Was there a major change in Plato's views on the role and importance of law? It can be argued that he held in both 'Republic' and 'Laws' that law and administrators are essential to a state of the best kind, but legislators are not, since legislation has been done by the founders. This interpretation seems to be incompatible with passages in 'Statesman', in which the status and role of law appear to be positively downgraded. The appearance of a contradiction between (...) such passages and the insistence in 'Laws' on the importance of law is created by failure to recognize different uses of 'nomoi', as guiding rules of skill or as rules of law. What Plato says about the contrast between ideal and actual rulers commits him to the distinction, whether or not he had clearly formulated it for himself. An afterword recommends Plato's way of handling laws dealing with criminal attempt. (shrink)

In this pathbreaking book, which includes a powerful new translation of Hesiod's Works and Days by esteemed translator David Grene, Stephanie Nelson argues that a society's vision of farming contains deep indications about its view of the human place within nature, and our relationship to the divine. She contends that both Hesiod in the Works and Days and Vergil in the Georgics saw farming in this way, and so wrote their poems not only about farming itself, but also about its (...) deeper ethical and religious implications. Hesiod, Nelson argues, saw farming as revealing that man must live by the sweat of his brow, and that good, for human beings, must always be accompanied by hardship. Within this vision justice, competition, cooperation, and the need for labor take their place alongside the uncertainties of the seasons and even of particular lucky and unlucky days to form a meaningful whole within which human life is an integral part. Vergil, Nelson argues, deliberately modeled his poem upon the Works and Days, and did so in order to reveal that his is a very different vision. Hesiod saw the hardship in farming; Vergil sees its violence as well. Farming is for him both our life within nature, and also our battle against her. Against the background of Hesiods poem, which found a single meaning for human life, Vergil thus creates a split vision and suggests that human beings may be radically alienated from both nature and the divine. Nelson argues that both the Georgics and the Works and Days have been misread because scholars have not seen the importance of the connection between the two poems, and because they have not seen that farming is the true concern of both, farming in its deepest and most profoundly unsettling sense. In reference to two central concepts of Albert Camus' philosophy, that is, the absurd and the rebellion, this article examines to what extent hisThe Plague is of interest to medical ethics. The interpretation of this novel put forward in this article focuses on the main character of the novel, the physician Dr. Rieux. For Rieux, the plague epidemic, as it is described in the novel, implies an unquestioning commitment to his patients and fellow men. According to Camus this epidemic has (...) to be understood as a symbol of the absurd. Unable to base his actions on a Christian, metaphysical value system, Rieux sees his commitment as a continuous rebellion against the fact of the absurd, which opposes him in the form of evil, suffering and death. As a physician, Rieux is therefore forced to adjust his actions to life in its immediacy, that is, the suffering of his patients. In this article, it will be shown that Rieux's attention to the immediate is of particular interest to medical ethics: Theother person in need, rather thanmy moral convictions, sets the norm. Arguments for the inherent value, equality of interests,or rights of non-human animals have presented a strong challenge for the anthropocentric worldview. However, they have been met with criticism.One form of criticism maintains that,regardless of their theoretical consistency,these 'pro-animal arguments' cannot be accepted due to their absurdity. Often, particularly inter-species interest conflicts are brought to the fore: if pro-animal arguments were followed,we could not solve interest conflicts between species,which is absurd. Because of this absurdity, the arguments need to (...) be abandoned. The paper analyses the strength, background and relevance of this 'argument from absurdity'. It is claimed that in all of the three areas mentioned above, the argument faces severe difficulties. (shrink)

Knowledge of causal laws is expensive and hard to come by. But we work hard to get it because we believe that it will reduce contingency in planning policies and in building new technologies: knowledge of causal laws allows us to predict reliably what the outcomes will be when we manipulate the factors cited as causes in those laws. Or do they? This paper will argue that causal laws have no special role here. As economists from JS Mill to Robert (...) Lucas and David Hendry stress, along recently with philosophers like James Woodward and Sandra Mitchell, they can do the job only if they are invariant under the manipulations proposed. But then, I shall argue, anything that is invariant under the proposed manipulations will do this job equally well. There seems to be nothing special about causal-law knowledge in and of itself that makes it particularly valuable for policy and technology prediction. What seems to matter is invariance alone, not causality. But what guarantees invariance and how do we know when it will obtain? Here certain kinds of causal laws do have a special place – those underwritten either by what I have called ‘nomological machines’ or by what I have called ‘capacities’. Capacities and nomological machines have a double virtue that makes them invaluable for policy planning. First, the causal laws they give rise to will be invariant so long as they obtain; and second, they typically have visible markers we can come to recognize that tell us when they obtain. The markers for nomological machines are shakier than those for capacities, though, since capacities are often tied to markers by well-established empirical laws. Capacities have their own drawback however, which is the final topic of this paper: the causal laws that are guaranteed by a capacity connect the obtaining (or triggering) of a capacity with its exercise. But Hume argued (mistakenly I suggest) that no distinction can be made between the obtaining of a power and its exercise. (shrink)

The world is quite seriously disrupted with wars, class struggles, crimes of violence, crimes of fraud and deceit, racial injustices, and a pervading distrust. Many people in our world feel unwanted and unnoticed, perhaps even rejected by the society that gave them their existence. In this paper I argue that doctors who are found guilty of serious professional misconduct should be required to apologize as a condition of their registration. I argue that such a requirement is to be justified on the basis of the need to protect patients, maintain public confidence in the profession, and declare and uphold proper standards of conduct and behaviour. I also answer an objection that might be made to the position I defend. Finally, I consider whether there (...) should be any exceptions to the demand for an apology from doctors who have been found guilty of serious professional misconduct. (shrink)

This article is about Islamism as a challenge for contemporary liberal democracies. Islamism is portrayed as an ideology that favors one specific religion as supreme and that is a threat to freedom of speech. The author makes a plea for distinguishing a. the religion of Islam, b. Muslims as a group, and c. the political ideology of Islamism. Regarding the dangers of Islamism, some sociological research about the convictions of Muslims is discussed and the most recent case from the European (...) Court of Human Rights in Strasbourg—E.S. v. Austria —is analysed, which renders all criticism of Islam and Islamism difficult, if not impossible. (shrink)

In response to my article “Earth, Technology, Language”, Christopher Müller asks whether use-oriented theory and Wittgensteinian language can capture the structural relations of power that shape habituation and argues that digital media do not provide opportunities for empowerment and democracy because there is no co-ownership. In my reply I argue that I have shown that this can be done with the broader conception of use I propose, that the grammar of technology should also be understood in terms of implicit knowledge, (...) and that technology, like language, also has a public dimension: I claim that there is no such thing as a private technology or private power, and that some degree of co-ownership or resistance is possible. In the second part of the paper I reply to Bas de Boer’s questioning of my criticism of postsphenomenology. I insist that postphenomenology does not have the full instrumentarium to carry out an adequate and comprehensive analysis of the social dimension of technology use, and that it is important to attend to the structural dimension of technology, with or without use of the term ‘transcendental’. Issues about heritage, knowledge, and memory are central to climate change narratives. In an age when reality television stars become world leaders, the urgency of climate change narratives requires us to understand the crucial roles of memory and heritage to the future of our planet. The sanctity of knowledge simply cannot be abandoned. Knowledge slips away through the cracks, both in mainstream media efforts to sell its news and in the nonchalance of the admittedly more mindful scholars and popularizers of (...) climate change narratives. We face complex issues here, and there is an urgent need to reassess the value systems and ethics that brought us to where we are in terms of climate change. This is no easy task. To face this complex and controversial issue will require tremendous care with facts, honesty about heritage, and commitment to remembering. It will also need recognition of the painful fact that heritage can no longer be an excuse for continued derogation of the natural environment. (shrink)

The paper is a response to Russell Daylight’s “In the Name of Democracy”. I argue that Daylight’s postmodernist approach to the question of democracy is flawed in several respects. First, he interprets the claim that the meaning of democracy is open to entail that there can be no closure when democratic norms are in dispute. I argue that normative closure is not only essential but also necessary to democratic practice, in particular for democratic legitimacy. I reject the claim that normative (...) closure requires transcendental truths or dubious metaphysical commitments. Second, I critically examine Daylight’s positive proposal for “language-citizens.” I end by offering a sketch of a theory of democratic legitimacy that I believe evades the charges that Daylight and postmodernists offer against normative democratic theory. Antipoverty movements have generated many “little” or “near” basic income guarantee (BIG) proposals. Most theorists discussing BIG posit a full-fledged universal grant that entirely satisfies the core value guiding their theory. Debates are conducted about feasibility, desirability and rival values. This article looks into particular considerations that need to be made when debating a little BIG. If a “status” value, meaning “all or nothing,” is the core value under debate, then a grant falling short of securing this status will (...) need some other justification. If the core value is “scalar,” meaning there can be more or less of it, then a lower grant can be justified if it is an efficient way to add to that value. I offer two reasons that a little BIG can have merit: 1. Organizations will benefit because the grant provides a clear target for citizen action. 2. There are reasons to think that a BIG of whatever size will promote organizational capabilities more efficiently than money coming from an employer, family member or conditional public entitlement. This paper argues that one problem that besets black-box AI is that it lacks algorithmic justifiability. We argue that the norm of shared decision making in medical care presupposes that treatment decisions ought to be justifiable to the patient. Medical decisions are justifiable to the patient only if they are compatible with the patient’s values and preferences and the patient is able to see that this is so. Patient-directed justifiability is threatened by black-box AIs because the lack of rationale provided (...) for the decision makes it difficult for patients to ascertain whether there is adequate fit between the decision and the patient’s values. This paper argues that achieving algorithmic transparency does not help patients bridge the gap between their medical decisions and values. We introduce a hypothetical model we call Justifiable AI to illustrate this argument. Justifiable AI aims at modelling normative and evaluative considerations in an explicit way so as to provide a stepping stone for patient and physician to jointly decide on a course of treatment. If our argument succeeds, we should prefer these justifiable models over alternatives if the former are available and aim to develop said models if not. (shrink)

As a domain of political intervention, speed is a meeting ground for projects of domination and tactics of emancipation, for logics of exclusion coexisting with various forms of collisions, intersections and amalgamations. Instead of reducing the ‘need for speed’ to a linear and unequivocal process, this article makes the case for thinking about speed as an arena of conflict, subject to brutal accelerations but also to at least momentary decelerations. Taking the example of Karachi, where road accidents and larger (...) controversies around transport played a prominent role in the violent postcolonial transformations of the city, it argues that from these collisions emerged a form of political power premised on the regulation of traffic flows. It concludes that moving-power always exceeds the initial intentions of those setting it in motion as it simultaneously builds on and disrupts the forces that give every city its vitality, that is, on the vitalism of speed. That knowledge ascriptions exhibit some form of sensitivity to context is uncontroversial. How best to account for the context-sensitivity at issue, however, is the topic of heated debates. A certain version of nonindexical contextualism seems to be a promising option. Even so, it is incumbent upon any contextualist account to explain in what way and to what extent the epistemic standard operative in a particular context of epistemic evaluation is affected by non-epistemic factors. In this paper, I investigate how non-epistemic (...) factors come into play when knowledge is ascribed. I argue that knowledge ascriptions often serve the purpose of providing actionable information. This, in turn, requires that epistemic interests be balanced against non-epistemic interests. Moreover, it raises the question of whose interests matter, those of the ascriber, the addressee, or the subject of ascription. Eventually, an answer to the question is suggested. (shrink)

Even though the interrelationship between education and democratic politics is as old as democracy itself, it is seldom explicitly formulated in the literature. Most of the time, the political system is taken as a given, and education conceptualized as an instrument for stability and social integration. Many contemporary discussions about citizenship education and democracy in the Western world mirror this tendency. In the paper, I argue that, in order to conceptualise the socio-political potential of education we need to understand (...) democracy in more political terms. This means that democracy can neither be seen primarily as a mode of associated living, nor a model for handling different life-views. A third alternative is Gert Biesta’s notion of democratic subjectification. Even though Biesta identifies depoliticising trends in citizenship education policies, I argue that his alternative still fails to be a sufficiently political alternative. What is lacking in Biesta is the explicit attention to political causes and the kind of collective activities that define a democracy: the creation of one’s own laws, norms and institutions. This capacity of the collective to question and govern itself is put in relief by Cornelius Castoriadis’s notion of “the project of autonomy”. (shrink)

This paper is devoted to an examination of the discovery, characterization, and analysis of the functions of microRNAs, which also serves as a vehicle for demonstrating the importance of exploratory experimentation in current (post-genomic) molecular biology. The material on microRNAs is important in its own right: it provides important insight into the extreme complexity of regulatory networks involving components made of DNA, RNA, and protein. These networks play a central role in regulating development of multicellular organisms and illustrate the importance (...) of epigenetic as well as genetic systems in evolution and development. The examination of these matters yields principled arguments for the historicity of the functions of key biological molecules and for the indispensability of exploratory experimentation in contemporary molecular biology as well as some insight into the complex interplay between exploratory experimentation and hypothesis-driven science. This latter result is not only important for philosophy of science, but also of practical importance for the evaluation of grant proposals, although the elaboration of this latter claim must be left for another occasion. In this article, it is claimed that the protective provisions for adults with impaired decision-making capacity are misguided, insofar as they do not conclusively state whether research on this group should be permitted only as an exception, and as they arbitrarily allow for some groups to benefit from such research while others will not. Moreover, the presumed or former will of the subject is given insufficient weight, and the minimal risk standard does not make sense in this context. Because of (...) these problems, the present guidelines allow for the possibility of vulnerable people being exploited, something that is hidden behind a guise of solidarity. Instead we need to address the real issues at stake by rewriting the present statutes. It is suggested that new guidelines should be in some continuity with earlier efforts. However, in order to protect these subjects there is additional need for appointed representatives who monitor research and for legal obligations to compensate for any injuries suffered. Without these or similar measures we won't have an adequate system in place for the protection of non-benefiting persons who are unable to consent to research. (shrink)

The article explores whether sociotechnical imaginaries of digitalization as inevitable accelerating development can be traced in Denmark’s official policy papers concerning digitalization 2015–2020. It identifies imperatives of speed, acceleration and agility equal to what has been described as a corporate data imaginary as well as tropes of an imaginary of the fourth industrial revolution and inevitable exponential technological development and disruption. The empirical analysis discovers a shift in the studied period mid-2018, before which inevitabilism is prominent and after which the (...) focus on non-economic values increases and the aim of influencing the development, instead of adapting to it, emerges. The article then addresses how imperatives of acceleration and narratives of inevitabilism may be considered problematic from a democratic point of view employing Hartmut Rosa’s critical diagnosis of the acceleration society and the notion of discursive closure. Finally, it discusses the empirical findings in light of technological determinism and constructivism inherent in the notion of sociotechnical imaginaries and introduces a sociotechnical selectionist theory allowing both for human agency in technological development while also providing a mechanism for explaining the emergence of law-like technological trends, as Moore’s Law, at macro level. Science and medicine have had great success in reducing the uncertainties surrounding sickness over the last 100 years. But current efforts to reduce the risk of future disease in healthy people depend on abstract and disembodied statistical models that are increasingly distant from individual lives with little or no likelihood of personal benefit. When couched in numerical terms and combined with the fear of an unknown future, we are easily manipulated by the authority of fact. A new form of authority (...) is needed, rooted in relationship, informed by sound science, and embracing risk. Enabled through the support of caring relationships to make commitments in the face of uncertain outcomes, we will be better able to choose wisely in our hope for health. (shrink)

Multidimensional space representations like those posited in Edelman's target article are not sufficient to capture all similarity phenomena. We discuss phenomena that are compatible with models of similarity that assume structured relational representations. An adequate model of similarity and perception will require multiple approaches to representation.

This article analyzes the problem of harmonization between traditional values and modern values, alongside the struggle against traditional and modern anti-values for the construction of sustainable peace in contemporary Burundi. It starts from a reminder of the historical events in Burundi which, from the advent of European colonizers and the confrontation on Burundian soil between Germans and Belgians, and the brutal accession to independence in 1962, have fundamentally caused the loss of axiological and cultural references, coupled with trauma experienced by (...) Burundians due to the unprecedented violence of these events. The analysis of the traditional values of ubuntu and ubutungane/intahe makes it possible to show that Burundian society was based both on the virtue ethics and on deontological ethics which should urgently be rediscovered to reinvigorate democratic institutions. Rediscovering these values requires a corollary work of struggle against the anti-values of uwawe and igihugu ntikiribw’ivu which corresponds to the modern anti-values of ethnocentrism and capitalist greed. The article proposes that education of the Burundian people in the values cited above and against these anti-values be promoted as a solid path to the formation of a new leadership embodied by ethically committed leaders who can carry with responsibility the project of a new Burundi, peaceful and prosperous, which was the dream of the two national heroes celebrated every year: the Prince Louis Rwagasore, the father of Independence, and President Melchior Ndandaye, the hero and martyr of democracy. Recently improved understanding of evolutionary processes suggests that tree-based phylogenetic analyses of evolutionary change cannot adequately explain the divergent evolutionary histories of a great many genes and gene complexes. In particular, genetic diversity in the genomes of prokaryotes, phages, and plasmids cannot be fit into classic tree-like models of evolution. These findings entail the need for fundamental reform of our understanding of molecular evolution and the need to devise alternative apparatus for integrated analysis of these genomes. We advocate (...) the development of integrative phylogenomics for analyzing these genomes and their histories, with tools suited to analyzing the importance of lateral gene transfer (LGT) and of DNA evolution in extra-cellular mobile genetic elements (e.g., viruses, plasmids). These phenomena greatly increase the complexity of relationships among interacting genetic partners, as they exchange functional genetic units. We examine the ontology of functional genetic units, interacting genetic partners, and emergent genetic associations, argue that these three categories of entities are required for a successful integrated phylogenomics. We conclude with arguments to suggest that the proposed new perspective and associated tools are suitable, and perhaps required, as a replacement for the bifurcating trees that have dominated evolutionary thinking for the last 150 years. This short paper is a response to Richard Smith’s ‘ion and finitude: education, chance and democracy’. In his paper Smith contends that a rationalist agenda dominates education and democracy today, and that this agenda by rendering us insensitive to the tragic dimension of life, breeds a sense of hubris, or arrogance towards fate which is fuelled by an inordinate confidence in our knowledge. In the worlds of education and politics it has led to an obsession with management and transparency, and (...) to students who fear to take risks. As a specific example of this, he takes up the recent fixation in universities with learning how to learn, which he says leads to an over-emphasis on skills in the curriculum, and to an ‘audit’ culture. While sympathising with much of his analysis of the latter, my counter-suggestion is that the contemporary world lacks anything but a sense of the contingency of things, to the contrary, that at the heart of its mangerialist culture and its performatist ethos lies the need for reassurance. My response focuses on the politics of the self-directed learner that lies at the heart of the lifelong learning literature, on learning how to learn, on the notion of transparency and on the transparent society, and on the politics of contingency and scepticism. At the 2019 and 2021 International Conference on Environmental Psychology, discussions were held on the future of conferences in light of the enormous greenhouse gas emissions and inequities associated with conference travel. In this manuscript, we provide an early career researcher perspective on this discussion. We argue that travel-intensive conference practices damage both the environment and our credibility as a discipline, conflict with the intrinsic values and motivations of our discipline, and are inequitable. As such, they must change. This change (...) can be achieved by moving toward virtual and hybrid conferences, which can reduce researchers’ carbon footprints and promote equity, if employed carefully and with informal exchange as a priority. By acting collectively and with the support of institutional change, we can adapt conference travel norms in our field. To investigate whether our arguments correspond to views in the wider community of ECRs within environmental psychology, we conducted a community case study. By leveraging our professional networks and directly contacting researchers in countries underrepresented in those networks, we recruited 117 ECRs in 32 countries for an online survey in February 2022. The surveyed ECRs supported a change in conference travel practices, including flying less, and perceived the number of researchers wanting to reduce their travel emissions to be growing. Thirteen percent of respondents had even considered leaving academia due to travel requirements. Concerning alternative conference formats, a mixed picture emerged. Overall, participants had slightly negative evaluations of virtual conferences, but expected them to improve within the next 5 years. However, ECRs with health issues, facing visa challenges, on low funding, living in remote areas, with caretaking obligations or facing travel restrictions due to COVID-19 expected a switch toward virtual or hybrid conferences to positively affect their groups. Participants were divided about their ability to build professional relationships in virtual settings, but believed that maintaining relationships virtually is possible. We conclude by arguing that the concerns of ECRs in environmental psychology about current and alternative conference practices must be taken seriously. We call on our community to work on collective solutions and less travel-intensive conference designs using participatory methods. (shrink)

The question of how well we need to be known, to be loved, is considered. A ‘second-person’ model is argued for, on which love requires that the beloved’s demands to be known be respected. This puts pressure on the idea that lovers need to make a beloved’s interests their own, taking that to require comprehension of the beloved’s interests: a lover would have to appreciate the normative intelligibility and motivating force of an interest. The possibility of love with (...) failure of comprehension is defended, using illustrations from Marilynne Robinson’s novel Gilead. (shrink)
