Among the various human forms alluded to in the Hebrew prayer, mental retardation appears to be one of the most difficult to celebrate. It is the disability that other disabled persons do not want attributed to them. It is the disability for which prospective parents are most likely to use selective abortion (Wertz 2000). And it is the disability that prompted one of the most illustrious United States Supreme Court Justices to endorse forced sterilization, because "three generations of imbeciles are (...) enough." The mentally retarded have at times been objects of pity, compassion, or abuse by their caretakers and society at large. But they have rarely been seen as subjects, as citizens, as persons with equal entitlement to fulfillment. (shrink)

During the last couple of decades, concurrently with an increased awareness of the complexity of ethical conflicts, political theorists have directed attention to how constitutional democracy should cope with a fact of incommensurable doctrines. Poststructuralists such as Chantal Mouffe claim that ethical conflicts are fundamentally irreconcilable, which is indeed a view shared by many liberal theorists. The question of whether ethical conflicts are in principle irreconcilable is an important one since the answer has implications for what democratic institutions are desirable. (...) In light of this question the article investigates the notion of conflict in agonistic pluralism and discourse theory. At first glance, Mouffe’s agonism seems apt to accommodate ethical conflict in democratic governance, since it focuses on conflict as the core of politics, whereas Habermasian deliberative democracy seems inappropriate for this task, as it focuses on consensus. However, through an inquiry into the conditions of conflict this article will argue the opposite, namely, that conflict cannot be adequately understood within Mouffe’s agonistic framework. The thesis defended is (1) that discourse theory offers a more accurate account of conflict than agonistic theory because it embraces the idea that deliberation is constitutive of conflict, and (2) that some of Habermas’ assumptions concerning ethical discourse need to be revised in order for his democratic theory to fully accommodate this insight. Since Hegel, the idea of an end of art has become a staple of aesthetic theory. This book analyzes its role and its rhetoric in Hegel, Nietzsche, Benjamin, Adorno, and Heidegger in order to account for the topic's enduring persistence. In addition to providing a general overview of the main thinkers of post-Idealist German aesthetics, the book explores the relationship between tradition and modernity. For despite the differences that distinguish one philosopher's end of art from another's, all authors treated here (...) turn the end of art into an occasion to thematize and to reflect on the very thing that modernism cannot or should not be: tradition. Contrary to the widespread concern about over-treatment at the end of life, today, patient preferences for palliative care at the end of life are frequently respected. However, ethically challenging situations in the current healthcare climate are, instead, situations in which a competent patient requests active treatment with the goal of life-prolongation while the physician suggests best supportive care only. The argument of futility has often been used to justify unilateral decisions made by physicians to withhold or withdraw life-sustaining treatment. However, (...) we argue that neither the concept of futility nor that of patient autonomy alone is apt for resolving situations in which physicians are confronted with patients' requests for active treatment. Instead, we integrate the relevant arguments that have been put forward in the academic discussion about ‘futile’ treatment into an ethical algorithm with five guiding questions: (1) Is there a chance that medical intervention will be effective in achieving the patient's treatment goal? (2) How does the physician evaluate the expected benefit and the potential harm of the treatment? (3) Does the patient understand his or her medical situation? (4) Does the patient prefer receiving treatment after evaluating the benefit-harm ratio and the costs? (5) Does the treatment require many resources? This algorithm shall facilitate approaching patients' requests for treatments deemed futile by the physician in a systematic way, and responding to these requests in an ethically appropriate manner. It thereby adds substantive considerations to the current procedural approaches of conflict resolution in order to improve decision making among physicians, patients and families. (shrink)

The authors analyze democracy and the political community in a transnational context, using new critical, conceptual and normative perspectives on the borders, territories and political agents of the state.

In this essay, I recount and examine my response to a genetic diagnosis of my disabled daughter. My daughter was forty‐nine before the diagnosis came. All her disabilities were traceable to a de novo single gene variant on the PURA gene that was discovered only in 2014. I speak of the jolt and the recalibration that this discovery engendered, concluding that, while it seemed that everything had changed, nothing had changed. But my family did discover a community in which Sesha (...) joins other PURA‐perfect sons and daughters and where we as a family acquire a “horizontal identity” marked by a genetic variant. (shrink)

This essay describes the Hungarian historical background out of which Michael Polanyi’s lifelong commitment to a liberal, democratic form of government grew. Hungary’s liberal thinkers blossomed in the nineteenth centruy, but their orientation was more political and practical than philosophical. Enlightenment ideas did not penetrate deeply into Hungarian society, which in recent centuries was hampered by its Eastern European and feudal ties. Thus Polanyi felt he had to move to more liberal countries.

Women's activities and relations to men are persistent metaphors for man's projects. I query the prominence of these and the lack of equivalent metaphors where men are the metaphoric vehicle for women and women's activities. Women's role as metaphor results from her otherness and her relational and mediational importance in men's lives. Otherness, mediation, and relation characterize the role of metaphor in language and thought. This congruence between metaphor and women makes the metaphor of woman especially potent in man's conceptual (...) economy. (shrink)

This brings us not only to the conclusion of my list of eight features proposed as being common to all or most value experience, but also to a reminder of its purpose. First, I hope that, in the spirit of Husserl's dictum, “to the things themselves,” this proposal will initiate a discussion of a “basic research” type of question, namely: What are the main features of value experience? Second, I hope that the fruits of such a discussion might eventually contribute (...) to the working out of a metatheory for value inquiry: a theory about criteria of adequacy for any general theory of value.In a paper of this scope it is obvious that one cannot even begin to discuss all the points and subpoints made in the manner in which they deserve. Much less can one defend all, or even any, of its claims with the kind of logical rigor and linguistic fastidiousness which have come to be the norm in most Anglo-American philosophy today. As a counterbalance to a tendency in some professional circles to making adherence to this norm the end of, rather than merely a means for, philosophic understanding, I have offered this paper after the spirit of Socrates and Plato, who certainly appreciated appropriate logical rigor and linguistic tidiness. Philosophy was nevertheless always for them first and foremost a mutual adventure of exploration into value through significant dialogue. Thus, rather than submitting one more piece of logic or language to the microscope, it has been my purpose to go exploring this time with a telescope. Agenda 21 of United Nations demands better situation of ecology, economy, health, etc. in all countries. An evaluation of scientific contributions in international congresses of fundamental anthropological sciences (philosophy, psychology, psychosomatics, physiology, genito-urology, radio-oncology, etc.) demonstratesevidence of large discrepancies in the participation not only of developing and industrial countries, but also between the last ones themselves. Low degree of research and education leads to low degree of economy, health, ecology, etc. [Lit.: Neu, Michailov et al.: Physiology in Agenda 21. Proc. (...) Int. Un. Physiol. Sci. CONCEPTION: The science is leading in the social and economic development of humanity, but the misuse of science causes disastrous repercussions (ecological and self-destruction). New models for scientific education, beginning with philosophy, followed by philosophical, pedagogical, medical, theological anthropology, and research are necessary tosupport Agenda 21 and prevent misuse of science. According to proposals on foundation of experimental schools (Immanuel Kant) and international universities (Bertrand Russell) the International Academy of Science/ICSD supports these ideas and initiated the creation of first (interdisciplinary) International Faculties forAnthropology as paradigm for humanization, higher effectiveness and pluralistic internationalization of science, leading to better education ("Erziehung und Ausbildung") and research in all countries, i.e. decrease of the gap between industrial and developing countries. CONCLUSION: Foundation of international institutes for general (philosophy, pedagogy, medicine) as well as for special anthropology (theology, informatics-logic-mathematics, culture, biology, (bio-) physics/chemistry) in context of an integralanthropology via networks of national ones from selected countries of Africa, America, Asia, Australia, Europe can permit the necessary implication of philosophy in education of anthropological sciences as well as research and education (post graduate) by common international research and educational programmes, lecturers, students, etc. in one country. This project needs political and financial support by UNO, European Union, governments, banks, industries to support the education of a homo sanus, humanus et spiritualis for the future humanity. The remarkable increase in diagnoses of autism has paralleled an increase in scientific research and turned the syndrome into a kind of a new ‘trend’ within psychiatric and developmental conditions of childhood. At the same time, discursive technologies, such as DSM-IV, autobiographies, movies, fiction, etc., together with ‘educational’ interventions, such as TEACCH, PECS, Makaton, etc., seem to anticipate a form of an apparatus built around the condition named autism. Starting from this premise, the article proposes a new approach within autism (...) studies, which treats the condition in Foucauldian terms and focuses on the emergence of the autistic subjectivity following Foucault's methodology of archaeology, genealogy, and modes of subjectification. A growing number of multinational companies (MNCs) report on their progress toward contributing to the Sustainable Development Goals (SDGs) in their annual reports, yet the amount and quality of the information they disclose varies significantly. The aim of this study is twofold: First, we investigate how transparent MNCs report on their SDG engagement and second, we study how the reported SDG engagement changed over time due to major shifts in sustainability reporting requirements. Using a dataset of the largest German MNCs, (...) we analyze their disclosure of SDG contribution reporting practices. Our results show that, overall, between 2016 and 2021 all German MNCs increased their SDG reporting activity and that the MNCs adopted four different practices to report their SDG engagement. We also found that the largest MNCs were more transparent and systematic in their SDG reporting than smaller MNCs, whose reporting was more heterogeneous. Our study contributes to legitimacy research and the role of transparency in corporate reporting as well as the debates on the efficacy of sustainability reporting legislation in the context of SDG engagement. Our findings imply that regulations on environmental and social regulation increase the transparency of sustainability reporting. (shrink)

Eva Simantoni-Bournia Un masque humain à Hyria de Naxos, nouveau témoignage de contacts chypriotes p. 119-132 Neuf tessons d'un masque en terre cuite représentant une figure masculine barbue presque grandeur nature, datés de la fin du VIIIe - début du VIIe siècle av. J.-C., ont été découverts en 1994 dans le sanctuaire d'Hyria à Naxos. Ce masque naxien doit son importance à la rareté de ce type d'objets, surtout à haute époque. Les masques en terre cuite du sanctuaire d'Orthia à (...) Sparte, les plus connus et les plus étonnants du monde grec, sont presque tous plus récents et la plupart relève d'une tradition stylistique différente. Les masques en terre cuite du Chypro-Géométrique I mis au jour dans les sanctuaires de Kition et de Salamine à Chypre constituent les parallèles les plus proches de l'exemplaire d'Hyria. Cet article propose que le masque barbu idéalisé d'Hyria était porté, lors d'une sorte de représentation (δρώμενον), par celui qui jouait le rôle de l'époux de la déesse de la fécondité vénérée avec Dionysos dans le grand sanctuaire naxien et identifiée à Ariane. La représentation — fréquente dans le culte de Dionysos — d'une sorte d'union rituelle dans les pratiques cultuelles d'Hyria est vraisemblable. Les contacts chypriotes, confirmés par notre masque, étayent le rapprochement de l'Ariane naxienne avec la grande déesse chypro-orientale, que nous avons proposé jadis sur la base des trouvailles du sanctuaire et à partir des témoignages littéraires. Every ethic, if it is not to be a feather in the wind, needs an epistemology. As we look at epistemologies from Plato's Theaetetus to Kant's First Critique to contemporary virtue epistemology, the question of knowledge is always tethered to an ethics, sometimes tightly, sometimes loosely. To live a good life and act rightly toward others, we need to know what we need to know to do this well; we need to know how to know that what we are doing (...) is what is good or right; and we need to know how we can know what is good and right. The title of this paper deserves an explanation—or rather two explanations, one for the portion preceding the colon, the other for that following as the subtitle. The first part is derived from a short essay by Emily Perl Kingsley, written in 1987 in response to questions she had received about what it is like to raise a child with Down Syndrome.1 Kingsley suggests that planning for a child is like planning a trip to some wonderful destination—in her example, Italy. The cognitive gain in the use of metaphor and simile is nicely elucidated by Tversky's theory of similarity. The features of the theory which are of special importance are the directionality and context-dependency of similarity judgments. These indicate the extent to which such judgments are classificatory and that similarity is not only the cause of an object's classification but is also a derivative of groupings. Metaphor and simile exploit certain cognitive features involved in the relation between classification, context and similarity (...) judgments so as to make possible the creation of similarity, which, from a conceptual standpoint, is the prime motivation for metaphor. Institutional suggestions for how to rethink democracy in response to changing state responsibilities and capabilities have been numerous and often mutually incompatible. This suggests that conceptual unclarity still reigns concerning how the normative ideal of democracy as collective self-determination, i.e. ?rule by the people?, might best be brought to bear in a transnational and global context. The aim in this paper is twofold. First, it analyses some consequences of the tendency to smudge the distinction between democratic theory and moral theories (...) of legitimacy and justice. Second, it develops a conceptual framework that distinguishes between necessary conditions, aspects and aims of democracy. On this basis it specifies three objectives of democracy, some of which may also hold for multilevel governance. It is argued that there are in principle at least three reasons to value democratic institutions: they are intrinsically justified to the extent that they distribute fair shares of political influence over decision-making; they are instrumentally justified to the extent that they secure several of our other best interests, one of which is our interest in non-domination; and finally, they are also instrumentally justified insofar as they secure the just distribution of other goods. The aim of this framework is not to develop a specific theory of multilevel governance but to point at important distinctions to be made and normative criteria to be specified. The intention is to take the debate forward by noting some of the issues that any satisfactory account must address. The framework lays out the grounds for analysing the institutional challenges facing legitimate multilevel governance through what is speculatively called ?multiple citizenship?, understood in explorative terms, opening the door for the manifold roles that citizens could and ought to play in multilevel governance, not only as democratic agents, but also as agents of democracy and agents of justice. Social policy, broadly understood, is an intervention by government or other public institution designed to promote the well‐being of its members or intended to rectify perceived social problems. Governmental policy can issue from legislative, executive, or judicial actions. Regulations and rules governing major public establishments, such as universities or medical institutions, and directed at promoting the aims of the larger social body can also be considered instruments of social policy. Social policy is sometimes understood more narrowly as interventions of the (...) state in the domain of distribution or redistribution, when action has been thought necessary to correct for the instability inherent in a given social structure or created by pressures for social change. In this sense, it pertains to welfare policies aimed at the poor. In this article, we will deal primarily with social policy in the broad sense, reserving a brief discussion at the end on social policy in the narrow sense, as welfare policy. (shrink)

It traces their history from the Dionysian Performance Tradition and brings a fresh perspective to the issue as it recasts standard interpretations of the Aristotelian theory in broader terms that offer new grounds for distinguishing humor', comedy' and mirth'.

The article discusses two historical events taken from texts from the Holy Scripture – the Old and the New Testaments, and a spiritual view on human soul, as found in the Holy tradition of the Orthodox church: they support the thesis that, according to the method of allegorical interpretation, the three evidences point to three inner stages through which human soul passes in its transition to a holistic spiritual development: from the act of the Holy Baptism to the entry into (...) the Kingdom of God.
