Carl Schmitt está de moda. Sin embargo, pocos conocen su faceta de organizador de congresos antisemitas 1. Muchos alaban la finura de sus análisis, el poder descriptivo de sus conceptos, su estilo literario, su carácter de jurista polémico. No sólo se trata de una proliferación de lectores entre los más jóvenes, sino de un reconocimiento por parte de los más afamados y de un uso un tanto miope de sus conceptos (por ejemplo, la idea de estado de excepción, su idea (...) de constitución material 2, etc.). In this article I explore some topics of the philosophy of law of Julius Binder. More specifically, I explore the relation and compatibility of his ideas with national-socialism. In the first part of the article I analyze the neo- Kantian approach underlying to his philosophy. Subsequently I analyze his turn towards neo- Hegelianism. In the last sections I address the philosophical concept of nation that this author defended and I search for its links with both national- socialism and Hegelian philosophy. (...) A hemi-implicative lattice is an algebra \((A,\wedge,\vee,\rightarrow,1)\) of type (2, 2, 2, 0) such that \((A,\wedge,\vee,1)\) is a lattice with top and for every \(a,b\in A\), \(a\rightarrow a = 1\) and \(a\wedge (a\rightarrow b) \le b\). A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the \(\{\wedge,\vee,\rightarrow,1\}\) -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. La guerra no es una actividad necesariamente sangrienta, pero sí necesariamente política. Esta, en tanto que actividad del espíritu y sentimiento, anida en las mentes de quienes toman parte en ella. En el mundo del siglo XXI el incremento de relaciones e intereses compartidos hace difícil que las guerras puedan ser totales; lo que existe es una zona gris en la que se plasma la rivalidad de los diferentes actores en planos concretos. Narrativas e imágenes son fundamentales como herramientas de (...) persuasión política. En este sentido también son elementos del _Soft Power_, entre ellas la Historia, que puede ser instrumentada como la mejor de las narrativas. Estas permiten controlar la agenda informativa y, a su vez, la realidad, así como crear los sobreentendidos que sirven a las Relaciones Internacionales y ayudan a la implementación de las políticas. El dominio cultural y, sobre todo, la cinematografía son elementos claves en tal propósito, porque no importan los hechos tanto como su percepción, su memoria y recuerdo. (shrink)

Ortega no estudió de manera concreta el tema de la religión. Sin embargo, a lo largo de su obra, encontramos muchas y variadas referencias a cuestiones religiosas. Parte de ellas se refieren, sobre todo en su juventud, a un personal modo de concebir la religión: como afirmación de la vida, respeto y fidelidad a uno mismo y a su circunstancia. Además de las fuentes de inspiración en Goethe o Renan, es indispensable, para comprender esta concepción, contar con las problemáticas religiosas (...) de la época. Éstas se enclavan en la circunstancia por excelencia del pensamiento de Ortega: el problema de España, y su atraso científico y cultural respecto a Europa. (shrink)

According to the principle of Knowledge Counter-Closure , knowledge-yielding single-premise deduction requires a known premise: if S believes q solely on the basis of deduction from p, and S knows q, then S must know p. Although prima facie plausible, widely accepted, and supported by seemingly compelling motivations, KCC has recently been challenged by cases where S arguably knows q solely on the basis of deduction from p, yet p is false or p is true but not known . I (...) explore a view that resolves this tension by abandoning KCC in the light of these challenges, and which acknowledges their force but also their limits. Adopting this view helps identify the epistemic constraints that operate on the premises of knowledge-yielding deduction, clarifies the epistemic role of deduction, and allows us to distil the kernel of truth in the motivations that are standardly taken to support KCC. According to a widespread view, the Bell theorem establishes the untenability of so-called ‘local realism’. On the basis of this view, recent proposals by Leggett, Zeilinger and others have been developed according to which it can be proved that even some non-local realistic theories have to be ruled out. As a consequence, within this view the Bell theorem allows one to establish that no reasonable form of realism, be it local or non-local, can be made compatible with the (experimentally tested) (...) predictions of quantum mechanics. In the present paper it is argued that the Bell theorem has demonstrably nothing to do with the ‘realism’ as defined by these authors and that, as a consequence, their conclusions about the foundational significance of the Bell theorem are unjustified. Reflecting the current turn in curriculum work that underscores the relationship between theory and practice, this volume brings together the voices of curriculum theorists working within academic setting and practitioners working in schools and other educational settings. The book traces their collaborative work, challenging the assumption that practitioners should be only consumers of the theory produced by academics. Thus, this collection engages readers in the complicated conversation about the relationship between theory and practice, between theoreticians and practitioners. Although every author (...) is, to some degree, a practitioner as well as a theorist, their collaboration emerges from the particular positions and identification that each assumes in the practice of their craft. From working with homeless youth to deepening one's personal commitment to antiracist pedagogy in schools, each author's experience implodes the false binary of the theory/practice dichotomy, illuminating a different dimension of the challenges therein. Miranda Fricker has influentially discussed testimonial injustice: the injustice done to a speaker S by a hearer H when H gives S less-than-merited credibility. Here, I explore the prospects for a novel form of testimonial injustice, where H affords S due credibility, that is, the amount of credibility S deserves. I present two kinds of cases intended to illustrate this category, and argue that there is presumptive reason to think that testimonial injustice with due credibility exists. I show that if (...) it is denied that ultimately these cases exemplify testimonial injustice without credibility deficit, then either they must be taken to exemplify a novel kind of epistemic, non-testimonial injustice, or they bring to light a significant exegetical result. I argue that patients who suffer genital surgery to ‘disambiguate’ their sexual anatomy, a practice labelled ‘intersex genital mutilation’ (IGM) by intersex advocates, can be understood as victims of hermeneutical injustice in the sense elaborated by Miranda Fricker. This claim is clarified and defended from two objections. I further argue that a particular subset of cases of IGM-based hermeneutical injustice instantiate a novel form of hermeneutical injustice, which I call deception-based hermeneutical injustice. I highlight how this differs from central types (...) of hermeneutical injustice in the literature and trace its harms. (shrink)

In the philosophical literature, self-deception is mainly approached through the analysis of paradoxes. Yet, it is agreed that self-deception is motivated by protection from distress. In this paper, we argue, with the help of findings from cognitive neuroscience and psychology, that self-deception is a type of affective coping. First, we criticize the main solutions to the paradoxes of self-deception. We then present a new approach to self-deception. Self-deception, we argue, involves three appraisals of the distressing evidence: (a) appraisal of the (...) strength of evidence as uncertain, (b) low coping potential and (c) negative anticipation along the lines of Damasio’s somatic marker hypothesis. At the same time, desire impacts the treatment of flattering evidence via dopamine. Our main proposal is that self-deception involves emotional mechanisms provoking a preference for immediate reward despite possible long-term negative repercussions. In the last part, we use this emotional model to revisit the philosophical paradoxes. (shrink)

How are we to understand the intentionality of desire? According to the two classical views, desire is either a positive evaluation or a disposition to act. This essay examines these conceptions of desire and argues for a deontic alternative, namely the view that desiring is representing a state of affairs as what ought to be. Three lines of criticism of the classical pictures of desire are provided. The first concerns desire’s direction of fit, i.e. the intuition that the world should (...) conform to our desires. The second concerns the “death of desire” principle, i.e. the intuition that one cannot desire what one represents as actual. The last pertains to desire’s role in psychological explanations, i.e. the intuition that desires can explain motivations and be explained by evaluations. Following these criticisms, three positive arguments in favor of the deontic conception are sketched. (shrink)

Martínková et al provide an overview of a tendency to use gender terms in key sports contexts, including eligibility criteria and testing, where gender is unintended. They argue that to avoid conceptual confusion and aid clarity, we should disentangle gender and sex, acknowledging that often gender talk should be interpreted as talk of sex. One of their recommendations is that the labels of competitive categories ‘women’s’/’men’s’ should change to ‘female’/’male’. I first make their argument against gendered labelling more precise by (...) showing that important yet neglected moral and practical reasons support their abandonment. I then argue that in the case of WA regulations, those moral reasons also cut against Martínková et al.’s relabelling proposal ‘female’/’male’. I sketch a testosterone-based proposal which circumvents the problem and which WA itself should accept. More generally, I argue we should be more mindful of the risk that competitive category labels unnecessarily harm athletes. (shrink)

This paper addresses the problem of pluralism in democratic societies, by exploiting some insights from the debate about the epistemology of disagreement. First, by focusing on the permissibility of experiments on nonhuman animals for research purposes, we provide an epistemic analysis of deep normative disagreements. We understand that to mean disagreements in which epistemic peers disagree about both the substantive content of an ethical issue and the correct justificatory reasons for their contrary claims. Second, we argue for a compromise solution (...) in which the reasons for reaching it are not prudential but grounded on the recognition of epistemic peerhood. (shrink)

Desire has not been at the center of recent preoccupations in the philosophy of mind. Consequently, the literature settled into several dogmas. The first part of this introduction presents these dogmas and invites readers to scrutinize them. The main dogma is that desires are motivational states. This approach contrasts with the other dominant conception: desires are positive evaluations. But there are at least four other dogmas: the world should conform to our desires (world-to-mind direction of fit), desires involve a positive (...) evaluation (the “guise of the good”), we cannot desire what we think is actual (the “death of desire” principle), and, in neuroscience, the idea that the reward system is the key to understanding desire. The second part of the introduction summarizes the contributions to this volume. The hope is to contribute to the emergence of a fruitful debate on this neglected, albeit crucial, aspect of the mind. Se realizó una investigación descriptiva con el objetivo de caracterizar la esfera afectiva de mujeres diagnosticadas con trastornos depresivos, en el período comprendido entre 2012 y 2015. La muestra estuvo conformada por 46 mujeres residentes en la provincia de Camagüey, seleccionadas de manera intencional, a partir de los criterios establecidos por los autores del estudio. Se aplicó el Psicodiagnóstico de Rorschach, según la codificación e interpretación del Sistema Comprehensivo de Exner. Como principales resultados se obtuvo que, en la mayoría de (...) las mujeres, predominó la combinación del Índice de depresión negativo y el Índice de inhabilidad social positivo, el estilo vivencial coartado e introversivo, proporción afectiva baja y Lambda alta. A descriptive study was conducted to characterize the affective sphere of women diagnosed with depressive disorders during a period between 2012 and 2015. The sample consisted of 46 women living in Camagüey, who were selected intentionally using criteria established by the investigation authors. A Rorschach Test was applied, with regard to the encoding and interpretation of Exner´s Comprehensive System. Results suggested that most women exhibited a combination of the negative depression index and the positive social disability index, constricted and introversive experiential style, low affective proportion and high Lambda. The goal of this article is to show that formal analysis and reconstructions may be useful to discuss and shed light on substantive meta-theoretical issues. We proceed here by exemplification, analysing and reconstructing as a case study a paradigmatic biochemical theory, the Monod-Wyman-Changeux theory of allosterism, and applying the reconstruction to the discussion of some issues raised by prominent representatives of the new mechanist philosophy. We conclude that our study shows that at least in this case mechanicism and more traditional (...) accounts are not rivals but complementary approaches. (shrink)

La mundialización de la economía, el reacomodo geopolítico, los conflictos entre pueblos y naciones, la desigualdad social, así como el avance vertiginoso en la ciencia, la tecnología y la cultura; son rasgos y desafíos significativos del tercer milenio. La racionalidad técnica-instrumental propicia una educación que establece roles y competencias como elementos centrales de la formación profesional, soslayando la problemática sobre los fines, objetivos y la dimensión social y política de la educación. En México se observa que los contenidos, estructuras y (...) enfoques curriculares, se han apegado a los "lineamientos y directrices" de la política educativa emanada de las "recomendaciones" de los organismos e instituciones financieras a nivel mundial. El respeto y la práctica de los DDHH es uno de los grandes desafíos de la humanidad ante el predominio de la racionalidad instrumental y la lógica del libre mercado, que concibe al ser humano como el "homofaber". El currículum rígido y vertical, crea condiciones para un ejercicio del poder, basado en la antidialogicidad, la imposición y el autoritarismo. La escuela requiere estructuras curriculares flexibles y una organización democrática, donde los docentes deberán asumir una actitud de profundo respeto y práctica de los derechos humanos dentro y fuera de la escuela. We explore the distinctive characteristics of Mexico's society, politics and history that impacted the establishment of genetics in Mexico, as a new disciplinary field that began in the early 20th century and was consolidated and institutionalized in the second half. We identify about three stages in the institutionalization of genetics in Mexico. The first stage can be characterized by Edmundo Taboada, who was the leader of a research program initiated during the Cárdenas government (1934-1940), which was primarily directed towards improving (...) the condition of small Mexican farmers. Taboada is the first Mexican post-graduate investigator in phytotechnology and phytopathology, trained at Cornell University and the University of Minnesota, in 1932 and 1933, respectively. He was the first investigator to teach plant genetics at the National School of Agriculture and wrote the first textbook of general genetics, Genetics Notes, in 1938. Taboada's most important single genetics contribution was the production of "stabilized" corn varieties. The extensive exile of Spanish intellectuals to Mexico, after the end of Spain's Civil War (1936-1939), had a major influence in Mexican science and characterizes the second stage. The three main personalities contributing to Mexican genetics are Federico Bonet de Marco and Bibiano Fernández Osorio Tafall, at the National School of Biological Sciences, and José Luis de la Loma y Oteyza, at the Chapingo Agriculture School. The main contribution of the Spanish exiles to the introduction of genetics in Mexico concerned teaching. They introduced in several universities genetics as a distinctive discipline within the biology curriculum and wrote genetics text books and manuals. The third stage is identified with Alfonso León de Garay, who founded the Genetics and Radiobiology Program in 1960 within the National Commission of Nuclear Energy, which had been founded in 1956. The Genetics and Radiobiology Program rapidly became a disciplinary program, for it embraced research, teaching, and training of academics and technicians. The Mexican Genetics Society, created by de Garay in 1966, and the development of strains and cultures for genetics research were important activities. One of de Garay's key requirements was the compulsory training of the Program's scientists for at least one or two years in the best universities of the United States and Europe. De Garay's role in the development of Mexican genetics was fundamental. His broad vision encompassed the practice of genetics in all its manifestations. (shrink)

Jeff McMahan has recently provided a forceful defense of methodological anti-speciesism against speciesists’ claim that species standard is a meaningful criterion to assess the value of lives and the nature of deprivation. In this paper I discuss McMahan’s favored account (the Intrinsic Potential Account) to assess the value of life and the nature of deprivation and challenge its overall ethical and methodological tenability. I level three charges against the Intrinsic Potential Account. I argue, first, that it cannot be consistent with (...) some widely held egalitarian moral intuitions. Second, it is unconvincing in its justification of the idea of equal respect for persons. Third, it is unclear how it can make sense of the value of individual capacities without referring to some species-based standard. Although I remain neutral with respect to the debate between anti-speciesists and speciesists, I argue that anti-speciesists cannot rely on McMahan’s arguments. (shrink)

In a recent paper on Foundations of Physics, Stephen Boughn reinforces a view that is more shared in the area of the foundations of quantum mechanics than it would deserve, a view according to which quantum mechanics does not require nonlocality of any kind and the common interpretation of Bell theorem as a nonlocality result is based on a misunderstanding. In the present paper I argue that this view is based on an incorrect reading of the presuppositions of the EPR (...) argument and the Bell theorem and, as a consequence, is unfounded. (shrink)

Desires matter. How are we to understand their intentionality? According to the main dogma, a desire is a disposition to act. In this article, I propose an alternative to this functionalist picture, which is inspired by the phenomenological tradition. On this approach, desire involves a specific manner of representing the world: deontic mode. Desiring a state of affairs, I propose, is representing it as what ought to be or, if one prefers, as what should be. Firstly, I present three principles (...) of the semantics of desires that pertain to their satisfaction conditions, their world-to-mind direction of fit, and the idea that we desire what, we think, is not actual. Secondly, I examine the functionalist view in light of these features. Finally, I argue for the deontic mode conception: desire and ought-to-be fit like hand in glove. Consequently, desire’s intentionality is irreducible to desire’s functional role and calls for a first-person perspective taking modes seriously. (shrink)

This Ph.D. Dissertation examines these conceptions of desire and proposes a deontic alternative inspired by Meinong. On this view, desiring is representing a state of affairs as what ought to be or, if one prefers, (...) as what should be. Desire involves a deontic manner of representing: a norm of the ought-to-be type features in desire’s intentional mode, as opposed to content. The dissertation is structured in three parts. In order to defend this conception, I formulate three main desiderata for a promising theory of the intentionality of desire in the introduction (§0). The first concerns desire’s direction of fit, i.e. the intuition that the world should conform to our desires. The second concerns the death of desire principle, i.e. the intuition that one cannot desire what one represents as actual. The last pertains to desire’s role in psychological explanations, i.e. the intuition that desires can explain some mental states and be explained by other mental states. The first part examines the main conceptions of desire in light of these desiderata. I argue that the classical pictures of desire do not adequately meet our desiderata. The first chapter is devoted to the evaluative conception (§1), while the second examines the motivational approach (§2). Following these criticisms, I then present the deontic view of desire (§3). In the second part, I defend this conception with the help of three arguments. The main idea is that appealing to norms of the ought-to-be type can satisfy our chief desiderata: the world should conform to norms (world-to-mind direction of fit, §4), norms are grounded on values and in turn ground obligations (explanation, §5), and norms are about non-actual states of affairs (death of desire principle, §6). In the last part, I develop the deontic view to draw a cartography of the various types of desire. Some desires are correct, while others are inappropriate. This distinction is explained by the deontic conception, as it matches that between states of affairs that ought to obtain and states that should not obtain (§7). Two study cases are examined: caprice and the impermissibility of desire aggregation. Intuitively, hopes, wishes, or urges are types of desire. The next chapter presents a typology inspired by the deontic view and the type of norms there are (§8). The last chapter discusses the main objections to the deontic approach (§9). In conclusion, I show the relevance of the deontic view for several debates in philosophy of mind and ethics. Desires are crucial because they are the ‘eye’ of what should be. (shrink)

In this paper I argue that Fricker’s influential account of testimonial injustice (hereafter ‘TI’) should be expanded to include cases of TI from mutually neutralising countervailing prejudices. In this kind of case, the hearer is given due credibility by the speaker. I describe a relevant case, defend it from objections, highlight how it differs from extant cases of due-credibility TI and describe its distinctive features. This case demonstrates how paying attention to the way multiple prejudices operate in concert leads to (...) expanding the repertoire of cases of TI and casts light on the harms of TI. (shrink)

Experts from different disciplines offer novel ideas for improving research oversight and protection of human subjects.

In this text, we ask if analogy can enable a dialogue between religion and the social sciences. To do so, we focus in the conflict between the biblical understanding of man as a created being and the notion of human nature as a social construct. Although there seems to be a fundamental dispute in social constructivism between nature and freedom (Ian Hacking), we consider analogical reasoning (Mauricio Beuchot) enables anthropological views, like Philip Hefner’s, that include central aspects of the doctrine (...) of creation and understand nature and freedom as complementary human features, thus allowing the desired dialogue.
