In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential (...) ethics, the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The volume stands alone in its efforts to systematically "diagnose" the moral reasoning lodged within prevailing judicial opinions that sustain captivity and risk management practices impacting: (1) the rights of juveniles found competent to stand criminal trial, the mentally ill placed in long-term disciplinary isolation, and sex offenders subjected to civil detention and community re-entry monitoring; (2) the often unmet needs of victims; and (3) the demands of an ordered society. Carefully balancing sophisticated insights with concrete and cutting-edge applications, the book concludes with a series of provocative, yet practical, recommendations for future research and meaningful reform within institutional practice, programming, and policy. Generative AI technologies have the potential to be socially and politically transformative. In this paper, we focus on exploring the potential impacts that Generative AI could have on the functioning of our democracies and the nature of citizenship. We do so by drawing on accounts of deliberative democracy and the deliberative virtues associated with it, as well as the reciprocal impacts that social media and Generative AI will have on each other and the broader information landscape. Drawing on this (...) background theory, we outline some of the key positive and negative impacts that Generative AI is likely to have on democratic citizenship. As the distance between science and society is collapsed with the growth of contemporary knowledge societies, so a range of different approaches to the democratic governance of science superseding its Enlightenment government is emerging. In light of these different approaches, this article focuses on the figure of the scientific citizen and the variable dimensions of a new scientific citizenship. Three models of democracy - advanced consumer, deliberative and radical/pluralist - are put forward as both partly competing and partly complementary (...) frameworks within which the new rights and responsibilities of the scientific citizen can be articulated and discussed. In each case the theory and practice of scientific citizenship are viewed against the background of contemporary developments within the field of science communication; the rise of the public understanding of science movement; the new enthusiasm for advancing public engagements with science, and the legitimate place of different forms of public protest and dissent within new designs for democratic governance. We studied the impact of teachers’ ethical leadership on students’ moral identity and academic citizenship behaviors. Data from 256 student–teacher matching dyads were collected from one of the top 5 Pakistani business schools. Confirmatory factor analysis was used to ensure factorial validity of the measures that were employed, and the hypothesized relationships were tested using structural regression models that utilized structural equation modeling in AMOS with 5,000 bootstrap samples. Based on social learning theory, the results supported the hypothesis that (...) teachers’ ethical leadership had significant direct and indirect positive effects on the students’ academic citizenship behaviors that were directed toward other students and the school. This study contributes to existing literature on ethical leadership and organizational citizenship behavior by highlighting useful implications of these organization-based constructs in an academic context. We live in the Digital Era, where national frontiers are vanishing. In light of cultural globalization and digital identity, a contemporary re-interpretation of classical notions like citizenship is imperative. What does it mean to be a citizen in the Digital Era? To whom can we assign digital citizenship status? In order to discuss these questions we introduce the notion of hybrid beings. Our hypothesis is that the dynamical feedback relation between the physical and digital individual’s experience promotes the (...) embodiment of a hybrid identity from which the hybrid being emerges. It is important to stress that the hybrid identities of hybrid beings are not just alter egos or avatars created in the digital world, but that they express a new dynamic around the impossibility of distinguishing between “physical” and “digital” sides of an individuals’ actions. It is precisely because of a hybrid being’s participation in a merged physical/digital world that we believe the notion of hybrid beings is the most suitable paradigm to exemplify the role of the digital citizen and digital citizenship. Today the halls of Technology, Entertainment, and Design and Davos reverberate with optimism that hacking, brainstorming, and crowdsourcing can transform citizenship, development, and education alike. This article examines these claims ethnographically and historically with an eye toward the kinds of social orders such practices produce. This article focuses on a hackathon, one emblematic site of social practice where techniques from information technology production become ways of remaking culture. Hackathons sometimes produce technologies, and they always, however, produce subjects. This article (...) argues that the hackathon rehearses an entrepreneurial citizenship celebrated in transnational cultures that orient toward Silicon Valley for models of social change. Such optimistic, high-velocity practice aligns, in India, with middle-class politics that favor quick and forceful action with socially similar collaborators over the contestations of mass democracy or the slow construction of coalition across difference. In the Groundwork, we find three distinct conceptions of freedom: (i) A negative conception of freedom, understood as a capacity for spontaneous action independent of alien causes; (ii) a positive conception of freedom, understood as the capacity of giving law to oneself; and (iii) a second positive conception, understood as the capacity to give laws that bind others as well as oneself. The dominant interpretation of Kant ignores this third conception of freedom and interprets the second conception as a capacity (...) for self-determination or self-governance, which is seen as the most basic and important Kantian conception of autonomy. In this paper, we will focus mainly on explaining the distinction between the second and third conceptions of autonomy and will defend the claim that the third conception is morally the most basic. We will also explain briefly why Kant thinks that having the capacity for citizenship is necessary for having the capacity for self-governance. (shrink)

This article explores the tensions between different conceptions of “citizenship.” On the one hand, we point out the virtues and limitations of cosmopolitan citizenship in the terms in which Seyla Benhabib understands it in The Right of Others…; on the other hand, we delve into another notion of citizenship, namely, the localist, in a version that could be at odds with some cosmopolitan values, that is, localism as understood by some Mexican autonomous communities, particularly the Zapatistas. Although (...) Benhabib’s cosmopolitan federalism is inclusive in spirit, it is conceived within a preponderantly global perspective and ends up being asymmetrical. While her proposal has some positive aspects, it faces some difficulties in the case of Mexican autonomous communities. In this article, we shall introduce the notion of democratic confederalism as a form of sociopolitical organization that seeks to strengthen the self-organization of social actors and to recognize the practice of citizenship in the terms in which autonomous communities exercise it. We propose that democratic confederalism could be an alternative for decreasing tensions between global citizenship and the idea of citizenship within autonomous communities. (shrink)

I seek to advance enquiry into the point of a public higher education institution by drawing on ideals salient in the sub-Saharan African philosophical tradition. There are relational, and specifically communal, values prominently held by African thinkers that I use to ground a promising rival to the dominant contemporary Western, and especially Anglo-American, accounts of what a university ultimately ought to strive to achieve, which focus mainly on autonomy, truth, and citizenship. My aims are not merely comparative, contrasting an (...) Afro-communal approach with other ones that have been more globally influential, but also substantive. Although the theory of a university’s point that I articulate and defend has an African pedigree, I work to show that it should be taken seriously by a global audience, for plausibly capturing a variety of intuitions and claims that are widely shared. In this book Paul Dragos Aligica revisits the theory of political self-governance in the context of recent developments in behavioral economics and political philosophy that have challenged the foundations of this theory. Building on the work of the 'Bloomington School' created by Nobel Laureate Elinor Ostrom and Public Choice political economy co-founder Vincent Ostrom, Aligica presents a fresh conceptualization of the key processes at the core of democratic-liberal governance systems involving civic competence and public entrepreneurship. The result is not only (...) a re-assessment and re-articulation of the theories constructed by the Bloomington School of Public Choice, but also a new approach to several cutting-edge discussions relevant to governance studies and applied institutional theory, such as the debates generated by the recent waves of populism, paternalism and authoritarianism. Many of the problems that would be faced in setting up transnational institutions mirror problems that have already been addressed by appropriate institutional mechanisms in the establishment of the modern nation-state.

The concept ‘hereditary breast cancer’ is commonly used to delineate a group of people genetically at risk for breast cancer—all of whom also having risk for other cancers. People carrying pathogenic variants of the BRCA1 and BRCA2 genes are often referred to as those having predisposition for ‘hereditary breast cancer’. The two genes, however, are when altered, associated with different risks for and dying from breast cancer. The main risk for dying for carriers of both genes is from ovarian cancer. (...) These biological facts are of philosophical interest, because they are the facts underlying the public debate on BRCA1/2 genetic testing as a model for the discussion of how to implement genetic knowledge and technologies in personalized medicine. A contribution to this public debate describing inherited breast cancer as ‘biological citizenship’ recently printed in Med Health Care and Philos illustrated how fragmented and detached from the biological and socio-political facts this debate sometimes is. We here briefly summarize some of the biological facts and how they are implemented in today’s healthcare based on agreed philosophical, ethical and moral principles. The suggestion of a ‘biological citizenship’ defined by hereditary breast cancer is incorrect and ill-advised. ‘Identity politics’ focusing hereditary breast cancer patients as a group based on a bundle of ill-defined negative arguments is well known, but is supported neither by scientific nor philosophical arguments. To those born with the genetic variants described, the philosophical rule of not doing harm is violated by unbalanced negative arguments. (shrink)

In response to the concern that ethnically diverse immigrants are not being sufficiently integrated into receiving liberal democratic societies, liberal nationalists have offered two specific naturalization policy proposals. The first would require naturalizing immigrants to assimilate the national culture of the receiving society; the second would encourage newcomers to adopt the prevailing civic national identity. This paper rejects these proposals. In contrast to liberal nationalists, I deny that good citizenship presupposes a common culture or civic national identity and I (...) develop a non-nationalist naturalization model that would encourage immigrants to become integrated into liberal democratic societies by participating in their major socio-economic and political institutions and practices. When business organisations become involved in contributing to and resolving social issues, they enter areas traditionally seen as the purview of governments. In doing so, they begin to take on the expectations and responsibilities of government; they become politicised. This politicisation is a product of business’s success and power and appears largely unavoidable. Adopting Matten & Crane’s (2005a) extended view of corporate citizenship, business organisations’ responsibilities extend to the administration of citizens’ social, civil and political rights. We term these (...) areas where business organisations take over the administration of citizenship rights as the social governance gap. Drawing upon the agenda of Margolis and Walsh (2003), we seek to enhance the understanding of how business navigates its responsibilities within the social governance gap, including its function as a significant actor influencing societal development and wellbeing. We do this through an exploration of Rio Tinto’s involvement in the WA Future Fund. This paper forms part of an introductory scoping case study of the Rio Tinto WA Future fund and its function as one of Rio Tinto’s diverse responses to community development issues in Western Australia. This paper explores how women and non-binary Latinx Community Workers in Toronto, Canada, negotiate their identities, citizenship practices and politics in relation to settler colonialism and decolonization. We demonstrate how LCWs enact a Latinx decolonial politic of belonging, an alternative way of practicing citizenship that strives to simultaneously challenge both Canadian and Latin American settler colonialism. This can be seen when LCWs refuse to be recognized on white settler terms as “proud Canadians,” and create community-based learning initiatives that (...) incite conversations among everyday Latinx community members around Canada’s settler colonial history and present, Indigenous worldviews, as well as race and settler colonialism in Latin America. We consider how LCWs’ enactments of a Latinx decolonial politic of belonging serve as small, incomplete, but crucial steps towards decolonization. (shrink)

In this paper, we attempt to refine the concept of corporate citizenship. Traditionally, research on corporate citizenship has paid greater attention to corporateduties, leaving corporate rights relatively unattended in the corporate citizenship literature. However, some scholars have recently explored corporate citizenship as the corporation’s implementation of both of its respected rights and duties. Others have conceptualized the corporate citizenship concept with a specific focus on the corporation’s expansion of its new duties and rights. Integrating existing (...) conceptualizations of corporate citizenship, we propose a refined definition of corporate citizenship as a dynamic process by which corporations implement and expand their respective corporate rights and duties. PurposeAnomic feelings are predicted to play a moderating role in the relationship between organisational justice perceptions and the citizenship use of the organisation's internet access, or cybercivism. The purpose of this paper is to hypothesise that, just as AFs are supported in prior research as able to intensify the negative effects of organisational justice on cyberloafing, they will also intensify the positive effects of OJ on cybercivism.Design/methodology/approachData were collected from 270 of the 1,547 respondents at a public university.FindingsExcept in (...) the case of procedural justice, the results support that AF act as a moderator of the OJ‐cybercivism link because, among employees with comparatively less AF, the perceptions of the OJ under study had a stronger impact on cybercivism.Research limitations/implicationsTo generalise from a convenience sample of 17 per cent to the entire University is unfeasible, let alone the “public sector” as a whole for a whole culture/country. Therefore, the paper only aims to be an early exploration of actual phenomenon, and to provide new insights necessary to understand the impact of pervasive new media and information and communication technologies on individual behaviour in virtual work settings.Practical implicationsThe findings contribute to an improved understanding of the influence of OJ on cybercivism. As a moderator, anomia is supported in our sample as one of the key “controllers” of the OJ predictions on cybercivism and sets a new scenario in seeking electronic business effectiveness. By encouraging convincing values and equity in the workplace, organisational management seems be on the right path to create the proper context for cybercivism to occur.Originality/valueEmployee AFs are shown to be a moderator in the relationship between OJ and cybercivism. In this paper I will examine two issues concerning the nature of arguments, one having to do with the goal of argumentation and the criteria for a good or successful argument and the other having to do with the role of the informal fallacies in effective argument analysis.

This article uses the current ‘refugees/migrants crisis’ and Brexit as illustrative of the numerous challenges the European Union faces today when it comes to its identity and the construction of a ‘European citizenship’. By discussing the proliferation of borders on the European continent and by analysing the sociological significance of such proliferation, the article argues that Europe is experiencing an ontological and epistemological rather than an existential crisis that relates to its incapacity to acknowledge, and critically engage with, its (...) fundamental neo-colonial and neo-liberal matrix. The article argues that the stalemate experienced by the European Union with respect to its regional and global relevance can only be overcome by bringing to the surface buried or disqualified knowledges about ‘who counts as European’ beyond whiteness. Aiming to reduce the difficulty of managing and motivating knowledge workers, and promote the psychological well-being of them in Chinese hospitals, this study examines how k-workers’ leader–member exchange influences their task performance and the mediation effect of organizational citizenship behavior. Through a self-administered survey, valid questionnaires were collected from 384 k-workers in Chinese hospitals, and partial least squares structural equation modeling was employed for data analysis. The findings show that LMX is positively related to OCB and task performance, and (...) that OCB mediates the relationship between LMX and task performance. This research has theoretical implications and also provides practical suggestions on how to manage, motivate, and inspire k-workers, and promote the psychological well-being of them, and finally enhance the organizational performance in Chinese hospitals. Studies of the association between psychopathic traits and prosocial behavior are limited, with explanatory mechanisms of such dynamics being similarly scant within the empirical literature. Using a large sample of people in leadership roles, we explore the associations between the three facets of psychopathy (TriPM, Patrick CJ (2010) Operationalizing the triarchic conceptualization of psychopathy: preliminary description of brief scales for assessment of boldness, meanness, and disinhibition. Unpublished test manual, Florida State University, pp. 1110–1131), and organizational citizenship behavior (OCB, Smith (...) et al (1983) J Appl Psychol 68:653–663). We examine the mediating role of individualizing and binding moral foundations (MFQ, Graham et al. (2013) Adv Exp Soc Psychol 47:55–130) within these relationships. Correlation analysis revealed that boldness was positively correlated with OCB, while both meanness and disinhibition were negatively correlated with OCB. Mediation analysis demonstrated that only individualizing moral foundations (IMF) mediated the relationship between meanness and OCB, such that meanness led to lower IMF and reduced levels of OCB. Our findings signal that lower IMF enables the nefarious behavior of people with darker psychopathic traits, while moral foundations as a whole play no role in advancing the prosocial behavior of people with so-called adaptive psychopathic traits. This article examines the regulation of Latina youth sexualities in the context of sexual and reproductive health care provision. In-depth interviews with health care providers working in two Latino-serving community health centers are analyzed for how they interpret and respond to the sexual and reproductive practices of their low-income Latina teen patients. The author finds that providers emphasize teenage pregnancy as a social problem among this population to the exclusion of other dimensions of youth sexualities and encourage Latina girls’ adherence (...) to a life course trajectory that conforms to middle-class, heteronormative ideals as a solution to this problem. By relying on such understandings, providers construct meanings of sexual citizenship that require participation in bourgeois heteronormativity. These findings suggest that Latino-serving community health centers, their providers, and their teen patients could benefit from questioning the assumptions that inform providers’ appraisals of Latina youth and developing a more inclusive approach to Latina youth sexualities beyond a discourse of pregnancy prevention. Such efforts could allow community health centers to actively participate in disrupting the structural inequalities that shape their young patients’ lives. (shrink)

This book is an empirical study of global citizenship education in ten secondary schools in the United States and Asia. Proponents seek to equip students with the consciousness and competencies necessary to make a world of universal benevolence, peace, and prosperity. However, many of the moral assumptions of global citizenship education are more complex and contradict these goals, and are just as likely to have the unintended consequence of reinforcing a more particular Western individualism.
