Summary The need for education in moral values is increasingly being recognised today, but how is it to be conducted in schools? In particular we consider the appropriateness or otherwise of a teacher assuming the role of a neutral chairperson in discussion. Advocacy of such a stance is especially associated with Lawrence Stenhouse who saw neutrality as a procedural device in order to empower students? own involvement. We point out many of the insights of Stenhouse's approach, but also some of (...) its disadvantages which subtly encourage a popularist form of relativism. We suggest the substitution of procedural neutrality with a different approach, that of critical affirmation. Here the teacher advocates a stance alongside everyone else. This, however, is done in a way that affirms pupils, and their right to personal views, whilst subjecting all views, including the teacher's own, to a close scrutiny, especially regarding implications for the views of others. Although the use of arbitration has become commonplace in the organizational world, the ethical issues surrounding arbitration have never been fully explored. The paper reviews ethical issues in arbitration, particularly in terms of forensic bias parallels, that may affect decision-making and make the arbitrator''s decision questionable. Finally, the maintenance of fairness in the arbitration process, and the importance of an ethically acceptable system of organizational justice are also discussed.

In this imaginative and provocative book, Barbara Goodwin explores the question of how lottery systems can achieve egalitarian social justice in societies with seemingly ineradicable inequalities. She begins with the utopian fable of Aleatoria, a country not unlike our own in the not-too-distant-future, where most goods are distributed by lottery--even the right to have children. She then analyzes the philosophical arguments for and against lottery distribution and a comparison of "justice by lottery" with other contemporary theories of justice. (...) class='Hi'>Goodwin also applies her theory to practical problems in the real world which could be--or have been--justly resolved by the use of lotteries, such as military drafts, jury duty, and immigration eligibility. She demonstrates that in many areas, including that of political power, a regular and random reallocation of goods would be a fairer and more democratic method than the distributive systems found in liberal democracies today. Douglas Walton has been right in calling us to attend to the pragmatics of argument. He has, however, also insisted that arguments should be understood and assessed by considering the functions they perform; and from this, I dissent. Argument has no determinable function in the sense Walton needs, and even if it did, that function would not ground norms for argumentative practice. As an alternative to a functional theory of argumentative pragmatics, I propose a design view, which draws attention to (...) the way participants strategically undertake and impose norms on themselves in order for their arguments to have force. Professor Brian Goodwin (1931-2007) was a visionary biologist, mathematician and philosopher. Understanding organisms as dynamics wholes, he worked to develop an alternate view to extreme Darwinism based solely on genetic factors. He was a pioneer in the field of theoretical biology.

In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. This collection addresses whether ethicists, like authorities in other fields, can speak as experts in their subject matter. Though ethics consultation is a growing practice in medical contexts, there remain difficult questions about the role of ethicists in professional decision-making. Contributors examine the nature and plausibility of moral expertise, the relationship between character and expertise, the nature and limits of moral authority, how one might become a moral expert, and the trustworthiness of moral testimony. This volume engages with the growing (...) literature in these debates and offers new perspectives from both academics and practitioners. The readings will be of particular interest to bioethicists, clinicians, ethics committees, and students of social epistemology. In the subsequent pages, I want to develop a distinction between wanting and valuing which will enable the familiar view of freedom to make sense of the notion of an unfree action. The contention will be that, in the case of actions that are unfree, the agent is unable to get what he most wants, or values, and this inability is due to his own "motivational system." In this case the obstruction to the action that he most wants to do (...) is his own will. Since the 1970s Gary Watson has published a series of brilliant and highly influential essays on human action, examining such questions as: in what ways are we free and not free, rational and irrational, responsible or not for what we do? Moral philosophers and philosophers of action will welcome this collection, representing one of the most important bodies of work in the field.

Prior research on the psychology of retribution is complicated by the difficulty of separating retributive and general deterrence motives when studying human offenders . We isolate retribution by investigating judgments about punishing animals, which allows us to remove general deterrence from consideration. Studies 2 and 3 document a “victim identity” effect, such that the greater the perceived loss from a violent animal attack, the greater the belief that the culprit deserves to be killed. Study 3 documents a “targeted punishment” effect, (...) such that the responsive killing of the actual “guilty” culprit is seen as more deserved than the killing of an almost identical yet “innocent” animal from the same species. Studies 4 and 5 extend both effects to participants' acceptance of inflicting pain and suffering on the offending animal at the time of its death, and show that both effects are mediated by measures of retributive sentiment, and not by consequentialist concerns. Nicolas Abraham (1919–75) rethinks the symbol as the very fabric of being. The author examines how this notion challenges the limitations of Husserl’s phenomenology and its reliance on a transcendental ego that can apprehend hyletic data in its purity. For Abraham, the symbol is worldly and resonates with its emergence from intersubjective foundations to constitute subjectivity impurely as a Dyad. It is born from trauma, a cut that differentiates Ego from Other but also generates anxiety (and Time) to keep its (...) operation unfinished. This projection into the future implicates intention (agency) that builds upon origins that are opaque and immemorial. Abraham denotes this origin as the Arche, conceiving of it as a primary symbolism that renders the traumatic cut but without temporal or structural guarantee. It is a beginning that is beyond the phenomenal, requiring exploration through a radical transphenomenological perspective derived from psychoanalysis. Here, trauma is both the debilitation of the symbol and (potentially) the impetus for its transformation, (re)iterating structures of subjectivity that have greater complexity and degrees of freedom. This is, of course, as circumstances allow. Abraham’s construction of symbolic subjectivity is stratified as the symbol negotiates levels of existence from basic Ego-integration to sophisticated social organizations, none of which can individually capture its operation. The journey to a fulfilling existence is riddled with obstructions that could be physiological, relational, cultural or otherwise. The author highlights this multivalence as a complexity that must be carefully navigated – especially when there is suffering – by attending to the symbol and its resonances where creative transformations cannot be mapped in advance. As machine learning has gradually entered into ever more sectors of public and private life, there has been a growing demand for algorithmic explainability. How can we make the predictions of complex statistical models more intelligible to end users? A subdiscipline of computer science known as interpretable machine learning (IML) has emerged to address this urgent question. Numerous influential methods have been proposed, from local linear approximations to rule lists and counterfactuals. In this article, I highlight three conceptual challenges that (...) are largely overlooked by authors in this area. I argue that the vast majority of IML algorithms are plagued by (1) ambiguity with respect to their true target; (2) a disregard for error rates and severe testing; and (3) an emphasis on product over process. Each point is developed at length, drawing on relevant debates in epistemology and philosophy of science. Examples and counterexamples from IML are considered, demonstrating how failure to acknowledge these problems can result in counterintuitive and potentially misleading explanations. Without greater care for the conceptual foundations of IML, future work in this area is doomed to repeat the same mistakes. (shrink)

In this paper I propose to continue the analysis of the appeal to authority begun at the last OSSA conference. I proceed by examining the well-documented use of the appeal made by the ancient Roman advocate, Cicero. The fact that Cicero expressed his opinion was expectably sufficient to give his auditors--responsible citizens all--reason to do as he desired. But why? The resolution of this puzzle points to a strong sense in which arguments can be called rhetorical , for the rational (...) force of Cicero's authority depends necessarily on what he says. (shrink)

The provider–patient relationship is typically regarded as an expert-to-novice relationship, and with good reason. Providers have extensive education and experience that have developed in them the competence to treat conditions better and with fewer harms than anyone else. However, some researchers argue that many patients with long-term conditions (LTCs), such as arthritis and chronic pain, have become “experts” at managing their LTC. Unfortunately, there is no generally agreed-upon conception of “patient expertise” or what it implies for the provider–patient relationship. I (...) review three prominent accounts of patient expertise and argue that all face serious objections. I contend, however, that a plausible account of patient expertise is available and that it provides a framework both for further empirical studies and for enhancing the provider–patient relationship. This paper evaluates a general argument for the conclusion that visual representations in science must play the role of truth bearers if they are to figure as legitimate contributors to scientific arguments and explanations. The argument is found to be unsound. An alternative approach to assessing the role of visual representations in science is exemplified by an examination of the role of structural formulas in organic chemistry. Structural formulas are found not to play the role of truth bearers; nonetheless, they (...) contribute to the arguments and explanations of organic chemistry. In a previous article, we projected the future accumulation of profiles belonging to deceased users on Facebook. We concluded that a minimum of 1.4 billion users will pass away before 2100 if Facebook ceases to attract new users as of 2018. If the network continues expanding at current rates, on the other hand, this number will exceed 4.9 billion. Although these findings provided an important first step, one network alone remains insufficient to establish a quantitative foundation for further macro-level analysis (...) of the phenomenon of online death. Facebook is but one social media platform among many, and hardly the most representative in terms of their policy on deceased users. In this study, we use the same methodology to develop a complementary analysis of projected mortality on Instagram. Our models indicate that somewhere between 767 million and 4.2 billion Instagram users will die between 2019 and 2100, depending on the network’s future growth rate. Although the number of deceased Instagram profiles will likely be fewer than those on Facebook, we argue that they are nonetheless part of a shared digital cultural heritage, and should hence be curated with careful consideration. This paper was inspired by the author’s fortunate acquisition of a copy of an original copy of “Muspratt’s Chemistry” that was published in 1860. This raised, for the author, interesting and significant issues regarding the chemistry content and its presentation in the context of chemistry and education today. The paper is presented in two parts: Part 1 explores the content, structure and gives reactions to and insights into the original publication, whereas Part 2 provides a focus on the developments in (...) chemistry education as experienced by the author during almost 70 years of learning and teaching chemistry in schools and in teacher education in England. James Sheridan Muspratt is best remembered for this publication which is fully entitled “Chemistry, theoretical, practical and analytical as applied and relating to Arts and Manufactures”. This was developed during the period 1852–1860 and ran into several editions as well as being translated into German and Russian. Earlier he had done chemistry research with Liebig and Hofmann, and in 1848 he founded the Liverpool College of Chemistry. It is clear that he corresponded extensively with many of the leading nineteenth century chemists in the UK and Europe, many of whose names are still familiar with us today. (shrink)
