This commentary contributes to philosophical reflection on the growing challenge of digital distraction and the value of attention in the digital age. It clarifies the nature of the problem in conceptual and historical terms; analyzes “freedom of attention” as an organizing ideal for moral and political theorizing; considers some constraints of political morality on coercive state action to bolster users’ attentional resources; comments on corporate moral responsibility; and touches on some reform ideas. In particular, the commentary develops a response to (...) an anti-paternalistic line of argument rooted in Mill’s Harm Principle that would oppose state regulation on the grounds that securing attentional capacities is a matter of personal responsibility alone. Thomas Hobbes assigned indispensable, peace-directed roles to conscience in his moral and political philosophy. This paper first locates Hobbes's definition of conscience in its historical context by highlighting commonalities with scholastic and seventeenth-century doctrines. Second, it shows that Hobbes imposed numerous stringent obligations on conscience in the natural condition. Third, it analyses Hobbes's account of conscience as 'shared knowledge' in Chapter 7 of Leviathan and considers the possible targets for his polemics. Finally, it lays out the chief responsibilities of conscience (...) in society, clarifies the relationship between 'private' and 'public' conscience, and identifies major tensions in Hobbes's theory. To enhance the plausibility of naturalistic moral realism, David Copp develops an argument from epistemic defeaters aiming to show that strongly a priori synthetic moral truths do not exist. In making a case for the non-naturalistic position, I locate Copp’s account within the wider literature on peer disagreement; I identify key points of divergence between Copp’s doctrine and conciliatorist doctrines; I introduce the notion of ‘minimal moral competence’; I contend that some plausible benchmarks for minimal moral competence are grounded in (...) substantive moral considerations; and I discuss two forms of spinelessness that Copp’s moral naturalism could result in. Privacy rights can surely be waived. But can they also be forfeited? If so, why and under what conditions? This article takes up these questions by developing a novel theory of privacy rights forfeiture that draws inspiration from Judith Thomson’s canonical work on privacy. The paper identifies two species of forfeiture rooted in modes of negligent and reckless conduct and argues that both self-directed and other-regarding considerations play a role in grounding forfeiture. The paper also contributes to the literature by (...) proposing a new taxonomy of how Hohfeldian entitlements can be divested generally. It likewise engages at length with a recent article by Benedict Rumbold and James Wilson in which the authors criticize Thomson’s work and appear to reject the very idea of privacy forfeiture. In response, I make the case that Rumbold and Wilson’s forfeiture-free model of privacy is unconvincing on substantive moral grounds. (shrink)

It is a reflective mirror of the society in which it grew, so that the story is considered Folklore is one of the genres of popular literature that is beloved by adults and children, due to the elements it contains that attract, excite, and enrich the imagination, in addition to the positive values it contains. It is the ancient, common art of spontaneous speech, passed down from generation to generation, linked to customs and traditions. The story is the backbone of popular heritage, and it is what we metaphorically call popular literature. This research focuses on a profession, that of pedagogical consultant (PC) in mathematics, which has been little explored. Interviews were conducted with eight PCs in mathematics at the elementary school level, based on two professional situations related to problem solving and professional development of teachers. An emerging analysis brought to light, within their professional practice, common elements, characterizing what we can call “a PC’s professional genre”. This article is an attempt to explore and explain the complex processes and mechanisms involved in creating myth signs as presented in Roland Barthes’ Mythologies (1957) through an interdisciplinary and an interdiscursive approach. The article presupposes that the mythic system of signification occupies a liminal space of a multiplicity of disciplines and discourses. The mythic sign integrates a myriad of epistemological spaces philosophical, scientific, and cultural. Therefore, this article wants to cross the borderlines between fields of knowledge to understand the (...) unique position of the mythic sign. We are going to use scientific discourse of virology to investigate the parasitic and viral nature of the mythic sign. Moreover, we investigate the role of the mythologist in exploring the signs that are infected by ideology and how to demystify their intentionality and artificiality. Finally, we are going to rely on quantum physics to investigate the superposition of the mythologist and the role this position plays in understanding the ambiguous and multidimensional nature of the mythic sign. Older adults with age-related hearing loss often use hearing aids to compensate. However, certain challenges in speech perception, especially in noise still exist, despite today’s HA technology. The current study presents an evaluation of a home-based auditory exercises program that can be used during the adaptation process for HA use. The home-based program was developed at a time when telemedicine became prominent in part due to the COVID-19 pandemic. The study included 53 older adults with age-related symmetrical sensorineural hearing loss. (...) They were divided into three groups depending on their experience using HAs. Group 1: Experienced users. Group 2: New users. Group 3: Non-users. These three groups underwent auditory exercises for 3 weeks. The auditory tasks included auditory detection, auditory discrimination, and auditory identification, as well as comprehension with basic and more complex stimuli, presented in quiet and in noisy listening conditions. All participants completed self-assessment questionnaires before and after the auditory exercises program and underwent a cognitive test at the end. Self-assessed improvements in hearing ability were observed across the HA users groups, with significant changes described by new users. Overall, speech perception in noise was poorer than in quiet. Speech perception accuracy was poorer in the non-users group compared to the users in all tasks. In sessions where stimuli were presented in quiet, similar performance was observed among new and experienced uses. New users performed significantly better than non-users in all speech in noise tasks; however, compared to the experienced users, performance differences depended on task difficulty. The findings indicate that HA users, even new users, had better perceptual performance than their peers who did not receive hearing aids. (shrink)

Gerontologists have proposed different concepts for ageing well such as ‘successful ageing’, ‘active ageing’, and ‘healthy ageing’. These conceptions are primarily focused on maintaining health and preventing disease. But they also raise the questions: what is a good life in old age and how can it be achieved? While medical in origin, these concepts and strategies for ageing well also contain ethical advice for individuals and societies on how to act regarding ageing and old age. This connection between gerontology and (...) ethics is overlooked by both schools of thought. We thus develop this research programme for a systematic geroethics in four steps. First, we analyze ‘successful ageing’ as put forward by Rowe and Kahn as a paradigmatic example of a gerontological conception of ageing well. Then, in a second step, we move from criticisms within gerontology to an ethical perspective; in particular, we want to clarify the problem of the claim of universal validity of conceptions of the good life. In a third constructive step, we explain how the ‘capabilities approach’ could be applied in this context as a normative foundation for the implicit normative assumptions of gerontological conceptions of ageing well, such as a particular choice of functionings, the ethical relevance of human agency, and the resulting claims of individuals towards society. Finally, using a concept developed by the German philosopher Ursula Wolf, we systematically develop the different aspects of the connection between ageing well and the theory of the good life in their full complexity and show their interconnectedness. The stability of low student math scores has been a concern of education systems around the world for many years. While teaching practices are pointed out as a determining factor in student engagement and the quality of student learning, they are only the tip of the iceberg. Much work has shown that these practices are strongly colored by epistemological beliefs as well as by beliefs related to the teaching and learning of the school discipline under investigation. On this subject, if (...) some research reports a peremptory influence of beliefs on teaching practices, others present more moderate results by underlining, for example, the permeability of beliefs in pre-service training. Based on the results of a quantitative study that identified three belief profiles (pro-traditional, anti-traditionnal, flexible) among 190 future secondary school mathematics teachers in their final year of training, this contribution aims to shed qualitative light on the articulation between beliefs and teaching practices of eleven of them. The analysis of the semi-directive interviews highlights the reconcilable nature of transmissive and constructivist conceptions of teaching-learning. Moreover, the presence of similar pedagogical practices, supported in training, within profiles with contrasting beliefs argues in favor of a belief-practice non-linearity. (shrink)

Among various changing views on sex and gender, transsexualism, theoretically as well as clinically, raises a paradoxical issue: transsexual subjects seem to confirm something that they simultaneously disclaim or, at least, destabilize with their transition. These days psychoanalysis remains rather critical towards transsexualism. Jacques Lacan has developed several theories on sex and gender, reworking them during the course of his lifetime. That is why his work includes possibilities of understanding transsexual phenomena at the level of singular solutions that he himself, (...) especially with respect to some of his earlier cases, has not been able to formulate. This paper focuses on innovation in the context of business–non-governmental organization (NGO) partnerships for corporate social responsibility (CSR). While different aspects of business–NGO partnerships have been studied, the role of innovation and its potential implications for partnership outcomes have so far not been systematically explored. The paper defines innovation in simple and concrete terms and synthesizes from the literature what can be considered as critical ingredients to foster social alliance innovation. The paper posits in turn that these ingredients correspond closely (...) to the conception of social capital and offers a consolidated framework that helps in probing around these ingredients and social capital in accounting for innovative partnership outcomes. The empirical part consists of a comparative analysis of six case studies of business–NGO collaboration in the context of CSR in the United Kingdom. The evidence presented makes it clear that strategic partnerships are more readily capable of innovation and that social capital as an umbrella concept is very promising in explaining the differential success and performance of social alliances and central to understanding the dynamics of social alliance innovation and value creation. Against the troubling concern that the "novelty" and "impact" of techno-solutions have lost all meaning, the Solar Media Collective asks who or what dictates the scales at which change is made visible, meaningful, useful, and sustainable. In other words, we ask: where should we look for the hopeful gestures that define our future worlds, and how can we resourcefully resist and model alternative pathways to Big Tech's ever-grander "solutions" to the climate crisis? 1On May 11, 2023, the Solar Media Collective—a student-run research-creation group affiliated with Concordia University in Tio'tia:ke (Montréal)—ran a day-long symposium on the multiscalar dimensions of just and hopeful energy transitions. 2Taking inspiration from the transnational Solar Protocol network's exploration into the techniques and affordances of solar-powered computer networking, we asked how, when, and where social, political, [End Page 304]technical, and cultural protocols surrounding renewable energy and the production and disposal of digital technologies can be developed to encourage diverse designs and scales of deployment for sustainable innovations and practices. By exploring these themes through a series of roundtable discussions with invited guests, we attempted to imbue the word "sustainability" with new meaning and reclaim it from corporate optimization rhetoric.Situated Solar Relations: Rethinking Scale for the Renewable Energy Agechallenged the sitelessness of large-scale initiatives by asking what might happen if situatedsolar relations were to become the primary protagonist of research, production, and outreach. Across three roundtables, an interactive workshop, and a showcase of some of our functional prototypes, the symposium addressed creative practices as a mode of future building. Roundtable discussions approached the question of how to build a just solar future through multiple angles: art, literature, and aesthetics; ludic interactions; and social, political, and economic transformations. Rather than taking for granted the principle of "scaling up" that requires sustainability to be replicable and expandable into universal and precise sets of standardized models, we argue instead for the necessity of having (non)scalable, situated, and evolving relationships with the sun. 3In other words, we turn to process rather than product, hope rather than despair, and careful research rather than extractive data practices.Relations of scale are at the heart of these dichotomies. Max Liboiron and Josh Lepawsky have recently argued that power lies in the way things appear to be "true, natural and good," which is determined and reproduced on a homogeneous scale by specific interest groups. 4Intervening against extractive, energy-intensive, and polluting practices therefore requires multiple contextualized and situated knowledges of the processes at play, which in turn requires an understanding of the scales within which energy and waste-defining relationships occur. 5They write:Problems arise when one situated way of knowing disavows its context, becomes dominant to the exclusion of other ways of knowing, or thinks it accounts for all forms of discards. The effect of such monolithic approaches to knowledge can be termed "scalar mismatch," where one instance is taken to be the whole phenomenon, or where one perspective is assumed to work in all cases. 6Scale here is about the specific processes and relationships that matter in a given context. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

University students from Bulgaria, Estonia, Finland, and Portugal were given a list of morally relevant behaviors, the Schwartz Value Survey and Tangney’s TOSCA, measuring empathic guilt, guilt over norm-breaking, and shame. A factor analysis of MRB yielded 4 dimensions: prosocial behaviors, interpersonal transgressions, antisocial behaviors and secret transgressions. Prosocial behaviors were predicted by self-transcendence–self-enhancement value contrast only while the three transgression categories were associated with both SET and openness to change–conservation contrast. Norm-breaking guilt was more strongly associated with behaviors than (...) were empathic guilt and shame. However, shame was associated with secret transgressions in three countries, after controlling for values. The associations were strongest in Bulgaria and Estonia while fewer associations were found in Finland and Portugal. The implications of the findings for the cross-cultural psychology of morality are discussed. (shrink)

This participatory study, conducted in an introductory psychology class, recounts self-reflections of 22 undergraduate students and their instructor engaging in an GenAI-mediated storyboard generation process. It relies on Gordon Pask’s conversation theory, structuring out the nature of interactions between students, instructor, and GenAI, and then uses a qualitative narrative to describe these conversational feedback loops constituting the creation of draft and final storyboards. Results suggest students engaged in cyclical feedback driven processes to master their creations, used elements of photography related (...) to the relationships between objects in frame, image processing, and cultural objects/themes to generate narratives. Issues were faced with generating text on images, and the consistency and style of generated frames as they interacted with GenAI tools. This study provides guidelines to university teaching professionals to design effective activities mediated by text-to-image GenAI. (shrink)

This participatory study recounts conversational practices occurring between three teachers, a head of school, and a researcher during a month-long curriculum design workshop mediated by the MagicSchool AI technology to create social studies, language arts, science, and mathematics lessons for a virtual special education program. A social paradigm of AI-mediated educational practices is presented, wherein teachers interact with AI tools by embodying co-agency and a spirit of inquiry. Collective practices are interpreted using Gordon Pask’s conversation theory framework, showcasing how to (...) design systems of human-AI feedback loops devoted towards curriculum design. Meeting transcriptions, AI-prompt data, AI-mediated lesson plans, teacher feedback, and final products are shared using narrative inquiry to illustrate how collaborative co-agency culminated in lesson plans that co-observers felt confident in deploying. This mixed methods case study employed Vygotsky’s theory to show how peer and teacher contingent support created individualized zones of proximal development for three students with learning differences in a high school makerspace class at a special education institution. Our results expand extant literature by highlighting the intra- and interpsychological potential of makerspace curricula, specifically for students with learning differences. We employ mixed methods analyses of self-reported responses related to emergent problem navigation, a narrative of class fieldnotes, and visuals of (...) whole class projects to describe full class and individual project-based learning activities. Aggregated results from three students showcase stability in design thinking perceptions through the course of weekly whole class design challenges involving TinkerCAD, Homestyler, and material fabrication techniques. A single student example articulates how similar self-reported perceptions were observed in the non-linear development of an individual project for an end-semester Arts Festival. (shrink)

The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. O hâlde Tanrı’yı bilmeyi terk etme kötülüğünden sakınmak, Tanrı’yı bilmekle mümkün olacağı için Tanrı’yı bilmek gereklidir. Tanrı’yı bilmek akıl yürütmeyle gerçekleştiği için de akıl yürütme, Tanrı’nın bilinmesi gereken ilk şey oluşundan bir pay alarak ilk konuma yükselmektedir. Kādî Abdülcebbâr son olarak Tanrı’nın nasıl bilineceği ya da Tanrı’ya ilişkin bilginin hangi bilgi türüne dahil edileceği meselesinin kelâmcılar arasında tartışmalı bir konu olduğunu ve Tanrı’nın teklif devam ederken bu dünyada zarurî olarak bilinmeyeceğini ifade eder. Ancak bu hususta Muʿtezile içerisinden biri Câhız ve Ali el-Esvârî gibi ashâbü’l-maârifin, diğeri Ebü’l-Kāsım el-Belhî el-Kaʿbî’nin muhalefetine yer vererek her iki yaklaşımı sırasıyla hem Tanrı’ya ilişkin bilginin neden zorunlu olamayacağını hem de Tanrı’nın ahirette neden istidlâlî olarak bilinmeyeceğini göstererek yanıtlar. Understanding the developments in the early period when Ṣūfism became widespread in the Islamic society, both necessitates studies on other disciplines from Ṣūfism, and also requires the consideration of Ṣūfism from the perspective of other religious sciences. In this regard, one of the important names is the famous Ḥanbalī scholar Abū Yaʿlā al-Farrā. Abū Yaʿlā al-Farrā who was interested in ḥadīth, Islamic law and tafsīr as well as Ṣūfism and theological issues, has an important place especially with his works in (...) the Ḥanbalī tradition. Abū Yaʿlā, who grew up in a period when the Sunnī theology schools were formed, spread and exercised its influence, he maintained the Ḥanbalī viewpoint and criticized both some schools of kalām and the Ṣūfis by using the kalām method. Therefore, analyzing his views is important for understanding the formative conditions of the first period of religious science tradition, as well as giving clues about the relationship between Ṣūfism and Ḥanbalī tradition. In this article, his views of zuhd, tawakkul and Ṣūfism in general is examined in the context of his works Kitāb al-Muʿtamad fī uṣūl al-dīn and Kitāb al-tawakkul, and his importance in understanding the relationship between Ṣūfism and Ḥanbalī tradition is emphasized. Tanrı’nın varlığı kanıtlama (isbât-ı vâcib) kelâm ilminin diğer tüm meselelerin kendisine dayandığı en başta gelen gayesidir. Kelâmcıların özelliği inşa ettikleri bir bilgi teorisi ekseninde bunu ortaya koymaya çalışmalarıdır. Kelâmda mevcut, ma’dum, kadîm, muhdes, cevher, araz gibi ontolojik kavramların daha genelde bilinenler (malumat) kümesinin unsurları olmasından da anlaşılacağı üzere kelamcılar Tanrı’nın varlığı konusunu bilgiye konu olmak bakımından ele almaktadırlar. Bu durum kelâmcılara göre Allah’ın varlığının bilgisine (marifetgullah) ulaşmanın bir epistemoloji meselesi olduğunu ortaya koyar. Bu makalede Mu’tezile kelamında önemli bir yeri olan (...) Kādî Abdülcebbâr’ın (ö. 415/1025) Tanrı’nın varlığını benimsediği bilgi teorisi ekseninde nasıl ispat etmeye çalıştığı ortaya konulacaktır. Whence does international law derive its normative force as law in a world that remains, in many respects, one where legitimate politics is practiced primarily at the national level? As with domestically focused legal theories, one standard answer is positivistic: the law's authority is based on its origin in agreed procedures of consent. This is certainly plausible with respect to treaty obligations and commitments that derive from the United Nations Charter, but it leaves customary international law vulnerable to legitimacy critiques—of (...) which there is no shortage among international law skeptics. Even with respect to conventional international norms, such as treaty provisions, there is often a sense that such consent is democratically thinner than the public consent to domestic law, particularly fundamental domestic law, constitutional norms, and derivative principles of legitimate governance. State consent in international law, in this view, is often a very imperfect proxy for democratic consent to international legal norms. While it is obvious to international lawyers why (as a matter of positive law doctrine) state consent should make international norms prevail over domestic norms to which there is arguably deeper democratic consent, persistent critics of international law have questioned whether this should be so as a matter of legitimacy. Buna karşılık usûlî düşüncenin ilk mümessili sayılan Şeyh Müfîd’den itibaren mezhep içinden yükselen sesler bu iddiaları şiddetle reddetmişlerdir. Biz bu çalışmada Mu’tezile kelamına sistematik hüviyet kazandıran ve yazdığı eserlerle Mu’tezile kelamının bugüne ulaşmasında büyük pay sahibi olan Kâdî Abdülcebbâr ile İmamiyye’nin kelam düşüncesinin istikrar bulmasında ve Şeyh Müfîd’le başlatılan usûlî yaklaşımın benimsenip yaygınlaşmasında büyük bir yeri olan Ebû Ca’fer et-Tûsî arasında adalet ilkesi üzerinden bir karşılaştırma yaparak, söz (...) konusu iddiaların ne kadar sübut bulduğunu tespit etmeye çalıştık. Abstract The claim that the Shi’i Imamite thought is heavily influenced by the Mu’tazilite outlook has been alleged since the fouth century of hijra. However, beginning with Shaikh Mufid, the first representative of the Usuli branch of Shi’a, the Shi’is vehemently denied this allegation. In this article, this issue is dealt with by making a comparison between the idea of Qadi Abd al-Jabbar, the prominent Mu’tazilite scholar who made a major contribution to the consolidation of the schools’ theaching and that of al-Tusi, who also made a contrubitued to the integration of the Shi’ite kalam and the spreading of the usuli approach initiated by Shaikh Mufid. Leaving aside the differences in deatil, it seems that there is no noteworthy difference between their approcah to the issue of justice. Al-Qāḍī Ḥusayn al-Marwarrūdhī is one of the important representatives of Khurāsān Shāfi‘ī School. Al-Ta‘līḳa is his famous work, which is one of the first commentaries of al-Muzanī’s Mukḫtaṣar. One of the important features of this work is the introduction to some of the subjects of ijtihād (process of juristic legal reasoning), taqlīd (acting upon the word of another without asking for specific proof), ijmā‘ (consensus of jurists) and view’s of the companions of the Prophet. The first systematic, complete and detailed (...) works of uṣūl al-fiqh (Islamic legal theory) that belonged to the Khurāsān Shāfi‘ī School have reached to the present day belong to the second half of the V./XI. century. Making research on the studies which were done about uṣūl al-fiqh and formed the basis of this period is essential to follow the development of uṣūl al-fiqh of the Khurāsān Shāfi‘ī School. Transfer of the uṣūl al-fiqh in al-Qāḍī Ḥusayn al-Marwarrūdhī’s al-Ta‘līḳa make it possible to determine the literatüre, which was formed in Khurāsān region in the period from the death of Shāfi‘ī to the first half of the V./XI. century until the first half of the Khurāsān region, which allows the determination of the uṣūl al-fiqh. In this study, on the basis of ijmā‘, al-Qāḍî Ḥusayn al-Marwarrūdhī’s method in al-Ta‘līḳa will be examined.Summary: Al-Qāḍī Ḥusayn al-Marwarrūdhī is considered to be one of the most important representatives of the Khurāsān Shāfi‘ī School. In addition to receiving fiqh education from al-Qaffāl al-Marwazī, who is accepted as the founder of the Khurāsān Shāfi‘ī School in Shāfiʿī fiqh circles. Al-Qāḍī Ḥusayn, one of the most distinguished students of al-Qaffāl al-Marwazī, has become one of the important bearers of the fiqh heritage of Khurāsān Shāfi‘ī School. The fact that the epithet “el-kāḍî” is used in the works of Khurāsān Shāfi‘ī School to absolutely refer to al-Qāḍî Ḥusayn, is another issue that shows his being authority on fiqh. Al-Qāḍī Ḥusayn al-Marwarrūdhī has accomplished many works in the field of fiqh. The most famous and most important work of al-Qāḍī Ḥusayn is the al-Ta‘lîḳa, written according to the Mukḫtaṣar arrangement style of al-Muzanī. He is often cited as the author of the well-known work al-Ta‘lîḳa in the sect. Al-Ta‘lîḳa, commonly cited in fiqh studies to refer to the views of al-Qāḍī Ḥusayn, is one of the first commentary on Mukḫtaṣar by Muzanī. With these characteristics, al-Ta‘lîḳa is one of the outstanding manuscripts for exploring the fiqh legacy of the Khurāsān Shāfi‘ī School. Another important feature of this text is that uṣūl al-fiqh issues such as ijtihād, taqlīd, ijmā‘ and view’s of the companions of the Prophet (qawl al-ṣaḥābah) have been covered in the introduction of the work. Al-Qāḍī Ḥusayn discusses the issues of evidentiality and types of ijmā‘ and ijmā‘ of ṣaḥābah in the chapter on ijmā‘ in al-Ta‘lîḳa. Al-Qāḍī Ḥusayn also handles the debates on view’s of the companions of the Prophet in the section on ijmā‘ of ṣaḥābah. It is also seen that the proofs proposed for evidentiality of ijmā since Shāfiʿī’s period became more versatile and differed. The fact that the arguments al-Qāḍī Ḥusayn cites in the chapter of the evidences of ijmā‘ were also mentioned by his contemporary, al-Māwardī, an Iraqi Shāfiʿī jurist, points out the accumulation of knowledge in terms of proofs of ijmā. Al-Qāḍī Ḥusayn makes two related distinctions that are fundamentally related to the types of ijmā. The first is the division between ijmā supporters, those who argue for knowability of ijmā, and their opponents. According to this, ijmā is divided into two parts as ‘āmm (general public) ijmā‘ and khāṣṣ (scholars) ijmā‘. Opposition to ‘āmm ijmā‘, such as fardhs (obligations) in prayer, rawātib sunnah (the practice that the Prophet regularly performed) and feast prayer requires kufr (blasphemy). Al-Qāḍî Ḥusayn, who considers issues such as ‘awl (a sharing method in Islamic inheritance law), mut‘a marriage (a type of temporary marriage) and riba’l-faḍl (interest in exchange or sale transactions) which are seen as controversial ijmā‘ issues in literature, as khāṣṣ ijmā‘ and evaluates opposition to this type of ijmā‘ as fisq (impiety). The second division al-Qāḍī Ḥusayn makes is between ijmā‘ based on the text and apparent comparison, and the ijmā‘ based on hidden comparison. Al-Qāḍī Ḥusayn thinks that the opposition to ijmā‘ that is based on ijtihād or the text in terms of sanad (chain of narrators), requires blasphemy. In a sense, this is to accept ijmā‘ as a provision on an equal basis and to reduce the distinctions of ijmā‘ to literary level. Al-Qāḍī Ḥusayn also discusses evidentiality of qawl al-ṣaḥābah in connection with the issues of ijmā‘. Al-Qāḍī Ḥusayn opposes the thesis that ijmā‘ is only limited to companions’ era and argues that it can be realized in any century after the Prophet. Al-Qāḍī Ḥusayn, who discusses ṣaḥābah’s ijmā‘ under two categories: the views of ṣaḥābah that have gained prevalence among other ṣaḥābahs and those that have not gained prevalence among other companions, argues for evidentiality of qawl al-ṣaḥābah, which have gained prevalence and known not to be opposed. He provides significant information on ijmā‘ discussion in Shāfi‘ī fiqh methods with regard to the evidentiality of this type of qawl al-ṣaḥābah, which is referred ijmā‘ al-suqūtī (consensus based on lack of opposition-silence). The knowledge al-Qāḍī Ḥusayn cites with regard to the evidentiality of qawl al-ṣaḥābah which have not gained prevalence among other ṣaḥābahs differs from Māwardī, one of his contemporary, and his predecessors. The fact that he cites Shāfi‘ī’s previous and latest views with regard to the state of such qawl al-ṣaḥābah in the face of qiyās (legal analogy) enables him to make comparison using uṣūl material available in his era. Al-Qāḍī Ḥusayn, who mentions debatable issues among ṣaḥābah, makes controversial narrations. While al-Qāḍī Ḥusayn reports that there is not any conflict on the argument that it is legitimate to express a third view with regard to issues on which ṣaḥābah is divided in two groups and fall into conflict, his contemporary al-Māwardī and other Shāfi‘ī jurists report that it is not legitimate to propose a third view on such an issue as there is ijmā‘ on these issues. Therefore, the source of all information that is not based on observation and mutawatir khabars. The part that expresses certain information in the news is mutawatir.One of the scholars who discussed the details of the news in the Hijri 4th century and took a detailed view of it in his works is Qādi Abd al-Jabbar (415/1025). He has opened independent titles in his works on the value of news and knowledge of the news, and has based his views on this subject in various ways, using the methods of Islam as the basic sources of Islam, using the methods of intelligence and transportation against the Sumenians who do not accept the news as a source of information and Berahime who do not accept the prophethood of the prophethood. He was the advocate of ân, Sunnah and icma.In this study, the modest theory of Qādi Abd al-Jabbar is emphasized. His views were based on his work, al-Mughni, which had an encyclopedic identity. Qâdi, tried to put the modest news on a rational basis both in order to combat those who do not see the news as a source of information and to base the basic sources of Islam. Genel olarak İslam düşüncesini özel olarak da fıkıh düşüncesini derinden etkileyen isimlerden biri de hiç şüphesiz Kâdî Abdülcebbâr’dır (öl. 415/1025). Hayatının çoğu hicrî 4./11. yüzyılda geçen ve Basra Mu’tezilesi’nin Cübbâî’lerden sonra en önemli temsilcisi olan Abdülcebbâr, hem kelam hem de fıkıh usûlü alanındaki eserleriyle sadece Mu’tezilî çevrelerde değil Sünnî muhitlerde de çığır açıcı bir âlim olarak görülmüştür. Birçok Sünnî usûlcünün ortak kanaatine göre İmam Şâfiî’den sonra fıkıh usulü alanındaki en önemli isimlerden biri Abdülcebbâr’dır. Teoloji ve metodoloji alanlarında bu denli etkili (...) olan Kâdî Abdülcebbâr’ın amelî hayatını hangi sistematik çerçevede sürdürdüğü ve öğrenciliği sırasında benimsemiş olduğu Şâfiî mezhebine bağlılığını devam ettirip ettirmediği merak konusu olmuştur. İlgili literatürde Kâdî Abdülcebbâr’ın hayatı boyunca Şâfiî mezhebini benimsediği iddiası çokça dillendirilmiştir. Öyle ki Şâfiî fakihlerin tanıtıldığı tabakât eserlerinde Abdülcebbâr’a bir Şâfiî olarak yer verilmiştir. Günümüze kadar devam eden bu anlayış akademik çalışmalarda da devam eden bir kabul halini almıştır. Acaba gerçek böyle midir? Bu sorunun peşine düşen elinizdeki araştırma, şu adımlarla konuyu incelemiştir: Önce Kâdî Abdülcebbâr’ın fıkıhta takip ettiği yol ile ilgili olarak literatürde zikredilen iddialar sergilenmiş, ardından Abdülcebbâr’ın Mu‘tezile usûlündeki konumu ortaya konmuştur. Mu’tezilî bir âlimin benimsediği iddia edilen mezhebin kurucu imamının yani Şâfiî’nin (öl. 204/820) Mu‘tezile’ye olan mesafesi ve hatta onunla mücadelesine değinildikten sonra Kâdî Abdülcebbâr’ın İmam Şâfiî’nin meşhur usûl görüşlerine muhalif tavırları tespit edilmiştir. Abdülcebbâr’ın usûl görüşlerini İmam Şâfiî’nin usûl görüşleriyle mukayese ederek ilerleyen işbu araştırma, onun amelî sahada Şâfiî mezhebini benimsemiş olduğu iddiasının çok isabetli olmadığı sonucuna ulaşmıştır. Mukayeseyi, Şâfiî usûl düşüncesinin en ayırt edici 6 (altı) meselesi üzerinden yürüten araştırma Abdülcebbâr’ın İmam Şâfiî’ye ve Şâfiî usûlcülere açıkça muhalefet ettiğini göstermektedir. İslam hukuk metodolojisinin en önemli tartışma konuları arasında yer alan bu altı mesele şunlardır: Kur’ân ve Sünnet’in birbirilerini nesh edip edemeyeceği, Peygamber’den nakledilen söz ve fiillerin kabulünün ön şartı olarak bunların Kur’an’a arzı yani delil olabilmesi için Kur’an’ın ilgili düzenlemesiyle uyumlu olup olmadığının tespiti hususu, kıyas sonucu ulaşılan hükmü bir gerekçeye dayanarak terk edip başka bir hüküm koymak demek olan istihsân, çözüm bekleyen yeni meselenin iki veya daha fazla asla/makîsün aleyhe birden benzemesi halinde birçok açıdan en çok benzediği düşünülen aslı dikkate alarak söz konusu yeni meseleye bu aslın hükmünü vermek demek olan şebeh kıyası, mefhûmu’l-muhâlefenin yani bir sözün ters anlamının o sözdeki meselenin tam tersi olup hükmü belirtilmeyen meseleye aktarımı anlamına gelen karşıt kavram kanıtının sahih bir istidlal sayılıp sayılmaması ve emir kipinin hangi anlama geleceği konusu. In this study, Qāḍī Abd al-Jābbār’s views on knowing Allah (ma‘rifatullah) and following issues have been analysed. In this context, either the divine message has reached to a person or not, it is examined whether ma‘rifatullah is obligatory (wajib) upon him. Subsequently, it is discussed whether this obligation is ensured by reasoning (‘aql) or revelation (naql). Furthermore, while keeping in mind the role of intellect (nazar) and argumentation (istidlāl), we have established and evaluated religious state and source of nazar and (...) istidlāl. Also, we discussed to what extend God can be the subject of knowledge and from which aspects He can be known. Besides, we discussed whether ma‘rifatullah is an obligation and if not what its justification is. In addition, we examined whether imitative knowledge (taqlīd) is possible in the case of ma‘rifatullah or not and whether it’s sufficient to know God just by taqlīd without the reasoning at all. Finally, Qāḍī Abd al-Jābbār’s opinions on the religious situation of people to whom the divine revelation did not reach at all and so they lack of knowledge on God. (shrink)

Following the formation of disciplines/sciences in different fields of Islamic thought, the specific concepts and terminologies of these disciplines/sciences began to emerge. Then the special meaning and the area of utilization for every concept in each discipline/science were further clarified by compiling specific epistles of definition (ḥudūd), which would contribute to this process of conceptualization. For the terminological meaning of the used concept to be determined primarily and thus for the followed theological/sectarian affiliation to be supported, works belonging to this (...) genre have been written specifically for the field of theology. Especially, the Muʿtazilī theologians undoubtedly made the greatest contribution. Thusly, specific treatises containing theological concepts were compiled by names such as al-Qāḍī ʿAbd al-Jabbār (d. 415/1025), and his students Abū Rashīd al-Nīsābūrī (d. after 420/1029) and Ibn Sharwīn (fl. first half of the Vth/XIth century). Zaydī theologian and jurist Abū’l-Qāsim al-Bustī’s (d. 420/1029) Tahdhīb al-ḥudūd, which has no available copy, is also contemporary to the mentioned works. This tradition found its reflection in the Imāmī-Muʿtazilī line in Abū Jaʿfar al-Ṭūsī’s (d. 460/1067) al-Muqaddimah fī l-madkhal ilá ṣināʿat ʿilm al-kalām, which could be seen as a concise theological work in terms of its construct and the explanations which it comprises, and in the work called al-Ḥudūd wa-l-ḥaqāʾiq, which is attributed to al-Sharīf al-Murtaḍá (d. 436/1044). Abū Jaʿfar al-Muqrī al-Nīsābūrī’s (d. mid-VIth/XIIth century [?]) al-Ḥudūd stands out as the most voluminous example in this tradition. The most important work belonging to this genre in the Muʿtazilī tradition, as it is the first among the available works, is the Ḥudūd al-alfāẓ of al-Qāḍī ʿAbd al-Jabbār, which is found together with some other important Zaydī-Muʿtazilī works in a compilation discovered by us and thought to be lost until recently. In this treatise, which generally includes theological concepts and partially includes the concepts of Islamic law and the history of sects, al-Qāḍī ʿAbd al-Jabbār has put forward a language-based definition theory. His approach here is in line with the views he put forward on definition in his al-Mughnī. In particular, the Basra School of Muʿtazila has given the emphasis on tab' theory emphasizing the freedom of man. They have implemented the tab ' theory to a number of topics related to knowledge, action, metaphysical, moral and Spiritual life. The nature, which is defended by Muʻtezile, is a force that Allah places in the nature of man and body. Nature, which is in the essence of both living and inanimate substances, is not independent of Allah. It has caused some problems defending some scholars, such as Muammer and Câhız from Basra School of Muʿtazila the idea of compulsory natural causality in the interpretation of some metaphysical subjects. In this regard, The scholars of Muʿtazila such as Nazzâm and Kâdî Abdülcebbâr, have acted more carefully.
