Die Autorin legt eine Rekonstruktion von Kants Beweis der genuinen Subjektivität der Zeit vor. Sie berücksichtigt dabei Beweisform sowie Beweisinhalt und setzt sich außerdem durchgehend mit Kant-Kommentatoren und -kritikern auseinander. The most recent (Fifth) revision of the Declaration of Helsinki, adopted in October 2000 by the World Medical Association (WMA), reinforces the longstanding prohibition against offering placebo instead of effective therapy. The WMA left no doubt that if a beneficial treatment for a condition has already been recognised, it is unethical to offer placebo in place of such treatment to anyone in a study of the same condition. We have previously drawn attention to the discrepancy between the spirit of the (...) Declaration and the common practice of using placebo controls in randomised trials even if effective treatment exists. Despite the mandates of the Declaration of Helsinki and concern from ethicists and scientists, the US Food and Drug Administration (FDA) continues to demand and defend placebo‐controlled evidence of efficacy and safety for the development of many new pharmaceuticals, even if effective therapy exists. We suggest that the FDA's arguments defending their practice are insufficient to justify medical research that violates the Declaration of Helsinki. (shrink)

In October 2013, the Declaration of Helsinki was revised a seventh time in its 50 year history. While it is the most widely accepted set of ethical principles for the protection of patients participating in medical research, the Declaration of Helsinki has also been subject of constant controversy. In particular, its paragraph on the use of placebo controls in clinical trials divides the research community into active-control and placebo orthodox proponents, both continuously demanding revisions of the Declaration of Helsinki in (...) favour of their position. The goal of the present project is to compare the mainly theoretical controversy with regulatory implementation. We distributed a questionnaire to national drug regulatory authorities from different countries to collect information on the authorities’ respective approaches to interpretation and implementation of the Declarations’ placebo paragraph in the conduct of medical research. Our findings suggest that the majority of drug regulatory authorities have established a practice of a middle ground, allowing placebo controls in some instances. Various interpretations of “serious harm” and “methodological reasons” are proposed as well as safeguards to avoid abuse of the option to use placebo-controls. Leaving the placebo paragraph open to various interpretation is a result of the Declaration of Helsinki’s character as a guidance document. With the current version controversy will continue. The Declaration should be continued to be strengthened to enforce the appreciation of conducting medical research with the highest ethical standard. (shrink)

Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. Placebo-controlled trials are held by many, including regulators at agencies like the United States Food and Drug Administration, to be the gold standard in the assessment of new medical interventions. Yet the use of placebo controls in clinical trials has been the focus of considerable controversy. In this two-part article, we challenge a number of common beliefs concerning the value of placebo controls. Part I critiques statistical and other scientific justifications for the use of placebo controls in clinical research. The (...) continued use of placebo controls in clinical trials on diseases for which accepted treatment exists raises equally important ethical, legal, and regulatory issues for which various justifications have been given. Defense of this practice relies on normative as well as empirical myths.In their attack on the prevailing use of placebo controls, Kenneth Rothman and Karin Michels emphasize that this practice stands in violation of the World Medical Association's guidelines on the ethics of human experimentation, most commonly known as the Helsinki Declaration. The use of statistics in medical research has been compared to a religion: it has its high priests, supplicants, and orthodoxy. Although the comparison may be more unfair to religion than to research, a useful lesson can nonetheless be drawn: the practice of clinical research may benefit—as does the spirit—from critical self-examination. Arguably, no aspect of the conduct of clinical trials is currently more controversial—and thus in as dire need of critical examination—than the use of placebo controls. The ethical and (...) scientific controversies associated with placebo-controlled trials, never far below the surface, have once again seized public attention. Clearly, concern about these issues within the professional community runs deep and wide, as evidenced by the volume of response generated by Kenneth Rothman and Karin Michels's recent Critique. Criticisms of the use of placebo controls in clinical research are scattered through the literatureo; our objective is to present the case against placebos in a compendious form that takes account of scientific and statistical as well as normative issues. I would like to suggest another way to go further toward a new economy of power relations, a way which is more empirical, more directly related to our present situation, and which implies more relations between theory and practice. It consists of taking the forms of resistance against different forms of power as a starting point. To use another metaphor, t consists of using this resistance as a chemical catalyst so as to bring to light power relations, locate their position, (...) and find out their point of application and the methods used. Rather than analyzing power from the point of view of its internal rationality, it consists of analyzing power relations through the antagonism of strategies.[…]Let us come back to the definition of the exercise of power as a way in which certain actions may structure the field of other possible actions. What, therefore, would be proper to a relationship of power is that it be a mode of action upon actions. That is to say, power relations are rooted deep in the social nexus, not reconstituted "above" society as a supplementary structure whose radical effacement one could perhaps dream of. In any case, to live in a society is to live in such a way that action upon other actions is possible-- and in fact ongoing. A society without power relations can only be an abstraction. Which, be it said in passing, makes all the more politically necessary the analysis of power relations in a given society, their historical formation, the source of their strength or fragility, the conditions which are necessary to transform some or to abolish others. For to say that there cannot be a society without power relations is not to say either that those which are established are necessary or, in any case, that power constitutes a fatality at the heart of societies, such that it cannot be undermined. Instead, I would say that the analysis, elaboration, and bringing into question of power relations and the "agonism" between power relations and the instransitivity of freedom is a permanent political task inherent in all social existence.[…]In effect, between a relationship of power and a strategy of struggle there is a reciprocal appeal, a perpetual linking and a perpetual reversal. At every moment the relationship of power may become a confrontation between two adversaries. Equally, the relationship between adversaries in society may, at every moment, give place to the putting into operation of mechanisms of power. The consequence of this instability is the ability to decipher the same events and the same transformations either from inside the history of struggle or from the standpoint of the power relationships. The interpretations which result will not consist of the same elements of meaning or the same links or the same types of intelligibility, although they refer to the same historical fabric, and each of the two analyses must have reference to the other. Because of their range, brilliance, and singularity, the ideas of the philosopher-critic-historian Michel Foucault have gained extraordinary currency throughout the Western intellectual community. This book offers a selection of seven of Foucault's most important published essays, translated from the French, with an introductory essay and notes by Donald F. Bouchard. Also included are a summary of a course given by Foucault at College de France; the transcript of a conversation between Foucault and Gilles Deleuze; and an interview with Foucault (...) that appeared in the journal Actuel. Professor Bouchard has divided the book into three closely related sections. The four essays in Part One examine language as a "perilous limit" of what we know and what we are. The essays in the second part suggest the methodological guidelines to which Foucault subscribes, and they record, in the editor's words, "the penetration of the language of literature into the domain of discursive thought." The material in the last section is more obviously political than the essays. It treats language in use, language attempting to impart knowledge and power. Translated by the editor and Sherry Simon into fluent and lucid English, these essays will appeal primarily to students of literature, especially those interested in contemporary continental structuralist criticism. But because of the breadth of Foucault's interests, they should also prove valuable to anthropologists, linguists, sociologists, and psychologists. (shrink)

Written while the pandemic was still a key issue, this article tries to imagine the post-pandemic from different perspectives, and first of all in distinct temporalities. A question arises immediately: how can we consider the hypothesis of a deep cultural or anthropological mutation with intellectual or scientific tools that were forged before this mutation? What might new approaches for the social sciences look like? The article proceeds to analyse the more obvious social, technological and cultural changes that occurred with the (...) pandemic, which definitively modify our perception and understanding of globalisation. New or renewed inequalities, intergenerational tensions, racism, increasing fake news and conspiracy theory visions of the world, but also issues raised by feminism or ecology are at stake here. The course given by Michel Foucault from February to March 1984, under the title 'The Courage of Truth', was his last at the Collège de France. His death shortly after, on June 25th, tempts us to detect a philosophical testament in these lectures, especially in view of the prominence they give to the theme of death, notably through a reinterpretation of Socrates' last words--'Crito, we owe a cock to Asclepius'--which, with Georges Dumézil, Foucault understands as the expression of a (...) profound gratitude towards philosophy for its cure of the only serious illness: that of false opinions and prejudices. Dans les sociétés pluralistes, qui n'ont pas en commun un ensemble de valeurs éthiques, sociales et politiques, l'interprétation juridique est sous tension permanente. Les interprétations justes - c'est-à-dire les interprétations qui reflètent une conception partagée de la justice - peuvent être juste des interprétations ; autrement dit, des interprétations qui correspondent seulement aux aspirations et aux intérêts de différents groupes sociaux. Dans ce livre, Michel Rosenfeld s'affronte à cette crise de l'interprétation juridique. Il présente une évaluation critique des principaux (...) courants de la théorie du droit contemporaine aux Etats-Unis et en France et propose une approche différente. L'analyse de Michel Rosenfeld porte aussi bien sur le néo-formalisme, le pragmatisme, la théorie du discours, que la théorie autopoiétique. Elle comporte un examen des thèses des principaux auteurs et notamment de Habermas, Rorty, Posner, Luhmann, Dworkin, Fish et Weinrib. Pour remédier à certaines insuffisances de ces thèses, à propose la théorie du pluralisme compréhensif, fondée sur une conception matérielle du pluralisme. Cette approche transforme le fait du pluralisme en un principe normatif. A partir des intuitions de la déconstruction, il répond à cet appel de Derrida, auquel on n'a pas prêté une attention suffisante, à un engagement à combler la distance entre soi et l'autre, sans sacrifice de l'un ou de l'autre. Michel Rosenfeld montre que la théorie du pluralisme compréhensif permet de surmonter les limitations du libéralisme, du républicanisme et du communautarisme, tout en évitant les apories du monisme et du relativisme. " Les interprétations justes " est un outil pour s'orienter et sortir des labyrinthes théoriques et, à ce titre, il s'adresse à ceux qui s'occupent de théorie du droit, de droit constitutionnel, de philosophie sociale, de science politique ou de théorie critique, comme à ceux qui, à partir de points de vue disciplinaires divers, s'intéressent aux textes, à l'interprétation et qui partagent, dans une perspective postmoderne, le souci de la justice. Am 28. August 2020 ware Georg Wilhelm Friedrich Hegel (1770-1831) zweihundertfunfzig Jahre alt geworden. Zu diesem Anlass setzt sich Karin Weingartz-Perschel mit der aktuellen Bedeutung der Hegelschen Dialektik fur die geisteswissenschaftliche Forschung auseinander. Sie pladiert dafur, dass Hegels anthropologische Axiomatik als das Bleibende und Vorwartsgerichtete an seinem philosophischen Wirken erachtet werden sollte. In Hegels Fruhwerk, der "Phanomenologie des Geistes", findet sich seine anthropologische Axiomatik, auf der sich sein ganzes Gedankengebaude erhebt. Nur hier lasst sich der Schlussel zu seiner Dialektik (...) in Form seiner anthropologischen Grundannahmen finden. Alle seine weiteren Werke unterstellen dieses Wissen nur. Die "Phanomenologie" sollte daher nicht lediglich als Fruhwerk oder als zu vernachlassigende Einleitung in Hegels Hauptwerk abgetan werden, sondern einen deutlich hoheren Stellenwert einnehmen.
