Falls are frequent in Myotonic Dystrophy type 1, but the pathophysiology of the balance impairment needs further exploration in this disease. The current work aims to provide a richer understanding of DM1 imbalance. Standing balance in 16 patients and 40 controls was tested in two posturographic tests. In the Sensory Organization Test, standstill balance was challenged by combining visual and environmental conditions. In the “react” test, reflexes induced by sudden shifts in the support base were studied. Oscillations of the body (...) centre of mass were measured. In the SOT, COM sway was larger in patients than controls in any condition, including firm support with eyes open. On sway-tuned support, COM oscillations when standing with closed eyes were larger in patients than controls even after taking into account the oscillations with eyes open. In the “react” paradigm, balance reflexes were delayed in patients. Results in both experimental paradigms are consistent with leg muscle weakness. This, however, is not a sufficient explanation. The SOT test highlighted that patients rely on vision more than controls to maintain static balance. Consistently enough, evidence is provided that an impairment of proprioceptive and vestibular systems contributes to falls in DM1. Rehabilitation programs targeted at reweighting sensory systems may be designed to improve safe mobility in DM1. (shrink)

A macroscope is proposed and tested here for the discovery of the unique argumentative footprint that characterizes how a collective manages differences and pursues disagreement through argument in a polylogue. The macroscope addresses broader analytic problems posed by various conceptualizations of large-scale argument, such as fields, spheres, communities, and institutions. The design incorporates a two-tier methodology for detecting argument patterns of the arguments performed in arguing by an interactive collective that produces views, or topographies, of the ways that issues are (...) generated in the making and defending of standpoints. The design premises for the macroscope build on insights about argument patterns from pragma-dialectical theory by incorporating research and theory on disagreement management and the Argumentum Model of Topics. The design reconceptualizes prototypical and stereotypical argument patterns for characterizing large-scale argumentation. A prototype of the macroscope is tested on data drawn from six threads about oil-drilling and fracking from the subreddit Changemyview. The implementation suggests the efficacy of the macroscope’s design and potential for identifying what communities make controversial and how the disagreement space in a polylogue is managed through stereotypical argument patterns in terms of claims/premises, inferential relations, and presentational devices. Since March 2020, many countries throughout the world have been in lockdown in response to the COVID-19 pandemic. In Italy, the quarantine began on March 9, 2020, and containment measures were partially reduced only on May 4, 2020. The quarantine experience has a significant psychological impact at all ages but can have it above all on adolescents who cannot go to school, play sports, and meet friends. In this scenario, this study aimed to provide a general overview of the perceived (...) risk related to COVID-19 and the psychological experience of quarantine in a large sample of Italian adolescents. 978 adolescents (males = 339; females = 639) living in 13 Italian regions and attending upper secondary school (age range: 13–20, M = 16.57, SD = 1.20), responded to an internet-based questionnaire about perceived health risk related to COVID-19, knowledge and information on measures to control the pandemic, beliefs and opinions on stage two of the quarantine, and psychological experiences related to quarantine. 31.1% of the participants lived in "red zones," which are places where the government has imposed stricter measures of containment due to exponential and uncontrolled growth in contagion cases compared to other areas in Italy. According to our results, Italian adolescents had a low perception of risk of COVID-19. Perceived comparative susceptibility and perceived seriousness were also very low. However, they were aware of the restriction measures necessary to contain the spread of the virus, and they agreed with the limitations imposed by the government. Females and adolescents living in a “red zone” showed more significant psychological negative feelings about the quarantine experience. However, no significant differences were found about the regions where the teenagers of our sample live and the other variables related to the COVID-19 experience. This is very interesting data, leading us to hypothesize that the participants' negative feelings may be more related to the adolescent period than to the pandemic itself. (shrink)

A change of location implies a change in the net of relationships entertained by the QCS with the region wherein it is found. This fact entails changes of the ontological status of the CS, as this is not fully determined by the inherent features of the CS and includes a relevant relational contribution. As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). It is significant as it is one of only a small number of surviving commentaries by Ibn Sīnā and offers crucial insights into not only his attitudes towards his predecessors, but also his own philosophical positions — especially with regard to the human intellect's connections to God and the cosmos — and his attempt to develop a distinctive mode of commentary.

Fictions feature prominently in several of Hume’s important arguments about the external world. For example, Hume is clear that there would be no belief in the continued existence of objects, were it not for the fictions that are causally responsible for effecting this belief. Interpreters of Hume on the topic of fiction generally argue that the formation of fiction requires the possession of general ideas and the use of language. Drawing upon recent attempts in the literature to advance this claim, (...) I offer reasons for why this general approach is undesirable. By examining Hume’s comments on the capabilities of children, this paper advances a novel approach to the topic of fictions in Hume’s philosophy that separates the matter of fiction formation from the use of language, arguing instead that it is not the use of language that establishes fictions; fictions exert their influence upon the mind before the use of language becomes available to us. This essay discusses the ethical challenges and dilemmas in allocating scarce medical resources during the COVID-19 pandemic, using the German legislative process as a starting point. It is guided by the right to non-discrimination of people with disability and generally contrasts utilitarian and rights-based principles of allocation. Three approaches that were suggested in the German discussion, are presented, the lottery principle, the first come first served principle and the probability to survive principle. Arguments in favour and against each principle are (...) discussed. The focus is on the utilitarian probability to survive principle, which was adopted in German legislation in 2022, and its discriminatory potential against people with disability. The essay suggests ways to mitigate the concerns of discrimination related to the probability to survive principle. It concludes that resolving the triage dilemma requires a balanced approach between utilitarian and rights-based concerns, which promotes both maximising the number of patients surviving and the right not to be discriminated against and be treated equally. It calls for a further debate on how many ethical values such as equity, fairness and non-discrimination we are willing to sacrifice for a higher number of survivors and when we are willing to sacrifice survivors to secure ethical values. Concerning race and its intertwinements with gender, sexual orientation, class, accents, or ability there is a scarcity of social psychological research in Europe. With an intersectional approach studying racism in Europe it is possible to detect specific experiences of discrimination. The prevalent understanding of European racism is connected to migration from the former colonies to the European metropoles and the post-Second-World-War immigration of ‘guest workers.’ Thus, the focus of this research is on work-related discrimination. Against the background of a short (...) historical review, we present the results of the few existing studies on intersectional discrimination within the labor market in Europe and discuss their implications. The pattern of findings is more complex than the assumption that individuals belonging to two or more marginalized social categories are always the most discriminated ones. Gender, sexual orientation, and origin rather interact with the specific job context. These interactions determine whether minority individuals are discriminated against or even preferred over individuals belonging to the majority group. We argue that considering the stereotype content model and social-identity theory helps to structure the sometimes contradictory results of intersectionality research. Therefore, the review presents new perspectives on racism in Europe based on current research, develops hypotheses on the interplay of intersecting identities, and identifies four novel research questions based on racist attributions considering situational variables: These are the role of concrete job contexts in explaining discrimination, the influence of different stereotypes regarding marginalized groups, the explanatory value of sexual orientation as well as class or socioeconomic-status and age in terms of some patterns of results. The aim of this article is to describe the basic parameters of a value-oriented approach to assessing the education results as a possible basis for the methodology for assessment of the educational work in the general system of education. The key methods we used were content analysis of text sources, cross-reference analysis, comparative analysis, and humanitarian examination of juristic documents. The interpretation of education as a unity of teaching and upbringing for the state as a key subject of education, which (...) forms the requirements for the results and organization of the educational process, sets the task of assessing personal, subject and metasubject educational results. The philosophy of education faces a challenge regarding the determination of the expediency of assessing educational results, the conceptual basis of assessment, fixing the orientation of assessment on the conditions of educational organzations' activities, and on the results achieved by students. A practical managerial task is to develop an attitude towards using formalized procedures and methods for assessing educational results. The article proposes a value-oriented approach to assessing the educational work in the general education system of the Russian Federation based on an analysis of key regulatory documents of the Russian education system, the interpretation of upbringing as a process of forming value-semantic attitudes. The approach is based on identifying three main groups of value orientations to build a possible system of indicators that fix educational results: "Value orientations related to life, health and safety"; "Value orientations of social interaction"; "Value orientations of personal development". Values are an essential element in regulating human behavior, which guides the process of defining goals and choosing the means to achieve them. Values acquire a functional character in value orientations and can serve as indicators of education results at the level of students as a collective subject. It seems impossible to single out the contribution of individual actors to the output of education and to avoid contradictions between the value-semantic attitudes that exist in the space of modern culture. For the education system, the subject of assessing the quality of upbringing as a purposeful process can be both the quality of the organization of upbringing work and the outcomes of upbringing efforts. The results of education as a manifestation of value orientations in the activities of students can be considered based on quantitative and qualitative indicators, which is significant for making managerial decisions at different levels. Ganeri's [2018] discussion of mental time travel and the self focuses on remembering the past, but has less to say with respect to the status of future-oriented mental time travel. This paper aims to disambiguate the relation between prospection and the self from the framework of Ganeri's interpretation of three Buddhist views—by Buddhaghosa, Vasubandhu, and Dignaga. Is the scope of Ganeri's discussion confined to the past, or is there a stronger assumption that future thought always entails self-representation? I argue that (...) if mental time travel towards the past and towards the future are continuous, both past and future thought should be possible independently of self-representation. An assumption of discontinuity however would enable the employment of the self as one of the defining differences between remembering the past and imagining the future. The two options can be further contrasted on the basis of distinct ways of constructing past/future scenarios (field vs. observer perspective), modes of experiencing time (known vs. lived), and the origin of mental time travel (episodic vs. semantic memory). I further assess the compatibility of future-oriented thought with the three Buddhist views on the basis of these coordinates. (shrink)

This paper discusses von Wright's theory of causation from Explanation and Understanding and Causality and Determinism in contemporary context. I argue that there are two important common points that von Wright's view shares with the version of manipulability currently supported by Woodward: the analysis of causal relations in a system modelled on controlled experiments, and the explanation of manipulability through counterfactuals - with focus on the counterfactual account of unmanipulable causes. These points also mark von Wright's departure from previous action-based (...) theories of causation. Owing to these two features, I argue that, upon classifying different versions of manipulability theories, von Wright's view should be placed closer to the interventionist approach than to the agency theory, where it currently stands. Furthermore, given its relevance in contemporary context, which this paper aims to establish, I claim that von Wright's theory can be employed to solve present problems connected to manipulability approaches to causation. In this paper, I propose a logical-cognitive approach to argumentation and advocate an idea that argumentation presupposes that intelligent agents engaged in it are cognitively diverse. My approach to argumentation allows drawing distinctions between justification, conviction and persuasion as its different kinds. In justification agents seek to verify weak or strong coherency of an agent’s position in a dialogue. In conviction they argue to modify their partner’s position by means of demonstrating weak or strong cogency of their positions before a (...) ‘rational judge’. My approach to argumentation employs a ‘light’ version of Dung’s abstract argumentative frameworks. It is based on Stich’s idea of agents’ cognitive diversity the epistemic aspect of which is argued to be close to Pavilionis’s conception of meaning continuum. To illustrate my contributions I use an example based on the Kitchen Debate (1959) between Khrushchev and Nixon. (shrink)

This article examines how specific realist and projectivist versions of manipulability theories of causation deal with the problem of objectivity. Does an agent-dependent concept of manipulability imply that conflicting causal claims made by agents with different capacities can come out as true? In defence of the projectivist stance taken by the agency view, I argue that if the agent’s perspective is shown to be uniform across different agents, then the truth-values of causal claims do not vary arbitrarily and, thus, reach (...) a satisfactory level of objectivity. My argument connects Price’s considerations on the situation of deliberation, whose structure, common to all agents, is the same with respect to both decision making and causal claims on a concept inspired by Douglas’s classification of objectivity of thought processes: the perspective of the detached agent. I further argue that, despite his agent-independent concept of intervention, Woodward’s claim of a stronger objectivity standard cannot be achieved, as the relativity of causal concepts to a variable set brings about the issue of the agent’s choice of variables. Consequently, a more permissive objectivity standard applies to both views. (shrink)

Russians and Westerners access, process and communicate information in different ways. Whilst Westerners favour detailed analysis of subject matter, Russians tend to focus on certain components that are, in their view, significant. This disparity makes it difficult to achieve constructive dialogues between Western and Russian stakeholders contributing to cross-cultural communication problems. The author claims that the difference in the ways Russians and Westerners negotiate information is a significant cultural difference between Russia and West rather than an irritating (and in principle (...) amenable) lack of analytical skills on the Russian partners’ part. Understanding the reasons behind the Russian-specific approaches to dealing with information would be a positive step towards a more effective cross-cultural communication, important in business situations and essential in diplomacy. This study explores the use of deictic gestures, vocalizations and words compared to content-loaded, or representational gestures and words in children’s early one- and two-element utterances. We analyze the spontaneous production of four children, observed longitudinally from 10–12 to 24–25 months of age, focusing on the components of children’s utterances, the information encoded, and the temporal relationship between gestures and vocalizations or words that were produced in combination. Results indicate that while the gestural and vocal modalities are meaningfully and temporally (...) integrated form the earliest stages, deictic and representational elements are unevenly distributed in the gestural vs. the vocal modality, and in one vs. two-element utterances. The findings suggest that while gestural deixis plays a primary role in allowing children to define and articulate their vocal productions, representational skills appear to be markedly more constrained in the gestural as compared to the vocal modality. El presente artículo tiene como objetivo reconstruir la ética de la resistencia que Nietzsche propone en _El Anticristo _partiendo de la imagen que se ofrece en el prólogo a modo de declaración de intenciones: “preferible _vivir en medio del hielo_”. Dicha ética le exige al individuo la superación de la psicología de la convicción o de la fe y recurre, como método, a la Filología entendida como “_ephexis _en la interpretación”. La apropiación nietzscheana de ese término procedente del pirronismo obliga (...) a medir la utilidad de las enseñanzas escépticas para un individuo que aspira a autorrealizarse, _a llegar a ser el que es_. Con este fin ha de poner entre paréntesis los lugares comunes y asegurarse una posición hermenéutica propia que quiere evitar la_ des-simismación_ y que renuncia, por ello, a implicarse en la rutina democrática de las sociedades modernas. En sintonía con la sensibilidad pirrónica que anima a cultivar la distancia y la indiferencia, se acabará mostrando, en primer lugar, que Nietzsche se dirige exclusivamente a una comunidad de lectores afines y que, en segundo lugar, suspende la vocación política de su propuesta. The famous dispute between Protagoras and Euathlus concerning Protagoras’s tuition fee reportedly owed to him by Euathlus is solved on the basis of practical argumentation concerning actions. The dispute is widely viewed as a kind of a logical paradox, and I show that such treating arises due to the double confusion in the dispute narrative. The linguistic expressions used to refer to Protagoras’s, Euathlus’s and the jurors’ actions are confused with these actions themselves. The other confusion is the collision between (...) the pairs of incompatible actions ambiguously expressed by two different pairs of sentences, one of which is a propositionally consistent pair whereas the other is an inconsistent one. The actional paradox solution aims to clear up these confusions by means of two core borderlines, propositional and expressive, drawn between the actions and the propositions. The propositional distinction says that actions are empirical facts and they lack truth values unlike propositions, which are mental entities and are often employed for referring to the actions. This distinction helps to avoid the confusion between the empirical incompatibility of actions and the truth-functional inconsistency of propositions. The expressive distinction claims that although the same linguistic sentences can be used to refer both to actions and propositions, two empirically incompatible actions can be expressed both by a pair of inconsistent propositions as well as by a pair of consistent ones. Therefore, the action of Protagoras’s being paid may be linguistically symbolized in four different ways: Protagoras gets paid due to the verdict, Protagoras gets paid due to the contract that amount to Protagoras does not get paid by the contract and Protagoras does not get paid by the verdict respectively, and likewise for Euathlus’s actions. The two distinctions are used for classifying the two groups of paradox solutions, legal and logical, proposed so far depending on which of the two confusions they purport to escape from. The actional reconstruction of the paradox suggests that there is only one single agent in the dispute, Protagoras, while the other named Euathlus is a ‘phantom,’ which most probably was invented by Protagoras himself for the sake of creating this challenging sophism. Providing insights into the interrelation between scientific and religious belief, this work covers features of belief in general and discusses distinctive properties between belief, knowledge and acceptance. These properties are considered in relation and comparison to religious belief.".

I argue that, for Aristotle, virtues of character like bravery and generosity are, like the emotions, properties that require a hylomorphic analysis. In order to understand what the virtues are and how they come about, one needs to take into account their formal components and their material components. The formal component of a virtue of character is a psychic disposition, its material component is the appropriate state and composition of the blood. I defend this thesis against two potential objections and (...) I show that it is relevant for a study of Aristotle’s ethics. (shrink)

The debate on the right to be forgotten on Google involves the relationship between human information processing and digital processing by algorithms. The specificity of digital memory is not so much its often discussed inability to forget. What distinguishes digital memory is, instead, its ability to process information without understanding. Algorithms only work with data without remembering or forgetting. Merely calculating, algorithms manage to produce significant results not because they operate in an intelligent way, but because they “parasitically” exploit the (...) intelligence, the memory, and the attribution of meaning by human actors. The specificity of algorithmic processing makes it possible to bypass the paradox of remembering to forget, which up to now blocked any human-based forgetting technique. If you decide to forget some memory, the most immediate effect is drawing attention to it, thereby activating remembering. Working differently from human intelligence, however, algorithms can implement, for the first time, the classical insight that it might be possible to reinforce forgetting not by erasing memories but by multiplying them. After discussing several projects on the web which implicitly adopt this approach, the article concludes by raising some deeper problems posed when algorithms use data and metadata to produce information that cannot be attributed to any human being. The question of how democracy can deal with cultural diversity has become more central than ever. The increasing flow of people to many Western democratic countries indicates that our societies will become more and more multicultural. But what is the best way for democracy to deal with cultural diversity? It has been argued that, given its communicative core, the Habermasian model of deliberative democracy provides a platform where cultural groups can concur on peaceful agreements. In this paper, I show the (...) limits of this model of democracy in relation to diverse cultural traditions to public interactions. I will discuss the case of societies and ethnic groups of a Confucian heritage and show that Habermas’ account of public deliberation is not a neutral method for facilitating political decision making, but is culturally biased. With the birth of the feminist movement classicists, philosophers, educational experts, and psychologists, all challenged by the question of whether or not Plato was a feminist, began to examine Plato's dialogues in search of his conception of woman. The possibility arose of a new focus affecting the view of texts written more than two thousand years in the past. And yet, in spite of the recent surge of interest on woman in Plato, no comprehensive work identifying his position on the (...) subject has yet appeared. This book considers not only the totality of Plato's texts on woman and the feminine, but also their place within both his philosophy and the historical context in which it developed. But this book is not merely a textual study situating the subject of woman philosophically and historically; it also uncovers the implications hidden in the texts and the relationships that follow from them. It draws an image of the Platonic woman as rich and full as the textual and historical information allows, offering new and sometimes unexpected results beyond the topic of woman, illuminating aspects of Plato's work that are of relevance to Platonic studies in general. We use the analogy between the medicine and the judiciary for demonstrating these issues. The analogy involves two groups of norms governing the activities of judges – the norms of competence and the norms of conduct which (...) we interpret as the actional and the practical aspects of the ancient art of healing. The actional aspect is similar to the norms of competence of a judge and sets the goal for the art of healing – restoring patient’s health, and defines a physician as a person who is publicly allowed to pursue this goal in his professional activities. The practical aspect is reminiscent of the judges’ norms of conduct and it outlines the terms and techniques which lead to achieving this goal by those who are considered physicians, according to the norms of competence. In order to become a real tekhne, it is necessary and sufficient for the art of healing to secure its actional and practical aspects in the body of theoretical knowledge, on the one hand, and in the appropriate professional code, on the other. Practical argumentation serves as the tools of this implementation, for it allows to combine the norms and actions in a set of strategies of conduct, aimed at restoring patient’s health, of which the physisian is now free to chose the one that appear to be the most effective. The article deals with Aristotle’s conception of ‘place’, which is of cruсial importance for his theory of motion. It is shown that in the physics of Aristotle there is no concept of spасe; instead, there is the notion of ‘place’ of a body. Aristotle considered ‘place’ as the first boundary of a body embracing the body in question. The author shows the incommensurability between the spatial ideas of the Stagirite and the similar ideas of Newtonian physics. The article states that (...) in order to give an adequate reconstruction of Aristotle’s concept of ‘place’ we need to take into account two different levels of consideration: local and global. Places locally separable cannot be separated on the global level. In Newtonian physics, bodies are separable from places on both levels. The nature of parallelism of ideas between Aristotle’s conception of ‘place’ and the notions of space in present-day physics is analysed. (shrink)

But nothing could be further (...) from the truth. The articles were of such density and their content of such profundity that it took months of interpretation and study, and of bringing my own knowledge up to date, before I was in a position to understand the concepts, adjust my beliefs, and make some comments. I could certainly have delivered some kind of eulogy about the brilliance of their content; I might have countered with my own article. However, what seemed most coherent to me was to meet their arguments head on and deal with what I consider to be their principal weaknesses, leaving the bouquets for the end.The articles set out, as I understand them and within the clinical context, to relate phenomenology, in its most traditional form, with the most current form of Skinnerian behaviorism, situating themselves in a contextualism that is, at the same time, close to and removed from the most radical type of social constructionism.But let us begin by looking more closely at “Phenomenology and Behaviorism.” It is novel for me, though Professor Pérez-Álvarez had already proposed it several years ago (Pérez-Álvarez 1992), to view operant behavior as intentionality, or at least as involving final causality according to the Aristotelian classification. It is a surprising contention, not least because, as I recall, Skinner lived in a time and a context (historical reason) in which the basic goal of psychology was to convert itself into a natural science, comparable in all respects to physics, which it took as a model, focusing therefore on efficient causality (also according to Aristotle’s terminology), so that behavior was considered as the immediate consequence of a stimulus, and the stimulus–response association became the cornerstone of the discipline. It is true that the operant behavior concept refers to the functional relationship between behavior and reinforcement, but it is no less true that Skinner’s definition of reinforcement is totally empirical—“all that which increases or decreases the probability”—meaning that reinforcement can be considered neither as a motive nor as a reason for behavior, unless it be in the eyes of the observer. [End Page 251]Furthermore, even though Yela (1987) refers to Ortega y Gasset’s formula “I am myself and my circumstances” as a Skinnerian approach, the truth is that Yela himself argues that it is precisely the self that constitutes personality, such that I have a personality because I am me, and not vice versa, as Skinner would appear to argue. In this regard, Ortega’s celebrated formula has generally been interpreted, from the most personalist perspectives, as “the circumstances are myself”—to highlight the denial of the psychological subject by radical behaviorism (Mischel’s [1968] criticism of the concept of personality is relevant here). On top of this, Skinner’s rejection of all that was not directly observable, or at least, that could not be operationalized, calls into question the admissibility of anything called final cause or intentionality of behavior. In his philosophy, all the indications are that contingencies are what determine behavior; and that there would be no room for a structural causality, as Althusser would argue, or of a reciprocal determinism, in Bandura’s terms, or even of an interaction between subject and environment, as modern interactionists would maintain. “I am myself and my circumstances” seems in Skinner to become “the circumstances are me”, and indeed, the reinforcement history – which in the article in question is considered as something akin to the Sartrian idea of “life project” – is for Skinner nothing more than a continuous association of events. In my view, Ortega’s perspectivism would perhaps be closer to the sociology of the American action theorists, Merton, Parsons, etc., than to Skinnerian behaviorism, since “action”—as the action theorists... KrausIntroductionThe personal stories submitted by physicians and researchers for this symposium add much–needed dimension to conversations on conflicts of interest in medicine and research. Narratives from individuals living with conflicts of interest can serve as a unique lens through which to consider psychological and economic theories and survey data on (...) physician and patient views. In our reading of these personal narratives, we identified four primary themes that will serve as springboards for our commentary. We aim to triangulate clusters of meaning drawn from the narratives with relevant data from published empirical studies and identify gaps in knowledge where more research is needed. These themes are: the unique environments of medicine and research; weighing the potential benefits of conflicts of interest against the risks; conflict of interest management; and the roles and responsibilities of diverse stakeholder groups.The Unique Challenges of the Medical and Research EnvironmentsThe reflections of the narrative authors draw attention to many of the unique environmental aspects of medicine and medical research that make physicians and researchers especially vulnerable to conflicts of interest. Conflicts of interest may be more ubiquitous in medicine than in any other industry (Kassirer, 2006). As the narratives demonstrate, conflicts of interest emerge across a range of health care delivery and research activities. Surveys have shown that 94 percent of physicians have some kind of relationship with industry (Campbell, Gruen, Mountford, et al., 2007). There is also evidence that physician interactions with medical industry begin early and are a regular part of a physician’s professional practice along the career continuum (Wazana, 2000).Medicine as a profession is distinct from banking or law. It is often said that medicine is an art; in treating patients, creative individualized solutions and gut instinct are as (if not more) important than the application of scientific knowledge. Uncertainty surrounds medical decision making. There is limited precision with respect to diagnoses and prognoses, limited data regarding the effectiveness of many treatments, and a range of patient values and preferences. Because of this uncertainty, rules about practice standards, especially with respect to avoidance and management of conflicts of interest, cannot be as explicit as they are in law or business. As demonstrated by the story presented by Sal Cruz–Flores, research and practice often intersect. And, there is no system in greater need of reform—and no system about which there are more divergent opinions as to what shape that reform should take—than the United States health care [End Page 91] system. The narratives of Tony Mikulec, Govind Nagaldinne, and David M. Zientek demonstrate how various aspects of the structure of healthcare service provision and third–party payer arrangements have the potential to harm patients. Conflicts of interest comprise more than relationships with pharmaceutical and medical device manufacturers.The narratives of Laura Jean Bierut and David M. Zientek also discuss examples of conflicts of interest that arise from factors beyond relationships with industry or the direct potential for financial gain. This may be somewhat unique to the medical milieu. Non-financial conflicts such as a desire for the prestige bestowed upon scientists who make key discoveries, a requirement to publish for tenure and promotion, the need to maintain one’s license or other privileges, or simply the pressure of a competitive environment can influence physician and researcher behavior. The subject of the analysis of this paper is the Andean civilization view by the Peruvian author of the XVI century Felipe Guaman Poma de Ayala, a Quechua Indian by origin, who became a Catholic monk, as well as a translator and mediator between two civilizations: European, personalized by Spanish administration and Catholic Church present in the conquered lands, and Andean civilization, represented by local population speaking native Quechua and other Native American languages. The collision of two worlds is clearly (...) visible in the Chronicle «El primer nueva corónica y buen gobierno», which belongs to this author. This literary monument is an invaluable document because it describes in Medieval Spanish a disappearing world left behind, due to the lack of writing, having only artifacts of material culture and proto-hieroglyphic recording tools. The main methods of this research – analysis, synthesis, generalization. Analyzing the statements of the author of the Chronicle, who is trying to reconcile the two worlds, it is possible to recreate the panorama of the life of Andean society of that era and the sociolinguistic situation developed in it. The novelty of the study can be considered the combination of cultural and sociolinguistic approaches in the analysis of the material. The conclusion reached by the authors of the article is that the death of the Andean civilization was inevitable under the onslaught of the European one. But the Andean world, native languages and culture have not disappeared, and today are being revived, since the Peruvian society has formed a request to restore the social functions of native languages in full. RESUMEN: La labor del Tribunal Penal Internacional para la Ex-Yugoslavia tuvo un momento importante en la compresión del principio de legalidad, como principio básico en la garantía de los derechos humanos, al enfrentar no sólo el derecho consuetudinario como fuente de derecho sino también diferentes modos o enfoques en la identificación de este derecho consuetudinario. Esta relación debe ser analizada a la luz de las limitaciones que tiene el derecho internacional y, sobre todo, de los procedimientos de creación de normas. (...) No resulta fácil exigir responsabilidad en el cumplimiento del derecho internacional humanitario y de los derechos humanos. La práctica de este Tribunal abre una vía para la reflexión con la finalidad de asegurar el respeto de los derechos humanos en cualquier circunstancia, incluso de aquellos que llevaron a cabo la comisión de graves crímenes contra la comunidad internacional.ABSTRACT: The work of the International Criminal Tribunal for the former Yugoslavia was important for understanding the principle of legality as a key principle on the guarantee of Human Rights. The former was due to the Tribunal’s work on having faced the customary law as a source of law using different perspectives for its identification. The link between customary law, principle of legality and human rights has to be analyzed taking in account the limits of International law and the procedures for creating legal norms. It is not easy to invoke responsibility in the fulfillment of international humanitarian law and international law of human rights. The practice developed by this Tribunal provides an avenue for thinking about ensuring the respect of the human rights in any case including the commission of grave crimes against international community. Herzen’s type of socialism appears to be a specific variant of the Russian national culture as the Slavophiles depicted.
