This paper explores ethical challenges encountered when conducting research about, and telling, the stories of individuals who had died before the research began. Cases were explored where individuals who lived alone had died alone at home and where their bodies had been undiscovered for an extended period. The ethical review process had not had anything significant to say about the deceased ‘participants’. As social researchers we considered whether it was ethical to involve deceased people in research when they had no (...) opportunity to decline, and we were concerned about how to report such research. The idea that the dead can be harmed did not help our decision-making processes, but the notion of the dead having limited human rights conferred upon them was useful and aided us in clarifying how to conduct our research and disseminate our findings. Early in the Preface to Religion within the Limits of Reason Alone, Kant claims that “morality leads ineluctably to religion”. This thesis is hardly an innovation of the Religion. Again and again throughout the critical corpus, Kant argues that religious belief is ethically significant, that it makes a morally meaningful difference whether an agent believes or disbelieves. And yet these claims are surely among the most doubted of Kant's positions – and they are often especially doubted by readers who consider (...) themselves Kantians. That Kant of all people should have so cherished religion is perhaps surprising: his moral view enshrines the notion that moral worth arises solely form the “good will”, that is, from a will determined by the moral law. Kant claims to be able to deduce this law and to account for how it motivates without ever relying on religious propositions. Rather, he grounds morality in the conception of autonomy, in the absolutely free self-legislation of the moral principle. So why, after effecting this dramatic Copernican revolution in ethics, does Kant appear to backslide, insisting on the moral necessity of religious belief? (shrink)

Roughly 1.7 million people died in Cambodia from untreated disease, starvation, and execution during the Khmer Rouge reign of less than four years in the late 1970s. The regime’s brutality has come to be symbolized by the multitude of black-and-white mug shots of prisoners taken at the notorious Tuol Sleng prison, where thousands of “enemies of the state” were tortured before being sent to the Killing Fields. In Archiving the Unspeakable, Michelle Caswell traces the social life of these photographic (...) records through the lens of archival studies and elucidates how, paradoxically, they have become agents of silence and witnessing, human rights and injustice as they are deployed at various moments in time and space. From their creation as Khmer Rouge administrative records to their transformation beginning in 1979 into museum displays, archival collections, and databases, the mug shots are key components in an ongoing drama of unimaginable human suffering. Doctor/patient sexual contact has become a focal ethical issue of the 1990s. Guidelines or codes of ethics have been issued by various Medical Boards, prohibiting or regulating such conduct In some jurisdictions in Australia and elsewhere, such conduct has been deemed an offence under certain conditions. Mandatory reporting provisions may also apply. A clear profile of offending doctors and their areas of specialisation is emerging from various studies. The patient profile is less clear. The potential for harm to both the (...) patient and the offending doctor is an issue of concern, as is the apparently ineffective role of education in changing some doctor’s behaviour. The issue of sexual contact with former patients remains a grey area. (shrink)

It is common for drug trials to exclude older people, usually over 65 or 70. Many of the drugs which are successfully tested are then registered and become available either on prescription or over the counter. Healthcare professionals are left in a bind: either they do not prescribe the medications to those in the excluded age groups because of the lack of age-relevant data, or they prescribe, off-label, despite the lack of systematic collection of age-relevant data. Alternatively, if the pharmaceutical (...) is available without prescription, older people may be buying without any inkling or warning that the drug was never tried on people of their own age. Either way, our older fellow citizens are not getting the same ethical treatment as younger adults. Compounding the questionable ethics involved is the fact that as age increases, the ratio of women to men increases. Amplified by the fact that women consume more pharmaceuticals than do men, the discrimination takes on a distinctly sexist slant as well as an ageist one.Two other groups often excluded from trials are (a) minors and (b) pregnant or lactating women. But the rationale for their exclusion is different from that for the exclusion of seniors. A major reason for these two groups’ exclusion is the legal incapacity of the young to consent and the concomitant flow-on liability for injuries and damages to the youngsters. The potential exposure to later legal claims may be a strong motivating force for pharmaceutical companies to exclude from their trials people without legal capacity to consent. But the third group of people, seniors, is excluded by reference to their seniority not their inability to give informed consent. While the other two exclusions can be explained in terms of moral, social and legal conventions, seniority alone is based on two practical concerns: firstly, whether seniors are likely to die before the end of the trial, and secondly, the compounding effects of the so-called diseases of old age. Together, these concerns are thought to justify seniority exclusion in the interests of clean science. This paper explores some of the ethical issues, the implicit ageism and sexism in the exclusion of seniors. The discussion considers the ethical consequences of the exclusion, where seniors are either taking drugs in the absence of evidence-based trials on their age groups, or are denied drugs because they are untried on the age groups. Kant, it is argued, should not be read as defending the stark, metaphysics-laden formalism for which his (...) theory is so famous. Rather, the reinterpreters claim that the heart of Kantian practical philosophy is the absolute value of humanity, or human rational nature. Kant's ethics can thus be understood as a "theory of value," in which the singular value of our own end-setting capacity as rational agents is taken as supreme, or even as the source of all value. On this reading, morality is just acting in such a way that respects or promotes the value of humanity. Moreover, this value may be deduced through an immanent, regressive argument about the conditions of practical agency as such, according to which any adequate conception of ourselves as agents commits us, finally, to moral norms. The consequences of this approach to Kantian ethics for such central issues as the doctrine of transcendental freedom, ethical formalism, the meaning of Kantian deontology, and indeed the very picture of human moral life for which Kant's theory is meant to account are profound... The karma-rebirth doctrine is one of the core doctrines of the Buddhist worldview. Some forms of Western Buddhism emphasize doctrinal study and meditation practice over traditional Buddhist elements that have their foundation in the karma-rebirth doctrine, such as merit-making practices and other forms of ritual. Conversely, the worldwide Gelugpa Tibetan Buddhist Foundation for the Preservation of the Mahayana Tradition (FPMT) encourages its affiliates to perform traditional ritual such as chanting and pujas to make merit for oneself and others, in addition (...) to attending teachings and developing a regular meditation practice. During their exploration of the FPMT's activities, participants undergo a process of experimental validation of the teachings and practices, in which they come to accept doctrinal notions in one of two ways: the notion's capacity to validate and give meaning to personal experience, or to lend conceptual support to the newly acquired framework of ideas. Utilizing data obtained from fieldwork undertaken between 2003 and 2006 at Vajrayana Institute (VI), an FPMT centre in Sydney, Australia, I illustrate the way in which the karma-rebirth doctrine supports those aspects of the belief-system more capable of experiential validation through their capacity to frame and give meaning to personal experience. The acceptance of notions such as karma, rebirth and merit-making involves an interpretive shift from previously held notions about cause and effect and the nature of this-worldly existence, toward a Buddhist appreciation of these concepts. To his harshest critics, Kant's philosophy can seem an unending series of neglected alternatives. Time and again, Kant argues for his position by elimination, ruling out each possible alternative, until his own is the only one left standing. Of course, this strategy amounts to a demonstration of the Kantian position if and only if the field of possible alternatives really is – as Kant always assumes – exhaustive. But readers often suspect that Kant has stacked the deck, that his dogmatic (...) adherence to a particular set of presuppositions, or perhaps simply his lack of philosophical imagination, has unjustifiably restricted the possibilities under consideration, thereby rendering the alleged argument by elimination nothing but an elaborate exercise in question begging. Current assumptions and values with respect to management training for women are examined. A number of suggestions for change are made. The thrust of the changes will move us toward ensuring that education for women does not remain education for frustration, that is, education which gives women the desire for change in a world that remains the same.Many women have paid their dues, even a premium, for a chance at a top position, only to find a glass ceiling between them (...) and their goal. The glass ceiling is not simply a barrier for an individual, based on the person's inability to handle a higher-level job. In this article, we examine patterns of negotiation in multi-party decision making in social work. We draw on Strauss’ theory of negotiated order and a discourse analytical approach, seeking to gain insight into the complex accomplishment of making a decision in an inter-professional and multi-party setting. Working with data from 97 team meetings in a social work setting, we identify two patterns of negotiation in talk: expanding and postponing. ‘Expanding’ covers a group of interactional actions involving turn-taking and closure, while (...) ‘postponing’ includes a group of actions whereby assessments or topics are avoided or made irrelevant. Both are examples of the complex ways in which team members negotiate both the institutional order and the decision to be made in the specific case in situ. (shrink)

This paper develops a 'conceptual map' by which to chart contemporary developments in policy on school diversity. In part this has been prompted by the prospect in England of (private) Steiner schools becoming more closely involved in mainstream state-funded education. Whilst generated principally by policy developments within the UK, the conceptual thinking may also have wider applicability. We conceptualise diversity in the context of a differentiating public domain and a concern with existential questions which, arguably, persists in educational policy even (...) where narrow 'performative' criteria are dominant. Four diversity models are outlined and a policy path over time suggested in relation to these. We suggest that this may be leading towards diversity policy which affords greater recognition to different conceptions of valued learning and encourages co-operative exploration of these, though it is acknowledged that there remain strong contrary pressures. This paper is underpinned by an epistemological question: What are the types and ways of knowing that can be entailed in reflective leadership in its fullest sense? The question is explored through a mapping exercise which outlines a geography of reflective leadership in terms of three variables: type of knowledge, problem focus, and mode of learning (incorporating the notion of embodied learning). Particular attention is given to recognising within the terrain of reflective leadership the epistemic credentials of spiritual learning and (...) experiential awareness of spirituality. In the present article we consider general anesthesia as a means of exploring questions regarding unconscious influence. The primary questions addressed in the research are whether surgical patients who are under adequate general anesthesia unconsciously perceive auditory information and whether they can benefit from such information. In addition, we consider the relevance of individual hypnotic ability for perceptual processing in this context. Ninety-six adult patients, undergoing elective abdominal hysterectomy, were randomly allocated to one of four tape-recorded conditions: therapeutic suggestions, melodies, (...) suggestions-plus-melodies, or silence. Double-blind conditions were satisfied in every respect. Patients received a standardized, but typical, "balanced" anesthetic, and level of anesthesia was adequately monitored. Following surgery, all patients received their analgesic medication from a patient-controlled device. Patients who were played therapeutic suggestions used a significantly smaller dose of morphine than patients who were not played suggestions. Although hypnotic ability was not significantly associated with therapeutic outcome, high but not low hypnotizable patients accurately guessed whether they were played suggestions. No compelling evidence for memory of melodies was obtained. (shrink)

The counterfactual thinking cannot be only developed in early childhood, but it also could be a requirement for the causal reasoning. In this research a replica of German was made using counterfactual stories with Latin American kids between three and four years, demonstrating the possible main role counterfactual reasoning, by using computer animations. This was a different approach to the most recent made by Nyhout and Ganea. Nonetheless, the participants of the study evidenced counterfactual reasoning to the relevant choice and (...) the negative consequence conditions shown on the stories that represented the choices made by a starting role. Although some of the results were not totally conclusive under the analyzed conditions. Lastly, some possible not controlled effects are discussed from stories shown to the children, that could have motivated the counterfactual thinking. (shrink)
