An online world exists in which businesses have become burdened with managerial and legal duties regarding the seeking of informed consent and the protection of privacy and personal data, while growing public cynicism regarding personal data collection threatens the healthy development of marketing and e-commerce. This research seeks to address such cynicism by assisting organisations to devise ethical consent management processes that consider an individual’s attitudes, their subjective norms and their perceived sense of control during the elicitation of consent. It (...) does so by developing an original conceptual model for online informed consent, argued through logical reasoning, and supported by an illustrative example, which brings together the autonomous authorisation (AA) model of informed consent and the theory of planned behaviour (TPB). Accordingly, it constructs a model for online informed consent, rooted in the ethic of autonomy, which employs behavioural theory to facilitate a mode of consent elicitation that prioritises users’ interests and supports ethical information management and marketing practices. The model also introduces a novel concept, the informed attitude, which must be present for informed consent to be valid. It also reveals that, under certain tolerated conditions, it is possible for informed consent to be provided unwillingly and to remain valid: this has significant ethical, information management and marketing implications. I work every day in the Cornell College Library. Usually on the ground floor level, where the fast computers are. The other day I took an early afternoon break, and went up to the second floor reading room to get a copy of The Times and relax. As I passed through the reading room I saw a Japanese student sitting at the long reading table, studying his physics text. He was sitting up straight; the hard back book was standing vertical (...) in front of him on the table, three feet away. The room was pretty silent and the boy was concentrating. I got my paper and took it back to the lower level to read. I read for twenty minutes, then returned to my computer, where I worked for an hour and a half. I finished my online teaching for the day, I packed up my stuff, climbed back up the stairs to the reading room, crossed the room to exit. At that point, tired and stretching, I usually don’t observe much. But this time I noticed the same Japanese student. He was still in the same position, sitting upright looking at his book, balancing it firmly in both hands. He seemed still to be in the same position of attention: nothing had changed, I felt, except the design on the page: a different graph of a different color. I went out through the main door of the Library, and went home. (shrink)

I want in this paper to do two things. First, I want to respond to some studies that argue that people are often not rational: that people regularly and systematically depart from rationality. The conclusion itself does not worry me. I pressed for the same in a recent book. But the arguments seem to me wrong, and wrong in an interesting way. There may be something to be learned from seeing how and why they fail.

This article presents a contextualisation of Belgian philosopher and historian of psychiatry and sexuality, Patrick Vandermeersch’s (1946–), unpublished analysis of French philosopher Michel Foucault’s (1926–1984) interpretation of Methodius of Olympus’ (d.ca.311) views on virginity and chastity, in Histoire de la sexualité 4 ( Les aveux de la chair ), published in February 2018 at Gallimard in Paris under the editorship of Frédéric Gros. The article contributes to the reception and the ongoing analyses of Les aveux de la chair by (...) exploring Foucault’s reading while highlighting both the importance of Vandermeersch’s analysis and the sexological-historiographical significance of his broader oeuvre that spans over four decades. Vandermeersch shows that Foucault, as many other commentators of Methodius, did not substantially engage Methodius’ explicit indebtedness and persistent references to Plato (already evident in the title Symposium but especially regarding the Phaedrus ). Platonic homoeroticism is, according to Vandermeersch, as a consequence often too hastily, and therefore problematically, transposed on contexts of female virginity. Likewise, Foucault, when indicating already at the end of Histoire de la sexualité 2 ( L’usage des plaisirs 1984), the particular relevance of homoeroticism in the development of Western sexuality, seemed to adhere to this transposition. Could ‘beautiful boys’ truly be transposed onto ‘female virgins’ without severe sexual-discursive complications? And could Methodius’ encomium of virginity in any way be understood independent of his understanding of the ‘resurrection of the body’, with the integrity of its (virginised) sexual desire intact? These are among Vandermeersch’s valid and challenging questions to both Foucault and his contemporary readership. Contribution: Foucault’s reading of the church- and desert fathers in Histoire de la sexualité 4 ( Les aveux de la chair ) impacts early Medieval philosophy, early Medieval history, church history, patristics, philosophy of religion, psychology of religion and sociology of religion. Since these proximate disciplines are drawn towards Foucault’s text, they may well note its ongoing examinations. Foucault’s direct impact on these disciplines is illustrated in Vandermeersch’s significant analysis of Foucault’s reading of Methodius in Les aveux de la chair. Vandermeersch’s broader oeuvre in philosophy, theology, psychiatry, psychology, psychology of religion and the history of sexuality is concurrently contextualised as of ongoing contemporary importance for these disciplines. The article resituates critical realism within critical theory and proposes a tripartite articulation of British critical realism, German critical theory and French anti-utilitarianism. It suggests that the critique of positivism has to be enhanced with a critique of utilitarianism and makes the case that both critiques have to be grounded in a hermeneutic approach to social life. By taking the symbolic constitution of the world seriously, critical realist hermeneutics offers a via media between naturalism and anti-naturalism, explanation and interpretation, universalism (...) and relativism, materialism and idealism, realism and constructivism. Nikolai Lossky is key to the history of the Husserl-Rezeption in Russia. He was the first to publish a review of the Russian translation of Husserl’s first volume of the Logische Untersuchungen that appeared in 1909. He also published a presentation and criticism of Husserl’s transcendental idealism in 1939. An English translation of both of Lossky’s publications is offered in this volume for the first time. The present paper, which is intended as an introduction to these documents, situates Lossky within (...) the Rezeptionsgeschichte of Husserl in Russia and explains why he is central to it. It also explains what Lossky principally found in Husserl: he saw in the latter’s critique of psychologism support for his own ontology, epistemology, and axiology. Lossky characterizes his ontology as an ideal-realism. According to ideal-realism, both the realm of ideal beings and the realm of real beings are mind-independent. Per his epistemology, which he calls “intuitivism,” real beings are intuited by sensual intuition and ideal beings by intellectual intuition. The realm of ideal beings includes the subrealm of values, which is intuited by axiological intuition. This thoroughly realist conception contrasted sharply with the subjectivist tendencies of the time. So, when Lossky took cognizance of Husserl’s critique of psychologism, he thereupon found an ally in his battle against the various subjectivisms. But, when Husserl took the transcendental idealist turn, Lossky was at the forefront of the backlash against the new direction Husserl wanted to give to phenomenology. (shrink)

One of the trademarks of Nicolai Hartmann’s ontology is his theory of levels of reality. Hartmann drew from many sources to develop his version of the theory. His essay “Die Anfänge des Schichtungsgedankens in der alten Philosophie” testifies of the fact that he drew from Plato, Aristotle, and Plotinus. But this text was written relatively late in Hartmann’s career, which suggests that his interest in the theories of levels of the ancients may have been retrospective. In “Nicolai Hartmann und seine (...) Zeitgenossen,” Martin Morgenstern puts the emphasis on contemporaries of Hartmann: Émile Boutroux, Max Scheler, Heinrich Rickert, Karl Jaspers, and Arnold Gehlen. But there is another plausible source for Hartmann’s conception of levels that has so far remained overlooked in the literature. Hartmann studied with and was influenced by Nikolai Lossky. Lossky has a theory of levels that he adopted from Vladimir Solovyov. Solovyov presents his theory of levels, among other places, in Oпpaвдaнie дoбpa, where he says that the five principal stages of the cosmogonic process of ascension toward universal perfection, which are given in experience, are the mineral or inorganic realm, the vegetal realm, the animal realm, the realm of natural humanity, and the realm of spiritual or divine humanity. This theory appears to bear significant similarities with the theory of levels of reality that Hartmann will develop a few decades later. Solovyov was widely read in Russia and it would be unlikely that Hartmann was not at least minimally acquainted with his work. Chances are that Hartmann came into contact with it in some details. An intellectual lineage could thus likely be traced from Hartmann back to Solovyov. In this paper, I document and discuss this possible lineage. (shrink)

Russian philosophy underwent many phases: Westernism, Slavophilism, nihilism, pre-revolutionary religious philosophy, and dialectical materialism or Soviet philosophy. At first sight, each one of these phases seems antithetical to the preceding one. Yet, they all appear to have in common a certain negative attitude towards the subjectivism of Kantianism and German Idealism. In contrast to the latter, Russian philosophy typically displays a tendency towards ontologism, which is generally defined as the view that there is such a thing as being in itself, (...) i.e., being independent of cognition, and that this being is to some extent knowable. We discern, in these otherwise diametrically opposed movements, an underlying ontologism that constitutes a common thread running in a straight line through the history of Russian philosophy. The twentieth century Russian philosopher Nikolai Lossky was one of the earliest and most important proponents—but also critics—of Bergson’s philosophy in Russia at a time when many Russian philosophers were preoccupied with the same complex of philosophical questions and answers that Bergson was addressing. Thus, if only from the standpoint of intellectual history, Lossky is central to the study of the reception of Bergson in Russia. In this article, I present the principal historical links, points of agreement between Bergson and (...) Lossky, such as their respective anti-Kantianism, intuitivism, ontological realism, vitalism, organicism, Neo-Platonism, as well as their points of disagreement, including some of Lossky’s key criticisms of Bergson, with special emphasis on the issues of intuition, ideal being, substance and change, time, and sensible qualities. This paper is meant as an introduction to the translations of Lossky’s “Heдocтaтки гнoceoлoгiи Бepгcoнa и влiянie иxъ нa eгo мeтaфизикy” (The Defects of Bergson’s Epistemology and Their Consequences on His Metaphysics) (1913) and his review of Bergson’s, Les deux sources de la morale et de la religion (1932), which are published in the present issue of Studies in East European Thought. The prominent Russian philosopher Nikolai Lossky and his ex-student Nicolai Hartmann shared many metaphysical and epistemological views, and Lossky is likely to have influenced Hartmann in adopting several of them. But, in the case of axiological issues, it appears that Lossky also borrowed from the axiologies of Hartmann and the latter's Cologne colleague, Max Scheler. The links between the theories of values of Scheler and Hartmann have been studied abundantly, but never in relation to Lossky. In this paper, I examine (...) the manifold relationships – similarities, differences, borrowings, criticisms, and possible influences – between Lossky's axiology and those of Scheler and Hartmann on four key interweaving issues: (1) their ontological realism with regards to the objectivity of values, (2) their epistemological theories of the intuition of values, (3) their ontological definitions of "value", i.e., whether values are relations, qualities, essences, powers, meanings, etc., and (4) their theories of the stratification of values. A global transformation of modes of religious authority has been taking place at an increasing pace in recent years. The social and political implications of the growing dominance of neo-scripturalist discourses on Islam have been particularly noticeable after 11 September 2001. This evolution of religiosity, which is mediated by mass media and new media technology, creates the conditions of existence of a post-Weberian and post-Durkheimian order. In this new social context, legitimacy (and legitimate violence) can be more easily disconnected from (...) the institutionalized framework of religious and political authority. Both in Muslim countries and in Western democracies, the attempt by Islamic activists to make the Shari’a relevant in contemporary settings creates new opportunities and challenges for legal pluralism. At the same time, the multiplication of Muslim voices claiming to be able to interpret the sacred texts, particularly in virtual communities, creates an increasingly inchoate ‘noise’ about Islamic orthodoxy. In the context of an exponential increase in the global possibilities for religious identification and expression, the growth of neo-scripturalist interpretations of Islam reflects a quest for parsimony and stability. The Russian philosopher Nikolai Onufrievich Lossky adhered to an evolutionary metaphysics of reincarnation according to which the world is constituted of immortal souls or monads, which he calls ‘substantival agents.’ These substantival agents can evolve or devolve depending on the goodness or badness of their behavior. Such evolution requires the possibility for monads to reincarnate into the bodies of creatures of a higher or of a lower level on the scala perfectionis. According to this theory, a substantival agent can evolve (...) by being gradually reincarnated multiple times through a sort of process of metamorphosis from the level of the most elementary particles all the way up to the level of human beings or even higher. In ‘Ученiе Лейбница о перевоплощенiи какъ метаморфозѣ’, Lossky argues that the works of Leibniz contain scattered elements of such a systematic evolutionary doctrine of reincarnation as metamorphosis and he attempts to reconstitute this doctrine. Leibniz’s philosophy enjoyed a Russian fandom that endured from the eighteenth century to the death of the last exiled Russian philosophers in the twentieth century. There was, to begin with, Leibniz’s direct impact on Peter the Great and on the scientific development of Saint Petersburg. Then there was, still in the eighteenth century, Mikhail Lomonosov, who was sent to study with Christian Wolff in Marburg, and who came back to Saint Petersburg with a watered-down Leibnizian worldview, which he applied to (...) the study of chemistry and physics. Another eighteenth century philosopher, Alexander Radishchev, who studied in Leipzig, displayed acquiescence with a number of key elements from Leibniz’s philosophy. Russian Lebnizianism as a continuous philosophical movement was considerably reinvigorated in the 1870s when the Leibnizian German philosopher Gustav Teichmüller took a position at the University of Dorpat (nowadays Tartu, Estonia), which was then located within the Russian Empire. Teichmüller influenced a number of Russian philosophers into adopting a “Teichmüllerian” version of Leibnizianism. Among these philosophers were Evgeny Bobrov and Alexei Kozlov. In Saint Petersburg, Kozlov influenced his own son, Askoldov, and the latter’s friend — Nikolai Lossky. In the meanwhile, in Moscow Lev Lopatin, Nikolai Bugaev, and Petr Astafiev developed their own Leibnizianism in seemingly relative independence from Teichmüller’s influence and presumably, in some cases, under the partial influence of Vladimir Solovyov. Despite this relative independence, however, the fact remains that there was in late nineteenth and early twentieth century Russia a network of more or less loosely interconnected Leibnizian philosophers who read each other and wrote about each other, who exchanged ideas, and who constituted a movement that we might characterize as “Russian Leibnizianism” or “Russian Neo-Leibnizianism.” In this chapter, I tell the story of the intellectual lineage of Russian Leibnizianism. Investigating the neo-Kantian origins of structuralism and culturalism, this article analyses the development of Cassirer's thought by following his intellectual progression from knowledge to culture, and from culture to praxis. The article is in two parts. In the first part, the author presents an analysis of Cassirer's relational conception of knowledge. In the second part, the critique of knowledge is superseded by a critique of culture. The author analyses Cassirer's anthropological philosophy of symbolic forms and critically compares it to Simmel's (...) vitalist theory of culture. The article ends with a plea for a practical sociology inspired by Cassirer's return to Kant's practical philosophy. (shrink)

In sum, major critics of the twentieth century continually insist that poetry's unique value lies in its ability to convey meanings for which there are no public criteria whatsoever. But there are no such meanings, and to praise a poem for conveying them is empty. Again, these critics assume that what we understand by emotion is to be identified simply with an inner experience or state of mind and that this state of mind is what is conveyed by, or gives (...) meaning and definition to, words which are used to refer to our emotional life. The emotions or qualities of emotions supposedly communicated by poetry alone, moreover, are said to elude public language altogether; they can be neither defined nor discussed but only embodied in images. But whatever the status these private experiences have for us, they as yet play no part in our language, even our poetic language, and reference to them certainly contributes nothing to our criticism of poetry. Criticism can play a central role in interpreting and shaping our lives, but it will only be worth writing if its vocabulary has content. The following text is a translation of Semyon Frank’s “L’intuition fondamentale de Bergson” published in Henri Bergson: Essais et témoignages inédits, edited by Albert Béguin and Pierre Thévenaz, Neuchâtel: Éditions de la Baconnière, 1941. In this article, Frank addresses Bergson’s notion of intuition, his anti-intellectualism, his mysticism, his closeness to Lebensphilosophie, the notion of lived experience, the distinction between intuition as pure contemplation and intuition as living knowledge, the distinction between cognition of the atemporal essence of reality and cognition of (...) the world of becoming, pragmatism, the disinterested and open intuitive spiritual attitude vs the utilitarian attitude of social groups closed in on themselves, the transrational vs the irrational, spiritual life, psychic life, the Absolute, and the temporal flux. The article contains criticisms of Bergson on the issues of time and intuition: the durée, the intuitive time, is incomprehensible without an atemporal foundation. Therefore, according to Frank, Plato was correct—contra Bergson—to define time as the moving image of eternity. And, if there is such an atemporal foundation, then, contrary to what Bergson seems to think, intuition as living knowledge cannot be the sole mode of intuition. Moreover, unlike what Bergson appears to think, an intuition of the Absolute would be an intuition of the transrational rather than of the irrational. The translation is preceded by an introduction tracing the genesis of the article, which was commissioned by the Swiss philosopher Pierre Thévenaz. (shrink)

Cancer registries are an important part of the public health infrastructure, since they allow to monitor the temporal trends of this illness as well as facilitate epidemiological research. In order to effectively set up such registries, it is necessary to create a system of data collection that permits to record health-related information from patients who are diagnosed with cancer. Given the sensitive nature of such data, it is debated whether their recording should be based on consent or whether alternative arrangements (...) are possible (eg, opt-out systems where information is automatically collected but patients can later withdraw). In the recent reform of the Swiss cancer registration legislation, the lawmaker set out to implement rules about the recording of data in cancer registries that would allegedly go beyond a consent-based model, in order to balance accurate registration with respect of patient rights. However, by analysing the operational norms of the new legislation and comparing them with those of other systems, it emerges that the Swiss rules de facto closely resemble a system of registration based on informed consent—in partial contradiction with the objective pursued by the lawmaker. In this paper, we show how the details of a policy are crucial to determine its true nature and we highlight some critical elements—from an ethical standpoint—of the recently reformed Swiss policy on cancer registration. In his article “The Megarian and Aristotelian Concept of Possibility”, Nicolai Hartmann attempts to revive an interpretation of the conception of possibility of the Megarians that stood in opposition to the Aristotelian conception of possibility and thus in opposition to the Aristotelian conception of modality in general. In this introduction, I undertake to situate Hartmann’s article in its historical context. Did Hartmann come to adopt this thesis through his study of ancient Greek philosophy? Or did he already have a predilection (...) for the Megarian conception of possibility prior to this? If so, how did this predilection come about? Was there an influence from his friend Vasily Sesemann, who published an article discussing the Megarians the previous year? Or were both Hartmann and Sesemann influenced early on by their mutual Russian teacher Nikolai Lossky, or even by a general tendency pervading Russian thought—itself grounded in the fatalism typical of the Russian collective unconscious—as we find it expressed in the philosophy of Vladimir Solovyov, Lev Tolstoy, and other Russian thinkers? For John Wyclif, the fundamental belief that Scripture is true de virtute sermonis is grounded in the fact that the meanings of the words therein are equivocal. A word can have several different meanings depending on whether it is outside or inside Scripture as well as on its location in Scripture. This principle allows each and every word in Scripture to be endowed with its own meaning — however figurative, i.e., metaphorical, allegorical etc. it may be —, tailored for the (...) very context in which it is used. Scripture cannot then fail to be true in virtue of the syntactic-semantic properties of language, which are precisely set up in accordance with the message to be delivered. All in all, Scripture as the matrix of all logics and semantics is a holistic system that may serve as master key for deciphering any possible meaning of a word. (shrink)

Stochastic gene expression plays a leading developmental role through its contribution to cell differentiation. It is also proposed to promote phenotypic diversification in malignant cells. However, it remains unclear if these two forms of cellular bet‐hedging are identical or rather display distinct features. Here we argue that bet‐hedging phenomena in cancer cells are more similar to those occurring in unicellular organisms than to those of normal metazoan cells. We further propose that the atavistic bet‐hedging strategies in cancer originate from a (...) hijacking of the normal developmental bet‐hedging of metazoans. In response to the many changes currently going on in health care, this book offers the combined insight and wisdom of a stellar group of scholars and professionals with extensive experience in the health care field. The book opens with a look at people's actual experience of health care today, from four different perspectives.
