This article provides empirical results indicating that acting in a socially respon- sible and lawful manner is a necessary, though not sufficient, condition for increasing shareholder wealth. It meta-analyzes 27 event studies that have mea- sured the stock market's reaction to incidences of socially irresponsible and illicit behavior. It finds that for firms engaging in socially irresponsible and illicit behavior, the effect on shareholder wealth is negative (wealth decreases), statisti- cally significant (p <.001), and so substantial in size (D = (...) -.932) that the distribution of abnormal returns is shifted nearly a full standard deviation to the left (i.e., negatively) from their expected standard normal distribution. This result gives rationally self-interested firms a self-interested reason to act in a socially responsible and law-abiding manner. It also provides support for a moral position called enlightened self-interest, which prescribes that firms should act in a socially responsible manner to promote the shareholders' interests. This paper considers questions that small animals and AI systems raise for utilitarianism. Specifically, if these beings have more welfare than humans and other large animals, then utilitarianism implies that we should prioritize them, all else equal. This could lead to a ‘rebugnant conclusion’, according to which we should, say, create large populations of small animals rather than small populations of large animals. It could also lead to a ‘Pascal’s bugging’, according to which we should, say, prioritize large populations of (...) small animals even if they have a low chance of being sentient. I suggest that utilitarians should accept these implications in theory but might be able to avoid some of them in practice. (shrink)

Official apologies and truth commissions are increasingly utilized as mechanisms to address human rights abuses. Both are intended to transform inter-group relations by marking an end point to a history of wrongdoing and providing the means for political and social relations to move beyond that history. However, state-dominated reconciliation mechanisms are inherently problematic for indigenous communities. In this paper, we examine the use of apologies, and truth and reconciliation commissions in four countries with significant indigenous populations: Canada, Australia, Peru, and (...) Guatemala. In each case, the reconciliation mechanism differentiated the goal of reconciliation from an indigenous self-determination agenda. The resulting state-centered strategies ultimately failed to hold states fully accountable for past wrongs and, because of this, failed to transform inter-group relations. (shrink)

Abstract“Hypernormal science” has minimal potential for contestation on matters of principle and practice so that information exchange can be unproblematic. Sciences comprise hypernormal domains and more contestable “normal” domains where knowledge diffusion, like acquiring linguistic fluency, depends on face-to-face interaction. Hypernormal domains belonging to molecular biology are contrasted with normal domains in gravitational wave detection physics. Sciences as a whole should not be confused with their typical domains. The analysis has immediate implications for proposed transitions out of the Covid-19 lockdown, (...) proposed solutions to the replication crisis, and, perhaps, our understanding of the early development of social studies of science. Disgust is reasoned to operate in conjunction with the immune system to help protect the body from illness. However, less is known about the factors that impact the degree to which individuals invest in pathogen avoidance (disgust) versus pathogen management (prophylactic immunological activity). Here, we examine the role that one’s control over pathogen contact plays in resolving such investment trade-offs, predicting that (a) those from low control environments will invest less in pathogen-avoidance strategies and (b) investment in each of these (...) two strategies will occur in a compensatory fashion (i.e. they will be traded off with one other). Across four studies, we found support for these predictions, using a variety of manipulations and measures. By providing novel insights into how one’s control over pathogen exposure influences disgust sensitivity and immune system activity, the current research poses an important contribution to the literature on disgust, pathogen avoidance, and the immune system. The aim of this essay is to show that there are no easy options for those who are disturbed by the suggestion that infanticide may on occasion be morally permissible. The belief that infanticide is always wrong is doubtfully compatible with a range of widely shared moral beliefs that underlie various commonly accepted practices. Any set of beliefs about the morality of abortion, infanticide and the killing of animals that is internally consistent and even minimally credible will therefore unavoidably contain (...) some beliefs that are counterintuitive. In this short note we provide proof theories and completeness theorems for these consequence relations which may have some applicability in small examples.

This volume, the first to tackle Heidegger and music, features contributions from philosophers, musicians, educators, and musicologists from many countries throughout the world, utilizes Heidegger’s philosophy to shed light on the place of music in different contexts and fields of practice.

This article addresses the pressing issue of what process courts should use to identify those questions whose resolution lies beyond their appropriate capacity and legitimacy. The search for such a process is a basic constitutional problem that has defied a clear answer for well over a hundred years. The chequered history of earlier attempts illustrates why commentators have once again begun to gravitate towards institutional approaches. The general features of institutional approaches include emphasis on uncertainty, judicial fallibility, systemic impact, collaboration (...) between branches of government and incrementalism in judging. These features, however, are relied upon in support of two conflicting views of the role of judges in public law adjudication. One is restrictive, and advocates sharp limitations to the ambit of judicial review. The other is contextual, and, in stark contrast, it proposes to expand the ambit of review in reliance on the idea of using principles of restraint to structure the exercise of judicial discretion. While this article does not take sides between them, it nonetheless seeks to refine the contextual institutional approach by outlining a general framework for reasoning with principles of restraint, and by addressing some of the key difficulties such a reasoning process would face. More has been written about phenomenology than could possibly be read in a single person’s lifetime, or even in several lifetimes. Despite its unwieldy size, this vast “horizon” of literary output has a tractable structure. We leverage the tools of bibliometrics to study the structure of the phenomenology literature, and test several hypotheses about it. We create an author-wise co-citation network, a graph of nodes and connections, where each node corresponds to an author who has written a document with the (...) word “Phenomenology” in it, and where two nodes are connected if the corresponding authors have cited each other. By applying clustering algorithms and other techniques to this network, certain structural features of the field emerge. The main areas of research since 1970 conform fairly well to an intuitive understanding of the literature, though there are some surprises. (shrink)

In the essay I argue that the routine use of contraception is morally tantamount to early-term abortion because it produces the same result: namely, it prevents the creation of a human life that would have otherwise probably taken place. Because it can be shown that contraception is ethically acceptable, it follows that early-term abortion is as well.

Key Enlightenment minds are often juxtaposed with their iconic foes, religious conservatives. When discussing the subject of women’s rights, however, this comparison creates a false impression that Enlightenment male thinkers held ideas very much opposed to a dogmatic institution such as the Catholic Church. Ironically, and damaging to their legacy of prejudice-free rationalism, nearly all of the philosophes, many of whom were “freethinking” atheists, viewed woman’s intellectual nature and societal purpose through a prejudice-tainted glass, not unlike the most conservative establishments (...) of their time. Indeed, when it came to the perception of women, the philosophes had less in common with a virulently secular feminist such as Nicholas de Caritat, marquis de Condorcet, than they do with modern conservative Christians who believe women should be treated more fairly, but still cling to gender stereotypes. Berkeley, CA: Institute of Buddhist Studies and Numata Center for Buddhist Translation and Research, 2009. 290 pp.Roger Corless (1938–2007)—Catholic devotee, Tibetan Buddhist meditator, Pure Land interpreter, and renowned professor of religious studies—was a frequent contributor to the (...) dialogue between Christians and Buddhists in the West, including through the auspices of the Society for Buddhist-Christian Studies. Although he passed away in 2007, his spirit continues to enrich this historic encounter, including through several major posthumous works. Path of No Path is the first of three such works planned for release by the Institute of Buddhist Studies, a seminary and graduate studies institution associated with Jōdo Shinshū, the largest form of Pure Land Buddhism in Japan. Originally intended as a festschrift, the book unfortunately had to become a memorial volume. In addition to some laudatory material reflecting on Corless’s life, it contains articles by ten scholars focusing on the Pure Land tradition of Buddhism, broken into three categories of practice, transmission, and interpretation. Many contributors, such as Ruben Habito and Al Bloom, will be familiar to readers of Buddhist-Christian Studies.Edited anthologies are always a mixed bag, but happily Path of No Path holds together well and offers many interesting essays for scholars interested in this field, although at times the connection to Corless’s own work seems a bit forced. Alternately, we might view those essays with relatively tenuous connections to Corless’s work as representing the sort of playfulness that Corless famously displayed in his writings and speaking appearances. A good example of this is the first essay, by Harvey [End Page 225] Aronson, on Vajrasattva meditation. Vajrasattva, a major figure in Vajrayāna Buddhism, is not traditionally associated with the Pure Land tradition. Yet Aronson begins by putting a Jōdo Shinshū framework around his subsequent article, which deals with meditative visualizations as healing techniques. Like Corless frequently did, Aronson looks for connections between seemingly disparate cultures and religions. In the process, he offers some insightful comments on how Asian and Western practitioners approach healing within a Buddhist context. For example, he finds that the Westerners are far more heavily psychological in their orientation, and tend to react negatively to situations of obligation and responsibility to others that are comfortable to Asian participants.The second essay’s relationship to Corless is much more organic, as it deals with Chinese Pure Land Buddhism, a subject that he published important works on. This essay, by Charles Orzech, analyzes the Rites for Contemplation of and Offerings to Amitāyus Tathāgata (Wuliangshou rulai guanxing gongyang yigui), an esoteric text based in part on the famous Scripture on Contemplation of the Buddha of Limitless Life (Fo shuo guan wuliangshoufo ling). Orzech skillfully demonstrates how the Rites reframed the Scripture on Contemplation in a tantric context, contributing to the ongoing esotericization of Chinese Buddhism in the Tang period (618–907).James Sanford’s contribution also relates to both tantric and Pure Land forms of Buddhism. Sanford offers a translation of and commentary on the Guide to the Eighty Thousand Dharma Principles (Hōri hachiman chō). This is a short apocryphal text purporting to reveal secret teachings passed on from Jōdo Shinshū founder Shinran (1173–1263) to his grandson Nyoshin. These secret Jōdo Shinshū lineages are an important historical phenomenon that have not been given nearly enough attention, in part because they are actively disapproved of by the orthodox, nonesoteric schools of Jōdo Shinshū (and indeed orthodox Shinshū has at times persecuted these minority traditions). Sanford’s introduction, translation, and commentary therefore provide a major service to scholars of Japanese religion.Gordon Bermant’s entry is short but nonetheless contains some pithy observations on the role of “practice” in American Jōdo Shinshū, a subject that Corless himself wrote about numerous times. In this author-meets-critics dialogue, Sanjay Lal, author of, argues that Gandhian values of nonviolence raise aspirations of liberal democracy to a higher level. Since Gandhian values of nonviolence are closely associated with religious values, liberal democracy should make public commitments to religions on a non-sectarian basis, except for unreasonable religions. Critic Jeff Shawn Jose agrees that Gandhian values can strengthen liberal democracy. However, Jose finds a contradiction in Lal’s proposal that a liberal state should support reasonable religions only. A (...) more consistent Gandhian approach would focus on everyday interactions between citizens and groups rather than state-directed preferences. Critic Douglas Allen also welcomes Lal’s project that brings Gandhian philosophy into relation with liberal democratic theory; however, he argues that universalizing the Absolute Truth of genuine religion is more complicated than Lal acknowledges. D. Allen argues for a Gandhian approach of relative truths, which cannot be evaluated apart from contingency or context, and he offers autobiographical evidence in support of his critical suspicion of genuine religion. Critic Michael Allen argues that Lal’s metaphysical approach to public justification violates a central commitment of political liberalism not to take sides on any metaphysical basis. M. Allen argues that democratic socialism is closer to Gandhi’s approach than is liberalism. Lal responds to critics by arguing that Gandhi’s evaluation of unreasonable religions depends upon an assessment of violence, which is not as problematic as critics charge, either from a Gandhian perspective or a liberal one. Furthermore, by excluding unreasonable or violent religions from state promotion, Lal argues that he is not advocating state suppression. Bruno Latour has had a tremendous impact on the field of science studies. Yet, it is not always easy to say what he stands for. Indeed, Latour has often claimed that his work lacks any overall unity. In this essay, I suggest that at least one concept remains constant throughout Latour’s diverse studies of modern science and technology, namely, mediation. I try to make good this claim by focussing on Latour’s numerous attempts over the years to distance himself from, so (...) as to discredit, the philosopher Martin Heidegger. I argue that Latour’s repeated denunciations of Heidegger amount to a systematic tactic of dissimulation: by suppressing the substance of Heidegger’s critique of modern technoscience, Latour directs attention away from the not insignificant weaknesses in his own theory of mediation. Against the backdrop of an appropriately reconstructed Heidegger, Latour’s self-promotion as a radically progressive non-modern thinker cannot be sustained. (shrink)

Many writers in bioethics, science, and medicine contend that embryo selection is a morally better way of avoiding genetic disorders then gene editing, as the latter has risks that the former does not. We argue that one reason to use gene editing is that in many cases it would be better for the person who would develop from the edited embryo, so that not to have done it would have been worse for that person. By contrast, embryo selection is never (...) better for the person who develops from the selected embryo. This reason to use gene editing has, however, been challenged on two grounds: first, that it makes no difference, morally, whether a bad effect is worse for someone, or a good effect better for someone; and, second, that beneficent gene editing would not be unequivocally better for the person who would develop from the edited embryo. We argue that both of these objections can be satisfactorily answered and thus that there is indeed a significant moral reason, at least in some cases, to use gene editing rather than embryo selection. J. E. Malpas discusses and develops the ideas of Donald Davidson, influential in contemporary thinking on the nature of understanding and meaning, and of truth and knowledge. He provides an account of Davidson's holistic and hermeneutical conception of linguistic interpretation, and, more generally, of the mind. Outlining its Quinean origins and the elements basic to Davidson's Radical Interpretation, J. E. Malpas' book goes on to elaborate this holism and to examine the indeterminacy of interpretation and the principle of charity. The (...) metaphysical and epistemological consequences of Davidson's approach are considered, particularly in relation to scepticism and relativism, the realist/anti-realist debate, and the problem of truth. Parallels are drawn between the Davidsonian emphasis on the centrality of the notion of truth and Heidegger's notion of truth as aletheia, as the book looks to structuralist, hermeneutical and phenomenological sources to illuminate Davidson's position. This groundbreaking inquiry into the centrality of place in Martin Heidegger's thinking offers not only an illuminating reading of Heidegger's thought but a detailed investigation into the way in which the concept of place relates to core philosophical issues. In Heidegger's Topology, Jeff Malpas argues that an engagement with place, explicit in Heidegger's later work, informs Heidegger's thought as a whole. What guides Heidegger's thinking, Malpas writes, is a conception of philosophy's starting point: our finding ourselves already "there," situated (...) in the world, in "place." Heidegger's concepts of being and place, he argues, are inextricably bound together.Malpas follows the development of Heidegger's topology through three stages: the early period of the 1910s and 1920s, through Being and Time, centered on the "meaning of being"; the middle period of the 1930s into the 1940s, centered on the "truth of being"; and the late period from the mid-1940s on, when the "place of being" comes to the fore. The significance of Heidegger as a thinker of place, Malpas claims, lies not only in Heidegger's own investigations but also in the way that spatial and topographic thinking has flowed from Heidegger's work into that of other key thinkers of the past 60 years. This book charges that just about every philosophical theory of mind or language developed over the past 50 years in the West is systematically inaccurate. Systemic oppression has influenced the processes that theories of mind or language purport to identify; however, that same systemic oppression has also made it so that most middle-to-upper class White men (including most philosophers of mind or language) are ignorant of systemic oppression. Consequently, most theories of mind or language are systematically inaccurate because they fail (...) to account for the influences of systemic oppression. Philosopher Jeff Engelhardt argues for the de-idealization of two influential theories in the philosophy of mind and language--social externalism and objective type externalism--and considers some consequences of the de-idealization project. -/- Following the work of Charles Mills, Engelhardt argues that ideal theories adopt oppression-obscuring assumptions while nonideal theories avoid them (or at least try to). Ideal theories assume that language users are basically equal, and that social institutions and structures are basically just, but scholarship on Western social relations, institutions, and structures shows that in fact each of these is systematically influenced by oppression. Consequently, ideal theories tend to be systematically inaccurate. Moreover, since oppression systematically produces ignorance of systemic oppression, such systematically inaccurate theories are likely the norm rather than the exception. -/- Engelhardt shows that once we've shown that oppression systematically influences the processes that determine linguistic meanings (according to content externalism), then we have reason to expand our notion of hermeneutical injustice, we have evidence that hermeneutical injustice occurs systematically, and we have grounds for expanding discussions of conceptual engineering to include questions about engineering the processes that determine concepts, not just concepts themselves.
