El artículo analiza la introducción de las Rasā’il ijwān al-Ṣafā’ en al-Andalus y la implicación de esta cuestión en la historia de la ciencia y la filosofía árabes. Más particularmente, se centra en el impacto de la enciclopedia de los Hermanos de la Pureza en dos obras importantes de la literatura de al-Andalus en el campo de las ciencias ocultas: la Rutbat al-ḥakīm y la Gāyat al-ḥakīm. Retoma el tema de la autoría y cronología de estas tres (...) obras, destacando el hecho de que el corpus de las Rasā’il es el resultado final de un proceso de compilación históricamente largo y confirmando, a partir de algunos elementos nuevos, la identificación del autor de la Rutba y de la Gāya con Maslama al-Qurṭubī . La comparación textual de estas tres obras y, en particular, el análisis de la Rutba, obra aún inédita, permite identificar a Maslama al-Qurṭubī como el transmisor genuino del corpus ijwāniano a al-Andalus. As a continuation of previous studies about the reception of Rasā’il Ikhwān al-Ṣafā’ in al-Andalus, this paper argues that it was common among Andalusī scholars of the Middle Ages to credit the astronomer Maslama al-Majrīṭī not only with the authorship of Rutbat al-ḥakīm and Ghāyat al-ḥakīm – now both correctly ascribed to Maslama Ibn Qāsim al-Qurṭubī – but also with the entire encyclopaedic corpus of the Rasā’il. The first part of this article seeks to explain the series of (...) successive confusions by which these three works came to be identified as forming three steps of a philosophical ladder and how this trilogy then came to be attributed to the scientist al-Majrīṭī. The second part focuses on two biographical notes found on the title pages of two manuscripts of the as-yet-unedited Rutbat al-ḥakīm. In addition to providing supplementary evidence for the spread of this misconception among medieval scholars, these documents also offer valuable and sometimes unique information about the two Maslamas, their respective writings and entourages, as well as the widespread circulation of the Rasā’il across the Peninsula. The edition, translation and commentary of these two biographical notes are here provided for the first time. (shrink)

There is a divide within political and legal theory concerning the justification of hate-crime legislation in liberal states. Opponents of Hate-Crime Legislation have recently argued that enhanced punishment for hate-motivated crimes cannot be justified within political liberal states. More specifically, Heidi Hurd argues that criminal sanction which target character dispositions unfairly target individuals for characteristics not readily under their control. She further argues that a ‘character’ based approach in criminal law is necessarily illiberal and violates the state’s commitment to political (...) neutrality. In the current paper, I attempt to show the difficulties and absurdity that follows from Hurd’s characterization of hate- rimes. I aim to show that punishment for undesirable character traits is consistent with western conceptions of criminal law. Upon doing so, I then go on to construct a positive argument for the justifiability of punishing for character traits as well as for the enhanced punishment associated with hate-motivated crimes. The Qur’an is considered by Muslim scholars to be one of the two primary sources of Islamic law. The Qur’an deals with many diverse matters, including beliefs, morals, ethics, legal issues and historical narratives. We are not concerned here with establishing the exact proportion of the Qur’an devoted to each of these various categories and in particular to legal rulings. Rather, the pivotal aim of the present investigation is to establish the fact that the whole Qur’an is interrelated, and that (...) the non-legal material in the Qur’an ultimately supports its legal system. This article, therefore, attempts to contribute to the discussion on this issue by asserting that although a large part of the Qur’an does not contain explicit or even implicit legal rulings, it serves, however, to consolidate and establish the Islamic legal system. This assertion is founded on an analysis of the relationship between the legal verses and those with no direct legal rulings stated in them. This article will broadly assess three major themes in the Qur’an which are: God, the Prophet and His message and the present life with the Hereafter. It will underscore their relationship to explicit legal injunctions. These themes are doctrinal in nature but as the analysis will show, they are woven into the framework of the injunctions themselves thereby forging a link between creed and law. (shrink)

En su epístola “La clarificación elocuente para la refutación de Ibn Qutayba”, todavía en manuscrito, al-Nu,mān se lanza a una polémica en contra de Ibn Qutayba, que había vivido un siglo antes. Es probable que la epístola fuera escrita en la época de al- Mu´izz a petición de un tutor anónimo de los hijos del califa. En ella, al-Nu´mān se (...) propone refutar la afirmación de Ibn Qutaybba, incluida en la introducción de su famosa obra Adab al-Kātib, según la cual era suficiente para la realización de sus tareas que los kuttāb, o funcionarios del estado, memorizaran una serie de fórmulas legales simples, sin tener que aprenderse las largas disertaciones de los fuqahā’ o doctores de la ley. Al-Qādī al-Nu´mān, un faqīh famoso, se dedica en la epístola a demostrar que sin estas disertaciones no se podía aplicar la ley correctamente. En su texto se refiere a cada fórmula legal mencionada por su rival en Adab al-Kātib y demuestra cómo la ley se debería aplicar basándose en la autoridad de los imāmes del Ahl al-Bayt, la Familia del Profeta Muhammad. This research aims to describe and analyze Ibn Taymiyyah’s philosophical-constructive critique of Ibn ‘Arabī’s waḥdat al-wujūd thought. The method used in this research is descriptive-analytical. The primary data used in this research are the works of Ibn Taymiyyah and Ibn ‘Arabī. Meanwhile, secondary data in this research are books, journal articles, and other websites that discuss the thoughts of Ibn Taymiyyah and Ibn ‘Arabī. The research results show that Ibn Taymiyyah rejected thinking of waḥdat al-wujūd, because of his understanding of (...) the doctrine of waḥdat al-wujūd This is different from the understanding of Ibn ‘Arabī and his followers. According to Ibn Taymiyyah, waḥdat al-wujūd is the equating of God with nature. In modern terms synonymous with pantheism. Ibn Taymiyyah said those who adhere to waḥdat al-wujūd say that existence is one, and wajib al-wujūd what God has is the same as possible waḥdat al-wujūd that a creature has. Ibn Taymiyyah’s criticism emerged because he only saw aspects of tashabbuh (equation of God with his creatures) from understanding waḥdat al-wujūd, and did not see aspects of tanzīh (purification of God from the likeness of his creatures) from the same understanding. These two aspects are combined into one in the teachings of Ibn ‘Arabī. Even according to Ibn Taymiyyah, the understanding that considers God’s existence to be united with the existence of His creatures is a form of disbelief for God, a form of disbelief and shirk in Him. Many assumptions believe that classical Islamic theology is no longer relevant in the contemporary era, either because its discussion tends to be theocentric and far from the progress of humanism or because it is considered no longer relevant to answer contemporary issues such as secularism, pluralism, globalization, or neo-atheism. Departing from these problems, efforts have emerged for new readings of classical theology by paying more attention to the context and needs of the times. Among these efforts is the renewal of (...) theology by highlighting its methodological aspects, as was done by a contemporary Moroccan theologian and philosopher, Ṭahā ‘Abdurraḥmān. This study attempts to describe and analyze the style of renewal of theology from the perspective of Ṭahā ‘Abdurraḥmān. This research is a character study using qualitative methods, in which the existing data is analyzed critically. This article shows that Ṭahā ‘Abdurraḥmān’s style of renewal of ‘ilm al-kalām focuses on efforts to reform the methodology of classical kalam by reforming the method of dialogue science (munaẓarah) through contemporary linguistic and logical tools, rearranging analogy patterns (qiyas), and building a logic of kalam based on the principle’s logic and morality as well as the amalgamation of theoretical aspect and practical aspect. The significance of Ṭahā ‘Abdurraḥmān’s renewal in contemporary Islamic theology lies in the theorizing of concepts in classical theology with a contemporary approach as well as the construction of the methodology of contemporary Islamic theology to answer ever-evolving theological issues. Suhrawardī, as the founder of illumination philosophy, has works in the field of literature that have philosophical nuances. Researchers through this article attempt to examine philosophically-hermeneutically the Sufistic Romance of Ghurbah al-Gharbiyah Suhrawardī which has not been extensively studied by researchers including Suhrawardī scholars. The novel is genealogically related to Ḥay bin Yaqẓān by Ibn Sīnā and Ibn Ṭufayl, so it is called the Ḥay bin Yaqẓān trilogy: Avicenna, Ibnu Ṭufayl, and Suhrawardī. Through Ricoeur’s Hermeneutic Approach and Corbin’s Epistemology of (...) Sufistic Imagination, which is used as a research method, researchers intend to interpret the symbols and existential meanings of Ghurbah al-Gharbiyah's novel. The purpose of this study is to interpret the background, symbols, and meaning behind Suhrawardī’s novel. The conclusion of this study: Ghurbah al-Gharbiyah discusses the philosophical theme of human alienation in the world with the use of symbols: the city of Qairawan as the imprisoned phase, the Hudhud bird as the enlightenment phase, and the journey on Mount Sinai during the liberation phase and meeting with the "Light of all Lights". Three phases each characterize today's Sufistic consciousness of man: the experience of alienation, enlightenment, and liberation. On the other hand, this novel is a representation of Suhrawardī's subjective creative imagination (al-quwwah al-khayāliyyah) inspired by prophetic experiences: Prophet Muhammad's Ascension, Prophet Sulaiman's Hudhud bird, and Prophet Musa's Mount Sinai. This study deals with al-Ḥakīm al-Tirmidhī’s conception of morality, how he bases this conception on hadiths and how he interprets hadiths according to his own Sufi disposition. al-Ḥakīm al-Tirmidhī is one of the foremost Sufis who resorted to the Qur'an and the Sunnah to prove his views on the issues of Sufism and morality. The study aims to analyze his handling of hadiths and the way he resorted to hadiths while grounding moral issues within the framework of his (...) work Nawādir al-Uṣūl. The study reveals that al-Ḥakīm al-Tirmidhī revealed the theoretical framework of the moral issue, determined the relationship between morality and related concepts such as wisdom and ingenuity, and read the hadiths with a moral perspective. In addition, it was concluded that al-Ḥakīm, who deals with the issue of morality from a different perspective, deals with and evaluates different issues that are frequently discussed in works of ethics and touches on the issue of practical ethics. Therefore, we can say that it represents a clear trend in the issue of ethics. However, it should be pointed out that he never touched the authenticity of the hadiths. (shrink)

The teachings of Islam and the Indonesian constitution clearly prohibit interfaith marriage. However, some Muslim communities in North Sulawesi as a minority group have entered into interfaith marriages. Therefore, this study aims to analyze the phenomenon of interreligious marriage in North Sulawesi and the achievement of minority fiqh objectives in interfaith families. This research is a field research that uses qualitative methods with a phenomenological approach. Data collection was conducted through interviews with informants consisting of 5 interfaith marriage actors, 1 (...) village official, and 1 religious leader. The results showed that the main motivation for interfaith couples to marry is mutual love. They also tend to get support from their respective extended families so that the marriage runs relatively smoothly and safely. The objectives of minority fiqh are achieved in interfaith marriages in the multicultural society of North Sulawesi. Minority fiqh can be an approach in interfaith marriages in multicultural societies where Muslims are a minority, without losing their Islamic essence, it is based on the fiqh rule that changes in law can occur due to changes in times and places. Minority jurisprudence can be an alternative basis for the sustainability of interfaith families in North Sulawesi that are able to maintain their Islamic identity while still respecting their partner's beliefs. al-Zarkashī, an ethnic Turk, is an important hadith, fiqh and commentary scholar who lived during the Mamlūks period. He was taught by some of the leading scholars of his era, such as Alā al-Dīn Mughultay (d. 762/1360), Imād al-Dīn Ibn Kashīr (d. 774/1372) ve Jamal al-Dīn al-Asnawī (d. 772/1370), and he grew up under their mentorship. Nevertheless, his only well-known student is Birmāvī (d. 831/1428). Almost half of his works have been related to fiqh and methodology of fiqh, and he (...) has also written some important works in the field of hadith. Among these, especially al-Tadhkira, al-Nukat alā Ibn al-Salāh, al-Nukat alā al-Umda fī al-Ahkām ve al-Icāba are worthy of mention. The work named al-Tadhkira, which we built our work upon, is the first known work to have been preserved in the field. Due to his being a first in his field, he was vastly studied as to how he evaluated the narrations and what kind of procedure he followed. In this work of his, not only the criticism but also the application of the text criticism adds to the importance of the work. Then, on the basis of this work, scholars such as al-Sakhāwī and al-Aclūnī made complementary works on the same subject. Summary: It is inevitable for a person to be shaped by the society he lives in. During the time when al-Zarkashī lived, Egypt was under the rule of the Mamlūks. The history of Mamlūks is examined under two periods: 1. Bahrī or Turkish Mamlūks (745 / 1344 - 794-1391) 2. Burjī or Circassian Mamlūks (784 / 1382 - 923 / 1517) period. Our author lives in both periods. About forty years of his life was in the period of Bahrī and the rest was in the period of Burjī. In both periods, the state did not have a full political authority in the country, but this was not the case in education and training. In fact, on the contrary to the political situation, scientific activities have accelerated by the arrival of many scholars to the land of Mamlūk because of the Mongol invasions coming from the east and the Crusades from the west. The increase of scientific activity was caused not only by the coming of the scholars but also by the support given by the Mamlūk sultans. In fact, they built many new madrasas in addition to the resurrection of the old ones. In addition to madrasas during the Mamlūks period, mosque, hāngāh, ribat and zāwiya are also among the educational places.Hadith, fiqh and Tafsir scholar al-Zarkashī is originally Turkish. He was born in Cairo at 745 under the conditions mentioned above. His family learned of gold and silverworking because of their subsequent settlement to Egypt, and they made their living with this craft. A person who performs this is called Zarkash in Arabic. Muhammad ibn Bahādır, who learned and did this job, was known as al-Zarkashī. al-Zarkashī, known for his love of science since childhood, was trained hadith by Alā al-Dīn Mughultay (d. 762/1360) and Imād al-Dīn Ibn Kashīr (d. 774/1372) in Damascus, and fiqh by al-Asnawī (d. 772/1370). Among his beneficiaries are distinguished personalities such as al-Subkī (d. 756/1355), al-Azraī (d. 783/1381) and al-Bulqīnī (d. 824/1421). The most remarkable of his student is al-Birmāvī (d. 831/1428).It is known that he wrote about fifty works in hadith, tafsir, fiqh, methodology of fiqh and other fields. Especially among these works al-Burhān fī ʻUlūm al-Qur’ān, al-Tadhkira, al-Ijāba, al-Bahr al-Muhīt fî Usūl al-Fiqh ve al-Mansūr fī al-Qawāid is worth mentioning. Studies on al-Burhān and al-Bahr were carried out at the level of Master and PhD.al-Zarkashī did not hesitate to criticize any person for whom he had found his mistake. For example, even though he has a great love for him, and even because of this love, he has been given the name of al-Minhāj, the criticism of al-Nawawī is the clearest indication of the value given to science. Not just him, critics of scholars such as al-Hākim al-Naysābūrī and Ibn ʻAbd al-Barr who are recognized as authority in hadith can also be considered in this framework.The work named al-Tadhkira which we have studied in our work is of importance in that it shows the accumulation of knowledge in the field of hadith. In order to compose this work, it is necessary to have enough information in this field since the riwāyas must be criticized in terms of isnād and text. To compose his work, al-Zarkashī has benefited from about a hundred and forty works related to hadith, tafsir, al-siyar, history, tabakāt, commentary, jarh - taʻdīl, ilal and maghāzī. The use of such works is an effort to reach all sources and right information as much as possible. Some of these sources are basic hadith books such as al-Bukhārī (d. 256/870) al-Sahīh, Muslim (d. 261/875) al- Sahīh, Abū Dāʾūd (d. 275/889) al-Sunan, al-Tirmidhī (d. 279/892) al-Sunan, al-Nasā’ī (d. 303/915) al-Sunan, Ibn Mādja (d. 273/887) al-Sunan, Mālik ibn Anas (d. 179/795) al-Muwatta, Ahmad ibn Hanbal (d. 241/855) al-Musnad, al-Dārimī (d. 255/869) al-Sunan, ʻAbd al-Razzāq al-Sanʻānī (d. 211/826-27) al-Musannaf, Ibn Abī Shayba (d. 235/849) al-Musannaf, Ibn Rāhwayh (d. 238/853) al-Musnad, al- Bazzār (d. 292/905) al-Musnad, Abu Yaʻlā el-Mawsilī (d. 307/919) al-Musnad, Ibn Hibbān (d. 354/965) al-Sahīh, al-Tabarānī (d. 360/971) al-Muʻjam al-Awsat and al-Muʻjam al-Kabīr, al-Hākim al-Naysābūrī (d. 405/1014) al-Mustadrak.al-Zarkashī divided the riwāyas he had studied into eight subjects. These are judgments, wisdom, zuhd, medicine, virtue, prayer, story, words and riwāyas circulating in language. He shares the information he obtains from sources about him after mentioning the riwāyas he will examine. For example, it is mentioned that there is not a hadith which is transmitted as a hadith, it is a word of a sahāba, tābiun or a person. He transferred on the riwāyas the sources mentioned in the sources, but also stated that he did not participate in some information as the place came.The author has evaluated the narrators of the riwāyas from the point of jarh and taʻdīl. He did not only evaluate riwāyas in terms of isnād, but also text criticism. This activity is a distinctive feature of his work.al-Zarkashī gave information about the misrepresentation of the name of the narrators. He also explained the strange words that are difficult to understand in the text. It is a manifestation of his knowledge in the fiqh area that some of the riwāyas that are considered weak are expressed in some sects. The author described some errors about the riwāyas. For example, he stated that a riwāya that is said to be marfūʻ is a mavkūf. al-Zarkashī also included verses, hadiths and poems about the riwāya that he had studied while writing his work or he defended it by saying that it is not the case of a riwāya that is said to be fictitious.Perhaps it is the weakest point of al-Zarkashī’s work not to give any information about some riwāya, only to mention their isnāds. He also found some riwāyas that did not have a reliable isnāds and stated that their meanings are correct. This knowledge has become an enlightening characteristic for later generations.This work has a great significance in showing that the majority of the riwāyas that spread among the people are not hadiths. As a matter of fact, 73% of the riwāyas examined in the work are weak or irrelevant riwāyas. This work of al-Zarkashī is unique. The existence of such a work has not been determined before him. This work constituted the basis of the works written by scholars such as al-Sakhāwī and al-Aclūnī in the same subject after him. (shrink)

Mu'tazila and Shīʿa (Zaydiyya-Imāmiyya) have common views on many theological issues except the imamate. This issue has been generally accepted by other Islamic scholars rather than Shīʿa and by Western researchers. That in this interaction between the Mu‘tazila and the Shīʿa, the Shīʿa is the side mostly affected. However, it is an issue that should not be overlooked that the Shīʿa partially influenced the Mu'tazila in ʿAlī b. Abī Ṭālib, over the other Companions. In this context, some persons from the (...) Baghdad Mu’tazila School such as Bishr b. al-Muʿtamir (d. 210/825), Jaʿfar b. Mubashir (d. 234/848), Jaʿfar b. Harb (d. 236/850) and al-Iskāfī (d. 240/854) argued that the imamate of Abū Bakr, who was less virtuous, was permissible although they considered ʿAlī as the most virtuous person after the Prophet. In addition, al-ʿAllāf (d. 235/849-850), al-Naẓẓām (d. 231/845), Abū Abdullah al-Basrī (d. 369/979-80) and Qāḍī ʿAbd al-Jabbār (d. 415/1025) along with Abū ʿAlī al-Jubbāʾī (d. 303/916), one of the chiefs of the Basra Mu'tazila School, and Abū Hāshim al-Jubbāʾī (d. 321/933) did not accept the order of caliphate as the order of virtue. This study focuses on the issue of whether the aforementioned affinity between Mu'tazila and Shīʿa affected Mu'tazila, especially in the interpretation of the verses associated with ʿAlī. In the study, the aforementioned problem was examined through the tafsīr al-Kashshāf of the Muʿtazilī mufassir al-Zamakhsharī (d. 538/1144). In addition to the importance of tafsīr, the fact that al-Zamakhsharī took lessons from Shīʿīte/Zaydī persons and he wrote the tafsīr with the support of Zaydī leader al-Wahhās (d. 506/1112) is effective in handling this issue through al-Kashshāf's tafsīr. In the first part of the study, first of all, the interaction between Imāmiyya and Zaydism, which are the two most important branches of Mu‘tazila and Shīʿa, is briefly mentioned. Then, Mu'tazila’s and Al-Zamakhsharī’s view on ʿAlī's position among other caliphs is emphasized. Al-Zamakhsharī, who is from the Basra school of the Mu'tazila, does not consider ʿAlī b. Abī Ṭālib superior to Abū Bakr, unlike al-ʿAllāf, Abū ʿAlī al-Jubbāʾī, Abū Hāshim al-Jubbāʾī and Qāḍī ʿAbd al-Jabbār, who are the leading figures of this school. In fact, the fact that he always observed the order of the caliphate while talking about the merits of the four caliphs supports the possibility that, unlike his predecessors, he accepted the order of the caliphate as the order of virtue. In the second part, it is questioned whether the narrations that al-Zamakhsharī included in his tafsīr of the verses associated with ʿAlī are similar to the narrations of the Shīʿīte/Zaydī/Imāmī tradition and whether he interpreted the verses in parallel with these narrations. In this respect, the tafsīr al-Kashshāf has been examined comparatively with the Sunni and Shiite tafsīrs prior to it. Eventually, while interpreting these verses associated with the Ahl al-bayt (members of the Prophet’s household), al-Zamakhsharī highlights the narrations that appreciate the virtues of ʿAlī b. Abī Ṭālib and his child. However, he also refrains from making comments that would be in line with the Shīʿa's belief in imamate. In particular, his tafsīr of the verse al-Aḥzāb 33/33 in the context of the Prophet’s wives is the greatest indicator of this situation. It has been determined that while al-Zamakhsharī includes the narrations highlighting the virtue of ʿAlī b. Abī Ṭālib and his children, he mostly follows the Sunni commentator al-Thaʿlabī. In particular, it has been seen that al-Zamakhsharī transferred the narration material in the interpretation of the relevant verses from al-Thaʿlabī's commentary almost in the same way. However, it is noteworthy that al-Zamakhsharī differs from him in some details such as linguistically supporting these narrations in some verses such as ʾĀli ʿImrān 3/61 and al-Māʾidah 5/55. An indirect influence can be mentioned because al-Thaʿlabī frequently narrates the narrations supporting the Shīʿītes in places where there is a Sunni-Shīʿīte conflict. Therefore, although there is no evidence that al-Zamakhsharī took these narrations from Shīʿīte sources, it is seen that he brought ʿAlī b. Abī Ṭālib-based narrations in Sunni sources into the fore. Even in the commentary of al-Ḥākim al-D̲h̲us̲h̲amī, al-Zamakhsharī's teacher in the line of Zaydi/Mu'tazili, the lack of Ali emphasis in the interpretation of the aforementioned verses supports our view. In this study, some postscripts (Ḥashiyah) written on Sharḥ al-Aqâid in the Ottoman Empire were examined and their sectarian identities were tried to be determined in the context of the Takwīn. Our aim is to determine the correctness of the opinion that the Ottoman Empire adopted the Ash’arism based on the reading of Ash’arian kalâm books in the Ottoman madrasahs. The book of al-Taftâzânî named Sharḥ al-Aqâid is an important kalâm book that was read together with its postscripts in the (...) time of the Ottoman Empire. This book, in which the views of Omar al-Nasafī in his book named Aqâid is evaluated from the perspective of Ash’ari, is one of the important examples of the commentary and postscript period. In this book, al-Taftâzânî explained both the views of al-Nasafī, who adopted the school of Mâturidism, and his own evaluations together. This structure of the book led to the writing of postscripts and to discuss the views of the two theological schools of Ahl al-Sunnah through this book. In this study, the postscripts written by the Ottoman period famous kalâm scholars such as Ahmad b. Mûsâ al-Khayâlî (875/1470), Muṣliḥ al-dîn Moṣtafâ al-Kastalî (901/1496) and Ramaḍân b. Moḥammad (1017/1608) on the views of al-Taftâzânî were examined. In order to understand the views of al-Khayâlî, the postscripts of Ḳûl (or Ḳavl) Aḥmad b. Ḫıżır al-Kâzarûnî (950/1543) and Abd al-Ḥakîm al-Siyâlkûtî (1067/1657) are also included. (shrink)

The quality of the narrations of 'Abdullah b. Salih al-Misrî (d. 223/838), one of al-Bukhârî's famous teachers, in al-Jâmi al-Sahîh has been a matter of debate among hadîth scholars. Abdullah b. Salih, whose narrations are narrated by Abu Dâwûd, al-Tirmidhî and Ibn Mâjah, is an important figure whom al-Bukhârî interviewed and also narrated from him in his works such as al-Adab al-mufred, al-Kirâʾa Khalfa al-imâm and al-Târîkh al-kabîr. However, whether he narrated directly from him in al-Jâmi al-Sahîh has been a (...) matter of debate among the scholars of Hadith. Ismâ'îlî (d. 371/982) and al-Hâkim (d. 405/1014) claim that al-Bukhârî did not narrate any hadîth from him in his Sahîh, while al-Zaḥebî (d. 748/1347) and al-'Aynî (d. 855/1451) argue that he did. It is possible to say that this disagreement is due to two reasons. The first is that there are differences between the copies of the Sahîh, and the second is that al-Bukhârî mentioned some of the narrators in an incomplete form. In this study, we will investigate various copies of the Sahîh and focus on whether the person whose identity is mentioned as "Abdullah b. Sâlih", "Abdullah" and "Abû Sâlih" in them is really Abdullah b. Sâlih al-Misrî. In addition, we will touch upon the evidences relied upon by the muhaddithis who express an opinion on this issue in terms of narration and dirāyah, and we will also draw attention to how the sîgas of tahammul and âdâ used in the narrations should be understood. Finally, we will try to determine whether al-Bukhârî has made any tahrīj from 'Abdullah b. Salih in his Sahīh, and if so, for what purpose, i.e., for ihtijâj or istishhâd. (shrink)

Arabo-Islamic alchemy enjoyed considerable popularity until well into the 19th and 20th centuries. It can be considered both as a predecessor of modern chemistry and as a natural philosophy whose purpose is to explain the world. Yet one of the unresolved questions concerning alchemy is how one was supposed to learn it, since it was an art that was meant to be kept secret and only revealed to a few select individuals. While the practicalities of the learning experience remain obscure, (...) it is noteworthy that Arabic alchemical literature often makes use of the literary form of the dialogue, a genre strongly associated with teaching and learning. This paper focuses on three Arabic dialogues on alchemy; namely, Masāʼil Khālid li-Maryānus al-rāhib, Kitāb Mihrārīs al-ḥakīm and Risālat al-ḥakīm Qaydarūs, and discusses how the transfer of secret knowledge is represented. I will focus on the literary frames of these texts, their mise-enscéne, the master-disciple relation as represented within them, and the question of interaction between unequal partners. (shrink)

Turkish-Islamic literature contains numerous religious literar writings. In the existing literature, it can be seen that many kinds such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, and al-asmā al-ḥusnā were written. Al-Asmā al-ḥusnā, written in the form of poetry and prose, were mostly sharḥ or their khawaṣṣ were explained. Çihil-nām al-Manẓūm, which is mentioned in the study, was written as khawaṣṣ al-asmā al-ḥusnā. The work is a poet entitled as Fażāyī. Manuscript was written in the (...) last quarter of the fifteenth century, and thus, it is presumed that the poet lived in the same century. This work has been identified in a manuscript. In addition, the poet’s Hadiyyat al-aḥbāb, der-Bayān al-maqāmāt al-darwīshān, Kitāb al-sharʿiyyat al-arbāb, and Ghazaliyyāt al-Darwīsh Fażāyī four other works have been identified. In the writings of the asmā al-ḥusnās, the names of ninety-nine were emphasized. In this study, the forty names of God are expressed. The text presented is a continuation of the tradition of writing some prose works written in Arabic and Persian. Çihil-nām al-Manẓūm, written in Arabic prose and known as Asmā al-Idrīsiyya it can be seen as a free stsyle translation of the prophet Idrīs. Forty names in the content of the work, their proper-ties, when, how much and how to read is explained. In this literature, which has begun to be formed, religious genres such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, have been revealed. Religious literary writings about God were written in the form of tawhīd and munājāts, which consist of one or more prophets found at the head of the dīwāns, or as the annotations of asmā al-ḥusnā or as khawaṣṣ asmā al-ḥusnā.In time, the need for some Turkish literary and scientific works to be translated into a different language were born. It can be seen that with some changes such as subtraction and addition, texts are rewritten or poetic works are translated into prose. The original of our research subject Çihil-nām al- Manẓūm’s is written in Arabic and prose. Çihil-nām al-Manẓūm, it is a munājāt of the work known as Asmā al-Idrīsiyya, which describes the call of prophet Idrīs.Asmā al-ḥusnā is a religious term used mostly to describe the attributes and names of God. In the Qurʾān, there is no information about the number of asmā al-ḥusnā mentioned as a concept. However, the number of the names of God in the Qurʾān is 155. This number is differ-ent in ḥadīths. It is widely accepted that the number of asmā al-ḥusnā is 99. Some Islamic schol-ars have argued against such restricting statements, arguing that ninety-nine names, such as the hiding of the Night of Qadr, were hidden in all Divine names during the month of ramaḍān, while others suggested that the number of ninety-nine was large number of asmās (names).The first examples of asmā al-ḥusnā were written in Arabic literature. Some of them are not detached: Abū Manṣūr al-Māturidī (d. 333/944) Kitāb al-Tawḥīd, Abū ʿAbdullāh al-Ḥalīmī (d. 403/1012) al-Minhāj fī shuʿabiʾl īmān, Taḳī al-Dīn Ibn Taymiyya (d. 728/1328) al-Īmān. Among them, asmā al-ḥusnās has a special importance. Many asmā al-ḥusnā were written in Turkish literature. The most famous among the verses of Ibn Isa b. Majduddīn ʿĪsā Saruḥanī (d. 967/559) is Sharḥ al-asmā al-ḥusnā. Other than that, Ḥusayin b. Sharḥ al-manẓūm al-asmā al-ḥusnā, Ḥākim Sayyid Maḥmad Afandi (d. 1184/1770) Sharḥ manẓūm al-asmā al-ḥusnā, Lāmiʿ Jelebi (d. 938/1532) Sharḥ al-muʿammayāt ʿalā asmā al-ḥusnā, Ḥamdī Afandi (n.d.) Sharḥ al-manẓūm al-asmā al-ḥusnā, Naḥīfī (d. 1151/1738) Manẓūm al-asmā al-ḥusnā, ʿAbd al-Majīd b. The verses of the Qurʾān, the rings, the hours of the days, some prayers, the names of God have some of the accents. It is believed that the desire of the person who reads them in certain conditions, in a certain amount, or in any manner, in specific hours, will occur. The fact that the concept of khawaṣṣ met these meanings allowed him to acquire scientific knowledge and to call it “khawaṣṣ science” characteristic in the literature.The works that deal with the Qurʾān and the asmā al-ḥuṣnā are written. Among the miracles of prophet Idrīs, there have been intresting miracoulus performances such as possessing the knowledge of astronomy, fortune, mathematics, plants, writing, sew-ing, using the scales and strange art. The mysterious secrets were revaled to him in 30 ṣuḥuf. His major miracles are governing spiritual beings, knowing the properties of the beings and possessing the knowledge of various unknown things. Again, he wrote a book about the char-acteristics of letters. Aristotle later wrote a commentary using the majority of the information found in this book. Some of the works are written to narrate the Prophet Idrīs’s praising God with forty names:Muḥammad al-Tunisian, al-Ravḍatu al-Sundusiyya fī asmā al-ḥusnā al-Idrīsiyya al-Suhrawardiyya; Shāb al-Dīn Yaḥya b. Ḥabash al-Suhrawardī, Çihil-nām. Among these, the most famous is the work called Asmā al-Idrīsiyyā, written by Suhrawardī. Here, in addition to the asmā al-ḥusnā (forty names), prayers, prayers, conquests, their meanings, and the merits of reading them are explained. The book is written in Arabic. There are some radical practices of asceticism, such as wearing ṣūf (wool clothes), traveling without provisions, choosing to be single, and avoiding earning a living by working, which were generally seen in the 2nd century A.H. and were subject to criticism with the formation of classical Ṣūfism. Criticisms of these practices have started to appear in the literature since the 3rd century A.H. Early Ṣūfī writers such as Al-Ḥakīm al-Tirmidhī, Muḥāsibī, Abū Saʿīd al-Kharrāz, al-Sarrāj focused on this issue and (...) criticized these practices. How are these practices of ascetics viewed in the sects that were formed and spread in the 6th and 7th centuries? Our research seeks the answer to this question, but limits it to the example of Abū l-Ḥasan al-Shādhilī, the founder of Shādhiliyya. This question is important in two respects: First of all, it is investigated whether the determination of some researchers that al-Shādhilī taught comfort in the face of worldly blessings is also correct. Because, among contemporary researchers, there are those who believe that al-Shādhilī wears ostentatious clothes, rides horses, encourages economic competitiveness, and is therefore open to benefiting from worldly blessings to the fullest. Secondly, it includes an investigation of the validity of the belief that these practices belong to an early period in the history of Sûfism and have been completely abandoned over time. Although al-Shādhilī seems to have completed his spiritual education in Morocco with his sheikh, he later went to Tunisia with the latent command of his master. We see that in his first years in Tunisia, he went into seclusion in a cave and was completely isolated from the society and engaged in worship in a way that reminds us of the practices of the early ascetics. But in the second phase of his life in Tunisia, he went to the city on a spiritual sign, socialized, started to give sermons to people, and started to behave more flexible about eating and drinking. al-Shādhilī specifically states that he did not prefer socialization at this stage, but with a spiritual sign. Later, he went to Egypt again with a spiritual sign and got married there, started to deal with agriculture, and continued to socialize by establishing relations with the rulers. Therefore, it can be said that this new social period is a break both from the radical practices of the early ascetics and from the early period in Tunisia itself. It is also seen that in this new period of al-Shādhilī, he did not wear the clothes of ascetics like sūf (wool clothes) and did not want his followers to wear them. He also encouraged to have a profession and was generally against traveling without provisions. But there are two points to be noted here: First, these milder and more comfortable practices should not lead to a search for comfort and luxury. He continued to keep his distance from worldly blessings and to advise asceticism. Secondly, he had some of his distinguished disciples make some practices of the ascetics. The reason for the existence of these seemingly contradictory practices is that while he recommends moderate and sustainable practices to the general public and his followers, he can make the specialized sūfis more strict and difficult practices. While he was encouraging work and earning in general, not ignoring experience, including avoiding work; not ignoring seclusion while leading to sociality in general; while generally suggesting to resort to occasions, he also follows a path of implementing and enforcing radical practices such as traveling without food. Thus, al-Shādhilī is able to encompass all the seemingly incompatible practices of the previous sūfi accumulation with a point of view of spiritual rank and hierarchy. (shrink)

Medieval Islamic philosophers were occupied with questions of cosmology, predestination and salvation and human responsibility for actions. For Ismailis, the related notions of religious leadership, namely the imamate, and the eschatological role of the prophets and imams were equally central. These were also a matter of doctrinal controversy within the so-called Iranian school of Ismaili philosophical theology. Hamid al-Din al-Kirmani (d. after 411/1020) was one of the most important theologians in the Fatimid period, who rose to prominence during the reign (...) of the imam-caliph al-Hakim bi-Amr Allah (r. 386/996–411/1021). He is renowned for blending the Neoplatonic philosophical heritage with Ismaili religious tradition. This book provides an analysis of al-Kirmani’s thought and sheds new light on the many layers of allusion which characterise his writings. Through a translation and analytical commentary of the eighth chapter of al-Kirmani’s Kitab al-Riyad (Book of Meadows), which is devoted to the subject of divine preordination and human redemption, Maria De Cillis shows readers first-hand his theologically distinctive interpretation of qada’ and qadar (divine decree and destiny). Here, al-Kirmani attempts to harmonise the views of earlier renowned Ismaili missionaries, Abu Hatim Ahmad b. Hamdan al-Razi (d. 322/934), Muhammad b. Ahmad al-Nasafi (d. 331/942) and Abu Ya'qub Ishaq b. Ahmad al-Sijistani (d. c. 361/971). De Cillis skilfully guides the reader through al-Kirmani’s metaphysical and esoteric correspondences, offering new insights into Shi’i/Ismaili philosophical thought which will be of great interest to those in the field of Shi’i studies and, more broadly, to scholars of medieval philosophy. Türk ve İslam tarihinin kırılma noktalarından birisi 1040 yılında Selçuklular ile Gazneliler arasında cereyan eden Dandanakan Savaşı’dır. Savaşın ardından Selçuklular hızlı bir yükselişle özellikle Sünnî İslam coğrafyasında etkin ve belirleyici güç haline gelmiştir. Göçebe kültürden gelen ve bir oba hüviyetinde iken çok kısa bir sürede önlenemez bir şekilde hâkimiyet alanını Türkistan coğrafyasından Anadolu içlerine kadar genişleten Büyük Selçuklu Devleti, kurumsal olarak da olgunlaşmaya başlamıştır. Bu noktada hem merkezi yönetimde hem de vilayetlerde ortaya çıkan yetişmiş eleman ihtiyacını birçoğu daha önce Gazneli (...) devlet teşkilatında görev yapmış Fars asıllı devlet adamları karşılamıştır. Bu isimlerden birisi de ileride Nizâmülmülk adıyla şöhret bulacak ve namı isminin önüne geçecek olan Hasan b. Alî b. İshâk et-Tûsî’dir. Nizâmülmülk, devlet gücünün askeri alanda elde edilen zaferlere endekslendiği bir dönemde askerî, idarî, ilmî ve ekonomik alanda attığı adımlar ve aldığı tedbirlerle Büyük Selçuklu Devleti’nin kurumsallaşmasında son derece etkin bir isim olmuştur. Bu etkinlik neticesinde hem halk hem de devlet adamları nezdinde saygın bir yer edinmiştir. Bu çalışma çerçevesinde Nizâmülmülk’ün devlet bürokrasisi içerisindeki konumuna, hükümdar ve hanedan üyeleri ile olan ilişkilerine ve vezirlik sürecinde attığı adımların Selçuklu tarihine yansımalarına değinilecektir. Çağrı Bey’in hizmetinde rüştünü ispat eden Nizâmülmülk, Çağrı Bey’in en güvendiği isimlerden biri haline gelmiştir. Öyle ki, Çağrı Bey ileride önce Horasan’ın sonrasında tüm Selçuklu yurdunun yönetimini üstlenecek olan oğlu Alparslan’ı Nizâmülmülk’e emanet etmiş, oğluna da Nizâmülmülk’ü bir baba olarak kabul etmesini, ona muhalefet etmemesini öğütlemiştir. Alparslan, babasının tavsiyeleri ve üvey kardeşi Süleyman ile giriştiği taht mücadelesinde gösterdiği yararlılık münasebetiyle devletin en önemli idari görevi olan vezirlik makamını Nizâmülmülk’e tevdi etmiştir. Bu dönemden itibaren vefatına kadar, yaklaşık 30 yıl kesintisiz bir süreyle Büyük Selçuklu Devleti’nin vezirliğini yapmış ve V./XI. yy.’ın ikinci yarısından itibaren Büyük Selçuklu siyasetinin en etkin figürü haline gelmiştir. Melikşah’ın tahta geçebilmesinin Nizâmülmülk ile ilişkilendirilmesi, onun döneminde elde edilen başarıların ve devlet sisteminin düzenlenmesi, şehirlerin imarı, ekonominin güçlenmesi gibi ülke içerisinde yaşanan olumlu gelişmelerin Nizâmülmülk’ün marifetiyle gerçekleştirildiğinin dillendirilmesi, Tanrı tarafından yeryüzünü yönetmek ve inşa etmek için seçildiği düşünülen bir sultan varken bir vezirin devlet için nimet olarak gösterilmesi sultanın vezirine bakışını etkilemiştir. Bu noktada üzerinde durulması gereken hususlardan birisi de Nizâmülmülk’ün kendisini nasıl gördüğü ve devlet içerisinde kendini nerede konumlandırdığıdır. Nizâmülmülk’ün Sultan Melikşah’a verdiği bir cevapta devletin geldiği noktayı ve sultanın mevcudiyetini kendi varlığıyla eşleştirmesi, tarihinin gördüğü en yetenekli vezirlerden biri olan Nizâmülmülk’ün özgüveninin son derece yüksek ve kendisini kudret sahibi olarak gördüğüne işaret etmektedir. Bu anlamlandırma halk nezdinde herhangi bir kutsiyeti bulunmayan vezirlik makamındaki bir kişinin, toplum nezdinde Allah tarafından seçildiğine inanılan kutlu kişiye meydan okutan gücü kendisinde hissetmesinin kaynağını sorgulatmaktadır. Aranan cevap Nizâmülmülk’ün vezirlik sürecinin çeşitli başlıklar altında ve bu başlıklara dair verilecek örneklerle incelenmesi neticesinde onun devletin iç işleyişine etkisinin tespitinde ve farklı kesimlerle kurduğu ilişkide saklıdır. Nizâmülmülk, Selçuklu tahtına karşı sıkı bir bağlılık göstermiştir. Bu bağlılığını lüzumu halinde savaş meydanında göğüs göğüse çarpışarak sergilemiş, gerekli olduğunda kıvrak zekâsı ile sorunları devlet için tehlikeli boyuta gelmeden çözmüş, siyasi öngörüsü ile aldığı tedbirler sayesinde devletin büyümesine katkı sağlamıştır. Onun bu sadakati ve samimiyeti, Selçuklu sultanları tarafından karşılık bırakılmamış, Alparslan vezirinin fikirlerine büyük önem verip tercihlerini bu doğrultuda şekillendirirken, aleyhine söylenen sözlerin hiçbirine kulak asmamıştır. Melikşah da, bir anlamda kendisine Selçuklu tahtını veren Nizâmülmülk’e gerekli hürmeti göstererek bütün devlet işlerinin yürütülmesini ona tevdi etmiş ve kendisini bir “baba” gibi gördüğünü ifade etmiştir. İlaveten Selçuklu tarihinde bir ilk olmak üzere Melikşah, Nizâmülmülk’e atabeg (el-emîrü’l-vâlid) unvanını vermiştir. Melikşah, Büyük Selçuklu tahtındaki ilk yıllarını, gençliğin etkisiyle, polo oynayıp, büyük av partileri düzenlemekle geçirmiş ve bundan dolayı devlet içerisinde bütün güç Nizâmülmülk’ün eline geçmiştir. Ortaya çıkan bu durum da “ülke resmen ve ismen sultanın olmakla birlikte gerçekte ‘Nizam’ına kavuştu.” ifadesiyle açıklanmıştır. Ayrıca Melikşah’ın saltanatı döneminde elde edilen askerî, siyasî ve ekonomik başarılar Nizâmülmülk’ün yeteneği ve devlet işlerinde attığı adımlara bağlanmıştır. Nizâmülmülk, hanedan ile kurduğu ilişkinin yanı sıra devlet kademesinde görev alan farklı zümrelerle de güven üzerine dayalı yakın bir ilişki biçimi geliştirmiştir. Örneğin, Nizâmülmülk’ün katıldığı askerî seferlerde bir nefer gibi askerlerin içerisinde savaşa katılması ordu içerisinde kendisine saygı duyulmasına yol açmıştır. Ayrıca, Melikşah ile Kirman Hâkimi Kavurd Bey arasındaki taht mücadelesinde Melikşah’ın safında yer almakla birlikte Kavurd Bey’i destekleyen bazı isimlerin yazdıkları destek mektuplarının ortaya çıkmasına engel olarak hem emirlerin korkularını yatıştırırmış hem de itibarını artırmıştır. Nizâmülmülk’ün yakın ilişki içerisinde olduğu bir diğer grup ilmiye sınıfı olmuştur. Bilge vezir, Tuğrul Bey döneminde Amidülmülk Kündürî tarafından takibata uğrayan ve baskılara maruz kalan ilim adamlarının yurtlarına dönebilmelerine imkân sağlamıştır. Bu ilim adamları da yurtlarına dönüşlerini sağlayan isme zihinlerinde ve gönüllerinde her zaman özel bir yer ayırmışlardır. Birçok âlimin çalışmalarını Nizâmülmülk’e ithaf etmesi, diğer saiklerle birlikte, bunun bir göstergesidir. Nizâmülmülk bir adım daha atarak, Sultan Alparslan ve Melikşah’ın müsaadeleriyle, bu ilim adamları için hâkim olunan coğrafyanın her tarafında ilimle iştigal edebilecekleri medreseler inşa etmiştir. Nizâmülmülk’ün adına nispetle Nizamiye Medreseleri olarak isimlendirilen bu medreselerde hem eğitim-öğretim kadrosuna hem de öğrenim süresi boyunca ve de mezun olduktan sonra öğrencilere sunulan imkânlar, insanların medreselere olan ilgisini arttırıyordu. Medreseler eliyle bir taraftan önceki dönemde yerlerinden edilen ve baskıya maruz kalan ilim adamlarına bir borç ödenip iade-i itibar sağlanırken diğer taraftan da Büyük Selçuklu Devleti’nin idari ve adli sisteminin ihtiyaç duyduğu yetişmiş insan gücü inşa edilmiştir. Nizâmülmülk, toplum lehine attığı adımlar ve sorunların çözümüne verdiği önem ile halkın desteğini sağlamıştır. Öyle ki insanların hayatları boyunca ona minnettar kaldığı vurgulanmıştır. Nizâmülmülk halkın sorunlarının çözümüne önem göstermiş ve onlarla yakından ilgilenmiştir. Nizâmülmülk’ün verdiği güven duygusu halkın hoşuna gitmiş ve toplum içerisinde kabul görmesine vesile olmuştur. Nizâmülmülk’ün bir diğer hasleti de fakirlere sofrasını açmasıdır. Böylece onlarla diyalog kurmuş ve gönüllerini kazanmıştır. Her yönüyle eksiksiz bir devlet adamı olan Nizâmülmülk, toplumun her türlü ihtiyacının çözümünü düşünmüş ve bu yönde adımlar atmıştır. Nizâmülmülk’ün toplumun her kesimi ile kurduğu samimi ve yakın ilişki o kadar büyük bir takdir ve beğeni toplamıştır ki bu durum Nizâmülmülk’ün toplum nezdinde sultan itibarı görmesine sebep olmuştur. İlaveten Selçuklu coğrafyasının her yerinden ve toplumun her kesiminden insanın kendisine yönelmesi hasebiyle Kâbe’ye benzetilmiştir. Nizâmülmülk, devlet kademesinde görev alan aile bireyleri, ilişki içerisinde olduğu âlimler, kendi ordusu ve emirleri ile bir güç odağı haline gelmiştir. Bunun sonucunda Nizâmülmülk, 11. yüzyılın son çeyreğinde rakipsiz bir şekilde Büyük Selçuklu siyasetinin en etkin figürü, Selçuklu yönetimini ve politikalarını belirleyen isim ve Selçuklu tarihinin en önemli olaylarında karar mercii olmuş ve sonuçta Selçuklu tarihine damga vurmuştur. İbnü’l-Esîr, Fatımî veziri Bedr el-Cemalî’nin kendisi için kullandığı sayısız lakabı kaydettikten sonra sadece Mısır’a hâkim olan bir devletin veziri bu kadar lakap kullanıyorsa Nizâmülmülk’ün “ilah”lık iddiasında bulunması gerekirdi diyerek hem Selçuklunun azametini hem de Selçuklu devletinde Nizâmülmülk’ün yerini göstermektedir. This article aims to study the Hadiths which ascribe morality to Allah, regarding narration and understanding, and how these Hadiths have cont-ributed to the establishment of a moral framework. The primary research problem is based upon understanding the meaning of Allah’s morality, how scholars have dealt with these Hadiths, and how they have benefited from them in the field of Islamic ethics. There are several key research questions, the most important of which are: What is the authenticity of these Hadiths (...) that attribute morality to Allah? What is the intended meaning of Allah’s morality? How have scholars addressed these Hadiths? Perhaps the most significant question is how these Hadiths have contributed to the develop-ment of an ethical theory. The research investigated the Hadiths that attri-bute qualities to Allah and studied them through the analysis of their chains of transmission. It then analysed how the phrase "Allah’s morality" contri-buted to the ethical theory among thinkers. The paper arrived at several conclusions, the most important of which is that there are five Hadiths att-ributing morality to Allah, all of which are weak according to Hadithic principles. However, these Hadiths support each other, and there are addi-tional references that espouse the idea of Allah being characterized by cer-tain morals, such as the Hadiths "Indeed, Allah is Tayyib (Pure)" and "In-deed, Allah is Modest." These Hadiths embrace the notion that Allah has attributes He loves His servants to embody. Therefore, the five Hadiths can be accepted as Hasan (good) due to external support. These Hadiths were accepted by some thinkers who interpreted Allah’s morality as His Beautiful Names (Asmāʾ llāhi al-ḥusnā). Consequently, Allah’s morality is understood as His Beautiful Names. The impact of these Hadiths can be observed in the works of Al-Ḥakīm al-Tirmidhī, Al- Ghazālī, and Al- Rāzī, as they placed the Beautiful Names of Allah at the centre of their ethical views. It is no-teworthy that those who accepted the idea of Allah’s morality were cauti-ous in dealing with it. An important observation is that those who based an ethical perspective on these Hadiths were not Hadith scholars, but rather individuals engaged in other fields of study. This can be ascribed to several reasons: one being that the Hadiths attributing morality to Allah are not authentic, and another being that many Hadith scholars refrained from in-terpretation and were content with the literal meaning of the Hadiths. Studies the threefold hierarchy of certainty, from its origins in Mahāyāna Buddhism, through Islam, to 17th century China. This tripartite scheme may be traced back to the ancient Buddhist scheme of the threefold wisdom as systematized by Vasubandhu of Gandhāra in the 4th-5th centuries CE. Following the advent of Islam in the 8th century, it was combined with Qur'anic notions of certainty. Initially taken up by early Islamic mystics such as Sahl al-Tustarī and al-Ḥākim al-Tirmiḏī, the notion of yaqīn was (...) gradually systematized into the three-level hierarchy of “knowledge or science of certainly”, “essence” of certainty, and “truth or reality of certainty”, a hierarchy that bears a distinct resemblance to the Buddhist threefold path of wisdom as discussed by Marc-Henri Deroche. Half a millennium later, this threefold hierarchy of levels of certainty, remotely inspired by Buddhism and integrated into the philosophical Sufism of Ibn ʿArabī and his Persian disciple Jāmī, this complex of ideas may have resurfaced in 17th century China. One of the most obvious differences between recent Shi’ite and Sunni political activism is the dominance of clerical leadership in the former and lay leadership in the latter. This article examines the reasons for this difference, analysing the authority theories of three contemporary Iraqi Shi’ite clerics. Ayatallah Baqir al-Hakim, until his death in 2003, was the ideologue of the Supreme Council for Islamic Revolution in Iraq, the military wing of which is the Badr Corps. Ayatallah Kazim al-Ha’iri is considered the (...) successor of the late Ayatallah Sadiq al-Sadr; the latter was the ideological inspiration for the Mehdi Army led by Sadiq al-Sadr’s son Muqtada al-Sadr. The relationship between Ha’iri and Muqtada has been tested in the recent past, and the two have distanced themselves from each other. In 2004, Ha’iri officially announced that Muqtada is not his representative in Iraq. Hence the analysis in this article represents the tradition of Shi’i thought from which Muqtada has emerged, rather than the specific doctrine to which he subscribes. Muqtada’s legal doctrine is difficult to ascertain given that he has not yet written a comprehensive work of jurisprudence. Grand Ayatallah Ali Sistani is certainly the most internationally respected of the three scholars. Considered the leading Ayatallah in Iraq (and perhaps the Shi’ite world in general), Sistani successfully negotiated the end to the occupation of Najaf by the Mehdi Army and is credited with masterminding the success of the United Iraqi Alliance in the Iraqi elections of January 2005. This article compares and contrasts the three thinkers’ theories of religious and political authority, including their differing conceptions of the ulama (scholarly elite) and their power within the community. The Arabic original of the ninth-century Kitāb al-Nawāmīs has not been discovered, save for three incomplete chapters. We have access to a fuller version only through a Latin translation, often known as the Liber vaccae, a title derived from its notorious experiments which involve the gruesome slaughter and mutilation of a cow to magically produce a rational animal or bees. Recent research on the Liber vaccae has focused mostly on its reception in medieval and early modern Europe. By contrast, the (...) present article explores the Indo-Arabic tradition to which Kitāb al-Nawāmīs belongs, as a re-orientation of the Liber vaccae established on two levels: textual and theoretical. Section I, on 'Texts and Practices', introduces ʿUyūn al-ḥaqāʾiq of Abū al-Qāsim al-ʿIrāqī, a text on magical practices which contains 26 chapters that correspond to sections in the Liber vaccae, affording us a glance into the Arabic reception of Kitāb al-Nawāmīs and bringing us closer to the Arabic original. The textual connection is established further by highlighting parallels between the experiments of the Liber vaccae / Kitāb al-Nawāmīs and other texts on natural magic, namely Ghāyat al-ḥakīm of Maslama al-Qurṭubī and Kitāb al-Sumūm by Ibn Waḥshiyya. Section II investigates the theoretical bases of the Liber vaccae / Kitāb al-Nawāmīs, by associating its content with the theories of spontaneous and artificial generation in Kitāb al-Tajmīʿ attributed to Jābir ibn Hayyān, Ghāyat al-ḥakīm, Kitāb al-Sumūm and, finally, another work by Ibn Waḥshiyya, al-Filāḥa al-nabaṭiyya. Jābir's and al-Qurṭubī's works have been studied in relation to the Liber vaccae by David Pingree, Maaike Van der Lugt, Sophie Page and William Newman; their findings are re-evaluated here in light of the texts of Ibn Waḥshiyya and al-ʿIrāqī. Der heilige Lazaros vom Berge Galesion gehört unbestreitbar zu den wichtigsten Vertretern des Mönchtums in der mittelbyzantinischen Zeit. Wohl um 966/67 in einfachen Verhältnissen unweit von Magnesia am Mäander geboren und als Leon getauft, hatte er das Privileg, schon in jungen Jahren in einigen Klöstern seiner heimatlichen Umgebung, in Oroboi, Kalathai und in Strobelion, eine Ausbildung erhalten zu können. Die Sehnsucht, mit eigenen Augen die Terra Sancta zu schauen, führte ihn dann im Alter von etwa 18 Jahren zunächst nach Attaleia, (...) wo er geraume Zeit verweilte und unter dem Namen Lazaros in die Reihen der Mönche aufgenommen wurde, bevor er sich seinen großen Wunsch erfüllte und nach Jerusalem weiterzog. Er verbrachte einige Jahre in den bedeutenden Klöstern H. Sabbas und H. Euthymios, bevor er sich durch die Zerstörung des Heiligen Grabes im September 1009 durch den Kalifen al-Hakim veranlaßt sah, nach Kleinasien zurückzukehren. Nach einer Zeit der Wanderschaft durch Kilikien, Kappadokien und Pontos traf er, wahrscheinlich 1010 oder 1011, wieder in der heimatlichen Provinz Asia ein, wo er sich alsbald am Berge Galesion niederließ, um hier für gute vierzig Jahre als Asket und Stylit auf wechselnden Säulen zu leben. Als Lazaros dann am 7. November des Jahres 1053 verstarb, stand er bei seinen Zeitgenossen in höchstem Ansehen, war er doch zu einer „lebenden Ikone“ geworden: aufgrund seiner Frömmigkeit und Spiritualität, aber nicht zuletzt auch dank seiner weisen Ansprachen und Ratschläge kamen die Gläubigen in großer Zahl, ihn zu sehen und zu hören; sie machten den Galesion dergestalt zu einem eigenen Pilgerzentrum, das zeitweilig sogar zum unweit gelegenen Ephesos in Konkurrenz treten konnte. Allah’ın ilk insanı, ilk peygamber yapmak suretiyle, insanoğlu ile iletişim kurmayı ve ona hitap eden vahiyler göndermeyi amaçladığı anlaşılmaktadır. Söz gelimi Tevrât’ı İbranice, İncîl’i Süryanice ve Kur’ân’ı Arapça göndermek suretiyle insanlar tarafından anlaşılmak istemiştir. Bununla birlikte onun İbranice kelâmı, Süryanice sözünden ve Arapça kelâmı da diğer dillerdeki sözünden farklı bir tabiata sahiptir. Bu gerçeklikten hareketle İslâm düşünce-fikir tarihine bakıldığında ilim adamlarının ilâhî kelâmın mâhiyetini, tabiatını anlamak ve bunu anlamlandırmak konusunda bir çabanın içerisine girdikleri görülmektedir. Esasen Allah’ın nasıl bir kelâma sahip (...) olduğunu anlamak ve kavramak, cismanî/fizik âleminden gayrı cismanî/fizikötesine doğru bir bakış çabasıdır. Buna rağmen hakikatin yılmaz arayıcısı insan, bu konuda söyleyecek bir söz bulabilme çabası içindedir. “İlâhî kelâmı”, Allah’ın bir sıfatı olarak değerlendirenler olduğu gibi bunu “ilâhî bir fiil” olarak telakki edenler de bulunmaktadır. İlâhî kelâm sıfatının veya fiilinin tecellîsinin Kur’ân olduğu da ehlince müsellemdir. Kur’ân lafızlarının aidiyeti konusunda başlıca üç görüş ortaya konulmuştur. Bu görüşler içerisinde hâkim ve râcih bakış açısına göre Kur’ân metni, lafız ve mana itibariyle Allah’a aittir. Buna göre Hz. Muhammed’e nâzil olan Kur’ân vahyi hem lafız hem de manadan oluşmaktadır. Bu telakkîyi savunan müelliflere göre vahyin oluşumu ve iletimi konusunda ne Cebrâil’in ne de Hz. Muhammed’in herhangi bir müdahale veya katkısı olmuştur. Dolayısıyla peygamberin vahiy nüzûl sürecinde rolünün tamamen pasif olduğu söylenebilir. Cibrîl, Kur’ân’ı önceden yazılı olarak bulunan bir mekândan, yani levh-i mahfûzdan ezberleyerek veya Allah’tan işiterek ya da Allah’ın lafızları ona vahyetmesiyle Hz. Peygamber’e indirmiştir. İkinci yaklaşıma göre Kur’ân metninin manası Allah’a, lafızları Hz. Peygamber’e aittir. Bu yaklaşıma göre Cebrâil, sadece manaları Hz. Peygamber’e indirmiştir. Hz. Peygamber de kendisine bildirilen manaları kavramış ve onları Arapça ifade kalıplarında söylemiştir. Üçüncü yaklaşıma göre ise Kur’ân’ın manası Allah’a, lafızları Cebrâil’e ait olmaktadır. Yani Cebrâil’e yalnız mana ilkâ edildi ve o lafızları oluşturdu. Bu çalışmada İslâm düşünce tarihinde ilim adamlarının kelâmullâhın tabiatını anlamak ve bunu anlamlandırmak konusunda lafızların aidiyeti konusunda ortaya koydukları söz konusu yaklaşımlar öncelikle deskriptif (tasvîrî/betimleyici) bir üslupla incelenmektedir. Akabinde bu doğrultuda serdedilen yaklaşımlar Kur’ân’ın bütünlüğü ve klasik dönem tefsir merviyyâtı açısından analitik (tahlîlî/istidlâlî) bir bakış açısıyla irdelenmektedir. Denilebilir ki Kur’ân’ın mana yönüyle Allah’a aidiyeti konusunda ilim ehli arasında herhangi bir ihtilâf yoktur. Temel ihtilâf Kur’ân lafızlarının Allah’a mı Cebrâil’e mi yoksa Hz. Muhammed’e mi ait olduğu hususudur. Kur’ân’ın bütünlüğü ve vahyin nüzûl keyfiyetine dair klasik dönem tefsir rivayetleri dikkate alındığında hâkim görüşün diğer iki görüşe göre daha tutarlı olduğu kanaatine ulaşılmaktadır. (shrink)

İstisnâ‘ akdi klasik fıkıh eserlerinde yerini bulan ve Hz. Peygamber döneminden itibaren insanlar arasında yaygın olarak kullanılan bir akittir. Fıkhın gelişimiyle birlikte bu akitle ilgili de geniş bir bilgi birikimi oluşmuştur. Tarihi süreçte ihtiyaçlara binaen akdin uygulama biçimi ve şartlarında son dönemlerde bazı gelişmeler olmuştur. Özellikle Osmanlı’nın son dönemlerinde kabul edilen Mecelle-i Ahkâm-ı Adliyye ile akdin genişletildiği ve zamanın ihtiyaçlarına göre içtihatlar arasında tercihe gidildiği görülmektedir. Günümüzde İslamî finansın gelişimine paralel olarak yeni finansman teknikleri geliştirme çalışmaları devam etmektedir. Bu bağlamda (...) klasik bir akit hüviyeti arz eden istisnâ‘ akdi de barındırdığı özel durumlar sebebiyle İslamî finans alanında rağbet görmeye başlamış ve çeşitli uygulamalarda kullanılmaktadır. İstisnâ‘ akdi, tarıma dayalı ekonomik yapının hâkim olduğu toplumlarda, insanların ihtiyaç duyduğu bir akit olmakla birlikte; sanayi ve mühendisliğin hâkim olduğu günümüz dünyasında daha fazla ihtiyaç duyulur hale gelmiştir. Bunun için akdin, farklı çalışmalara konu olması ve finans alanında yeni ürünlerin oluşturulmasında, aktif bir şekilde kullanılması gerekmektedir. Çalışmada istisnâ‘ akdinin fıkıh eserlerinde işlenişi ele alınarak günümüzdeki uygulamaların fıkhi boyutu bu çerçevede değerlendirilmeye çalışılacaktır. (shrink)

Diyanet İşleri Başkanlığı teşkilatı kurumsal olarak Türk medyasında en çok tartışılan kurumlar arasında yer almaktadır. Bu çerçevede Diyanet teşkilatının kamuoyunda nasıl algılandığı ve nasıl bir imaja sahip olduğu önem arz etmektedir. Çalışmada köşe yazarlarının yazdığı yazılar üzerinden Diyanet İşleri Başkanlığı’nın imajının medyada nasıl algılandığı araştırılmıştır. Nicel içerik analizi yönteminin kullanıldığı çalışmada iki aşamalı akış kuramı temelinde köşe yazarları kanaat önderi olarak ele alınmıştır. Araştırma, 2013-2022 yıllarını kapsayan 10 yıllık bir veri setinde kota örneklemesi ve maksimum çeşitlilik örneklemesi uygulanarak Diyanet İşleri (...) Başkanlığı’nı en çok konu edinen 20 yayın organı üzerinden gerçekleştirilmiştir. Çalışmanın bulgularına göre kurumun genel imajına bakıldığında köşe yazılarında Diyanet İşleri Başkanlığı’nın olumsuz olarak algılandığı belirlenmiştir. Türkiye’deki siyasi kutuplaşmanın bir yansıması olarak Diyanet kurumuna bakış açısı da keskinleşmektedir. Diyanet’in yaygın eğitim anlamında topluma ulaşma araçlarından olan hutbe ve vaazların, diğer taraftan sosyal hayatı din ölçeğinde yorumlama ve yönlendirme işlevi olan fetva mekanizmasının çıktılarının olumsuz algılanması yaygın din eğitiminde kullanılan din dili ve gündelik ihtiyaçlar ile dinî metinler arasındaki uyumu sağlama konusunda uygulanan yöntemlerin gözden geçirilmesi gerektiğini göstermektedir. Cinsiyet dağılımı ve temaların ele alınış biçimi bakımından Diyanet hakkında kaleme alınan yazılarda erkek egemen bir bakış açısının hâkim olduğu belirtilebilir. Bu durum, din merkezli tartışmalara da eril bir söylem ve yorumun hâkim olduğu şeklinde yorumlanabilir. Yazılar incelendiğinde Diyanet kurumunun ekonomik faaliyetleri de olumsuz olarak algılanmaktadır. Yayın organlarının Diyanet’e bakış açılarının genel olarak ideolojik eksende değil siyasi eksende farklılaştığı görülmektedir. (shrink)

Dinî tecrübe Friedrich Schleiermacher (ö.1768) ile önem kazanan ve William James’in (ö.1842) eserleriyle din felsefesinde teistik delillerin içine dahil olan bir delildir. Dini tecrübelerin birçok şekilde meydana geldiği iddia edilmektedir. Bunlardan biri de sezgidir. Bu bildirinin amacı sezgisel bilginin Tanrı’nın varlığına delil olup olmadığını ortaya koymaktır. Sezgisel yetenek, insanın fiziksel gelişimine (yani beyin) paralel olarak gelişen bir yetidir ve zihnin gelişmesiyle birlikte kapasitesi artmaktadır. Önce çocukta duygusal bir sezgi hakim iken (4-7 yaş), daha sonra çocuğun somut işlemlere geçmesiyle sezgisel yetenek (...) somutla ilişkili hale gelir. (7-11 yaş) Ve somut nesne ve durumlar (deney ve pratikler) çocuğun sezgisel yeteneğinin gelişmesine yol açar. En son aşamada yani soyut işlemler döneminde (11-17 yaş) çocuğun beyninde prefrontal lobun gelişmesine bağlı olarak akli muhakeme gelişir ve bunun etkisiyle sezgisel yetenek, akli verileri kullanarak soyut sezgiye yönelir. Sezgisel yetenek böylece üç dönemin özelliklerini gösterebilir; çocukluktan aldığı duygusal sezgi ve somut/nesnenin çağrıştırdığı somut sezgi ve aklın dış dünyadan aldığı bilgileri zihinsel süreçlerden geçirerek işlemesi sonucu gelişen akılcı sezgi. O nedenle insanlarda tek bir sezgiden bahsetmek yanlıştır. Sezginin üç türü birbiriyle eş güdümlü olarak bilgiyi elde etmek için çalışır. Bu üç sezgi türünden akılcı sezgiye önem veren İbn Sina, sezgi bilgisini rasyonel, epistemolojik alana dahil eder. Yaptığı ilim sınıflamasında sezgi bilgisini deneye dayalı bilgi türü olarak görür ve akla/deneye dayalı bir sezgi anlayışı geliştirir. Bu sezgi anlayışı, peygamberliği rasyonel bir temele oturtmak ve irrasyonel olmadığın açıklamak için de kullanır. Kudsi akla sahip peygamberler üstün zekalarının etkisiyle güçlü sezgiye sahip olurlar ve vahiy alırlar. Vahiy alan sezgisel yetenek diğer insanlarda ortaya çıkıp dini tecrübeleri şekillendirebilir mi? Peygamberlerin vahiy tecrübesini taklit ederek kendilerinde yüksek sezgisel yeti olduğunu savunan bazı kişiler (veli) ilham yoluyla bilgi elde ettiklerini iddia etmişlerdir. Dini tecrübe delilinde bu tür tecrübeler dini delil olarak sayılmaktadır. Fakat bu sezgisel bilginin kaynağı duygu mudur, somut bir gösterge (deney) midir yoksa akıl mıdır? İlham ürünü olan eserlerde her zaman duygu vardır ve bu tür ifadeler insanı duygunun hakim olduğu zihinsel bir duruma götürür. Fakat vahiy tecrübesinde duygunun yanında, somut dünyanın varlığı ve akla dayalı bir sezginin olduğu da vurgulanmaktadır. O nedenle sezgisel bilgi ürünü vahiy üç tür sezgi bilgisine dayalı iken, ilham ürünü olan sezgisel bilgi sadece duyguya dayalıdır. O nedenle ‘dini’ bir delil olarak değil ‘mistik’ bir delil olarak değerlendirmeyi hak eder. (shrink)

The main evidence used in a matter of proving prophethood in Kalām is miracles. For this reason, other extraordinary situations that miraculously occur have always been on the agenda of theologians. Of these the most similar to miracle is karāma events that occur extraordinary in the hands of Walī. Karāma has been discussed on certain theoretical grounds in kalām books during the beginning period of Sunnī kalām. As in other theological debates, the leading adversaries of Sunnī theologians in the issue (...) of karāma were Muʿtazilite theologians. This study discusses approaches towards karāma in early period of Sunnī kalām. Accordingly, the scholars who determined the basic approaches of Ashʿariyya and Māturīdiyya kalām schools are included in the study. İmām al-Ashʿarī, Ibn Fūrak, al-Bāqillānī, ʿAbd al-Qāhir al-Baghdādī, Abu’l-Maʿālī İmām al-ḥaramayn al-Juwaynī, Abū ʿAbdallāh al-Ḥalīmī and Abū Isḥāq al-Isfarāyīnī from Ashʿarī school; Abū Manṣūr al-Māturīdī, Ḥakīm as-Samarqandī, Abū al-Yusr al-Bazdawī and Abū al-Muīn an-Nasafī from Māturīdiyya school, in this context, are included in the study. Besides, some authors from fields other than kalām are included in the scope of the study in order to determine the first use of the concept of karāma and different approaches are discussed. In the study, after the views of the theologians on the subject are presented descriptively, these views are critically assessed. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Bu makalede, Erwin Schrödinger’in kuramsal biyolojiye önemli bir katkıda bulunan Yaşam Nedir? adlı kitabındaki fikirlerini ve bu kitabın da etkisiyle gelişen gen-merkezci yaklaşımı eleştirel olarak değerlendirmeyi amaçlıyorum. Schrödinger’in canlılık konusundaki entelektüel mirasının tartışmaya açılması moleküler biyolojinin yaşam bilimlerinde hakim hale gelişinin ve yaşamın organizasyona dayalı temelinin anlaşılması açısından özel bir önem taşıyor. Yayınlandığından beri biyoloji felsefesinde önemli tartışmaları beraberinde getiren Yaşam Nedir? kitabı, yaşamı termodinamiğin yasaları doğrultusunda ele alması açısından biyolojide organizasyonu vurgular. Bununla birlikte Schrödinger’in canlılığın kodu olarak tasavvur ettiği (...) aperiyodik kristal kavramı gen-merkezciliği destekleyen öncül fikirleri barındırmaktadır. Schrödinger, canlı varlıkların doğadaki entropi artışı eğilimiyle baş etmesi gereken nitelikte olması gerektiğini savundu ve bu görüş, canlılığa dair temel bir ilke olarak yaygın kabul gördü. Schrödinger’in yaşamın düzenliliğini mikro düzeyde aperiyodik kristal hipotezi ile açıklama girişimi ise nispeten daha tartışmalıdır. Makalede, bu tartışmalı konuları aydınlatmak amacıyla Schrödinger ve ardından gelişen gen-merkezci yaklaşımlara yönelik eleştirileri ele alıyorum. Ardından, gen-merkezciliğin sınırlılıklarına karşı yaşamın organizasyonunun organizma seviyesinde ele alınması değerlendiriyorum. Bu görüş, Kant’ın self-organizasyon kavramıyla tanımladığı, parça-bütün ilişkilerindeki karşılıklılığı temel alır. Son olarak, yaşamın organizasyonuna dair felsefî yaklaşımları ve entropinin buradaki rolünü tartışıyorum. Organizma düzeyinde ve organizma-çevre ilişkisindeki çoklu etmenlerin geri-besleme ilişkilerine dayanan ağ yapısı, gen-merkezciliğin indirgemeci yaklaşımına karşı kapsayıcı bir alternatif sunmaktadır. Psikolojinin bir bilim dalı olarak ortaya çıktığı 19. yüzyıla kadar, insana dair sorunlar, felsefi bir yorumla ele alınmıştır. Zaman içinde pozitivizm, materyalizm gibi felsefe akımlarının yön vermesiyle psikoloji bilimi kendine ait kavram ve yöntemlere sahip olmuştur. Bu süreçte bilimde hâkim olan paradigmaların etkisiyle din, uzun bir dönem bilimsel araştırmaların dışında tutulmuştur. Bilim adamalarının dine karşı olumsuz tutumlarına rağmen, Hıristiyan din adamaları felsefe ve psikoloji gibi alanlardaki bilimsel gelişmeleri yakından takip etmişlerdir. Kilise hizmetleri çerçevesinde geleneksel olarak sürdürülen “pastoral care” faaliyetlerinin psikoloji (...) ve psikoterapi alanlarındaki gelişmelerden etkilenmesiyle bugünkü dini danışma ve rehberliğin temeli olan “pastoral care and counseling” kavramları ve yöntemleri ortaya çıkmıştır. 1960’lardan sonra dünya genelinde bir yayılma eğilimi gösteren dini danışma ve rehberlik konusu, son yıllarda Türkiye’deki dini kurum ve akademik çevrelerin de ilgi odağı haline gelmiştir. Bu makalede, konunun İslam kültürü içindeki realizasyonu ile ilgili çalışmalara katkı vermek amacıyla dini danışma ve rehberliğin temel kavramları ve tarihi arka planına odaklanılmıştır. Modern yaşam biçimi toplumsal değişimi hızlandırmakla kalmamış bireysel ihtiyaçları da bir hayli değiştirmiştir. Yaşanan hızlı değişim ve farklılaşan ihtiyaçlar bir takım psikolojik problemleri beraberinde getirmiştir. Buna bağlı olarak insanı olumsuz etkileyen ve hastalanmasına yol açan psikolojik süreçler incelenmeye başlanmıştır. Öte yandan değişimden hayatın değer ve inanç sistemleri de etkilenmiş, kurumsal dini yapılarda ve din hizmeti anlayışlarında önemli değişme ve gelişmeler meydana gelmiştir. Bu sebeple bir taraftan yeni ortaya çıkan olay ve durumlar karşısında dinin bakış açısını ve tutumunu öğrenme ihtiyacı, diğer taraftan yaşanan acı ve krizler karşısında psikolojik yardım ve manevi destek gereksinimleri giderek artmıştır. Kısacası din, insanların kendi başlarına hareket etmekte zorlandığı, rehberliğe ihtiyaç duyduğu bir alan olmuştur. Dini danışma ve rehberlik alandaki ilk çalışmalar, tamamen bir Hıristiyanlık faaliyeti olarak ortaya çıkmış olduğu için bu alana ait ilk kavramlar da Hıristiyan kültürü ile yakından ilgilidir. Dini danışma ve rehberliğin temel kavramlarından olan “pastoral care” genellikle rahip ya da papazların özellikle kilise dışında yürüttükleri dini danışmanlık ve rehberlik hizmetlerini ifade etmektedir. Günümüzdeki dini danışma ve rehberlik hizmetlerinin temelini, Hıristiyan din adamlarının verdiği manevi destek, öğüt ve tavsiye anlamındaki pastoral care faaliyetleri oluşturmaktadır. Ayrıca kavramların, Mesih ve teslis inancı; günahsızlık ve günahların kefareti, lütuf yoluyla kurtuluş öğretileri; papazların yanılmazlığı ve ruhbanlık anlayışı; itiraf müessesesi ve kilisenin statüsü gibi Hıristiyan teolojisine ait kökenleri bulunmaktadır. Pastoral care ve pastoral counseling birbirlerinden bir dereceye kadar ayırt edilebilen yardım şekilleridir. Aralarındaki farklılık, papazların insanlarla çalışırken, ilgili psikolojik dinamikler yerine kendilerinin ahlaki duruş mesafelerinden kaynaklanır. Bu nedenle ikisi arasında en geniş ve kapsayıcı pastoral faaliyet, kesinlikle pastoral care çalışmalarıdır. Bu çalışmalar, resmi ve gayrı resmi konuşmalar, diyaloglar ve diğer iletişim etkileşimleri ile gençler, çiftler, yetişkinler ve çeşitli diğer gruplarla daha fazla ya da az yapılandırılmış genel ilişkilerdir. Pastoral counseling olarak adlandırılan yardım ilişkileri ise pastoral care faaliyetlerinin genel ve her yerde uygulanabilirliğinden farklı şekilde, bireylerin belirli bir yerde ve belirli bir süre tahdidi çerçevesinde yapılandırılmış olan yardım faaliyetlerini içerir ki, böyle bir yardım sürecinde papazın dikkatini ve zamanını gerektiren durumlar söz konusudur. Burada ayırt edici nokta, bireyin psikolojik durumu ve sorunlarının daha fazla olmasıdır. Dini danışma ve rehberliğin kurumsal bir hizmet alanı olarak ortaya çıkışı, reform hareketleri ve sanayi devriminin Batı Avrupa ülkelerinin sosyal dokusu ve dini kurumların yapılanması üzerinde yaptığı değişimle doğrudan alakalıdır. Nitekim Katolikler ve özellikle Ortodokslar yeni gelişen psikolojik danışma faaliyetlerinde daha temkinli bir tutum takınırken Protestanlar dini destek ve yardım hizmetlerinde yeni psikolojik teori ve teknikleri kucaklama eğilimi göstermişlerdir. 15. yüzyıldan itibaren oluşan, insana, Tanrı’ya ve âleme bakıştaki farklılaşmanın gerçekleştiği süreç, 18. yüzyılda “aydınlanma” olarak adlandırılan köklü bir değişimi beraberinde getirmiştir. Doğaüstünün doğayla, dinin bilimle, tanrısal buyruğun doğa yasasıyla, din adamlarının filozoflarla yer değiştirmesi ve dini inanca toleransın azalması ile karakterize edilen bu dönemde, din ve maneviyat konusu, psikolojik araştırmalar ve klinik deneyler dışında tutulması gerektiğine inanılan, kişilere özgü, bilim dışı, bilinmez bir özel alan olarak görülmüştür. Psikolojinin bir bilim dalı olarak ortaya çıktığı dönemde bilimsel sahada hâkim olan paradigmanın etkisiyle bilim adamaları her ne kadar din ile sağlıklı bir ilişki kuramadıysa da; özellikle Amerika ve Avrupa’da kilise hizmetleri çerçevesinde “pastoral care” faaliyetlerini yürüten din adamları, modern psikiyatri ve psikoterapi birikiminden etkili bir şekilde yararlanmışlardır. Kilise faaliyetlerinin psikoloji alanındaki gelişmelerden etkilenmesiyle papaz ve rahiplerin dini konulardaki yardım çalışmaları hem kilise içinde hem kilise dışında daha profesyonelce yürütülen faklı bir boyut kazanmaya başlamıştır. Papazların yetiştirilmesinde danışma psikolojisi ve klinik psikolojinin yöntem ve kurallarının kullanılmaya başlamasıyla “pastoral counseling” alanı gelişme göstermeye başlamıştır. Abraham Maslow’un “kendini gerçekleştiren kişiler” hakkındaki araştırmasına kadar (1962) ilgiye layık görülmeyen din ve maneviyat, bu araştırma sonucunda, karşılanması gereken nihai bir ihtiyaç ve önemli bir motivasyon olarak fark edilmiştir. Alanda son yapılan araştırmalar, din ile ruh ve beden sağlığı arasında önemli ilişkilerin olduğunu ortaya koymaktadır. Danışmanlarca, danışanların dini inançlarının danışma sürecine dâhil edilmemesi; danışanın kimliğinin işe yarayan önemli bir bölümünü yok saymakla eş anlamlı kabul edilmektedir. Bu gelişmelerin sonucu olarak bugün başta ABD ve diğer gelişmiş ülkelerde birçok Tıp Fakültesi ve Psikoloji bölümleri, programlarına dini danışmanlıkla ilgili dersler koymaktadır. 20. yüzyılın başından beri Hıristiyan Batı dünyasında uygulanmakta olan pastoral care and counseling faaliyetleri, toplumsal değişmenin küresel etkileri ve gittikçe benimsenen modern yaşamın farklılaşan ihtiyaçlarına bağlı olarak son yıllarda Türkiye’deki akademik çevrelerin ve ilgili kurumların ilgi odağı haline gelmiştir. Dini danışma ve rehberlik, kültürümüzde henüz yabancı bir kavram ve kurumsallaşmamış bir hizmet alanı olarak kabul edilse de; Hz. Peygamber’den (s.a.v) bu yana sürdürülen din hizmetlerinin en önemli bölümünü, özü dini rehberlik olan irşat faaliyetleri oluşturmaktadır. Ancak günümüzde modern psikolojik yardım disiplinlerinin ilke ve yaklaşımlarından destek alan yeni irşat modellerine ihtiyaç vardır. Dini danışma ve rehberlik, amaç, ilke, yöntem ve yaklaşımları ile toplumda oluşan yeni ihtiyaç ve beklentileri karşılamaya yönelik sürdürülen çabalara önemli katkılar sağlayacaktır. (shrink)
