The escalation of contemporary distress migration has coincided with an intensification of intolerance, xenophobia and nativism precipitating enormous human suffering among the migrant and refugee community. This chapter examines some instances of the growing exclusionary trend in current refugee and migration policy and explores alternative strategic opportunities to enforce the human rights and humanitarian entitlements for distress migrants established by international norms.

Background: In the context of new reimbursement systems like diagnosis-related groups, moral distress is becoming a growing problem for healthcare providers. Moral distress can trigger emotional and physical reactions in nurses and can cause them to withdraw emotionally from patients or can cause them to change their work place. Objective: The aim of this pilot study was to develop an instrument to measure moral distress among acute care nurses in the German-speaking context, to test its applicability, and to obtain initial (...) indications of the instrument’s validity. Method: The study was designed in 2011 as a cross-sectional pilot survey. Conducted on eight units of one university hospital in German-speaking Switzerland, 294 registered nurses were asked to fill out a web-based questionnaire on moral distress. Ethical considerations: The study proposal was approved by the cantonal ethics committee. All participating nurses provided informed consent and were assured of data confidentiality. Results: The survey had a response rate of 55%. The results show the prevalence of statements on the questionnaire indicating situations with the potential to trigger moral distress. The entire range of answers was used in the responses. Most participants found the questionnaire comprehensible, while some criticized the phraseology of certain statements. Many more found the registration process prior to online access to be too time consuming. Nurses confirmed that the results reflect their subjective assessment of their situation and their experience of moral distress. Conclusion: The newly developed moral distress questionnaire appears to produce face validity and is sufficiently applicable for use in our study. The results indicate that moral distress appears to be a relevant phenomenon also in Swiss hospitals and that nurses were experiencing it prior to the introduction of Swiss diagnosis-related groups. How does microbiota research impact our understanding of biological individuality? We summarize the interdisciplinary summer school on "Microbiota, Symbiosis and Individuality: Conceptual and Philosophical Issues" (July 2019), which was supported by a European Research Council starting grant project "Immunity, DEvelopment, and the Microbiota" (IDEM). The summer school centered around interdisciplinary group work on four facets of microbiota research: holobionts, individuality, causation, and human health. The conceptual discussion of cutting-edge empirical research provided new insights into microbiota and highlights the value of (...) incorporating into meetings experts from other disciplines, such as philosophy and history of science. Theories of consciousness have a long and controversial history. One well-known proposal — integrated information theory — has recently been labeled as ‘pseudoscience’, which has caused a heated open debate. Here we discuss the case and argue that the theory is indeed unscientific because its core claims are untestable even in principle.

Jacqueline Taylor presents an original reconstruction of Hume's social theory, which examines the passions and imagination in relation to institutions such as government and the economy. She goes on to examine Hume's system of ethics, and argues that the principle of humanity is the central concept of Hume's Enlightenment philosophy.

Psychology may have to get seriously political as human aims in living and selfhood itself are increasingly influenced in a deleterious manner by the vicissitudes of living in a neoliberal political economy and one-sided “enterprise culture” (Martin & McLellan, 2013; Sugarman, 2015). This article reviews recent writings of several social critics, including Jackson Lears (2015), Sebastion Junger (2015), Philip Blond (2010), and Christopher Lasch (1995), who richly flesh out the picture of this detrimental state of affairs. We note that many (...) of these critics have little to say about credible alternatives to neoliberalism. The article then seeks to identify resources within theoretical and philosophical psychology, including hermeneutic philosophy and interpretive social science, for helping to overcome neoliberalism. They might help clarify and nurture a renewed democratic populism or engaged democratic politics and contribute to gaining what Lasch termed a much-needed “wisdom of limits” in today’s society. Although canine identification of body odor (BO) has been widely used as forensic evidence, the concept of nosewitness identification by human observers was only recently put to the test. The results indicated that BOs associated with male characters in authentic crime videos could later be identified in BO lineup tests well above chance. To further evaluate nosewitness memory, we assessed the effects of lineup size (Experiment 1) and retention interval (Experiment 2), using a forced-choice memory test. The results showed that (...) nosewitness identification works for all lineup sizes (3, 5, and 8 BOs), but that larger lineups compromise identification performance in similarity to observations from eye- and earwitness studies. Also in line with previous eye- and earwitness studies, but in disagreement with some studies on odor memory, Experiment 2 showed significant forgetting between shorter retention intervals (15 min) and longer retention intervals (1-week) using lineups of five BOs. Altogether this study shows that identification of BO in a forensic setting is possible and has limits and characteristics in line with witness identification through other sensory modalities. BackgroundThe Mental Capacity Act was enacted in 2007 in England and Wales, but the assessment of mental capacity still remains an area of professional concern. Doctors’ compliance with legal and professional standards is inconsistent, but the reasons for poor compliance are not well understood. This preliminary study investigates doctors’ experiences of and attitudes toward mental capacity assessment.MethodsThis is a descriptive, cross-sectional study where a two-domain, study-specific structured questionnaire was developed, piloted and digitally disseminated to doctors at differing career stages employed (...) in a large, multi-site National Health Service Trust in London over 4 months in 2018. Descriptive statistics and frequency tables adjusted for missing data were generated and secondary analysis was conducted.ResultsParticipants were predominantly UK trained, female and between the ages of 30 and 44 years. Less than half of the participants reported receiving formal MCAx training. Only one-third of the participants self-rated themselves as very competent or extremely competent. Self-reported MCA confidence was significantly affected by career stage with Consultants with over 10 years of experience reporting lowest confidence.ConclusionsThis study describes significant variation in practice by doctors and low self-confidence in the practice of MCAx. These results raise concerns that MCAx continues to be inconsistently performed by doctors despite appropriate awareness of the law and professional guidance on best practice. (shrink)

For more than sixty years, surgeons have used bioethical strategies to promote patient self‐determination, many of these now collectively described as “informed consent.” Yet the core framework—understanding, risks, benefits, and alternatives—fails to support patients in deliberation about treatment. We find that surgeons translate this framework into an overly complicated technical explanation of disease and treatment and an overly simplified narrative that surgery will “fix” the problem. They omit critical information about the goals and downsides of surgery and present untenable options (...) as a matter of patient choice. We propose a novel framework called “better conversations.” Herein, surgeons provide context about clinical norms, establish the goals of surgery, and comprehensively delineate the downsides of surgery to generate a deliberative space for patients to consider whether surgery is right for them. This paradigm shift meets the standards for informed consent, supports deliberation, and allows patients to anticipate and prepare for the experience of treatment. (shrink)

This article examines Djanet Sears’ Afrika Solo (1990), the first published play by an African Canadian woman, as an example of African diasporic writing in Canada. Now one of Canada's most celebrated playwrights, and a leading figure in the recent popularity and success of African Canadian theatre in the last decade, Sears began her dramatic exploration of African Canadian identity in her semi-autobiographical play Afrika Solo, first produced in 1987. As I intend to argue, the play's musical score and its (...) use of stage space problematizes the notion of static cultural origins often associated with the Canadian multicultural discourse of hyphenated identities by pointing to the many cross-cultural and transnational sites that shape constructions of African Canadian identity. In so doing, the play develops an innovative diasporic aesthetic that can be placed within a larger cultural tradition of African diasporic representation theorized by Rinaldo Walcott, Paul Gilroy, and Dionne Brand. In this rich and detailed study of early modern women's thought, Jacqueline Broad explores the complexity of women's responses to Cartesian philosophy and its intellectual legacy in England and Europe. She examines the work of thinkers such as Mary Astell, Elisabeth of Bohemia, Margaret Cavendish, Anne Conway and Damaris Masham, who were active participants in the intellectual life of their time and were also the respected colleagues of philosophers such as Descartes, Leibniz and Locke. She also illuminates the continuities (...) between early modern women's thought and the anti-dualism of more recent feminist thinkers. The result is a more gender-balanced account of early modern thought than has hitherto been available. Broad's clear and accessible exploration of this still-unfamiliar area will have a strong appeal to both students and scholars in the history of philosophy, women's studies and the history of ideas. Despite its centrality in the philosophy of cognitive science, there has been little prior philosophical work engaging with the notion of representation in contemporary NLP practice. This paper attempts to fill that lacuna: drawing on ideas from cognitive science, I introduce a framework for evaluating the representational claims made about components of neural NLP models, proposing three criteria with which to evaluate whether a component of a model represents a property and operationalising these criteria using probing classifiers, a popular analysis (...) technique in NLP (and deep learning more broadly). The project of operationalising a philosophically-informed notion of representation should be of interest to both philosophers of science and NLP practitioners. It affords philosophers a novel testing-ground for claims about the nature of representation, and helps NLPers organise the large literature on probing experiments, suggesting novel avenues for empirical research. The work of German theologian Friedrich Schleiermacher has played a key role in the development of Protestant thought. Jacqueline Maria highlights the relation of Schleiermacher's ideas on the moral transformation of the self to other thinkers and current debates in the philosophy of religion.

In a recent letter, Dillion et. al (2023) make various suggestions regarding the idea of artificially intelligent systems, such as large language models, replacing human subjects in empirical moral psychology. We argue that human subjects are in various ways indispensable.

What can contemporary machine learning (ML) models do? Given the proliferation of ML models in society, answering this question matters to a variety of stakeholders, both public and private. The evaluation of models' capabilities is rapidly emerging as a key subfield of modern ML, buoyed by regulatory attention and government grants. Despite this, the notion of an ML model possessing a capability has not been interrogated: what are we saying when we say that a model is able to do something? (...) And what sorts of evidence bear upon this question? -/- In this paper, we aim to answer these questions, using the capabilities of large language models (LLMs) as a running example. Drawing on the large philosophical literature on abilities, we develop an account of ML models' capabilities which can be usefully applied to the nascent science of model evaluation. Our core proposal is a conditional analysis of model abilities (CAMA): crudely, a machine learning model has a capability to X just when it would reliably succeed at doing X if it 'tried'. The main contribution of the paper is making this proposal precise in the context of ML, resulting in an operationalisation of CAMA applicable to LLMs. We then put CAMA to work, showing that it can help make sense of various features of ML model evaluation practice, as well as suggest procedures for performing fair inter-model comparisons. This article deals with one aspect of imparting criminal justice in the context of various objective and subjective determiners. It provides some indication of the breadth, quality, and value of the empirical research work that has been conducted in this area of the law. It considers the pervasive influence of two broad issues—efficiency and security—on decision-making in criminal justice systems across various jurisdictions. It illustrates the contingent nature of the criminal process and discusses the social and political issues, the institutions (...) of the criminal justice system, legal doctrine, policies, and working practices which are the product of complex reflexive relationships. The frame includes the subjective aspects of the decision-maker, his behavioral subjectivity and the prism through which he perceives the matter at hand. This article ends by suggesting a pressing need for empirical research that reveals how policy and practice are influenced by these concepts. (shrink)

In times of crisis, when democracies are under threat, our lessons of justice and equality are best learnt from those who are marginalized or oppressed. There could be hope for democracy if responses to the attacks of September 11, for example, were characterized not by blind revenge but by democratic solidarity. To think of democracy in terms of non-realized ideals does not adequately challenge the failures of its promises. ‘Not to respond’ is often a strategic necessity for democratic discourse, which (...) recognizes failure as part of its evolutionist and utopian narrative. The internal dialectic of the unrealized finds in the negative instance of failure a strange moral coherence. Thus it is proposed to consider democracy as something de-realized rather than unrealized. The term ‘de-realized’ places the democratic experience at a distance, in a context not of its making, in order to de-familiarize it and to block its natural or normative reference. The idea is to see the potential of democracy in translation or in an extraterritorial sense. Democracy’s potential lies not in its failure but in its frailty. (shrink)

Public memory is embedded in an affective matrix of anxiety which is capable of creating the conciliatory conditions of political virtue and of fueling the terror of political passion. The vicious and sudden turn of cosmopolitan (...) memory from reconciliation to revenge is less surprising if anxiety is seen as the translational moment that mediates relations between remembering and forgetting. Anxiety forces the discourse of cosmopolitan memory to confront its own alterity, negotiating a knife-edge balance between sympathy and antipathy. The ethics of cosmopolitanism is an anxious ethics of the past that refuses to die, confronting a future that will not wait to be born. (shrink)

The past decade has witnessed a growing awareness of conceptual and methodological hurdles within psychology and neuroscience that must be addressed for taxonomic and explanatory progress in understanding psychological functions to be possible. In this paper, I evaluate several recent knowledge-building initiatives aimed at overcoming these obstacles. I argue that while each initiative offers important insights about how to facilitate taxonomic and explanatory progress in psychology and neuroscience, only a “coordinated pluralism” that incorporates positive aspects of each initiative will have (...) the potential for success. The field of AI safety seeks to prevent or reduce the harms caused by AI systems. A simple and appealing account of what is distinctive of AI safety as a field holds that this feature is constitutive: a research project falls within the purview of AI safety just in case it aims to prevent or reduce the harms caused by AI systems. Call this appealingly simple account The Safety Conception of AI safety. Despite its simplicity and appeal, we argue that (...) The Safety Conception is in tension with at least two trends in the ways AI safety researchers and organizations think and talk about AI safety: first, a tendency to characterize the goal of AI safety research in terms of catastrophic risks from future systems; second, the increasingly popular idea that AI safety can be thought of as a branch of safety engineering. Adopting the methodology of conceptual engineering, we argue that these trends are unfortunate: when we consider what concept of AI safety it would be best to have, there are compelling reasons to think that The Safety Conception is the answer. Descriptively, The Safety Conception allows us to see how work on topics that have historically been treated as central to the field of AI safety is continuous with work on topics that have historically been treated as more marginal, like bias, misinformation, and privacy. Normatively, taking The Safety Conception seriously means approaching all efforts to prevent or mitigate harms from AI systems based on their merits rather than drawing arbitrary distinctions between them. Feminist care ethicshas for some time guided contemporary artists and curators in their search for sustaining and sustainable practices in the current neoliberal backwash and climate crisis. With a focus on current Australian art in the context of recent care ethics scholarship, this article considers what contemporary art – in its processes as well as aesthetic outcomes – can offer in imagining and practising care for the human and more-than-human world. The article focuses on a series of exhibitions that comprised (...) a key exploratory methodology of The Care Project: Feminism and art in neoliberal times (La Trobe University, 2019–2022). The exhibitions featured the work of regionally based artists. This accent on creative practices emerging from the experience of living in regional communities that are often on the frontline of climate change and social inequality offers unique perspectives on care ethics in practice.
