Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. Superficially, citizenship appears relatively simple: a legal status denoting political membership. However, critical citizenship studies scholars suggest that citizenship is first and foremost a political practice. When non-citizens, such as irregularised migrants, constitute themselves as citizens through their actions, irrespective of legal status, these practices of citizenship have transformational potential because they are extra-legal. Yet, there is an ambivalence here: rights-claiming migrants tend to frame their key demands within the terms of the law often by calling for the regularisation of (...) their status. This article addresses this ambivalence by adopting a ‘deconstructive method’ to investigate the legal dimensions of citizenship as sites of theoretical and political intervention. It is argued that practices of rights-claiming by irregularised migrants are important to grasp because they mobilise the paradoxes inherent to the fact that universal rights are enshrined in the constitutional texts of modern citizenship in order to generate new legal meanings and horizons of justice. This hypothesis is explored through a series of illustrative examples of rights-claiming taking place within and beyond the formal confines of legal orders. In so doing, the article sets out a novel conceptual framework for analysing how migrants’ claims to justice strategically negotiate citizenship in its legal form. (shrink)

In a range of contexts, individuals arrive at collective decisions by sharing confidence in their judgements. This tendency to evaluate the reliability of information by the confidence with which it is expressed has been termed the ‘confidence heuristic’. We tested two ways of implementing the confidence heuristic in the context of a collective perceptual decision-making task: either directly, by opting for the judgement made with higher confidence, or indirectly, by opting for the faster judgement, exploiting an inverse correlation between confidence (...) and reaction time. We found that the success of these heuristics depends on how similar individuals are in terms of the reliability of their judgements and, more importantly, that for dissimilar individuals such heuristics are dramatically inferior to interaction. Interaction allows individuals to alleviate, but not fully resolve, differences in the reliability of their judgements. We discuss the implications of these findings for models of confidence and collective decision-making. (shrink)

Metacognitions, which are beliefs about our own thinking processes, can modulate worry and rumination and thereby influence emotional distress. This study aimed to develop a self-report measure of unhelpful pain-related metacognitions which might serve as a clinical and research tool to better understand pain catastrophizing, a significant risk factor for adverse pain outcomes. Two phases of validation are presented. Phase 1 reports on how the Pain Metacognitions Questionnaire (PMQ) was empirically developed through a qualitative study of 20 people with chronic (...) back ( n = 15) or knee ( n = 5) pain in secondary or tertiary care and then validated in a large internet sample of people experiencing pain ( N = 864). Rasch analysis yielded a 21-item scale with two dimensions (positive and negative metacognition) assessing how useful and problematic people believe rumination about pain to be, respectively. In Phase 2, further validation using a new sample ( N = 510) replicated initial findings. Both PMQ subscales have good retest reliability ( r = 0.76, r = 0.72) and internal consistency (0.86, 0.87). They correlate negatively with mindfulness and positively with pain intensity, disability, anxiety, depression, catastrophizing, rumination, and metacognition. The PMQ also predicts unique variance in catastrophizing when other variables are controlled and predicts ‘patient’ status for pain catastrophizing. Sensitivity analysis yielded preliminary suggestions for clinically meaningful cut-offs. Unhelpful pain metacognitions can be validly and reliably measured using a self-report instrument. Future studies using the PMQ might shed new light on pain-related thinking processes to develop better interventions for people prone to worry and rumination about their pain. (shrink)

ABSTRACTGrounded in Emotional Cascade Theory, we explored whether rumination and multisensory imagery-based cognitions moderated the relationships between affect and both odds of non-suicidal self-injury, and frequency of the behaviour. A sample of 393 university students completed self-report questionnaires assessing the constructs of interest. Contrary to expectations, rumination did not emerge as a significant moderator of the affect-NSSI relationship. However, the relationship between affect and frequency of NSSI was moderated by the use of imagery. Further, the relationship between negative affect and (...) NSSI was moderated by positive affect, underscoring the need to consider both negative and positive affect in models of NSSI. Most youth who self-injured reported thinking in images while the urge to self-injure was strong, with 53% thinking in images at least half the time. This article examines the arguments used by Robert Watts, a contemporary of John Stuart Mill, in his criticism of Mill's Utilitarianism. The pamphlet in which Watts expresses his views is a scarce and neglected work. Pioneering studies by J.C. Rees and J.B. Schneewind emphasize the importance of Mill's early critics for historians of nineteenth-century ethics and politial thought. Rees, however, confines his study to the responses to Mill's On Liberty. Schneewind's work is more comprehensive and does mention Watts, (...) but without examining in detail the actual arguments that Watts uses. Further, while Watts criticizes Mill's ethical views from a theological standpoint the arguments he uses are philosophical in character. Watts should not be thought of as a major philosophical critic of Mill, but his relative neglect leaves a gap in the study of the reception of Mill's thought which this article is intended to fill. In lieu of an abstract, here is a brief excerpt of the content:Toward the Materiality of Aesthetic ExperiencePeter de Bolla (bio)Over the last twenty years or so it has become a commonplace in discussions of "aesthetics" or of "art" in the most general sense to note that the term "aesthetics" was only very recently invented by Alexander Baumgarten in 1735, where it appears in his Meditationes philosophicae de nonnullis ad poema pertinentibus [see Menke 40; Dickie; Eagleton]. But the force of (...) this observation in regard to the relative youth of the concept is rarely, if ever, commented upon. As many philosophers and critics have pointed out, Baumgarten's use of the term was not primarily angled at what today might be unproblematically called "artworks"—say, paintings in the European grand master tradition—since his new kind of investigation was to be a "science of sensual recognition," that is, a general inquiry into how we come to know the world from the evidence of our senses. But, as is also frequently remarked, early on in the tradition of speculation now associated with "aesthetics as the study of art" the mutual attraction (to put it in the most anodyne terms) of "art" and "aesthetics" seems to have been extremely strong. As Jonathan Ree remarks, "the real begetter of the philosophical doctrine connecting the arts with the empirical senses—what we might call the aesthetic theory of the arts—was Gotthold Ephraim Lessing" [58]. From this point on (for heuristic purposes it may be identified with the date of publication of Lessing's Laokoon in 1766), artworks, which heretofore had not required a specific branch of inquiry in order for them to make sense or be conceptually grounded as art, are almost universally assumed to require "aesthetic" contemplation or appreciation.1 It is curious, then, that before 1766 such a mode of experiencing artworks had not been felt to be lacking.One might understand this observation both historically and philosophically, and both approaches, it seems to me, are needed. In the case of the first, a number of material effects conspired across mid-eighteenth-century Europe to produce what was in essence the modern art market. These include the legal establishment of copyright, first in England in 1709 but only by the end of the century in France and Germany; the foundation of various institutions whose primary purpose was the promotion and establishment of the fine arts: academies of painting, sculpture, or letters either with or without royal patronage; the public exhibition of paintings (from 1737 in France and 1761 in England); the opening of royal collections to public view (during the second half of the century in London, Paris, Munich, Vienna and Rome); the development of public concerts of secular music (in small scale from the 1670s in England but only becoming fully integrated in fashionable social life by mid-century); the construction of purpose-built concert venues (the Gewandthaus in Leipzig, a former cloth merchant's hall, was remodeled in 1781 in order to accommodate a resident orchestra, in effect becoming the first dedicated concert hall in Europe); the foundation of literary periodicals and review media; the emergence of social spaces and rituals encompassing polite discussion of [End Page 19] literature (coffeehouses, the construction of dedicated library rooms in domestic settings); and the promotion of architecture to a fine art through various societies, competitions, and the public display of architectural drawings in exhibition contexts (the Royal Academy yearly show included both drawings and models). We argue that a theory of phenomenal experience cannot discard subjective report and that Block's examples of phenomenal relate to two different types of perception. Recent discoveries in physics, cosmology and biochemistry have captured the public imagination and made the Design Argument - the theory that God created the world according to a specific plan - the object of renewed scientific and philosophical interest. Peter Carruthers's essays on consciousness and related issues have had a substantial impact on the field, and many of his best are now collected here in revised form. The first half of the volume is devoted to developing, elaborating, and defending against competitors one particular sort of reductive explanation of phenomenal consciousness, which Carruthers now refers to as 'dual-content theory'. Phenomenal consciousness - the feel of experience - is supposed to constitute the 'hard problem' for a scientific world view, (...) and many have claimed that it is an irredeemable mystery. But Carruthers here claims to have explained it. He argues that phenomenally conscious states are ones that possess both an 'analog' intentional content and a corresponding higher-order analog content, representing the first-order content of the experience. It is the higher-order analog content that enables our phenomenally conscious experiences to present themselves to us, and that constitutes their distinctive subjective aspect, or feel.The next two chapters explore some of the differences between conscious experience and conscious thought, and argue for the plausibility of some kind of eliminativism about conscious thinking. Then the final four chapters focus on the minds of non-human animals. Carruthers argues that even if the experiences of animals aren't phenomenally conscious, this needn't prevent the frustrations and sufferings of animals from being appropriate objects of sympathy and concern. Nor need it mean that there is any sort of radical 'Cartesian divide' between our minds and theirs of deep significance for comparative psychology. In the final chapter, he argues provocatively that even insects have minds that include a belief/desire/perception psychology much like our own. So mindedness and phenomenal consciousness couldn't be further apart.Carruthers's writing throughout is distinctively clear and direct. The emergence of experimental philosophy was one of the most significant developments in the early modern period. However, it is often overlooked in modern scholarship, despite being associated with leading figures such as Francis Bacon, Robert Boyle, Isaac Newton, Jean Le Rond d'Alembert, David Hume and Christian Wolff. Ranging from the early Royal Society of London in the seventeenth century to the uptake of experimental philosophy in Paris and Berlin in the eighteenth, this book provides new terms of reference for (...) understanding early modern philosophy and science, and its eventual eclipse in the shadow of post-Kantian notions of empiricism and rationalism. As two of the most important twentieth-century theatre directors, Bertolt Brecht and Vsevolod Meyerhold shared striking artistic, personal, and professional similarities. In addition to their middle-class background, both were the sons of merchants, well educated, politically persecuted, and exposed to the cultural innovations that spread throughout Germany and Russia during the 1920s and 1930s. Although Brecht's legacy is more salient, Meyerhold's artistic contributions can be traced to the work of numerous successors, including Brecht himself.

This article analyzes the socio-cultural theories of Adorno, Benjamin, and Brecht through the lens of the theatre, most especially as it pertains to the work of actors. It explores the forces of capitalism that determine how art is produced, distributed, and consumed. Following Adorno’s reading of Marx, actors are here posited as commodities whose labor is separated from the product they create for public consumption. This commodification raises various questions: How does a market economy shape the production and consumption of (...) art? What is technology’s function in the commodification of art? What is art’s sociopolitical role and how does it apply to theatre? To address these questions I juxtapose the cultural theory of Adorno and Benjamin with Brecht’s epic theatre. This comparison exposes the ritualistic potential of the theatre to bring an audience together as a community through sharing a socially enriching event. (shrink)

Adorno had such an affinity for Beckett that he dedicated his posthumously published work, Aesthetic Theory, to him. In 1961, he wrote a thoughtful—if dizzyingly complex—tribute to Beckett’s play, Endgame, a work that models many aspects of Adorno’s cultural criticism. My aim, accordingly, is to offer an Adornian reading of Beckett’s Waiting for Godot by drawing upon his critiques of music, aesthetics, and the culture industry. My goal is twofold: to offer a refreshing analysis of one of the most significant (...) dramatic achievements of the twentieth century, and, in doing so, to demonstrate Adorno’s relevance to contemporary cultural studies by deploying multiple elements of his oeuvre. In this remarkably clear and original study of the Tractatus Peter Carruthers has two principal aims. He seeks to make sense of Wittgenstein's metaphysical doctrines, showing how powerful arguments may be deployed in their support. He also aims to locate the crux of the conflict between Wittgenstein's early and late philosophies. This is shown to arise from his earlier commitment to the objectivity of logic and logical relations, which is the true target of attack of his later discussion of (...) rule-following. Within this general framework Dr Carruthers explores a number of themes, including the early Wittgenstein's doctrine of the priority of logic over metaphysics, the nature and purpose of his programme of analysis for ordinary language and the various possible arguments supporting the existence of Simples. He offers many original interpretations and defends them with considerable attention to textual detail, yet the book's clarity and directness will make it accessible to anyone acquainted with the Tractatus. Desire-based accounts of practical argument about incompatible ends seem limited either to advice about means or to coercive threats. This paper argues that this can be avoided if the parties to the dispute desire its resolution by means other than force more than they desire the satisfaction of any particular ends. In effect, this means they must argue as if in a position of equal power. This leads to an explanation of the apparent objectivity of moral claims and of why (...) moral reasons appear to be categorical and external. It also explains how notions such as reciprocal altruism and TIT-FOR-TAT can play a role in an evolutionary account of morality. The paper concludes with an argument to the effect that a desire-based metaethic must accept the is-ought gap and explains why there may appear to be no is-ought gap from within a given normative perspective.
