The question of whether Do Not Resuscitate orders should be sustained in the operating room was brought to our ethics committee by a pulmonologist and involved one of his patients for whom he serves as a primary care physician. His patient, a woman with chronic obstructive lung disease was electing, for comfort purposes, to have a hip pinning following a fracture. At the same time, she wished to have a DNR order covering her entire hospital stay. The anesthesiologist described her (...) direction as “improper” and refused to participate in surgical procedures if DNR orders extended to the operating room. The patient refused to rescind the order during surgery. As a result, the surgery was canceled to the great chagrin of the patient. (shrink)

In an intriguing essay, G. A. Cohen has defended a conservative bias in favour of existing value. In this paper, we consider whether Cohen’s conservatism raises a new challenge to the use of human enhancement technologies. We develop some of Cohen’s suggestive remarks into a new line of argument against human enhancement that, we believe, is in several ways superior to existing objections. However, we shall argue that on closer inspection, Cohen’s conservatism fails to offer grounds (...) for a strong sweeping objection to enhancement, and may even offer positive support for forms of enhancement that preserve valuable features of human beings. Nevertheless, we concede that Cohen’s arguments may suggest some plausible and important constraints on the modality of legitimate and desirable enhancements. (shrink)

Cohen Kadosh & Walsh (CK&W) discuss the limitations of the behavioral, imaging, and single-cell studies related to number representation in human parietal cortex. The limitations of the imaging studies are grossly underestimated, particularly those using adaptation paradigms, and the problem of establishing a link between single-cell studies and imaging is not even addressed. Monkey functional magnetic resonance imaging (fMRI), however, provides a solution to these problems.

This article explores the potential utility of certain features of Friedrich Nietzsche’s philosophical concepts for philosophical counselling. Central to the philosophical counseling process is philosophical counsellors applying the ideas of philosophers or philosophical system to inspire, educate, and guide their counselees in dealing with life problems. For example, the philosophical practice methodology of Logic-based Therapy, developed by American philosopher Elliot Cohen, provides a rational framework for confronting problems of living, where the counselor helps the counselee find an uplifting philosophy (...) that promotes a guiding virtue to act as an antidote to unrealistic and often self-defeating conclusions derived from irrational premises. I present the argument that Nietzsche’s analysis of suffering, is one such uplifting philosophy which can be of utility to philosophical counselors. According to Bernard Reginster, suffering forms the bedrock of Nietzsche’s life-affirming concept of the ‘will to power.’ Nietzsche’s notion of the will to power radically alters our conception of, and the significance we assign to suffering, where the will to power is best understood as an individual’s desire for the activity of overcoming resistance. Nietzsche’s analysis implies that the fundamental human impulse is not to avoid suffering, but rather to embrace suffering as an unavoidable existential given of life itself: the meaning to be found in suffering is tantamount to affirming life itself. “Bioconservatives” in the human enhancement debate endorse the conservative claim that we should reject the use of biotechnologies that enhance natural human capacities. However, they often ground their objections to enhancement with contestable claims about human nature that are also in tension with other common tenets of conservatism. We argue that bioconservatives could raise a more plausible objection to enhancement by invoking a strain of conservative thought developed by G.A. Cohen. Although Cohen’s conservatism is not sufficient to fully (...) revive the bioconservative objection, we argue that it can be supplemented by an account of reasonable partiality for humanity in a way that provides further support to the bioconservative position in a manner congruous with broader conservatism. We propose that the idea of partiality to humanity can buttress the bioconservative objection into its strongest possible form. However, we conclude by arguing that, even in this form, the objection cannot do all the work that bioconservatives expect of it. (shrink)

We present the argument that Holism is one such uplifting philosophy which can be of utility to philosophical counselors or practitioners to help their counselees with confronting problems of living. Furthermore, we argue that Smuts’ articulation of freedom can act as a guiding virtue within this uplifting philosophy of Holism in accordance with the methodology of LBT. Smuts’ contribution to philosophy and psychology is arguably inadequately credited, and for this reason, and to the best of our knowledge, Smuts’ theory of Holism has yet to be discussed in the context of philosophical counseling or practice. Given these omissions, we begin this article with a discussion of his influence on 20th Century Anglo-American psychology. We then provide a brief historical context, and an introduction to the central argument of Smuts’ Holism, as well as a brief overview of the origins of Smut’s Holism and an introduction to his book Holism and Evolution. In the remainder of the article, we discuss several foundational concepts that underlie Smuts’ theory of Holism, as articulated and developed in his book Holism and Evolution, to substantiate our arguments. We conclude by highlighting the limitations of our article, limitations to Smuts’ model, and the challenges inherent in the use of a now largely antiquated theory, even by Smuts’ own admission nineteen years after its publication, for the purposes of contextualizing and substantiating the arguments and recommendations presented herein. Online Public Shaming is a form of norm enforcement that involves collectively imposing reputational costs on a person for having a certain kind of moral character. OPS actions aim to disqualify her from public discussion and certain normal human relations. We argue that this constitutes an informal collective punishment that it is presumptively wrong to impose on others. OPS functions as a form of ostracism that fails to show equal basic respect to its targets. Additionally, in seeking to mobilise unconstrained (...) collective power with potentially serious punitive consequences, OPS is incompatible with due process values. (shrink)

Hermann Cohen (1842-1918) was among the most accomplished Jewish philosophers of modern times. This newly translated collection of his writings illuminates his achievements for student readers and rectifies lapses in his intellectual reception by prior generations.

Virtue theories can plausibly be argued to have important advantages over normative ethical theories which prescribe a strict impartialism in moral judgment, or which neglect people’s special roles and relationships. However, there are clear examples of both virtuous and vicious partiality in people’s moral judgments, and virtue theorists may struggle to adequately distinguish them, much as proponents of other normative ethical theories do. This paper first adapts the “expanding moral circle” concept and some literary examples to illustrate the difficulty of (...) adequately distinguishing virtuous from vicious partiality. Later sections aim to show how an adequate philosophical ethics will be able to both a) attribute virtue (and hence praiseworthiness) to agents whose actions may directly serve only their special interests, roles, or special relationships; and b) attribute vice (and hence censure) where an agent’s attitudes and/or actions mirror known personal biases (for instance, an egoistic attitude) or social biases (for instance, and ethnocentric attitude). This dual ability leaves space for much virtuous partiality, while also reflecting a “risk-aware” approach, recognizing the deleterious consequences of our human penchant for constructing and imbuing moral significance to oftentimes factitious us/them dichotomies. It is often claimed that liberalism is falsely and perniciously universalist. I take this charge seriously, exploring three positions: the communitarians’, Rorty’s, and that of “comprehensive” liberalism. After explaining why universalism is thought impossible, I examine the communitarian view that value is determined within communities and argue that it results in a form of relativism that is unacceptable. I next discuss Richard Rorty’s liberal acceptance of “conventionalism” and explain how, despite his rejection of universalism, Rorty remains a liberal. I then (...) present a defense of universalism, based in part on arguments that parallel Thomas Nagel’s arguments in defense of a “view from nowhere” and Jean Hampton’s objectivist arguments against Rawls’s moves to a “merely political” theory. Freiheitsentziehende Maßnahmen in Altenpflegeheimen sind unter pflegerischen und ethischen, aber auch betreuungsrechtlichen und vor allem strafrechtlichen Gesichtspunkten von besonderer Bedeutung. Häufig sind eingeschränkte Mobilität, Verringerung der kognitiven Funktionen, große Hilfsbedürftigkeit des älteren Menschen der auslösende Faktor für den Einsatz derartiger Einschränkungen. Daneben gibt es jedoch Hinweise, dass die Anwendung freiheitsentziehender Maßnahmen auch mit organisatorischen Abläufen in Altenpflegeeinrichtungen zusammenhängt. Der vorliegende Beitrag diskutiert, wieweit freiheitsentziehende und freiheitsbeschränkende Maßnahmen bei alten Menschen überhaupt zulässig sind und zeigt auf, dass die Entwicklung von alternativen (...) Betreuungs- und Versorgungsansätzen dazu beitragen kann, dass durch weniger freiheitsentziehende Maßnahmen in der stationären Pflege die Würde der alten Menschen gewahrt bleibt. (shrink)

Prosthetic devices that replace an absent body part are generally considered to be either cosmetic or functional. Functional prostheses aim to restore (some degree of) lost physical functioning. Cosmetic prostheses attempt to restore a “normal” appearance to bodies that lack (one or more) limbs by emulating the absent body part’s looks. In this article, we investigate how cosmetic prostheses establish a normal appearance by drawing on the stories of the users of a specific type of artificial limb: the facial prosthesis. (...) Given that prostheses are first and foremost devices worn upon the body, such an analysis requires an understanding of the ways in which bodies and technologies interact. We thus interpret users’ stories by critically engaging with the work of disability researcher and Actor-Network theorist Myriam Winance, as well as with the postphenomenological scholarship of Don Ihde and Peter-Paul Verbeek. Using this framework, we explore users’ attempts to achieve a proper fit between their faces and their prostheses, the technological transparency such a fit enables, and the ways in which transparency mediates users’ everyday exchanges with others. We conclude that a normal appearance, when it is achieved by means of prosthetics, enables the device’s user to navigate a precarious social environment as they encounter and interact with others in public. L’objet de cet essai est l’accueil des entités mathématiques dans l’architecture des modes d’existence proposée par Bruno Latour dans le cadre de son ontologie pluraliste du monde moderne [Latour 2012]. Les travaux de Reviel Netz sur l’émergence des mathématiques grecques [Netz 1999] et de Charles Sanders Peirce sur la dimension diagrammatique de l’activité mathématique [Peirce 1933-1958], [Peirce 1976] sont employés pour proposer une réponse dans le cadre d’une conception empirique des mathématiques basée sur la notion d’expérience chère à William James (...) [James 2007] et inspirée par certains aspects de la philosophie de Per Martin-Löf [Martin-Löf 1987]. Cette approche permet de penser la solide certitude dont la démonstration dote les résultats mathématiques tout en invalidant son interprétation comme la marque d’un accès direct à une vérité absolue et transcendante. This article seeks explore the complex relations between Beauty and the Sublime. The exploration is guided by two very powerful, but very different, thinkers: Swiss Catholic metaphysical theologian Hans Urs von Balthasat and American naturalist metaphysician Robert S. Corrington. Through reflection upon von Balthasar’s themes of Beauty, Splendor and Being and Corrington’s themes of the Sublime and the Encompassing it is hoped implications of the complex relations between Beauty and the Sublime might be evoked and engaged.

Self-harm within immigration detention centres has been a widely documented phenomenon, occurring at far higher rates than the wider community. Evidence suggests that factors such as the conditions of detention and uncertainty about refugee status are among the most prominent precipitators of self-harm. While important in explaining self-harm, this is not the entire story. In this paper, we argue for a more overtly political interpretation of detainee self-harm as resistance and assess the ethical implications of this view, drawing on interviews (...) with detainees from Australia’s offshore system. Self-harm by detainees is not only a medical ‘condition’ arising in response to oppression but a form of political action to lessen or contest it. We first establish how self-harm could be conceptualised as resistance. We then discuss its political purpose, noting it serves at least three functions: intrinsic, instrumental and disruptive or coercive. Viewing detainee self-harm as political resistance is a supplement to (rather than a substitute for) a medical approach. However, conceptualising self-harm this way has several advantages, namely, moving away from the idea that such behaviour is ‘maladaptive’, recognising detainees as political agents, combatting government claims of ‘manipulation’ and ‘blackmail’ and clarifying the duties of healthcare workers who work in detention. This book has argued that problems of religious luck, especially when operationalized into concerns about doxastic risk and responsibility, can be of shared interest to theologians, philosophers, and psychologists. We have pointed out counter-inductive thinking as a key feature of fideistic models of faith, and examined the implications of this point both for the social scientific study of fundamentalism, and for philosophers’ and theologians’ normative concerns with the reasonableness of a) exclusivist attitudes to religious multiplicity, and b) theologically-cast but bias-mirroring (...) trait-ascriptions to religious insiders and outsiders. It is important to keep the descriptive/explanatory and normative concerns properly separated, but philosophy of luck and risk are relevant to both. More specifically, inductive risky theological strategies,we have argued, are a relevant concern both descriptively and normatively. The descriptive/explanatory relevance of measures of high inductive risk connects it with cognitive and social psychology of religion, while its normative relevance connects with critical concerns with epistemology of testimony, the epistemology of disagreement, and the ethics of belief. A research program to examine fideistic orientation and its relation to epistemically risky doxastic strategies is one of potentially numerous research programs on which philosophers and psychologists might work collaboratively. So this concluding chapter of our study culminates with the outline of a proposed research program at the intersection of shared concerns. I term this research program CICI, because it examines what lies at the intersection of CSR’s standing interest in the appeal of counter-intuitive ideas, and our own study’s focus on the fideistic penchant for counter-inductive thinking. Religious Studies scholars typically focus on particular traditions and teachings, while CSR scholars tend to eschew such content-focused approaches in favor of a study of evolutionary and hence generic or trans-religious functions and processes. I argue that CICI has the added benefit of effectively mediating this generic-specific contrast between CSR and Religious Studies, allowing CSR research to be more closely connected with and relevant to comparative fundamentalism. Chapter 3 surveys objectivity in the natural sciences. Thomas Kuhn problematized the logicist understanding of the objectivity or rationality of scientific change, providing a very different picture than that of the cumulative or step-wise progress of theoretical science. Theories often compete, and when consensus builds around one competitor it may be for a variety of reasons other than just the direct logical implications of experimental successes and failures. Kuhn pitted the study of the actual history of science against what Hans (...) Reichenbach referred to as the “logical substitutes” logicists used to reconstruct the rationality of theory change. Such substitutes were promoted to show that theory confirmation is a purely epistemic affair, where purely epistemic implies purely inferential. But where the positivists saw logical compulsion as the reason for theory change, Kuhn saw psychology in values as relevant to how theories are actually confirmed or accepted by the scientific community. From what norms does the ethics of belief derive its oughts, its attributions of virtues and vices, responsibilities and irresponsibilities, its permissioning and censuring? Since my inductive risk account is inspired by pragmatism, and this method understands epistemology as the theory of inquiry, the paper will try to explain what the aims and tasks are for an ethics of belief, or project of guidance, which best fits with this understanding of epistemology. More specifically, this chapter approaches the ethics of belief (...) from a focus on responsible risk management, where doxastic responsibility is understood in terms of the degree of riskiness of agents’ doxastic strategies, a riskiness which is in turn most objectively measured through accordance or violation of inductive norms. Doxastic responsibility is attributable to agents on the basis of how epistemically risky was the process or strategy of inquiry salient in the etiology of their belief or in their maintenance of what one believes or accepts. L'expression marché de l'art, couramment employée, le plus souvent au singulier, soulève une foule de questions, qui vont de l'opposition que l'on établit instinctivement et sans doute un peu vite entre l'art et l'économie marchande, à l'existence d'une multitude de disciplines artistiques différentes, s'adressant des publics, en passant par le caractère de bien public de l'oeuvre, par les formes très particulières que peut revêtir sa consommation et par la présence sous-jacente, anticipée, des générations futures, notamment dans les règles juridiques et (...) l'action de la puissance publique. La place, aujourd'hui prépondérante, prise de longue date par la collectivité dans ce mouvement, justifie que l'on parle de service public culturel et que l'on s'interroge sur la place faite à l'art dans les sociétés du xxe siècle finissant.
