It is assumed a) that the statement that a human right exists means that a state which does not grant it is not legitimate, and b) that the legitimacy of power can, in modern times, be justified only by showing that it is in the equal interest of everybody. Mere democracy is insufficient to legitimate political power. Freedom for every individual must be guaranteed. So much is common ground in the controversy on human rights, but to interpret these freedom as (...) a negative freedom, as the classical conception of human rights has done, is insufficient and therefore illegitimate, because it is not in the equal interest of everybody. To add a positive concept of freedom is correct but not enough, because it still neglects those who even if they are given the facilities do not have the capacity. Since the handicapped, the old and the young cannot even enter a contract and the disposessed cannot enter a fair contract, the contractarian foundation of human rights must be discarded. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was (...) disseminated via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

ArgumentThe sphygmograph as designed and tested by Jules-Étienne Marey – an apparatus destined to write pulse tracings on paper – revolutionized medical diagnostics in the early 1860s. Since the accuracy with which this device registered and objectified the pulse was controversial from the outset, the young scholar Ernst Mach decided to thoroughly examine Marey's sphygmograph. The investigation led to the invention of an alternative, truly Machian, sphygmograph. Mach's sphygmograph had originated in the regime of theoretical and applied physics, (...) whereas the instrument invented by Marey had been rooted in the regime of experimental physiology. This one type of instrument thus serves as the focal object of a comparative study of two antagonistic epistemological approaches to sphygmography. (shrink)

A study of the published and unpublished parts of Ernst Mach's last notebook (1910–14) suggests that Max Planck's attack (1908–11) provoked Mach into opposing ‘The Church of Physics’ more strongly than previously realized. Shortly after Mach threatened to leave the discipline if belief in atoms were required. Albert Einstein tried to persuade him to accept atomism (September 1910). Mach declined to mention Einstein again in his publications and increasingly criticized ‘The Church of Physics’. Evidence that Mach opposed relativity theory (...) and the absence of evidence that he favored it is pointed out. It is suggested that Mach's alleged ‘friendly interest’ in Einstein's work in early 1914 may have been stimulated by the hope that the young genius might develop a continuum or field theory to refute Planck's discontinuity physics. The paper concludes with suggestions on how philosophers who defend Mach's non-realism such as Gereon Wolters and Paul Feyerabend might be better off switching to a realist epistemology more compatible with rationally-held science, religion, and common sense. In late winter of 1864, Charles Darwin received two folio volumes on radiolarians, a group of one-celled marine organisms that secreted siliceous skeletons of unusual geometry. The author, the young German biologist Ernst Haeckel (fig. 1), had himself drawn the figures for the extraordinary copper-etched illustrations that filled the second volume.1 The gothic beauty of the plates astonished Darwin (fig. 2 ), but he must also have been drawn to passages that applied his theory to construct the descent (...) relations of these little known creatures. He replied to Haeckel that the volumes "were the most magnificent works which I have ever seen, & I am proud to possess a copy from the author."2 Emboldened by his own initiative in contacting the famous naturalist, Haeckel, a few days later, sent Darwin a newspaper clipping that described a meeting of the Society of German Naturalists and Physicians at Stettin, which occurred during the previous autumn. On September 12, 1949, the liberal politician Theodor Heuss, party leader of the „Freie Demokratische Partei“ (FDP), was elected by the Bundesversammlung (Federal Convention) as the first Bundespräsident, i. e. head of state, of the newly founded Bundesrepublik Deutschland. As a young man Heuss had been a close friend and political ally of Friedrich Naumann, the protestant pastor and left wing liberal politician, supported by Ernst Troeltsch. Heuss then working as a political journalist for liberal newspapers and Naumann’s (...) weekly journal Die Hilfe, was an admirer of Troeltsch, and since 1910 they often met in Heidelberg, at Villa Fallenstein, Ziegelhäuser Landstraße 17, where Max and Marianne Weber as well als the Troeltschs lived; Heuss frequently visited Max Weber’s Sunday jour fixe. When in 1915 Troeltsch became a professor at the Philosophical Faculty of Berlin University Heuss regularly kept in contact with him especially through Hans Delbrück’s „Mittwochabend“, a weekly gathering of liberal intellectuals, professors, politicians and journalists discussing political reforms and the ongoing war. Both Troeltsch and Heuss, 19 years younger, demanded the democratization of the Deutsches Reich, and after the end of the war and the revolution of 1918/19 they became members of the newly founded left wing liberal party „Deutsche Demokratische Partei“ (DDP). After Troeltsch’s sudden death on February 1st, 1923, Heuss wrote an obituary, and, together with his wife Elly Heuss-Knapp, attended the funeral service conducted by Adolf von Harnack. Heuss was a member of the „Demokratischer Klub Berlin“, founded in 1919 by liberal politicians, bankers and academics to regularly discuss the political situation of the new democratic state, the Weimar Republic. Unknown until now, seven weeks after Troeltsch’s death the „Demokratische Klub“ invited its members (the club only had male mebers!) to a memorial act for Troeltsch. On this occasion Heuss delivered a speech „Zu Ernst Troeltschs Gedächtnis“ („To the Memory of Ernst Troeltsch“) which is published here for the first time. (shrink)

Although Mach insisted that he was a scientist, not a philosopher, many of his ideas were genuinely philosophical. This collection of essays indicates, among other matters of mathematical and scientific interest, how such ideas grew from Mach's work and something of their philosophical significance. In particular, discussions of Mach's experiments in aerodynamics and psychology show how he made physical phenomena observable and applied "causal" concepts to sensory processes. Having done this, Mach felt that he could hold a phenomenalism of neutral (...) elements which are neither subjective nor objective. He thought that a unified science could be based on such elements and that he would then no longer have to change his conceptual frame in going from one discipline to another, as from "atoms" to "mind" in going from physics to biology. Young Albert Einstein was deeply impressed by Mach's attitude toward fundamental concepts. One essay discusses the influence on Einstein's theory of general relativity of Mach's Principle, i.e., Mach's substitution of the concept of motion with respect to the distant stars for the unobservable Newtonian concept of motion with respect to absolute space. A discussion of Mach's own use of the atomic theory illustrates his attitude toward theories and suggests that he was able to reject the atom because this concept is not particularly useful in the fields with which he was primarily concerned. An essay by editor Cohen on the implications of Mach's theory of knowledge argues that a phenomenalism of neutral elements collapses into mysticism, i.e., into a submergence of the ego in the universal consciousness. Also interesting is Philipp Frank's classification of Mach as an "Enlightment" philosopher, or one who criticizes the abuse of concepts. Just as the men of the eighteenth century Enlightenment opposed theological concepts in physics, so Mach opposed physical concepts in biology, thereby clearing science of old error to make way for new truth. Health care may be the most regulated industry in the United States, at least in terms of the volume of State and Federal laws and regulations that affect business practices. Lawyers who counsel health care clients often face a dilemma: is the client seeing legitimate advice about the legal limitations on his or her conduct, or is the client seeking to use the lawyer's skills to evade the law? The history of health care fraud prosecutions involving lawyers and other professional (...) advisors in recent years makes this an issue of more than academic interest. The well publicized case of U.S. v. Anderson, in which health care counsel faced charges as co-defendants for purported kickback violations, the recent prosecution of Ernst & Young for allegedly aiding Medicare fraud on behalf of client hospitals, and the recent indictment and conviction of an in-house lawyer in a national durable medical equipment fraud case, make clear that the wrongful use of legal advice by health care clients can lead to significant criminal and civil charges against attorneys. Six essays which analyze the non-national thought processes that influence culture.

Is the basis of criminality an act that causes harm, or an act undertaken with the belief that one will cause harm? The present study takes a cognitive neuroscience approach to investigating how information about an agent’s beliefs and an action’s conse- quences contribute to moral judgment. We build on prior devel- opmental evidence showing that these factors contribute differ- entially to the young child’s moral judgments coupled with neurobiological evidence suggesting a role for the right tem- poroparietal junction (...) (RTPJ) in belief attribution. Participants read vignettes in a 2 2 design: protagonists produced either a negative or neutral outcome based on the belief that they were causing the negative outcome (‘‘negative’’ belief) or the neutral outcome (‘‘neutral’’ belief). The RTPJ showed significant activation above baseline for all four conditions but was modulated by an interaction between belief and outcome. Specifically, the RTPJ response was highest for cases of attempted harm, where protag- onists were condemned for actions that they believed would cause harm to others, even though the harm did not occur. The results not only suggest a general role for belief attribution during moral judgment, but also add detail to our understanding of the inter- action between these processes at both the neural and behavioral levels. Much as Hume had awoken Kant, Aenesidemus jolted the young Fichte out of his slumbering adherence to Reinhold's formulation of Kant's philosophy, leading him to re-evaluate the claims, methods, and foundations of the Critical philosophy. Continued failure to limit emissions of carbon dioxide and other greenhouse gases that are causing global climate change has brought increased attention to climate engineering technologies, which actively modify the global environment to counteract heating and climate disruptions caused by elevated greenhouse gases. Some proposed forms of CE, particularly spraying reflective particles in the upper atmosphere to reduce incoming sunlight, can cool the average temperature of the Earth rapidly and cheaply, thereby substantially reducing climate-related risks. Yet CE interventions provide only (...) imperfect corrections for the climatic and other environmental effects of elevated greenhouse gases, and carry their own environmental risks. Moreover, they may also increase other risks, by weakening political support for essential emissions reductions or providing new triggers for international conflict. These technologies thus require international governance, but also pose novel and severe challenges to current international laws and institutions. Effective governance of CE will require a capacity to make decisions regarding the conditions, if any, under which specific interventions are authorized, plus realtime operational oversight of any interventions that are conducted. Decision processes must be effectively linked with scientific research and assessment, and with institutions to manage and respond to threats of CE-related conflict. We advance preliminary suggestions to address two priority areas for early investigation: how international cooperation on early CE research can help develop shared norms that can grow robust enough to support future decision needs; and how early research and development on CE can be made to complement and encourage, rather than undermine, parallel efforts to reduce climate risks by cutting emissions. Young and Karel W. de Pauw Keywords: delusions, Cotard delusion, Capgras delusion, cognitive neuropsychiatry. WE WELCOME THE OPPORTUNITY to offer our reflections on Philip Gerrans' interesting paper. Our opinion is that on fundamental issues we agree quite a bit—but there are clear differences when it comes to details.The most basic (...) issue concerns the nature of the enterprise. Like Gerrans, we think that it is possible to create testable accounts of the formation and maintenance of what would otherwise seem bizarre and inexplicable delusions, and that these accounts should be grounded in theoretical models of factors that underpin our everyday perception and reasoning. This general approach certainly forms part of what has been called cognitive neuropsychiatry. However, we disagree with Gerrans in that we see cognitive neuropsychiatry as an attempt to draw on the underlying logic of cognitive neuropsychology, rather than (as Gerrans implies) its current methods. The underlying logic of cognitive neuropsychological approaches has been to try to understand the effects of brain injury in terms of disruption of different components of theoretical models of normal abilities. In this approach, a model of normal performance is tested by its ability to account for the effects of brain injury. Where the model of normal performance also provides a convincing account of brain injury it is retained, and when it fails to account for effects of brain injury, it is revised or abandoned. In cognitive neuropsychiatry, the key theoretical move has been to argue that an adequate model of normal performance should be able to account for any disordered pattern (Ellis and Young 1990). The same logic of seeking to explain disordered performance by reference to models of normal function is then attempted, but for disorders that would usually fall within the province of psychiatry.In our opinion, however, cognitive neuropsychiatry will not simply involve importing the methods of cognitive neuropsychology into the new domain; they will need to be developed and adapted to fit the new agenda (Young 2000).In cognitive neuropsychology, progress has often come from the careful investigation of people with stable, selective deficits of fundamental cognitive functions involved in sensory analysis, memory, and verbal or motor output. In contrast, delusional beliefs can be relatively unstable; often they are only held for a few weeks or even days. When the delusions change, patients may modify or abandon them as suddenly as they seemed to form them, or they may give them up much more slowly and reluctantly. At the very least, this creates difficulties in the timing of investigations and in interpreting the relation of deficits and symptoms, which may be recorded on separate dates. These methodological problems [End Page 55] are exacerbated by the fact that deficits linked to complex abnormal experiences such as delusions may be multifaceted and diffuse, even when the delusions themselves have a specific content or theme. Such complications do not invalidate cognitive neuropsychiatry, but they do mean it will need to develop its own methods for dealing with them and making appropriate inferences.One of the key complexities that has surfaced already involves the idea that delusional beliefs might reflect the interaction of two or more contributory factors. Gerrans discusses a particular variant of this idea, which had been suggested by Young and Leafhead (1996) as an approach to understanding the Cotard delusion: The Cotard delusion represents a depressed person's attempt to account for abnormal perceptual experiences. It follows that the delusion is based on an unfortunate interaction between different contributory factors. Als ich meine Schrift "Zur Einsteinschen Relativitätstheorie" veröffentlichte, fanden sich viele Kritiker, die mir in den Schlußfolgerungen, die ich aus der Entwicklung der neuen Physik gezogen hatte, zwar zustimmten, die aber an diese Zustimmung die Frage knüpften, ob ich, als "Neu-Kantianer", derartige Folgerungen hätte ziehen dürfen. Die vorliegende Schrift ["Determinismus und Indeterminismus in der modernen Physik"] wird vielleicht in noch weit höherem Grade solchen Fragen und Zweifeln ausgesetzt sein. Aber ich glaube, daß derartige Einwände das Wesen und die historische Tendenz (...) des "Neukantianismus", wie er von den Begründern der "Marburger Schule", von Hermann Cohen und Paul Natorp verstanden worden ist, verkennen. Natorp hat in einem Aufsatz "Kant und die Marburger Schule" ausdrücklich erklärt, daß es niemals die Meinung der "Marburger Schule" gewesen sei, an den Lehrsätzen Kants unbedingt festhalten zu sollen oder zu wollen. "Die Rede von einem orthodoxen Kantianismus"- so betont er - "war niemals begründet; sie hat mit der Weiterentwicklung der Schule auch jeden fernsten Schein von Berechtigung verloren" [Auszug aus dem Buch].
