Alors qu'il est encore bien malaisé de porter un jugement éthique et juridique sur le développement des biotechnologies, chacun s'interroge sur la justification et les risques des techniques les plus récentes, les perspectives qu'elles ouvrent à l'homme, mais également leur compatibilité avec la dignité de la personne. Lors d'un colloque pluridisciplinaire et international organisé par (...) la Faculté de droit de Nancy, le Centre Juridique Franco-Allemand et le Groupe de recherche de droit médical de l'Université de la Sarre, juristes, philosophes et médecins se sont penchés ensemble sur ces questions essentielles. Leurs réflexions et les discussions qu'elles ont engendrées, à la lumière des sensibilités française et allemande, font l'objet du présent ouvrage. En langue française, les diverses contributions sont suivies d'un résumé en allemand. Les fulgurants progrès des biotechnologies offrent incontestablement à l'humanité des chances nouvelles. Mais face à des biologistes dont certains se prennent déjà pour Dieu, il devient d'une urgente nécessité de réaffirmer les Droits de l'Homme. Qu'il s'agisse de procréation médicalement assistée, de thérapie génique ou d'expérimentation sur l'homme, une conclusion s'impose : lorsqu'elle menace la dignité de la personne, la liberté de la Science doit être limitée. Through a wide-ranging international collection of papers, this volume provides theoretical and historical insights into the development and application of phenomenological sociology and ethnomethodology and offers detailed examples of research into social phenomena from these standpoints. All the articles in this volume join together to testify to the enormous efficacy and potential of both phenomenological sociology and ethnomethodology.

This article discusses the role of the mental in the analysis of criminal liablity. The relation between the general conditions for mens rea and those of criminal liability are considered. Claims made by John Gardner and Heike Jung are considered. Their suggestion that there is a hard and fast distinction between the principles of moral and criminal culapability are considered and shown to have some absurd conclusions.

The notion of ‘wise mother and good wife (WMGW)’ (Hyonmo Yangcho) is the traditional idealized image of Korean womanhood as one who serves her country and others through her roles as a mother and wife. This ideology may continue to have some significance in the lives of many first‐generation Korean immigrant women, but its potential role in the adjustment challenges these women may face while acculturating to the immigrant context in the United States has received little attention. In this paper, (...) we briefly review the historical background of the WMGW ideology and discussed the significance of focusing research attention on the role of this notion in contemporary first‐generation Korean immigrant women in the United States. We focus on the intersecting influences of gender, ethnicity, and immigrants’ generation status, which may further marginalize some first‐generation Korean immigrant mothers. We then outline possible unique challenges faced by some of these mothers due to the WMGW gender ideology, highlighting potential immigration‐related difficulties including changes in their social support networks, parenting burden, mental health, and language issues. Finally, we provide suggestions for researchers and practitioners working with U.S. Korean immigrant women. (shrink)

Business Ethics: A European Review, EarlyView.

This study aims to disclose how the magnetic resonance imaging neuroimaging approach has been applied in education studies, and what kind of learning themes has been investigated in the reviewed MRI neuroimaging research. Based on the keywords “brain or neuroimaging or neuroscience” and “MRI or diffusion tensor imaging or white matter or gray matter or resting-state,” a total of 25 papers were selected from the subject areas “Educational Psychology” and “Education and Educational Research” from the Web of Science and Scopus (...) from 2000 to 2019. Content analysis showed that MRI neuroimaging and learning were studied under the following three major topics and nine subtopics: cognitive function, science education, and brain development. As for the type of MRI neuroimaging research, the most frequently used approaches were functional MRI, followed by structural MRI and DTI, although the choice of approach was often motivated by the specific research question. Research development trends show that the neural plasticity theme has become more prominent recently. This study concludes that in educational research, the MRI neuroimaging approach provides objective and empirical evidence to connect learning processes, outcomes, and brain mechanisms. (shrink)

Abstract This study was designed to investigate the factors affecting ethical practices of public relations professionals in public relations firms. In particular, the following organizational ethics factors were examined: (1) presence of ethics code, (2) top management support for ethical practice, (3) ethical climate, and (4) perception of the association between career success and ethical practice. Psychopathy is typically seen as a trait that is undesirable in any context, including the workplace. But several authors have suggested that people high in psychopathy might possess resources that preserve their ability to perform well in stressful contexts. We consider the possibility that primary psychopathy is adaptive—for the employee, if not for the organization—under conditions of abusive supervision. In particular, we draw from the multimotive model of interpersonal threat and the theory of purposeful work behavior to argue that high (...) primary psychopathy individuals possess characteristics that enable them to experience higher levels of well-being and lower levels of anger than their peers under abusive supervisors. Based on a scenario study and a time-lagged field study, we found support for a model in which abusive supervision moderates the relationships between primary psychopathy and positive work-related outcomes, such that these relationships are positive under conditions of abusive supervision and either diminished or negative under conditions of low abusive supervision. Abusive supervision also affected the relationship between primary psychopathy and anger in the field study such that high primary psychopathy individuals were less angry under more abusive supervisors. Thus, there appears to be some credence to the notion of a “psychopathic advantage” in that primary psychopaths do have access to greater psychological resources than their peers under abusive supervision. However, these findings also suggest that abusive supervisors may empower employees with characteristics that hold strong potential to damage the organization and its stakeholders. (shrink)

Introduction: Congenital myasthenic syndromes refer to a heterogenic group of neuromuscular transmission disorders. CMS-subtypes are diverse regarding exercise intolerance and muscular weakness, varying from mild symptoms to life-limiting forms with neonatal onset. Long-term follow-up studies on disease progression and treatment-response in pediatric patients are rare.Patients and Methods: We analyzed retrospective clinical and medication data in a cohort of 32 CMS-patients including the application of a standardized, not yet validated test to examine muscular strength and endurance in 21 patients at the (...) last follow-up. Findings obtained in our cohort were compared with long-term follow-up studies of CMS-cohorts from the literature by considering the underlying molecular mechanisms. Outcomes of CMS-ST were compared to results of normal clinical assessment.Results: Thirty-two pediatric patients with defects in eight different CMS-genes were followed by a median time of 12.8 years. Fifty-nine percentage of patients manifested with first symptoms as neonates, 35% as infants. While 53% of patients presented a reduced walking distance, 34% were wheelchair-bound. Even under adequate therapy with pyridostigmine and 3,4-diaminopyridine, CHAT-mutations led to the progression of muscular weakness partly in combination with persistent respiratory and bulbar symptoms. RAPSN, CHRND, and CHRNB1 patients with neonatal manifestation, early respiratory problems, and bulbar symptoms showed a good and maintained treatment response. CHAT and CHRNE patients required higher PS dosages, whereas RAPSN patients needed a lower mean dosage at the last follow-up. The benefits of short-term medication and long-term progression of symptoms were highly dependent on the specific genetic defect. CMS-ST was carried out in 17/21 patients, determined affected muscle groups including bulbar and ocular symptoms, some of which were not reported by the patients.Conclusions: Our findings and comparison with the literature- suggest a better treatment-response and less severe progression of symptoms present in patients suffering from mutations in CMS-genes directly associated with receptor deficiency, while patients with defects leading to synaptopathy and presynaptic defects tend to have worse outcomes. Assessment of affected muscular groups and clinical symptoms by CMS-ST may be a useful tool for optimal therapeutic management of the patients, especially for future clinical studies. (shrink)

This book investigates the different meanings and logics that the notion of qi/gi has acquired within the East Asian traditions in order to understand the diversity of these traditions. More specifically, this work focuses on investigating how the notion was understood by traditional Chinese and Korean philosophers.

This volume documents the 17th Münster Lectures in Philosophy with Susan Haack, the prominent contemporary philosopher. It contains an original, programmatic article by Haack on her overall philosophical approach, entitled ‘The Fragmentation of Philosophy, the Road to Reintegration’. In addition, the volume includes seven papers on various aspects of Haack’s philosophical work as well as her replies to the papers. Susan Haack has deeply influenced many of the debates in contemporary philosophy. In her vivid and accessible way, she has made (...) ground-breaking contributions covering a wide range of topics, from logic, metaphysics and epistemology, to pragmatism and the philosophy of science and law. In her work, Haack has always been very sensitive in detecting subtle differences. The distinctions she has introduced reveal what lies at the core of philosophical controversies, and show the problems that exist with established views. In order to resolve these problems, Haack has developed some ‘middle-course approaches’. One example of this is her famous ‘Foundherentism’, a theory of justification that includes elements from both the rival theories of Foundationalism and Coherentism. Haack herself has offered the best description of her work calling herself a ‘passionate moderate’. (shrink)

Comparing expression patterns of orthologous genes between insects and vertebrates, we have recently proposed that the ventral nerve cord in insects may correspond to the dorsal nerve cord in vertebrates. Here we show that the early development of the insect and vertebrate brain anlagen is indeed very similar. Insect and vertebrate brains express similar sets of genes in comparable areas with similar functions in the adult. In addition, early axogenesis establishes surprisingly similar patterns of axonal connectivity in both groups. We (...) therefore propose that insect and vertebrate brains are built according to a common ground plan, and that specific areas of the insect and vertebrate brains be considered as homologous, meaning that these areas already existed, with their specific functions, in their common ancestor. While the effect of top executives' social networks on their compensations has received substantial scholarly attention, little effort has been made to integrate segmented views to offer more complete understanding of this effect. In this paper, we propose an integrative two-stage model by taking both economic and socio-political views into account. We theorise that some characteristics of top executive's outside social ties are positively related to firm performance, and those relationships are conditioned by external and internal strategic contexts, such as (...) environmental uncertainty, strategic relevance, and tie strength. We also theorise that firm performance leads to executives' compensations, but this linkage is moderated by the socio-political dynamics among executives (within-group dynamics) as well as between executives and a board of directors (between-group dynamics) inside the firm. Based on our integrative framework, this paper provides the comprehensive understanding of how executives' compensations are determined and highlights the importance of executive's social ties and their implications. Nicht zuletzt der Krieg in der Ukraine zeigt die herausragende Bedeutung des Weltraumes für unsere Gesellschaft sowie die militärische Operationsführung im Allgemeinen. Bereits in 2019 wurde durch die NATO dieser Bedeutung Rechnung getragen, in dem der Weltraum als fünfte Dimension neben Luft, Land, See und Cyber anerkannt wurde. Die für den Weltraum notwendige Infrastruktur wird gemeinhin als kritisch betrachtet und fällt damit auch unter die Abschreckungssystematik der NATO. Der Beitrag diskutiert die Abschreckungspolitik der NATO im Kontext Weltraum entlang der zwei (...) vorherrschenden Paradigmen – deterrence by punishment und deterrence by denial. In der Folge wird diskutiert, inwieweit die Förderung einer tragfähigen Responsive Space-Mentalität und deren Umsetzung in anwendbare Strategien von wesentlicher Bedeutung für die Übertragung auf eine kollektive Abschreckungsstrategie der NATO sein wird. Reaktionsfähige Weltraumkapazitäten werden es allen Mitgliedstaaten ermöglichen, zu den kollektiven Verteidigungsanstrengungen des Bündnisses beizutragen und den Grundsatz der deterrence by denial zu stärken. Resumo: Este artigo objetiva investigar de que forma a proposta de educação continuada de uma escola de Educação Básica privada franciscana, localizada no Sul do Brasil, contribui na construção de si e da prática pedagógica de seus docentes. A metodologia é de abordagem qualitativa, do tipo estudo de caso. Para a coleta de dados utilizou-se a entrevista semiestruturada, com escolha intencional dos participantes (professores, coordenadoras pedagógicas e alunos). Optou-se pela análise textual, cujo processo de auto-organização deu-se a partir da desordem (...) em direção a uma nova ordem, passando pela emergência do novo para, finalmente, auto organizar-se de forma intuitiva. Os resultados apontam possíveis caminhos para o projeto formativo e confirmam que a participação dos professores na educação continuada ofertada pela escola contribui para a mudança no ser pessoa, incentivando-os a empreenderem inovações na prática pedagógica. Além disso, produziram aprendizagens significativas sobre a sua prática pedagógica e concepções de educação continuada, seus entendimentos no processo de autoformação (subjetividade) de si como seres em devir. Evidenciou-se que o despertar para a necessidade da educação continuada como contribuição para a autoformação do ser pessoa profissional é algo inerente ao ser humano na busca pela sua inteireza. The methodology uses a qualitative approach, of the case study type. For data collection, a semi-structured interview was used, with the intentional choice of the participants (teachers, pedagogical coordinators and students). We opted for textual analysis, whose self-organization process started from disorder towards a new order, passing through the emergence of the new and, finally, self-organizing in an intuitive way. The results indicate possible paths for the training project and confirm that the participation of teachers in the continuing education offered by the school contributes to the change in being a person, encouraging them to undertake innovations in pedagogical practice. In addition, they produced significant learning about their pedagogical practice and conceptions of continuing education, their understandings in the process of self-training (subjectivity) of themselves as beings in becoming. It was evident that the awakening to the need for continuing education as a contribution to the self-training of being a professional person is something inherent to human beings in the search for their wholeness. La metodología utiliza un enfoque cualitativo, del tipo de estudio de caso. Para la recolección de datos se utilizó una entrevista semiestructurada, con la elección intencional de los participantes (docentes, coordinadores pedagógicos y estudiantes). Se optó por el análisis textual, cuyo proceso de autoorganización partió del desorden hacia un nuevo orden, pasando por la emergencia de lo nuevo y, finalmente, autoorganizándose de manera intuitiva. Los resultados señalan posibles caminos para el proyecto formativo y confirman que la participación de los docentes en la formación continua que ofrece la escuela contribuye al cambio en el ser persona, animándolos a emprender innovaciones en la práctica pedagógica. Además, produjeron aprendizajes significativos sobre su práctica pedagógica y concepciones de educación continua, sus entendimientos en el proceso de autoformación (subjetividad) de sí mismos como seres en devenir. Se evidenció que el despertar a la necesidad de la educación continua como aporte a la autoformación del ser profesional es algo inherente al ser humano en la búsqueda de su integridad. Generalized structured component analysis (GSCA) is a component-based approach to structural equation modeling (SEM), where latent variables are approximated by weighted composites of indicators. It has no formal mechanism to incorporate errors in indicators, which in turn renders components prone to the errors as well. We propose to extend GSCA to account for errors in indicators explicitly. This extension, called GSCA_M, considers both common and unique parts of indicators, as postulated in common factor analysis, and estimates a weighted composite of (...) indicators with their unique parts removed. Adding such unique parts or uniqueness terms serves to account for measurement errors in indicators in a manner similar to common factor analysis. Simulation studies are conducted to compare parameter recovery of GSCA_M and existing methods. These methods are also applied to fit a substantively well-established model to real data. (shrink)

In this paper, we formulate some approaches to belief fusion and revision using epistemic logic semantics. Fusion operators considered in this paper are majority merging, arbitration, and general merging. Some modalities corresponding to belief fusion and revision operators are incorporated into epistemic logics. The Kripke semantics of these extended logics are presented. While most existing approaches treat belief fusion and revision operators as meta-level constructs, we directly incorporate these operators into our object logic language. By doing so, we both extend (...) the expressive power of epistemic logic and enhance the techniques of information fusion. (shrink)
