BackgroundThe Mental Capacity Act was enacted in 2007 in England and Wales, but the assessment of mental capacity still remains an area of professional concern. Doctors’ compliance with legal and professional standards is inconsistent, but the reasons for poor compliance are not well understood. This preliminary study investigates doctors’ experiences of and attitudes toward mental capacity assessment.MethodsThis is a descriptive, cross-sectional study where a two-domain, study-specific structured questionnaire was developed, piloted and digitally disseminated to doctors at differing career stages employed (...) in a large, multi-site National Health Service Trust in London over 4 months in 2018. Descriptive statistics and frequency tables adjusted for missing data were generated and secondary analysis was conducted.ResultsParticipants were predominantly UK trained, female and between the ages of 30 and 44 years. Less than half of the participants reported receiving formal MCAx training. Only one-third of the participants self-rated themselves as very competent or extremely competent. Self-reported MCA confidence was significantly affected by career stage with Consultants with over 10 years of experience reporting lowest confidence.ConclusionsThis study describes significant variation in practice by doctors and low self-confidence in the practice of MCAx. These results raise concerns that MCAx continues to be inconsistently performed by doctors despite appropriate awareness of the law and professional guidance on best practice. (shrink)

Over the last quarter century, the dominant tendency in comparative cognitive psychology has been to emphasize the similarities between human and nonhuman minds and to downplay the differences as (Darwin 1871). In the present target article, we argue that Darwin was mistaken: the profound biological continuity between human and nonhuman animals masks an equally profound discontinuity between human and nonhuman minds. To wit, there is a significant discontinuity in the degree to which human and nonhuman animals are able to approximate (...) the higher-order, systematic, relational capabilities of a physical symbol system (PSS) (Newell 1980). We show that this symbolic-relational discontinuity pervades nearly every domain of cognition and runs much deeper than even the spectacular scaffolding provided by language or culture alone can explain. We propose a representational-level specification as to where human and nonhuman animals' abilities to approximate a PSS are similar and where they differ. We conclude by suggesting that recent symbolic-connectionist models of cognition shed new light on the mechanisms that underlie the gap between human and nonhuman minds. (shrink)

We prove a finite model theorem and infinitary completeness result for the propositional -calculus. The construction establishes a link between finite model theorems for propositional program logics and the theory of well-quasi-orders.

Anti-selection occurs when information asymmetry exists between insurers and applicants. When an applicant knows they are at high risk of loss, but the insurer does not, the applicant may try to use this knowledge differential to secure insurance at a lower premium that does not match risk.

It is shown that over any countable first-order structure, IND programs with dictionaries accept exactly the Π 1 1 relations. This extends a result of Harel and Kozen 118) relating IND and Π 1 1 over countable structures with some coding power, and provides a computational analog of a result of Barwise et al. 108) relating the Π 1 1 relations on a countable structure to a certain family of inductively definable relations on the hereditarily finite sets over that structure.

Did the Carthaginian cavalry general Maharbal really urge Hannibal to march on Rome after Cannae, and then comment bitterly Vincere sets, Hannibal; victoria uti nescis, when his leader refused? There are two main objections: Maharbal may not have been there, and anyway Cannae was too far away to justify such a march. The whole story has been seen as one of those well-known Roman historiographical inventions. Science should tell us what the world is like. However, realist interpretations of physics face many problems, chief among them the pessimistic meta induction. This book seeks to develop a realist position based on process ontology that avoids the traditional problems of realism. Primarily, the core claim is that in order for a scientific model to be minimally empirically adequate, that model must describe real experimental processes and dynamics. Any additional inferences from processes to things, substances or objects are not (...) warranted, and so these inferences are shown to represent the locus of the problems of realism. The book then examines the history of physics to show that the progress of physical research is one of successive eliminations of thing interpretations of models in favor of more explanatory and experimentally verified process interpretations. This culminates in collections of models that cannot coherently allow for thing interpretations, but still successfully describe processes. (shrink)

This paper argues that human beings possess the rational capabilities necessary to achieve the goal of more just and peaceable social orders, but that our educational institutions are failing in their responsibility to do what in fact can be done to produce graduates who make decisions in ways most likely to achieve this goal.Data compiled by us, consistent with other research, indicates that only a small percentage of the individuals graduating from universities and professional schools have developed the capacity for (...) post-conventional moral reasoning. In spite of laws in many states regulating the nutritional content of foods and the availability of “junk food” and soda, a 2001 Surgeon General’s Report indicated that 15% to 20% of the nation’s children are overweight or obese. In areas that are predominately Hispanic and African American, the numbers rise to between 40% and 50%. Although there are continuing efforts to educate the adult population, many school systems and public health jurisdictions have had little impact on the rising numbers (...) of overweight and obese children. This session described the process of initiating a student-based, student driven approach to obesity, junk food, and diabetes and disease prevention.A need existed for a grassroots approach at the student level to raise awareness of increasing obesity rates and diabetes and other related diseases in the adolescent population. We provide an algorithm for determining a categorial grammar from linguistic data that essentially uses unification of type-schemes assigned to atoms. The algorithm presented here extends an earlier one restricted to rigid categorial grammars, introduced in [4] and [5], by admitting non-rigid outputs. The key innovation is the notion of an optimal unifier, a natural generalization of that of a most general unifier.

In our opinion, the discontinuity between extant human and nonhuman minds is much broader and deeper than most researchers admit. We are happy to report that Evans & Levinson's (E&L's) target article strongly corroborates our unpopular hypothesis, and that the comparative evidence, in turn, bolsters E&L's provocative argument. Both a Universal Grammar and the “mental continuity” between human and nonhuman minds turn out to be modern myths.

There is a considerable literature about causation. A great many investigators constantly employ the notion of causation in some form. But with the exception of a very few items, these investigators will find little of use in this literature.

We are in vehement agreement with most of Vaesen's key claims. But Vaesen fails to consider or rebut the possibility that there are deep causal dependencies among the various cognitive traits he identifies as uniquely human. We argue that is one such linchpin trait in the evolution of human tool use, social intelligence, language, and culture.

Many of the haemopoietic cell growth factors have now been purified to homogeneity and their structural genes cloned. Methods are also now available for obtaining pure populations of haemopoietic cells. The use of such cells, in combination with pure growth factors, has provided intriguing information about the biological activities and mode of action of the factors in faciliating survival, proliferation and differentiation of the haemopoietic cells.

In our target article, we argued that there is a profound functional discontinuity between the cognitive abilities of modern humans and those of all other extant species. Unsurprisingly, our hypothesis elicited a wide range of responses from commentators. After responding to the commentaries, we conclude that our hypothesis lies closer to Darwin's views on the matter than to those of many of our contemporaries.

In free and open source software (FOSS), computer code is made freely accessible and can be modified by anyone. It is a creative domain with many unique features; the FOSS mode of creativity has also influenced many aspects of contemporary cultural production. In this article we identify a number of fundamental but unresolved general issues in the study of creativity, then examine the potential for the study of FOSS to inform these topics. Archival studies of the genesis of FOSS projects, (...) coupled with laboratory studies detailing the psychological processes involved in software creation, can provide converging evidence on the nature of creativity in software design. Such a research program has broad implications both for theories of creativity and for real-world innovation in software and other forms of digital cultural production. (shrink)

As a student and collaborator of Louis Agassiz on the study of fishes, F. W. Putnam gave promise of becoming a leading ichthyologist with special interest in taxonomy generally and the Etheostomidae in particular. While he was noted briefly in these fields, contributed a number of minor papers, and aided in the posthumous publications of some of Agassiz's work on fishes, he neither reached his original goal nor completed his major projected works. For in 1874 he switched careers and was (...) appointed Curator of the Peabody Museum of American Archaeology and Ethnology at Harvard University, and is remembered today primarily as a founder of American archaeology rather than as a systematic ichthyologist. A far-reaching account of what is meant by the human spirit, and its relevance to the worldwide efforts being made to meet the challenges that define this historical moment. Notions of identity, grounded in socially constructed conceptualizations of race, gender, class, and nationality continue to pose serious threats to our collective future. At the same time, everything that had once been associated with the human spirit is often understood today only in terms of neurobiology and cognitive science. Yet if the (...) twenty-first century is to be any different from the century just ended, the protection and development of the human spirit will have to emerge as an appropriate focus for judging the moral legitimacy of human acts, social policy, or cultural or religious practices. In a Bahá'í-inspired approach to these issues, the unique perspectives contained in the Bahá'í writings are explored alongside the rich diversity of other philosophical, epistemic, and moral traditions that have contributed to our understanding of the nature and needs of the human spirit over the ages.
