Alors qu'il est encore bien malaisé de porter un jugement éthique et juridique sur le développement des biotechnologies, chacun s'interroge sur la justification et les risques des techniques les plus récentes, les perspectives qu'elles ouvrent à l'homme, mais également leur compatibilité avec la dignité de la personne. Lors d'un colloque pluridisciplinaire et international organisé par (...) la Faculté de droit de Nancy, le Centre Juridique Franco-Allemand et le Groupe de recherche de droit médical de l'Université de la Sarre, juristes, philosophes et médecins se sont penchés ensemble sur ces questions essentielles. Leurs réflexions et les discussions qu'elles ont engendrées, à la lumière des sensibilités française et allemande, font l'objet du présent ouvrage. En langue française, les diverses contributions sont suivies d'un résumé en allemand. Les fulgurants progrès des biotechnologies offrent incontestablement à l'humanité des chances nouvelles. Mais face à des biologistes dont certains se prennent déjà pour Dieu, il devient d'une urgente nécessité de réaffirmer les Droits de l'Homme. Qu'il s'agisse de procréation médicalement assistée, de thérapie génique ou d'expérimentation sur l'homme, une conclusion s'impose : lorsqu'elle menace la dignité de la personne, la liberté de la Science doit être limitée. Much of this interest has been tied to efforts to draw up national and international plans to deal with a global pandemic. It is common for these plans to state the importance of drawing upon a well-developed (...) ethics framework and we argue that this framework should reflect the values and insights of feminist relational theory. More specifically, we argue that pandemic planning must be squarely situated in the larger realm of public health and that an ethics framework for public health will be one that recognizes the need to pay particular attention to the vulnerability of subpopulations lacking in social and economic power. We propose an ethics framework for public health that builds on the notions of relational personhood (including relational autonomy and social justice) and relational solidarity. We need to distinguish two sorts of natural kinds, scientific and common NKs, because the notion of NK, which has to satisfy demands at three different levels—ontological, semantic and epistemological—, is subject to two incompatible sets of constraints. In order to prove this, I focus on the much-discussed case of jade. In the first part of the paper, I show that the current accounts are unsatisfactory because they are inconsistent. In the process, I explain why LaPorte’s analysis of “jade” as (...) a vernacular NK-term with an open-texture meaning does not offer a way out. Using a reductio ad absurdum argument, I conclude that according to the main tenets of NK-term theories, today’s “jade” has to be an NK-term, and jade thereby an NK. In the second part of the paper, I argue for this conclusion in a positive manner. First, I present a series of thought experiments demonstrating that today’s “jade” has the specific features of an NK-term. Then, I show that the kind that we presently call “jade” exhibits the typical ontological and epistemological features of an NK. More generally, I expound on why common NKs are more than mere classes, and why categories such as “jade” are useful in many inferences and explanations. (shrink)

The dominant approach to conscience in contemporary bioethics presumes that conscience functions to promote personal moral integrity, and therefore presumes that the relevant values are inherently personal. This approach fails to demonstrate when and why claims of conscience should be taken seriously by others. I draw on Hannah Arendt’s deliberative model of conscience and Cheshire Calhoun’s social model of integrity to develop an alternative relational view of conscience—one that demonstrates that the relevant values are social as well as personal. In this article, I argue that there is no compelling therapeutic ‘need’ for human nuclear genome transfer to prevent mitochondrial diseases caused by mtDNA mutations. At most there is a strong interest in this technology on the part of some women and couples at risk of having children with mitochondrial disease, and perhaps also a ‘want’ on the part of some researchers who see the technology as a useful precedent – one that provides them with ‘a quiet way station’ in (...) which to refine the micromanipulations techniques essential for other human germline interventions and human cloning. In advance of this argument, I review basic information about mitochondrial disease and novel genetic strategies to prevent the transmission of mutated mitochondria. Next, I address common features of contemporary debates and discussions about so-called mitochondrial replacement. First, I contest the cliché that science-and-technology is fast outpacing ethics. Second, I dispute the accuracy of the term ‘mitochondrial replacement’. Third, I provide a sustained critique of the purported ‘need’ for genetically-related children. In closing, I call into question the mainly liberal defense of human nuclear genome transfer. I suggest an alternative frame of reference that pays particular attention to issues of social justice. I conclude that our limited resources should be carefully expended in pursuit of the common good, which does not include pandering to acquired desires. (shrink)

Now that stem cell scientists are clamouring for human eggs for cloning-based stem cell research, there is vigorous debate about the ethics of paying women for their eggs. Generally speaking, some claim that women should be paid a fair wage for their reproductive labour or tissues, while others argue against the further commodification of reproductive labour or tissues and worry about voluntariness among potential egg providers. Siding mainly with those who believe that women should be financially compensated for providing eggs (...) for research, the new stem cell guidelines of the International Society for Stem Cell Research (ISSCR) legitimise both reimbursement of direct expenses and financial compensation for many women who supply eggs for research. In this paper, the authors do not attempt to resolve the thorny issue of whether payment for eggs used in human embryonic stem cell research is ethically legitimate. Rather, they want to show specifically that the ISSCR recommended payment practices are deeply flawed and, more generally, that all payment schemes that aim to avoid undue inducement of women risk the global exploitation of economically disadvantaged women. The existence of dysfunctions precludes the possibility of identifying the function to do F with the capacity to do F. Nevertheless, we continuously infer capacities from functions. For this and other reasons stated in the first part of this article, I propose a new theory of functions (of the etiological sort), applying to organisms as well as to artefacts, in which to have some determinate probability P to do F (i.e. a probabilistic capacity to do F) is a necessary condition (...) for having the function to do F. The main objective of this paper is to justify the legitimacy of this condition when considering artefacts. I begin by distinguishing “perspectival probabilities”, which reflect a pragmatic interest or an arbitrary state of knowledge, from “objective probabilities”, which depend on some objective feature of the envisageditems. I show that objective probabilities are not necessarily based on physical constitution. I then explain why we should distinguish between considering an object as a physical body and considering it as an artefact, and why the probability of dysfunction to be taken into account is one relative to the object as member of an artefact category. After clarifying how an artefact category can be defined if it is not defined in physical terms, I establish the objectivity of the probability of dysfunction under consideration by showing how it is causally determined by objective factors regulating the production of items of a definite artefact type. We outline a number of ethical objections to genetic technologies aimed at enhancing human capacities and traits. We then argue that, despite the persuasiveness of some of these objections, they are insufficient to stop the development and use of genetic enhancement technologies. We contend that the inevitability of the technologies results from a particular guiding worldview of humans as masters of the human evolutionary future, and conclude that recognising this worldview points to new directions for ethical thinking about genetic enhancement (...) technologies. We study definable sets and functions in such groups, and relate them to the quasi-o-minimal groups introduced in Belegradek (...) et al. . Main results: An essentially periodic group G is abelian; if G is discrete, then definable functions in one variable are ultimately piecewise linear. Suddenly, COVID-19 has changed the world and the way people work. Companies had to accelerate something they knew was imminent in the future, but not immediate and extremely humongous. This situation poses a huge challenge for companies to survive and thrive in this complex business environment and for employees, who must adapt to this new way of working. An effective e-leadership, which promotes companies’ adaptability, is needed. This study investigates the existing knowledge on teleworking and e-leadership; and analyzes the supposed (...) challenges. The literature review shows that companies with effective e-leadership can view teleworking as an opportunity. It is advantageous for not only companies’ productivity but also the environment and people who work remotely. However, a traditional or no leadership can result in some risks. Thriving in remote work environments implies that managers must adjust the companies’ structure, making them less hierarchical, and developing new abilities to establish a strong and trustworthy relationship with their employees to maintain their competitiveness, while retaining a genuine concern for their employees’ well-being. Similarly, successful e-leadership must be able to consolidate and lead effective virtual teams to accomplish organizational goals. This study contributes to the literature and leaders during the pandemic. (shrink)

Françoise Thébaud, en posant la question de savoir comment le genre structure les politiques de guerre, présente une intervention qui fait le point sur la « barbarisation » de la guerre dans le cadre de l’histoire du genre, à partir de la mise en évidence du passage du problème de l’émancipation, ou de l’autonomisation (cf. travaux des années 1960-1970), des femmes à celui de la réflexion plus récente sur la violence de guerre (depuis les années 1980) qui conteste la (...) thèse de la guerre « émancipatrice » (si provisoire et superficielle qu’ait été cette émancipation). Dans ce cadre-là, la guerre en ex-Yougoslavie a pu jouer un rôle d’accélérateur de la prise de conscience du caractère très relatif de l’émancipation des femmes par la guerre des hommes. Certains historiens récents de la Première Guerre mondiale en viennent à travailler sur la culture de guerre qui serait le fondement d’une « brutalisation » du conflit au nom d’une « ethnicisation » de l’ennemi. Leurs thèses sont contestées par ceux qui rejettent l’idée d’un simple consentement à la guerre au profit d’un mélange complexe de contraintes, fraternité, patriotisme et refusent que la « culture de guerre » prenne le pas sur les autres cultures pré-existantes. La place des femmes et du genre dans la guerre est d’abord abordée par F. Thébaud à la lumière d’une double mythologie sexualisée (l’équation pureté nationale/pureté sexuelle et la féminisation de l’ennemi comme décadent) et de l’autre mythe de la femme « naturellement » pacifiste en tant que mère potentielle. Or, les féministes ont adhéré massivement à l’effort de guerre et l’internationalisme « féministe » s’est effondré. Par ailleurs, la relative « humanisation » du conflit dont sont porteuses les femmes aux armées se fait toujours au service exclusif de la patrie. Dans un dernier volet de son intervention, F. Thébaud s’attarde sur la réalité des violences faites aux femmes et les réactions qu’elles ont pu susciter. Les viols ont eu lieu pendant l’invasion plus que pendant l’occupation et le débat sur l’« enfant de l’ennemi » s’il a été animé d’un point de vue discursif ne permet pas d’en savoir beaucoup plus sur la réalité. Les déportations de femmes hors des villes occupées suscitèrent, quant à elles, suffisamment de réactions violentes pour que les Allemands mettent fin à cette pratique dès 1916. Certaines interventions féministes visèrent à modifier les lois de la guerre mais on en sait peu sur la place des femmes dans l’humanisation de la guerre. Par ailleurs, une comparaison s’avérerait nécessaire entre les histoires respectives de la guerre dans les pays dits occidentaux et dans les pays de l’Est. (shrink)

Fragments of painted plaster found in the destruction layer of three first floor rooms in the House of Seals and of one first floor room of the House of the Sword had broken from the ceiling. They allow the restoration of the schema in the room of the House of the Sword and of two of the rooms in the House of Seals, the latter in colour. Composed of bands surrounding a quadrangular field, these décorations, evoking carpets stretched on the (...) ceiling, are richer (costly pigments, gold leaf) and more complex (some fifteen motifs) than those in tombs of the same period, which adopted the same « carpet » composition and which borrowed from the same repertoire, often confirmed by the textiles. Since we know of no other ceiling decoration in habitation rooms, it is unwise to contrast the exuberance of these ceilings with the tomb ceilings. The room that could not be restored had moreover a much more perfunctory decoration. (shrink)

Françoise Lauwaert Dans cet article, après un essai de définition de ce que l’on entendait par « rites » dans les premiers traités normatifs qui leur furent consacrés, sera retracée l’évolution ayant mené à la constitution d’un « système rituel » à visée totalisante. Or, la recherche de « l’ordre parfait » à laquelle s’adonnaient les ritualistes a suscité des débats infinis et n’a pu aboutir à construire un édifice aussi solide que ces derniers l’auraient souhaité. Pour l’anthropologue Philippe (...) Descola, ce mélange de fascination pour un système quasi totalitaire et d’incapacité à se mettre d’accord sur sa physionomie réelle caractérise l’ontologie analogiste qui fut celle de la Chine à l’époque où ces traités ont été rédigés (la fin de la période des Royaumes Combattants). C’est la première cause, d’ordre logique, que l’on peut trouver à la fragilité d’un système décrit par Yuri Pines comme « the Universal Panacea ». La deuxième cause est plutôt d’ordre psychologique. Elle trouve sa source dans le doute et l’anxiété provoqués par la pression qu’exerce sur les sujets l’injonction de recréer en soi un ordre idéal et toujours déjà perdu. Cette dernière partie s’appuie sur les travaux récents de deux auteurs, Mark Csikzentmihalyi et Michael David Kaulana Ing, lesquels montrent, à partir d’une analyse détaillée de deux ouvrages normatifs : le Wuxing 五行 (Les Cinq types d’actions vertueuses) et le Liji 禮記 (Livre des rites), comment furent abordées les questions de la faillite du rituel et de la faillibilité humaine, indiquant ainsi la voie vers une sortie possible du fantasme de l’ordre parfait. In January 2008, the Human Fertilisation and Embryology Authority issued two 1-year licenses for cytoplasmic hybrid embryo research. This article situates the HFEA's decision in its wider scientific and political context in which, until quite recently, the debate about human embryonic stem cell research has focused narrowly on the moral status of the developing human embryo. Next, ethical arguments against crossing species boundaries with humans are canvassed. Finally, a new argument about the risks of harm to women egg providers resulting (...) from research involving the creation of humanesque cytoplasmic hybrid embryos is elaborated. Taken together these ethical concerns about the moral status of the human embryo, about the ethics of crossing species boundaries with humans, and about the potential harms to women, provide good reason to eschew humanesque cytoplasmic hybrid embryo research in favor of less ethically controversial means to the laudable end of successful regenerative medicine. The primary objective of The Health Care Ethics Con sultant is to focus attention on an immediate practical problem: the role and responsibilities, the education and training, and the certification and accreditation of health care ethics consultants. The principal questions addressed in this book include: Who should be considered health care ethics consultants? Whom should they advise? What should be their responsi bilities and what kind of training should they have? Should there be some kind of accreditation or certification program (...) to ensure that those who call themselves ethics consultants are in fact qualified to advise, consult, research, and write in health care ethics? The distinguished authors ofthese articles are persons with diverse backgrounds, interests, presumptions, and val ues. Not surprisingly, therefore, diverse responses have emerged to the questions posed. Though the book's chapters are individually authored, they are informed by the group discussions that went on during active workshop sessions, and by knowledge of the contributions of others. All of the chapters meaningfully represent their consensus. This is not to say that there were no disagreements regarding specific details, but rather that there were no fundamental objections on the book's basic content among a panel of authors who share basic premises regarding the role, responsibilities, education, and certifica tion of health care ethics consultants. Il montre ensuite que l’adoption plénière, qui provoque toujours une rupture de la filiation d’origine et qui fait obstacle à une reconnaissance mutuelle des parties à ce transfert d’enfant, n’est pas toujours dans l’intérêt de ce (...) dernier. Tant de limpidité et d'éclat a éclipsé l'homme même, qui demeure très méconnu : fils d'un temps d'incertitude? père de la philosophie moderne? Qui était vraiment René Descartes et qu'en reste-t-il aujourd'hui, au-delà des idées reçues et de la référence obligée? Mettant en lumière les contradictions du philosophe, Françoise Hildesheimer brosse le portrait (...) d'un homme fort éloigné du mythe officiel. On le veut rationnel, on ne l'imagine pas rêvant ; c'est pourtant sur trois songes que Descartes a fondé son projet d'une science universelle qui devait faire de lui le nouvel Aristote. Il a côtoyé de très près les courants déviants de l'époque, avant de s'établir en Hollande en 1628 pour concevoir son système, dévoilé au fil du Discours de la méthode, des Méditations métaphysiques, des Principes de la philosophie et des Passions de l'âme. Sa vie durant, Descartes a balancé entre désir de reconnaissance officielle et soif d'incognito ; il invitait le monde entier à débattre de ses théories, mais n'aimait guère la contestation ; il affectionnait le repos, et n'a cessé de voyager, sans jamais s'établir durablement ; lui qui se tenait éloigné du pouvoir a fini ses jours, en 1650, à la cour de la reine Christine de Suède. Curieux paradoxe que cet obsédé du secret, ce maniaque du brouillage des pistes, se soit consacré corps et âme à la quête de la Vérité et à l'étude de la lumière... (shrink)

In this note we argue that the theoretical approach, developed in the field of quasicrystals, may prove to be useful in a completely different area, namely biology, and more precisely for the transmission electron microscopy observation of biological structures this sections. Whenever the real three-dimensional structure is periodic, a generic cut will produce a quasiperiodic pattern. This is illustrated in a theoretical example inspired by the 3D organization of annelid cuticle. In addition, we discuss recent results on dislocations in quasicrystals, (...) and their possible consequence about observation in biology. Finally, this analysis could be extended to images obtained from other technics, like freeze-fracture, and other materials, provided that certain length scale relations be satisfied. (shrink)

À partir de l'étude de la constitution et de l'histoire des archives du parlement de Paris et de leur traitement archivistique, ainsi que des multiples collections de copies et d'extraits dont elles ont été l'objet, cet article propose une réflexion sur la manière dont ce fonds d'archives, qui allie une exceptionnelle importance matérielle et historique et une particulière complexité, a pu être traité par les archivistes et utilisé par les chercheurs, ainsi que sur les perspectives qu'il peut ouvrir à la (...) recherche. Ces archives du Parlement illustrent en effet toute la gamme des problèmes de conservation, de traitement, de communication au public et d'exploitation et rendent particulièrement manifeste la complémentarité et l'interpénétration nécessaires, voire la confusion, des approches historique et archivistique ; elles démontrent que la connaissance par les chercheurs de l'histoire du fonds d'archives va bien au-delà de la simple pratique archivistique et contribue à la perception de la documentation comme« source» d'histoire. Joséphin's (self-)denial of air speaks to us today, eloquently, of an urgent issue that became prominent in the past two years: choking as a form of torture inflicted upon victims of police brutality. The oft repeated slogan, "I can't breathe," militant words of the international Black Lives Matter movement, [End Page 169] have become a rallying cry against oppression. "I can't breathe" is recognizable everywhere as a sign of outrage against gratuitous human cruelty, and in 2020, George Floyd became its most famous contemporary symbol, after Eric Garner's death in a choke hold first drew attention to the issue. Journalist Lonnae O'Neal has discussed Floyd's fate, his tragic last moments, his call to his absent, deceased mother. O'Neal dwells on the words he uttered as he lay in the street: "Momma! Momma! I am through." In her elegy to black motherhood, O'Neal asserts that a dying man's call to his mother "is a prayer to be seen," "a sacred invocation" that expresses the poignant hope that memory and justice will prevail. She invokes Floyd's need to be recognized as a human being, to testify to his humanity with his last breaths, and thus to be remembered as having mattered. We show in this paper that the theory of ordinal addition of any fixed ordinal ωα, with α less than ωω, admits a quantifier elimination. This in particular gives a new proof for the decidability result first established in 1965 by R. Büchi using transfinite automata. We show here that the first order theory of the positive integers equipped with multiplication remains decidable when one adds to the language the usual order restricted to the prime numbers. We see moreover that the complexity of the latter theory is a tower of exponentials, of height O(n).

Début 1871, Helmholtz donne une conférence à Heidelberg, devant un public de non spécialistes, sur « la genèse du système planétaire », dont le sujet sera ce qu’il appelle la théorie de Kant-Laplace. Plutôt que de commencer par expliquer ce qu’il faut entendre par cette dernière, Helmholtz expose devant ses auditeurs la représentation que l’on se fait désormais de la formation des corps célestes et de leur devenir probable, en s’appuyant sur les progrès des connaissances, la découverte de nouvelles lois, (...) l’usage d’instruments de plus en plus perfectionnés. C’est ainsi que la validité de l’hypothèse de Kant et de Laplace se trouve confirmée a posteriori et leur audace légitimée. Aussi, la démarche adoptée par Helmholtz relativise-t-elle implicitement, et peut-être à son insu, la rigueur postulée de la bonne méthode scientifique. La cosmogonie esquissée par Helmholtz ressemble à un spectacle bien étudié dont les auditeurs sont les spectateurs, les savants, les acteurs, et la science épurée, l’enjeu. L’analyse de ce texte a donc pour objectif principal d’identifier et de rappeler les éléments contextuels qui lui confèrent son épaisseur, depuis la guerre franco-prussienne jusqu’aux tensions idéologiques, philosophiques, scientifiques qui en sont l’arrière-plan. La combinaison d’intérêts économiques divergents et la tradition allemande de l’Ostpolitik approfondissent les divergences entre la France et l’Allemagne. La France affirme la souveraineté stratégique européenne ; l’Allemagne considère l’alliance avec (...) les États-Unis incontournable. Elle décide de porter le projet de « bouclier antimissile européen » avec la plupart des pays de l’Est, au moyen de technologies américaines et israéliennes, ce qui crispe la France. La question de l’envoi possible de troupes en Ukraine achève de détériorer le tandem franco-allemand. L’Europe est entrée dans une nouvelle ère : son centre de gravité se déplace vers l’est. The current debate on the ethics of cloning humans is both uninspired and uninspiring. In large measure this is because of mistakes that permeate the discourse, including the mistake of thinking that cloning technology is strictly a reproductive technology when it is used to create whole beings. As a result, the challenge this technology represents regarding our understanding of ourselves and the species to which we belong typically is inappropriately downplayed or exaggerated. This has meant that important (albeit disquieting) societal (...) issues and species-type concerns have not been fully explored. This paper, intended as a corrective, suggests that we take an alternate view of human cloning as both an enhancement and a reproductive technology. This proposed shift in the framework for analysis counters the current narrow framing of the issues and introduces new questions about the prospect of modifying the species. (shrink)

This article looks at the tensions experienced by teacher trainers in National Higher Institutes for Teaching and Education (Instituts nationaux supérieurs du professorat et de l'éducation ; INSPE), following the implementation of the reform of pre-service teacher training (beginning of the 2021 academic year). Thus, the positioning of competitive examinations at the end of the master's degree has led to the reorganization of training content. A questionnaire survey (n = 725) was conducted in spring 2022. Having defined the place and (...) role of trainers in the professional development of future teachers, the analyses highlighted the tensions present in the respondents' discourse. This latest reform, between continuity and change, has generated tensions with multiple sources and has forced many trainers to reconsider their activity, judging some of the prescribed measures as paradoxical. The resulting dilemmas have forced these trainers to rethink their priorities, to readjust their practices, and to reconsider their professionalism as well as the meaning of their activities. Separated and immediate extensions of valued fields. The notion of separated extension of valued fields was introduced by Baur. He showed that extensions of maximal fields are separated. We prove that, when (K, v) is Henselian with residual characteristic 0, then $(K, v) \subset (L, w)$ is separated iff L is linearly disjoint over K from each immediate extension of K.
