This article investigates a high-profile and ongoing dilemma for healthcare professionals (HCPs), namely whether the existence of a (legal) duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English caseABC v St George’s Healthcare NHS Trust and othersconsidered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. Americans read more than 10 magazines per month. Despite the profound effect this exposure has on individuals and society, little research has been done into ethical standards of magazines. Results of this pilot study of 100 consumer magazines indicate a considerable lack of standard practices and few ethical guidelines.

The explosion of research interest in faces and face processing and the engagement of a wide range of disciplines is fueled by theoretical fascination combined with applied importance. This article describes some of the psychological research that has accompanied the recent rapid development or deployment of systems for showing, building, or manipulating faces for a variety of purposes. It illustrates the psychological issues that arise in a range of engineering, medical, and legal contexts and shows that technological development has not (...) always been matched by an appreciation of the psychological issues that need to be overcome to take full advantage of new systems. In some areas the advances raise new psychological issues. New technology has simply replicated old problems—e.g. that witnesses cannot recall individual face features; or that resemblance and identity are not the same thing. (shrink)

After centuries of philosophical explorations of the remote and the elevated, in our work we give credibility to the possibility that the time has come for philosophy to conquer back the ordinary. Nor only we assume this, but we would also conclude that the main task of philosophy is the recovery of the ordinary (world). A task that also helps to understand what philosophy is or should be or could be. We intend to explore philosophy traditional reluctance to the ordinary (...) and its tendency to look for answers far from it explaining the reasons it has for it. Secondly we would explore the ordinary world itself, trying to characterize it and what does inhabiting it mean. And finally we would look at some philosophical problems (mainly epistemological and moral problems, but not exclusively) from the perspective that gives a philosophy that finds itself comfortable in the ordinary world. Much has been written over the last decade on the urgency of expanding the canon, although the imperialist overtones of such a movement have not always been registered. A great deal of attention has pooled at the borders of the canon, as we aim to erode or extend those borders, but crucial assumptions about the privileged status of the subject matter that we as critics choose, whatever that subject matter may be, canonical or extracanonical, have not been questioned with comparable (...) intensity. Although the hegemony of the subject and the concomitant transformation of the “other” into an object have been attacked theoretically from several different directions , we nevertheless lack a widespread practical, professional awareness of the extent to which the status of what we “criticize” and teach silently reproduces a subject/object economy of privilege. In the pages that follow, my contribution to the case against the sacralized status of art emerges out of the implicit dialogue that Paul Wunderlich initiates with James Joyce on the “subjects” of sexism, anti-Semitism, art, and politics, set against the background of the Holocaust. My target is neither Wunderlich nor Joyce—nor is it any of the groups that they might be said to represent—but the political implications of artistic privilege, a priveilege that criticism, even “resistant” criticism, may seek to redistribute but not to challenge. My aim is not to desecrate Joyce’s authority nor to objectify him as a stereotypical sexist or anti-Semite, but to deauthorize and rehumanize his monumental status by recontextualizing the grounds of his achievement, climbing down to . In the hundred years since its publication, Wittgenstein’s Tractatus Logico-Philosophicus has become a contemporary classic with the peculiarity that it is surrounded by an aura of mystery: what is really Wittgenstein’s aim in writing the Tractatus, how are we to understand the last two propositions of the Tractatus that enjoin us to detach ourselves from the book itself and keep silent, can the Tractatus be anything other than a positivist and anti-metaphysical treatise, and so on? Here we will argue that (...) the answer to these questions must consider what the ethical meaning of the Tractatus might be and, closely related to that, what its importance is and that of the ineffable in general. This collection of essays explores conceptions of toleration and tolerance in Asia and the West. It tests the assumption in contemporary Western political discourse and theory that toleration is a uniquely Western virtue and finds that many other traditions have comparable ideas and practices in grappling with religious and cultural diversity.

LindIn "Dispelling the Myth of the Non-Singer: Embracing Two Aesthetics for Singing," Louise Pascale explores classroom teachers' beliefs about singing. Specifically, she looks at possible reasons why many classroom teachers who have been raised in the Western traditions of music-making do not feel comfortable singing. As a vocal music education professor and an (...) avid singer, this is a topic near and dear to my heart. My image of a vibrant elementary classroom, rooted in my experiences as a student and later as an elementary music teacher, includes singing. If, as Pascale notes, there is a growing number of teachers who define themselves as "non-singers" and who, because of this, do not include music in the classroom, there is indeed reason for alarm.As I read the introductory paragraph of this paper I immediately thought of elementary teachers who had at one time or another been labeled as "tone deaf" and who had allowed an early negative singing experience to cause them to believe they could not sing. Pascale challenged this simple explanation of the non-singer and made a strong case for a more thorough investigation of the problem.Pascale began her investigation by conducting a series of interviews with people who believed they could not sing. She found a variety of reasons for the self-proclaimed non-singers negative self image including: 1) never being selected to sing a solo; 2) not being able to lead songs, and 3) not singing in tune. Pascale used the story of a young Barbados woman, Onika, as an illustration of how these experiences could be linked to Western music traditions. Onika was born in Barbados but moved to the United States at the age of four. This young woman considered herself a singer in her native country but a non-singer in America. Onika felt she was a singer in Barbados because she enjoyed singing music in the Solka tradition; the music was fun, moved fast, and she could sing along without being concerned about how she sounded. She described herself as a non-singer in the United States because she was not able to lead songs and did not have a strong voice.I agree that the conventional Western view of music in the schools is rooted in classical traditions that value performance, perfection, and virtuosity and that these views may lead to the above mentioned assumptions regarding singing. I question, however, whether this conventional view permeates the beliefs of those [End Page 200] outside of the traditional music education circle. Onika's experiences with music in Barbados seemed to be very natural, a part of life; her experiences with music in the United States seemed limited to formal experiences in church or school settings. It would be interesting to investigate whether the dichotomy is between two cultures, the United States and Barbados, or between two different ways of experiencing music, in school and in everyday life.The main body of Pascale's work is the description of two aesthetics for singing, Aesthetic A, the classical Western tradition and Aesthetic B, a broader, multi-dimensional perspective. The list of characteristics differentiating Aesthetic A and Aesthetic B relate to the teaching of music, the process of music education. Emphasizing product and performance, stressing the importance of skill building and relying on classical repertoire are characteristics related to the traditional viewpoint, or Aesthetic A. These characteristics are contrasted with those related to Aesthetic B; the emphasis is placed on process and participation, stress is placed on social value and feeling, and vernacular repertoire is used. Pascale makes the point that Aesthetic B is not meant to replace "traditional" thinking but is a broadening of the perspective. Two questions emerge from Pascale's two aesthetics. First, is there a commonly held "traditional" culture of singing that exists in schools today? Schools and learning populations in the United States are so diverse it is hard to imagine a single philosophy driving music education. Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health and (...) Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. Parents who are facing decisions about life-sustaining treatment for their seriously ill or dying child are supported by their child's doctors and nurses. They also frequently seek other information sources to help them deal with the medical and ethical questions that arise. This might include written or web-based information. As part of a project involving the development of such a resource to support parents facing difficult decisions, some ethical questions emerged. Should this information be presented in a strictly neutral fashion? (...) Is it problematic if narratives, arguments or perspectives appear to favour stopping over continuing life-sustaining treatment? Similar questions might arise with written materials about decisions for adults, or for other ethically contentious decisions. This paper explores the meaning of ‘balance’ in information provision, focusing particularly on written information about life-sustaining treatment for children. We contrast the norm of non-directiveness in genetic counselling with the shared decision-making model often endorsed in end-of-life care. We review evidence that parents do not find neutrality from medical professionals helpful in discussions. We argue that balance in written information must be understood in the light of the aim of the document, the most common situation in which it will be used, and any existing biases. We conclude with four important strategies for ensuring that non-neutral information is nevertheless ethically appropriate. (shrink)

In exploring phenomenological literature, it is evident that the term ‘phenomenology’ holds rather different meanings depending upon the context. Phenomenology has been described as both a philosophical movement and an approach to human science research. The phenomenology of Husserl, Heidegger, Gadamer, and Merleau-Ponty was philosophical in nature and not intended to provide rules or procedures for conducting research. The Canadian social scientist, van Manen, however, introduced specific guidelines for conducting human science research, which is rooted in hermeneutic phenomenology and this (...) particular method has been employed in professional disciplines such as education, nursing, clinical psychology, and law. The purpose of this paper is to explore the difference between the phenomenological method as described by van Manen and that of other philosophers such as Husserl, Heidegger, Gadamer, and Merleau-Ponty. In so doing, the author aims to address the blurred boundaries of phenomenology as a research method and as a philosophical movement and highlight the influence of these blurred boundaries on nursing knowledge development. This article aims to present a Žižekian reading of the British author David Herbert Lawrence. The contemporary continental philosopher has tackled each of the British author’s reoccurring themes individually and thus may be used as a keystone for a valid literary interpretatio n. The paper begins by shedding light on the representation of Western ideology, moves further into the comprehension of the impacts of modern cultural capital and the limitations of industrialization. While at the same time the dissertation targets another (...) component of the romantic poet’s many writings which are characterized by the regeneration of the subject’s carnal presence as a defense mechanism against the prevalent culture of de-humanization. The argument at hand is that the reconstruction of the bodily image rendered through Lawrence’s erotic literature is not one that portrays promiscuity, but rather demonstrates a transgression of the Lacanian symbolic and the attainment of a partial rendition of a Hegelian totality. Lawrence’s six novels and set of poems are thoroughly analyzed from a strictly Žižekian p erspective to demonstrate that th e two authors share thematic representations, a common worldview and propose a manifestation of how literary analyses may be conveyed using Žižek as a philosophical lens for literary interpretation. In this contribution to the Common Knowledge symposium “Fuzzy Studies,” the authors, all of whom work in the field of science, technology, and society, begin from the assumption that, as Bruno Latour has put it, “we have never been modern.” They accept the STS thesis that, while modern practices purport to be entirely rational and coherent, on closer inspection they turn out to be as much noncoherent as coherent. This article poses the question of what forms “noncoherences” take and how (...) they are managed. The basic argument is that there is a range of styles of noncoherence or “modes of syncretism.” In small case studies, the authors identify six such modes or styles, which they term denial, domestication, separation, care, conflict, and collapse. Given that consistency and coherence seem less important now than they were once taken to be — and given that the conditions of possibility for purity are, in any case, in decline — this list and its supporting case studies, while not meant to be definitive, are offered as a way of understanding how practices that do not cohere may still function and fit together admirably. La convicción de que los fenómenos y procesos naturales podían ser representados en un espacio físico regido por la geometría euclídea actuó en la ciencia clásica como supuesto epistemológico fundamental de la creación teórica. La posibilidad de un análisis matemático del continuo garantizaba, en efecto, una descripción intuitiva y pictórica de las trayectorias de los móviles estudiadas por la dinámica, así como una determinación precisa de los efectos producidos en el seno de las relaciones causales. Fueron convicciones y supuestos que (...) tuvieron que ser revisados en el momento en que el cuanto de acción de Planck obligó a desarrollar una nueva... física de los sistemas atómicos. Las consecuencias, no obstante, se dejarían sentir no sólo en el ámbito de la Física sino en todas aquellas regiones de la ciencia natural, como la Biología, que tenían que construirse bajo la cobertura conceptual de la naciente mecánica. El presente trabajo es una reflexión sobre los problemas filosóficos planteados en el encuentro entre la física del átomo y la química de las moléculas. The certainty that natural phenomena and processes could be represented in a physical space ruled by Euclidean geometry was a fundamental epistemological assumption of theoretical creation in classical science. The possibility of a mathematical analysis of the continuum ensured an intuitive, pictorial description of mobile trajectories as studied in dynamics, as well as a precise determination of the effects generated within causal relations. These convictions and assumptions had to be reviewed when the Plank action quantum forced the development of a new physics of atomic systems. Consequences, nevertheless, transcended the scope of Physics and... extended to all regions of natural science, including Biology, which had to be built under the conceptual coverage of the nascent mechanics. The present work is a reflection on the philosophical problems posed by the encounter of physics of atoms and chemistry of molecules. (shrink)

In ancient Rome, there was no need for people to have distinct names, they followed that of their tribe. For instance, a family of four children would classify their kids as young, middle, old, and first-born. There was no need for them to have their own identity because this identity was no expected to serve any purpose. Although two thousand years have gone by, this ideological reproduction of the self into a miniature replica is still present within contemporary Levantine societies. (...) This paper will particularly shed light on 21 st century Lebanon and its system of ideological stratification and inheritance; this structure functions on the basis of an advanced rendition of primitive tribalism, known as sectarianism. Consequently, this sectarian identity enables the othering of the self from its own surrounding as well as any “outsider”. This constant and inter-generational practice is classified as a manifestation of persistence. (shrink)

Recent state regulations require women, before undergoing abortions, to be subjected to unwanted and nonmedically necessary sonograms, often requiring an intrusive vaginal probe. Physicians, for their part, are forced to turn the viewing screens toward the faces of their patients and to describe to them the details on the screen. In this commentary, I explain these current laws and the various court responses to them to date. Further, I demonstrate why these abortion regulations violate the ethical principles governing informed consent (...) and why they should be declared unconstitutional based on women’s constitutional rights as settled by Planned Parenthood of Southeastern Pennsylvania v. Casey and physicians’ First Amendment rights. (shrink)

The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

International research guidance has shifted towards an increasingly proactive inclusion of children and adolescents in health research in recognition of the need for more evidence-based treatment. Strong calls have been made for the active involvement of children and adolescents in developing research proposals and policies, including in decision-making about research participation. Much evidence and debate on this topic has focused on high-income settings, while the greatest health burdens and research gaps occur in low-middle income countries, highlighting the need to take (...) account of voices from more diverse contexts. Between January and March 2014, 56 community representatives and secondary school students were involved in eight group discussions to explore views on the acceptability of involving children and adolescents in research, and how these groups should be involved in decision-making about their own participation. Discussions were voice-recorded and transcriptions analyzed using Framework Analysis, combining deductive and inductive approaches. Across these discussions, the idea of involving children and adolescents in decision-making about research participation was strongly supported given similar levels of responsibility carried in everyday life; existing capacity that should be recognized; the opportunity for learning involved; varying levels of parental control; and generational shifts towards greater understanding of science for adolescents than their parents. Joint decision-making processes were supported for older children and adolescents, with parental control influenced by perceptions of the risks involved in participation. Moves towards more active involvement of children and adolescents in planning studies and in making decisions about their participation are supported by these findings from Kenya. Important emerging considerations include the need to take account of the nature of proposed studies and prevailing attitudes and understanding of research in identifying children’s and adolescents’ roles. More research is needed to expand diversity and develop approaches to joint assent and consent processes that would fairly represent children’s and adolescents’ wishes and interests, towards their long term benefit. Machiavelli's ambiguous treatment of religion has fueled a contentios and long-standing debate among scholars. Whereas some insist that Machiavelli is a Christian, others maintain he is a pagan. Sullivan mediates between these divergent views by arguing that he is neither but that he utilizes elements of both understandings arrayed in a wholly new way. She develops her argument by distinguishing among the three Romes that can be understood as existing in Machiavelli's political thought: the first is the Rome of the (...) Christian era, dominated by the pope; the second is the republican Rome of pagan times, which Machiavelli praises; and the third is an idealized Rome that is neither entirely pagan nor entirely Christian. Sullivan draws primarily from the Florentine Histories, The Prince, and the Discourses to offer a unique study of Machiavelli's political thought. Her examination of Machiavelli's three Romes will engage readers concerned with political thought, philosophy of the state, and Machiavelli. (shrink)

This paper examines the connection between politics and public space at a time when photography and the new media have put the classical distinction between the public and the private into question. My focus is on the body which, according to Hannah Arendt and the classical philosophers, is the most private thing there is. Drawing on the work of Weimar photojournalist Erich Salomon – who was among the first to infiltrate the spaces where political talks were held and decisions taken (...) – I argue for an understanding of the body as an aesthetic object and a site where public and private criss-cross and intersect. The body in photography leads me to the final part of the paper where I trace the figuring of the body in the texts of Plato, Aristotle and the Stoics, and argue that far from being a recent phenomenon, the aestheticisation of politics is already at work in the tradition that celebrates deliberation and the public use of reason.
