From Comrades to Bodhisattvas is the first book-length study of Han Chinese Buddhism in post-Mao China. Using an ethnographic approach supported by over a decade of field research, it provides an intimate portrait of lay Buddhist practitioners in Beijing who have recently embraced a religion that they were once socialized to see as harmful superstition. The book focuses on the lively discourses and debates that take place among these new practitioners in an unused courtyard of a Beijing temple. In this (...) non-monastic space, which shrinks each year as the temple authorities expand their commercial activities, laypersons gather to distribute and exchange Buddhist-themed media, listen to the fiery sermons of charismatic preachers, and seek solutions to personal moral crises. Applying recent theories in the anthropology of morality and ethics, Gareth Fisher argues that the practitioners are attracted to the courtyard as a place where they can find ethical resources to re-make both themselves and others in a rapidly changing nation that they believe lacks a coherent moral direction. Spurred on by the lessons of the preachers and the stories in the media they share, these courtyard practitioners inventively combine moral elements from China’s recent Maoist past with Buddhist teachings on the workings of karma and the importance of universal compassion. Their aim is to articulate a moral antidote to what they see as blind obsession with consumption and wealth accumulation among twenty-first century Chinese. Often socially marginalized and sidelined from meaningful roles in China’s new economy, these former communist comrades look to their new moral roles along a bodhisattva path to rebuild their self-worth. Each chapter focuses on a central trope in the courtyard practitioners’ projects to form new moral identities. The Chinese government’s restrictions on the spread of religious teachings in urban areas curtail these practitioners' ability to insert their moral visions into an emerging public sphere. Nevertheless, they succeed, at least partially, Fisher argues, in creating their own discursive space characterized by a morality of concern for fellow humans and animals and a recognition of the organizational abilities and pedagogical talents of its members that are unacknowledged in society at large. Moreover, as the later chapters of the book discuss, by writing, copying, and distributing Buddhist-themed materials, the practitioners participate in creating a religious network of fellow-Buddhists across the country, thereby forming a counter-cultural community within contemporary urban China. Highly readable and full of engaging descriptions of the real lives of practicing lay Buddhists in contemporary China, From Comrades to Bodhisattvas will interest specialists in Chinese Buddhism, anthropologists of contemporary Asia, and all scholars interested in the relationship between religion and cultural change. The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

In this article, we will consider how the regulation of populations is not just a feature of prisons, but of all institutions and organisations that control members though hierarchies, divisions and norms. While nurses and other allied health professionals are considered to be predominantly self‐regulatory, practice is guided by a code of conduct and codes of ethics that act as rules that serve to uphold the safety of the patient, whether they are a sick person in a hospital bed or (...) an inmate in a prison. The codes of conduct espouse a number of rules that to a certain extent govern the behaviour of individual and groups of practitioners through reciprocal rewards and punishments. Supervision is one method of monitoring the effectiveness of the codes of conduct and ethics while regulating both the minimum standard of individual practice and of training organisations. It is posited that one of the possible effects of clinical supervision is to make the person effectively self‐regulatory as, an autonomous practitioner. We take the view that professional autonomy is a highly problematic concept requiring closer examination. (shrink)

In the ontology of music the Aristotelian theory of musical works is the view that musical works are immanent universals. The Aristotelian theory (hereafter Musical Aristotelianism) is an attractive and serviceable hypothesis. However, it is overlooked as a genuine competitor to the more well-known theories of Musical Platonism and nominalism. Worse still, there is no detailed account in the literature of the nature of the universals that the Aristotelian identifies musical works with. In this paper, I argue that the best (...) version of Musical Aristotelianism identifies musical works with structural universals. I first motivate the view by outlining its explanatory benefits. I then argue that Musical Aristotelianism is preferable to Musical Platonism and present a novel account of musical works as structural universals by developing D. M. Armstrong’s theory of structural universals. I discuss the consequences of Musical Aristotelianism with respect to on-going issues in debates about musical works and defend the view against an influential objection, concluding that Musical Aristotelianism is a genuine competitor in debates about the nature of musical works. Here we prove the existence of sheaf cohomology theory in arbitrary o-minimal structures.

United States federal regulations for pediatric research with no prospect of direct benefit restrict institutional review board (IRB) approval to procedures presenting: 1) no more than "minimal risk" (§ 45CFR46.404); or 2) no more than a "minor increase over minimal risk" if the research is commensurate with the subjects' previous or expected experiences and intended to gain vitally important information about the child's disorder or condition (§ 45CFR46.406) (DHHS 2001). During the 25 years since their adoption, these regulations have helped (...) IRBs balance subject protections with the pursuit of scientific knowledge to advance children's welfare. At the same time, inconsistency in IRB application of these regulations to pediatric protocols has been widespread, in part because of the ambiguity of the regulatory language. During the past decade, three federally-charged committees have addressed these ambiguities: 1) the National Human Research Protections Advisory Committee (NHRPAC) (Washington, DC), 2) the Institute of Medicine (IOM) Committee on the Ethical Conduct of Clinical Research Involving Children (Washington, DC); and 3) the United States Department of Health and Human Services Secretary's Advisory Committee for Human Research Protections (SACHRP) (Washington, DC). The committees have reached similar conclusions on interpretation of language within regulations § § 45CFR46.404 and 406; these conclusions are remarkably consistent with recent international recommendations and those of the original National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1977) report from which current regulations are based. Drawing on the committees' public reports, this article identifies the ethical issues posed by ambiguities in regulatory language, summarizes the committees' deliberations, and calls for a national consensus on recommended criteria. David Lewis is typically interpreted as a class nominalist. One consequence of class nominalism, which he embraced, is that the reduction of ordered pairs, triples, etc to unordered sets of sets is conventional. The reaction by his Australian counterparts D.M. Armstrong and Peter Forrest was that Lewis was not being ontologically serious. This chapter evaluates this debate over serious ontology. It is argued that in one sense Lewis is ontologically serious, but that his additional commitment to structuralism about classes should (...) push him to adopt a trope-theoretic account of naturalness, which opens up another way to respond to the charge of not doing serious ontology. This conclusion is supported by certain remarks he makes in his correspondence, thus revealing how his thinking about properties appears to have evolved from property-egalitarianism to a sparse theory of tropes. Three widely accepted principles – autonomy, beneficence and justice – provide a useful analytic framework for considering controversies and conflicts in bioethics. Since these principles capture key concepts found in diverse normative theories they provide a starting point from which consistent ethical analysis and comparison can begin. While justice is commonly discussed in the business ethics literature, the other two principles are not widely discussed. This paper investigates whether the principles of autonomy and beneficence provide a framework that is equally (...) useful for framing issues in business ethics. It is argued that they do. First, the principle of autonomy, with its associated notions of informed consent, privacy, confidentiality, voluntariness, self-mastery, and so on, provides a consistent approach to the analysis of diverse issues that arise in business ethics from market research to recruitment practices. Second, it is argued that the relationships between a business and its stakeholders ground duties of beneficence. The principle of beneficence provides a framework for considering the issues that arise in these relationships. (shrink)

To do so, it argues that informed consent often goes awry due to procedural misconceptions built into the research context. The concept of procedural misconception is introduced to describe how individuals respond to what is familiar in research settings and overlook what is different. This look at Gassendi’s philosophy and science illuminates his contributions to early modern thought and to the broader history of philosophy of science. Two keys to his thought are his novel picture of acquiring and judging empirical belief, and his liberal account of criteria for counting empirical beliefs as parts of warranted physical theories. By viewing his philosophical and scientific pursuits as part of one and the same project, Gassendi’s arguments on behalf of atomism can be fruitfully explained as licensed (...) by his empiricism. This article empirically examines how healthy volunteers evaluate and make sense of the risks of phase I clinical drug trials. This is an ethically important topic because healthy volunteers are exposed to risk but can gain no medical benefit from their trial participation. Based on in-depth qualitative interviews with 178 healthy volunteers enrolled in various clinical trials, we found that participants focus on myriad characteristics of clinical trials when assessing risk and making enrolment decisions. These factors include the short-term and (...) long-term effects; required medical procedures; the type of trial, including its design, therapeutic area of investigation, and dosage of the drug; the amount of compensation; and trust in the research clinic. In making determinations about the study risks, participants rely on information provided during the consent process, their own and others’ experiences in clinical trials, and comparisons among studies. Our findings indicate that the informed consent process succeeds in communicating well about certain types of risk information while simultaneously creating lacunae that are problematically filled by participants through their collective experiences and assumptions about risk. We discuss the ethical implications of these findings and make recommendations for improving the consent process in healthy volunteer trials. (shrink)

In this paper I explore the politics of trust in the clinical testing of pharmaceuticals in the US. Specifically, I analyze trust in terms of its institutional manifestations in the pharmaceutical clinical trials industry. In the process of testing new drugs, pharmaceutical companies must (1) protect their proprietary information from the clinicians who conduct their studies, and (2) find a way to ensure human subjects’ compliance to study protocols. Concern with these two critical issues leads drug companies to approach clinicians (...) and research subjects with an attitude of mistrust and the desire to exert control over their activities. This orientation results in an institutionalization of mistrust that structures the relationships and activities required for the clinical development of new pharmaceutical products. (shrink)

Newly powerful large language models have burst onto the scene, with applications across a wide range of functions. We can now expect to encounter their outputs at rapidly increasing volumes and frequencies. Some commentators claim that large language models are bullshitting, generating convincing output without regard for the truth. If correct, that would make large language models distinctively dangerous discourse participants. Bullshitters not only undermine the norm of truthfulness (by saying false things) but the normative status of truth itself (by (...) treating it as entirely irrelevant). So, do large language models really bullshit? I argue that they can, in the sense of issuing propositional content in response to fact-seeking prompts, without having first assessed that content for truth or falsity. However, I further argue that they need not bullshit, given appropriate guardrails. So, just as with human speakers, the propensity for a large language model to bullshit depends on its own particular make-up. (shrink)

We argue that the importance of properties can be shown by explaining what explanatory work they can do in philosophical theorising across many areas of philosophy. A critical note on Peter Lamarque and Nigel Walter’s ‘The Application of Narrative to the Conservation of Historic Buildings’.

In the Critique of the Power of Judgment, Kant calls purposiveness the “lawfulness of the contingent”. I argue that this should be interpreted not as lawfulness assumed in order to remove unacceptable mechanical indeterminacy, but rather as an additional kind of lawfulness which, in the case of organisms, inexplicably coincides with mechanical determination. Schelling adapts Kant’s notion of natural purposiveness in his own conception of the relation between mechanism and organism. He states in his 1798 work, On the World Soul, (...) that nature is “lawless in its lawfulness, and lawful in its lawlessness”. This should be interpreted similarly: there is a coincidence of two orders of lawfulness in nature. However, while Kant maintains that the coincidence or unity of these two orders is inexplicable for beings like us, Schelling explains the unity by assigning these laws to distinct levels of operation in nature. Organic organization is generated by a second-order operation of an organic principle on the first-order mechanical forces that are characteristic of matter. Schelling thereby builds on Kant’s third Critique framework in a creative way in order to offer a more fully unified account of nature. In this account, mechanism and organism maintain distinct roles but are both grounded in a further, higher principle. (shrink)

This paper extracts and articulates the account of normativity in Plato’s Philebus. Central to this account is the concept of measure, which plays both an ontological and a normative role. With regard to the former, measure is what makes particular things to be the specific kind of thing they are; with regard to the latter, measure supplies the appropriate standard for determining whether or not those things are good or bad instances of their kind. Blumenbach’s epigenetic theory, particularly his concept of the formative drive, was appropriated by both Kant and Schelling. Kant’s third Critique endorsement of Blumenbach’s formative drive shows him to be close to Schelling’s conception of nature, since it is evidence of his distance from an artifactual conception of teleology. Schelling also draws on this concept of the formative drive, making the structures operative in the formative drive the explanatory ground of all natural forces and processes, thereby supplying the unity between the (...) organic and inorganic which, according to Kant’s Critical philosophy, is unattainable for our discursive understanding. In this paper, I will argue for two related conclusions. First, Kant is closer to Schelling in his outlook than he has been interpreted to be, particularly in his conception of reflecting teleological judgment, according to which we must judge organisms as if they internally directed at ends, while using design as a heuristic device. Second, Schelling’s philosophy of nature expands upon Kant’s view of the teleological principle, and in doing so develops a systematically unified view of nature. For Schelling, the organizing principle manifested in the formative drive also unifies all of nature into a single system. (shrink)

The proliferation of open technologies and content in higher education is motivated by broad embrace of a principle of sharing that is consonant with various contemporary economic, pedagogic and policy drivers.At the same time, open technologies and content present the possibility of a departure in the culture of humanities research and teaching.The open frameworks celebrate and facilitate collaborative and cooperative modes of working which are, to a degree, alien to a traditional ‘individualist’ conception of work in the Humanities. Some of Quine’s critics charge that he arrives at a behavioristic account of linguistic meaning by starting from inappropriately behavioristic assumptions (Kripke 1982, 14; Searle 1987, 123). Quine has even written that this account of linguistic meaning is a consequence of his behaviorism (Quine 1992, 37). I take it that the above charges amount to the assertion that Quine assumes the denial of one or more of the following claims: (1) Language-users associate mental ideas with their linguistic expressions. (2) A (...) language-user can have a private theory of linguistic meaning which guides his or her use of language. (3) Language learning relies on innate mechanisms. Call an antecedent denial of one or more of these claims illicit behaviorism. In this paper I show that Quine is prepared to grant, if only for the sake of argument, all three of the above claims. I argue that his claim that there is nothing in linguistic meaning beyond what is to be gleaned from overt behavior in observable circumstances is unscathed by these allowances (Quine 1992, 38). And I show that the behaviorism which Quine does assume should be viewed as a largely uncontroversial aspect of his evidential empiricism. I conclude that if one sets out to dismiss Quine’s arguments for internal-meaning skepticism, this dismissal should not be motivated by the charge that his conclusions rely on the illicitly behavioristic assumptions that some have suggested that they do. As the title of her book indicates, Zuckert’s approach to Kant’s Critique of Judgment differs somewhat from that taken by many recent commentators. Rather than focusing narrowly on aspects of the CJ that are directly relevant to a particular philosophical issue, Zuckert offers an interpretation of the work as a whole that is aimed at vindicating Kant’s claim concerning its unity. According to her interpretation, the “Critique of Aesthetic Judgment” and the “Critique of Teleological Judgment” are parts of an extended (...) argument for a temporal and teleological conception of human subjectivity that differs significantly from the conception of subjectivity Kant develops in his other works. In Zuckert’s view, this new conception of the judging subject provides the unifying theme of the two main parts of the CJ, but it also marks a problematic transition within Kant’s critical philosophy. The CJ moves beyond the formal structures characteristic of transcendental subjectivity in its concern with the contingent, particular materials of human experience, history, and culture. Academia’s mathematical metaphysics are briefly explored en route to an elaboration of the qualitatively rigorous requirements underpinning the calibration and unambiguous interpretation of quantitative instrumentation in any science. Of particular interest are Gadamer’s emphases on number as the paradigm of the noetic, on the role of play in interpretation, and on Hegel’s sense of method as the activity of the thing itself that thought experiences. These point toward and overlap with (1) Latour’s study of the metrological social networks through which (...) technological phenomena are brought into language as modes of being that can be understood, and (2) the way that Rasch’s models for measurement comprise a potential beginning for metaphysically astute, qualitatively and quantitatively integrated, mathematical methods in the social sciences. The paper closes with observations on the general problem that is philosophy, the need to remain open to multiplicities of meaning even as clear understandings are sought and obtained. (shrink)

The three central themes underlying this issue of Theoretical Inquiries in Law—the privatization of law model, the legal pluralism paradigm, and multiculturalism — are united in their shared opposition, be it descriptive or normative, to the monopolistic concentration of law production power in the hands of the state. The three models focus on dispersion of the social ordering function amongst non-state agents. They advocate the claim that the state has not succeeded at securing a monopoly over law and/or should not (...) secure a monopoly over law. On the policy front, as well, protagonists of the privatization of law model, scholars of the legal pluralism paradigm and writers in the multiculturalism tradition often unite in their plea for recognition of tribal courts or the expansion of the lawmaking capacity of local governments. However, despite their shared underlying assumption that the centralist state law model lacks normative appeal, these three bodies of research diverge significantly. The differences between them have been marginalized in the debate, because each of these models has essentially concentrated on conducting the dialogue with the state law model. Thus far, these models have been solely occupied with taking a particular stance against the centralization model of state law, and have failed to engage in any debate amongst themselves as representatives of alternative legal decentralization schemes. This Article attempts to partially fill the void, by pitting the multiculturalism model of legal decentralization against the privatization model. It will show that the differences in both models’ legal decentralization visions derive from conflicting ontological premises regarding law, community, social life, and the human subject. These theoretical distinctions, which will be drawn between the two decentralization models, have great bearing when considering the social units that ought to supplant the state in its lawmaking capacity. This book combines performance analysis with contemporary political philosophy to advance new ways of understanding both political performance and the performativity of the politics of the street. Our times are pre-eminently political times and have drawn radical responses from many theatre and performance practitioners. However, a decade of conflict in the Middle East and Afghanistan, the eruption of new social movements around the world, the growth of anti-capitalist and anti-globalisation struggles, the upsurge of protests against the blockades of neoliberalism, and (...) the rising tide of dissent and anger against corporate power, with its exorbitant social costs, have left theatre and performance scholarship confronting something of a dilemma: how to theorize the political antagonisms of our day? Drawing on the resources of ‘post-Marxist’ political thinkers such as Chantal Mouffe and Jacques Rancière, the book explores how new theoretical horizons have been made available for performance analysis.
