We defend the moral and legal right to secede in accordance with plebiscitary theory. Our paper has three main goals. First, by offering a schematic characterization of plebiscitary theory, the main arguments in its favour (and the main objections to them), we contribute to clarify the structure of this complex debate. Second, we stress the point that, if the moral right to secede is established, the resistance for its inclusion into positive law is unjustified. Finally, by addressing old and new (...) objections to plebiscitary theory, we hope to make a compelling case for a wider recognition of secessionist rights. (shrink)

We argue that the health sciences make causal claims on the basis of evidence both of physical mechanisms, and of probabilistic dependencies. Consequently, an analysis of causality solely in terms of physical mechanisms or solely in terms of probabilistic relationships, does not do justice to the causal claims of these sciences. Yet there seems to be a single relation of cause in these sciences - pluralism about causality will not do either. Instead, we maintain, the health sciences require a theory (...) of causality that unifies its mechanistic and probabilistic aspects. Critical Data Studies explore the unique cultural, ethical, and critical challenges posed by Big Data. Rather than treat Big Data as only scientifically empirical and therefore largely neutral phenomena, CDS advocates the view that Big Data should be seen as always-already constituted within wider data assemblages. Assemblages is a concept that helps capture the multitude of ways that already-composed data structures inflect and interact with society, its organization and functioning, and the resulting impact on individuals’ daily lives. CDS questions the (...) many assumptions about Big Data that permeate contemporary literature on information and society by locating instances where Big Data may be naively taken to denote objective and transparent informational entities. Para ello, haremos una breve explicación sobre las características de las dos versiones que hoy tenemos de esta obra hegeliana; esto tanto en su origen histórico como en las implicaciones teóricas de cada uno de estos textos. Posteriormente, localizaremos la ópera en cada una de las versiones de la Estética, para poder así exponer las particularidades y diferencias teóricas entre ambos materiales bibliográficos. Cabe (...) mencionar que profundizaremos en la ópera pensada como Gesamtkunstwerk, noción encontrada en la versión más reciente de los cursos de estética de Hegel, puesto que consideramos, además de su novedad, que es una noción del espíritu que nos conduce a nuevas precisiones en el estudio del pensamiento del filósofo de Stuttgart. This book introduces readers to Indian philosophy by presenting the first integral English translation of Vaiśeṣikasūtra with the earliest extant commentary of Candrānanda on the old aphorisms of Vaiśeṣika school of Indian philosophy. The book offers a comprehensive description of the fundamental categories of ontology and metaphysics, among which the category of 'particularity' plays a major role in the 'problem of individuation' of 'substance' and 'nature' in both Indian and Western metaphysics. The book should be read primarily in relation to (...) Aristotle's Categories and is structured in three parts. Part 1 contains a general introduction to Indian philosophy and the Vaiśeṣika system. This paper presents a formalism that combines useful properties of both logic and probabilities. Like logic, the formalism admits qualitative sentences and provides symbolic machinery for deriving deductively closed beliefs and, like probability, it permits us to express if-then rules with different levels of firmness and to retract beliefs in response to changing observations. Rules are interpreted as order-of-magnitude approximations of conditional probabilities which impose constraints over the rankings of worlds. Inferences are supported by a unique priority ordering on rules (...) which is syntactically derived from the knowledge base. This ordering accounts for rule interactions, respects specificity considerations and facilitates the construction of coherent states of beliefs. Practical algorithms are developed and analyzed for testing consistency, computing rule ordering, and answering queries. Imprecise observations are incorporated using qualitative versions of Jeffrey's rule and Bayesian updating, with the result that coherent belief revision is embodied naturally and tractably. Finally, causal rules are interpreted as imposing Markovian conditions that further constrain world rankings to reflect the modularity of causal organizations. These constraints are shown to facilitate reasoning about causal projections, explanations, actions and change. (shrink)

Segundo, introducimos una nueva terminología que distingue entre lo que llamamos razones dependientes, accesibles y aceptables. The author attempts to emphasize several aspects of religious types of discrimination that apply to women in different practices of Christian Orthodoxy. The basis of these interpretations is found both in the Bible and in the traditional writings of the church. This text suggests several solutions for locating the fundamentals that would allow for a renewal of the ecclesiastical practices in such a manner as to eliminate all possible discrimination that women are subjected to in the church.

In this paper I will deal with the question of the religious education in the public schools in Romania, from the point of view of the relationship between Church and State. My quantitative and qualitative analysis of the bills concerning religious education, the way in which law has been applied and some of the consequences of this application wants to circumscribe the meaning of some concepts such as religious liberty and the new religious forms. The basic consequence of this I (...) hope will be the redefining of the notion of public space and of the role played by religion with its characteristic aspects: the relationship between state and religious organizations. This will clearly show the essential bond between two main aspects of religious liberty: the formal aspect - legal and institutional - and the informal aspect – an aspect connected to the personal and social attitudes regarding the new forms of religious behaviour. Resumen: El propósito de este trabajo es mostrar cómo la propuesta de la nueva retórica de Chaïm Perelman se constituye fundamentalmente en una teoría de la racionalidad práctica en perspectiva argumentativa. Para el desarrollo de esta tesis procedemos de la siguiente manera: primero se describe el giro pragmático que lleva a Perelman a señalar los límites de la lógica formal deductivista para el campo de los valores en algunos de sus textos de juventud; a continuación se muestra la apuesta de (...) Perelman por una nueva retórica como un tipo de aplicación de la racionalidad, desarrollada en su Tratado de la argumentación y algunos textos posteriores a 1958; y finalmente se desarrolla la noción perelmaniana de lo razonable en el marco de la argumentación jurídica, para mostrar cómo, desde esta perspectiva, Perelman se vincula al debate de la segunda mitad del siglo XX conocido como la “doctrina de los casos difíciles en derecho”.: The purpose of this work is to show how Chaïm Perelman’s new rhetoric proposal fundamentally constitutes a theory of practical rationality in an argumentative perspective. To develop this thesis, we proceed as follows: first, we describe the pragmatic turn that leads Perelman to point out the limits of formal deductivist logic in the field of values, in some of his youth texts; then, Perelman’s bet on new rhetoric is presented as a kind of application of rationality, developed in his Treaty of Argumentation and in some texts written after 1958; finally, the Perelmanian notion of reason is developed in the framework of legal argumentation, to show how, from this perspective, Perelman is linked to the debate of the second half of the twentieth century known as the “doctrine of difficult cases in law”. The need for fair and just AI is often related to the possibility of understanding AI itself, in other words, of turning an opaque box into a glass box, as inspectable as possible. Transparency and explainability, however, pertain to the technical domain and to philosophy of science, thus leaving the ethics and epistemology of AI largely disconnected. To remedy this, we propose an integrated approach premised on the idea that a glass-box epistemology should explicitly consider how to incorporate values and (...) other normative considerations, such as intersectoral vulnerabilities, at critical stages of the whole process from design and implementation to use and assessment. To connect ethics and epistemology of AI, we perform a double shift of focus. First, we move from trusting the output of an AI system to trusting the process that leads to the outcome. Second, we move from expert assessment to more inclusive assessment strategies, aiming to facilitate expert and non-expert assessment. Together, these two moves yield a framework usable for experts and non-experts when they inquire into relevant epistemological and ethical aspects of AI systems. We dub our framework ‘epistemology-cum-ethics’ to signal the equal importance of both aspects. We develop it from the vantage point of the designers: how to create the conditions to internalize values into the whole process of design, implementation, use, and assessment of an AI system, in which values (epistemic and non-epistemic) are explicitly considered at each stage and inspectable by every salient actor involved at any moment. Mark Johnston (2016, 2017) has raised concerns that a worm-theoretic account of persistence through time is incompatible with ethical singularity: that within the life of any actual person, there is only one morally considerable being, namely that person. To deny ethical singularity is to deny a core feature of our ordinary ethical and prudential thinking. The worm theory, Johnston concludes, proves to be “disastrous … for our ordinary moral outlook”. This paper defends the worm theory from Johnston’s argument. Though I (...) agree that the worm theory must deny ethical singularity, it can nevertheless be squared with our ordinary ethical thinking by adopting a temporal counterpart analysis of temporal predication (‘x will be F’, ‘x was previously F’, etc.) for those morally considerable beings involved in a person’s life that are not the person. The concept of corporate social responsibility (CSR) has been widely investigated, but a generally accepted theoretical framework does not yet exist. This paper argues that the idiosyncrasies of large firms and SMEs explains the different approaches to CSR, and that the notion of social capital is a more useful way of understanding the CSR approach of SMEs, whereas stakeholder theory more closely addresses the CSR approach of large firms. Based on the extant literature, we present a comparison of large firm (...) and SME idiosyncrasies suggesting that both consolidated and emerging strategic orientations toward responsible behaviours exist. Idiosyncrasies of large firms and SMEs are also discussed to provide an assessment of the firm’s strategic CSR orientation, suggesting the key drivers upon which CSR strategies must be based. A twofold consideration emerges. First, the CSR–SME relationship could be better explained if the notion of social capital is taken into account, but this should also be accompanied by a stakeholder view of the SME; second, social capital and stakeholder theory should be taken as alternative ways of explaining CSR in both large firms and SMEs. According to Russo and Williamson (Int Stud Philos Sci 21(2):157–170, 2007, Hist Philos Life Sci 33:389–396, 2011a, Philos Sci 1(1):47–69, 2011b ), in order to establish a causal claim of the form, ‘_C_ is a cause of _E_’, one typically needs evidence that there is an underlying mechanism between _C_ and _E_ as well as evidence that _C_ makes a difference to _E_. This thesis has been used to argue that hierarchies of evidence, as championed by evidence-based movements, tend (...) to give primacy to evidence of difference making over evidence of mechanisms and are flawed because the two sorts of evidence are required and they should be treated on a par. An alternative approach gives primacy to evidence of mechanism over evidence of difference making. In this paper, we argue that this alternative approach is equally flawed, again because both sorts of evidence need to be treated on a par. As an illustration of this parity, we explain how scientists working in the ‘EnviroGenomarkers’ project constantly make use of the two evidential components in a dynamic and intertwined way. We argue that such an interplay is needed not only for causal assessment but also for policy purposes. (shrink)

The purpose of this paper is to expand the theoretical field of discursive injustice by identifying a specific kind of discursive injustice, namely, the kind we are subject to when we are unjustly prevented from exchanging reasons with others. Broadly speaking, discursive injustice is the kind of injustice we suffer when we are unjustly harmed as language users, most notably when we are prevented from using language in ways we are entitled to. The dominant approach to discursive injustice has focused (...) on the corruption of the illocutionary force of a speech act due to the hearer’s improper uptake. I claim that there is a genuinely distinct kind of discursive injustice, which I label as deliberative injustice, that cannot be accounted for by the dominant approach to discursive injustice. In my view, what makes deliberative injustice discursively unjust is that it amounts to denying someone a normative position that she is entitled to as a language user, which I understand in terms of being a source of reasons. Moreover, I explore two ways of trying to illuminate deliberative injustice by appealing to the social level of analysis, namely, by resorting to a structural explanation to explain how it comes about, and by asking what it signifies for the collective life of groups. In this regard, I show that the structural explanation has some explanatory limitations, and that deliberative injustice essentially constitutes a collective failure. (shrink)

According to the worm theory, persons are (maximal) aggregates of person-stages existing at different times. Personites, on the other hand, are non-maximal aggregates of stages that are very much like persons. Their existence appears to make instances of prudential self-sacrifice morally problematic: the personites that exist at the time of the sacrifice but not at the time of the reward seem not to receive future compensation for their sacrifice. Instances of punishment appear to give rise to a similar problem. We (...) argue that these impressions arise from a mistaken assumption about the primary bearers of properties such as suffering, receiving compensation (in the future) and having (previously) committed a crime. According to the worm theory, stages, rather than persons or personites, possess these properties. Persons and personites have these properties only derivatively. As we show, once this clarification and related ones are made, the apparent moral problems raised by the existence of personites dissolve. (shrink)

Vico, on the other hand, never believed that progress was bound inevitably to occur, let alone that it were an unavoidable process, since barbarism is always lying in wait and all conquer appears to be meager. La tesis o hipótesis que se sostiene en el artículo es que la puesta en relación de formas explícitas e implícitas de vida compartida en las sociedades contemporáneas conlleva el auge de identidades híbridas, múltiples o complejas. Entendiendo por identidades híbridas la confluencia de múltiples identificaciones en la biografía personal. Siendo la globalización y la pluralización cultural las formas fundamentales de la sociedad contemporánea, la movilidad se convierte en su principal ingrediente. Se describe la presencia de distintos elementos culturales conformadores (...) de identidad en Chiapas. Internet, la emigración a Estados Unidos o el Tratado de Libre Comercio entre México, Estados Unidos y Canadá se hibrida con la heterogeneidad identitaria (religiosa, étnica, lingüística) existente en el territorio. Se discute el carácter híbrido de las sociedades contemporáneas y las consecuencias sociales y políticas que conlleva. (shrink)

The uncertainty concerning the genre of the Ḥorvat ʿUza ostracon 1 is problematized through the lens of linguistic anthropology. Although a denotative approach to the linguistic forms in this Hebrew ostracon is well attested, less attention has been paid to the indexical meaning of specific stylistic features and their semi- otic register implications. Several linguistic-ideological concepts are drawn upon to examine how the act of inscription and specialized linguistic forms align the discursive genre of the ostracon with prophecy. El término aventura resumiría lo que de impulso inmanentista encierra el bergsonismo. Dicha aventura, empero, se ve finalmente empañada por las más diversas consideraciones de tipo espiritualista y de modo especial por la inquietud teológica del último Bergson. Llevar a cabo esa aventura implicaría formar un "circuito" entre lo virtual y lo posible. Sería así desarticulada en la ontología bergsoniana la inquietud antes mencionada y pensado el futuro con condiciones humanistas.

Resumen: Este texto se concentra en el valor de las relaciones de cuidado y en la política pública que debe adoptarse en relación con ellas. Defiendo que, en consonancia con lo que argumenta Elizabeth Brake, debido a que las RC son una de las bases sociales del respeto propio, el mismo marco de apoyo que las leyes maritales ofrecen actualmente a las relaciones biamorosas debe ser accesible a otras RC consensuadas entre adultos -como las amistades a largo plazo, las relaciones (...) entre cohabitantes y las poliamorosas-. Sin embargo, a diferencia de lo que sostiene Brake, argumento que debemos evitar usar el término "matrimonio" para referirnos legalmente a cualquier RC. En concreto, mi propuesta es extender los derechos asociados con el matrimonio a otras RC entre adultos y suprimir dicho término por completo en la legislación.: This paper focuses on the value of caring relationships and the public policy that should be adopted regarding them. I defend that, as Elizabeth Brake has argued, considering that such relationships are one of the social bases of self-respect, the same legal protective framework that it is now accessible to bi-amorous relationships under marriage law should be available to other caring relationships between adults -such as long-term friendships, long-term cohabitations and poli-amorous relationships. However, unlike Brake, I hold that we should avoid referring legally by the term 'marriage' to any caring relationship. In short, my proposal is to extend the rights associated to marriage to other caring relationships between adults and to eliminate such term from legislation all together. (shrink)

Causal claims in biomedical contexts are ubiquitous albeit they are not always made explicit. This paper addresses the question of what causal claims mean in the context of disease. It is argued that in medical contexts causality ought to be interpreted according to the epistemic theory. The epistemic theory offers an alternative to traditional accounts that cash out causation either in terms of “difference-making” relations or in terms of mechanisms. According to the epistemic approach, causal claims tell us about which (...) inferences (e.g., diagnoses and prognoses) are appropriate, rather than about the presence of some physical causal relation analogous to distance or gravitational attraction. It is shown that the epistemic theory has important consequences for medical practice, in particular with regard to evidence-based causal assessment. (shrink)

The paper addresses the question of how different types of evidence ought to inform public health policy. By analysing case studies on obesity, the paper draws lessons about the different roles that different types of evidence play in setting up public health policies. More specifically, it is argued that evidence of difference-making supports considerations about ‘what works for whom in what circumstances’, and that evidence of mechanisms provides information about the ‘causal pathways’ to intervene upon.

Causal analysis in the social sciences takes advantage of a variety of methods and of a multi-fold source of information and evidence. This pluralistic methodology and source of information raises the question of whether we should accordingly have a pluralistic metaphysics and epistemology. This paper focuses on epistemology and argues that a pluralistic methodology and evidence don’t entail a pluralistic epistemology. It will be shown that causal models employ a single rationale of testing, based on the notion of variation. Further, (...) We argue that four-dimensionalists should adopt a contextualist semantics, according to which ordinary speakers’ judgments may concern person-stages, person-segments or person-worms, depending on the context. We explain how context helps select the boundaries of the temporal parts we refer to or quantify over and show that contextualism offers the best treatment of ordinary predications and ordinary counting judgments. Contextualism implies an error theory; however, we explain why this error theory is less problematic than those entailed by the worm and stage (...) theories. (shrink)

El hecho de que Popper hable del conocimiento como de una habilidad práctica da pie a analizar su propuesta en los términos de la filosofía práctica de la ciencia, tal y como ha sido desarrollada por Alfredo Marcos. Este enfoque ofrece una visión más coherente del pensamiento popperiano en el que no cabría distinguir dos etapas incoherentes, una crítica y otra ontológica, sino un mismo pensamiento (...) en el que la relación entre sujeto y objeto de conocimiento no es tan simple como suponen el psicologismo subjetivista ni el objetivismo esencialista (extremos que Popper pretendió evitar siempre). Abstract“Patient-centred care” is the recent response to the malaise produced in the field of health care from the point of view both of a technical mentality and the paternalistic model. The interest in the story-telling approach shown by both the humanities and the social sciences has favoured a “narrative turn” in medicine too, where the new ethics of therapeutic relationship consider the hermeneutic method a means by which to integrate evidence and subjectivity, scientific data and patient experience. The aim of (...) this paper is to show how Ricoeur’s theory of “threefold mimesis” makes a conceptual contribution to the use of narrative interviews in nursing and also be successfully transferred into and applied in the field of healthcare in general. First, the paper examines how this narrative approach might open up new possibilities for the acquisition of in-depth knowledge of patients’ life experiences, a condition indispensable for the improvement of the quality of care. Secondly, it highlights how this Ricoeurian method seems capable of provide an opportunity for healthcare professionals to review their own understanding of the caregiver-patient therapeutic relationship, beginning with their confrontation with the patient’s world as revealed by the narrative they provide.
