According to the fox koan, the second case in the Wu-men kuan koan collection, Zen master Pai-chang encounters a fox who claims to be a former abbot punished through endless reincarnations for denying the efficacy of karmic causality. In the end he is liberated by Pai-chang's turning word, which asserts the inexorability of cause-and-effect. Most traditional interpretations of the koan focus on the philosophical issue of causality in relation to earlier Buddhist doctrines, such as dependent origination and emptiness. Dogen, the (...) founder of the Japanese Soto school, devoted two fascicles of the Shobogenzo exclusively to the fox koan. One fascicle supports a paradoxical view of causality and non-causality, the two being "two sides of the same coin"; the second strongly attacks this interpretation and defends a literal reading that asserts causality and denies non-causality. Dogen's apparent change of heart on this topic has inspired scholars of the recent Critical Buddhist methodology to evaluate the merits and weaknesses in Zen's attitude toward ethical issues and social affairs. Shifting Shape, Shaping Text examines the fox koan in relation to philosophical and institutional issues facing the Ch'an/Zen tradition in both Sung China and medieval and contemporary Japan. Steven Heine integrates his own philological analysis of the koan, textual analysis of koan collections and related literary genres in T'ang and Sung China, folklore studies, recent discourse theory, Dogen studies, and research on monastic codes and institutional history to craft an original and compelling work. More specifically, he illuminates a fascinating dimension of the entire Ch'an/Zen tradition as he carefully lays out the philosophical issues in the koan concerning causality/karma and enlightenment, the ethical issues contained therein, the bearing that certain interpretations of causality had on the creation of monastic codes and institutional security in China, the relation between Zen and folk religion as revealed by the koan, and the issue of possible antinomianism in Zen, especially as grappled with by later thinkers such as Dogen and contemporary representatives of Critical Buddhism. Finally he applies theories of "high" and "low" religion and contemporary discourse and in the process rethinks the theories and their applicability across cultures. Far-reaching yet rigorous, Shifting Shape, Shaping Text will not only attract the interest of Ch'an/Zen specialists, but also those studying folklore, popular religion, and issues concerning the nature of discourse and the relation between "high" and "low" religions. An impressionistic and idealistic paper from the author’s youth suggesting how his _de-projective approach to phenomenology_ could lead to an actual, lived, worldview.

The goal of “Inclusive Economics” is to tie together various authoritative strands of contemporary economic theory into an easily comprehensible whole that illuminates the need for a broader approach to contemporary economic policymaking undistorted by obsolete 18th century rationalist assumptions about utility, ethics, worthiness and traditional culture. This is accomplished by elaborating the rationalist competitive ideal along the optimizing lines pioneered by Paul Samuelson (neoclassical economics); plumbing modifications necessitated by Herbert Simon's realist concepts of “bounded rationality” and “satisficing”; refined further (...) by applying a pragmatist outlook to probe the consequences of relaxing Enlightenment teleological, ethical, spiritual and cultural taboos. The exercise will explain why competitive market economies guided by rational utility-seeking invariably are less productive, efficient, just and beneficent than most theorists concede, and will illuminate the full range of interventions needed to achieve better outcomes. Two distinct problems of objectivity in moral theory are that of reference and truth and that of justification. These questions are often run together. However, it is possible to discuss the two questions separately. A defense is offered of moral ascriptions and moral properties, in opposition to the proposals of Mackie and Harman. But the thin or minimal defense of moral ascriptions leaves the second problem of objectivity unaddressed. Further argumentation leads to a proposal that claims limited moral objectivity.

Conrad’s Lord Jim presents not only a paradigmatic case of weakness of will, but an equally paradigmatic case of the enormous difficulties that attend fitting weakness of will into our other moral attitudes, particularly those relating to moral worth and moral shame. Conrad’s general conception of character and morality is deeply Aristotelian in many respects, somewhat Kantian in others. The essay traces out the intuitive strengths and philosophical difficulties that both an Aristotelian and a Kantian conception will have before the (...) problem of weakness of will, and argues that the ambiguity in Conrad’s treatment of Jim’s case is the reflection of the clash between these two equally compelling, incompatible conceptions of the self and moral worth. "Literature and the Right to Marriage," which bears the same title as the special issue that it introduces, takes up the challenge of the claim that marriage is a universal right. Framing the questions that traverse the five essays in the collection with a close reading of the sections on marriage from Hegel's Elements of the Philosophy of Right, the authors argue that if marriage can be considered a right, this right both guarantees access to and is founded upon each (...) partner's vow to abide by his or her vows to the other. Hegel's text is important because it underscores the linguistic dimension of the marriage ceremony; and it thus helps to show that, if the right to marriage were universal, it must be understood as the right to an irreplaceable kind of ritual speech. Moreover, this text is remarkably modern in its emphasis upon love as the condition of rightful marriage. Hegel considered the exchange of marriage vows to be a political event at which love becomes ethical , and ethics becomes political ; and thus also the point at which the model for "ethical love" becomes the verbally solemnized love between a man and a woman rather than the priestly love of the neighbor. Marriage, for Hegel, is always a turning point, both in the lives of the couple and in the history of the state. But this means that the importance of any marriage cannot be measured in terms of a norm; it can only be measured in terms of the amorous situation that precedes the event of marriage. Hegel's analyses are indispensable for grasping the stakes of the essays collected in this special issue and for addressing contemporary questions about which couples have the right to marry and what marriage becomes when those who would marry already have shared long and complex lives together. The movement to assess teacher competency is becoming a central concern for professional educators, state departments of education, and the public. The major underlying assumption of this concern is that primary and secondary school-aged children are falling far behind in basic skills as compared with their counterparts in other countries. A further concern is that, within this country, variability in teacher competency may exacerbate differences among children of various socioeconomic, racial and ethnic backgrounds and thus perpetuate long-term educational and economic (...) inequalities. To support these assumptions, critics of teacher preparation institutions cite declining SAT and ACT test scores of those entering teacher training, and also this constitutes sufficient grounds for assuming that becoming a teacher is less intellectually demanding than preparing for other fields. Roth's analysis of the Rationalitätstreit (i.e., the debate(s) about rationality) stands as one of the major works on how the debate affects a wide range of issues in the philosophy of science and the social sciences. His principal thesis is that the debate may be seen as a series of Quine-type "translation manuals," exhibiting characteristics of paradigms (following Kuhn 1970) that can be treated as testable scientific theories by adequate empirical tests. The author argues that Roth's notion of empirically testing (...) translation manuals is not possible given his criteria. He suggests a clearer definition of "methods" and develops a case whereby translation manuals can be adequately tested within an inductive model-but with rather severe restrictions. The Treasury of the True Dharma Eye (Shōbōgenzō) is the masterwork of Dōgen (1200–1253), founder of the Sōtō Zen Buddhist sect in Kamakura-era Japan. Social order is regulated from above by the law but its foundation is built on norms and customs, informal social practices that enable people to make meaningful and productive uses of their time and resources. Despite the importance of these practices in keeping the social fabric together, very little of the jurisprudential literature has focused on a discussion of these norms and customs. In Social Norms in a Wired World Steven Hetcher argues that the traditional conception of norms as (...) rule-like linguistic entities is erroneous. Instead, norms must be understood as patterns of rationally governed behaviour maintained in groups by acts of conformity. Using informal game theory in the analysis of norms and customs, Hetcher applies his theory of norms to tort law and Internet privacy laws. John Polkinghorne, formerly a physicist and now an Anglican priest and theologian, has made a significant contribution to the current dialogue between Christian theology and the natural sciences. I examine here his reflection on what is commonly called the problem of special divine action in the world. Polkinghorne argues that God acts in the world via a “topdown” or “downward” mode of causation that exploits the indeterministic openness of chaotic systems without requiring that God violate natural laws. In response, I (...) argue: (1) that divine intervention in response to human sin is theologically, as well as scientifically unobjectionable; and (2) that the belief that God is the transcendent creator of the world renders the “causal joint” between God and the world metaphysical in nature, thus obviating the need to uncover a physical feature of the world that God exploits in order to act in the world. A recent effort has been made to better characterize the genetic architecture of schizophrenia, and apply a precision medicine model to its treatment. In pursuing this approach, it is likely that ethical concerns regarding cost-benefit uncertainties, the duty to inform and confidentiality will arise. Due to the complexity of schizophrenia’s genetic profile, research efforts must be weighed against the risk to human subjects and the required consumption of valuable healthcare resources. Genetic risk profiles must be judged in conjunction with actionability (...) and must be fully explained to patients and others potentially affected. However, confidentiality should be of paramount importance due to the presence of a risk-state phenotype, meaning the associated presence of clinically detectable neurocognitive deficiencies in those with elevated schizophrenia risk profiles.
