Globalisation may concern many different issues, among others, the increase in migration that creates opportunities for all. There should be no doubt that globalisation can bring both positive and negative effects to workers. It can be seen as new opportunities for people, because they can travel, work, learn and live in different countries. Simultaneously however it can be perceived as synonymous to job losses, social injustice, or low environmental, health, and privacy standards. As a result of globalisation, the world is (...) becoming more and more complex and the economic importance of state borders is reduced. It should therefore not raise doubts, that global problems require the capacity to agree on coordinated global responses and mechanisms on the basis of international cooperation. Among the basic international organisations which provide solutions for workers who have decided to look for a job in another country, one can generally mention the International Labour Organisation, the Council of Europe, and the European Union. There is quite a large number of legal acts created in the framework of those organisations, and so we should ask a question if in such a situation we should also try to understand some legal concepts; in our case concepts connected with taking up employment, in a similar way. Even if the answer is positive, another question comes to mind – is it possible to have such definitions in a global world? It is thus not enough to provide legal regulations concerning worker’s rights and obligations if we do not know who exactly should be treated like a worker. The following article will try to answer those questions and simultaneously try to show that globalisation may affect the way certain terms should be understood. (shrink)

Artykuł opisuje widzenie praw i wolności w Kazaniach sejmowych Piotra Skargi. We wstępie ukazano dzieło jezuity w kontekście innych traktatów społeczno-politycznych XVI wieku. We właściwej części artykułu przedstawiono rozumienie praw przez kaznodzieję. Zaprezentowano różne ich kategorie. Następnie dowiedziono konieczności istnienia ustaw państwowych. Kolejno przybliżono cechy dobrych praw, czyli: sprawiedliwość, krzewienie cnoty i obronę czci Boskiej. Ukazano błędy w polskim prawodawstwie, wśród których na plan pierwszy wysuwa się zniesienie jurysdykcji sądów duchownych oraz pobłażliwe traktowanie morderców. Zobrazowano zależność praw od obyczajów. Podkreślono (...) znaczenie odpowiedniej władzy wykonawczej i przedstawiono kilka uwag w sprawie sądownictwa. W następnej części pracy przybliżono wizję wolności w dziele Skargi. Ukazano więc wartość złotej wolności szlacheckiej ze wskazaniem nieprawidłowości w jej pojmowaniu. Podniesiono złe traktowanie chłopów. Zwrócono uwagę na zagrożenia płynące ze strony innowierców. Kolejno przedstawiono cztery rodzaje wolności. Potem dowiedziono istnienia związku praw i wolności. Wykazano, że do zniewolenia często prowadzi grzech i dlatego należy zapewnić prawne wsparcie religii. Zobrazowano, że rolą praw jest ograniczenie sprawujących władzę — by nie naruszali autonomii innych. Stwierdzono, iż sprawiedliwe prawa mają chronić wszystkich członków narodu. Na końcu dowiedziono, iż posłuszeństwo prawu współgra z koncepcją wolności chrześcijańskiej — w jej tradycyjnym rozumieniu. (shrink)

What is the proper unit of analysis in the psycholinguistics of dialog? While classical approaches are largely based on models of individual linguistic processing, recent advances stress the social coordinative nature of dialog. In the influential interactive alignment model, dialogue is thus approached as the progressive entrainment of interlocutors' linguistic behaviors toward the alignment of situation models. Still, the driving mechanisms are attributed to individual cognition in the form of automatic structural priming. Challenging these ideas, we outline a dynamical framework (...) for studying dialog based on the notion of interpersonal synergy. Crucial to this synergetic model is the emphasis on dialog as an emergent, self-organizing, interpersonal system capable of functional coordination. A consequence of this model is that linguistic processes cannot be reduced to the workings of individual cognitive systems but must be approached also at the interpersonal level. From the synergy model follows a number of new predictions: beyond simple synchrony, good dialog affords complementary dynamics, constrained by contextual sensitivity and functional specificity. We substantiate our arguments by reference to recent empirical studies supporting the idea of dialog as interpersonal synergy. (shrink)

In an influential paper, James Lenman argues that consequentialism can provide no basis for ethical guidance, because we are irredeemably ignorant of most of the consequences of our actions. If our ignorance of distant consequences is great, he says, we can have little reason to recommend one action over another on consequentialist grounds. In this article, I show that for reasons to do with statistical theory, the cluelessness objection is too pessimistic. We have good reason to believe that certain patterns (...) of action will tend to have better consequences, and we have good reason to recommend acting in accordance with strategies based on those advantageous patterns. I close by saying something about the strategies that this argument should lead us to favour. (shrink)

This special issue of Philosophy and Technology investigates whether and to what extent machines, of various designs and configurations, can or should be considered moral subjects, defined here as either a moral agent, a moral patient, or both. In the paper we discuss criticisms against David Armstrong’s general theory of truthmaking by Gonzalo Rodriguez-Pereyra, Peter Schulte and Benjamin Schnieder, and conclude that Armstrong’s theory survives these criticisms. Special attention is given to the problems concerning Entailment Principle, Conjunction Thesis, Disjunction Thesis and to the notion of explanation.

We study a new formal logic LD introduced by Prof. Grzegorczyk. The logic is based on so-called descriptive equivalence, corresponding to the idea of shared meaning rather than shared truth value. We construct a semantics for LD based on a new type of algebras and prove its soundness and completeness. We further show several examples of classical laws that hold for LD as well as laws that fail. Finally, we list a number of open problems. -/- .

This is a comprehensive investigation into the theme of time in the work of Jacques Derrida and shows how temporality is one of the hallmarks of his thought. Drawing on a wide array of Derrida's texts, Joanna Hodge: compares and contrasts Derrida's arguments concerning time with those Kant, Husserl, Augustine, Heidegger, Levinas, Freud, and Blanchot argues that Derrida's radical understanding of time as non-linear or irregular is essential to his aim of blurring the distinction between past and present, biography (...) and literature, philosophical and religious meditation, and the nature of the self explores the themes of death, touch and transcendence to argue that if considered under the theme of temporality there is more continuity to Derrida's thought than previously considered. Rather than focus on effects, the isolatable and measureable outcomes of events and interventions, the papers assembled here offer different perspectives on the affective dimension of the meaning and politics of human/non-human relations. The authors begin by drawing attention to the constructed discontinuity between humans and non-humans, and to the kinds of knowledge and socialities that this discontinuity sustains, including those underpinned by nature-culture, subject-object, body-mind, individual-society polarities. The articles presented track human/non-human relations through different domains, including: humans/non-humans in history (...) and animal welfare science (Fudge and Buller); the relationship between the way we live, the effects on our natural environment and contested knowledges about ‘nature’ (Whatmore); choreographies of everyday life and everyday science practices with non-human animals such as horses, meerkats, mice, and wolves (Latimer, Candea, Davies, Despret). Each paper also goes on to offer different perspectives on the human/non-human not just as division, or even as an asymmetrical relation, but as relations that are mutually affective, however invisible and inexpressible in the domain of science. Thus the collection contributes to new epistemologies/ontologies that undercut the usual ordering of relations and their dichotomies, particularly in that dominant domain of contemporary culture that we call science. Indeed, in their impetus to capture ‘affect’, the collection goes beyond the usual turn towards a more inclusive ontology, and contributes to the radical shift in the epistemology and philosophy of science’s terms of engagement. How leaders and managers respond to not knowing is highly relevant given the complex, ambiguous, and chaotic business environment of the twenty-first century. Drawing on the literature from a variety of disciplines, the paper explores the dominant, unfavorable conceptualization of not knowing. The authors present some potential ethical implications of a negative view of not knowing and suggest how organizations would benefit from identifying any unhelpful aspects of the culture that may encourage unethical, undesirable, and/or hasty actions in situations of (...) not knowing. The paper specifically illustrates how patience, courage, honesty, integrity, and humility are integral to negative capability in the contexts of not knowing. Finally, the paper calls for deeper inquiry into the role of virtue ethics in preparing managers and leaders for not knowing and urges organizations to embrace negative capability in not knowing rather than engaging in damaging delusion. Heyd's approach resolves many paradoxes in intergenerational justice, while offering a major test case for the profound problems of the limits of ethics and the nature of value.

Everyone knows what is feels like to be in pain. Scraped knees, toothaches, migraines, giving birth, cancer, heart attacks, and heartaches: pain permeates our entire lives. We also witness other people - loved ones - suffering, and we 'feel with' them. It is easy to assume this is the end of the story: 'pain-is-pain-is-pain', and that is all there is to say. But it is not. In fact, the way in which people respond to what they describe as 'painful' has (...) changed considerably over time. In the eighteenth and nineteenth centuries, for example, people believed that pain served a specific (and positive) function - it was a message from God or Nature; it would perfect the spirit. 'Suffer in this life and you wouldn't suffer in the next one'. Submission to pain was required. Nothing could be more removed from twentieth and twenty-first century understandings, where pain is regarded as an unremitting evil to be 'fought'. Focusing on the English-speaking world, this book tells the story of pain since the eighteenth century, addressing fundamental questions about the experience and nature of suffering over the last three centuries. How have those in pain interpreted their suffering - and how have these interpretations changed over time? How have people learnt to conduct themselves when suffering? How do friends and family react? And what about medical professionals: should they immerse themselves in the suffering person or is the best response a kind of professional detachment? (shrink)

Recently, scholars have described the emotional consequences of transnational motherhood on families. Research, however, has neglected to address the lives of migrant fathers and how they compare to those of migrant mothers. This article fills the gap by analyzing the experiences of Mexican transnational mothers and fathers residing in New Jersey. Ethnographic data and interviews show that parents behave in similar ways when internationally separated from children. However, their migration patterns and emotional responses to separation differ. I show that these (...) differences are tied to Mexican gender ideology in which women’s maternal roles are sacralized, whereas fathers’ roles are tied to financial provision. Although the contemporary Mexican transnational family structure challenges gender norms, the analysis of how parents understand their family roles when separated from their children proves gender ideals to be highly durable in the transnational context. Pyrrho and colleagues (2022) argue that the loss of health privacy can damage democratic values by increasing social polarization, removing individual choice, and limiting self-determination. As a remedy, the authors propose a data-regulation regime that prohibits companies from using such data for discriminatory purposes. Our commentary addresses three issues. First, we point out an additional problematic dimension of excessive health privacy loss, namely, the potential racialization of groups and individuals that it may likely contribute to. Second, we note that, in (...) our view, the authors’ argument for more regulation rests on an invidious comparison between the realistically described status quo and the idealized picture of the imagined regulatory regime that the authors briefly propose. Third, we argue that, despite existing regulations, both private and government actors frequently use private data in ways that lead to ethically problematic outcomes, especially when it comes to racialized communities. A CHOICE Outstanding Academic Title 2012! Contemporary picturebooks open up spaces for philosophical dialogues between people of all ages. As works of art, picturebooks offer unique opportunities to explore ideas and to create meaning collaboratively. This book considers censorship of certain well-known picturebooks, challenging the assumptions on which this censorship is based. Through a lively exploration of children's responses to these same picturebooks the authors paint a way of working philosophically based on respectful listening and creative and authentic interactions, rather (...) than scripted lessons. This dialogical process challenges much current practice in education. The authors propose that a courageous and critical practice of listening is central to the facilitation of mutually educative dialogue. This paper discusses strategic decision making in firms pursuing biotechnology innovation and the influence of risk regulation on firm strategy. Data from three research projects, involving interviews with over 60 managers from agricultural and food related biotechnology companies and also over 60 key participants in the regulatory process in the UK and EC, shows a diversity of strategy and opinion. While some industry representatives identified new risk regulations governing the release of genetically manipulated organisms (GMOs) as the primary constraint on (...) biotechnology innovation, the findings of the study painted a more complex picture. The controversies surrounding the issue of risk regulation and its impact on innovation are best understood if viewed in the context of other political and economic factors. We conclude that the actual impact of risk regulation on industry strategies is probably less than the rhetoric of industry lobbyists would suggest. At the same time, the very act of lobbying so forcefully could lead to a public backlash against industry that would be much more damaging than the regulation itself. (shrink)

Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

Absolute velocities in Newtonian mechanics are commonly regarded as unmeasurable. Roberts (Br J Philos Sci 59(2):143–168, 2008) provides a justification for this thesis which appeals to the observational indistinguishability of boost-related models of Newtonian mechanics. Middleton and Murgueitio Ramírez (Australas J Philos, 2020) criticise his argumentation by pointing out that his analysis of the notion of measurement is too restrictive, and that, under a weaker analysis (based on counterfactuals), absolute velocities are measurable. Jacobs (Australas J Philos, 2020) opposes their view, (...) arguing that, on a properly formulated counterfactual-based account of measurement, absolute velocities are unmeasurable. However, in his argument, observational indistinguishability plays no role, even though, intuitively, it is very relevant for the issue of (un)measurability. This paper’s aim is to bring observational indistinguishability back to this discussion. I build upon the observation that there is an analogy between possible views on knowledge and justification on the one hand, and on measurement on the other. In particular, I explore the distinction between externalist and internalist approaches. Counterfactual-based accounts are all externalist, whereas the observational indistinguishability of boost-related models becomes relevant if we are interested in an internalist concept of measurement. Hannah Arendt began her scholarly career with an exploration of Saint Augustine's concept of _caritas_, or neighborly love, written under the direction of Karl Jaspers and the influence of Martin Heidegger. After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. The disseration became a bridge over which Arendt traveled back and forth between 1929 Heidelberg and 1960s New York, carrying with her Augustine's question about the possibility of social life in an age of rapid political and moral change. In _Love and Saint Augustine_, Joanna Vecchiarelli Scott and Judith Chelius Stark make this important early work accessible for the first time. Here is a completely corrected and revised English translation that incorporates Arendt's own substantial revisions and provides additional notes based on letters, contracts, and other documents as well as the recollections of Arendt's friends and colleagues during her later years. Public participation broadcasting has recently become the focus of attention in media studies, as well as from the social interactional perspectives of discourse and conversation analysis, and it has been argued in particular that the talk show genre has given new and enhanced status to the `authentic' voice of lay members of the public. What remains largely unexplored is how lay participants discursively construct authentic positions for their own knowledgeable participation in such discourse. Expert speakers in public participation broadcasts are (...) typically attributed names, rank, institutional affiliation and status, which legitimizes their position, and in so doing provides their warrant to talk about whatever issue they have been brought in to discuss. Lay participants typically do not have this status attributed to them, but need to establish their own position from which to talk. In this article I examine the public identities that lay speakers build for themselves in these broadcasts, and show how they routinely draw on a range of discursive resources to construct situated, local identities which provide a warrant for what they have to say. One of the unmet challenges for risk–benefit assessment in biomedical research is whether there should be an upper limit of risk in non-beneficial studies involving competent and consenting participants, and if yes, how it should be defined. This chapter focuses on this second question. It examines the four dominant regulatory and conceptual approaches to setting a maximal risk threshold in research: no catastrophic harm/risk approach, pure procedural approach, numerical approach, and comparative approach. It then considers the pure procedural approach, which (...) leaves the judgment of risk acceptability to RECs discretion. The approach has significant advantages, but it is not free from certain shortcomings, such as unwarranted diversity and arbitrariness of RECs judgments. The chapter concludes by sketching the outlines of what is referred to as the “ELS procedural approach” that provides RECs with procedural recommendations for identifying an ethically, legally and socially acceptable upper limit of risk in non-beneficial research on volunteers. The ELS procedural approach is an improvement over the pure procedural approach. It is more standardized and accountable, but still context-sensitive and flexible. (shrink)

Non-beneficial paediatric research is vital to improving paediatric healthcare. Nevertheless, it is also ethically controversial. By definition, subjects of such studies are unable to give consent and they are exposed to risks only for the benefit of others, without obtaining any clinical benefits which could compensate those risks. This raises ethical concern that children participating in non-beneficial research are treated instrumentally; that they are reduced to mere instruments for the benefit of science and society. But this would make the research (...) incompatible with the widely endorsed principle of the primacy of the human subject, which stipulates that the interests of the participating individual should prevail over the interests of science and society. This paper deals with this conflict. It analyses solutions to this problem developed in the literature, and shows that they are unsuccessful. Finally, it offers a new idea of how to reconcile the conduct of non-beneficial paediatric research with the PP. The paper argues for a new formula of the PP, and shows that it implies a specific non-comparative definition of the minimal risk threshold. (shrink)

The analysis of Political Action Committee activities is dominated by the perspective that PAC contributions are a rational investment in political candidates; they yield valuable short-term payoffs. PACs buy access to officeholders and their votes on important legislation. Despite broad acceptance of this morally suspect theory, the evidence upon which it is based is weak. An alternative perspective — what we call the principled approach — both fits the evidence and rejects the morally repugnant interpretation of the relationship between business (...) and politics that permeates the rational investment perspective. Ballard et al. show how control structures using minimal state can be made flexible enough for complex cognitive tasks by using deictic pointers, but they do so within a specific computational framework. We discuss broader implications in cognition and memory and provide biological evidence for their theory. We also suggest an alternative account of pointer binding, which may better explain their limited number.

Wskazuję również na dzielące ich różnice m.in. w podejściu do przedmiotu etyki, ujmowaniu charakteru oceny i normy moralnej oraz w wymogach metodologicznych. Zwracam uwagę na wspólną obu filozofom postawę wyrażającą konieczność kształtowania „kręgosłupa moralnego”, niezależnie od okoliczności, polegającą na wierności wyznawanym wartościom. Prezentuję podobieństwa (...) w poglądach etycznych T. Kotarbińskiego i M. Ossowskiej dotyczących etyki walki, w pojmowaniu idei godności i jej wtórności względem innych wartości, w rozumieniu sumienia jako rodzaju wstydu przed pogardą, wreszcie wspólny pogląd na rolę i naturę cnót. Staram się pokazać, że w przypadku obojga myślicieli kompetencje naukowe szły w parze z kompetencjami moralnymi — jasność myślenia z jasnością działania. (shrink)
