In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

My aim in this paper is to determine how Locke understands suspension and the role it plays in his view of human liberty. To this end I, 1) discuss the deficiencies of the first edition version of ‘Of Power’ and why Locke needed to include the ability to suspend in the second edition, then 2) analyze Locke’s definitions of the power to suspend with a focus on his use of the terms ‘source’, ‘hinge’, and ‘inlet’ to describe the power. I (...) determine from these descriptions that the ability to suspend is a passive power and is a necessary condition for the rational deliberation that Locke takes to be necessary for acting as a free agent. In 3) I connect Locke’s view of the power to suspend to his discussion in the sections that precede ‘Of Power.’ I argue that the kind of judgment that Locke endorses in his discussion of the Molyneux problem is also at work in acts of suspension. In 4) I apply my interpretation to Locke’s description of the connection between the power to suspend and liberty. In 5) I conclude with a discussion of a passage from the fifth edition of the Essay. Locke adds this passage to address worries raised by Limborch over the course of their correspondence. According to Chappell, it lends evidence to the view that Locke takes suspensions to be caused by undetermined volitions. (shrink)

A central project of Enlightenment thought is to ground claims to natural freedom and equality. This project is the foundation of Suchon’s view of freedom. But it is not the whole story. For, Suchon’s focus is not just natural freedom, but also the necessary and sufficient conditions for oppressed members of society, women, to avail themselves of this freedom. In this paper I, first, treat Suchon’s normative argument for women’s right to develop their rational minds. In Section 2, I consider (...) Suchon’s three necessary and sufficient conditions for freedom, and the manners in which women are blocked from meeting them. The normative argument together with the obstacles to women meeting the conditions for freedom raises the question of how to get women into a position where they can enjoy the freedom to which they are entitled. In Section 3, I outline Suchon’s answer: women must live a life without attachment. I argue this answer situates Suchon both chronologically and theoretically between the Béguines, a medieval women’s spiritual movement, and 20th century feminist separatism. I conclude that Suchon’s view of freedom is radical, both for its time and ours, and deserves greater attention from historians of philosophy and of feminist thought. (shrink)

JohnLocke’s 1700–1702 correspondencewith Dutch Arminian Philippus van Limborch has been taken by commentators as the motivation for modifications to the fifth edition of “Of Power,” the chapter in An Essay Concerning Human Understanding that treats freedom. In this paper, I offer the first systematic and chronological study of their correspondence. I argue that the heart of their disagreement is over how they define “freedom of indifference.” Once the importance of the disagreement over indifference is established, it is clear that when (...) Locke altered parts of “Of Power” as a reaction to Limborch’s questioning, he did so in the interest of further clarifying and solidifying his view, not changing it. Seeing how they disagree over indifference also allows us to see the correspondence as showcasing the conflict between intellectualism, the view that cognitive states determine the will, and voluntarism, the view that the will alone determines action. The supervisor of the activities of a system user should benefit from the knowledge contained in the event logs of the user. They allow the monitoring of the sequential and parallel user activities. To make event logs more accessible to the supervisor, we suggest a process mining approach, including first the design of an understanding model of the activities of a system user. The model design is based on the relationships between the event logs and the activities of a system (...) user. An intervention model completes the understanding model to assist the supervisor. The intervention model enables an action of the supervisor on the critical activities, and the detection of anomalies. The models are automatically designed with a model-driven engineering approach. An experiment on a smart home system illustrates this tooled design, where the supervisor is a medical or paramedical staff member. (shrink)

This article critically examines the relationship between shared residence and contact after the breakdown of the parents’ relationship. It examines the background to the government’s main emphasis on methods of monitoring, facilitating and enforcing contact as the most efficacious method of proceeding in respect of the law reform agenda, focussing particularly on the potential impact of punitive enforcement measures on primary carers, usually mothers. The article sets the discussion within its wider cultural context in respect of fathers’ rights claims that (...) family law currently favours mothers, and shows how recent legal developments constitute part of a package to manage post-separation relationships between parent and children. It also examines some of the emerging case law to show how the judiciary is using shared residence orders and transfer of residence to deal with protracted and very difficult contact disputes, and in ways which were not anticipated when shared residence orders were first introduced. Drawing on feminist legal commentaries the argument will be made that the use of transfer of residence and shared residence orders in these disputes is extremely worrying, especially in light of the growing body of empirical research which heralds caution. The article will conclude by suggesting that far from favouring mothers, both the law reforms and the case law effectively construct mothers as integral to the problem of contact. They are treated as the site of and solution to the ‚problem’ of contact, and the means of dealing with the problem is by increasingly punitive measures which are inappropriate in a family law context. At the same time non-residential fathers who do not uphold contact escape legal sanctions. (shrink)

Within hospital settings, chaplains offer emotional support, spiritual counseling, and healing services to patients and simultaneously address ethical considerations by upholding confidentiality and impartiality. This study examines the impact of chaplains in hospital settings on patients, families, and healthcare teams by analyzing diverse case studies and personal anecdotes. Further, it highlights the significant spiritual and pastoral roles of chaplains, which potentially contribute to ethical decision-making in end-of-life situations. Results reveal that chaplains play a crucial and dynamic role in providing ethical (...) support to patients, families, and healthcare personnel. Additionally, the traits possessed by chaplains can help ensure the continuous provision of care and adherence to best practices. This study further examines the various ethical conflicts of interest that may occur when chaplains participate in and discuss effective conflict management strategies. Finally, it contributes to the ongoing academic discussion on chaplains’ role in and impact on patient-centered care and ethical decision-making within healthcare organizations. (shrink)

Biomedical research is increasingly carried out in low- and middle-income countries. International consensus has largely been achieved around the importance of valid consent and protecting research participants from harm. But what are the responsibilities of researchers and funders to share the benefits of their research with research participants and their communities? After setting out the legal, ethical and conceptual frameworks for benefit sharing, this collection analyses seven historical cases to identify the ethical and policy challenges that arise in relation to (...) benefit sharing. A series of recommendations address possible ways forward to achieve justice for research participants in low- and middle-income countries. (shrink)

Surprise – these much-publicized rules are not the least bit reassuring to people who specialize in the study of ethics. While attention to ethics is certainly welcome, these ethical codes provide a too-easy cop-out, a way to neatly dispose of attention to nagging and pervasive problems. The typical professional code is little more than a checklist of rules that enables professionals of any stripe to give lip service to ethical behavior without engaging in continuing dialogue on ethical dilemmas. This article discusses the discourses of disability through a parallel `disabling' of its own text. It draws on literary as well as sociological sources in order to interrogate the nature and relations of the `tragic', the `heroic' and the `comic'. The authors offer the conclusion that the comic is never quite absent from the discourse of tragedy (after Kundera), and turn that insight back on their own text, in an attempt to refuse the solemnities and closures of their own narrative.

Several philosophical problems concerning the object of criticism in dance are identified and analyzed as preliminary to an eventual theory of evaluation of dance. Basic to philosophical adequacy is understanding the artform as it is actually practiced and appreciated, recognizing its complexity as a performing artform using unique human bodies as instruments. ;Definitions of "dance" proposed by philosophers, dance historians, and others are inadequate to specify necessary and sufficient conditions of dance, to distinguish dance from other human non-art phenomena, and (...) to distinguish dance from other artforms. Definitions can be adequate for a specific purpose, using descriptive characteristics and standards for evaluation and appreciation by an audience. ;The ontological status of dance is best understood as consisting of the primary media of movement by human bodies and music and secondary media of the visual dimensions of costumes, scenery, and lighting. Improved understanding of the artform is possible with this more comprehenive recognition of its complex multi-media status, as shown in an analysis of "appropriateness" of the various media, a typical criterion for evaluation. ;The identity of a work of art in dance can be established using a notational system in conjunction with a standard for acceptable compliance with that notation. "Substantial similarity," as determined by lay observers, the test for copyright infringement, provides a useful standard for dance. Other theories have required too much of an identity standard; its purpose is to identify a particular performance as one of a certain work, not to teach dancers to perform the work, nor to enable directors to produce it, nor to provide standards for a good performance of the work. ;A necessary condition of the proper object of criticism is perceivability. The considerable interest in the dance world in production and other factors not perceivable on stage during performance is best understood as a interest in the on-going skills of artists, as opposed to the evaluation of an aesthetic object. I identify issues of philosophical concern in Eldred v. Ashcroft, the U.S. Supreme Court’s decision on copyright extension, and encourage the participation of philosophers in these public policy debates. Philosophers have contributions to make to the dialogue not captured exclusively by the technical and often narrow legal debate in the courts.

It led to debates on the ontology of the syllogism as studied in the Prior Analytics, i.e. the syllogism made of letters and the four logical constants a/e/i/o, with deep consequences on the definition of logic as a universal method for all sciences (...) and as a science itself. Discrete supposition occurs whenever a discrete term, such as ‘Socrates‘, is the subject of a given proposition. I propose to examine this apparently simple notion. I shall draw attention to the incongruity, within a general theory of the semantic variation of terms in a propositional context, of the notion of discrete supposition, in which a term usually has a single semantic correlate. The incongruity comes to the fore in those treatises that attempt to describe discrete supposition as a sort of (...) personal supposition, although the same term cannot be in simple supposition in another propositional context, because it has no significate distinct from its suppositum. This shows a fundamental link between common signification, simple supposition and predicability, three notions that rely on the existence of a significate distinct and independent from the suppositum of the term. The connection is to be seen especially in William of Sherwood’s Introductiones, the only author of a terminist Summa who recognizes the existence of simple supposition for discrete terms. (shrink)

We argue that the post-9/11 environment has amounted to a substantive change in the longstanding United States relationship with the international human rights regime. We identify three distinct phases of that relationship, noting that in the most recent phase, since 9/11, the US has moved from passive support of the international human rights regime to a direct attack of that regime. Realist and liberal regime theories suggest that the human rights regime is relatively weak, and is unlikely to withstand such (...) an attack. We find that the regime has not only continued to persist, but has flourished even as US support has faltered. The human rights regime is surprisingly strong. We argue it is the ideological nature of the regime that explains its resilience, which suggests that constructivist theory is necessary to fully understand the human rights regime. (shrink)

Recent debates about inequality have focused almost exclusively on the distribution of wealth and disparities in income, but little notice has been paid to the distribution of free time. Free time is commonly assumed to be a matter of personal preference, a good that one chooses to have more or less of. Even if there is unequal access to free time, the cause and solution are presumed to lie with the resources of income and wealth. In Free Time, Julie (...) Rose argues that these views are fundamentally mistaken. First, Rose contends that free time is a resource, like money, that one needs in order to pursue chosen ends. Further, realizing a just distribution of income and wealth is not sufficient to ensure a fair distribution of free time. Because of this, anyone concerned with distributive justice must attend to the distribution of free time. On the basis of widely held liberal principles, Rose explains why citizens are entitled to free time—time not committed to meeting life's necessities and instead available for chosen pursuits. The novel argument that the just society must guarantee all citizens their fair share of free time provides principled grounds to address critical policy choices, including work hours regulations, Sunday closing laws, public support for caregiving, and the pursuit of economic growth. Delving into an original topic that touches everyone, Free Time demonstrates why all citizens have, in the words of early labor reformers, a right to "hours for what we will.". (shrink)
