Objectives:Over the past two decades, all U.S. states have incorporated alcohol ignition interlock technology into sentencing laws for individuals convicted of driving while intoxicated. This article provides the first 50-state summary of these laws to include changes in the laws over time and their effective dates. This information is critical for policy makers to make informed decisions and for researchers to conduct quantitative evaluation of the laws.Methods:Standard legal research and legislative history techniques were used, including full-text searches in the Westlaw (...) legal database and identification of state session laws. Because ignition interlock device laws often change over time, we identified the date of each law's initial enactment as well as the effective date of each law in its current form.Results:Beginning with California and Washington in 1987, all 50 states have enacted IID laws as a sentencing option for DWI offenders. Initially, most of these laws were discretionary. Today, however, 48 states mandate IID installation for at least some types of DWI offenders to maintain lawful driving privileges. Of these, 27 mandate an IID for all offenders; seven mandate an IID for repeat offenders only; and 21 for some combination of specific groups of DWI offenders, including repeat offenders, offenders with a blood alcohol content above a legislatively-specified level, and aggravated offenders.Conclusion:States have wrestled with a number of IID policy issues, including for whom to mandate IIDs and whether to suspend a license for DWI prior to reinstating driving privileges with or without an IID. By understanding how state interlock laws differ, policy makers and researchers can ultimately better ascertain the impact of these laws. (shrink)

A cornerstone of Buddhist philosophy, the doctrine of the four noble truths maintains that life is replete with suffering, desire is the cause of suffering, nirvana is the end of suffering, and the way to nirvana is the eightfold noble path. Although the attribution of this seminal doctrine to the historical Buddha is ubiquitous, Rethinking the Buddha demonstrates through a careful examination of early Buddhist texts that he did not envision them in this way. Shulman traces the development of (...) what we now call the four noble truths, which in fact originated as observations to be cultivated during deep meditation. The early texts reveal that other central Buddhist doctrines, such as dependent-origination and selflessness, similarly derived from meditative observations. This book challenges the conventional view that the Buddha's teachings represent universal themes of human existence, allowing for a fresh, compelling explanation of the Buddhist theory of liberation. This article brings together two debates in contemporary political philosophy: on the one hand, the dispute between the distributive and relational approaches to equality and, on the other hand, the field of intergenerational equality. I offer an original contribution to the second domain and by doing so, I inform the first. The aim of this article is thus twofold: (1) shedding some light on an under-researched and yet crucial question – ‘which inequalities between generations matter?’ and (2) contributing to a (...) far-reaching debate that touches upon the nature of egalitarianism. After showing that there are two key problems that fall within the scope of intergenerational equality – questions of justice between age groups and questions of equality between birth cohorts – I argue that, contrary to what the default distributive view (complete lives egalitarianism) states, some inequalities between age groups matter independently of their diachronic impact, and so partly for relational reasons. I argue that, even if we are distributive egalitarians, we must endorse the relational egalitarian conception to successfully make sense of some inequalities between age groups. I infer from this both that the putative view that the ‘relational’ conception of equality can be redescribed as distributive must be rejected and that the distributive view requires supplementation (but not necessarily displacement) by the relational view. This paper investigates continuities and changes in the definition of sickle cell disease in 1950s Brazil, taking into account that diseases have a history and are recognized as such according to the knowledge and perceptions available in a certain historical period and specific location. In the post-war era, new diagnostic tools, inheritance theories and, in particular, discussions on the concepts of race and racial relations, both nationally and internationally, were changing previous racialist and racist views. Nonetheless, the Brazilian medical interpretations (...) of sickle cell disease continued to racialize it and even use deep-rooted racist formulations to explain its symptoms or the existence of the disease. It is argued that the celebration of racial mixture and racial democracy might have concealed racist presumptions biasing the study of sickle cell disease. Although race as a biological concept gradually gave way to other genetic expressions, in Brazilian medical papers on sickle cell disease, race continued to influence the interpretation of the disease, along with the persistence of concepts of heredity through blood mixture. O artigo propõe, a partir de uma análise da célebre tese das “bestas-máquinas” de Descartes, uma discussão acerca da possibilidade de os animais, segundo esta doutrina, possuírem sensações, sendo assim capazes ou não de sentir dor; de sua recepção nos círculos científicos ingleses do século XVII em vista das práticas de vivissecção a sangue frio, correntes à época; de como os processos de mecanomorfose do pensamento afetam atualmente a vida dos animais.

Specifically, the aim of this study is to see the role and correlation between transformational and transactional leadership with effective followership. Using multiple regression, research found that transformational leadership had positive and significant correlation with effective followership but transactional leadership didn’t have significant effect. Regression model proves that transformational and transactional can be used to predict effective followership.  .

The study examined the influence of culture to trust-building. It also identified the relationship among social categorization, trust as a psychological state, and trusting behavior. The main theoretical frameworks were individualism-collectivism concept and social indentity theory. A variance of social dilemma game was developed as a mean to observe group interaction in the Indonesian workgroups and in the German workgroups (N Indonesian = 221; N German =181), and to measure trusting behavior in the groups. Results showed that culture has a (...) significant effect on trustbuilding within the groups. When individuals believed in trustworthiness of their interactive partners, the influence of social categorization was reduced. Social categorization played a mediation effect in both workgroups. However, Indonesian workgroups tended to show in group bias, German workgroups does not show this phenomenon. (shrink)

En las siguientes páginas me propongo exponer de modo sucinto dos de los problemas filosóficos más significativos de la Edad Media: el de los universales y el de la individuación. El primero se pregunta por el estatus ontológico de las nociones universales; el segundo por el principio de individuación de las diferentes substancias. A pesar de ser problemas distintos, estas cuestiones están estrechamente unidas. El problema de los universales albergó desde sus inició la pregunta por el estatus ontológico de los (...) individuos, cuestión de la que derivó posteriormente la pregunta por la individuación. Por su parte, al no haber sido un problema tratado independientemente desde su origen, el problema de la individuación se ha entendido como un hacerse individuo del universal. Dada esta cercanía, parece necesario establecer cómo se conectan las nociones de ‘universal’, ‘individuo’ e ‘individuación’ con el fin de entender con mayor claridad dichas cuestiones. (shrink)

El presente trabajo aborda el pensamiento educativo de John Locke desde una perspectiva poco frecuentada: sus vínculos con la teoría lockeana de la propiedad. Como se pone de relieve, Locke discrimina entre la educación de los hijos de propietarios y la de los hijos de no propietarios. La finalidad primaria de la primera es cultivar una serie de valores morales estrechamente vinculados con la propiedad –como la liberalidad y la justicia. Research on unethical leadership has predominantly focused on interpersonal and high-intensity forms of harmful leader behavior such as abusive supervision. Other forms of harmful leader behavior such as excessively pressuring subordinates or acting in self-centered ways have received less attention, despite being harmful and potentially occurring more frequently. We propose a model of four types of harmful leader behavior varying in intensity and orientation : Intimidation, Lack of Care, Self-Centeredness, and Excessive Pressure for Results. We map out how these relate (...) to other constructs in the unethical leader behavior field in order to integrate the existing work on how leaders can cause harm to followers. Next, in five studies, we develop and test a new survey instrument measuring the four proposed types of perceived HLB. We provide initial validity evidence for this new measure, establish its psychometric properties, and examine its nomological network by linking the four types of HLB to related leadership constructs and soft and hard outcome correlates at the individual and team level. We find that HLB is negatively related to constructive forms of leadership and positively to unethical ones. HLB is also related in the expected direction to job satisfaction, engagement, psychological safety, knowledge sharing, knowledge hiding, deviance, and objectively recorded team-level stress-related absenteeism. What is the content of beliefs expressed by sentences with fictional names? Millianism has notoriously struggled to give a satisfactory answer to this question. Some Millians have argued that fictional names are empty names. But such a view entails that the belief that Superman has impressive superpowers and the belief that Aquaman has impressive superpowers have the same content, contrary to our intuitions. Others have argued that fictional names refer to fictional entities. But this view has a long-standing problem, Frege’s (...) Puzzle, and many philosophers are skeptical that Millians have successfully addressed it, despite commendable efforts. In this paper, I put forward a different Millian Theory of fictional proper names that by-passes these and other objections related to belief content. The novelty of my proposal partially rests on a distinction I draw between semantic content and belief content—as opposed to a distinction between belief content and belief state or a way of grasping the content, as it is commonly found in Millian accounts—in a framework where belief contents are not part of the meaning of names. An accurate determination of an individual’s decisionmaking capacity is fundamental to obtaining informed consent for medical treatment, as it allows clinicians to balance respect for patients’ autonomy with the best interests of patients. Despite the increasing demand for assessments of patients’ capacity, healthcare professionals find this task complex and challenging. Currently, assessments are largely based on patients’ cognitive ability and do not sufficiently take into account other factors that influence patients’ judgment. Furthermore, it is important to assess for and treat (...) modifiable factors that impair decision-making capabilities, and to have guidance on when it is appropriate to delay treatment-related decisions. This article will review current methods for assessing capacity, highlight other factors to consider in the decision-making process, and propose an enhanced framework to guide clinicians in making timely and prudent treatment-related decisions for patients with impaired capacity. A finalidade da comparação é evidenciar o que Jacobi de fato entende por “saber imediato” em oposição ao saber mediato e mostrar por que a crença não pode ser meramente subjetiva — como foi e é ainda largamente interpretado — e sobretudo por que individualidade (...) não é sinônimo de subjetividade como queria Hegel. The notion of hope occupies a central position in Paulo Freire’s work. Since he understands hope to be a motor for change, an ontological necessity and a political act, Freire concludes that it is important to educate hope so that it is not converted into infertile hopelessness or tragic despair. Imbued with Freirean spirit, my purpose in this paper is to construct a dialogue between this great educator’s thoughts and those of Spinoza. This impossible encounter between these two men who (...) rebelled in thought and action against the oppressions of their times will occur through the investigation of the following themes: 1) the role of hope in the Freirean conception of history; 2) relationships between freedom and necessity; 3) hope’s social functions and 4) Freire’s proposal of an ‘education of hope’. Two notions of hope will be discussed: naïve hope and critical hope. The spinozist provocation consists in suggesting an ethical and political attitude which is primarily moved by our power to think and act and is, therefore, not based on hope. (shrink)

When compared with the Pāli versions of the Nanda tale—the story of the ordainment and liberation of the Buddha’s half-brother—some of the peculiar features of Aśvaghoṣa’s telling in the Saundarananda come to the fore. These include the enticing love games that Nanda plays with his wife Sundarī before he follows Buddha out of the house, and the powerful, troubling scene in which Buddha forces Nanda to ordain. While the Pāli versions are aware of fantastic elements such as the flight to (...) the Himālayas, and while each adds its own unique emphases that re-shape the events, none raise such deep ambivalence as done by Aśvaghoṣa. The Comparison of the different tellings then raises a more general theoretical point in relation to Buddhist literature—that genre defines the special features of each adaptation of the story, rather than any historical conditions regarding transmission; the versions each conform to the specific intellectual context of the text that appropriates them. This understanding allows an advancement of the idea of genre in Buddhist canonical and semi-canonical texts. (shrink)

Cramer et al.'s network approach reconceptualizes mental comorbidity on the basis of symptom space originating from psychometric signatures. We argue that the advantages of this approach need to be regarded in the context of the multi-level functional organization of the neural substrate, ranging from neurogenetic to psychometric. Neuroelectric oscillations are proposed as a level-integrating principle.

In 1956, as a young art critic, the Mexican philosopher Juliana González first encountered the paintings of the Spanish surrealist Remedios Varo at the artist’s breakthrough solo exhibition in Mexico City’s Galería Diana. González, greatly impressed, soon befriended the much older Varo and became a regular visitor to her studio, where they talked about her paintings and their shared intellectual interests in literature, psychoanalysis, and philosophy, a conversation that ended with Varo’s untimely death in 1963 at age 54. A (...) few years later, González contributed this essay-homage to the 1966 catalog Remedios Varo. She opens with an evocation of Varo’s masterpiece, the triptych To the Tower, Embroidering the Earth’s Mantle and The Escape —a magnet for viewers at the recent “Surrealism Beyond Borders” exhibition in New York and London—and finds in it keys to the artist’s life and to her attempts through art “to flee this inexorable order toward another reality.” González’s close examination of the contradictions and ambiguities in Varo’s artistry, of “her wise, poetic humor,” and of her quest “to comprehend the universe” remains an essential read almost 60 years later. The catalog in which it first appeared is long out of print, and, to the best of my knowledge, González’s essay has never been republished in Spanish, making the text that follows as much an act of recovery as it is a translation. This paper investigates a reference to the voice of the legendary musician Orpheus in Plato’s Protagoras. I propose that the Orpheus image does serious philosophical work in the text. Understanding the mythic and religious elements of the Orpheus tradition can help us conceptualize the harms of sophistry from a Platonic viewpoint. In the light of the image, the sophist emerges as a quasi-magical manipulator of rhetorical beauty who charms his students into subrational creatures. Furthermore, the image provides insight into Plato’s (...) conception of the difference between sophistic and Socratic education. Playing on the tradition of Orpheus as (failed) psychopomp, I suggest that the sophist employs a descent-style education which holds students captive in an underworld of glamorous but empty sensibles. In sharp contrast, Socratic ascent-style education pulls students upwards to active contemplation of ultimate reality. (shrink)

Resumo: Este estudo objetiva identificar a natureza de verdade por Agostinho de Hipona (354-430), segundo as reflexões contidas no VII Livro da obra Confissões (397) que trata da Busca da Verdade. Para isso, é necessário reconhecer quais percursos o bispo de Hipona percorreu em sua vida terrena, bem como sua vivência filosófica. Nesse itinerário em busca da verdade se envolveu com o maniqueísmo, que em certa medida apresentava uma verdade racional e material, perspectiva que se aproximava do pensamento de Agostinho (...) na sua fase de juventude. Conforme foi amadurecendo intelectualmente e buscando compreensões das questões que permeiam a vida humana pode-se depreender o seu projeto de formação cristã, uma vez que, ao criticar o modo como conduzia sua vida pregressa (anterior à conversão) e evidenciar as mudanças em seus atos cotidianos para se adequar à forma de vida de um bom cristão, o autor explicita um projeto de educação e de sociedade que conduza aos bens eternos e imutáveis. The itinerary of Augustine of Hippo in search of the truth and its Christian formation project Abstract: This study aims to identify the nature of truth by Augustine of Hippo (354-430), according to the reflections contained in the VII Book of the work Confessions (397) which deals with the Search for Truth. For this, it is necessary to recognize which paths the Bishop of Hippo took in his earthly life, as well as his philosophical experience. In this itinerary in search of the truth, he became involved with Manichaeism, which, to a certain extent, presented a rational and material truth, a perspective that was close to the thought of Augustine in his youth. As he matured intellectually and sought understanding of the issues that permeate human life, his project of Christian formation can be inferred, since, by criticizing the way he led his former life (prior to conversion) and highlighting the changes in his acts to adapt to the way of life of a good Christian, the author explains a project of education and society that leads to eternal and immutable goods. The _play of formulas_ is a new theory designed to explain the manner in which discourses (Suttas, Sūtras) were composed in the early Buddhist tradition, focusing at present mainly on the _Dīgha-_ and _Majjhima- Nikāyas_ (the collections of the Buddha’s Long and Middle-length discourses). This theory combats the commonly accepted views that texts are mainly an attempt to record and preserve the Buddha’s teachings and life events, and that the best way to understand their history is to compare parallel versions (...) of them. By identifying the creative, mainly the literary, vectors alive in the shaping of the texts, the theory explains how discourses are the products of formulas, which themselves are the primary texts of early Buddhism. Formulas combine in order to produce meaningful textual patterns, with little account of historical context and with much interest in aesthetic appeal and emotive potency. Formulas connect according to set narrative designs, in which different types of audiences are represented not only through unique formulas, but also with their specific narrative trajectories and complementing doctrinal emphases. It is not that the early authors were not at all interested in safeguarding the tradition. It is only that there was much more going on, and that thinking about the texts in this way misses their entertaining faces and ignores their beauty. These probably tell us more about what the early discourses actually were for the people that first produced and studied them than dry philosophical doctrine. (shrink)

During the second half of the 19th century, in the field of physiological optics, there was a strong controversy between Hermann von Helmholtz and Ewald Hering. This controversy has been usually characterized as “empiricism” vs. “nativism”. In the field of physiology of visual perception, several subjects demanded attention, among them, color vision. Helmholtz and Hering suggested different theories for the physiological correlate of color sensation and different color spaces to give an account of the relationships between colors. In this article, (...) I will argue that the controversy between the two authors could be understood as differences between styles of reasoning, and these different styles express different presuppositions. More specifically, I want to suggest that the disagreements could be linked to the discussions on how vital phenomena should be studied. (shrink)

This paper reconstitutes and addresses critically the deontological and consequentialist arguments given by the French government to justify the denial of the national guaranteed minimum income support to young people under 25 years old. The deontological arguments express a concern for distributive justice and suggest that young people do not deserve income support. The consequentialist arguments; on the other hand; emphasise social efficiency: they draw on the alleged negative outcomes that the extension of income support to young people would bring (...) about. After analysing each argument; this paper concludes that the denial of RSA to young people is an illegitimate discrimination. It then proposes that we understand our duties towards young people through an account of prudence that reconciles both concerns of distributive justice with concerns for social efficiency and concerns for inter- and intragenerational justices. O objetivo deste artigo é discutir a relação da diversidade epistemológica no campo das ciências humanas e seus pressupostos para a produção do discurso científico no campo da educação. A discussão é interpelada pela especificidade das ciências humanas em contraposição às ciências naturais, sobre realidade e sentimento de realidade. Reconhecer a existência de um pensamento abissal em educação é condição sine qua non para atravessar linhas e para pensar o impensado no ocidente moderno. É imperativo desenhar um caminho alternativo, de (...) modo a desaprender, ignorar e esquecer alguns conhecimentos já “validados” para aprender outros que há muito tempo vêm sendo “esquecidos” e ignorados. American cultural technologies of the early nineteenth century shaped Nature and the synonymous "native" in contradictory ways: celebrating the wilderness but then transforming it by cultivation, mourning lost "natives" (both people and species) while also naturalizing the succession of new Euro-American settlers. Settler colonial geopolitics understood its own territorial claims in association with the retreats, migrations, and expansions of select species populations: cattle replacing American bison or Euro-Americans replacing Indians on the western frontier. In this way, Euro-American descendants of settlers (...) who then considered themselves "natives" could be the natural stewards to "preserve" or "reform" wild remnants of nature while also identifying against the encroachment of the Old World. Technological arts as varied as moving panoramas and picturesque sketches depicted and enacted civilization overtaking the wild frontier through visual tours. This chapter explores how the sketch fits into technologies of seeing accompanying American settler colonialism and points to moments when it suggests ecological processes of ongoing passage rather than terminal extinction or succession.
