An online world exists in which businesses have become burdened with managerial and legal duties regarding the seeking of informed consent and the protection of privacy and personal data, while growing public cynicism regarding personal data collection threatens the healthy development of marketing and e-commerce. This research seeks to address such cynicism by assisting organisations to devise ethical consent management processes that consider an individual’s attitudes, their subjective norms and their perceived sense of control during the elicitation of consent. It (...) does so by developing an original conceptual model for online informed consent, argued through logical reasoning, and supported by an illustrative example, which brings together the autonomous authorisation (AA) model of informed consent and the theory of planned behaviour (TPB). Accordingly, it constructs a model for online informed consent, rooted in the ethic of autonomy, which employs behavioural theory to facilitate a mode of consent elicitation that prioritises users’ interests and supports ethical information management and marketing practices. The model also introduces a novel concept, the informed attitude, which must be present for informed consent to be valid. It also reveals that, under certain tolerated conditions, it is possible for informed consent to be provided unwillingly and to remain valid: this has significant ethical, information management and marketing implications. I work every day in the Cornell College Library. Usually on the ground floor level, where the fast computers are. The other day I took an early afternoon break, and went up to the second floor reading room to get a copy of The Times and relax. As I passed through the reading room I saw a Japanese student sitting at the long reading table, studying his physics text. He was sitting up straight; the hard back book was standing vertical (...) in front of him on the table, three feet away. The room was pretty silent and the boy was concentrating. I got my paper and took it back to the lower level to read. I read for twenty minutes, then returned to my computer, where I worked for an hour and a half. I finished my online teaching for the day, I packed up my stuff, climbed back up the stairs to the reading room, crossed the room to exit. At that point, tired and stretching, I usually don’t observe much. But this time I noticed the same Japanese student. He was still in the same position, sitting upright looking at his book, balancing it firmly in both hands. He seemed still to be in the same position of attention: nothing had changed, I felt, except the design on the page: a different graph of a different color. The idea that deep brain stimulation (DBS) induces changes to personality, identity, agency, authenticity, autonomy and self (PIAAAS) is so deeply entrenched within neuroethics discourses that it has become an unchallenged narrative. In this article, we critically assess evidence about putative effects of DBS on PIAAAS. We conducted a literature review of more than 1535 articles to investigate the prevalence of scientific evidence regarding these potential DBS-induced changes. While we observed an increase in the number of publications in theoretical neuroethics (...) that mention putative DBS-induced changes to patients’ postoperative PIAAAS, we found a critical lack of primary empirical studies corroborating these claims. Our findings strongly suggest that the theoretical neuroethics debate on putative effects of DBS relies on very limited empirical evidence and is, instead, reliant on unsubstantiated speculative assumptions probablyin lieuof robust evidence. As such, this may reflect the likelihood of a speculative neuroethics bubble that may need to be deflated. Nevertheless, despite the low number of first-hand primary studies and large number of marginal and single case reports, potential postoperative DBS changes experienced by patients remain a critical ethical concern. We recommend further empirical research in order to enhance theoretical neuroethics work in the area. In particular, we call for the development of better instruments capable of capturing potential postoperative variations of PIAAAS. (shrink)

The phenomenological effects of deep brain stimulation (DBS) on the self of the patient remains poorly understood and under described in the literature, despite growing evidence that a significant number of patients experience postoperative neuropsychiatric changes. To address this lack of phenomenological evidence, we conducted in-depth, semistructured interviews with 17 patients with Parkinson's disease who had undergone DBS. Exploring the subjective character specific to patients' experience of being implanted gives empirical and conceptual understanding of the potential phenomenon of DBS-induced self-estrangement. (...) Our study concluded that (1) the more patients preoperatively felt alienated by their illness, the more they experienced postoperative self-estrangement, and (2) the notion of self-estrangement seems to exist in association with certain common qualitative characters, namely, loss of control, which reflects a deteriorative estrangement, and distorted perception of capacities, which reveals a restorative estrangement. These findings indicate that subjective self-reports help us to understand some aspects of the potential phenomenon of DBS-induced self-estrangement. (shrink)

One important concern regarding implantable Brain Computer Interfaces is the fear that the intervention will negatively change a patient’s sense of identity or agency. In particular, there is concern that the user will be psychologically worse-off following treatment despite postoperative functional improvements. Clinical observations from similar implantable brain technologies, such as deep brain stimulation, show a small but significant proportion of patients report feelings of strangeness or difficulty adjusting to a new concept of themselves characterized by a maladaptive je ne (...) sais quoi despite clear motor improvement. Despite the growing number of cases in the DBS literature, there is currently no accepted or standardized tool in neuroethics specifically designed to capture the phenomenological postoperative experience of patients implanted with DBS or BCI devices. Given potential risks of postoperative maladaptation, it is important for the field of neuroethics to develop a qualitative instrument that can serve as a shared method for capturing postoperative variations in patient experience of identity and agency. The goal of this article is to introduce an instrument we have developed for this purpose and call for further neuroethical efforts to assess the phenomenology of implantable brain device use. Optogenetics is being optimistically presented in contemporary media for its unprecedented capacity to control cell behavior through the application of light to genetically modified target cells. As such, optogenetics holds obvious potential for application in a new generation of invasive medical devices by which to potentially provide treatment for neurological and psychiatric conditions such as Parkinson's disease, addiction, schizophrenia, autism and depression. Design of a first-in-human optogenetics experimental trial has already begun for the treatment of blindness. Optogenetics trials involve a (...) combination of highly invasive genetic and electronic interventions that results in irreversible and permanent modifications of an individual's nervous system. Given its novelty, its uncertain benefit to patients, and its unique risk profile of irreversible physiological alteration, optogenetics requires a reassessment of the ethical challenges for protecting human participants in clinical trials, particularly at formative stages of clinical evaluation. This study explores the evolving ethical issues surrounding optogenetics’ potential harm to participants within trial design, especially focusing on whether Phase 1 trials should incorporate efficacy as well as safety endpoints in ways that are fair and respectful to research trial participants. Building upon a non-standard understanding of evolutionary process focusing on variation and persistence, I will argue that communities and ecosystems can evolve by natural selection as emergent individuals. Evolutionary biology has relied ever increasingly on the modeling of population dynamics. Most have taken for granted that we all agree on what is a population. Recent work has reexamined this perceived consensus. I will argue that there are good reasons to restrict the term “population” to collections of monophyletically related replicators and (...) interactors, which explains why many existing models in population biology exclude by definition many genuine evolving biological individuals such as communities and ecosystems. By studying a case of community evolution (a symbiotic termite–fungus community), we will see that it is variation that is important to evolutionary processes, not populations. Variation within a population is only one of many types of variation that can lead to evolution by natural selection. The upshot of focusing on variation is that cases of community and ecosystem adaptive change become tractable in evolutionary terms. I will show that complex emergent individuals such as communities and ecosystems cannot be fully accommodated by conventional population/reproduction models but can be accommodated by variation/persistence models. Cet article s’intéresse au problème de la maintenance, c’est-à-dire au moment où les membres d’un collectif social tentent d’assurer dans le temps l’existence de leur collectif en instituant des règles pour réguler leurs comportements. Ce problème se pose avec acuité lorsque certains membres ne respectent pas ces règles communes. Pour maintenir la coopération sociale, les membres peuvent décider d’instituer des règles secondaires visant à sanctionner les transgressions des règles primaires déjà établies. La maintenance d’un collectif peut ainsi reposer sur l’émergence (...) de pouvoirs déontiques qui donnent aux membres l’autorité de légitimement punir et expulser les transgresseurs. Mais d’où viennent ces règles ? On peut penser qu’elles émergent des émotions éprouvées par les membres envers les transgresseurs. Je le démontre à l’aide d’une étude de cas qui établit que, dans le collectif Occupy Geneva, l’institutionnalisation de normes pour punir, exclure et réintégrer les déviants s’ancraient respectivement dans l’indignation, le mépris et le pardon. -/- This article focuses on the problem of maintenance; that is the moment when the members of a social collective attempt to ensure the existence of their collective over time by instituting rules to regulate their behavior. This problem becomes critical when certain members do not respect the common rules. To maintain social cooperation, members can decide to institute secondary rules aimed at sanctioning the transgressions of the already established primary rules. The maintenance of a collective can thus rely on the emergence of deontic powers that give members the authority to legitimately punish and expel transgressors. But where do these rules come from? The hypothesis is that they emerge from the emotions felt by the members towards the transgressors. I show this with the help of a case study, which establishes that the institutionalization of norms allowing the punishment, the exclusion, and the reintegration of deviants within the “Occupy Geneva” collective, was grounded in indignation, contempt, and forgiveness respectively. This article presents a contextualisation of Belgian philosopher and historian of psychiatry and sexuality, Patrick Vandermeersch’s (1946–), unpublished analysis of French philosopher Michel Foucault’s (1926–1984) interpretation of Methodius of Olympus’ (d.ca.311) views on virginity and chastity, in Histoire de la sexualité 4 ( Les aveux de la chair ), published in February 2018 at Gallimard in Paris under the editorship of Frédéric Gros. The article contributes to the reception and the ongoing analyses of Les aveux de la chair by (...) exploring Foucault’s reading while highlighting both the importance of Vandermeersch’s analysis and the sexological-historiographical significance of his broader oeuvre that spans over four decades. Vandermeersch shows that Foucault, as many other commentators of Methodius, did not substantially engage Methodius’ explicit indebtedness and persistent references to Plato (already evident in the title Symposium but especially regarding the Phaedrus ). Platonic homoeroticism is, according to Vandermeersch, as a consequence often too hastily, and therefore problematically, transposed on contexts of female virginity. Likewise, Foucault, when indicating already at the end of Histoire de la sexualité 2 ( L’usage des plaisirs 1984), the particular relevance of homoeroticism in the development of Western sexuality, seemed to adhere to this transposition. Could ‘beautiful boys’ truly be transposed onto ‘female virgins’ without severe sexual-discursive complications? And could Methodius’ encomium of virginity in any way be understood independent of his understanding of the ‘resurrection of the body’, with the integrity of its (virginised) sexual desire intact? These are among Vandermeersch’s valid and challenging questions to both Foucault and his contemporary readership. Contribution: Foucault’s reading of the church- and desert fathers in Histoire de la sexualité 4 ( Les aveux de la chair ) impacts early Medieval philosophy, early Medieval history, church history, patristics, philosophy of religion, psychology of religion and sociology of religion. Since these proximate disciplines are drawn towards Foucault’s text, they may well note its ongoing examinations. Foucault’s direct impact on these disciplines is illustrated in Vandermeersch’s significant analysis of Foucault’s reading of Methodius in Les aveux de la chair. Vandermeersch’s broader oeuvre in philosophy, theology, psychiatry, psychology, psychology of religion and the history of sexuality is concurrently contextualised as of ongoing contemporary importance for these disciplines. The G7 should address new, unprecedented and highly disruptive issues that characterize our complex world, rather than well-understood international problems that fit into existing categories. We argue that the G7 can do this by playing to its strengths – informality and like-mindedness in particular – in addressing emerging and transversal issues such as Artificial Intelligence (AI) and cryptocurrencies.

The prominent Russian philosopher Nikolai Lossky and his ex-student Nicolai Hartmann shared many metaphysical and epistemological views, and Lossky is likely to have influenced Hartmann in adopting several of them. But, in the case of axiological issues, it appears that Lossky also borrowed from the axiologies of Hartmann and the latter's Cologne colleague, Max Scheler. The links between the theories of values of Scheler and Hartmann have been studied abundantly, but never in relation to Lossky. In this paper, I examine (...) the manifold relationships – similarities, differences, borrowings, criticisms, and possible influences – between Lossky's axiology and those of Scheler and Hartmann on four key interweaving issues: (1) their ontological realism with regards to the objectivity of values, (2) their epistemological theories of the intuition of values, (3) their ontological definitions of "value", i.e., whether values are relations, qualities, essences, powers, meanings, etc., and (4) their theories of the stratification of values. This article explores the link between liberalism and biopolitics in Foucault, through the analyses of the 1979 Lecture at the Collège de France The Birth of Biopolitics.

When developing phylogenetic systematics, the entomologist Willi Hennig adopted elements from Nicolai Hartmann’s ontology. In this historical essay I take on the task of documenting this adoption. I argue that in order to build a metaphysical foundation for phylogenetic systematics, Hennig adopted from Hartmann four main metaphysical theses. These are (1) that what is real is what is temporal; (2) that the criterion of individuality is to have duration; (3) that species are supra-individuals; and (4) that there are levels of (...) reality, each of which may be subject to different kinds of law. Reliance on Hartmann’s metaphysics allowed Hennig to ground some of the main theoretical principles of phylogenetic systematics, namely that the biological categories—from the semaphoront to the highest rank—have reality and individuality despite not being universals, and that they form a hierarchy of levels, each of which may require different kinds of explanation. Hartmann’s metaphysics thereby provided a philosophical justification for Hennig’s phylogenetic systematics, both as a theory and as a method of classification. (shrink)

Intentional explanation, according to Elster, seeks to elucidate an action by showing that it was intentionally conducted, in order to bring about certain goals . Intentional actions furthermore, are rational actions: they imply that agents establish a connection between the goals they target and the means that are appropriate to reach them, by way of different beliefs about the means, the goals and the environment. But how should we understand intentional actions in the light of philosophical research on emotions, rationality, (...) and normativity? This question is the departure point of this article. Various philosophers have analyzed the relationships between rationality and emotion, those between emotion and normativity, and those between emotion and intentional action. Nonetheless, their theses are scattered and do not offer an integrative view on how rationality, normativity and emotions work from the standpoint of intentional explanation. By using de Sousa’s distinction between the epistemic and the strategic modes of rationality as a theoretical framework, this article proposes therefore to remedy this deficit by unifying these philosophical insights with the goal of elaborating a theory of intentional explanation which brings together rationality, normativity and emotions. Qu’est-ce que l’indignation ? Cette émotion est souvent conçue comme une émotion morale qu’une tierce-partie éprouve vis-à-vis des injustices qu’un agent inflige à un patient. L’indignation aurait ainsi trait aux injustices et serait éprouvée par des individus qui n’en seraient eux-mêmes pas victimes. Cette émotion motiverait la tierce-partie indignée à tenter de réguler l’injustice en l’annulant et en punissant son auteur. Cet article entreprend de montrer que cette conception de l’indignation n’est que partielle. En effet, l’indignation ne porte pas que (...) sur les injustices, mais plus généralement sur les torts injustifiés. Ce faisant, l’indignation peut être une émotion morale, mais aussi une émotion conventionnelle ou esthétique. De plus, elle peut être éprouvée par les individus victime des torts : elle n’est pas uniquement éprouvée par des tierces-parties. De la sorte, les individus indignés qui subissent les torts peuvent eux-mêmes chercher à les annuler et à punir leurs auteurs. Puisqu’elle peut être éprouvée tant par des spectateurs que par les personnes qui subissent les torts et qu’elle incline ceux qui l’éprouvent à faire appel à d’autres personnes pour réguler ces torts, l’indignation vécue individuellement est partageable : elle peut devenir une émotion collective jouant un rôle fondamental dans la régulation sociale en contribuant au renforcement de normes sociales existantes ou à l’émergence de nouvelles normes sociales associées aux idées du juste prévalant dans la société considérée. Cet article s’intéresse aux émotions dans l’internalisation et l’émergence des normes sociales. Nous y montrons comment les normes sociales ont un impact sur les émotions et comment les émotions ont un impact sur les normes sociales. Pour le faire, trois approches complémentaires mais souvent traitées indépendamment les unes des autres dans la littérature scientifique sont discutées. La première a trait à la façon dont les normes sociales (les normes émotionnelles) régulent les émotions. Cette régulation se comprend comme l’internalisation de la (...) normativité sociale dans les membres d’une société : les normes émotionnelles contribuent à la fabrique des dispositions émotionnelles des membres qui s’ajustent aux normes et aux valeurs valant dans leur société. La deuxième approche a trait au rôle des émotions dans le soutien aux normes sociales. Une fois que l’internalisation des normes et des valeurs est opérée et que les membres ont développé une sensibilité affective aux normes et aux valeurs de leur collectif, les émotions peuvent opérer comme des régulateurs des comportements : les émotions font que les membres se conforment aux normes et aux valeurs. Les normes internalisées suscitent des réactions émotionnelles qui contribuent au maintien de l’ordre normatif. La troisième approche affirme que les émotions contribuent à l’émergence des normes sociales et des valeurs dans une société donnée. En ce sens, les émotions peuvent contribuer à la transformation de l’ordre normatif. Il s’agit donc de la fabrique de la société. (shrink)

On conçoit souvent la jalousie comme une émotion ayant pour objet les relations de proximité (amour, amitié, fratrie, etc.). Elle a généralement mauvaise presse et est typiquement envisagée comme une émotion moralement condamnable, voire comme un vice. Or, la jalousie ne porte pas uniquement sur les relations de proximité : elle peut également porter sur divers biens (prestige, richesses, biens matériels, privilèges, etc.). Par ailleurs, certains auteurs soutiennent que des cas de jalousie pourraient être moralement justifiés, voire que la jalousie (...) pourrait être une vertu. La jalousie paraît également jouer un rôle dans l’institution et le maintien d’institutions visant à perpétuer des inégalités entre les individus jaloux de leurs avantages et ceux qu’ils envisagent comme des concurrents cherchant à les déposséder de leurs biens. De fait, la jalousie paraît utile pour la théorie politique de par les liens qu’elle entretient avec la justice distributive. Cet article propose, dans la première section, une discussion portant sur la nature de la jalousie où elle est contrastée avec l’envie et l’indignation. Dans la seconde section, on se demandera si la jalousie est un vice, ou si elle peut être parfois moralement justifiée, ou même être une vertu. La troisième section traitera les rôles joués par la jalousie collective dans la justice distributive et la fondation et le maintien d’institutions sociales visant à protéger les intérêts des jaloux. Pour le faire, le cas de la jalousie économique, telle que David Hume et Adam Smith la concevaient dans les relations commerciales entre États européens au XVIIIème siècle, est considéré. (shrink)

What are the motivational bases that help explain the various normative judgements that social agents make, and the normative reasoning they employ? Answering this question leads us to consider the relationships between thoughts and emotions. Emotions will be described as thought-dependent and thought-directing, and as being intimately related to normativity. They are conceived as the grounds that motivate social agents to articulate their reasoning with respect to the values and norms they face and/or share in their social collective. It is (...) argued that because they are modes of thinking, emotions generate cognitive activities that relate to the making of evaluative and deontic judgements, the utterance of speech acts, the mastering of normative concepts and the building of arguments. Furthermore, each type of emotion generates its own constitutive judgements and structures normative thinking according to its own logic. The main thesis is that emotions provide sociological explanations for social agents’ thinking and speech, for emotions are precisely what motivate and, especially, structure normative reasoning and language. Being observable in language, emotions allow us to explain a) how social subjects reason and argue through norms and values, and b) how social subjects through their speech acts can contribute to the (un-)making of the social world. In his book, Emre Şan undertakes a confrontation between Merleau-Ponty and Patočka on the question of transcendence understood as a phenomenological problem,indeed as the problem of phenomenology. This approach has the great merit of identifying the meaning of being of Being as promise, on the path of an ontology beyondHusserl and Heidegger. Emre Şan’s book thus offers a very important contribution to phenomenological studies.

On propose ici la notion de « rite de la vie quotidienne » en liant les analyses de Goffman sur la « mise en scène de la vie quotidienne » avec sa réflexion, d’inspiration durkheimienne, sur les « rites d’interaction ». Après avoir rappelé l’analyse durkheimienne du rituel, on montre en quoi le pragmatisme de Mead permet à Goffman de refuser un certain nombre de présupposés de la sociologie de Durkheim. On montre ensuite que la référence à la mise en (...) scène théâtrale permet à Goffman de se détacher du normativisme de Mead pour proposer une analyse des personnes (selves) qui rejoint le cœur de la pensée durkheimienne, celle qui sera reprise par le structuralisme lévi-straussien et qui s’inscrit dans la réflexion juridique. La conclusion propose alors une nouvelle comparaison entre Goffman et Foucault à partir du domaine de la biopolitique. (shrink)

It has long been recognized that the concept of inconsistency is a central part of commonsense reasoning. In this issue, a number of authors have explored the idea of reasoning with maximal consistent subsets of an inconsistent stratified knowledge base. This paradigm, often called “coherent-based reasoning", has resulted in some interesting proposals for para-consistent reasoning, non-monotonic reasoning, and argumentation systems. Unfortunately, coherent-based reasoning is computationally very expensive. This paper harnesses the approach of approximate entailment by Schaerf and Cadoli [SCH 95] (...) to develop the concept of “approximate coherent-based reasoning". To this end, we begin to present a multi-modal propositional logic that incorporates two dual families of modalities: □S and?S defined for each subset S of the set of atomic propositions. The resource parameter S indicates what atoms are taken into account when evaluating formulas. Next, we define resource-bounded consolidation operations that limit and control the generation of maximal consistent subsets of a stratified knowledge base. Then, we present counterparts to existential, universal, and argumentative inference that are prominent in coherence-based approaches. By virtue of modalities □S and?S, these inferences are approximated from below and from above, in an incremental fashion. Based on these features, we show that an anytime view of coherent-based reasoning is tenable. (shrink)
