Freiheitsentziehende Maßnahmen in Altenpflegeheimen sind unter pflegerischen und ethischen, aber auch betreuungsrechtlichen und vor allem strafrechtlichen Gesichtspunkten von besonderer Bedeutung. Häufig sind eingeschränkte Mobilität, Verringerung der kognitiven Funktionen, große Hilfsbedürftigkeit des älteren Menschen der auslösende Faktor für den Einsatz derartiger Einschränkungen. Daneben gibt es jedoch Hinweise, dass die Anwendung freiheitsentziehender Maßnahmen auch mit organisatorischen Abläufen in Altenpflegeeinrichtungen zusammenhängt. Der vorliegende Beitrag diskutiert, wieweit freiheitsentziehende und freiheitsbeschränkende Maßnahmen bei alten Menschen überhaupt zulässig sind und zeigt auf, dass die Entwicklung von alternativen (...) Betreuungs- und Versorgungsansätzen dazu beitragen kann, dass durch weniger freiheitsentziehende Maßnahmen in der stationären Pflege die Würde der alten Menschen gewahrt bleibt. (shrink)

A New Route to the Necessity of Origin’ (2004, henceforth ‘NR’), we offered an argument for the thesis that there are necessary connections between material things and their material origins. Much of the philosophical interest lay in our claim that the argument did not depend on so-called sufficiency principles for crossworld identity. It has been the verdict of much recent work on the necessity of origin that valid arguments for the thesis require some such sufficiency principle as a premise but (...) that such principles are deeply problematic.1 Finding an argument free of such principles would advance both our understanding and the plausibility of that thesis. These claims are now the subject of a pair of insightful critiques by Teresa Robertson and Graeme Forbes (2006, henceforth ‘RF’) and by Ross Cameron and Sonia Roca (2006, henceforth ‘CR’), and we welcome the opportunity to clarify and improve our account of the matter. Prosthetic devices that replace an absent body part are generally considered to be either cosmetic or functional. Functional prostheses aim to restore (some degree of) lost physical functioning. Cosmetic prostheses attempt to restore a “normal” appearance to bodies that lack (one or more) limbs by emulating the absent body part’s looks. In this article, we investigate how cosmetic prostheses establish a normal appearance by drawing on the stories of the users of a specific type of artificial limb: the facial prosthesis. (...) Given that prostheses are first and foremost devices worn upon the body, such an analysis requires an understanding of the ways in which bodies and technologies interact. We thus interpret users’ stories by critically engaging with the work of disability researcher and Actor-Network theorist Myriam Winance, as well as with the postphenomenological scholarship of Don Ihde and Peter-Paul Verbeek. Using this framework, we explore users’ attempts to achieve a proper fit between their faces and their prostheses, the technological transparency such a fit enables, and the ways in which transparency mediates users’ everyday exchanges with others. We conclude that a normal appearance, when it is achieved by means of prosthetics, enables the device’s user to navigate a precarious social environment as they encounter and interact with others in public. A ‘teoria da virtude’ contemporânea enfatiza a necessidade de voltar à formação moral do indivíduo, seguindo o modelo ético disponibilizado por Aristóteles. Segundo MacIntyre, representante importante dessa teoria, o estoicismo favoreceu o desenvolvimento da ética moderna e contemporânea, ao destacar noções como vontade, assentimento e lei natural ou divina. Por conseguinte, o desenvolvimento do próprio agente moral foi negligenciado. No século XII, Abelardo apresenta uma ética híbrida, que mantém, ao mesmo tempo, a teoria aristotélica da virtude e elementos da moral (...) estoica. No presente estudo, consideramos a crítica feita por MacIntyre da ética abelardiana, estimada ser na origem das concepções morais modernas e contemporâneas. (shrink)

Peter Abelard and William of Ockham represent the two main figures of the nominalism of the Middle Ages. Both share the fundamental thesis of that doctrine, according to which only individual entities exist. The repercussions of nominalism are quite evident in relation to the question of universals, which constitutes a subject that, until now, won the attention of the majority of contemporary studies on the two most important logicians of their time. Nevertheless the nominalism of each of these two protagonists (...) apparently diverges in a significant manner, especially in respect to the role exercised by the mind in the semantic process. Ockham seems to distance himself definitely from his predecessors, including Abelard, when he transfers grammar and semantic functions of conventional language to the level of mental language. In the present article, the chief intention is to expound the theory of sign and signification of each of the authors under consideration. The ultimate objective is to compare their respective semantic positions and indicate the principal points of agreement and disagreement, keeping in mind the hypothesis according to which these two medieval nominalists should have more theoretical elements in common than not. This essay seeks first to clarify the type of complementary understanding two disciplines such as philosophy and sociology can bring to the investigation of the concept of morality. The present study concerns Durkheim, attempts to show how the sociological concept of morality that he develops in his works on the division of labor, solidarity, anomie, suicide, elementary forms of religion, collective ideals, etc..., inevitably spills over into essentially philosophical considerations. Should philosophical inquiry into the concept of morality also make reference (...) to essentially sociological considerations? It is ultimately to this question that this essay addresses itself.Cet article a pour but premier de mettre en lumière le type de complémentarité que peuvent apporter deux disciplines comme la philosophie et la sociologie dans l'approfondissement du concept de moralité. La présente étude porte sur l'exemple de Durkheim et tente de montrer comment le concept sociologique de moralité qu'il a développé dans ses thèses portant sur la division du travail, la solidarité, l'anomie, le suicide, la religion élémentaire, les idéaux collectifs, etc... débouche inévitablement sur des considérations d'ordre philosophique. Inversement, la philo- sophée qui s'interroge sur le concept de moralité se voit-il dans l'obligation de faire appel à des considérations d'ordre sociologique' C'est la question que soulève en dernière analyse cet article. L'Ambitieux Projet du professeur John Rawls dans son important ouvrage intitulé «A Theory of Justice» consiste essentiellement dans l'élaboration d'une théorie de la justice qui prétend offrir une «solution de rechange viable» aux doctrines traditionnelles de la justice représentées par l'utilitarisme, l'intuitionisme, les théories contractuelles, etc …, mais une théorie qui, en méme temps, se présente comme une tentative pour «généraliser et porter a un plus haut niveau d'abstraction la theorie traditionnelle du contrat social telle que representee par Locke, Rousseau (...) et Kant», de telle sorte qu'elle puisse parer aux objections les plus decisives qui ont ete faites a l'endroit de ces diverses formulations de la theorie contractuelle. En procédant ainsi, Rawls estime pouvoir offrir une approche systematique au probléme de la justice qui soit non seulement une alternative a 1'utilitarisme traditionnel, mais une synthése supérieure et plus valable pour une sociéte démocratique en méme temps qu'une approche de la justice sociale qui puisse servir de contrepartie ou de succedane a la perspective de Marx. Le Commentaire du Traité de l'âme d'Aristote par Thomas d'Aquin est le cinquième des commentaires fondamentaux des oeuvres d'Aristote traduits en langue française. Avec celui des Physiques, de la Métaphysique, de l'Interprétation et des Analytiques, il fonde l'édifice de la philosophie de Thomas d'Aquin et assure les contreforts de sa théologie. Ce traité se présente comme un vaste essai de définition de l'âme et principalement de l'âme humaine, avec en filigrane, une question lancinante : cette âme est-elle immortelle? Si ce (...) traité est l'un des plus courts d'Aristote, et selon ses propres termes, encore à l'état d'ébauche, il est construit avec une rigueur méthodologique qui en fait une sorte de modèle pour toute réflexion philosophique. Thomas propose une explication reconnue comme des plus limpides, et introduit à un livre encore loué deux millénaires plus tard par Hegel, Marx ou Darwin. Comme le reste de l'oeuvre d'Aristote, il connaît aujourd'hui un regain d'intérêt remarquable et le commentaire de Thomas offre un guide très sûr pour son intelligence. (shrink)
