ABSTRACT A common conclusion of lab dishonesty studies is that subjects cheat to a very modest extent even when they cannot get caught. The modest level of cheating is attributed to subjects’ moral feelings which restrict their cheating to a level that enables them to retain their self-image as honest individuals. The present paper questions this claim, reporting the results of two experiments which uncover a discrepancy between self-portrayed honesty and actual dishonest behavior. The experiments reveal, first, that self-portrayed honesty (...) is stricter than practical honesty, suggesting that when facing an opportunity to benefit from dishonest behavior, subjects trade off some of their self-image as honest persons for dishonestly-generated payoffs. Secondly, dishonesty out of lab, in subjects’ self-chosen environment, is greater than in the lab, with a considerable fraction of subjects cheating to the maximum extent possible. We suggest that it is not a concern about their self-image that holds subjects back from cheating maximally, but rather a concern about their social image. The modest level of dishonesty observed in the lab presumably reflects caution subjects exercise in an unsafe setup. Given an environment where they feel safe to reap the fruits of dishonesty without compromising their image as honest persons in the eyes of others, the image they have of themselves hardly plays a role in curbing their unethical behavior. The paper examines the conditions under which we are responsible for actions performed under duress, focusing on a real case in which a soldier was compelled at gunpoint to participate in the massacre of civilian prisoners. The case stands for a class of cases in which the compelled act is neither clearly justified nor clearly excused on grounds of temporary incapacity, but in which it is nonetheless plausible that the agent is not morally blameworthy. The theoretical challenge is to identify (...) the excuse in such cases and to explain its basis. The paper argues that when mortal duress excuses in cases of this sort, it does so because the compelled act, though impermissible and freely chosen, nonetheless fails to manifest ‘an insufficiently good will’. The argument depends on a potentially controversial thesis in the ethics of concern, namely, that a thoroughly decent moral agent—someone who cares enough about morality and the values that underlie it—will not always be moved to do what he knows he ought to do. When a person acts from ignorance, he is culpable for his action only if he is culpable for the ignorance from which he acts. The paper defends the view that this principle holds, not just for actions done from ordinary factual ignorance, but also for actions done from moral ignorance. The question is raised whether the principle extends to action done from ignorance about what one has most reason to do. It is tentatively proposed that the principle holds in full (...) generality. Magnetic resonance imaging (MRI) is an imaging technique with a rapidly expanding application range. This methodology, which relies on quantum physics and substance magnetic properties, is now being routinely used in the clinics and medical research. With the advent of measuring functional brain activity with MRI (functional MRI), this methodology has reached a larger section of the neuroscience community (e.g. psychologists, neurobiologists). In the past, the use of MRI as a biomarker or as an assay to probe tissue pathophysiological condition (...) was limited. However, with the new applications of MRI: molecular imaging, contrast‐enhanced imaging and diffusion imaging, MRI is turning into a powerful tool for in vivo characterization of tissue pathophysiology. This review focuses on the diffusion MRI. Although it only measures the averaged Brownian translational motion of water molecules, using different analysis schemes, one can extract a wide range of quantitative indices that represent tissue morphology and compartmentalization. Statistical and visualization routines help to relate these indices to biologically relevant measures such as cell density, water content and size distribution. The aim of this review is to shed light on the potential of this methodology to be used in biological research. To that end, this review is intended for the non‐MRI specialists who wish to pursue biological research with this methodology. Calls to ?build civil society?, ?create active citizenship?, ?empower communities?, or ?widen political participation? are growing by the day. They are heard in academia, the private sector, among NGOs and increasingly in government. In short, the rhetoric of self?government, that ideal dear to republicans, is back on the political agenda. This time, however, it is increasingly tied to the category of civil society. Yet can the programme of ?more power to civil society? really achieve democratic autonomy in the way that (...) many neo?republicans want it to? This article pursues this question, first, by reconstructing an ideal?type model of republican civil society from the writings of Hannah Arendt and Vaclav Havel ? two influential theorists of self?organisation in civil society. Second, it asks, sceptically, where such a civil society will come from, whether it can be fully reconciled with modernity and how ? if at all ? it can meet the charge of voluntarism. These critical interrogations are followed by a further three, focusing on the problematic absence of the market in the republican account of civil society, its under?theorised ? even Utopian ? notion of power and, finally, its likely complicity in the ongoing exclusion of women from the public sphere. The article concludes by calling for a more ambitious, wide?ranging vision of republican autonomy than the narrow emphasis on civil society will allow. (shrink)

In a recent paper, Dylan Evans proposed that emotions could help solve what has been known as ‘the frame problem’. In the process, he first questioned the utility of using the frame problem as a framework. After tackling this issue, he provided an alternative terminology to the frame problem—termed ‘the search hypothesis of emotion’—in order to re-examine how emotions aid rational agents. His new terminology, however, opens itself to other critiques. While accepting the basic tenets of his analysis, I question (...) (i) whether a single search theory of emotion is adequate, and (ii) whether his theory would have been better termed ‘the search hypothesis of feeling’. In this stimulating investigation, Gideon Freudenthal has linked social history with the history of science by formulating an interesting proposal: that the supposed influence of social theory may be seen as actual through its co herence with the process of formation of physical concepts. The reinterpre tation of the development of science in the seventeenth century, now widely influential, receives at Freudenthal's hand its most persuasive statement, most significantly because of his attention to the theoretical form which is charac (...) teristic. of classical Newtonian mechanics. He pursues the sources of the parallels that may be noted between that mechanics and the dominant philosophical systems and social theories of the time; and in a fascinating development Freudenthal shows how a quite precise method - as he descriptively labels it, the 'analytic-synthetic method' - which underlay the Newtonian form of theoretical argument, was due to certain interpretive premisses concerning particle mechanics. If he is right, these depend upon a particular stage of con ceptual achievement in the theories of both society and nature; further, that the conceptual was generalized philosophically; but, strikingly, Freudenthal shows that this concept-formation itself was linked to the specific social relations of the times of Newton and Hobbes. This chapter explores bridge-law non-naturalism: the view that when a particular thing possesses a moral property or stands in a moral relation, this fact is metaphysically grounded in non-normative features of the thing in question together with a general moral law. Any view of this sort faces two challenges, analogous to familiar challenges in the philosophy of science: to specify the form of the explanatory laws, and to say when a fact of that form qualifies as a law. This article argues that constitutional mixture should be regarded as an inherent, inevitable feature of constitutions, and to some degree all constitutions are mixed. Thus, “mixed constitutions” should not be regarded as a distinct category of constitutions. Instead of asking whether a constitution is mixed, it might therefore be more useful to ask in which characteristics and to what extent a constitution is mixed. To demonstrate this, the article provides a preliminary typology of constitutional mixture considering the form or system (...) of government; the nature or character of government; the religious or secular identity; the flexibility or rigidity of the constitution; and its model of judicial enforcement—judicial or parliamentary supremacy. Examining these constitutional features, allows to shed light on the three different dimensions of “constitutional mixture”: First, the various features of the constitutional order do not function in a binary yes-or-no manner but appear and move along a spectrum. Second, the various features of the constitution change with time. Third, the various features of the constitutional text may be in tension with the features of the society. (shrink)

This title was first published in 2002. This collection of essays aims to present a wide range of interpretations of central themes in Spinoza's philosophy. Philosophical interpretations of Spinoza divide into three general categories. The first sets Spinoza within what is taken to be his historical context. Special emphasis is laid here on aspects of his teaching that seem to bear the influence of Spinoza's own education (and self-education), either through concepts assimilated into his own thinking, or those he undertook (...) to refute and displace. A second interpretative approach uses analytical tools in an attempt to reconstruct Spinozistic issues and theories critically. Finally, there are philosophers who explore Spinoza's texts in their own terms, attempting to present a coherent picture of one or more aspects of Spinoza's teaching. Given the broad span of issues with which Spinoza deals, the latter is often the most difficult track to follow. The 25 articles in this collection exemplify these three attitudes to Spinoza interpretation, though most avail themselves of more than one. In making the selection the editors preferred studies that treat their subject as a viable, endurable philosophical issue, whether the writer accepts Spinoza's presentation or highlights his difficulties. On each issue the articles critically analyze the texts, rather than simply portraying the Spinozistic ideas they express. (shrink)

The ethics of hospitality – the welcome of the foreigner – is implied in all moral debate in international relations ranging from questions of asylum to those of humanitarian intervention. Why then has there been so little reflection on hospitality in the study of international relations to date? Seeking to correct this striking omission, and making an important and original contribution to debates about ethics in international relations in the process, Baker outlines a theory of cosmopolitanism as hospitality which goes (...) beyond existing cosmopolitanisms. He argues that we must understand cosmopolitanism not as the pursuit of a world in which there are no more foreigners but as the welcome of the foreigner. However, though hospitality calls for a welcome, there is always a decision on the welcome to be made. Cosmopolitanism as hospitality is therefore always as much a politics as it is an ethics. Addressing issues of central concern for those who seek to understand our obligations to strangers, this book will be of interest to students and scholars of international relations, security studies, ethics, and political and international theory. Ten years after the enactment of the Biologics Price Competition and Innovation Act, competition in biologics markets remains scant and far from sufficient for lowering prices of biologics to the level of 80-90% price drops seen in generic drug markets. This reality is not a result of one or two cardinal reasons, but many. If lowering the price of biologics is the goal and competition is the means by which we seek to achieve that goal, then there does not seem (...) to be a quick fix to address all of the many impediments to competition that plague biologics markets. Yet, certain changes to how the Food and Drug Administration evaluates and approves biologics may go a long way toward the creation of meaningful competition in biologics markets. One such change would be making original biologics' manufacturing information available to follow-on manufacturers.As recognized by several commentators, access to biologics manufacturing information is key to increasing competition in biologics markets. Without access to such information, making follow-on biologics is difficult and expensive, if not outright impossible. This is expected to be especially true for the highly anticipated class of interchangeable biologics, none of which has been approved by the FDA to date. Yet, it has long been the position of the brand-name pharmaceutical industry that biologics manufacturing information is proprietary and, thus, may not be shared. Congress has subscribed to the Industry's position, prohibiting the FDA from disclosing regulatory filings submitted by developers of original biologics, including manufacturing information, to third parties. That prohibition not only undermines competition in biologics markets, but is also wasteful, potentially unethical, and poses unnecessary risks to the health and safety of patients.This article makes the case for FDA sharing of original biologics manufacturing information with follow-on biologics developers. It is informed by the similar legal and commercial circumstances in the area of pesticides and the regulatory regime established by Congress in the Federal Insecticide, Fungicide and Rodenticide Act, which is administered by the Environmental Protection Agency. The article reviews the FIFRA regime, including its upholding as constitutional by the United States Supreme Court, and then examines its applicability to the area of biologics. The article concludes with a proposal for a similar regime to be incorporated into the pathway for approval of follow-on biologics as a means of increasing competition in biologics markets. (shrink)

The essence of number was regarded by the ancient Greeks as the root cause of the existence of the universe, but it was only towards the end of the 19th century that mathematicians initiated an in-depth study of the nature of numbers. The resulting unavoidable actuality of infinities in the number system led mathematicians to rigorously investigate the foundations of mathematics. The formalist approach to establish mathematical proof was found to be inconclusive: Gödel showed that there existed true propositions that (...) could not be proved to be true within the natural number universe. This result weighed heavily on proposals in the mid-20th century for digital models of the universe, inspired by the emergence of the programmable digital computer, giving rise to the branch of philosophy recognised as digital philosophy. In this article, the models of the universe presented by physicists, mathematicians and theoretical computer scientists are reviewed and their relation to the natural numbers is investigated. A quantum theory view that at the deepest level time and space may be discrete suggests a profound relation between natural numbers and reality of the cosmos. The conclusion is that our perception of reality may ultimately be traced to the ontology and epistemology of the natural numbers. (shrink)

The widely held assumption about what motivated On Denoting is irreconcilable with Russell's position shortly beforehand; but discarding it leaves one with a carefully worked out solution whose problem is missing. The real motivation is to be found in a notoriously obscure passage in OD, in which Russell exposes a decisive (though easily overlooked) flaw in his former theory of denoting; a flaw which also cripples Frege's theory of sense and reference. A comprehensive account of this passage is the chief (...) concern of the present paper. Recognizing the critical role of this argument of Russell's leads to a more credible account of his argumentation in that essay. It also suggests that the fundamental standpoint underlyingThe Principles of Mathematics remains intact. In this light, the appropriation of OD to the philosophy of language may be misguided. The fair use doctrine is at once the most significant and the most problematic qualification of the copyright owner's right to exclusivity. An affirmative defense against copyright liability, the fair use doctrine legitimates certain unauthorized reproductions of copyrighted materials that would otherwise be regarded as copyright infringements. Notwithstanding its importance, “fair use” continues to be “the most troublesome [doctrine] in the whole law of copyright.” Throughout its long history, neither courts nor legislatures have provided a useful definition of “fair use” (...) nor have they adumbrated its objectjves. Since the doctrine's inception over two and a half centuries ago, courts and legislatures have attempted to formulate, explicate, refine, and revamp the fair use doctrine. Generally, these efforts have proven unfruitful. At best, they have resulted in various formulations of how to approach fair use questions that offer courts and users of copyrighted works scant guidance on how fair use should be recognized. All this would not have been of grave concern had judges shared a common understanding of fair use or of the principles that should guide them in deciding fair use cases. The problem is that they do not. Rather, the case law reflects wdely divergent notions of the concept of fair use. The lack of consensus is best witnessed in the multiple reversals and divided courts that have become the hallmark of fair use litigation. (shrink)

During the past half-century the patterns of publication in science have undergone radical change. A vast increment has occurred in the amount of scientific writing. And scientific findings are increasingly being disseminated through “non-traditional” publishing media such as mimeographing and microfilming. These two interrelated trends have had some notable effects upon science. 1. With the rapid increase in the number of publications the problem of maintaining continuity in science has become acute; the traditional scientific social structure seems quite incapable of (...) accomplishing this vital task. 2. An extensive organization is developing which seeks to provide the desired continuity, but its very existence poses dilemmas for the traditional scientific order. 3. Moreover, the changing publication patterns seem to be intensifying the “schisms” between the theoretician and the specialized researcher. 4. They are also challenging the older standards for evaluating scientists. We thus hypothesize that the volume and form of communication is a significant variable inducing modifications in the scientific social system. This theoretical orientation has in part been suggested by Harold Innis who, however, was concerned with broader systems—i.e., civilizations. The following analysis should point up some little-considered problems inherent in the research process. (shrink)
