Biobanks are repositories that store human biological materials and their associated data. They are rapidly becoming part of national and international networks and give rise to unique ethico-regulatory issues. Whether consent is informed and whether this term should be used when specimens are collected for biobank research is questionable. Where risks occur, they are usually social and relate to identifiability. Public trust and confidence are important for the success of this type of research. Consensus is growing that governance of biobanks (...) should be harmonised. Controlled specimen and data access agreements are essential. The South African National Health Act and its Regulations, that provide the foundation for the legal framework with regard to human tissue and research in South Africa, are silent on the issue of biobanks and the law lags behind while science and technology advance rapidly. The use of biobank assets will lead to significant benefits in human health and should be encouraged while taking account of the associated ethical, legal and social issues and working towards a balance between these two positions. Rule of law is a concept that is regularly debated by legal philosophers, often in connection to discussion of the concept of law. In this article, the focus is not on the substance of the conceptual claims, but on the methodologies employed by legal philosophers, investigating seminal articles on the rule of law by Joseph Raz and Jeremy Waldron. I argue that their philosophical argumentations often crucially depend on empirical or legal doctrinal arguments. However, these arguments remain underdeveloped. I explore (...) how these arguments could be linked to approaches related to rule of law in different fields of legal scholarship and investigate how the methodologies of these fields may complement each other. Thus, the article aims to provide an argument for a specific form of triangulation of three kinds of approaches to the rule of law: philosophical, social-scientific and legal doctrinal. Modern legal positivism can be criticized for being unduly state-centred, and thus failing to account for the role of law in modern, globalized and fragmented, society. One aspect of that state-centred perspective that has not been addressed adequately, is the role of legal officials. In theories such as that of Jules Coleman or Scott Shapiro, the distinction between officials and ordinary citizens plays a pivotal role: in the rule of recognition that grounds the concept of law, in the conventional character (...) of law and in the guidance function of law. I argue that the role of officials is overstated and the distinction with ordinary people is overdrawn.Resumen:El positivismo jurídico moderno puede ser cuestionado por concentrarse excesivamente en el Estado y, en consecuencia, por su incapacidad para explicar el papel del derecho en una sociedad moderna, fragmentaria y globalizada. Un aspecto que no ha sido abordado adecuadamente por esta perspectiva centralizada en el Estado es el papel de los oficiales del derecho. En teorías como las de Jules Coleman y Scott Shapiro la distinción entre los oficiales y los ciudadanos ordinarios ocupa un papel central: en la regla de reconocimiento que fundamenta el concepto de derecho, en el carácter convencional del derecho y en la función del derecho de guiar la conducta. Narrating the law: Law and literature as a legal philosophical method Literature sometimes makes a surprise appearance in a legal philosophy text. Novels or stories are used to support a philosophical argument, but also to question basic presuppositions of the law. This contribution investigates in what ways literary fiction can be used in legal philosophy. Legal philosophy tends to focus on abstract theories and arguments, while both literature and law are interested in the concrete. Stories, however, have a contextual quality (...) and ambiguity, making them multi-layered, that the more restricted case description lacks. This makes stories valuable within a philosophical inquiry. I distinguish five functions that stories may fulfil in legal philosophy. Some of these are so radical that they may question the project of legal philosophy itself. However, one need not accept that route; it is the plurality of uses that makes stories an interesting addition to traditional forms of legal philosophy. (shrink)

In this paper I critically reflect on the sustainability potential of biomimetic technologies by focusing on writings of the German philosopher Peter Sloterdijk. Although I agree with Sloterdijk that biomimetic technologies – or, as he calls them, ‘homeotechnologies’ – offer specific opportunities for a more peaceful co-existence of humans and nature, I will argue that his reflections are based on a series of problematic assumptions. I will conclude by arguing that the ‘homeotechnological turn’ can be effected only if it is (...) developed within the context of a different ecological ethos from the technocentric ethos that currently dominates our attitude towards nature. This study investigates the underlying mechanisms of how young adolescents process social advertising (i. e., advertising on social networking sites which shows how many and which of the user’s friends have ‘liked’ the brand’s page). Particularly, two experiments examined the role of brand trust in adolescents’ attitude formation and how brand trust is predicted by theories of social proof and persuasion knowledge. In addition, the moderating role of brand familiarity and brand value is investigated. The first experiment (N = 142) (...) showed that higher brand trust was induced for social advertising for unfamiliar but not for familiar brands through the principle of social proof. This means that friends’ likes may reduce uncertainty and increase trust in unfamiliar brands through social advertising, something which enhances brand attitudes. Persuasion knowledge could not explain the effects of social advertising. The second experiment (N = 72) showed that social advertisements are more effective for brands that are symbolic (versus non-symbolic). Managerial and policy implications regarding social advertising targeting adolescents are discussed. (shrink)

Pregnancy has a profound impact on individuals’ lives, yet the subjective experience is often absent from the discourse on reproductive rights and ethics. Although pregnancy is an epistemically transformative experience, phenomenology can help us describe common structures in the many different subjective experiences of pregnancy. Doing so shows us that the effects of pregnancy go beyond the physical symptoms; they invade the experience of the self and the world and transform identity. If someone wants to formulate an argument against abortion, (...) they will have to include the existential impact of pregnancy. In this paper I will further explore the impact of pregnancy through a phenomenological analysis of birth and birthmothers and show that the existential impact of pregnancy does not cease to exist after birth. Giving birth fundamentally changes the world of the pregnant person and leads to irreversible changes in identity. Their world will never return to the way it was before pregnancy. Arguments against abortion would have to take these existential implications into account as well. Finally, I will argue that a similar argument will also become relevant in the discourse on ectogenesis. (shrink)

Body dysmorphic disorder (BDD) poses a significant challenge to an individual’s mental well-being. The obsessive preoccupation with perceived defects in one’s appearance affects individuals’ daily functioning and can result in serious risks, including suicidal ideation and self-surgery. While treatments such as cognitive behavioural therapy and serotonin reuptake inhibitors can provide relief, they do not achieve complete remission. It has been suggested that therapy should not only interrupt the harmful behaviour, but should also address their sense of self, and that after (...) addressing their internalised values, individuals with BDD will be able to incorporate their perceived defect in a manner similar to how individuals with real deformities often do. Phenomenology of psychopathology analyses subjectivity in cases of pathology, and analyses of BDD show that the perceived defect has become a locus of shame. This implies that individuals with BDD have permanently incorporated the gaze of the Other and constantly experience their body as a body-for-others. This paper further explores the sense of self in individuals with BDD through Jenny Slatman’s interpretation of bodily integrity: bodily integrity as a never-ending process of identification. By comparing the experiences of individuals with BDD to those with real deformities and to those who have undergone cosmetic surgery, I will show that re-identification does not occur in individuals with BDD. This suggests that their bodily integrity is fundamentally disturbed and that addressing their internalised values alone will probably not be sufficient for the disorder to go into remission. Every field of science, but especially biology, contains particular conceptions of nature. These conceptions are not merely epistemological or ontological, but also have normative dimensions; they provide an ethos, a framework for moral orientation. These normative dimensions, whilst often remaining ‘hidden’ and inarticulate, influence the way in which biologists practice their profession. In this paper, I explore what happens when different versions of these implicit normative frameworks collide. To do so, I will focus on a case study from the field (...) of ecological genomics as it has evolved in one particular country, namely the Netherlands. During an important inaugural meeting, the director of one of the most sizeable Dutch ecogenomics centres gave a presentation in which he introduced the term ‘nature mining’. Part of the audience immediately embraced the term, but others were very reluctant. This mixed response is generally explained as a culmination of growing tension about the future direction of the field: due to new funding demands, a shift had occurred from fundamental research to research more interested in ‘valorisation’. The emerging field of ecological genomics promises to bring about a marriage between ecological and laboratory-based, genomic investigations. In this paper, I will reflect on this promise by exploring how ecology and genomics are integrated in the two approaches that currently dominate this field: the organism-centred approach, focusing individual organisms, and the metagenomic approach, concentrating on entire microbial communities composed of a variety of species. I will show that both approaches have already taken some important steps in bridging the gap (...) between genomics and ecology. Since the introduction of next-generation sequencing methodology in 2007, the organism-centred approach does not need to stick to classical model organisms like Arabidopsis anymore. Instead, it is now able to apply genomic tools to ecologically interesting species as well. The metagenomic approach has been able to give ecology a more prominent place in its investigations, in another way. Contrary to classical microbiology, it does not study microbial communities under controlled laboratory settings, but under nature's own conditions. However, in the marriage between genomics and ecology, genomics still appears to be the dominant partner, especially in the case of the organism-centred approach that continues to study the new ecological models in artificial lab environments. Moreover, the organism-centred and metagenomic approaches employ a gene-centred perspective in understanding critical ecological interactions, thus strengthening a reductionist rather than a holistic approach. This study examines how mainstream political actors and other organizations use political targeted messages. For this purpose, a data set from ProPublica is used. The study examines 55,918 sponsored Facebook ads that were posted by 236 political actors (i.e., political elites and other organizations) in the United States. (1) Topic classification was used to identify policy issues, (2) network analysis to identify the main policy issues from the various political actors, and (3) Sankey diagrams to visualize microtargeted messages. Our findings (...) indicate that actors focus on traditionally owned issues (i.e., the Democratic Party: environmental policy, social issues, and social welfare; the Republican Party: foreign affairs, law, and government finances). No clear evidence for a focus on wedge issues can be found, however, some first indications (e.g., a focus on reproductive rights, LGBTQ+) are present in a targeted media environment. All in all, the current study helps us to understand in what way political actors deploy targeted messages. (shrink)

Bhikkhu Ñ??ananda’s Concept and Reality has exerted a certain influence on Buddhist Studies, from translations of the P?li Nik?yas to interpretations of doctrine. Far beyond proposing translations for papañca and papañca-saññ?sa?kh?, the book lays out a thesis, supported and illustrated by frequent citations from the Nik?yas, concerning the role of concepts and language itself in perpetuating bondage to sa?s?ra. Concepts and language are said to obscure reality in a self-perpetuating cycle that bars us from liberation. The thesis has intuitive force (...) and profound implications for understanding the P?li sources. However, the presentation is flawed by inconsistencies, lack of clarity, and overly interpretive translations of the P?li — it is not even clear in important details precisely what Ñ??ananda’s intended thesis is. The present offering is an attempt at clarifying this seminal work so as to enable building upon it. The given thesis is elucidated, making its problems explicit, and suggesting resolutions, arriving finally with a proposal of what he may have intended. Along the way, I indicate where given support from the Nik?yas is weak. (shrink)

En sanningsteoretisk antirealist kan inte godta denna möjlighet utan accepterar en eller annan version av Dummetts vetbarhetsprincip: (K) Om ett påstående är sant, så måste det i princip vara möjligt att veta att det är sant. Det kan dock förefalla rimligt, även för en antirealist, att gå̊ med på̊ att det kan finnas sanningar som ingen faktiskt (...) vet (har vetat, eller kommer att veta) är sanna. Man kan därför tänka sig att en antirealist skulle acceptera principen (K) utan att därför gå med på den till synes starkare principen: (SK) Om ett påstående är sant, så måste det faktiskt finnas någon som vet att det är sant. Ett mycket omdiskuterat argument – som ytterst går tillbaka till Alonzo Church, men som först publicerades i en uppsats av Frederic Fitch i Journal of Symbolic Logic 1963 – tycks emellertid visa att principen (K) implicerar principen (SK). Anta nämligen att (K) är sann, medan (SK) inte är det. Men om (SK) är falsk, så finns det ett påstående som är sant men som ingen faktiskt vet är sant. Anta nu att p är ett sådant påstående. Låt Kp betyda att någon vet att p är sant. Det galler alltså̊ att p är sant samtidigt som Kp inte är det. Betrakta nu påståendet (p ∧ −Kp). Enligt antagandet är detta påstående sant. I uppsatsen diskuterar jag några olika sätt att undgå̊ Church-Fitch paradoxala slutsats. Ett tillvägagångssätt är att ersätta kunskapsoperatorn med en hierarki av kunskapspredikat. Ett annat är baserat på distinktionen mellan faktisk och potentiell kunskap och ett förkastande av den vanliga modallogiska formaliseringen av principen (K). Den senare typen av lösning betraktas både från ett realistiskt och ett icke-realistiskt perspektiv. Utifrån denna analys kommer jag fram till slutsatsen att vi, vare sig vi är realister eller antirealister rörande sanning, kan sluta oroa oss för vetbarhetsparadoxen och ändå uppskatta Church-Fitchs argument. Abstract.In recent issues of Zygon, numerous reflections have been published commenting on where the field of science‐and‐religion has been, where it presently stands, and where it should move in the future. These reflections touch on the importance of the dialogue and raise questions as to what audience the dialogue addresses and whom it should address. Some scholars see the dialogue as prospering, while others point out that much work needs to be done to make the dialogue more accessible to a (...) larger audience and more successful at tackling the provocative questions before us. Other academics view the questions themselves as needing further consideration and focus before answers to them can even be explored. In this article I provide a general overview of these essays by outlining some general categories of thought that seem to emerge from the contributors. I then present some of my own opinions concerning the future of the science‐religion field and emphasize that the dialogue, in addition to its traditional roles, must further the philosophical framework that can aid humanity in resolving the most pressing global concerns of our time. I discuss the behavior of the Akaike Information Criterion in the limit when the sample size grows. I show the falsity of the claim made recently by Stanley Mulaik in Philosophy of Science that AIC would not distinguish between saturated and other correct factor analytic models in this limit. I explain the meaning and demonstrate the validity of the familiar, more moderate criticism that AIC is not a consistent estimator of the number of parameters of the smallest correct model.
