In Moral Failure, Lisa Tessman argues against two principles of moral theory, that ought implies can and that normative theory must be action-guiding. Although Tessman provides a trenchant account of how we are thrust into the misfortune of moral failure, often by our very efforts to act morally, and although she shows, through a discussion well-informed by the latest theorizing in ethics, neuroethics, and psychology, how much more moral theory can do than provide action-guiding principles, I argue that the two (...) theses of moral theory that she disputes remain indispensable for ethical theory. A key feature of facial behavior is its dynamic quality. However, most previous research has been limited to the use of static images of prototypical expressive patterns. This article explores the role of facial dynamics in the perception of emotions, reviewing relevant empirical evidence demonstrating that dynamic information improves coherence in the identification of affect (particularly for degraded and subtle stimuli), leads to higher emotion judgments (i.e., intensity and arousal), and helps to differentiate between genuine and fake expressions. The findings (...) underline that using static expressions not only poses problems of ecological validity, but also limits our understanding of what facial activity does. Implications for future research on facial activity, particularly for social neuroscience and affective computing, are discussed. (shrink)

Companies increasingly recognize the importance of communicating corporate social responsibility including their engagement toward employees, the community, the environment and other stakeholder groups to attract applicants. The positive findings on the effect of CSR on applicants’ reactions are commonly based on the assumption that companies send a clear signal about their commitment to CSR. However, communication is always contextualized and has become more ambiguous through the increased availability of information online. External stakeholders including actual and potential applicants are confronted with (...) inconsistencies between the way companies communicate CSR activities and their overall CSR performance. Drawing on signaling theory, this article raises the question of how the interaction between strong CSR communication and low CSR performance influences organizational attractiveness. We propose that low CSR performance dampens the effect of CSR communication on organizational attractiveness. Hence, the inconsistency between CSR communication and CSR performance decreases organizational attractiveness. To test our hypotheses, we scraped 67,189 posts published on corporate Facebook career pages by 58 Fortune 500 companies from the time they began their respective career page until June 2018. Surprisingly, our results show that a low CSR performance strengthens the effect of CSR communication on organizational attractiveness. Thus, inconsistencies between CSR communication and CSR performance seem to lead to positive evaluations among applicants. (shrink)

This paper outlines Jesse Prinz’s theory that emotions represent values by registering bodily changes, discusses two objections, and concludes that Prinz’s theory stands in need of modification: while emotions do represent values, they do not do so in the first place by registering bodily changes, but by processing information about how things we care about fare in the world. The function of bodily changes is primarily to motivate and prepare us for action.

The paper deals with the position of a scholar in the society, as articulated in the philosophy of J. G. Fichte. It also offers a brief outline of the philosophies of education of the 18th and 19th centuries and their differences. It shows different interpretations of the concept of Bildung in German philosophy, which in that time became almost a “fashion”. The spirit of that time is reflected also in the idealist views of J. Schupbach and Sprenger introduce a novel probabilistic approach to measuring the explanatory power that a given explanans exerts over a corresponding explanandum. Though we are sympathetic to their general approach, we argue that it does not adequately capture the way in which the causal explanatory power that c exerts on e varies with background knowledge. We then amend their approach so that it does capture this variance. Though our account of explanatory power is less ambitious than Schupbach and Sprenger’s in (...) the sense that it is limited to causal explanatory power, it is also more ambitious because we do not limit its domain to cases where c genuinely explains e. Instead, we claim that c causally explains e if and only if our account says that c explains e with some positive amount of causal explanatory power. (shrink)

An intensified discussion on the role of normative ideals has re-emerged in several debates in political philosophy. What is often referred to as “ideal theory,” represented by liberal egalitarians such as John Rawls, is under attack from those that stress that political philosophy at large should take much more seriously the nonideal circumstances consisting of relations of domination and power under which normative ideals, principles, and ideas are supposed to be applied. While the debate so far has mainly been preoccupied (...) with defending or rejecting ideal theory through a defense or rejection of a specific ideal theory, this paper instead focuses on a number of general philosophical concerns on which the critique relies. More specifically, it brings up for scrutiny, and ultimately rejects, three charges against ideal theory: the charge that ideal theory is not action-guiding, that ideal theory is impossible, and that ideal theory is distorting. By investigatingthese charges in tandem, the paper shows that the criticism against ideal theory is premised on assumptions about the relationships between thought and action and between concepts and the world for which there is little or no support. The paper deals with the question of religious tolerance in Europe’s past and present. Tolerance within Christianity (and within the other so called “Abrahamitic” or “Biblical” Religions) is one of the main points. However, the reader is also invited to take a brief look at Europe’s pre-christian past. To some extent, the religious situation of the Roman Empire in particular rather seems to resemble our own experiences with pluralistic societies in today’s Europe than medieval and early modern circumstances would do. (...) Even the ancient problems with “religious freedom” can be linked with modern counterparts. So this paper will avoid long retrospectives at the well known facts of Europe’s Christian past such as inquisition and European religious wars in order to deal with some more hidden perspectives of European religious his- tory, which were often obscured by the main historiographical narrative. In recent years, some political realists have argued that there is a “distinctively political normativity” which should be used when construing and justifying political theories. Among realists focusing on a distinctively political normativity, one can identify two approaches. On the “moral view,” it is explicitly acknowledged that moral norms have a role to play in political normativity. On the “non-moral view,” distinctively political normativity is understood in terms of a non-moral kind of practical normativity. The non-moral view has received severe (...) criticism, not least pertaining to its instrumental versions. Recently, however, Carlo Burelli has attempted to develop a realist account that is faithful to the non-moral view, but which is said to avoid the criticism directed against non-moral accounts in general, and the purely instrumental ones, in particular. Burelli offers a functional account of distinctively political normativity, according to which the function of providing binding collective decisions generates a normative standard that is independent of morality. Despite its many innovative features, however, we argue that it fails with regard to the most pressing concern, which is not whether functional normativity is genuine normativity, but whether it is the right normativity for its assigned role. The comment starts with a brief exposition of the Eroteric View put forth by Artūrs Logins. I then provide one friendly comment on the exact form of the normative question which is central to the view, and suggest that in addition to the question, ‘Why ought S to φ?’, Logins should take the question, ‘Why is S permitted to φ?’ as definitive of normative reasons. In a more critical comment, I reflect on how normative explanatory reasons and normative reasoning reasons (...) relate, calling into question Logins’s claim that the two kinds of reasons are fundamentally distinct. First, I argue that being a normative explanatory reason near enough guarantees being a normative reasoning reason; second, I argue that normative explanatory reasons as well as normative reasoning reasons can be weighed, and that they can be weighed against each other. Most agree that mental properties depend in some way on physical properties. While phys- icalists describe this dependence in terms of deterministic synchronic relations like identity or supervenience, some dualists prefer to think of it in terms of indeterministic dynamic relations, like causation. I’m going to develop a third conception of the dependence of the mental on the physical that falls somewhere between the deterministic synchronic dependence relations of the physicalist and the indeterministic diachronic dependence relations advocated by some dualists. I’ll then use this new conception of metaphysical dependence to formulate a novel approach to the mind body problem that (i) posits a necessary, metaphysically robust synchronic dependence of the mental on the physical, (ii) satisfies several of the key motivations of both non-reductive physicalism and naturalistic dualism, (iii) is consistent with both the causal efficacy of the mental and the causal closure of the physical, and (iv) is capable of reconciling determinism about the physical world with indeterminism about the mental world. Although the discussion about feasibility in political theory is still in its infancy, some important progress has been made in the last years to advance our understanding. In this paper, we intend to make a contribution to this growing literature by investigating the proper place of feasibility considerations in political theory. A motivating force behind this study is a suspicion that many presumptions made about feasibility in several current debates—such as that between practice-independence and practice-dependence, ideal and non-ideal theory, and (...) political moralism and political realism—are too rigid and underestimate the numerous different ways in which feasibility concerns may enter into our theorizing. To chisel out this feasibility space, our aim is to suggest two metatheoretical constraints on normative political principles as intuitively plausible, the so-called ‘fitness constraint’ and the ‘functional constraint’, through which we elucidate five central aspects for determining proper feasibility constraints of an account in political theory. In an adversarial common law courtroom, where one party tries to defeat the other by using words as weapons, polysemous words more often than not pose a problem to the court interpreter. Unlike in dyadic communication, where ambiguity can be easily clarified with the speaker by the hearer, court interpreters’ freedom to clarify with speakers is to a large extent restricted by their code of ethics. Interpreters therefore can only rely on the context for disambiguating polysemous words. This study illustrates (...) the problem of polysemy in an interpreter-mediated rape trial. It exemplifies how the interpreter’s goal to avoid contradictions by making her interpretation of a polysemous word consistent with the preceding context runs counter to that of the bilingual cross-examiner, whose primary goal is to identify inconsistencies in the hostile witness’s testimony in order to discredit him. This study also manifests a denial of the interpreter’s latitude in the interpretation of contextual clues and her loss of power in a courtroom with the presence of other bilinguals. (shrink)

In this commentary I expand on the first of Noble’s illusions, the selection metaphor. Building on my work with Simona Ginsburg on the evolution of minimal consciousness, I argue that the existence of some complex sensory and motor patterns in the living world can be accounted for only through the evolution of conscious choice.

On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

This article examines how corporate social responsibility (CSR) can serve as an external source of rents for governments that depend on foreign financing for state-building and development. The strategic, instrumental use of CSR has been overlooked in previous research on governments and CSR, especially in the Global South. To understand how CSR can serve as a lever for rents, the concept of “extraversion” is introduced to describe the way in which rent-seeking African governments instrumentalize their asymmetric external relations for political (...) and private benefit. The connection between CSR and rent-seeking is analyzed through a case study of large gas investments in Tanzania. The article finds that the government has set up regulation that enables local and central government authorities to appropriate, mediate, reclaim, or possibly trick CSR practices to gain rents. Based on the study, two contributions are made to the literature on CSR and governments. First, the instrumental use of CSR in the Global South is added to the variety of perspectives that can be taken when studying government agency. Second, CSR is conceptualized as a potential stream of rents for governments to exploit. The article ends with discussing that the outcome of CSR in a rent-seeking environment depends on whether the leveraged resources are managed well to support peaceful and locally beneficial economic development or whether they serve private accumulation through corruption. In a previous article, we unpacked the so-called “ethics first premise”—the idea that ethics is “prior” to politics when theorizing political legitimacy— that is denied by political realists. We defended a “justificatory” reading of this premise, according to which political justification is irreducibly moral in the sense that moral values are among the values that ground political legitimacy. We called this the “necessity thesis.” In this paper we respond to two challenges that Robert Jubb and Enzo Rossi raise against our (...) proposal. Their first claim is that our argument for the necessity thesis is question begging, since we assume rather than show that freedom and equality are moral values. The second claim is that Bernard Williams’s Basic Legitimacy Demand demonstrates the possibility of giving political legitimacy a non-moral foundation, since it allows for a distinction to be made between politics and sheer domination. The practice-dependent approach to justice has received a lot of attention in post-millennium political philosophy. It has been developed in different directions and its normative implications have been criticized, but little attention has been directed to the very distinction between practice-dependence and practice-independence and the question of what theoretically differentiates a practice-dependent account from mainstream practice-independent accounts. The core premises of the practice-dependent approach, proponents argue, are meta-normative and methodological. A key feature is the presumption that a concept of justice (...) is dependent on the function or aim of the social practices to which it is supposed to be applied. Closely related to this meta-normative thesis is an interpretive methodology for deriving principles of justice from facts about existing practices, in particular regarding their point and purpose. These two premises, practice-dependent theorists claim, differentiate their account since they are not accepted by practice-independent accounts and they justify different principles of justice than practice-independent accounts. Our aim in this article is to refute both and, demonstrating that practice-independent accounts may indeed accept the meta-normative and methodological premises of the practice-dependent accounts, and that we are given no theoretical reason to think that practice-dependent accounts justify other principles of justice for a practice than do practice-independent accounts. In other words, practice-dependent theorists have not substantiated their claim that practice-dependence is theoretically differentiated from mainstream accounts. When practice-dependent proponents argue for other principles of justice than mainstream theorists, it will be for the usual reason in normative theory: their first-order normative arguments differ. In this paper, I discuss the conceptualist claim that we cannot speak of perceptual content unless we assume it is objective content. The conceptualist argues that only conceptual content can meet the requirement of being objective, so that the view that perceptual experience has nonconceptual content is not tenable. I start out by presenting the argument from objectivity as it can be found in McDowell. I then present the following objections: First, perceptual objectivity cannot be due to the perceiver’s conception (...) of objectivity; and second, even nonconceptual capacities of the individual cannot and need not be appealed to in order to account for objective perceptual content. The central ideas coming out of the so-called pragmatic turn in philosophy have set in motion what may be described as a pragmatic turn in normative political theory. It has become commonplace among political theorists to draw on theories of language and meaning in theorising democracy, pluralism, justice, etc. The aim of this paper is to explore attempts by political theorists to use theories of language and meaning for such normative purposes. Focusing on Wittgenstein's account, it is argued that these (...) attempts are unsuccessful. It is shown that pragmatically influenced political theorists draw faulty epistemological, ontological and semantic conclusions from Wittgenstein's view in their normative theorising, and it is argued that pragmatically influenced theories of language and meaning, however full of insight, cannot be put to substantial normative use in political theory. The general scope of the thesis is motivated by pointing to the general form of the argument and by moving beyond Wittgenstein to other philosophers of mind and language, illustrating how similar overextensions are made with regard to Robert Brandom's theory of language and meaning. In our target article, “Learning and the evolution of conscious agents” we outlined an evolutionary approach to consciousness, arguing that the evolution of a form of open-ended, representational, and generative learning (unlimited associative learning, UAL) drove the evolution of consciousness. Our view highlights the dynamics and functions of consciousness, delineates its taxonomic distribution and suggests a framework for exploring its developmental and evolutionary modifications. The approach we offer resonates with biosemioticians’ views, but as the responses to our target article show, (...) our proposal also faces challenges and has led to suggestions that extend, develop and qualify it. Our response to the 14 varied and rich commentaries starts with the recurring and deep question raised by many of them – the relation between life and sentience. We explore this question by introducing and expanding on “vivaciousness”, a term we coined to describe the turbulent, flexible exploration-stabilization processes inherent in the living condition, as well as addressing the related concepts of Umwelt and selfhood. We then consider the question of the adequacy of unlimited associative learning (UAL) as an evolutionary transition marker (ETM) of minimal consciousness (rather than as a marker of a complex form of sentience), and the possible precursors of sentience. The engagement with these broad themes is entangled with a discussion of evolutionary transitions, constitutive emergence and the function/s of consciousness. The suggestions of our commentators, urging us to explore new concepts and new avenues of research within the framework of a richer view of evolution are then discussed. We end by briefly considering what we regard as a conceptual lacuna, which is leading to the indiscriminate use of the term “sentience” and which awaits further investigation. (shrink)

Infants who suffer severe neglect fail to thrive emotionally as well as bodily. The absence of early coexistential structures that provide well-being leads to a narrowing of the child's perceptual and social developmental horizon. What is the nature of these early structures? In this essay, an ontology of well-being or housedness is elaborated through phenomenological reflections on breast-feeding and infant perception. Merleau-Ponty's ontology of the flesh makes a contribution to the ontology of well-being: it gives us a conceptual and evocative (...) language to describe human existence in its pre-verbal, syncretic, and non-dualistic manifestations. It also allows for a re-evaluation and re-interpretation of the results of current research in infant perception. Through the structures of infant perception we perceive the coexistential fit between infants, other human beings, and the world of things. An infant's fundamental housedness in the flesh is taken up and cultivated or destroyed by the child's social and cultural environment. (shrink)

Empathy as “Feelingly Grasping” Perhaps the central question concerning empathy is if and if so how it combines aspects of thinking and feeling. Indeed, the intellectual tradition of the past centuries has been marked by a dualism. Roughly speaking, there have been two pathways when it comes to understanding each other: 1) thinking or mind reading and 2) feeling or empathy. Nonetheless, one of the ongoing debates in psychology and philosophy concerns the question whether these two abilities, namely, understanding what (...) the other is thinking and “understanding” what the other is feeling, are separate or not. Most of the authors in this volume consider the cognitive and affective dimensions at work within empathy. Each author does this within and beyond their own field. Coming from the humanities, we propose the following definition for empathy: Empathy is a social feeling that consists in feelingly grasping or retracing the present, future, or past emotional state of the other; thus empathy is also called a vicarious emotion. We would like to highlight two aspects of this definition in particular: 1.) the peculiar position of “grasping” which involves a cognitive dimension and 2.) the social dimensions of relating to the emotions of another human being. Building on Dor’s theory of language as a social technology for the instruction of imagination, I suggest that autobiographical memory evolved culturally as a response to the problems of false memory and deliberate deceit that were introduced by that technology. I propose that sapiens’ linguistic communication about past and future events initially occurred in small groups, and this helped to correct individual memory defects. However, when human groups grew in size and became more socially differentiated, and movement between groups prevented (...) story-verification, misattributions of events became more common. In such conditions individuals with better autobiographical memory had an advantage because they could evaluate their own contents and sources of information, as well as that of others, more accurately; this not only benefitted them directly, but also improved their reliability as social partners. Autobiographical memory thus evolved in the context of human linguistic communication through selection for communicative reliability. However, the advantages of imagination, which enables forward-planning and decision-Making, meant that memory distortions, although controlled and moderated by autobiographical memory, could not be totally eradicated. This may have driven the evolution of additional forms of memory control involving social and linguistic norms. I interpret the language and the social norms of the Pirahã as the outcome of the cultural-evolutionary control of memory distortions. Some ways of testing aspects of this proposal are outlined. Die hier vorgestellte Münchner Leitlinie zu Entscheidungen am Lebensende soll rechtliche Unsicherheit reduzieren, Klinikumsmitarbeiter für die ethische Dimension von Therapieentscheidungen am Lebensende sensibilisieren und ethisch begründete Entscheidungen fördern. Aus organisationsethischer Perspektive soll mit der Leitlinie eine Reflexion und Meinungsbildung zu einem ethisch relevanten (...) Themenbereich erfolgen und ein Beitrag zur Qualitätssicherung der Patientenversorgung und damit auch zur Patientenzufriedenheit geleistet werden. Die Prozesse der Leitlinienentwicklung, -aktualisierung und -implementierung werden vorgestellt. Die wesentlichen inhaltlichen Elemente der Leitlinie mit Darstellung der Rechtslage, der Definition zentraler Begriffe und Klärung medizinischer Entscheidungskriterien werden an Hand eines Entscheidungsalgorithmus dargestellt. Inhalt und Prozess der Leitlinienentwicklung werden auf die folgenden organisationsethischen Qualitätskriterien hin überprüft: deliberativer Prozess, inhaltliche Transparenz, repräsentative Zusammensetzung der Arbeitsgruppe, Implementierung und Evaluation der Leitlinie. Institutionen, die diese Leitlinie übernehmen wollen, sollten diese von einem autorisierten Gremium überprüfen lassen und auf die spezifischen Bedürfnisse ihrer Institution adaptieren. Hierfür ist eine vorgeschaltete Bedarfserhebung hilfreich. In dem Gremium sollten all diejenigen vertreten sein, die in der Folge mit der Leitlinie arbeiten werden. (shrink)

In his target article, Koonin discusses the insights into the evolution of bacterial genomes provided by the CRISPR-Cas system. This evolved defense system is based on intrinsic processes of genome engineering which, as he argues, enable Lamarckian inheritance. In this commentary I discuss some historical and conceptual issues that pertain to Koonin’s analysis of this aspect of the CRISPR-Cas system, extending and qualifying his discussion.
