It is argued that a certain form of the view that the semantic paradoxes show that natural languages are "inconsistent" provides the best response to the semantic paradoxes. After extended discussions of the views of Kirk Ludwig and Matti Eklund, it is argued that in its strongest formulation the view maintains that understanding a natural language is sharing cognition of an inconsistent semantic theory for that language with other speakers. Descartes says that the Meditations contains the foundations of his physics. But how does the work advance his geometrical view of the corporeal world? His argument for this view of matter is often taken to be concluded with the proof of the existence of bodies in the Sixth Meditation. This paper focuses on the work that follows the proof, where Descartes pursues the question of what we should think about qualities such as light, sound and pain, as well as the (...) size and shape of particular bodies. His inquiry makes crucial use of the notion of a teaching of nature originating from God, as contrasted with an apparent teaching of nature originating from habit. I attempt to reconstruct Descartes's use of these notions in order to clarify the way in which he makes space for his geometrical conception of the corporeal world. (shrink)

Business ethics have become an important topic globally for both policy-makers and businesses. This paper first discusses the conceptual framework for business ethics followed by ethical management (EM) and corporate social responsibility (CSR) as well as relevant theories. Within this conceptual framework, Korea is used as a country context as to the development of EM and CSR. An important example of an ethical scandal is the major steel manufacturer, POSCO as it was held up as an exemplar and role model (...) of ethical management. However, in 2015, it faced allegations that the engineering and construction overseas unit chief of its Vietnamese subsidiary created a slush fund by overstating payments to Vietnamese contractors. This conceptual paper discusses the factors that created this situation referring to the theory of connection. It locates the case in the EM and CSR literature and analyses what went wrong and what the parent company could have done to prevent this from happening. (shrink)

Doctor/patient sexual contact has become a focal ethical issue of the 1990s. Guidelines or codes of ethics have been issued by various Medical Boards, prohibiting or regulating such conduct In some jurisdictions in Australia and elsewhere, such conduct has been deemed an offence under certain conditions. Mandatory reporting provisions may also apply. A clear profile of offending doctors and their areas of specialisation is emerging from various studies. The patient profile is less clear. The potential for harm to both the (...) patient and the offending doctor is an issue of concern, as is the apparently ineffective role of education in changing some doctor’s behaviour. It is common for drug trials to exclude older people, usually over 65 or 70. Many of the drugs which are successfully tested are then registered and become available either on prescription or over the counter. Healthcare professionals are left in a bind: either they do not prescribe the medications to those in the excluded age groups because of the lack of age-relevant data, or they prescribe, off-label, despite the lack of systematic collection of age-relevant data. Alternatively, if the pharmaceutical (...) is available without prescription, older people may be buying without any inkling or warning that the drug was never tried on people of their own age. Either way, our older fellow citizens are not getting the same ethical treatment as younger adults. Compounding the questionable ethics involved is the fact that as age increases, the ratio of women to men increases. Amplified by the fact that women consume more pharmaceuticals than do men, the discrimination takes on a distinctly sexist slant as well as an ageist one.Two other groups often excluded from trials are (a) minors and (b) pregnant or lactating women. But the rationale for their exclusion is different from that for the exclusion of seniors. A major reason for these two groups’ exclusion is the legal incapacity of the young to consent and the concomitant flow-on liability for injuries and damages to the youngsters. The potential exposure to later legal claims may be a strong motivating force for pharmaceutical companies to exclude from their trials people without legal capacity to consent. But the third group of people, seniors, is excluded by reference to their seniority not their inability to give informed consent. While the other two exclusions can be explained in terms of moral, social and legal conventions, seniority alone is based on two practical concerns: firstly, whether seniors are likely to die before the end of the trial, and secondly, the compounding effects of the so-called diseases of old age. Together, these concerns are thought to justify seniority exclusion in the interests of clean science. This paper explores some of the ethical issues, the implicit ageism and sexism in the exclusion of seniors. The discussion considers the ethical consequences of the exclusion, where seniors are either taking drugs in the absence of evidence-based trials on their age groups, or are denied drugs because they are untried on the age groups. Intersectional feminist scholars emphasize how overlapping systems of oppression structure gender inequality, but in focusing on the gendered, classed, and racialized bases of stratification, many often overlook disability as an important social category in determining economic outcomes. This is a significant omission given that disability severely limits opportunities and contributes to cumulative disadvantage. We draw from feminist disability and intersectional theories to account for how disability intersects with gender, race, and education to produce economic insecurity. The findings from our analyses (...) of 2015 American Community Survey data provide strong empirical support for hierarchies of disadvantage, where women and racial minority groups with disabilities and less education experience the highest poverty levels, report the lowest total income, and have a greater reliance on sources outside the labor market for economic security. By taking disability into account, our study demonstrates how these multiple characteristics lead to overlapping oppressions that become embedded and reproduced within the larger social structure. In the contemporary fear of death literature, few if any discuss what implications insights from the philosophical literature on emotions might have for arguments about the fear of death’s rationality. I remedy that here. I discuss two types of arguments to conclusions about the fear of death’s rationality. One type is Badness Arguments. The other is Epicurean Arguments. Both argument types have contradictory conclusions. Both employ different conditional claims as their crucial premise. And both presuppose that there is some relation (...) between the fear of death’s rationality and the value of death. I argue these arguments share another feature: they are unsound. This is because the crucial premise of each argument type is false given some plausible analyses of the several conceptions of emotional rationality found in the fear of death literature, analyses that themselves follow from several ubiquitous assumptions about the nature of emotions. In her 2007 paper, “Argument Has No Function” Jean Goodwin takes exception with what she calls the “explicit function claims”, arguing that not only are function-based accounts of argumentation insufficiently motivated, but they fail to ground claims to normativity. In this paper I stake out the beginnings of a functionalist answer to Goodwin.

The karma-rebirth doctrine is one of the core doctrines of the Buddhist worldview. Some forms of Western Buddhism emphasize doctrinal study and meditation practice over traditional Buddhist elements that have their foundation in the karma-rebirth doctrine, such as merit-making practices and other forms of ritual. Conversely, the worldwide Gelugpa Tibetan Buddhist Foundation for the Preservation of the Mahayana Tradition (FPMT) encourages its affiliates to perform traditional ritual such as chanting and pujas to make merit for oneself and others, in addition (...) to attending teachings and developing a regular meditation practice. During their exploration of the FPMT's activities, participants undergo a process of experimental validation of the teachings and practices, in which they come to accept doctrinal notions in one of two ways: the notion's capacity to validate and give meaning to personal experience, or to lend conceptual support to the newly acquired framework of ideas. Utilizing data obtained from fieldwork undertaken between 2003 and 2006 at Vajrayana Institute (VI), an FPMT centre in Sydney, Australia, I illustrate the way in which the karma-rebirth doctrine supports those aspects of the belief-system more capable of experiential validation through their capacity to frame and give meaning to personal experience. The acceptance of notions such as karma, rebirth and merit-making involves an interpretive shift from previously held notions about cause and effect and the nature of this-worldly existence, toward a Buddhist appreciation of these concepts. This paper explores ethical challenges encountered when conducting research about, and telling, the stories of individuals who had died before the research began. Cases were explored where individuals who lived alone had died alone at home and where their bodies had been undiscovered for an extended period. The ethical review process had not had anything significant to say about the deceased ‘participants’. As social researchers we considered whether it was ethical to involve deceased people in research when they had no (...) opportunity to decline, and we were concerned about how to report such research. The idea that the dead can be harmed did not help our decision-making processes, but the notion of the dead having limited human rights conferred upon them was useful and aided us in clarifying how to conduct our research and disseminate our findings. Wittgenstein's distinction between understanding and interpretation is fundamental to the account of meaning in _Philosophical Investigations. In his discussion of rule-following, Wittgenstein explicitly rejects the idea that understanding or grasping a rule is a matter of interpretation. Wittgenstein explains meaning and rule-following in terms of action, rejecting both realist and Cartesian accounts of the mental. I argue that in his effort to employ Wittgenstein's views on meaning and rule-following, Professor Morawetz embraces the position Wittgenstein rejects. In the course of making (...) his case for law as a "deliberative practice", Professor Morawetz embraces interpretation as a fundamental element of human practices, thereby taking up precisely the view Wittgenstein rejects. Controversy has arisen of late over the claim that deflationism about truth requires that we explain meaning in terms of something other than truth-conditions. This controversy, it is argued, is due to unclarity as to whether the basic deflationary claim that a sentence and a sentence that attributes truth to it are equivalent in meaning is intended to involve the truth- predicate of the object language for which we develop an account of meaning, or is intended to involve the truth- (...) predicate of the metalanguage in which we develop an account of meaning. The former view is compatible with the truth-conditional theory of meaning for the object language, the latter is incompatible with it. However, the former view is also trivially true; hence we should endorse the claim that any form of deflationism worth being interested in is incompatible with understanding meaning truth-conditionally. With the goal of explaining the maldistribution of evil in the world, Asha Lancaster-Thomas has recently (2023) expounded upon the idea of a fluctuating maximal God (FMG) that she and others developed (Jeffrey et al. (2020)) from the idea of a maximal God originally proposed by Yujin Nagasawa ( 2017 ). Lancaster-Thomas uses this model to answer what I and my co-author, Daniel Linford, have called the problem of geography (Linford and Patterson (2015)). The problem of geography points to (...) the geographically unequal distribution of suffering in the world and argues that this aggravates the original problem of evil (POE) and undermines the primary theodicies offered as solutions to it. I subsequently (2021) added to this problem by pointing out that evil is also maldistributed across race, gender and time. This larger problem may be referred to as the problem of the distribution of evil (PODE). Lancaster-Thomas argues that the FMG, especially under her modified version, is not susceptible to the problem of geography or to temporal inequalities of well-being. In this article I will demonstrate how the FMG, even on Lancaster-Thomas? updated model, fails to undermine either the problem of geography or the more broadly conceived PODE. (shrink)

This article situates the work of East India Company servant Alexander Dow (1735–1779), principally his writings on the history and future state of India, in contemporary debates about empire, religion and enlightened government. To do so it offers a sustained analysis of his 1772 essay ‘A Dissertation Concerning the Origin and Nature of Despotism in Hindostan’, as well as his proposals for the restoration of Bengal, both of which played an influential part in shaping the preoccupations with Mughal history that (...) dominated the contemporary crisis in the Company’s legitimacy. By linking these texts to his earlier work on ‘Hindoo’ religion, it will argue that Dow’s analysis of the relationship between certain religious cultures and their civic qualities was rooted in a deist perspective. It doing so it restores the enlightenment components of Dow’s thought, and their impact on the ideology of empire, in a crucial period of British expansion in India. (shrink)
