Although the notion of physician value neutrality in medicine may be traced back to the writings of Sir William Osler, it is relatively new to medicine and medical ethics. We argue in this paper that how physician value neutrality has been cashed out is often obscure and its defense not persuasive. In addition, we argue that the social/political implementation of neutrality, Political Liberalism, fails, and thus, PVN's case is weakened, for PVN's justification relies largely on the reasoning undergirding PL. For (...) these reasons, we conclude that PVN has no philosophical or ethical warrant and thus should be abandoned. We suggest that the physician present to her patients some type of statement or creed that would give them an idea of where she stands on important axiological issues and how these stands are cashed out clinically. Supporters of Justificatory Liberalism (JL)—such as John Rawls and Gerard Gaus—typically maintain that the state may not coerce its citizens on matters of constitutional essentials unless it can provide public justification that the coerced citizens would be irrational in rejecting. The state, in other words, may not coerce citizens whose rejection of the coercion is based on their reasonable comprehensive doctrines (i.e., worldviews). Proponents of the legal recognition of same-sex marriage (SSM) usually offer some version of JL as the (...) most fundmental reason why laws that recognize marriage only if it is a union between one man and one woman are unjust. In this article I argue that the application of JL in support of legal recognition of SSM does not succeed because the issue under scrutiny—the nature of marriage—is deeply embedded in, and in most cases integral to, many (if not most) citizens’ reasonable comprehensive doctrines. Thus, I argue that because of the effects and consequences of the legal recognition of SSM, it results (or will result) in a violation of JL against dissenting citizens. (shrink)

This article critically assesses an account of religious liberty often associated with several legal and political philosophers: Ronald Dworkin, John Rawls, and Christopher Eisgruber and Lawrence Sager. Calling it the Religion as Comprehensive Doctrine approach (RCD), the author contrasts it with an account often attributed to John Locke and the American Founders Thomas Jefferson and James Madison, the Two Sovereigns approach (TS). He argues that the latter provides an important corrective to RCD’s chief weakness: RCD eliminates (or greatly (...) diminishes) from our vision those aspects of religious belief and practice that most conventional religious believers would consider essential to their faith. Kennedy offers an account of the desacralization of politics in the West by critically examining the works of five central figures in the (...) Protestant Reformed tradition: John Calvin (1509–64), Richard Hooker (1554–1600), Johannes Althusius (1557–1638), Thomas Hobbes (1588–1679), and John Locke (1632–1705). He dedicates a chapter to each thinker. The core of Kennedy's thesis is that desacralization is the result of a shift in the way modern thinkers like Hobbes and Locke reimagined the nature of natural law. The medieval tradition, having found its fullest expression in the work of St. Thomas Aquinas, saw natural law as one of four different types of law: eternal law (the eternal plan of creation in the mind of God), natural law (the rational creature's participation in the eternal law), human law (civil laws that are derived from the natural law), and divine law (the Old and New Testaments). According to Kennedy, the eventual desacralization of politics was set in motion with the development of arguments for natural rights that relied on a natural law that was in [End Page 553] practice severed from eternal law. But in that case, our political institutions—which are founded on the natural law—are purely human constructions and thus entirely secular.The usual story is that the Protestant Reformation constituted the decisive break with the medieval tradition and that it was the political theology of the reformers and their immediate successors that made the secularization of politics nearly inevitable. Kennedy wants to push back against that story. He argues, quite convincingly, that Calvin, Hooker, and Althusius, all Reformed Protestants, were in continuity with their medieval predecessors. Although Calvin is often depicted by his contemporary followers—especially among American Evangelicals—as hostile to the natural law tradition, Kennedy marshals an impressive case that shows that classical natural law seemed almost second nature to Calvin. My own sense is that the confusion over Calvin is the result of his contemporary readers expecting him to use the vocabulary of an Aquinas or a Duns Scotus. But not finding that vocabulary, they conclude that he rejected the natural law. Kennedy dispels that confusion by showing that Calvin in fact was fully committed to the four types of law absent the technical jargon of medieval scholasticism.Hooker and Althusius, writes Kennedy, continue in that tradition, though with a bit of a twist that some argue portends to Hobbes and Locke. Hooker and Althusius use the language of contract to account for the origin of certain aspects of political life. But Kennedy insists that it is a mistake to interpret them as proto-contractarians (as one finds in Hobbes and Locke), for they still held that the natural law participates in the eternal law, and that any agreements employed in the service of political life are under the authority of, and guided by, the natural law. One could argue, then, that these "contracts," like constitutions and treaties, are nonstatutory manifestations of the human law, which is perfectly consistent with classical natural law. In this paper we open up the topic of ethical corporate identity: what we believe to be a new, as well as highly salient, field of inquiry for scholarship in ethics and corporate social responsibility. Taking as our starting point Balmer’s (in Balmer and Greyser, 2002) AC2ID test model of corporate identity – a pragmatic tool of identity management – we explore the specificities of an ethical form of corporate identity. We draw key insights from conceptualizations of corporate social responsibility (...) and stakeholder theory. We argue ethical identity potentially takes us beyond the personification of the corporation. Instead, ethical identity is seen to be formed relationally, between parties, within a community of business and social exchange. Extending the AC2ID test model, we suggest the management of ethical identity requires a more socially, dialogically embedded kind of corporate practice and greater levels of critical reflexivity. Are the disciplines of education ghosts of a productive past or creative and useful forms of inquiry? Are they in a demographic and organisational crisis today? The contribution of the ‘foundation disciplines’ of sociology, psychology, philosophy, history and economics to the study of education has always been contested in the UK and in much of the English-speaking world. But such debates are now being brought to a head in education by the demographic crisis. Recent research has shown that with the (...) an ageing population of education academics, in ten years' time, there could be very few disciplinary specialists left working within faculties of education in UK universities. But does that matter and is the UK no more than a special case? How does this ‘crisis’ look from Europe where the disciplines of education are more embedded, and from the USA with its more diverse higher education system? In this book, leading scholars – including A.H. Halsey, David Bridges, John Furlong, Hugh Lauder, Martin Lawn and Sheldon Rothblatt – consider the changing fortunes of each discipline as education moved away from the dominance of psychology in the 1930s, 1940s and 1950s as a result of the growing importance of the other disciplines and new social questions, and how the changing epistemological and political debates of the last twenty years haves resulted in their progressive demise. Finally, the book confronts the question as to whether the disciplines have a place in education in the twenty-first century. The book brings the coming crisis into the public view and explores the issue of the past, current and future relevance of the disciplines to the study of education. We introduce the notion that an AEC admits intersections. We conclude that for AEC which admit intersections, the amalgamation property can have no positive effect on locality: there is a transformation of AEC's which preserves non-locality but takes any AEC which admits intersections to one with amalgamation. More specifically we have: Theorem 5.3. There is (...) an AEC with amalgamation which is not (N₀, N₁)-tame but is 2(N0, ∞)-tame; Theorem 3.3. The present paper examines the arguments and data presented by Nisbett and Wilson relevant to their thesis that subjects do not have access to their own cognitive processes. It is concluded that their review of previous research is selective and incomplete and that the data they present in behalf of their thesis does not withstand a demand characteristics analysis. Furthermore, their use of observer-subject similarity as evidence of subjects' inability to access cognitive processes makes tests of their hypothesis confounded and, (...) at the same time, reveals limitations in the application of the pre-inquiry quasi-control to research on social behavior. Problems with postexperiment questionnaires, such as the demand characteristics of the inquiry procedure are also considered. Although there are difficulties in assessing subjects' cognitive processes, many of these may be overcome through the application of novel techniques and research conducted on more traditional methods. In contrast to the view that subjects have limited access to cognitive processes and that their verbal reports are not valid, it is concluded that subjects' verbalizations are a rich source of psychological data which must be pursued if we are to tap their cognitive processes and are to gain an adequate understanding of human behavior. In this volume, Graham investigates Ortega's social thought as expressed in his central work, _Man and People,_ and in several pragmatic fields, interpreting it all in terms of comprehensive categories of postmodernism and interdisciplinarity. While others have studied Ortega's social thought and recently his postmodernity, no one has done so in the context of his thought as a whole or by such a variety of methods. The "unity in plurality" of Ortega's system is evident in the broad and varied structure of his sociology, which he intended to serve for postmodern times. His own postmodernism was rooted in Nietzsche but also in the pragmatism—from James, Peirce, and Dewey—that informs all parts of this trilogy. Yet, it is also a common notion that a person has the least knowledge of his or her own biases or prejudices, and that it is often a naive observer, who can better interpret the meaning of someone's actions when such biases are involved.

The problem of evil is a central issue in the philosophy of religion, for countless believers and skeptics alike. The attempt to resolve the dilemma of positing the existence of an omnipotent, omnibenevolent, creator while recognizing the presence of evil in the world has engaged philosophers and theologians for millennia. This article will not seek to resolve the dilemma but rather to explore the question of why there is a problem of evil. That is, why is it that gods are (...) conceived in ways that give rise to this dilemma? The topic will be approached using insights into the religious mind being developed by the disciplines contributing to the Cognitive Science of Religion. The thesis to be developed is that this problem is a product of natural cognitive processes that give rise togod-beliefs, beliefs that are shaped by evolved moral intuitions. (shrink)

Despite existing international, regional and national guidance on how to obtain valid consent to health-related research, valid consent remains both a practical and normative challenge. This challenge persists despite additional evidence-based guidance obtained through conceptual and empirical research in specific localities on the same subject. The purpose of this paper is to provide an account for why, despite this guidance, this challenge still persist and suggest conceptual resources that can help make sense of this problem and eventually mitigate it’. This (...) paper argues that despite the existence of detailed official guidance and prior conceptual and empirical research on how to obtain valid consent, the question of ‘how to obtain and ascertain valid consent to participation in health-related research’ cannot always be fully answered by exclusive reference to pre-determined criteria/guidance provided by the guidelines and prior research’. To make intelligible why this is so and how this challenge could be allayed, the paper proposes six concepts. The first five of these are intended to account for the persistent seeming inadequacies of existing guidelines. These are fact-skepticism; guideline insufficiency; generality; context-neutrality and presumptiveness. As an outcome of these five, the paper analyzes and recommends a sixth, called bioethical reflexivity. Bioethical reflexivity is reckoned as a handy tool, skill, and attitude by which, in addition to guidance from context-specific research, the persisting challenges can be further eased. Existing ethical guidelines on how to obtain valid consent to health-related research are what they ought to be – general, presumptive and context-neutral. This explains their seeming inadequacies whenever they are being applied in concrete situations. Hence, the challenges being encountered while obtaining valid consent can be significantly eased if we appreciate the guidelines’ nature and what this means for their implementation. There is also a need to cultivate reflexive mindsets plus the relevant skills needed to judiciously close the unavoidable gaps between guidelines and their application in concrete cases. This equally applies to the gaps which cannot be filled by reference to additional guidance from prior conceptual and empirical research in specific contexts. (shrink)

This paper examines the current use of the terms ‘story’, ‘narrative’ and ‘voice’ within health care. It argues that the focus on narrative forms is related to nursing's professional development of an alternative epistemology to science, and to nursing theorists' mistrust of ‘Enlightenment’ modes. However, in order for this project to be productively developed it is necessary to distinguish story from narrative: the former is an informal activity, the latter is meditative and theoretical. Both have dierapeutic dimensions.

Cavafy (1863-1933) was not born a poet but became one only through persistence and labor, reaching his "first step" sometime after the midpoint of his life. In his effort to assess the quality of his earlier poetic production and sharpen his sensitivity in facing self-criticism, he decided to put in writing his (...) personal thoughts on his work sometime in 1903. The text was written in English in a personal shorthand Cavafy had devised for his own use. It was found among the papers he left to A. Sengopoulos and published for the first time in 1963 by M. Peridis, who also supplied the suitable title Ars Poetica. It falls outside the scope of this essay to discuss the antecedents of this document. Taken as a whole, the text has all the clarity and directness required of a testament designed to serve as a personal guide and handbook. The problems it discusses are limited to the needs of the poet. In this regard, the Ars Poetica has neither the range of topics nor the theoretical scope of, for instance, Aristotle's Poetics. It is quite certain that the ideas that preoccupy Cavafy in the Ars Poetica had been on his mind for a period of years. However, the Ars Poetica is his first prose piece where he gives a systematic treatment to technical and critical issues directly related to the assessment of his work and his role as a poet. In order to project here a clear image of Cavafy's struggle to reach his technical maturity which came after 1910, we need first to discuss the persistent problems he faced during this crucial decade, then to examine the attitudes and values he embodied in certain representative early poems, and finally to relate them to the guiding principles he formulated in his self-addressed poetics of 1903. A number of interrelated problems confronted Cavafy in his late twenties and throughout his thirties. They emerged one by one, to 85 86Philosophy and Literature make more pressing the demand for a consistent solution and a complete recasting of his outlook. Coming to terms with them was extremely difficult. Aside from the emotional and sexual pressures he had to face alone, there was the absence of suitable ideas and conceptual tools to provide him with even the rudiments of an intellectual framework. Whatever he borrowed from Europe and England, or resurrected from his own Hellenic heritage, proved either beyond assimilation or insufficiently digested. The lingering issues fell roughly into four areas. (i) Despite his determination to devote his life to the writing of poetry, the quality of his work was discouraging. He knew this and as a result he often expressed uncertainty about his ability to proceed. Time and again he appeared suffering from a feeling of inadequacy, but nevertheless he sought to engage a reflective mood from which to draw encouragement and hope. (ii) On the theoretical side, he identified with the long tradition which assigned a coveted cultural role to the savant-poet as discloser of truth and spokesman for humanity; this despite the prevailing climate of opinion in his immediate environment which recognized no such high position in his case. Cavafy knew that his standing with the Greek community of Alexandria had gradually dwindled with the loss of family wealth and his lowly employment, and also that his expectations to be respected in his role as a poet and leader in communal affairs were futile. This denial of personal recognition in a society dominated by commerce and finance contributed to his mood of depression. The feeling of being an outcast, despite his associations with the upper social circles of Alexandria, became a constant irritant to his sense of pride. (iii) The course of culture, the destiny of human institutions and the workings of history, became puzzles as he tried to view them through the opaque glass of disillusionment. These were the grand themes actively discussed in the writings of leading European intellectuals, but to the young poet they had a different personal urgency. In great measure the success was due to the conference's scenic and user-friendly location at the Pacific Lutheran University, Tacoma,Washington, and to the untiring work of (...) Professor Paul Ingram and his staff. The spirit of Mount Rainier towered over the whole event, reminding us that both Buddhism and Christianity have a stake in global healing.One of the most enjoyable aspects of the conference was how well the various panels, presentations, plenary programs, and workshops matched the announced theme of the conference. Although I cannot speak for all the participants, in my extensive sampling of the events, care was given in addressing the question of global healing from a diverse set of spiritual perspectives and academic disciplines.Whether you attended the section on meditation or the erudite papers on orthodoxy, the presenters strove to show how their work could be understood as a way to promote global healing.Nowhere was this attention to the theme of the conference more clearly demonstrated than in the evening plenaries. I confess that I am not a fan of evening meetings. However, in each case the various panels presented their analysis as a gift to the larger mosaic of the conference. The evenings began with Dr. A. T. Ariyaratne and Dr. Cecil Murray addressing nonviolent struggle for economic justice. This was followed by presentations on the Earth Charter; gender, justice, and oppression in Buddhism and Christianity; and consumerism and ecology. I would also be remiss if I did not note that we were treated to wonderful musical performances not only at the opening and closing ceremonies but during all the other plenaries as well.One of the most noteworthy features of the work of the society over the last two decades has been its conviction that erudite scholarship and the actual profession and practice of religion are not mutually exclusive. Furthermore, the society was founded on the belief that dialogue between Buddhists and Christians is a good thing in and of itself. The workshop on the interior dialogue of meditation was a gentle refutation to those in the academic world who maintain that only analysis of isolated religious practices or texts makes any sense. The plenary sessions took place in the magnificent new music center at PLU, wherein resides a huge concert organ.We were literally moved by the organ's powerful rendition of the classic works of the Western religious musical tradition. Matching the organ was the gentle call of the shakuhachi. An organ and a shakuhachi may seem mismatched in theory and performance--much less sheer volume for the bamboo flute--but they blended into a symphony of shared sacred music.Having praised the thematic attentiveness, musical brilliance, and spiritual depth of the conference, I must likewise highlight the academic integrity of the papers. Many of the professorial types mentioned over and over again how pleased they were with the thoughtfulness of the academic presentations. Here we need not only to thank the authors but also the conference planning committee for its ability to select the best representatives of erudite, informed, and engaged models of academic scholarship. Those who were not present will simply have to wait for many of these fine papers to be published in various scholarly journals. Another helpful detail was the conference bookstore, which stocked many of the recent publications of the participants.The only criticism I heard during the whole conference was that it was, alas, a bit too long. This is an examination of the dialectical structure of deep disagreements about matters not open to empirical check. A dramatic case in point is the Law of Non-Contradiction . Dialetheists are notoriously of the view that, in some few cases, LNC has a true negation. The traditional position on LNC is that it is non-negotiable. The standard reason for thinking it non-negotiable is, being a first principle, there is nothing to negotiate. One of my purposes is to show that the (...) first-principle defence of LNC is inadequate. A second purpose is to argue that it flows from this inadequacy that LNC stands or falls on economic considerations, much in the spirit of Quine's pragmatism about logic generally. This is a tactical victory for dialetheists. It gives them room to make the case against LNC on cost-benefit grounds. As things presently stand, no such case can be considered decisive. But, given that costs and benefits shift with changing circumstances, it is possible that a winning case for the dialetheist may present itself in the future. Notwithstanding the rivalry between consistentists and dialetheists, they share a common opponent. This is trivialism, the doctrine that everything whatever is true. It is an ironic alliance, in as much as the dialetheist's case against the consistentist can be adapted to a defence of trivialism. How damaging this turns out to be depends on the adequacy of the reasons for the dialetheist's rejection of trivialism. My further purpose is to show that the damage is slighter than dialetheists commonly believe. (shrink)

Among various kinds of disclosures typically required in research as well as in clinical scenarios, risk information figures prominently. A key question is, what kinds of risk information would the reasonable person want to know? I will argue, however, that the reasonable person construct is and always has been incapable of settling this very question. After parsing the nebulous if not “contentless” character of the reasonable person, I will explain how Western courts have actually adjudicated cases of “negligent nondisclosure,” that (...) is, cases in which patient‐plaintiffs allege that their informed consent rights were violated by the failure of their health providers to inform them of reasonably foreseeable risks that subsequently materialized. To support my argument, I will scrutinize the landmark decision by the United Kingdom's Supreme Court in Montgomery v. Lanarkshire Health Board and, in particular, Justice Brenda Hale's concurrence.
