Should decision-making algorithms be held to higher standards of transparency than human beings? The way we answer this question directly impacts what we demand from explainable algorithms, how we govern them via regulatory proposals, and how explainable algorithms may help resolve the social problems associated with decision making supported by artificial intelligence. Some argue that algorithms and humans should be held to the same standards of transparency and that a double standard of transparency is hardly justified. We give two arguments (...) to the contrary and specify two kinds of situations for which higher standards of transparency are required from algorithmic decisions as compared to humans. Our arguments have direct implications on the demands from explainable algorithms in decision-making contexts such as automated transportation. (shrink)

In this paper, we propose a regularity theory of causation. The theory aims to be reductive and to align with our pre‐theoretic understanding of the causal relation. We show that our theory can account for a wide range of causal scenarios, including isomorphic scenarios, omissions, and scenarios which suggest that causation is not transitive.

Recent work by philosophers of mind and psychology on nonconceptual content.

We aim to devise a Ramsey test analysis of actual causation. Our method is to define a strengthened Ramsey test for causal models. Unlike the accounts of Halpern and Pearl ([2005]) and Halpern ([2015]), the resulting analysis deals satisfactorily with both over- determination and conjunctive scenarios.

Any satisfactory model of the emotions must at once recognize their place within intentional psychology and acknowledge their uniqueness as mental causes. In the first half of the century, the James-Lange model had considerable influence on reinforcing the idea that emotions are non-intentional (see Lange 1885 and James 1890). The uniqueness of emotions was therefore acknowledged at the price of denying them a place within intentional psychology proper. More recently, cognitive reductionists (including identity theorists) like Robert Solomon and Joel Marks (...) recognize that emotions are intentional but, by reducing them to judgments, beliefs, desires, etc., fail to capture their distinctiveness as mental causes (see Solomon 1976 and Marks 1982). In other words, their place within intentional psychology is acknowledged at the price of denying them their uniqueness. (shrink)

In this paper, we analyse actual causation in terms of production. The latter concept is made precise by a strengthened Ramsey Test semantics of conditionals: \ iff, after suspending judgement about A and C, C is believed in the course of assuming A. This test allows us to verify or falsify that an event brings about another event. Complementing the concept of production by a weak condition of difference-making gives rise to a full-fledged analysis of causation.

We define a formal semantics of conditionals based on _normatively ideal worlds_. Such worlds are described informally by Armgardt (Gabbay D, Magnani L, Park W, Pietarinen A-V (eds) Natural arguments: a tribute to john woods, College Publications, London, pp 699–708, 2018) to address well-known problems of the counterfactual approach to causation. Drawing on Armgardt’s proposal, we use iterated conditionals in order to analyse causal relations in scenarios of multi-agent interaction. The well-known formal semantics of conditionals due to Stalnaker Studies in logical theory, Blackwell, Oxford, 1968), Lewis, and Gärdenfors The logic and 1140 epistemology of scientific change, North-Holland, Amsterdam, 1978, Knowledge in flux, MIT Press, Cambridge, 1988) all fail to distinguish between trivially and nontrivially true indicative conditionals. This problem has been addressed by Rott :345–370, 1986) in terms of a strengthened Ramsey Test. In this paper, we refine Rott’s strengthened Ramsey Test and the corresponding analysis of explanatory relations. In this paper, we put forth an analysis of sensitivity which aims to discern individual from merely statistical evidence. We argue that sensitivity is not to be understood as a factive concept, but as a purely epistemic one. Our resulting analysis of epistemic sensitivity gives rise to an account of legal proof on which a defendant is only found liable based on epistemically sensitive evidence.

We put forth an account for when to believe causal and evidential conditionals. The basic idea is to embed a causal model in an agent’s belief state. For the evaluation of conditionals seems to be relative to beliefs about both particular facts and causal relations. Unlike other attempts using causal models, we show that ours can account rather well not only for various causal but also evidential conditionals.

We put forth an analysis of causation. The analysis centers on the notion of a causal model that provides only partial information as to which events occur, but complete information about the dependences between the events. The basic idea is this: an event causes another just in case there is a causal model that is uninformative on both events and in which the first event makes a difference as to the occurrence of the other. We propose a semantics for a connexive conditional based on the Lewis-Stalnaker conditional. It is a connexive semantics that is both classical and intuitive.

This article argues that legal proof should be tantamount to justified belief of guilt. A defendant should be found guilty just in case it is justified to believe that the defendant is guilty. My notion of justified belief implies a threshold view on which justified belief requires high credence, but mere statistical evidence does not give rise to justified belief.

We propose a method of learning indicative conditional information. An agent learns conditional information by Jeffrey imaging on the minimally informative proposition expressed by a Stalnaker conditional. We show that the predictions of the proposed method align with the intuitions in Douven, 239–263 2012)’s benchmark examples. Jeffrey imaging on Stalnaker conditionals can also capture the learning of uncertain conditional information, which we illustrate by generating predictions for the Judy Benjamin Problem.

One of the open questions in Bayesian epistemology is how to rationally learn from indicative conditionals (Douven, 2016). Eva et al. (Mind 129(514):461–508, 2020) propose a strategy to resolve this question. They claim that their strategy provides a “uniquely rational response to any given learning scenario”. We show that their updating strategy is neither very general nor always rational. Even worse, we generalize their strategy and show that it still fails. Bad news for the Bayesians.

In the third and fourth parts of the book, Günther shows--in debate with Hare, Dworkin, and others--how argumentation on the appropriate application of norms and principles in morality and law is possible.

In this paper, we propose a unified account of conditionals inspired by Frank Ramsey. Most contemporary philosophers agree that Ramsey’s account applies to indicative conditionals only. We observe against this orthodoxy that his account covers subjunctive conditionals as well—including counterfactuals. In light of this observation, we argue that Ramsey’s account of conditionals resembles Robert Stalnaker’s possible worlds semantics supplemented by a model of belief. The resemblance suggests to reinterpret the notion of conditional degree of belief in order to overcome a (...) tension in Ramsey’s account. The result of the reinterpretation is a tenable account of conditionals that covers indicative and subjunctive as well as qualitative and probabilistic conditionals. (shrink)

Mit seinem epochalen Werk »Idee und Grundriß einer nicht-Aristotelischen Logik« (1959) legte Gotthard Günther (1900–1984) den Grundstein für eine radikal neue Form der philosophischen Betrachtung der ontologischen Einheit des Universums, deren Richtigkeit heute (auch unabhängig von Günther und in der Regel auf ungleich niedrigerem Niveau) von den Wissenschaften bestätigt wird (so z.B. in der Chaos-Forschung). Gegen die klassische (aristotelische) Logik, die nur zweiwertige Entscheidungen für verbindlich hält (eine Behauptung ist entweder wahr oder falsch), zeigt Günther auf, daß die – mathematisch (...) widerspruchsfrei formulierbare – mehrwertige Logik auch auf dem Gebiet der Ontologie, d.i. der Erfassung der Grundstrukturen des natürlichen Universums und des gesellschaftlichen Dialogs zwischen dem Ich und dem Du, Erkenntnismöglichkeiten eröffnet, die das Limit des klassischen Denkens rational überwinden. Theories of embodied cognition assume that concepts are grounded in non-linguistic, sensorimotor experience. In support of this assumption, previous studies have shown that upwards response movements are faster than downwards movements after participants have been presented with words whose referents are typically located in the upper vertical space. This is taken as evidence that processing these words reactivates sensorimotor experiential traces. This congruency effect was also found for novel words, after participants learned these words as labels for novel objects that (...) they encountered either in their upper or lower visual field. While this indicates that direct experience with a word's referent is sufficient to evoke said congruency effects, the present study investigates whether this direct experience is also a necessary condition. To this end, we conducted five experiments in which participants learned novel words from purely linguistic input: Novel words were presented in pairs with real up- or down-words ; they were presented in natural sentences where they replaced these real words ; they were presented as new labels for these real words ; and they were presented as labels for novel combined concepts based on these real words. In all five experiments, we did not find any congruency effects elicited by the novel words; however, participants were always able to make correct explicit judgements about the vertical dimension associated to the novel words. These results suggest that direct experience is necessary for reactivating experiential traces, but this reactivation is not a necessary condition for understanding the corresponding aspects of word meaning. Driven by privacy-related fears, users of Online Social Networks may start to reduce their network activities. This trend can have a negative impact on network sustainability and its business value. Nevertheless, very little is understood about the privacy-related concerns of users and the impact of those concerns on identity performance. To close this gap, we take a systematic view of user privacy concerns on such platforms. Based on insights from focus groups and an empirical study with 210 subjects, we find (...) that (i) Organizational Threats and (ii) Social Threats stemming from the user environment constitute two underlying dimensions of the construct Privacy Concerns in Online Social Networks . Using a Structural Equation Model, we examine the impact of the identified dimensions of concern on the Amount, Honesty, and Conscious Control of individual self-disclosure on these sites. We find that users tend to reduce the Amount of information disclosed as a response to their concerns regarding Organizational Threats. Additionally, users become more conscious about the information they reveal as a result of Social Threats. Network providers may want to develop specific mechanisms to alleviate identified user concerns and thereby ensure network sustainability. (shrink)

The author introduces a normative conception of coherence, derived from a pragmatic interpretation of the application of norms to concrete cases. A distinction is made between the justification of a norm and its application. In the case of moral norms, justification and application can be analysed as two different discursive procedures which give rise to different aspects of the principle of impartiality. Impartial justification requires a procedure by which all interests concerned are taken into account whereas impartial application requires a (...) procedure where all features of a situation are considered. The complete description of a concrete case makes necessary a coherent interpretation of all the valid norms which are prima facie applicable. This requirement of an ideal coherent system of norms is restricted to interpretive “paradigms” in the case of legal norms, because it is necessary to produce singular judgments under the restrictive conditions of scarce time and incomplete knowledge. In this paper the author criticizes the way Robert Alexy reconstructs the relationship between legal and practical reasoning. The core of Alexy's argumentation (Alexy 1978) is considered the claim that legal argumentation is a “special case” of general practical discourse. In order to question this claim, the author analyzes three different types of argument: (1) that legal reasoning is needed by general practical discourse itself, (2) that there are similarities between legal argumentation and general practical discourse, (3) that there is (...) a correspondence between certain types of argument in general practical discourse and in legal argumentation.**. In this paper, we develop a non-reductive variant of the regularity theory of causation proposed in Andreas and Günther (Pacific Philosophical Quarterly 105: 2–32, 2024). The variant is motivated as a refinement of Lewis’s (Journal of Philosophy 70:556–567, 1973) regularity theory. We do not pursue a reductive theory here because we found a challenge for Baumgartner's (Erkenntnis 78:85–109, 2013) regularity theory which applies to our previous theory as well. The challenge is sidestepped by a framework of law-like propositions resembling structural (...) equations. We furthermore improve the deviancy condition of our previous theory. Finally, we show that the present theory can compete with the most advanced regularity and counterfactual accounts. (shrink)

I confront Feyerabend's position and critical rationalism in order to have a foundation or starting point for my (historical) investigation. The main difference of his position towards falsificationism is the belief that different theories cannot be discussed rationally. Feyerabend is convinced that Galilei's observations with the telescope in the historical context of the Copernican revolution supports his criticism. In particular, he argues that the Copernican theory was supported by deficient hypotheses, and falsifications were disposed by ad hoc hypotheses and propaganda. (...) Furthermore, he claims that his philosophy of science reconstructs Galilei's defence of the Copernican theory. He introduces a central principle of his position (the principle of tenacity) in order to justify a research strategy of not eliminating falsified theories. He tries to show that the tenacious defence of a theory corresponds to Galilei's defence of the Copernican theory. Remarkably, Feyerabend's approach to explain the development of science earns an important support from his interpretation of Galilei's observations. On this basis I give a falsificationist interpretation of Galilei's observations with the telescope, and oppose this interpretation to Feyerabend's. From a falsificationist perspective, auxiliary hypotheses compete during the Copernican revolution which can (with some effort) be critically discussed. Then I analyse the historical case in order to test Feyerabend's interpretation of the Copernican revolution. Inter alias I investigate thoroughly whether Galilei, as Feyerabend claims, immunised falsifications of the Copernican theory by the introduction of ad hoc hypotheses. The investigation considers Galilei's explanation of Venus' phases, his establishment of the irradiation hypothesis, the explanation of the telescope's functionality, and the role of the reproducibility of the observations with the telescope. Finally I provide a rational reconstruction of Galilei's falsification of the Ptolemaic theory. The formalisation shows that Galilei was not a cautious critical rationalist, but a very confident scientist using the method of falsification. (shrink)

Die Autoren berichten über die erste kontrollierte Psychotherapiestudie, die psychoanalytische und kognitiv-verhaltenstherapeutische Langzeitpsychotherapien mit randomisierter und präferierter Zuweisung mit­einander vergleicht. In vier Behandlungszentren wurden 554 chronisch depressive Patienten interviewt, von denen 252 in die Studie aufgenommen werden konnten. In den Selbsteinschätzungen der Patienten zeigten sich große und stabile Veränderungen. Die vollständige Remissionsrate (für BDI) lag nach einem Jahr bei 34 % und stieg auf 45 % nach drei Jahren. Analoge Ergebnisse zeigten sich in den Einschätzungen der unabhängigen, bezogen auf die (...) Therapieverfahren verblindeten Rater (QIDS). Entgegen ihrer Hypothesen fanden die Autoren aber keinen statistisch signifikanten Unterschied zwischen den Verfahren und auch keine Effektunterschiede zwischen randomisierter Therapiezuweisung und Behandlung mit der präferierten Psychotherapie. Besser als in anderen Studien sind die erzielten Remissionsraten, die zeigten, dass chronisch depressive Patienten von Langzeitpsychotherapien profitieren. (shrink)

In legal proceedings, a fact-finder needs to decide whether a defendant is guilty, or not, based on probabilistic evidence. We defend the thesis that the defendant should be found guilty just in case it is rational for the fact-finder to believe that the defendant is guilty. We draw on Leitgeb’s stability theory for an appropriate notion of rational belief and show how our thesis solves the problem of statistical evidence. Finally, we defend our account of legal proof against challenges from (...) Staffel and compare it to a recent competitor put forth by Moss. (shrink)

Philosophers of mind have recently sought to establish a theoret- ical use for nonconceptual content. Although there is disagreement about what nonconceptual content is supposed to be, this much is clear. A state with nonconceptual content is mental. Hence, while one may deny that refrigerators and messy rooms have conceptual capacities, their states, as physical and not mental, do not have nonconceptual content. A state with nonconceptual content is also intentional, which is to say that it represents a feature of (...) the world for a subject. It may be tempting to think of qualitative states as having nonconceptual content since they can be experienced by indi- viduals independently of their possession of the requisite concepts, e.g. someone could experience pains, itches or tingles without possessing the concept pain, itch or tingle. But on such a view, one would have to assume that qualitative states are representational since mental states cannot be candidates for nonconceptuality unless they have intentional properties.2. Neste artigo quer-se delinear o conceito de competência discursiva como um caso especial de competência comunicativa, tanto quanto o Discurso é um caso especial de agir comunicativo. Parte-se da discussão de competência dentro do processo de aprendizagem e do desenvolvimento moral, e dentro dela a competência linguística e a competência comunicativa. Faz-se o desenvolvimento da noção de competência discursiva como capacidade de argumentar racionalmente, de reconhecer o outro e os seus argumentos e de fazer acordos em torno do melhor argumento. (...) Inclui também a capacidade de universalizar o processo argumentativo. O desenvolvimento da competência discursiva está vinculado ao desenvolvimento moral de indivíduos, grupos sociais e sociedade. The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

This special issue on affordances bases on the thesis, that all natural and artificial things inhere affordances that appeal to our cognitive system, and thus invite us to look at them, perceive them, think about them, interpret them, and use them. The concept roots in the studies of the American psychologist James J. Gibson from the 1960s. According to him, "things" offer a certain range of possible activities depending on their form, time patterns, and material qualities, thus becoming part of (...) human-thing-interactions. However, affordances can also be culturally trained. This aspect has been intensively discussed subsequently within different disciplines (e.g., Social Sciences, Design Studies). But only recently has the concept received attention in the field of Visual Culture Studies particularly through archaeological scholarship. (shrink)
