Definition of the problem. In the field of biomedical research on humans, ethical committees have an important role. They ensure the necessary protection of the subjects and contribute to quality assurance in medical research. Originally established as an instrument of ethical self-regulation in the medical profession, the ethical committee soon advanced to a statutory institution and is now on the way to becoming the body charged with judicial control in medical research. This development implies the need for changes in both (...) position and function of the ethical committee, but these have not been made with due consideration for all the developments there have been. Arguments and conclusion. The existing uncertainties are hampering medical research, which is in the interests of neither the public nor the actual medical research. Owing to the different and obscure legal arguments used, it has not been possible to make any definitive decision on the legal standing of decisions made by ethical committees. It seems obvious that these problems cannot be solved unless the work of ethical committees can be based on a clear and reliable legal basis regulating the judicial nature of the committees’ decisions, the composition of the actual committees and the procedures they are to follow in reaching their decisions. With regard to the existing regulations, this might be best achieved by integrating the work of the ethical committees into the approval procedures of an administrative authority. (shrink)

With regard to the handling of dual use research, the dominant approach in Germany aimed at mitigating dual use risks emphasizes the freedom of research and the strengthening of academic self-regulation. This article presents this approach as one example for a framework for handling security-relevant research, underlines the need for awareness-raising about risks of security-relevant research, and, more generally, highlights some of the dilemmas researchers and legislators face when dealing with security-relevant research. The article furthermore presents the key questions developed (...) by the German Joint Committee on the Handling of Security-Relevant Research to provide guidance for researchers and institutions when they address possible research of concern. It applies these key questions in a case study of a well-publicized experiment in which artificial intelligence and drug discovery technologies were used to determine their dual use potential in identifying highly toxic chemical substances. Moreover, it discusses the utility of the framework applied in Germany and concludes that this approach is practicable. Given the strong emphasis on the researchers’ own responsibility, however, awareness of dual use risks and risk mitigation strategies should be further enhanced and an academic culture of responsible handling of security-relevant research should be promoted. Background: Biomedical research nowadays is increasingly carried out in multinational and multicenter settings. Due to disparate national regulations on various ethical aspects, such as informed consent, there is the risk of ethical compromises when involving human subjects in research. Although the Declaration of Helsinki is the point of reference for ethical conduct of research on humans, national normative requirements may diverge from its provisions. The aim of this research is to examine requirements on informed consent in biomedical research in Germany, (...) Poland, and Russia to determine how each national regulatory framework relates to the provisions of the Declaration of Helsinki. Methods: For this analysis, we conducted a search of the legal databases “Gesetze im Internet” for Germany, “Internetowy System Aktow Prawnych” for Poland, and “ГAPAHT – Garant” for Russia. The search was complemented by a review of secondary literature contained in the databases Google Scholar, PubMed, Polish National Library, and eLibrary ru. We have identified 21 normative regulations containing provisions on informed consent in clinical research in all three countries. The content of these documents was systematically categorized and analyzed. Results: The normative framework in all three countries shows a strong commitment towards the core ethical principles of research envisaged in the Declaration of Helsinki. Nevertheless, provisions on informed consent vary between these three countries. The differences range from the method and language in which information should be provided, through the amount of information required to be disclosed, to the form of documenting consent or withdrawal. In the case of research on vulnerable groups, these differences are particularly visible. Conclusions: The identified differences can negatively impact the ethical conduct of international clinical studies. Attention needs to be paid that flexibilities within national regulations are not misused to undermine the protection of research subjects. Achieving global or regional legislative harmonization might prove impossible. Such lack of legal consensus reinforces the significance of the international ethical agreements. (shrink)

To organise future behaviour, it is important to remember both the central and contextual aspects of a situation. We examined the impact of contextual threat or safety, learned through verbal instructions, on face identity recognition. In two studies (N = 140), 72 face–context compounds were presented each once within an encoding session, and an unexpected item/source recognition task was performed afterwards (including 24 new faces). Hierarchical multinomial processing tree modelling served to estimate individual parameters of item (face identity) and source (...) memory (threat or safety context) as well as guessing behaviour. Results show that language was highly effective in establishing threatening and safe context conditions. In Study 1, a fleeting picture stream (1 s per picture) led to poor item and source recognition. Prolonged presentation times (Study 2 with 6 s per picture) improved face memory but no contextual modulation was observed. Thus, incidental face learning was surprisingly poor and rapidly changing contextual settings might have interfered with the accurate encoding of face identity information and item–source binding. Cutting across Chicago's South Side in a broad swath of concrete, steel, and overpasses, the Dan Ryan Expressway is one of America's busiest, and perhaps most chaotic highways. Yet underneath the cacophony of its ten lanes lies an intriguing world of urban ecology and human networks. In The Dan Ryan Expressway, artist and photographer Jay Wolke unearths an ecosystem unto itself that weaves human and industrial elements into an essential feature of Chicago's identity. Between 1981 and 1985, Wolke shot thousands (...) of photographs on and along the Dan Ryan during the day and night, traveling up and down the expressway in an effort to accurately capture it. In the twenty years since the photographs were taken, Wolke has organized his pictures into a complex and fascinating portrait of this iconic highway, which he characterizes as an "arterial organism" with its own "cycles and flows, causes and effects." This paper provides a comprehensive review of the experimental philosophy of action, focusing on the various different accounts of the Knobe Effect.

Introduction: There is currently no binding, internationally accepted and successful approach to ensure global equitable access to healthcare during a pandemic. The aim of this ethical analysis is to bring into the discussion a legally regulated vaccine allocation as a possible strategy for equitable global access to vaccines. We focus our analysis on COVAX (COVID-19 Vaccines Global Access) and an existing EU regulation that, after adjustment, could promote global vaccine allocation. -/- Methods: The main documents discussing the two strategies are (...) examined with a qualitative content analysis. The ethical values reasonableness, openness and transparency, inclusiveness, responsiveness and accountability serve as categories for our ethical analysis. -/- Results: We observed that the decision-making processes in a legal solution to expand access to vaccines would be more transparent than in COVAX initiative, would be more inclusive, especially of nation states, and the values responsiveness and accountability could be easily incorporated in the development of a new regulation. -/- Discussion: A legal strategy that offers incentives to the pharmaceutical industry in return for global distribution of vaccines according to the Fair Priority Model is an innovative way to achieve global and equitable access to vaccines. However, in the long term, achieving the Sustainable Development Goals will require from all nations to work in solidarity to find durable solutions for global vaccine research and development. Interim solutions, such as our proposed legal strategy for equitable access to vaccines, and efforts to find long-term solutions must be advanced in parallel. (shrink)

Identification of propositions as the core of attitudes and beliefs (De Houwer, 2014) has resulted in the development of implicit measures targeting personal evaluations of complex sentences (e.g., the IRAP or the RRT). Whereas their utility is uncontested, these paradigms are subject to limitations inherent in their block based design, such as allowing assessment of only a single belief at a time. We introduce the Propositional Evaluation Paradigm (PEP) for assessment of multiple propositional beliefs within a single experimental block. Two (...) experiments provide first evidence for the PEP’s validity. In Experiment 1 endorsement of racist beliefs measured with the PEP was related to criterion variables such as explicit racism assessed via questionnaire and indicators of behavioral tendencies. Experiment 2 indicates that the PEP’s implicit racism scores may predict actual behavior over and above explicit, self-report measures. Finally, Experiment 3 tested the PEP's applicability in the domain of hiring discrimination. Whereas general PEP based gender stereotypes were not related to hiring bias, results suggest a possible role of female stereotypes in hiring discrimination. In the context of these findings, we discuss both the potential and possible challenges in adopting the PEP to different beliefs. In sum, these initial findings suggest that the PEP may offer researchers a reliable and easily administrable option for the indirect assessment of propositional evaluations. (shrink)

New technologies such as smart sensors improve rehabilitation processes and thereby increase older adults’ capabilities to participate in social life, leading to direct physical and mental health benefits. Wearable smart sensors for home use have the additional advantage of monitoring day-to-day activities and thereby identifying rehabilitation progress and needs. However, identifying and selecting rehabilitation priorities is ethically challenging because physicians, therapists, and caregivers may impose their own personal values leading to paternalism. Therefore, we develop a discussion template consisting of a (...) series of adaptable questions for the patient–physician encounter based on the capability approach. The goal is to improve geriatric rehabilitation and thereby increase participation in social life and well-being. To achieve this goal, we first analyzed what is considered important for participation on basis of the capability approach, human rights, and ethics of care. Second, we conducted an ethical analysis of each of the four identified dimensions of participation: political, economic, socio-cultural, and care. To improve compliance with rehabilitation measures, health professionals must align rehabilitation measures in an open dialogue with the patient’s aspiration for participation in each dimension. A discussion template based on the capability approach allows for a proactive approach in patient information and stimulates a critical assessment of treatment alternatives while reducing the risk of imposing personal values. Studying the folk concept of intentional action, Knobe (2003a) discovered a puzzling asymmetry: most people consider some bad side effects as intentional while they consider some good side effects as unintentional. In this study, we extend these findings with new experiments. The first experiment shows that the very same effect can be found in ascriptions of intentionality in the case of means for action. The second and third experiments show that means are nevertheless generally judged more intentional than side effects, (...) and that people do take into account the structure of the action when ascribing intentionality. We then discuss a number of hypotheses that can account for these data, using reactions times from our first experiment. (shrink)

Regulations designed to prevent global inequalities in the use of genetic resources apply to both commercial and non-commercial research. Conflating the two may have unintended consequences for collaboration between the Global North and biodiverse countries in the Global South, which may promote global injustice rather than mitigate it.

According to Michael Dummett, we may think of the meaning of an expression as given by the principles governing the use we make of it. The principles regulating our linguistic practices can then be grouped into two broad categories (Dummett 1973: 396, 1991: 211). We might state them as follows: I-principles: state the circumstances under which an assertion of a sentence containing the expression in question is warranted. We consider a proportional-prize contest to forecast future events, and show that, in equilibrium, this mechanism possesses perfect forecasting ability for any group size when the contestants share common knowledge about the probabilities by which future events realize. Data gathered in a laboratory experiment confirm the performance invariance to group size. By contrast, when realization probabilities are not common knowledge, there are some differences across group sizes. The mechanism operates marginally better with three or four compared to two players. It is commonly argued that natural language has the expressive power of quantifying over intensional entities, such as times, worlds, or situations. A standard way of modelling this assumes that there are unpronounced but syntactically represented variables of the corresponding type. Not all that much as has been said, however, about the exact syntactic location of these variables. Meanwhile, recent work has highlighted a number of problems that arise because the interpretive options for situation pronouns seem to be subject to (...) various restrictions. This paper is primarily concerned with situation pronouns inside of determiner phrases, arguing that they are introduced as arguments of (certain) determiners. Verbal predicates, on the other hand, are assumed to not combine with a situation pronoun. The various restrictions on their interpretation are shown to fall out from the semantic system that is developed based on that view. Further support for such an account comes from situation semantic analyses of donkey sentences as well as data on the temporal interpretation of nominal predicates. Its ability to account for this full range of data in a unified manner is shown to set it apart from previous proposals. The paper closes with an outlook on further extensions, including an account of quantifier domain restriction based on situation pronouns. (shrink)

According to tradition, logic is normative for reasoning. Gilbert Harman challenged the view that there is any straightforward connection between logical consequence and norms of reasoning. Authors including John MacFarlane and Hartry Field have sought to rehabilitate the traditional view. I argue that the debate is marred by a failure to distinguish three types of normative assessment, and hence three ways to understand the question of the normativity of logic. Logical principles might be thought to provide the reasoning agent with (...) first-personal directives; they might be thought to serve as third-personal evaluative standards; or they might underwrite our third-personal appraisals of others whereby we attribute praise and blame. I characterize the three normative functions in general terms and show how a failure to appreciate this threefold distinction has led disputants to talk past one another. I further show how the distinction encourages fruitful engagement with and, ultimately, resolution of the question. (shrink)

Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

One of the goals of computerized tutoring systems is to optimize the learning of facts. Over a hundred years of declarative memory research have identified two robust effects that can improve such systems: the spacing and the testing effect. By making optimal use of both and adjusting the system to the individual learner using cognitive models based on declarative memory theories, such systems consistently outperform traditional methods. This adjustment process is driven by a continuously updated estimate of the rate of (...) forgetting for each item and learner on the basis of the learner's accuracy and response time. In this study, we investigated to what extent these estimates of individual rates of forgetting are stable over time and across different materials. We demonstrate that they are stable over time but not across materials. Even though most theories of human declarative memory assume a single underlying rate of forgetting, we show that, in practice, it makes sense to assume different materials are forgotten at different rates. If a computerized, adaptive fact-learning system allowed different rates of forgetting for different materials, it could adapt to individual learners more readily. (shrink)

We challenge an argument that aims to support Aesthetic Realism by claiming, first, that common sense is realist about aesthetic judgments because it considers that aesthetic judgments can be right or wrong, and, second, that becauseAesthetic Realism comes from and accounts for “folk aesthetics,” it is the best aesthetic theory available.We empirically evaluate this argument by probing whether ordinary people with no training whatsoever in the subtle debates of aesthetic philosophy consider their aesthetic judgments as right or wrong. The requirement of proof-theoretic harmony has played a pivotal role in a number of debates in the philosophy of logic. Different authors have attempted to precisify the notion in different ways. Among these, three proposals have been prominent in the literature: harmony–as–conservative extension, harmony–as–leveling procedure, and Tennant’s harmony–as–deductive equilibrium. In this paper I propose to clarify the logical relationships between these accounts. In particular, I demonstrate that what I call the equivalence conjecture —that these three notions essentially come to the (...) same thing—is erroneous. (shrink)

To operate in an unpredictable environment, a vehicle with advanced driving assistance systems, such as a robot or a drone, not only needs to register its surroundings but also to combine data from different sensors into a world model, for which it employs filter algorithms. Such world models, as this article argues with reference to the SLAM problem in robotics, consist of nothing other than probabilities about states and events arising in the environment. The model, thus, contains a virtuality of (...) possible worlds that are the basis for adaptive behavior. The article shows that the current development of these technologies requires new concepts because their complex adaptive behaviors cannot be explained by referring them to mere algorithmic processes. Instead, it proposes the heuristic instrument of microdecisions to designate the temporality of decisions between alternatives that are created by probabilistic procedures of world modeling. Microdecisions are more than the implementation of deterministic processes—they decide between possibilities and, thus, always open up the potential of their otherness. By describing autonomous adaptive technologies with this heuristic, the question of sovereignty inevitably arises. It forces us to re-think what autonomy means when decisions can be automated. The paper proposes a parallel reading of Albrecht Dürer’s engraving ›Melencolia I‹ (1514) and Alfred Sohn-Rethel’s notion of real abstraction. It argues for a constitutive link between the abstractions operative in ›Melencolia I‹, in commodity exchange, and in certain formations of psychological suffering, most notably described in the psychoanalytic conception of melancholia theorized by Sigmund Freud and the subsequent Lacanian tradition. With and against the iconographic analysis put forward by Raymond Klibansky, Erwin Panofsky, and Fritz Saxl in ›Saturn and Melancholy‹ (...) (1964), this paper understands the engraving’s polyhedron as a pivot point in Dürer’s artwork and in art history in general – namely, as a stumbling block that indicates the negativity of abstraction through its very positive existence. Abstraction, understood in this specific sense, and contrary to classical ontology and epistemology can in fact constitute a world of real material social relations instantiated through acts (and failures) of exchange. Quantum mechanics notoriously faces the measurement problem, the problem that if read thoroughly, it implies the nonexistence of definite outcomes in measurement procedures. A plausible reaction to this and to related problems is to regard a system's quantum state |ψ> merely as an indication of our lack of knowledge about the system, i.e., to interpret it epistemically. However, there are radically different ways to spell out such an epistemic view of the quantum state. We here investigate recent developments in the (...) branch that introduces hidden variables λ in addition to the quantum state |ψ> and has its roots in Einstein's views. In particular, we confront purported achievements of a concrete model that has been considered to serve as evidence for an epistemic view of the envisioned kind, as well as specific no-go results and their import. It will be argued that while an epistemic account of the particular kind is not straightforwardly ruled out by the no-go results, they demonstrate that the evidential character of the model(s) discussed rests on a rather shaky foundation, and that they make some achievements widely recognized in the literature appear worthy of doubt. This paper explores an apparent tension between two widely held views about logic: that logic is normative and that there are multiple equally legitimate logics. The tension is this. If logic is normative, it tells us something about how we ought to reason. If, as the pluralist would have it, there are several correct logics, those logics make incompatible recommendations as to how we ought to reason. But then which of these logics should we look to for normative guidance? I (...) argue that inasmuch as pluralism draws its motivation from its ability to defuse logical disputes—that is, disputes between advocates of rival logics—it is unable to provide an answer: pluralism collapses into monism with respect to either the strongest or the weakest admissible logic. I will here suggest an integrated perspective that mediates between extremes, by arguing that what makes DNNs in science special is their ability to develop functional concept proxies (FCPs): Substructures that occasionally provide them with abilities that correspond to those facilitated by concepts in human reasoning. Furthermore, I will argue that this introduces a problem that has so far barely been recognized by practitioners and philosophers alike: That DNNs may succeed on some vast and unwieldy data sets because they develop FCPs for features that are not transparent to human researchers. The resulting breach between scientific success and human understanding I call the ‘Actually Smart Hans Problem’. (shrink)

This theoretical paper considers the morality of machine learning algorithms and systems in the light of the biases that ground their correctness. It begins by presenting biases not as a priori negative entities but as contingent external referents—often gathered in benchmarked repositories called ground-truth datasets—that define what needs to be learned and allow for performance measures. I then argue that ground-truth datasets and their concomitant practices—that fundamentally involve establishing biases to enable learning procedures—can be described by their respective morality, here (...) defined as the more or less accounted experience of hesitation when faced with what pragmatist philosopher William James called “genuine options”—that is, choices to be made in the heat of the moment that engage different possible futures. I then stress three constitutive dimensions of this pragmatist morality, as far as ground-truthing practices are concerned: the definition of the problem to be solved, the identification of the data to be collected and set up, and the qualification of the targets to be learned. I finally suggest that this three-dimensional conceptual space can be used to map machine learning algorithmic projects in terms of the morality of their respective and constitutive ground-truthing practices. Such techno-moral graphs may, in turn, serve as equipment for greater governance of machine learning algorithms and systems. (shrink)
