The literature has shown that different types of moral dilemmas elicit discrepant decision patterns. The present research investigated the role of uncertainty in contributing to these decision patterns. Two studies were conducted to examine participants' choices in commonly used dilemmas. Study 1 showed that participants’ perceived outcome probabilities were significantly associated with their moral choices, and that these associations were independent from the dilemma type. Study 2 revealed that participants had significantly less preference for killing the individual when the outcome (...) probabilities were stated using the modal verb ‘will’ than when they were stated using the numerical phrasing of ‘100%’. Our findings illustrate a discord between experimenter and participant in the interpretation of task instructions. (shrink)

How does one committed to the claims of Christ and a biblical story of redemption live Christianly and navigate the competing worldviews encountered in everyday medical practice? Adopting the practical conceptual framework promoted by Reformed Christian philosopher and theologian Albert Wolters, we argue for an all-encompassing biblical understanding of God’s cosmic redemption plan for the entire creation order in contrast to a more typical sacred/secular duality. We then apply the concepts of structure and direction, drawn from a pretheological understanding of (...) human life drawn from the Scripture, to a semi-fictional case study in discerning Christian faithfulness in everyday mundane aspects of medicine. Our subsequent analysis seeks to render an interpretation of what it means to live life consistent with that worldview when confronted with challenges like those presented in the case. (shrink)

Since its enactment, the Affordable Care Act has faced numerous legal challenges. Many of these lawsuits have focused on implementation of the law and the limits of executive power. Opponents challenged the ACA under the Obama Administration while supporters have turned to the courts to prevent the Trump Administration from undermining the law. In the meantime, Congress remains gridlocked over the ACA and many other critical health policy issues, leaving the executive branch to adopt its preferred policy approach and ultimately (...) leading to lawsuits. This article briefly discusses the history of litigation over the ACA and some reasons why this litigation has been so enduring. The article then identifies other areas of health policy that are or could be future targets for litigation. Finally, the article comments on the potential impact of the courts on future health reform efforts. (shrink)

The phylogenetic species concept is applied for the first time to a major radiation of birds, the birds-of-paradise (Paradisaeidae) of Australasia. Using the biological species concept, previous workers have postulated approximately 40–42 species in the family. Of these, approximately 13 are monotypic and 27 are polytypic with about 100 subspecies. Phylogenetic species are irreducible (basal) clusters of organisms (terminal taxa) that are diagnosably distinct from other such clusters. Within the context of this concept, approximately 90 species of paradisaeids are postulated (...) to have diversified within Australasia. The phylogenetic species concept more accurately describes evolutionary diversity within the family and provides a better theoretical and empirical framework for analysing speciation, historical biogeography and patterns of morphological, behavioral and ecological diversification within this group than does the biological species concept. In the study of natural language quantification, much recent attention has been devoted to the investigation of verification procedures associated with the proportional quantifier most. The aim of these studies is to go beyond the traditional characterization of the semantics of most, which is confined to explicating its truth-functional and presuppositional content as well as its combinatorial properties, as these aspects underdetermine the correct analysis of most. The present paper contributes to this effort by presenting new experimental evidence in support (...) of a decompositional analysis of most according to which it is a superlative construction built from a gradable predicate many or much and the superlative operator -est. Our evidence comes in the form of verification profiles for sentences like Most of the dots are blue which, we argue, reflect the existence of a superlative reading of most. This notably contrasts with Lidz et al.’s results. To reconcile the two sets of data, we argue, it is necessary to take important differences in task demands into account, which impose limits on the conclusions that can be drawn from these studies. During the first two decades of the Cold War, a new kind of academic figure became prominent in American public life: the credentialed social scientist or expert in the sciences of administration who was also, to use the parlance of the time, a “man of affairs.” Some were academic high-fliers conscripted into government roles in which their intellectual and organizational talents could be exploited. McGeorge Bundy, Walt Rostow, and Robert McNamara are the archetypes of such persons. An overlapping group of (...) scholars became policymakers and political advisers on issues ranging from social welfare provision to nation-building in emerging postcolonial states. Many of these men—and almost without exception they were men—were also consummate operators within the patronage system that grew up around American universities after World War II. Postwar leaders of the social and administrative sciences such as Talcott Parsons and Herbert Simon were skilled scientific brokers of just this sort: good “committee men,” grant-getters, proponents of interdisciplinary inquiry, and institution-builders. This hard-nosed, suit-wearing, business-like persona was connected to new, technologically refined forms of social science. No longer sage-like social philosophers or hardscrabble, number-crunching empiricists, academic human scientists portrayed themselves as possessors of tools and programs designed for precision social engineering. Antediluvian “social science” was eschewed in favour of mathematical, behavioural, and systems-based approaches to “human relations” such as operations research, behavioral science, game theory, systems theory, and cognitive science. The interconnections, common interests, and other linkages between the Jewish and Islamic traditions have long been a matter of interest to academics. Today the need to understand these relationships, and to emphasize commonalities rather than conflicts, is of the greatest public interest. The present volume of studies, likely the first such collection in the scholarly literature, explores the full range of interconnections between Jews and Muslims in all fields (intellectual history, religion, philosophy, social history, etc.) and in all periods, from (...) the Middle Ages till today. Politicians, preachers, and ordinary people speak often of character; psychologists study `personality', used as a term of art with meanings close to `character'. Most ethical philosophers in the last two hundred years, on the other hand, have not had much to say about character. This book attempts to understand character and to refocus ethical philosophy so that character is central.

In this paper, I outline two strands of evidence for the conclusion that the dynamical approach to cognitive science both seeks and provides covering law explanations. Two of the most successful dynamical models—Kelso’s model of rhythmic finger movement and Thelen et al.’s model of infant perseverative reaching—can be seen to provide explanations which conform to the famous explanatory scheme first put forward by Hempel and Oppenheim. In addition, many prominent advocates of the dynamical approach also express the provision of this (...) kind of explanation as a goal of dynamical cognitive science. I conclude by briefly outlining two consequences. First, dynamical cognitive science’s explanatory style may strengthen its links to the so-called “situated” approach to cognition, but, secondly, it may also undermine the widespread intuition that dynamics is related to emergentism in the philosophy of mind. When firm misconduct comes to light, CEOs are often faced with difficult decisions regarding whether and how to respond to stakeholder demands as they attempt to restore their firms’ legitimacy. Prior research largely assumes that such decisions are motivated by CEOs’ calculated attempts to manage stakeholder impressions. Yet, there are likely other motives, particularly those of a morally-relevant nature, that might also be influencing CEOs’ decisions. To address this limitation, we advance moral cleansing as an alternative explanation for how and (...) why CEOs lead their firms to respond to stakeholder demands following the firm’s misconduct and, in turn, whether they can successfully restore their firm’s legitimacy. In the context of firm misconduct, moral cleansing motives reflect CEOs’ desire to restore their threatened moral self-image resulting from the misconduct. We theorize that a CEO’s moral cleansing motives increase the likelihood that their firm will engage in a series of reparative responses that can restore the firm’s legitimacy (i.e., discovery, explanation, penance, and rehabilitation). In addition, we explicate the unique implications of CEOs’ moral cleansing in a post-misconduct context by theorizing how such motives may simultaneously improve one form of their firms’ legitimacy while hindering another. Specifically, we theorize that CEOs’ moral cleansing motives increase (decreases) the authenticity (strategic cognition) of their firm responses, which strengthens (weakens) the effectiveness of those responses on the firms’ ability to restore its moral (pragmatic) legitimacy with stakeholders. We add texture to the conclusion of Duchon and Drake (Journal of Business Ethics, 85, 2009, 301) that extreme narcissism is associated with unethical conduct. We argue that the special features possessed by financial accounting facilitate extreme narcissism in susceptible CEOs. In particular, we propose that extremely narcissistic CEOs are key players in a recurring discourse cycle facilitated by financial accounting language and measures. Such CEOs project themselves as the corporation they lead, construct a narrative about the corporation and themselves (...) using financial accounting measures, and then reflect on how their accounting-constructed performance is perceived by stakeholders. We do not present empirical evidence about whether the use of accounting language and measures leads to unethical behaviour by extreme narcissistic CEOs — although the conclusions of Duchon and Drake (2009) suggest empirical support is probable. Rather, we focus on developing alertness to the potential for accounting, when engaged by an extremely narcissistic CEO, to be a precursor or implement of unethical behaviour. (shrink)

This paper argues that the political adage “Be ye prudent as serpents and guileless as doves” involves three different types of relation between prudence and morality, namely: unification (Vereinigung), subordination (Unterordnung), and association (Beigesellung). I maintain that these relations are set up according to the same principle that determines the relationship between mechanical and teleological causality in the third Critique. Thus, I argue that morality and prudence are much more systematically related within the system of critical philosophy than is normally (...) assumed in the literature and that this is made possible by way of an intimate relationship between prudence and teleological judgment. In The Body of Compassion, Joel Shuman presents an important, new theological treatment of contemporary bioethics, weaving together personal experience, a critical treatise on contemporary bioethics, and an exploration of a Christian theological alternative.The author first draws the reader into a consideration of the current state of bioethics by relating the story of his grandfather, a hard-working family man who died a solitary death, unaccompanied by loved ones, in the unfamiliar and sterile world of a hospital. Troubled by the way (...) his grandfather died, Shuman takes the reader along as he explores how modern medicine has distanced itself from dealing with people as living beings beyond their immediate physicality. He examines how various approaches to bioethics over the past twenty years have tried to remedy this problem by prescribing certain standards for treatment and how each of these ultimately has fallen short due to the lack of “a teleological concern for the body”—i.e., to trying to understand what the body is actually for in a larger context. From this point, Shuman deftly moves to a discussion of the centrality of the body to Christianity, focusing on how baptism, participation in the liturgy, and the partaking of the Eucharist all serve to unite Christians as one in the body of Christ. For Christians, the author argues, the body does not just belong to the individual but rather is one with the community of the Church. With this in mind, Shuman proposes a new kind of bioethics for Christians, where care for the body of Christ becomes the model of how we should care for and receive care from each other.This fresh and thought-provoking book is sure to be of interest to ethicists, medical professionals, and everyone who is troubled by places where science and religion intersect and seem to conflict. I present a perceptual account of other minds that combines a Husserlian insight about perceptual experience with a functionalist account of mental properties.

Since the publication of Wahrheit und Methode in 1960 (Tfibingen), Gadamer's hermeneutics has called forth a varied and fruitful response from the Continent, without receiving anything near the same attention from the English-speaking world. Though E. D. Hirsch thought Gadamer sufficiently important in 1965 to merit an early rebuttal and rehabilitation (Validity in Interpretation [New Haven, Conn., 1967], pp. 245-64), Wahrheit und Methode remained unread in England and America, partly because a translation was not available until 1975 (Truth and Method, (...) ed. Garrett Barden and John Cumming [New York]). Even after that date, Gadamer's influence on Anglo-American debate has been largely secondhand, filtering in through such figures as Paul Ricoeur and Jiurgen Habermas. But a renewed interest in the question of what we are to make of tradition, no doubt spurred in large measure by deconstruction's effort to unmake it, has lent Gadamer a new pertinence. One sign that his stock is on the rise is the publication of Joel Weinsheimer's Gadamer's Hermeneutics, a much needed and admirably written introduction to Truth and Method that should push its value even higher. -- JSTOR (June 12, 2012.). In this paper, following an idea of Christophe Chalons. I propose a new kind of forcing axiom, the Maximality Principle, which asserts that any sentence varphi holding in some forcing extension $V^P$ and all subsequent extensions $V^{P\ast Q}$ holds already in V. It follows, in fact, that such sentences must also hold in all forcing extensions of V. In modal terms, therefore, the Maximality Principle is expressed by the scheme $(\lozenge \square \varphi) \Rightarrow \square \varphi$ , and is equivalent to (...) the modal theory S5. In this article. I prove that the Maximality Principle is relatively consistent with ZFC. A boldface version of the Maximality Principle, obtained by allowing real parameters to appear in φ, is equiconsistent with the scheme asserting that $V_\delta \prec V$ for an inaccessible cardinal δ, which in turn is equiconsistent with the scheme asserting that ORD is Mahlo. The strongest principle along these lines is $\square MP\!_{\!\!\!\!\!\!_{\!\!_\sim}}$ , which asserts that $MP\!_{\!\!\!\!\!\!_{\!\!_\sim}}$ holds in V and all forcing extensions. From this, it follows that $0^\#$ exists, that $x^\#$ exists for every set x, that projective truth is invariant by forcing, that Woodin cardinals are consistent and much more. The principle of legal paternalism justifies state coercion to protect individuals from self-inflicted harm, or in its extreme version, to guide them, whether they like it or not, toward their own good. Parents can be expected to justify their interference in the lives of their children on the ground that “daddy knows best.” legal paternalism seems to imply that since the state often can know the interests of individual citizens better than the citizens know them themselves, it stands as a (...) permanent guardian of those interests in loco parentis. Put in this blunt way, paternalism seems a preposterous doctrine. If adults are treated as children they will come in time to be like children. Deprived of the right to choose for themselves, they will soon lose the power of rational judgment and decision. Even children, after a certain point, had better not be “treated as children,” else they will never acquire the outlook and capability of responsible adults. (shrink)

This paper seeks to expand our appreciation of the gene editing tool, clustered regularly interspaced short palindromic repeats‐associated protein 9 (CRISPR‐Cas9), its function, its benefits and risks, and the challenges of regulating its use. I frame CRISPR's emergence and its current use in the context of 150 years of formal exploration of heredity and genetics. I describe CRISPR's structure and explain how it functions as a useful engineering tool. The contemporary international and domestic regulatory environment governing human genetic interventions is (...) reviewed and shown to be increasingly ineffective in its ability to restrain, guide, and optimize the emerging use of CRISPR. Several reasons for this lack of consensus are discussed. In conclusion, I suggest a number of public policy recommendations that might allow us to simultaneously embrace our most important moral values and manage the inevitable power CRISPR will come to have in our lives.
