The aim of this review is to comment on two main issues: (i) the critiques that McBride addresses to competing accounts of private law (I claim that they miss the mark) and (ii) the account of human flourishing that McBride sees as underlying English private law, which he calls the ‘RP’ (‘RP’ stands both for ‘reflective picture’ and ‘received picture’ of human flourishing). I raise some worries about the nature and content of the RP as explained by McBride.

Given the ubiquitous nature of love, numerous theories have been proposed to explain its existence. One such theory refers to love as a commitment device, suggesting that romantic love evolved to foster commitment between partners and enhance their reproductive success. In the present study, we investigated this hypothesis using a large-scale sample of 86,310 individual responses collected across 90 countries. If romantic love is universally perceived as a force that fosters commitment between long-term partners, we expected that individuals likely to (...) suffer greater losses from the termination of their relationships—including people of lower socioeconomic status, those with many children, and women—would place a higher value on romantic love compared to people with higher status, those with fewer children, and men. These predictions were supported. Additionally, we observed that individuals from countries with a higher (vs. lower) Human Development Index placed a greater level of importance on romantic love, suggesting that modernization might influence how romantic love is evaluated. On average, participants worldwide were unwilling to commit to a long-term romantic relationship without love, highlighting romantic love’s universal importance. (shrink)

Analizando las causas, la cura y el ser de la enfermedad en el Filoctetes, el Ayax y Edipo Rey, podremos observar las distancias con respecto a la concepción técnica y racional del (...) diagnóstico hipocrático y delimitar así los procesos de desarrollo técnico, democratización del saber y de pérdida de autoridad divina que posibilitarán una medicina liberada, en tanto saber, de sus ancestrales raíces religiosas. The article explores the moral conflict between individual animal rights and the value of species conservation, using the culling of kangaroos to save earless dragons in Australia as a case study. The author argues that species do not possess nonderivative final value and thus cannot justify the infringement of individual rights. While recognizing the instrumental and contributory value of species, the paper rejects philosophical arguments that claim species have nonderivative value, such as the replication argument and the last person argument. In his new book Emotion: The Basics, Michael S. Brady introduces the fundamentals on the philosophical approach to emotions: by fleshing out these basic tenets Brady provides insight into a core component of all our lives and covers the nature of emotions, their relationship to knowledge and understanding, and their relationship to our moral and social selves. In my comments, I value the achievements of Brady's work as well as explore a critical approach to the book in which I emphasise (...) how the book deals with the dichotomy between emotions and reasons. I also engage with the limitations that emerge from a viewpoint of a scholar specialised on the history of philosophy and epistemology, and point towards some puzzles that ought to be further considered. Se realiza una revisión bibliográfica con el objetivo de analizar los diferentes códigos éticos y deontológicos internacionales, regionales y nacionales de los que se nutre la especialidad de psiquiatría. Se concluye que el comportamiento ético se basa en el sentido de la responsabilidad individual de cada psiquiatra hacia cada paciente y en la capacidad de ambos para determinar cuál es la conducta correcta y más apropiada. Las normas externas y las directrices, tales como los códigos de conducta profesional, las aportaciones (...) de la ética y de las normas legales, no garantizan por sí solas la práctica ética de la medicina, pero constituyen un importante marco referencial. A literature review was performed with the objective of analyzing the various international, regional and national ethical and deontological codes that the psychiatry specialty feeds on. It is concluded that ethical behavior is based on the sense of individual responsibility of each psychiatrist to each patient and the ability of both to determine what the correct and appropriate behavior is. External standards and guidelines, such as professional codes of conduct, the study of ethics and legal standards alone do not guarantee the ethical practice of medicine but are an important framework. This volume, the fourth in the Vancouver Studies in Cognitive Science published by OUP, examines the role of logic in cognitive psychology in light of recent developments. Gonzalo Reyes's new semantic theory has brought the fields of cognitive psychology and logic closer together, and has shed light on how children may master proper names and count nouns, and thus acquire knowledge. The chapters highlight the inadequacies of classical logic in its handling of ordinary language and reveals the prospects of (...) applying the new theory of kinds to cognitive psychology, cognitive science, linguistics, the philosophy of language and logic. Fringe science has been an important topic since the start of the revolution in the social studies of science that occurred in the early 1970s. The revolution was what Collins and Evans refer to as the "second wave of science studies," while this paper is best thought of as an exercise in "third wave science studies." This paper offers some insights and clarifications of the paramount role that Mexico has had in the forging of first-order cybernetics. Our account starts with Arturo Rosenblueth as a key intellectual figure in the foundation and formation of the field. After revisiting a historical context of people and places, we proceed to a cultural and media archeological investigation that helps us obtain new insights into the ongoing effort to intertwine the complex intellectual networks across different countries in Latin America, North (...) America, and Europe. We then present cases and first-hand interviews to discuss the legacy of cybernetics in Mexico around institutions where Rosenblueth was affiliated, mainly the Institute of Cardiology and, later on, the CINVESTAV at the Instituto Politécnico Nacional. We claim that subjective affinities are as important as common scientific goals to establish and keep connections alive, necessary to the development of a research field. As the active compound in spicy peppers, capsaicin represents a local component to the definition of cybernetics. Ultimately, the paper aims to contribute to the research on the importance of cybernetics in Latin America. (shrink)

We specify two problems in syllogistic: the lack of functoriality of predicates (although a thief is a person, a good thief may not be a good person) and the change of grammatical role of the middle term, from subject to predicate, in some syllogisms. The standard semantics, the class interpretation, by-passes these difficulties but, we argue, in a manner that is at odds with logical intuition. We propose a semantics that is category theoretic to handle these difficulties. With this semantics (...) we specify when syllogisms are valid and we set limits to the class interpretation. To perform this task we show how to construct the categorical notion of an entity in a system of kinds. We devote two brief sections to an argument that our approach is very much in the spirit of Aristotle. (shrink)

El objetivo de este artículo es realizar un recorrido sobre la tramitación parlamentaria de la Ley Orgánica 8/2021, de 4 de junio,de protección integral a la infancia y adolescencia frente a la violencia. Se reflexionará sobre el olvido inicial de los y las menores víctimas de violencia de género ysu primer impulso de dar entrada a aquellos planteamientos en los que se pone la atención en la protección del interés superior de la infancia y adolescencia en los casos de ruptura (...) familiar, escondiendo los daños sufridos por la infancia y adolescencia derivados de la violencia de género. Mostraremos cómo, para paliar los daños derivados de la “alta conflictividad” provocada por la ruptura familiar, se está asentando jurisprudencialmente la coordinación de parentalidad. Mediante un análisis jurisprudencial, comprobaremos cómo este método de resolución de conflictos se aplica en contextos de violencia de género, con el objetivo de restablecer o normalizar la relación del padre que ejerce violencia de género con sus hijos e hijas. The Patients’ Rights and Duties Act, promulgated in Chile in 2012, has made the informed consent process a critical step to respect the patient’s autonomy. It is then relevant to test health workers’ knowledge of the subject, especially in the surgery department. We carried out a quantitative study on 90 specialists from the surgery department in a public tertiary hospital, to whom a questionnaire was administered to test their knowledge of informed consent. Tres cuestiones se investigan en el presente trabajo. En primer lugar, lo que tiene que ver el concepto benjamíníano de historia con el de filosofía de la historia, dominante en Europa. Si este último puede ser caracterizado como una ontología del presente, Benjamin subraya que sólo cabe un futuro nuevo si se quiebra el presente. En segundo lugar, el concepto de pasado capaz de romper el presente e inaugurar un futuro real. El pasado en cuestión, inédito y salvador, es el (...) de los vencidos. Finalmente, qué política es esa que Benjamin coloca por encima de la historia. Extrapolando a Benjamin cabria enfrentar una universalidad negativa a la universalidad positiva. La segunda es siempre particular, la primera conlleva un orden mundial basado en la intersubjetividad asimétrica. (shrink)

The World Health Organization has declared a world pandemic due to COVID-19. In response, most affected countries have enacted measures involving compulsory confinement and restrictions on free movement, which likely influence citizens' lifestyles. This study investigates changes in health risk behaviors with duration of confinement. An online cross-sectional survey served to collect data about the Spanish adult population regarding health behaviors during the first 3 weeks of confinement. A large sample of participants from all Spanish regions completed the survey. Binomial (...) logistic regressions adjusted for socioeconomic characteristics, body mass index, previous HRBs, and confinement context were conducted to investigate associations between the number of weeks confined and a set of six HRBs. When adjusted, we observed significantly lower odds of experiencing a higher number of HRBs than before confinement overall in a time-dependent fashion: OR 0.63; 95% CI: 0.49–0.81 for the second and OR 0.47; 95% CI: 0.36–0.61 for the third week of confinement. These results were equally consistent in all age and gender subgroup analyses. The present study indicates that changes toward a higher number of HRBs than before confinement, as well as the prevalence of each HRB except screen exposure, decreased during the first 3 weeks of COVID-19 confinement, and thus the Spanish adult population may have adapted to the new situational context by gradually improving their health behaviors. In this paper we summarize observations bridging the declared aspirations of pictorial semiotics and its real achievements. Pictorial semiotics is here understood as the general study of pictures as signs and it constituted a fundamental step beyond the art historical captivation with individual images. In the first part of our contribution we present a review of the most important methods that have been proposed as an answer to deal with several pictorial problems (multiple instances, segmentation, non-figurative meaning). In the second (...) part, we offer some positive and on-going implementations designed to remedy the shortcomings observed. What is suggested is the proof of concept that human researchers need the assistance of computing methodologies. However, computers can only do their job once an adequate phenomenology of human experience is fed into the process. (shrink)

Objectives To develop and test two educational programmes (interactive and passive) aimed at improving family doctors' (FD) prescribing practices and patient's knowledge and use of non-opioid analgesics (NOA).Methods The educational programmes were conducted in two family medicine clinics by using a three-stage approach: baseline evaluation, design, and implementation of educational activities, and post-programme evaluation. An interactive educational programme (IEP) was compared with a passive educational programme (PEP); both were participated by FDs and patients. The IEP for FDs comprised of workshops, (...) discussion groups, in-service training and guidelines, while for patients the IEP consisted of an interactive session with a video, leaflets and a discussion. The PEP consisted in delivering the guidelines to the FDs and the leaflets to patients. The effect of the programmes on the FDs was measured through the appropriateness of prescriptions and analysed using the differences-in-differences estimator (D-in-D), and on patients through changes in self-medication and in their knowledge about the proper use and adverse events by analysing the inter- and intra-group differences before and after the programmes.Results The IEP obtained better results to improve appropriate FDs prescription of NOA than PEP (D-in-D = 15%). Regarding the patients, the PEP group reached higher reduction of self-medication than the IEP group (13.4% vs. 9.1%); the knowledge of proper NOA use increased by 8.5% in both groups, whereas knowledge of NOA-related adverse events was better in the IEP (39.6%) than in the PEP group (9.2%).Conclusions The IEP was better to improve the doctors' abilities to prescribe NOAs, and both programmes improved patients' knowledge. La distinción aristotélica entre lo justo por naturaleza y lo justo por ley fue objeto de una especial atención por parte de los comentaristas medievales de la Ética a Nicómaco. En este trabajo se examina la forma en que este texto fue entendido por tres comentaristas del primer tercio del siglo XIV: Radulfus Brito, Walter Burley y Geraldus Odonis. La lectura que hacen los dos primeros está notoriamente influida por Tomás, a pesar de la Condemnatio de 1277, pues entienden lo (...) justo natural a partir de su teoría de la ley natural. En cambio Odonis, que es el primer franciscano que comenta la Ética, es más original, como se observa en su idea de que en las manifestaciones de la justicia legal siempre subyacen algunos elementos naturales; en su preocupación por vincular las enseñanzas deAristóteles sobre lo justo natural con ciertos tópicos platónicos, y en su convincente explicación de los ejemplos que pone Aristóteles para explicar tanto el cambio de lo justo por naturaleza como el cambio de las cosas que son justas por ley. Se aborda la intersección entre la ética, la inteligencia artificial (IA) y el capitalismo digital. Se plantean tres supuestos: primero, que la IA incrementa su efectividad a expensas de nuestra intimidad y autonomía, fundamentales para la condición humana. Segundo, que es crucial entender la IA dentro del contexto del capitalismo digital, donde se convierte en un producto ideológico y mercantil. Tercero, se enfatiza la necesidad de regulaciones tanto globales como nacionales para salvaguardar los derechos humanos frente a los riesgos que (...) presenta la IA. Se destaca que la digitalización ha transformado las relaciones sociales, creando un mundo donde la IA puede vulnerar nuestra dignidad. Además, criticamos la falta de regulación adecuada, advirtiendo que sin un marco ético, la IA podría ser utilizada para manipular y vigilar a las personas. Finalmente, se aboga por una ética de la IA que priorice la dignidad humana y fomente un uso responsable de la tecnología, reconociendo sus beneficios, pero también los riesgos que conlleva en un mundo cada vez más digitalizado.
