We know that Husserl knew the text of the Anthropology from a Pragmatic Point of View, which he had at least partly read in Hartenstein’s edition of Kant’s Sämtliche Werke. In the section called « On the inhibition, weakening, and total los of the sense faculties », Kant poses the problem of death in terms comparable to those of Husserl. Here, I argue that in his analysis of sleep, birth and death in the so-called C-Manuscripts, Husserl makes a transcendental and (...) non-anthropological use of Kant’s non transcendental anthropology. If we can say, along with Saulius Geniusas, that the C-manuscripts « mark the emergence of the problematic of birth, death, and sleep into the critical scope of Husserl’s phenomenology of time », then we need to add that the analysis of the sense faculties in the Anthropological Didactic marks the period of gestation. This article addresses the question of engagement in French philosophy from the Munich Agreement to the Korean War. It focuses on establishing a little-known fact about the history of the concept of engagement: the role played by the individual and social ethics developed by Husserl in the early 1920s, through its personalist reception, in the genesis of the philosophies of engagement during our reference period. Paul-Louis Landsberg was, with his Reflections on Personal Engagement (1937), the main architect of the renewal (...) through which French personalism, breaking away from the strategy of purity, became a personalism of engagement. In the early 1920s, he had attended Husserl’s lectures in Freiburg, as he explained in the posthumous tribute “Husserl and the Idea of Philosophy” (1939). What did he take from Husserl? What did he choose to abandon? With the failure of transcendental rationalism, had rationalism reached the exhaustion of its meaning and the depletion of its possibilities? The philosophies of engagement that developed in post-war France stemmed largely from a critique of Husserlian rationalism, either by seeking to go beyond rationalism—the strategy of personalism—or by seeking to rebuild it on different grounds, not as transcendental rationalism, but as engaged rationalism. L’article examine le problème des restrictions qu’il faut apporter à la loi des trois états : la loi du développement de l’esprit est-elle valable à tous les degrés de l’échelle hiérarchique? Ou bien la mathématique fait-elle exception à la loi historique? La réponse apportée par Brentano est assez surprenante et semble même contradictoire. Dans certains textes, il soutient que la mathématique est soumise au même régime que les autres branches du savoir ; et que si restriction il y a, ces (...) restrictions doivent être pensées avec Comte, et non pas contre lui. Dans d’autres textes, Brentano semble se ranger à la position critique de J. S. Mill. Comment concilier ces affirmations apparemment contradictoires? On se propose de répondre à cette question en montrant que la position de Brentano a évolué au tournant des années 1870, et en indiquant le rôle de la nouvelle classification des sciences dans cette évolution. The human intestinal ecosystem, previously called the gut microflora is now known as the Human Gut Microbiota. Microbiome research has emphasized the potential role of this ecosystem in human homeostasis, offering unexpected opportunities in therapeutics, far beyond digestive diseases. It has also highlighted ethical, social and commercial concerns related to the gut microbiota. As diet factors are accepted to be the major regulator of the gut microbiota, the modulation of its composition, either by antibiotics or by food intake, should be (...) regarded as a fascinating tool for improving the human health. Scientists, the food industry, consumers and policymakers alike are involved in this new field of nutrition. Defining how knowledge about the HGM is being translated into public perception has never been addressed before. This raises the question of metaphors associated with the HGM, and how they could be used to improve public understanding, and to influence individual decision-making on healthcare policy. This article suggests that a meeting of stakeholders from the social sciences, basic research and the food industry, taking an epistemological approach to the HGM, is needed to foster close, innovative partnerships that will help shape public perception and enable novel behavioural interventions that would benefit public health. The Monographs produced by the International Agency for Research on Cancer (IARC) apply rigorous procedures for the scientific review and evaluation of carcinogenic hazards by independent experts. The Preamble to the IARC Monographs, which outlines these procedures, was updated in 2019, following recommendations of a 2018 expert Advisory Group. This article presents the key features of the updated Preamble, a major milestone that will enable IARC to take advantage of recent scientific and procedural advances made during the 12 years since (...) the last Preamble amendments. The updated Preamble formalizes important developments already being pioneered in the Monographs Programme. These developments were taken forward in a clarified and strengthened process for identifying, reviewing, evaluating and integrating evidence to identify causes of human cancer. The advancements adopted include strengthening of systematic review methodologies; greater emphasis on mechanistic evidence, based on key characteristics of carcinogens; greater consideration of quality and informativeness in the critical evaluation of epidemiological studies, including their exposure assessment methods; improved harmonization of evaluation criteria for the different evidence streams; and a single-step process of integrating evidence on cancer in humans, cancer in experimental animals and mechanisms for reaching overall evaluations. In all, the updated Preamble underpins a stronger and more transparent method for the identification of carcinogenic hazards, the essential first step in cancer prevention. (shrink)

One effect of information technology is the increasing need to present information visually. The trend raises intriguing questions. What is the logical status of reasoning that employs visualization? What are the cognitive advantages and pitfalls of this reasoning? What kinds of tools can be developed to aid in the use of visual representation? This newest volume on the Studies in Logic and Computation series addresses the logical aspects of the visualization of information. We present a Kripke model for Girard's Linear Logic (without exponentials) in a conservative fashion where the logical functors beyond the basic lattice operations may be added one by one without recourse to such things as negation. You can either have some logical functors or not as you choose. Commutatively and associatively are isolated in such a way that the base Kripke model is a model for noncommutative, nonassociative Linear Logic. We also extend the logic by adding a coimplication operator, (...) similar to Curry's subtraction operator, which is resituated with Linear Logic's contensor product. And we can add contraction to get nondistributive Relevance Logic. The model rests heavily on Urquhart's representation of nondistributive lattices and also on Dunn's Gaggle Theory. Indeed, the paper may be viewed as an investigation into nondistributive Gaggle Theory restricted to binary operations. The valuations on the Kripke model are three valued: true, false, and indifferent. The lattice representation theorem of Urquhart has the nice feature of yielding Priestley's representation theorem for distributive lattices if the original lattice happens to be distributive. Hence the representation is consistent with Stone's representation of distributive and Boolean lattices, and our semantics is consistent with the Lemmon-Scott representation of modal algebras and the Routley-Meyer semantics for Relevance Logic. Despite hundreds of definitions, no consensus exists on a definition of life or on the closely related and problematic definitions of the organism and death. These problems retard practical and theoretical development in, for example, exobiology, artificial life, biology and evolution. This paper suggests improving this situation by basing definitions on a theory of a generalized particle hierarchy. This theory uses the common denominator of the “operator” for a unified ranking of both particles and organisms, from elementary particles to animals (...) with brains. Accordingly, this ranking is called “the operator hierarchy”. This hierarchy allows life to be defined as: matter with the configuration of an operator, and that possesses a complexity equal to, or even higher than the cellular operator. Living is then synonymous with the dynamics of such operators and the word organism refers to a select group of operators that fit the definition of life. The minimum condition defining an organism is its existence as an operator, construction thus being more essential than metabolism, growth or reproduction. In the operator hierarchy, every organism is associated with a specific closure, for example, the nucleus in eukaryotes. This allows death to be defined as: the state in which an organism has lost its closure following irreversible deterioration of its organization. The generality of the operator hierarchy also offers a context to discuss “life as we do not know it”. The paper ends with testing the definition’s practical value with a range of examples. (shrink)

AIDS and the Politician’s Right to Privacy.

Is the current state of international governance by the United Nations and related organizations a preface to what eventually might become a world government? Is it at all similar to what was the structure of government in the United States after the adoption of the Articles of Confederation in 1781 and before adoption of the Constitution of 1787? Are changes in the way international institutions like the United Nations operate related to changes in our conceptions of the role of these (...) institutions in providing international governance? When governmental institutions prove to be too weak to adequately perform the tasks expected of them is there a natural evolution toward greater centralization of power? If so, might an early sign of this evolution be decisions by public officials that afford greater deference to the decrees of international institutions that previously might have been sidestepped? The article argues that lesbian, gay, bisexual, and transgendered (LGBT) rights are a particular instantiation of human rights. But in order to make this argument several things must be done first. Preliminarily, it should be noted that some transgendered issues fall under the rubric "gay rights," even though strictly speaking, they center most prominently on gender and not sexual orientation. Still, there gender aspects are often ignored because of concerns related to sexual orientation, such as whether a transgendered female can (...) use a woman's washroom. Arguably, the reverse may also be true of gays, lesbians, and bisexuals, as many of society's concerns regarding this group involve their following gender roles, even though the discrimination against them is not usually seen as sex discrimination. Bearing that in mind, among the various responsibilities of this article is to define--in the broad sense--what gay and lesbian rights are. This is followed by a similar set of expressions defining what human rights are and an argument for how such rights get justified. Once that is done, the connection between gay and lesbian rights and human rights is pursued within the context of a theory of political morality that establishes the centrality of human rights to all moral concerns. In this essay, I maintain that the issue of whether the right to die is viable as a constitutionally protectable right remains open. I intend to reconcile the Supreme Court's holdings in Glucksberg and Quill by examining the different rationales the Justices offered for their decisions. I do not believe this issue can be resolved simply by asserting that the intention of the actor is different when assisting suicide, as compared to when life-sustaining treatment is withdrawn. Rather, the right to (...) die continues to be viable due to the level of abstraction at which the Court chose to frame the issue in these cases. (shrink)

I here advance the thesis that if there is a general right to privacy, it follows that each person has a right not to be intruded upon in respect to their HIV status. I shall call this right RNIH (the Right to Non-Intrusion on HIV Status). Closely related to RNIH is society's compelling interest to protect against the spread of a fatal disease. In cases where the two conflict, the state's interest dominates but only to a point. In this article (...) I sketch out a theoretical basis for believing RNIH exists. The unexpected passing of United States Supreme Court Justice Antonin Scalia left a vacancy on the Court in the midst of a presidential election year. As a result, the appointment process did not proceed in the same fashion as previous appointments. Instead, the Senate declared shortly after Justice Scalia’s death that it would not consider any candidate to fill the vacancy until the next president is elected. The Senate remained steadfast in this decision throughout the remainder of President Obama’s term. (...) -/- This Article analyzes the constitutional questions surrounding the Senate’s refusal to consider any nominee and argues the Senate has a duty to advise and consent in a timely manner. Additionally, it demonstrates how a politically-motivated delay threatens the integrity of the constitutional process for selecting judges, violates separation of powers concerns by politicizing the Court, and contradicts the express intent of the Framers of the Constitution. Recent U.S. Supreme Court decisions regarding the scope of the Establishment Clause have failed to provide a clear framework for determining what government actions are prohibited. Part of the problem concerns what kinds of actions constitute an establishment of religion. What criteria should determine the boundaries of an establishment challenge? Are governmental actions that may only indirectly affect religion (either positively or negatively) prohibited? This article aims to provide a coherent and normatively justified understanding of the Establishment Clause to help (...) answer these questions by considering not just the history of the Clause or the cases the Court has decided under it, but also considering overlaps from various philosophical justifications for the Clause—including justifications from rights theory, political liberalism, utilitarianism, and communitarianism. In the process, the article eliminates from consideration the Supreme Court’s so-called “accommodationist” approach and presents a new understanding of the neutrality test that anchors itself between strict separation and the current neutrality approaches. This it does by also taking into account what in moral theory is known as the doctrine of double effect and by showing how the doctrine further limits the various judicial views to just neutrality in the new sense I suggest, while also providing both clearer and firmer conditions. The purpose of this essay is to suggest a new direction in our thinking about substantive due process that recognizes human rights in the lived experience of our fellow human beings. The applicability of the approach, at least for equal protection purposes, was hinted at by the Supreme Court’s majority opinion in Romer v. Evans, but it has never been given full consideration.1 There, Justice Kennedy noted the very real impact of a state group of people. What he did not (...) say is how such an amendment might also impact the self-impression gays and lesbians have of themselves, although this would certainly be part of such an amendment’s impact. Moreover, legal and philosophical research in this area suggests that there may be more here than previously thought. While I do not hope to resolve every philosophical question at the heart of my legal analysis, I do intend to bring forth enough substance to answer the indeterminacy charge levied by certain Supreme Court justices and others concerning which rights should count as “fundamental” under substantive due process in part by looking at the impact such rights have on individual self-esteem. Terrorist attacks throughout the world and particularly within the United States have given rise to a new chapter in the ongoing debate over liberty versus security. The most recent manifestation of this dispute focuses on whether Muslim refugees can be denied entry as a class into the United States, based on their religion alone, for fear they might be harboring potential terrorists. This Essay shows that such a policy cannot be justified under the First Amendment Establishment Clause, as well the (...) United States’ expressed international commitments to preserving international human rights. What can be done is to engage a broader set of investigative approaches that are more likely to provide greater security than any policy focused on religion alone. (shrink)
