In Latin America there are two models of constitutions - the liberal and the most stable Constitution of the Argentine Nation, drafted in 1853, (which was discussed in our previous article) and one of the most radical, comprehensive and unstable – the Constitution of the United Mexican States of 1917. Although both of them were constructed under the model of the US constitution with the influence of Spanish and French constitutionalism and local national traditions, the Argentine constitutionalism has developed on (...) the grounds of the American legal system, as the Mexican one still could not break with the civil law tradition. This paper examines the relationship between corporate social responsibility and financial performance for Islamic banks in the Gulf Cooperation Council region over the period 2000–2014 by generating CSR-related data through disclosure analysis of the annual reports of the sampled banks. The findings of this study indicate that there is a significant positive relationship between CSR disclosure and the financial performance of Islamic banks in the GCC countries. The results also show a positive relationship between CSR disclosure and the future financial (...) performance of GCC Islamic banks, potentially indicating that current CSR activities carried out by Islamic banks in the GCC could have a long-term impact on their financial performance. Furthermore, despite demonstrating a significant positive relationship between the composite measure of the CSR disclosure index and financial performance, the findings show no statistically significant relationship between the individual dimensions of the CSR disclosure index and the current financial performance measure except for ‘mission and vision’ and ‘products and services’. Similarly, the empirical results detect a positive significant association only between ‘mission and vision’ dimension and future financial performance of the examined banks. (shrink)

A chemical substance is instantiated in the material world by a number of quantities of such substance, placed in different locations. A change of location implies a change in the net of relationships entertained by the QCS with the region wherein it is found. This fact entails changes of the ontological status of the CS, as this is not fully determined by the inherent features of the CS and includes a relevant relational contribution. How to create a computer-mediated environment which can engender a spontaneous, creative, and individualized experience such as felt presence? The Other experiment described in this paper explores the possibility of unfolding phenomenological and poetic aura of felt presence experience in a media-rich environment with liminal stimulation, (...) dosed carefully, and open to interpretation. The Ibero-American Conference is a forum for dialogue, consultation and cooperation in which the observance of human rights is an essential principle. These rights are an area of action of the Ibero-American system. The instruments adopted by the Conference and other Ibero-American instances provide political and legal indications in the field of human rights that must be developed through initiatives, actions, programmes and agendas of cooperation. Social rights deserve special attention at the Ibero-American Summits. All this should have an influence (...) on the positions of the Inter-American Court of Human Rights, particularly when it deals with cases in which are affected economic, social and cultural rights, as it has been done in the wake of recent judgments on the matter. The work of the Ibero-American system in the fields of migration and culture will be of particular interest to the Inter-American Court in determining the content and scope of the rights recognized and protected in the inter-American system. Son numerosos los valores que se atribuyen al pretérito imperfecto en castellano, de ahí que muchas gramáticas –especialmente aquellas que están dirigidas a los estudiantes de ELE- adopten un enfoque mecanicista para reflejar los diferentes empleos de este tiempo. Partiendo de esta constatación, este trabajo se propone determinar - desde un enfoque aspectual- si es posible atribuir al pretérito imperfecto un valor único del cual se desprenden sus múltiples usos; se examina, entonces, la interacción del aspecto verbal del pretérito imperfecto (...) y del aspecto léxico del predicado conjugado. Los resultados muestran que los variados usos del pretérito imperfecto en el discurso provienen de la combinación de su aspecto verbal imperfectivo y de la naturaleza semántica de los predicados así como de ciertos elementos co-textuales. Se demuestra así, por una parte, la unicidad del pretérito imperfecto y la importancia de la noción de Aspecto en los diferentes valores que puede adquirir este tiempo; por otra parte, se evita la asignación de valores, a veces, contradictorios que dificulta el estudio del pretérito imperfecto de indicativo en castellano. Sustainable development has increasingly found its way into the context of environmental legislation. Russian environmental legislation is not effective for transitioning toward sustainable development. The main obstacle is ignoring traditional environmental values, which are not properly incorporated into laws and regulations. However, rich Russian traditions and culture imply a big potential to develop environmental legislation in accordance with sustainable principles. The paper explores areas where environmental regulations should be revised and implemented with adequate legal mechanisms based on traditional values. Initially conceived as an interview with the hybrid media artist Brian Goeltzenleuchter, this text gradually took the form of a conversation on various issues regarding olfactory art and the aesthetic significance of smell. Framing the artistic uses of odours in the context of contemporary art, the paper discloses some of its foundational traits, variations, and underlying impulses. By commenting on Goeltzenleuchter’s olfactory artworks through a philosophical perspective, this contribution covers a number of subjects including the notion of atmosphere, the socio-cultural (...) values and narratives conveyed by scents, the suggestive relationship between spaces and aromas, and the phenomenology of smells as compared to the experience of sounds. Consistent with how smell perception unfolds, the dialogue flows in a form that is not rigidly structured but airy, ephemeral, and fluid, developing a sequence of insights whose aim is, rather than scrutinising a specific topic, to evoke the essence of olfactory poetics as a whole. Allí defenderé que la metafórica utilizada, engarzada con el concepto de fracaso, permite dos lecturas: una que une necesariamente naturalismo metodológico y escepticismo mitigado, y otra que no. By embracing the ontological view of vulnerability and stressing its social basis, the paper aims to clarify the role of vulnerability within human rights paradigm.Vulnerability is conceived of by the author as a heuristic notion, which works as a pillar for a general approach to some crucial challenges to human dignity. Both this heuristic notion and these challenges are regarded in the paper as hallmarks for the human rights paradigm.In order to ground this view, the coherence between “vulnerability turn” and (...) the rationale of human rights relies on a four-steps argument dealing with: (i) the denial of a necessary mismatch between the notion of vulnerability and the principle of autonomy; (ii) the appreciation of relation in human rights conceptualization; (iii) the complementarity between vulnerability, as a heuristic notion, and the principle of equality; (iv) the understanding of vulnerability as a “vehicle of empathy” not necessarily involving paternalist trends and therefore not in conflict with the empowerment purposes of human rights.The relevance of “vulnerability turn” in human rights paradigm is defended in the paper within a view of human rights as basic rights, i.e. as means to prevent or fight against those threats that seriously affect basic human needs. This paper investigates Negative Concord, arguing that it results from a systematic lexical ambiguity: the items that participate in Negative Concord ("n-words" in Laka's 1990 terminology) are ambiguous between negative polarity items and their genuinely negative counterparts. I try to show that on empirical grounds the proposed account compares favorably with other analyses that shy away from ambiguity. I furthermore suggest that the ambiguity is not implausible conceptually because it can be viewed as reflecting an intermediate stage of the Jespersen (...) Cycle. Negative Concord can be observed in many languages. The data discussed here are taken from Romance, primarily Spanish. (shrink)

This paper addresses the phenomenological experience of precarity and vulnerability in racialized gender-based violence from a structural perspective. Informed by Indigenous social theory and anti-colonial approaches to intergenerational trauma that link settler colonial violence to the modalities of stress-inducing social, institutional, and cultural violences in marginalized women’s lives, I argue that philosophical failures to understand trauma as a functional, organizational tool of settler colonial violence amplify the impact of traumatic experience on specific populations. It is trauma by design. I explore (...) this through the history of the concept of trauma and its connection to tragedy. I give a brief overview of prominent theories of trauma and contrast these with the work of Indigenous feminist scholar Dian Million (2013), who highlights functional complicity of settler colonial institutions in shaping accounts of trauma in the west. I begin the piece with an important illustration of the kinds of lives and experiences that call for a politicized understanding of trauma in anti-colonial feminist theory. I end by offering an expansive notion of structural trauma that is a methodological pivot for conducting trauma-based gender-based violence research in a decolonial context, which calls for an end to narratives of trauma that are severed from the settler colonial project of Native land dispossession and genocide. The article discusses the challenges, benefits, and risks that, from a bioethical perspective, arise because of the the development of eHealth projects. The conceptual framework of the research is based on H. Jonas’ principles of the ethics of responsibility and B.G. Yudin’s anthropological ideas on human beings as agents who constantly change their own boundaries in the “zone of phase transitions.” The article focuses on the events taking place in the zone of phase transitions between humans and machines in eHealth. (...) It is shown that for innovative practices related to digitalization and datafication in medicine, it is needed to rethink central bioethical concepts of personal autonomy and informed consent. In particular, the concept of broad or open informed consent is discussed, which allows the idea of moral responsibility in the field of biomedical technologies to be extended to events of uncertain future. The authors draw attention to the problems associated with the emergence of new autonomous subjects/agents in relationship between doctors and patients. The humanization of machines occurring in eHealth is accompanied by a counter trend – the formation of conceptions and practices of the quantified self. There emerges the practices of self-care and bio-power caused by the datafication and digitization of personality. The authors conclude that bioethics should proactively develop norms for the evolving interaction between doctor and patients. (shrink)

The paper deals with a practical approach to developing of law stu- dents’ communicative and professional competences within a one-term, optional, cross-curricular course. The author, whose principal occupation is teaching Le- gal English, was offered the opportunity to train a team of law students to take part in the national rounds of the International Client Consultation Com- petition. Since then, the author has been involved in coaching teams for law students’ competitions and the author’s three year work has resulted in (...) framing an experimental cross-curricular course “Client Consultation in English”. The background and necessity for the development of the course are outlined in the paper, along with a brief overview of teaching legal skills in Russia and general information about international competitions for law students. The basic ele- ments of the course are described, as well as the methods used by the author for training students’ teams. A similar framework is being used now for creating another cross-curricular course “Legal Negotiations in English”. (shrink)

Beginning in the late 1950s, gradually from both private and privatized official settings and differentiating from them, the informal public sphere emerged-the sphere of social practices, regulated by the unwritten codes of everyday moral economy.
