It is well-known that the invocation of `equilibrium processes' in thermodynamics is oxymoronic. However, their prevalence and utility, particularly in elementary accounts, presents a problem. We consider a way in which their role can be played by sets of sequences of processes demarcated by curves carrying the property of accessibility. We also examine the vexed question of whether equilibrium processes are necessarily reversible and the revision of this property in relation to sets of sequences of such processes.

The Boltzmann and Gibbs approaches to statistical mechanics have very different definitions of equilibrium and entropy. The problems associated with this are discussed and it is suggested that they can be resolved, to produce a version of statistical mechanics incorporating both approaches, by redefining equilibrium not as a binary property but as a continuous property measured by the Boltzmann entropy and by introducing the idea of thermodynamic-like behaviour for the Boltzmann entropy. Simple models have played an important role in the discussion of foundational issues in statistical mechanics. Among them the spin-echo system is of particular interest since it can be realized experimentally. This has led to inferences being drawn about approaches to the foundations of statistical mechanics, particularly with respect to the use of coarse-graining. We examine these claims with the help of computer simulations.

Recent studies revealed how the reference to Zhuangzi played a determining role in the evolution of Heidegger’s thinking. Among the sources is a work written in 1945 under the title _Country Path Conversations_. The last of these conversations presents strong similarities with another between Confucius and Yan Hui, imagined by Zhuangzi at the beginning of the fourth chapter. Analogies between these two conversations are so numerous that it is surprising that it has not been noticed until now. However, the establishment (...) of this rapprochement is crucial. It might show how deep is the echo that Heidegger acknowledged between his work and the Lao-Zhuang perspective. Moreover, it reveals that this resonance is not limited to the themes of the “path” and the “letting be,” but also concerns the essential problem of evil and the way to face it. (shrink)

This article concerns kime, a somatic code used in the ‘empty hand’ Japanese martial art of karate. Kime is a tactile-kinesthetic entity born out of practice, coming into being in a social setting through the specific organization of the body-self, fusing body and self into one stance and movement. Kime is entirely embodied, yet can only be operated and recognized inter-subjectively. It plays a crucial role in combat and at the same time also indicates a spiritual possibility that depends on (...) eradication of emotion and volition. An analysis of kime shows how cultural understandings can emerge without necessarily using symbolic representations or verbal discourse in their construction. These somatic non-dual understandings can come to form an entire world-of-meaning directly through the moving body. The moving body shapes itself within itself even as it interacts with and contributes to shape its immediate environment. This is a world-of-meaning that includes complex inter-subjectivity founded on the speed and ambiguity of the interface between the innerness and the outerness of the body. (shrink)

In this paper I examine Wittgenstein’s appeals to madness in On Certainty in light of Foucault’s Histoire de la folie. A close look at these works, usually conceived as disparate, belonging to entirely different schools of thought, reveals they actually have much in common. Both can be read as investigations into the grounds of reason, and while they offer quite different and distinct perspectives on the matter, they share some central insights. In both we find that the boundaries of reason (...) are not only vague but also largely founded upon the relations - social in Foucault, socio-linguistic in Wittgenstein - between the reasonable person and the unreasonable person. Both perspectives reveal a curious state of affairs whereby the reasonable person is the one who dominates discourse, and yet, in his claim for reason, remains forever dependent upon the unreasonable person and his rejection. The pressing question triggered by Foucault's account is whether the boundary between reason and unreason is at all necessary. This undermines Wittgenstein’s thesis that this boundary is a matter of logical necessity upon which discourse depends. I flesh this point out in the paper also by examining the differences in Wittgenstein’s and Foucault’s treatments of Descartes’ Meditations. I conclude that Wittgenstein’s criticism of Cartesian skepticism presented in On Certainty loses much of its fortitude once examined in light of Foucault's Histoire de la folie. (shrink)

At a time when trade union activity is becoming more global, the article provides a theoretical framework that places a moral obligation on unions towards work migrants from the time they take a first step in the direction of movement, and continuing after they enter the receiving country and throughout the period of their work. The argument is based on theories of global justice and offers a three-axis framework that enables a complex analysis of union responsibility: direct and political responsibility, (...) labour connectedness and solidarity. The moral obligation of unions stemming from global justice differs from the citizenship-based model or that of human rights. Its basis is global. Such an obligation should be recognized by various institutions, including the courts, thereby adding a global dimension to rights relating to collective action, such as the right to unionize, the right to collective bargaining and the right to strike. The article analyses the ECJ’s decisions in the Viking and Laval cases, showing how the court failed to recognize this global dimension, and claiming that if such recognition were to be extended, a more accurate balance could be achieved between rights relating to collective action and economic interests in an era of globalization. Traumatic brain injury (TBI) is a major cause of death and disability in Western society, and often results in functional and neuropsychological abnormalities. Memory impairment is one of the most significant cognitive implications after TBI. In the current study we investigated procedural memory acquisition by observational training in TBI patients. It was previously found that while practicing a new motor skill, patients engage in all three phases of skill learning–fast acquisition, between-session consolidation, and long-term retention, though their pattern of learning (...) is atypical compared to healthy participants. A different set of studies showed that training by observing a motor task, generally prompted effective acquisition and consolidation of procedural knowledge in healthy participants. The aim of our study was to (i) evaluate the potential benefit of action observation in TBI patients. (ii) Examine the possibility of general improvement in performance between the first (24 h post-training) and second (2 weeks post-training) stage of the study. (iii) Investigate the link between patients’ ability to benefit from observational learning (viaperformance gains–speed and accuracy) and common measures of injury (such as severity of injury, functional and cognitive measures).Materials and methodsPatients hospitalized after moderate to severe TBI, were trained by observation for the finger opposition sequence (FOS) motor task. They were then tested for the observation-trained sequence (A) and a similar control sequence (B), at two different time-points (24 h post-training and 2 weeks later).Results revealed(i) a significant difference in performance between the trained (A) and untrained (B) sequences, in favor of the trained sequence. (ii) An increase in performance for both sequences A and B toward the second (retention) session. (iii) The advantage for sequence A was stable and preserved also in the second session. (iv) Participants with lower moderate Functional Independence Measure (FIM) scores gained more from observational-procedural learning, compared with patients with higher functional abilities.ConclusionOverall, these findings support the notion that TBI patients may achieve procedural memory consolidation and retention through observational learning. Moreover, different functional traits may predict the outcomes of observational training in different patients. These findings may have significant practical implications in the future, regarding skill acquisition methods in TBI patients. (shrink)

This review, based on analysis of the abstracts of 271 academic publications, critically examines the development of girlhood studies within a specific sociocultural context – Israeli society. By examining one particular context the authors hope to contribute to the discourse on the worldwide evolution of girlhood studies. The following research questions were posed: How did the body of literature on Israeli girls develop over time? What is the distribution of disciplines and topics represented? Who are the girls at the focus (...) of the writing? What are the methodological and paradigmatic approaches adopted? The findings point to the tentative development of a girlhood studies perspective that began in the 1980s and expanded over time, revealing the spread and reclaiming of feminist theoretical tenets as embodied in the study of girls. The review both sheds light on the pace and the manner in which Western feminist ideas spread to a specific local arena, and identifies unique local influences impacting this process. (shrink)

The number of family members caring and caregiving for a loved one undergoing physical and mental changes continues to increase dramatically. For many, this ongoing experience not only involves the “burden of caregiving” but also the “burden of grief” as their loved-one’s newfound medical condition can result in the loss of the person they previously knew. Dramatic cognitive, behavioral, and personality changes, often leave caregivers bereft of the significant relationship they shared with the affected person prior to the illness or (...) injury. This results in what we term conditions of acquired “non-death interpersonal loss”. Current approaches to these losses use an amalgam of models drawn from both death and non-death loss. Despite their utility, these frameworks have not adequately addressed the unique processes occurring in the interpersonal sphere where the grieving caregiver needs to reach some modus vivendi regarding the triad of “who the person was,” “who they are now,” and “who they will yet become.” In this paper we propose a process-based model which addresses cognitive-emotional-behavioral challenges caregivers meet in the face of their new reality. These require a revision of the interpersonal schemas and the relationships that takes into account the ongoing interactions with the affected family member. The model and its utility to identify adaptive and maladaptive responses to NoDIL is elaborated upon with clinical material obtained from caregivers of people diagnosed with major neuro-cognitive disorder and pediatric traumatic brain injury. This paper presents an in-depth analysis of the anatomy of both thermodynamics and statistical mechanics, together with the relationships between their constituent parts. Based on this analysis, using the renormalization group and finite-size scaling, we give a definition of a large but finite system and argue that phase transitions are represented correctly, as incipient singularities in such systems. We describe the role of the thermodynamic limit. And we explore the implications of this picture of critical phenomena for the questions of (...) reduction and emergence. (shrink)

This Article argues that when credit suppliers market and advertise their credit products, they utilize and enhance consumers’ cognitive biases, particularly their optimism bias and illusion of control. We apply the concept of manipulation to this practice. The biased and manipulated debtors attribute unrealistically low probability to negative life events, such as job loss, illness, accident or divorce, and high probability to positive life events. As a result of the manipulation, the biased debtors are triggered to borrow more than they (...) would have borrowed otherwise. This additional borrowing may contribute to the default of these debtors and to their eventual bankruptcy. Empirical studies of the causes of bankruptcy show that before their default, bankrupts have often experienced negative life events that decrease income, increase expenses, or both. The bias and its manipulation justify legal intervention. The Article discusses various justifications for legal intervention and offers tentative and partial prescriptions for intervention. It analyzes the comparative advantages and shortcomings of ex ante intervention, in the form of regulation of credit marketing practices and credit contracts, of tax and insurance, and ex post intervention, at the bankruptcy stage. Its main contribution is in bringing together bodies of literature on cognitive biases, consumer decision making, lifecycle, social influence, advertising and marketing, behavioral law and economics, economic analysis of bankruptcy and socio-legal studies of bankruptcy. By combining these bodies of literature, the Article provides a new perspective on bankruptcy and credit and offers a promising framework for future work. (shrink)

Jackendoff's position with respect to categories is unclear. Positing categories is implausible in several respects; it makes the binding problem in language seem more massive than it actually is; and it makes it difficult to explain language acquisition. Waiting for connectionism to fulfill its promise, a different track is sketched which is residually symbolic, exemplarist, and analogy-based.

During the course of the nineteenth century, a dramatic change took place in the way Americans die. The deathbed, formerly governed predominantly by religious tradition, gradually was being shaped by medical ethics and state law. By the end of the nineteenth century, not only had the physician replaced the priest as master of ceremonies at the deathbed, but the state, in the form of positive law, had begun to express an interest in regulating the treatment of the dying patient. This (...) interest first emerged in the context of the late nineteenth-century public debate over the legitimacy of medical euthanasia, an issue passionately disputed to this day in America and other Western societies. The history of the deathbed in nineteenth-century America suggests that the intervention of the state in the regulation of dying is a relatively new phenomenon. This paper examines this history, thereby enabling us to explore a world in which the legal regulation of dying was still unthinkable and inviting us to contemplate the historical significance of this development. The paper traces the changes that occurred during the nineteenth century in deathbed ethics, concluding with proposals for regulating dying legally through euthanasia. It focuses on the most significant moments in the history of the nineteenth-century deathbed, outlining a three-stage transformation in deathbed ethics--from the realm of religion, to the jurisdiction of medical ethics, to positive law regulation--a movement that reflects a change not only in specific rules of deathbed conduct, but also a more decisive alteration of the entire normative system governing the deathbed and the entire experience of dying. The insight to the modus operandi of regulatory law that emerges in the paper can lead to a deeper understanding of the conditions of its possibility. Regulation is only possible if the phenomenon to be regulated undergoes a transformation through which it severs its connections with anything that cannot be regulated. Thus, the paper shows how a radical transformation in the way people die was necessary for regulation by state law to emerge. (shrink)

A través del personaje del sabio hebreo - su posible portavoz- Bodin recupera la visión del alejandrino de la sabiduría como develadora de armonía universal, la exégesis alegórica como “filosofar con símbolos” y el papel de la Ley, que en ambos autores articula lo divino (...) y lo humano. Proponemos que esta adopción se basa en la afinidad de intención política entre el sincretismo filoniano y el irenismo humanista. (shrink)

We show that both positive and negative absolute temperatures and monotonically increasing and decreasing entropy in adiabatic processes are consistent with Carathéodory's version of the second law and we explore the modifications of the Kelvin–Planck and Clausius versions which are needed to accommodate these possibilities. We show, in part by using the equivalence of distributions and the canonical distribution, that the correct microcanonical entropy, is the surface (Boltzmann) form rather than the bulk (Gibbs) form thereby providing for the possibility of (...) negative temperatures and we counter the contention on the part of a number of authors that the surface entropy fails to satisfy fundamental thermodynamic relationships. Purpose Children are becoming heavy users of communication and information technologies from an early age. These technologies carry risks to which children may be exposed. In collaboration with the Israel Ministry of Education, the authors launched a week-long safe online awareness program for school children in 257 elementary and middle schools in Israel. Each class independently composed a safe and ethical code of online behavior following two classroom debate sessions. The purpose of this study was to analyze these codes and (...) learn how school children perceive and understand the proper use of the network using thematic analysis. Design/methodology/approach A total of 8,181 students between the ages of 8 and 14 years in 303 classes from 257 schools participated in the program. These classes composed 303 ethical codes, which were decomposed into 2,201 elements. Using mixed-methods research combining quantitative and qualitative methodologies, the elements of the ethical codes were analyzed, interpreted, and classified to identify the dominant themes and discourses used by the students when addressing issues related to safe online use. Findings Findings indicate that Israeli students are aware of the dangers and risks of the internet, and these concerns are reflected in their own ethical codes. The students discouraged online self-exposure and encouraged precautions and wariness towards members of out-groups. The themes included sentences which asked for responsible, appropriate, and lawful use, expressed concern about privacy issues, and stated the need for adult involvement. Most of them reflected an “us against them ” perspective. Originality/value The current study presents an innovative “bottom-up” program based on wisdom of the crowd approach, that can be implemented in schools internationally in order to encourage reflexivity and teach children the necessary skills for safe online experiences. In addition, this study analyses the school children’s own views of the dangers of social media and learn about their perspective and understanding of internet use. (shrink)

Objective: Appropriate reactivity to emotional facial expressions, even if these are seen whilst we are engaged in another activity, is critical for successful social interaction. Children with conduct problems (CP) and high levels of callous-unemotional (CU) traits are characterized by blunted reactivity to other people's emotions, while children with CP and low levels of CU traits can over-react to perceived emotional threat. No study to date has compared children with CP and high vs. low levels of CU traits to typically (...) developing (TD) children or each other, using a task that assesses attentional capture by irrelevant emotional faces. -/- Method: All participants performed an attentional capture task in which they were asked to judge the orientation of a single male face that was displayed simultaneously with two female faces. Three types of trials were presented, trials with all neutral faces, trials with an emotional distractor face and trials with an emotional target face. Fifteen boys with CP and high levels of CU traits, 17 boys with CP and low levels of CU traits and 17 age and ability matched TD boys were included in the final study sample. -/- Results: Compared to TD children and children with low levels of CU traits, children with CP and high levels of CU traits showed reduced attentional capture by irrelevant emotional faces. -/- Conclusions: This study is the first to demonstrate a different pattern in emotional attentional capture in children with CP depending on their level of CU traits. Recent work asked if visual cues facilitate word segmentation in adults and infants. While adults showed better word segmentation when presented with a regular visual cue, infants did not. This difference was attributed to infants' lack of understanding that objects have labels. Alternatively, infants’ performance could reflect their difficulty with tracking and integrating multiple multimodal cues. We contrasted these two accounts by looking at the effect of visual cues on word segmentation in adults and across childhood. We found that older (...) children benefitted from the regular visual cues, but younger children, who already knew that objects have labels, did not. Knowing that objects have labels was not enough to use visual cues as an aid for segmentation. These findings show that the ability to integrate multimodal cues develops during childhood, and it is not yet adult-like in children. (shrink)
