspects of ethical expertise, ethical knowledge and action of a health professional. Objective: This article aims to report an analysis of the concept of ethical competence. Method: A modified strategy suggested by Walker and Avant was used to analyse the concept. Results: As a result, the concept of ethical competence (...) can be defined in terms of character strength, ethical awareness, moral judgement skills and willingness to do good. Virtuous professional, experience of a professional, human communication, ethical knowledge and supporting surroundings in the organisation can be seen as prerequisites for ethical competence. Ethical competence results in the best possible solutions for the patient, reduced moral distress at work and development and democratisation of society. Conclusion: The results of the analysis establish a basis for an instrument to evaluate health professionals’ ethical competence. It will guide educators, as well as managers in healthcare, to support the development of ethical conduct in healthcare. (shrink)

Background: Clinical and experimental findings have suggested that insomnia is associated with altered emotion processing, such as facial emotion recognition and impairments in executive functions. However, the results still appear non-consensual and have recently been presented by a few number of studies. Accordingly, the aim of the present study was to investigate whether patients with Insomnia disorder will present alterations in recognition of facial emotions and that such alterations will be related to Executive Functions and that Insomnia Disorder patients will (...) exhibit a lower Executive Functions performance when compared to normal controls individuals. Method: A total of 11 individuals diagnosed with insomnia disorder and 15 control participants took part in the present cross-sectional study. They completed questionnaires covering socio-demographic data, a sleep and mood evaluation, and a cognitive assessment. Moreover, they underwent a computerized Facial Emotional Recognition test, consisting of facial emotion labeling and facial emotion matching. Results: Individuals with insomnia presented a lower recognition of facial expressions of fear and sadness in comparison to control volunteers. Perceptual Organization Index was found to be statistically significant lower in the insomnia group compared to the control group. There was a statistically significant association between facial recognition emotional and cognitive processes of in executive functions performance, especially in processes related to the inhibitory control, planning capacity, problem solving and cognitive flexibility in insomnia group. Conclusions: Insomnia disorder impairs the facial emotion recognition of the fear and sadness. Insomniacs with impairment in the facial emotion recognition had impaired performance of executive functions. There is a negative impact on processes related to cognitive-emotional capacity than on processes related to social-emotional recognition. Her daughter was 12 and was just beginning to learn about becoming a woman. The anticipatory grief of not having the opportunities to care for one's own children in the crucial moments of their development was devastating to S. Her ability to name what she grieves the most was profoundly sad to me and the other team members who witnessed it.As a palliative care chaplain, I am used to sad and tragic cases, but this one felt different. S and I had [End Page 80] a lot in common. I am also 38, married to my high school sweetheart, and I have a son and a daughter. Of course, it was not just these reasons that I felt a connection to S. It was also the tangible despair I felt when I was with her. As a chaplain, I am trained to meet people where they are and not to hurry them from a place of despair and anguish. I visited with S nine different times and watched the progression of her existential distress. Her distress was not always linear. Some days, it took a backseat and other days, it was front and center, but I was there to be a witness to whatever she was thinking and feeling, and a lot of times, it was inexpressible grief.S did not want to meet with "palliative care" initially. She was terrified of her diagnosis and believed that there were treatments that would give her back the life she desired. She was fierce and determined. S was also religious and believed that there was a miraculous cure for her that would allow her the time she desired to spend with her children and her husband. S was a softball mom and loved to watch her daughter play. While in the hospital, she missed many games, and this weighed on her.Along with being an athlete, S's daughter was very artistic and made S a bouquet of paper flowers. Each flower contained an encouraging phrase. S opened one while I was in her room. She had lost her hair, much of her body weight, and was wearing a hospital gown, but when she opened the flower, her daughter had written, "You are beautiful, Mom." In that moment, two 38-year-old women understood that beauty transcends outward appearances. S was beautiful: her story, her life, and her courage.S loved to walk around the hallway of her unit. I think she felt if she could keep moving, she could stay alive. She was able to take a walk outside a few times while she was inpatient and getting fresh air was very positive to her. These walks not only gave her the ability to widen her environmental space, but they also gave her space to think and consider the difficult situation she was faced with. I accompanied her on one of her walks. It was while we walked next to each other that she was able to finally share with me that she was afraid. She told me that the fear of not getting home, and the fear of death was overwhelming. I find that sometimes people can be vulnerable when they are not feeling interrogated by a medical team staring at them as they lay in a hospital bed. The "normal" activity of taking a walk and being side-by-side humanized the experience and I think S felt that at that moment, she could talk to me human-to-human—like friend-to-friend.When S finally decided to go home on hospice, I collected some legacy project supplies. In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. Recent critics (Andrew Light, Bryan Norton, Anthony Weston, and Bruce Morito, among others) have argued that we should give up talk of intrinsic value in general and that of nature in particular. While earlier theorists might have overestimated the importance of intrinsic value, these recent critics underestimate its importance. Claims about a thing’s intrinsic value are claims about the distinctive way in which we have reason to care about that thing. If we understand intrinsic value in this manner, we can (...) capture the core claims that environmentalists want to make about nature while avoiding the worries raised by contemporary critics. Since the distinction between intrinsic and extrinsic value plays a critical role in our understanding of the different ways that we do and should care about things, moral psychology, ethical theory in general, and environmental ethics in particular shouldn’t give up on the concept of intrinsic value. This paper explores what is meant by ‘loss and damage’ within the area of climate policy focused on loss and damage. I present two possible understandings of loss and damage, one of which connects it to harm and one of which connects it to value. In both cases, I argue that the best contemporary philosophical understandings of these concepts suggest a much broader range of losses and damages than is currently being considered within the usual discussions in this area. I (...) argue that a broader understanding of loss and damage would allow a more complete assessment of potential climate impacts. Older adults were considered a vulnerable group for the COVID-19 infection and its consequences, including problems with sleep.AimTo evaluate the prevalence of sleep disorders in older adults, to describe their sleep patterns, as well as to analyse if there were any changes in comparison with the period pre-pandemic.Materials and MethodsOnline survey used for data collection received answers from 914 elderly age range 65–90 years, from April to August 2020. Results: 71% of the sample reported a pre-existent sleep disorder, and some (...) of them worsened during the pandemic, especially Insomnia in women and Obstructive Sleep Apnea in men. No difference in sleep duration before and during the pandemic was found, although there was a worsening of some aspects related to sleep, such as sleep quality, sleep efficiency, awakening quality, sleep latency and nocturnal awakenings, especially in the female gender. Educational level influenced sleep latency, indicating higher sleep latency among those with primary education when compared with the ones with Ph.D.ConclusionThe pandemic had influenced sleep patterns among the elderly, as well as worsening of pre-existent sleep disorders. Female gender and low educational level were considered risk factors for sleep alterations, and high educational level, on its turn, appeared to be a protective factor. (shrink)

In this paper 1 1 This is a version of a paper originally presented at ArgMAS 2014. we address some limitations with proposals concerning an argumentation scheme for practical reasoning grounded on action-based alternating transition systems augmented with values. In particular, we extend the machinery to enable the proper representation of, and ability to reason with, goals. This allows the more satisfactory representation of certain critical questions, and the means to explicitly record differences between agents as to what will count (...) as the fulfillment of goals and the promotion of values. It also allows us to express desires in terms of values, and to make plain the relation between a change in circumstances and the promotion and demotion of values. The 2004 Canadian Assisted Human Reproduction Act bans commercial contract pregnancy and egg provision, but Canadians undertake cross-border reproductive travel to access these services. Feminist bioethicists have argued that the ethical justification for enforcing the ban domestically, namely exploitation, grounds its extraterritorial enforcement. I raise an additional problem when Global Southern or low-income countries are destinations for travel: neocolonialism. Further, I argue that a ban on commercialized reproduction is problematic. Although well-suited to address neocolonial forces of exploitation and commodification, a (...) ban reinforces neocolonialism by paying insufficient attention to the agency of gestational laborers and egg providers. We explore how a refugee’s experience of rootlessness may persist after they resettle in a new country. Drawing primarily on “We Refugees,” we focus on assimilation as an uprooting phenomenon that compels a person to forget their roots, thereby perpetuating threats to identity and the loss of community that is a condition for political agency. Arendt presents assimilation in a binary way: a person either conforms to or resists pressures to conform. We seek to move beyond this binary, arguing that (...) the performative quality of the “right to have rights” and the notion of dwelling in-between worlds reveal possibilities for a refugee to assimilate in some ways while reinforcing their rootedness. What emerges from our argument is an Arendtian account of assimilation that offers an alternative picture of navigating assimilation than that captured by the binary between parvenu/conscious pariah. In this paper, I analyze Simone de Beauvoir’s goals for women expressed in The Second Sex and compare these goals to the opportunities created by the Affordable Care Act’s contraceptive mandate. Though the contraceptive mandate advances Beauvoir’s goal of concrete equality by supporting economic independence and recognizing women’s sexual freedom, there are social and political limitations to these advancements.

Internet protocol development is a social process, and resulting protocols are shaped by their developers’ politics and values. This article argues that the work of protocol development poses barriers to developers’ reflection upon values and politics in protocol design. A participant observation of a team developing internet protocols revealed that difficulties defining the stakeholders in an infrastructure and tensions between local and global viewpoints both complicated values reflection. Further, Internet architects tended to equate a core value of interoperability with values (...) neutrality. The article describes how particular work practices within infrastructure development overcame these challenges by engaging developers in praxis: situated, lived experience of the social nature of technology. KATIE McSHANE | : Taking the Fifth Assessment Report of the Intergovernmental Panel on Climate Change as representative, I argue that animal ethics has been neglected in the assessment of climate policy. While effects on ecosystem services, biodiversity, and human welfare are all catalogued quite carefully, there is no consideration at all of the effects of climate change on the welfare of animals. This omission, I argue, should bother us, for animal welfare is not adequately captured by assessments of ecosystem (...) services, biodiversity, or human welfare. After describing the paper’s assumptions and discussing the role of the IPCC’s Assessment Reports in climate policy, I consider the presentation of climate impacts in the IPCC’s Fifth Assessment Report, noting the aspects of animal welfare that are considered there, and comparing the report’s treatment of animal welfare to its treatment of human welfare. Next, I argue that the concepts of ecosystem services, biodiversity, and human welfare do not adequately capture the welfare of animals. Finally, I discuss concerns about human responsibility for animal welfare and the practicality of including considerations of animal welfare among the climate impacts studied by the IPCC. | : En prenant le Cinquième Rapport d’évaluation du Groupe d’experts intergouvernemental sur l’évolution du climat à titre de cas représentatif, je soutiens que l’éthique animale a été négligée dans l’évaluation de la politique climatique. Richard Rudner famously argues that the communication of scientific advice to policy makers involves ethical value judgments. His argument has, however, been rightly criticized. This article revives Rudner’s conclusion, by strengthening both his lines of argument: we generalize his initial assumption regarding the form in which scientists must communicate their results and complete his ‘backup’ argument by appealing to the difference between private and public decisions. Our conclusion that science advisors must, for deep-seated pragmatic reasons, make value judgments is further (...) bolstered by reflections on how the scientific contribution to policy is far less straightforward than the Rudner-style model suggests. In "This is America," Katie Rios considers current American artists who build encoded gestures of resistance into their works. These gestures recur across images, live performances, and videos, becoming recognizable acts of resistance leveled at injustices based on a number of categories, including race, gender, class, religion, and politics.

In attempting to provide protection to individuals and communities, childhood immunization has benefits that far outweigh disease risks. However, some parents decide not to immunize their children with some or all vaccines for reasons including lack of trust in governments, health professionals, and vaccine manufacturers. This article employs a theoretical analysis of trust and distrust to explore how twenty-seven parents with a history of vaccine rejection in two Australian cities view the expert systems central to vaccination policy and practice. Our (...) data show how perceptions of the profit motive generate distrust in the expert systems pertaining to vaccination. Our participants perceived that pharmaceutical companies had a pernicious influence over the systems driving vaccination: research, health professionals, and government. Accordingly, they saw vaccine recommendations in conflict with the interests of their child and “the system” underscored by malign intent, even if individual representatives of this system were not equally tainted. This perspective was common to parents who declined all vaccines and those who accepted some. We regard the differences between these parents—and indeed the differences between vaccine decliners and those whose Western medical epistemology informs reflexive trust—as arising from the internalization of countering views, which facilitates nuance. We argue that concerns about double-counting—using the same evidence both to calibrate or tune climate models and also to confirm or verify that the models are adequate—deserve more careful scrutiny in climate modelling circles. It is widely held that double-counting is bad and that separate data must be used for calibration and confirmation. We show that this is far from obviously true, and that climate scientists may be confusing their targets. Our analysis turns on a Bayesian/relative-likelihood approach to incremental confirmation. On most understandings of what an ecosystem is, it is a kind of thing that can be literally, not just metaphorically, healthy or unhealthy. Health is best understood as a kind of well-being; a thing’s health is a matter of retaining those structures and functions that are good for it. While it is true both that what’s good for an ecosystem depends on how we define the system and that how we define the system depends on our interests, these facts (...) do not force us to the conclusion that an ecosystem has no good of its own. The technical details of Internet architecture affect social debates about privacy and autonomy, intellectual property, cybersecurity, and the basic performance and reliability of Internet services. This paper explores one method for practicing anticipatory ethics in order to understand how a new infrastructure for the Internet might impact these social debates. This paper systematically examines values expressed by an Internet architecture engineering team—the Named Data Networking project—based on data gathered from publications and internal documents. Networking engineers making technical choices also weigh (...) non-technical values when working on Internet infrastructure. Analysis of the team’s documents reveals both values invoked in response to technical constraints and possibilities, such as efficiency and dynamism, as well as values, including privacy, security and anonymity, which stem from a concern for personal liberties. More peripheral communitarian values espoused by the engineers include democratization and trust. The paper considers the contextual and social origins of these values, and then uses them as a method of practicing anticipatory ethics: considering the impact such priorities may have on a future Internet. The importance of negotiation has increased in the last years as a relevant interaction to solve conflicts in multi-agent systems. Although there are many different scenarios, a typical negotiating situation involves two cooperative agents that cannot reach their goals by themselves because they do not have some resources needed to reach such goals. Therefore, a way to improve their mutual benefit is to start a negotiation dialogue, taking into account that they might have incomplete or incorrect beliefs about the other (...) agent’s goals and resources. The exchange of arguments during the negotiation gives them information that makes it possible to update their beliefs and consequently they can offer proposals which are closer for reaching a deal. In order to formalize their proposals in a negotiation setting, the agents must be able to generate, select and evaluate arguments associated with such offers, updating their mental state accordingly. We situate our work on this kind of scenarios with two argumentation-based negotiation agents equipped with belief revision operations in the generation and interpretation of arguments. It has been proved that those agents that take advantage of belief revision during the negotiation achieve an overall better performance. Because the belief revision process depends on the information the agents exchange in their utterances, in this paper we focus on different communication strategies the agents may implement and the impact that they have in the negotiation process. For this purpose, we present a negotiation protocol where the messages are extended to include a critique to the last proposal received and a counterproposal. Also, we define proposals that may be more or less informative containing different justifications. An intentional agent architecture is proposed and following this model different kind of negotiating agents are created using diverse communication strategies. On Tuesday evenings at New York University School of Medicine, the anatomy lab is transformed into an art studio. Medical students gather with a spirit of creative enterprise and a unique goal: to turn anatomy into art. They are participants in Art & Anatomy, an innovative drawing course within the Master Scholars Program in Humanistic Medicine —a component of NYUSoM, which offers elective courses across a range of interdisciplinary topics in medical humanities. Art & Anatomy has had approximately four hundred (...) fifty participants since its inception in 2009. The educational intention of the course is to use drawing as an active mode of learning that enhances visual-perceptual ability and three-dimensional spatial understanding of the body's interior; however, the course also opens a creative space for participants to process the emotional complexities of cadaver dissection and the anatomy lab experience. The anatomy lab can be the training ground for clinical detachment, but many U.S. medical schools are beginning to attend more closely to the emotional aspects of dissection. The authors maintain that the inherently expressive nature of drawing makes the Art & Anatomy course a novel and effective approach to this endeavor. Along with the notion of war in general, the so-called war on terror has been, since its inception in 2001, the subject of much debate and theorization. French thinker Gilles Andréani discusses the appropriateness of the term "war" to apply to the present conflict; Antonio Negri has argued how the State's use of the concept of peace justifies its engagement in warfare in general. I approach the conversation, however, by presenting the thoughts of 20th century Czech philosopher Jan Patočka on (...) the relationship between war and peace. Here, I utilize his views, formulated in the context of Soviet control of Eastern Europe, to deconstruct the Bush administration's declaration of war on a concept; in this case, terror. In what follows, I delineate the main aspects of Patočka's understanding of continuous warfare in the 20th century, after which I apply them to some of the central features of the Bush administration's war rhetoric. Additionally, I suggest that Patočka's notion of the solidarity of the shaken may provide a starting point from which all of those involved in the conflict may begin to move forward. (shrink)
